Wisconsin ordinary civil money-judgment personal-property execution, levy, and sheriff-sale gateway
Actual fresh source-access date: October 26, 2026, America/Los_Angeles; October 27, 2026 UTC.
Historical baseline: October 22, 2026 Pacific.
Mode: Regular Chat with public-source browsing. No separately exposed power tier, quota status, reset status, or measured capability ranking is claimed.
Component boundary: Ordinary Wisconsin postjudgment execution against tangible and other personal property in the debtor’s possession or otherwise subject to a sheriff’s levy, followed when necessary by a personal-property execution sale.
This pass does not complete:
- real-property execution, redemption, or sheriff’s deed procedure;
- the current homestead or full personal-property exemption amounts;
- earnings or bank-account garnishment;
- prejudgment attachment or replevin;
- supplemental proceedings in full;
- bankruptcy, appellate-stay, support, tax, restitution, federal, tribal, or foreign-judgment execution;
- ownership, security-interest, or priority litigation on actual property; or
- any named debtor, creditor, sheriff, judgment, property, docket, or county procedure.
P01-P03, P07, P11, and P13 remain unreviewed and supply no accepted premise. PASS-08 and PASS-10 supply only the scoped reviewed judgment gateway and corrections; their judgment-duration, interest, and satisfaction work is not replayed here.
Throughout this report, C001 means S_WI-P14-C001, and S001 means S_WI-P14-S001.
Current-source qualification
A bounded fresh attempt to retrieve the Wisconsin Legislature’s integrated current chapter 815 body failed. The official Legislature result identified chapter 815 and its section structure, but the operative chapter body would not render. I did not repeat the same failed endpoint.
The different official alternatives actually read were:
- Wisconsin Court System form GF-115, Execution Against Property;
- the Court System’s small-claims execution guide SC-6080V;
- the current statewide forms index;
- published Wisconsin Supreme Court and Court of Appeals opinions; and
- official GPO bankruptcy text for the narrow automatic-stay boundary.
The statutory language below was also read through 2025 Wisconsin statute reproductions, which are expressly labeled nonofficial read-aids, never current primary-body certification. Therefore:
The procedural architecture is strongly supported by current official Wisconsin court materials and published opinions, but the complete current integrated chapter 815 text remains a formal source-currentness hold.
An unread current body is not treated as absence of law, permission to levy, or proof that no later amendment or exception exists. Wisconsin Legislative Documents+2
Executive disposition
A docketed money judgment does not automatically create a blanket lien on all of a Wisconsin debtor’s personal property. For priority over other unsecured creditors, Wisconsin’s Supreme Court describes a sequence requiring a docketed judgment, identification of specific nonexempt personal property, and a levy. Levy may occur through sheriff execution, garnishment of specifically held property, or a court order applying specific property through supplemental proceedings. Supplemental proceedings alone are a discovery tool, not a blanket lien. C008–C010. Wisconsin Court System
For the sheriff-execution branch researched here:
- The clerk issues a formal execution writ directed to the sheriff.
- The writ identifies the judgment and amount due and requires resort to personal property before real property.
- The sheriff endorses receipt, locates property, and may require an indemnity bond if ownership or execution liability is reasonably doubtful.
- Personal property becomes bound when seized—not merely when the judgment was docketed or the creditor sent a demand.
- Exempt property must be separated through the statutory exemption and valuation procedures.
- If property must be sold, the ordinary rule requires 20 days’ public notice, a public auction between 9 a.m. and 5 p.m., and sale arrangements designed to bring the highest price.
- A secured asset is not automatically sold free and clear; the sheriff ordinarily sells the debtor’s right and interest subject to the secured party’s rights.
- The sheriff returns the writ and a detailed report after sale; net realized value is credited against the execution, and an unpaid residue remains subject to whatever lawful future collection process is available.
