SettleADebt S_WI PASS-23
Motion-made, hearing-notice computation, electronic-service qualifications, and Mikrut date correction
Fresh access date: October 27, 2026, in both America/Los_Angeles and UTC. Exact individual source-opening times are unknown.
Disposition: The requested current integrated official bodies remain unavailable. One different official chapter-PDF route was attempted for each of chapters 802 and 801; both failed. No unchanged HTML route was retried.
This supplement adds limited primary support from official 2016 and 2021 rulemaking publications, but does not treat those instruments as a complete current amendment chain. The 2025 read-aids were narrowly rechecked and remain nonofficial. The Mikrut date is corrected from the precisely supplied coordinator observation, without a new opinion read.
P21’s substantive §806.07 grounds, original workflows, and calculations are not rerun.
1. What this pass establishes
1.1 The central current-primary gap is not closed
The following alternate published-format routes failed:
Neither failure establishes absence of law or invalidity of the previously reported text. It does mean that this pass cannot upgrade P21’s §802.01 or §801.15 conclusions to freshly verified current official statutory bodies. S_WI-P23-C001. (Invalid URL)
The narrow rechecks of the existing sources still display 2025:
Those bodies preserve the reported service-with-notice rule and computation structure. Their access on October 27, 2026 does not turn their edition into a verified October 2026 official consolidation. Justia Law+1
1.2 Limited primary electronic-filing support was obtained
Two official publications were read:
| Instrument |
What was actually established |
What remains unestablished |
| Court System’s Electronic filing rule, adopted April 28, 2016, effective July 1, 2016 |
Dated text governing submission, acceptance, electronic users, paper parties, and the late-transmission response provision |
Complete current text or later amendment chain |
| 2021 WI 37, Rule Order 20-07, filed April 23, 2021, effective July 1, 2021 |
Actual amendments to §801.18, including filing-time, acceptance/rejection, notice-of-activity, and service provisions |
Whether every relevant clause remained unchanged through October 2026 |
The 2021 order repealed former §801.18(4)(d) and (e), created paragraph (4)(am), and amended paragraph (4)(c). Thus the still-accessible 2016 PDF cannot be labeled the complete current rule. The 2021 order also expressly says its comments were not adopted as rules, although they may be consulted for guidance. C008–C011. Wisconsin Court System+3

2. Exact affected P21 claim replacements
These are replacement cells for the identified propositions—not replacements for the entire P21 claim register.
2.1 S_WI-P21-C031 — written motion, supporting papers, and formal requirements
| Field |
Replacement |
| Actor/predicate |
Person applying for an order through an ordinary noticed motion |
| Assertion |
Retain the 2025 read-aid’s §802.01(2)(a)–(d) structure: writing unless made during a hearing/trial; particular grounds and requested relief; a sufficiently complete written hearing notice can supply the writing; orders to show cause require statutory authorization. |
| Supporting papers |
Newly relied-on records accompany and are identified in the notice; previously filed/served materials are identified rather than automatically recopied. Additional hearing materials require a reasonable opportunity to respond when requested. |
| Other clauses |
Paragraph (c) addresses the order’s recitals and record basis. Paragraph (d) applies pleading-form/signature rules, requires the moving party and requested-relief description in the caption, and allows the stated affidavit-caption exception. |
| Source/status |
P21-S007, narrowly reread as a 2025 nonofficial read-aid. Current official paragraphs (a)–(d), incorporated formal requirements, and later amendments remain held. |

Direct read-aid: https://law.justia.com/codes/wisconsin/chapter-802/section-802-01/, §802.01(2)(a)–(d). Justia Law
2.2 S_WI-P21-C032 — when the noticed motion is “made”
| Field |
Replacement |
| Actor/predicate |
Movant whose motion requires notice under §801.15(4), when computing a statutory civil-procedure period |
| Assertion |
The narrowly rechecked 2025 text of §802.01(2)(e) deems that motion made when served with its notice of motion. |
| Consequence |
Filing, service, and the hearing are distinct events. Filing alone is not substituted for the specified service event; neither is the later hearing date. |
| Necessary qualifications |
The motion, notice, recipient, and method must actually satisfy the applicable rules. A draft, incomplete notice, or ineffective delivery is not assumed sufficient. |
| Source/status |
P21-S007 remains a read-aid. Current official-body confirmation is still pending. |