These steps are not creditor self-help authority and do not establish that any named asset is owned by the debtor, nonexempt, sufficiently valuable, unencumbered, or available for sale. Justia Law+3
G1. Judgment, writ, actors, levy, and legal effect
1. Execution is court process, not self-help
Wisconsin’s official GF-115 form is an order from the circuit court to the county sheriff. It directs the sheriff—not the judgment creditor—to satisfy the judgment from the debtor’s personal property in the county and, only if sufficient personal property cannot be found, from qualifying real property. The Court System’s guide similarly describes execution as a court-signed order directing the sheriff to seize property, sell it, and deliver the money obtained. C002, C004. Wisconsin Court System+1
A creditor’s letter, telephone demand, private inventory, credit-report entry, or statement that property “will be seized” is not itself:
- a writ of execution;
- a sheriff’s levy;
- a transfer of possession;
- a judicial determination of ownership;
- a ruling that the property is nonexempt; or
- permission for the creditor personally to take the property.
2. Core actors
| Actor |
Ordinary role in this component |
Material limit |
| Judgment owner / creditor |
Applies for the execution, countersigns through the owner or attorney, identifies possible property, advances applicable process expenses, and receives lawful credit from collections |
Does not personally acquire seizure authority merely by owning the judgment |
| Clerk of circuit court |
Issues, seals, and signs the execution from the appropriate court; supplies the formal writ |
Does not investigate every title, exemption, lien, or priority dispute |
| Sheriff |
Receives and endorses the writ, locates and seizes property, determines whether execution can proceed, conducts a sale if required, and makes the return |
May act only within the writ and governing law; may demand indemnity where risk is reasonably doubtful |
| Coroner or court-designated person |
Narrow substitute where the sheriff is interested or a party |
Not the ordinary actor |
| Judgment debtor |
Owns the interest, if any, that can be levied; may claim exemptions, contest ownership or value, or identify another person’s interest |
Debtor’s possession does not necessarily equal full ownership |
| Debtor’s spouse |
May claim an available exemption where the statute permits |
Marital-property ownership and combining exemptions require separate facts |
| Third-party owner |
Can assert that property belongs wholly or partly to that person |
The execution creditor’s assertion does not defeat third-party title |
| Secured creditor |
Retains rights in collateral when the debtor’s equity or interest is sold |
Sale is not automatically free and clear of the security interest |
| Purchaser at execution sale |
Acquires the interest lawfully sold under the execution |
Does not automatically acquire more title than the debtor had or defeat every prior lien |
| Court |
Resolves disputed exemptions, stays, title, valuation, or sale issues when properly raised |
No actual ruling is supplied here |

3. Issuance and contents of the writ
The 2025 read-aid for §815.05 states that the execution is issued under court seal and signed by the clerk where the judgment, certified judgment copy, or municipal transcript is filed. It is directed to the sheriff—subject to a narrow substitute-officer branch—and countersigned by the judgment owner or attorney.
It must intelligibly identify:
- the court;
- the county;
- the parties;
- the money judgment amount;
- the amount currently due; and
- the time of entry in the judgment and lien docket of the county to which it issues.
GF-115 reflects those fields and additionally provides spaces for costs, satisfactions, releases, modifications, interest, net amount due, other-county transcript information, and the sheriff’s date and time of receipt. C003, C039. Justia Law+1
The form’s references to interest and net due do not reopen PASS-08’s interest work. The issuing party must use the legally correct balance; no current interest calculation is made here.
4. Personal property precedes real property
The execution directs the officer first to satisfy the judgment from personal property. Only if sufficient personal property cannot be found does the writ move to the real-property branch. C004. Justia Law+1
That ordering does not mean:
- every item of personal property must be seized;
- exempt personal property must be exhausted;
- secured collateral necessarily has usable equity;
- real-property procedure is automatically available; or
- the sheriff must sell property where costs and prior interests eliminate meaningful value.
Real-property execution and redemption remain outside this pass.
5. County and delivery gateway
The read-aid and Court System guide identify county-specific issuance and execution rules. The writ is tied to the county in which the judgment or authorized transcript/copy is filed, and the sheriff acts against property in that county. The guide describes separate pathways for property located outside the originating county, involving docketing, transcripts, and in one route a certified judgment copy and a new county action. C005. Wisconsin Court System
This does not certify one operational filing method for all 72 counties.
6. Sheriff’s endorsement
The sheriff endorses the year, month, day, and hour the execution was received. That receipt point matters to the return period and can matter to competing execution timing. C006.