C003 |
Direct read-aid: https://law.justia.com/codes/wisconsin/chapter-802/section-802-01/, §802.01(2)(e). Justia Law
This does not certify what event satisfies a particular substantive §806.07 ground, its outer period, or an actual last permissible instant.
2.3 S_WI-P21-C035 — hearing notice and affidavits
| Field |
Replacement |
| Actor/predicate |
Party presenting a written motion that is not permitted to be heard ex parte |
| Reported rule retained |
The 2025 read-aid supplies a five-day pre-hearing service baseline, subject to a different statutory period or court order. An order changing that period may be made for cause on an ex parte motion. |
| Affidavits |
If the motion is supported by affidavit, serve it with the motion. Opposing affidavits may be served no later than one day before the hearing unless the court permits another time. This clause does not independently require an affidavit for every motion. |
| Limit |
A hearing-notice adjustment is not automatically authority to enlarge a separate substantive initiation period. |
| Source/status |
P21-S009, §801.15(4), freshly rechecked only as a 2025 read-aid; current primary body held. |

2.4 S_WI-P21-C036 — computation versus enlargement
| Field |
Replacement |
| Reported computation retained |
Exclude the triggering day; include the last day unless the clerk’s office is closed. For periods shorter than 11 days, exclude Saturdays, Sundays, and statutory holidays. |
| Holiday qualification |
The read-aid’s definition incorporates §§230.35(4)(a), 995.20, and a full Good Friday. Those linked holiday bodies and an actual local closure calendar were not freshly verified here. |
| Distinct enlargement rule |
Section 801.15(2)(c)’s reported prohibition on enlarging specified periods is separate from applying a built-in counting rule. An endpoint adjustment under the counting rule is not the same analytical act as granting extra time for cause or neglect. |
| Source/status |
P21-S009, §801.15(1), (2)(c), remains current-primary pending. No new §806.07 deadline is certified. |
| PASS-23 links |
C005–C006 |
2.5 S_WI-P21-C037 — response additions are not universal extensions
| Field |
Replacement |
| Actor/predicate |
Recipient entitled or required to act within a prescribed period after service of a notice or paper |
| Reported mail rule retained |
The read-aid adds three days when the triggering paper is served by mail. That condition does not itself add three days to a movant’s judgment-entry-based outer period. |
| Necessary separate branch |
The dated 2016 primary publication includes §801.15(5)(b)’s one-day addition for qualifying late fax/e-filing transmissions. The 2025 read-aid additionally lists email and cites 2019 Act 30 in its history. That amendment instrument and the complete current subsection were not read here. |
| Limit |
Neither branch validates an otherwise unauthorized service method. Do not automatically combine allowances or transfer them to an unrelated trigger. |
| Source/status |
P21-S009 plus P23-S003, with their separate edition limits. |
| PASS-23 link |
C007 |
The dated primary provision is at:
https://www.wicourts.gov/ecourts/efilecircuit/docs/eFilingrule.pdf, printed p.17 / zero-based index 16, “Cross-references,” §801.15(5)(b). Wisconsin Court System
2.6 S_WI-P21-C038 — electronic submission, acceptance, and recipients
| Field |
Replacement |
| New primary support |
The 2021 order actually creates §801.18(4)(am) and amends (4)(c), tying the recorded submission time to subsequent clerk acceptance and providing a notice of activity as proof. It also creates rejection-notification paragraph (4)(cm). |
| Service qualification |
The dated texts distinguish users in the particular case, paper parties, and documents requiring personal service. Written consent is material to substituting electronic service where personal service is required. |
| Effect |
A submission confirmation, acceptance, notice of activity, and effective service should not be treated as interchangeable facts without checking the applicable branch. |
| Currentness limit |
These are verified 2016/2021 instruments, not a complete 2026 consolidation. P21-S010’s 2025 reproduction retains its original nonofficial status. |

P21-C033 and C034 remain unchanged, including their prior source limits for recipient selection, ordinary service, and filing after service. No full service guide is added.
3. Why the three procedural dates must remain separate
The following is an analytical map of the retained text, not current-primary certification of a real deadline.
| Event |
Question it answers |
What it does not establish by itself |
| Filing |
Was the document accepted into the court file, and with what filing date? |
That every required recipient was served |
| Service with proper notice |
Did the qualifying noticed motion reach the legally prescribed “made” event? |
That its substantive ground was timely or sufficient |
| Hearing |
When will the court consider the motion, and was adequate lead time provided? |
That the motion was first “made” only on hearing day |
| Court changes hearing schedule |
What notice or submission schedule applies? |
Authority to enlarge every separate statutory outer limit |
| Built-in endpoint computation |
How does the rule count the prescribed period? |
Discretionary forgiveness of a missed period |
The rule’s legal conditions, the particular relief statute, and the actual proof must all be satisfied. C003–C007.
4. Mikrut metadata correction—dated coordinator reuse only
The supplied coordinator review at 2026-10-27T07:07:54.519882+00:00 reports that both the opinion header and filed stamp show June 16, 2004.