GF-115 contains the specific receipt fields. Wisconsin Court System
7. Sixty-day return, with levy-sale extension
The read-aid for §815.06 states that an execution is returnable within 60 days after the officer receives it. If the officer levied on property before the 60-day period expired, the officer may retain the execution until the property is sold. The return must state how the writ was executed. C007. Justia Law
The Court System guide matches this architecture: the sheriff ordinarily works within 60 days, but may need longer after a seizure because a lawful sale must be completed. Wisconsin Court System
8. Docketing is not a blanket personal-property lien
In Associated Bank v. Collier, the Wisconsin Supreme Court held that supplemental proceedings are a discovery tool and that neither supplemental service nor docketing alone creates a blanket lien on all personal property. A creditor obtains a superior interest over other unsecured creditors only after the required sequence involving a docketed money judgment, identified specific nonexempt personal property, and levy. C008–C012. Wisconsin Court System
Distinction matrix
| Act |
What it does |
What it does not do |
| Judgment entry/docketing |
Creates the formal judgment status and relevant judgment consequences |
Does not bind every item of personal property |
| Execution writ |
Authorizes the sheriff to proceed under the writ |
Does not itself seize a particular item |
| Creditor identifies property |
Gives the sheriff information to investigate |
Does not adjudicate ownership or exemption |
| Sheriff seizure/levy |
Binds the particular personal property from seizure |
Does not establish free-and-clear title |
| Garnishment |
Reaches specific debtor property or obligations held by another person |
Is not the sheriff-possession process covered here |
| Supplemental proceeding |
Discovers assets and may support a court order or receiver |
Does not alone create a blanket personal-property lien |
| Replevin |
Recovers possession of specific property under a different claim/process |
Is not collection of a money judgment through execution |
| Prejudgment attachment |
Secures property before judgment under separate rules |
Is not ordinary postjudgment execution |
| UCC repossession/sale |
Enforces a secured creditor’s consensual security interest |
Is not authority held by an unsecured judgment creditor |
9. Levy binds from seizure
The §815.19 read-aid states simply that personal property is bound from the time it is seized. C010–C011. Justia Law
This is why:
- a creditor’s demand is not enough;
- a general description such as “all property” does not itself complete levy;
- property ownership and possession matter;
- priority may turn on actual levy of identified property; and
- later transfers, liens, or competing creditor acts require fact-specific priority analysis.
10. Creditor information and sheriff control
The Court System guide says a creditor may give the sheriff information about property and location. It also says only the sheriff serves the execution and the sheriff determines whether nonexempt property is available. C012. Wisconsin Court System
Thus a creditor can identify a vehicle, equipment, cash, inventory, or another asset, but does not become the levy officer.
11. Indemnity where ownership or execution liability is doubtful
The §815.24 read-aid authorizes the officer to require sufficient indemnity where there is reasonable doubt whether property belongs to the debtor or is liable to execution. The statewide guide similarly warns that a sheriff may require an indemnity bond. C013. Justia Law+1
The officer’s request for indemnity is not a judicial ownership ruling. It protects against the risk of wrongful seizure while the creditor decides whether to proceed.
12. Money and negotiable instruments
The §815.25 read-aid distinguishes:
- current money, which may be applied without an auction; and
- negotiable debt instruments or bearer instruments, which may be levied and sold.
C014. Justia Law
This narrow provision does not transform every receivable, bank balance, cryptocurrency interest, account, or intangible right into cash immediately reachable by the sheriff. Garnishment, turnover, or supplemental proceedings may be the relevant route for property held by another.
13. Secured property and debtor equity
Under the §815.26 read-aid, where property is subject to a pledge, mortgage, or other security arrangement and is in the possession of the secured party, the execution sale reaches the debtor’s right and interest, subject to the secured party’s rights. C015, C028. Justia Law
This means the sheriff sale is not automatically a free-and-clear foreclosure of the secured creditor’s interest.
The published Prince decision likewise illustrates why judgment-creditor priority cannot be assumed where superior tax liens or other interests exist. C028, C037. Wisconsin Court System
G2. Exemption selection, valuation, notice, auction, and proceeds
14. Exemption gateway only
The §815.18 read-aid defines:
- equity as the fair market value of the debtor’s interest minus valid liens;
- exempt property as property free from a judicial lien and not subject to seizure, sale, or other judicial process; and
- multiple categories of exempt personal property and benefits.
The complete current exemption amounts and category-by-category conditions are not adopted in this pass. They remain P08 D7 work. C016.
Relevant categories identified—but not numerically decided here—include:
- consumer goods;
- business and farm property;
- motor vehicles;
- retirement interests;
- insurance and annuity interests;
- disability, personal-injury, and wrongful-death proceeds;
- depository accounts;
- support and certain benefit payments; and
- specifically protected property or proceeds.
The current integrated §815.18 body was not available, so no named asset is classified from this list.
15. Affirmative selection and timing
The reproduced exemption procedure generally requires the debtor to claim the exemption and select the property to which it applies. The claim can be oral or written to the creditor, creditor’s attorney, or levying officer. It may be made at seizure or within a reasonable time afterward, but before sale or another court-directed disposition.
Failure to follow the statutory claim procedure can waive the exemption, while a contractual waiver made before judgment is void. C017.
This is not a ruling that every exemption always must be claimed; some categories can have separate self-executing or source-specific treatment. The current complete body remains a hold.
16. Valuation and appraisal
Where seized personal property is partly exempt and the debtor or spouse claims the exemption, §815.19’s reproduced text says the officer:
- must, on the debtor’s or spouse’s request, or may on the officer’s own motion;
- appoint two disinterested county freeholders;
- administer an oath requiring a true appraisal;
- obtain a written signed appraisal;
- treat it as prima facie value evidence; and
- return the appraisal and inventory with the writ.
C018. Justia Law
The read-aid contains old, asset-specific automobile and tractor thresholds. Because the current integrated statute and full current exemption amounts were not read, those figures are not applied here.
17. Partially exempt indivisible property
The §815.18 read-aid describes a procedure under which the exempt and nonexempt portions are separated where practicable. If property cannot reasonably be divided and is sold, the debtor receives the exempt value from the proceeds and the nonexempt remainder can be applied to the execution. C019.
The actual legal result depends on:
- valid exemption category;
- current exemption limit;
- debtor equity after valid liens;
- valuation;
- divisibility;
- sale costs;
- secured claims; and
- any competing priority.
18. Other exemption predicates
The reproduced statute also contains material limitations involving:
- Wisconsin versus non-Wisconsin residency;
- spouses’ separate and combined exemption claims;
- tracing only where expressly authorized;
- fraudulent transfers or exemption planning;
- purchase-money and security-interest exceptions;
- and an election between chapter 425 consumer-credit exemptions and §815.18 exemptions for qualifying consumer-credit obligations.
C020.
Those issues require a separate full D7 exemption review and actual facts. No exemption set is selected here.
19. Twenty-day public notice of personal-property sale
The §815.29 read-aid says no ordinary execution sale of personal property may occur unless 20 days’ prior notice is given by:
- posting notice in one public place in the town or municipality where the sale will occur; and
- posting on the county website if the county maintains one.
The town or municipality may also post on its own website. C021. Justia Law
The notice must specify the sale’s time and place. C022. Justia Law
Personal-notice qualification
The sale-notice text read did not establish a separate universal requirement that the debtor personally receive the auction notice. The Court System guide does say that the sheriff serves the execution on the debtor, but service of the execution and publication of sale notice are different acts.
Accordingly:
This pass establishes the public posting and website requirements but holds any broader constitutional, local, case-specific, or separately enacted personal-sale-notice requirement.
20. Perishable or rapidly depreciating property
Where seized property is likely to perish or depreciate before the 20-day period ends, the court or judge may order a sale in the manner and on the terms that best serve the parties’ interests. C023. Justia Law
The creditor or sheriff cannot simply shorten the notice period by declaring that the property is losing value; a court order is the predicate in the text read.
21. Auction mechanics
The reproduced sale provision requires:
- auction between 9:00 a.m. and 5:00 p.m.;
- property in view of attendees, subject to identified statutory exceptions;
- offering in lots or parcels calculated to bring the highest price.
A sale of a debtor’s interest in secured property held by the secured party is one of the stated in-view exceptions. C024. Justia Law
No universal minimum bid, appraisal percentage, upset price, or creditor-bid right was established for ordinary personal property.