7. Eight fictional service, filing, and hearing postures
No example determines actual service validity, timeliness, or entitlement.
| # |
Fictional posture |
Conditional result and required proof |
Adverse branch / remaining fact |
| W1 |
Movant files a motion but serves nobody |
Under retained C032, filing alone does not establish the noticed motion’s “made” event |
Ex parte or other special route would require actual authority; service record absent |
| W2 |
Movant serves a complete motion and proper notice, then files the papers later |
Service can be the identified event while filing remains separately required |
Blank hearing information, wrong recipient, invalid method, or unreasonable filing delay can defeat the assumed compliance; C003 |
| W3 |
Motion relies on a previously unserved exhibit but does not include it; movant brings it to hearing |
Supporting-record rules and the opponent’s opportunity to meet additional proof must be addressed |
Previously filed/served material differs; no automatic exclusion or admission is decided; C002/C004 |
| W4 |
Hearing is set after a short notice interval containing a holiday |
Determine the controlling period, applicable holiday definition, exclusions, and any court order before counting |
No exact date is supplied because the current-primary and actual-calendar predicates remain missing; C005/C012 |
| W5 |
A notice sent by mail starts the recipient’s response period; sender also faces an entry-based outer period |
Keep the two triggers separate. A recipient allowance does not itself enlarge the sender’s entry-based period |
Actual method, governing statute, and court order may differ; C006–C007 |
| W6 |
Electronic motion and notice are submitted and later accepted; opponent is an opted-in user |
Apply the dated acceptance/activity-notice branch only if it remains operative and its conditions fit |
Submission confirmation alone, rejection, or a personal-service requirement changes the analysis; C009–C010 |
| W7 |
Filer uploads papers, but opponent is a paper party |
Upload is not assumed to complete that recipient’s service |
Traditional service or a legally effective consent branch must be established; C010 |
| W8 |
Court changes the hearing-notice schedule; movant assumes every outer period also changed |
A notice-scheduling order is not automatically enlargement authority for a separate barred period |
Read the actual order and governing statute; no §806.07 conclusion added; C004/C006 |
Fictional workflows: 8.
Two symbolic computation models
Because the requested current official computation bodies were not obtained, these are deliberately symbolic, not new calendar deadlines.
Model A — qualifying noticed motion and hearing lead
Let:
- S = completed valid service of the motion with proper notice;
- F = filing event;
- H = hearing;
- N = applicable notice period after statutory/court overrides;
- R = the applicable counting rule and verified closure/holiday calendar.
Then:
Made-event = S, only if the retained §802.01(2)(e) predicate applies.
Separately:
Required hearing lead = Count_R(S, H) ≥ N.
Neither F = S nor H = S is presumed. The current official text, valid notice/service, and calendar remain necessary. C003–C005/C012.
Model B — response-after-service versus entry-based initiation
Let:
- E = the substantive entry/event trigger;
- P = its prescribed outer period;
- S = service starting a recipient response period;
- Q = that response period;
- A = a legally applicable service-method allowance;
- R = verified computation rules.
Then:
Recipient response endpoint = Compute_R(S, Q, A).
But:
Entry-based initiation endpoint = Compute_R(E, P),
not automatically Compute_R(E, P, A).
The allowance’s existence, stacking, counting, and service validity are not inferred. C006–C007/C012.
Symbolic models: 2. P21’s four original models are neither recalculated nor upgraded by these examples.

P21’s supplied 48 claims, 98 coverage rows, 16 workflows, and four models remain historical totals. They were not rerendered, recounted as fresh law, or substantively rewritten.
The remaining result is precise: the current-primary motion-made and notice-computation gap remains open; dated electronic-rule support has been added; Mikrut’s date has been corrected. The additional materials do not establish a current §806.07 deadline or an actual filing outcome.
No actual party, docket, account, provider, borrower, creditor, service return, or electronic-filing record was queried. No filing, contact, form submission, account action, local coordinator-file write, or publication occurred. This is not independent review or component/parent acceptance.