22. Adjournment
Section 815.29 incorporates the adjournment provisions referenced in §815.31. The reproduced §815.31 text allows the sheriff to adjourn where interests require it, subject to an overall maximum of three months and appropriate public notice at the sale and, for longer adjournments, further notice suited to the circumstances. C025. Justia Law+1
The real-estate publication requirements in §815.31 are not imported wholesale into the ordinary personal-property sale. Only the incorporated adjournment branch is used here.
23. Officer may not purchase
The §815.37 read-aid prohibits the executing officer or deputy from directly or indirectly purchasing at the execution sale and says a sale made to such an officer or for that officer’s use is void. C026. Justia Law
24. Defaced or omitted notice
Two reproduced provisions are relevant:
- §815.35 imposes a stated $50 liability on a person who removes or defaces a sale notice before the sale date without satisfaction or authorized consent.
- §815.36 says a want or defect in notice does not affect the title of a purchaser in good faith without notice of the defect.
C027. Justia Law+1
Because the current integrated bodies and complete remedy framework were not read:
- no private recovery is promised;
- no limitations period is supplied;
- no conclusion is made about a purchaser with actual notice; and
- no conclusion is made that every notice defect is harmless to the parties other than a protected good-faith purchaser.
25. Sale does not automatically extinguish security interests
A sale of secured property ordinarily transfers only the debtor’s right and interest, subject to the secured party’s rights. C015, C028. Justia Law
The sale therefore does not automatically:
- discharge the secured debt;
- release a perfected security interest;
- pay a tax lien;
- defeat a co-owner;
- transfer third-party property;
- resolve title defects; or
- give the buyer clear title to more than was lawfully sold.
26. Sheriff’s return and report
The execution is returnable to the issuing court, and the sheriff’s return states what was done under the writ. After every execution sale, the reproduced §815.38(2) requires the sheriff promptly to return the execution and record a detailed report of the sheriff’s acts. C007, C029. Justia Law+1
The Court System guide says sale proceeds may be delivered directly to the creditor or, in some counties, through the clerk. That local operational variation is not uniform statewide law. Wisconsin Court System
27. Fees and expenses
The read-aids for §§59.32, 814.70, and 814.72 identify categories such as:
- sheriff service;
- collection commission;
- advertising;
- seizure, inventory, custody, transportation, and storage;
- necessary sale expenses; and
- appraiser fees.
The forms and guide also warn about sheriff fees and possible indemnity-bond costs. C030. Justia Law+3
No current dollar amount is adopted. The integrated current fee statutes, local sheriff schedules, storage charges, and actual necessary expenses remain held.
28. Application of proceeds and remaining balance
The combined sources support this bounded sequence:
- property or the debtor’s interest is lawfully seized;
- valid exemptions and secured interests are respected;
- allowed execution and sale expenses are accounted for;
- cash or net sale proceeds are credited toward the execution amount;
- the sheriff reports the disposition; and
- any lawful unpaid residue remains unsatisfied.
C031, C035.
The exact priority among:
- secured creditors;
- tax or statutory liens;
- exemption payments;
- sheriff fees and preservation costs;
- multiple execution creditors; and
- the execution creditor,
is not established as one universal formula in this pass.
G3. Ownership, priority, stays, objections, and remedy boundaries
29. Property ownership is not presumed from possession
Only the debtor’s interest can be levied. Where the sheriff reasonably doubts ownership or execution liability, indemnity may be required. Where a third party asserts ownership, title and priority can require a court proceeding. C013, C032. Justia Law+1
A creditor’s list saying “debtor owns these items” is evidence supplied to the sheriff, not a conclusive title adjudication.
30. No blanket lien and no automatic priority
Associated Bank expressly rejects the concept that serving supplemental-process papers or docketing a judgment alone creates a blanket personal-property lien. The creditor must identify and levy specific property. C008–C012. Wisconsin Court System
Prince further illustrates that tax or other superior interests can defeat the judgment creditor’s claimed priority even after collection process begins. C028, C037. Wisconsin Court System
31. Bankruptcy automatic-stay gateway
The 2024 United States Code provides that a bankruptcy petition generally stays:
- enforcement of a prepetition judgment against the debtor or estate property;
- acts to obtain possession or control of estate property;
- acts to create, perfect, or enforce liens; and
- acts to collect a prepetition claim,
subject to numerous statutory exceptions, termination rules, and possible relief from the stay. C033. GovInfo
This report does not determine:
- whether a bankruptcy case exists;
- whether the property is estate property;
- whether a repeat-filing rule limits the stay;
- whether an exception applies;
- whether relief was granted;
- whether the debt is dischargeable; or
- whether a completed levy survives bankruptcy.
Thus:
Before seizure or sale, present bankruptcy and stay status must be verified from proper legal sources. No actual bankruptcy search was performed.
32. Appeal or other state-law stay
This pass does not reopen PASS-08’s appeal and secured-on-appeal analysis. For the personal-property execution component, the safe bounded proposition is:
The sheriff and creditor cannot assume that an execution may proceed if a valid stay, injunction, supersedeas arrangement, or other order restrains enforcement.
C034.
The existence, scope, duration, and effect of any stay remain case-specific and unresearched here.
33. Exemption objection and timing
The read-aid permits an exemption claim at seizure or within a reasonable time afterward, but before sale or court disposition. Where property is partly exempt, the appraisal process supplies a value record. C017–C019.
No universal statewide blank “personal property execution exemption form” was identified in the forms index. A claim can therefore depend on a written or oral assertion to the identified actor and subsequent court practice. Local procedures remain held.
34. No ordinary personal-property redemption period established
Chapter 815’s explicit statutory redemption sections concern real property. No general post-sale redemption period for ordinary personal property was established in the personal-property sections read. C036.
That bounded finding does not resolve:
- a contractual repurchase right;
- UCC redemption before a secured-party sale;
- sale set-aside remedies;
- fraud, mistake, or void-sale theories; or
- a particular statutory category with its own rule.
35. Sale title and set-aside remedies
The read statutes contain protections for a good-faith purchaser and invalidate an officer’s self-purchase. They do not establish that every other procedural defect automatically voids or never voids a sale. C026–C027, C037.
Full sale-confirmation, equitable set-aside, due-process, damages, and limitation issues remain deferred.
36. Return fully, partially, or wholly unsatisfied
The sheriff’s return records the execution result. If property or proceeds satisfy only part of the execution, the realized amount is credited and the lawful residue remains. The statewide guide says creditors may pursue another execution process where the judgment remains unpaid, but the continuing judgment gateway, timing, and later asset availability must still be satisfied. C035. Justia Law+1
This does not create an endless or limitation-free right to repeat executions.
G4. Fictional workflows, timing, and arithmetic
All examples are invented. They do not identify a real person, asset, sheriff, county, judgment, debt, fee, exemption, or outcome.
Example 1 — Ordinary judgment and valid writ
Facts
- A hypothetical ordinary civil money judgment exists.
- The clerk issues GF-115 to the sheriff of the county where identified personal property is located.
- The writ correctly identifies the judgment and net due.
- No stay or bankruptcy is known.
- The creditor identifies a nonexempt commercial mower believed to belong to the debtor.
Required sequence
- Clerk issues and seals the writ.
- Judgment owner or attorney countersigns as required.
- Sheriff endorses receipt.
- Sheriff investigates ownership, exemption, liens, value, and practical sale.
- Levy occurs only if the sheriff seizes the item.
- If sale is needed, exemption and notice requirements precede the auction.
- Sheriff returns and reports the result.
Conditional result: The mower does not become bound merely when identified; it becomes bound when seized. C003, C006, C010–C013.
Adverse branch: If title belongs to a leasing company or the mower is fully exempt, levy or sale cannot be assumed.
Missing records: Judgment, writ, title, serial number, financing statement, exemption claim, sheriff inventory, and stay status.
Example 2 — Creditor demands seizure without a writ
Facts
A creditor sends a letter ordering the debtor to surrender household property but has no issued execution in the sheriff’s hands.
Result
The demand is not a levy. The creditor lacks ordinary chapter 815 sheriff-execution authority to seize the property personally. C002–C003, C010.
Adverse branch: A consensual turnover, valid secured-party remedy, replevin order, or another court order could involve different authority, but none is assumed.
Missing evidence: Any writ, security agreement, court order, or voluntary agreement.
Example 3 — Ownership is contested
Facts
- Sheriff is directed to seize a trailer at the debtor’s residence.
- A nondebtor produces a purchase invoice and registration showing ownership.
- The creditor claims the debtor paid for the trailer.
Conditional result
The sheriff may require indemnity because ownership and execution liability are reasonably doubtful. The property should not be treated as conclusively the debtor’s merely because it was physically present. C013, C032.
Adverse branch: Strong evidence of the debtor’s beneficial ownership, fraudulent transfer, or nominee arrangement could lead to separate litigation.
Missing records: Title, payment source, possession agreement, insurance, registration, creditor evidence, and indemnity.
Example 4 — Debtor selects potentially exempt property
Facts
- Sheriff seizes several personal-property items.
- Debtor timely claims that one item is exempt.
- Item is indivisible and has disputed value.
Required process
- Debtor identifies the exemption and selected property before disposition.
- On request, the officer obtains the statutory appraisal.
- Two disinterested county freeholders provide a sworn written value.
- Appraisal and inventory accompany the return.
- If the item is partly exempt and lawfully sold, the exempt value must be separated from execution proceeds.
C017–C019.
Adverse branch: If the exemption category, current amount, ownership, residence, or claim timing fails, the item may remain subject.
Missing evidence: Current exemption body, item category, liens, fair market value, appraisal, and timely claim.
Example 5 — Twenty-day sale notice
Facts
- Ordinary nonperishable personal property is to be sold Tuesday, June 30, 2026.
- Public-place and required county-website notices are posted Wednesday, June 10, 2026.
- No adjournment occurs.
- The first day is excluded and the last is included under the modeled §990.001 rule.
- No separate holiday issue affects the date.
Calendar
June 11 through June 30 equals 20 calendar days.
Modeled result: June 30 is the first modeled sale date satisfying the 20-day interval on these assumptions. C021–C022, C040–C041. Justia Law+1
Adverse branch: If a required website posting was omitted, the property was perishable, the sale was adjourned, or another notice rule applies, this model is incomplete.
Important limit: This is not an individualized deadline and does not determine whether separate personal notice was constitutionally or locally required.
Example 6 — Return period with pre-expiration levy
Facts
- Sheriff receives the writ Monday, January 5, 2026.
- First day is excluded.
- No Sunday, legal-holiday, or Saturday-office adjustment changes the modeled endpoint.
- Sheriff levies on property February 20 but cannot complete the sale by the 60th day.
Calendar
Sixty days after January 5 under the stated convention is Friday, March 6, 2026.
Conditional result
- Ordinarily, the writ would be returnable by March 6.
- Because the sheriff levied before the period expired, §815.06’s read text permits retention until the property is sold.
- After sale, the sheriff promptly returns the execution and detailed report.
C007, C029, C040, C042. Justia Law+2
Adverse branch: If no timely levy occurred, the retention-after-levy branch is not established.
Example 7 — Public sale and conditional proceeds arithmetic
Stipulated facts
- Gross sale proceeds: $9,000
- Valid allowed execution/sale expenses: $600
- Debtor’s valid exempt share from an indivisible item: $2,500
- Amount then due on execution before sale: $8,500
- No secured claim, tax lien, co-owner, or priority dispute
- Rounding to cents is unnecessary
Illustrative arithmetic
- Gross proceeds: $9,000
- Less stipulated allowed expenses: $9,000 − $600 = $8,400
- Less stipulated exempt share: $8,400 − $2,500 = $5,900
- Judgment credit: $5,900
- Modeled unpaid residue: $8,500 − $5,900 = $2,600
Conditional result: The modeled judgment receives a $5,900 credit and a $2,600 residue remains. C019, C030–C031, C035, C043.
Adverse branch: A secured lien, different statutory ordering, inadequate sale, current exemption amount, sheriff cost objection, or tax priority can materially change the distribution.
Critical limit: The $600 and $2,500 are stipulated inputs—not Wisconsin’s actual current fees or an actual exemption amount.
Example 8 — Prior secured interest
Facts
- Machinery market value: $15,000.
- Valid perfected secured debt: $12,000.
- Debtor’s apparent equity before sale costs: $3,000.
- Creditor claims the full asset can be sold free and clear.
Result
The sheriff sale does not automatically extinguish the secured party’s rights. Under the §815.26 branch read, the debtor’s right and interest are what can be sold, subject to the security interest. C015, C028.
Adverse branch: If the secured debt was paid, the lien was terminated, or a court authorized a different sale structure, the result can differ.
Missing evidence: Security agreement, financing statement, payoff, possession, priority, valuation, and sale terms.
Example 9 — Bankruptcy or appellate stay uncertainty
Facts
- Writ has issued.
- Debtor reports a bankruptcy filing.
- Creditor says the bankruptcy does not matter because the judgment predates it.
- Appeal status is also unclear.
Result
A prepetition judgment and acts to seize or control estate property are generally within the federal automatic-stay provisions unless an exception or relief applies. The sheriff and creditor cannot assume the execution remains active. C033–C034. GovInfo
Adverse branch: A stay may have terminated, may never have arisen in a repeat-filing circumstance, may not protect particular property, or may have been modified.
Missing evidence: Petition, filing date, chapter, property status, prior cases, stay order, relief order, appeal bond, injunction, and court orders.
Example 10 — Partial collection and unsatisfied return
Facts
- Execution amount before collection: $11,000.
- Sheriff lawfully obtains $3,200 net cash after all valid deductions.
- No additional property is found.
- No current interest calculation is assumed.
Arithmetic
$11,000 − $3,200 = $7,800
Conditional result
The sheriff reports and returns the writ reflecting the $3,200 collection and $7,800 unpaid residue. A later lawful execution might be requested only if the judgment and procedural gateway still permit it. C029, C031, C035.
Adverse branch: If the $3,200 was exempt, belonged to a third party, or was incorrectly calculated, the credit and return must be corrected through lawful process.

38. Evidence-backed article and checklist opportunities
A. “From judgment to sheriff levy” process map
A responsible article can distinguish:
- judgment;
- execution issuance;
- sheriff receipt;
- asset identification;
- ownership and exemption review;
- levy by seizure;
- appraisal;
- sale notice;
- auction;
- proceeds distribution;
- return; and
- judgment credit.
It should explicitly say that a creditor’s demand is not a levy.
B. Personal-property execution checklist
A checklist could ask for:
- issuing county and sheriff;
- writ date and receipt endorsement;
- exact property description;
- possession and ownership evidence;
- title and co-owner claims;
- current exemption category and selected property;
- liens and financing statements;
- valuation and sale-cost estimate;
- indemnity requirement;
- bankruptcy or appellate stay;
- 20-day posting and websites;
- auction time and property-in-view status;
- proceeds and judgment credit;
- sheriff’s return.
C. Conditional sale-net calculator
A calculator may accept only user-supplied values:
- gross proceeds;
- validated secured claims;
- exempt share;
- allowed sheriff expenses;
- other priority claims; and
- execution balance.
It must display every deduction and warn that priority and current exemption amounts require legal verification. It must not present its result as the amount legally collectible.
No article, checklist, calculator, form package, or website was built or approved.

Final researcher self-check
Actual fresh reading
Freshly read or inspected:
- the failed official chapter 815 route and section index;
- official Wisconsin Court System GF-115, its summary, SC-6080V, and the statewide forms index;
- official published Associated Bank v. Collier and Prince Corp. v. Vandenberg opinions;
- 2025 read-aid bodies for the chapter 815 sections listed in the source register;
- the read-aid time-computation provision;
- current official GPO 11 U.S.C. §362 for the narrow bankruptcy-stay gateway.
GF-115’s one-page image and both SC-6080V page images were inspected. No form was completed or submitted.
Currentness limitations
- The integrated current Wisconsin chapter 815 body was not retrieved.
- The complete current §815.18 exemption body and current amounts were not certified.
- The statutory read-aids are identified as nonofficial.
- No county sheriff schedule, local rule, local indemnity practice, or sale calendar was certified.
- No commercial citator or complete unpublished-case search was conducted.
- A failed official source was not converted into a no-law or permission conclusion.
Arithmetic and calendar checks
The modeled calculations are internally correct:
- June 10 to June 30, excluding the first day and including the last, gives 20 days.
- January 5, 2026 plus 60 days under the stated convention gives March 6, 2026.
- $9,000 − $600 − $2,500 = $5,900.
- $8,500 − $5,900 = $2,600.
- $11,000 − $3,200 = $7,800.
The $600 cost and $2,500 exemption figures are stipulated inputs, not legal Wisconsin amounts. No current interest, actual sheriff fee, statutory award, or individualized sale distribution was computed.
