Wisconsin ordinary consumer-judgment non-earnings garnishment of bank/deposit accounts and exempt-funds gateway
Actual fresh source-access date: October 26, 2026, America/Los_Angeles; October 27, 2026 UTC.
Historical baseline: October 22, 2026 Pacific.
Mode/model: Regular Chat, GPT-5.6 Sol Pro. No separately exposed power tier, quota status, reset status, or measured capability ranking is claimed.
Component boundary: Ordinary Wisconsin postjudgment non-earnings garnishment, principally deposit accounts, plus the narrow Wisconsin and federal exempt-funds procedures needed to understand what a bank must initially hold, automatically protect, or leave for judicial resolution.
PASS-11’s earnings report remains saved but unreviewed and supplies no premise here. P01-P03, P07, and P09 likewise remain unreviewed. PASS-08/PASS-10 supply only the reviewed boundary that garnishment was deferred; their judgment-duration, interest, and satisfaction conclusions are not rerun.
Throughout this report, C001 means S_WI-P13-C001, and S001 means S_WI-P13-S001.
Current-source qualification
A bounded fresh attempt to retrieve the Wisconsin Legislature’s official full chapter 812 PDF was unsuccessful. The official search result identifies an 11-page chapter 812 publication updated August 5, 2026, but the body timed out through the available public route. I did not repeat the same failed endpoint. Wisconsin Legislative Documents
Accordingly:
- official Wisconsin Court System forms, instructions, and official Legislature section snippets are treated as official procedural evidence;
- freshly read 2025 Wisconsin statute reproductions are labeled nonofficial read-aids, not current primary-body certification;
- the current integrated bodies of chapter 812 and §815.18 remain held;
- no unread provision is treated as absent; and
- local clerk, filing-fee, service, scheduling, and hearing practices are not certified for all 72 counties.
The federal benefit-protection sources were freshly read from current eCFR Title 31, displayed as current through October 23, 2026 and last amended October 15, 2026. eCFR+1
Executive disposition
A Wisconsin bank-account garnishment involves two separate layers:
- Wisconsin non-earnings garnishment: a separate civil action against the garnishee. The creditor files a garnishee summons and complaint; serves the financial institution and then the debtor; the bank identifies what it owes or holds, discloses liens, setoffs, exemptions, and third-party claims; the debtor may answer and claim exemptions; and the court ultimately directs payment or release where the matter is disputed. The creditor’s complaint is an allegation, not proof that the account is owned entirely by the debtor, that all funds are nonexempt, or that the judgment remains enforceable. C001–C018.
- Federal automated review of certain direct-deposited federal benefits: before freezing funds under an ordinary order, a financial institution must determine whether the order carries the special federal/support notice and, if not, review each account for specifically coded direct deposits of Social Security, SSI, VA, Railroad Retirement, or OPM benefits during the federal two-month lookback period. The protected amount is the lesser of the coded benefit deposits during that period or the balance at review. The customer obtains immediate access without filing an exemption claim. C031–C045.
These layers are not interchangeable:
- Wisconsin’s reproduced deposit-account exemption is an aggregate $5,000, personal-use-only exemption that must generally be affirmatively claimed.
- The federal protected amount is automatically calculated by the bank from specifically coded direct deposits.
- Funds outside the automated federal protected amount may still be exempt under federal or state law, but may require an affirmative claim and tracing.
- A bank’s initial hold is not the final judicial determination of ownership or exemption.
- Deposited wages are not automatically governed by the federal wage-garnishment percentages merely because their source was payroll.
- Neither an exemption nor a bank release invalidates the underlying judgment or debt. Wisconsin Legislative Documents+2
G1. Current procedure, actors, commencement, answers, and disposition
1. Actor and legal-role matrix
| Actor |
Role in the ordinary Wisconsin non-earnings action |
Material limit |
| Judgment creditor / plaintiff |
Starts the separate garnishment action and alleges the judgment, unpaid amount, and belief that the garnishee owes or holds nonexempt debtor property |
Allegation does not establish ownership, nonexemption, valid assignment, or present enforceability |
| Judgment debtor / principal defendant |
Receives the summons and complaint, may answer, claim exemptions, dispute ownership, and participate in trial |
Silence can create serious procedural consequences, but does not convert a third party’s property into the debtor’s property |
| Financial institution / garnishee |
Determines what debtor property or debts it holds, implements the garnishment, answers, identifies setoffs/liens/exemptions/other claimants, and holds or pays funds as directed |
The bank does not finally adjudicate a contested exemption or ownership claim merely by freezing funds |
| Nondebtor account co-owner or third-party claimant |
May assert ownership or be impleaded into the garnishment proceeding |
Joint account title alone does not resolve the debtor’s actual interest |
| Clerk of court |
Issues the summons after the filing-fee predicate, receives filings and potentially garnishee payment, and processes court orders |
Clerk procedure and fees can vary locally |
| Court |
Decides contested answers, ownership, exemptions, setoffs, and disposition; can order payment, release, transfer, delivery, or sale |
This pass does not decide merits of any actual account or judgment |
| Creditor’s Wisconsin attorney |
Required to commence the action for entities that cannot appear pro se; receives answers and can reply or object |
Actual representation and authorization are unsupplied |
| Sheriff or private process server |
May serve the summons and complaint under general service rules and court guidance |
Local service details remain uncertified |
| Representative acting for debtor |
May assert an exemption on the debtor’s behalf under the reproduced exemption procedure |
Authority and exact communication remain factual |

2. Separate-action and postjudgment gateway
Wisconsin’s non-earnings garnishment is a separate civil action, governed by general civil procedure unless chapter 812 supplies a different rule. The ordinary judgment branch is available after execution on an in-personam judgment is issuable. A person may not use the action to affect a nonparty spouse’s property unless the spouse is made a defendant as the statute requires. C002–C005. Justia Law+1
The required postjudgment complaint must state, in substance:
- the court and judgment information;
- the judgment date and amount;
- the amount presently claimed, with garnishment disbursements not exceeding the specified statutory addition;
- the creditor’s belief that the garnishee owes the debtor or possesses debtor property; and
- that, to the creditor’s best knowledge and belief, the property is not exempt.
Multiple garnishees can be joined, but joint liability must be pleaded where asserted. C005. Justia Law
The sources read do not establish a separate, universal affidavit as an additional statutory commencement prerequisite for the ordinary postjudgment complaint. A particular county, e-filing workflow, or special branch may impose additional procedural requirements; those remain held.
3. Commencement and service
3.1 Filing and issuance
After payment of the applicable fee, the clerk issues the garnishee summons. The action is commenced by filing the garnishee summons and annexed complaint. As to a defendant not served with authenticated copies within 60 days after filing, the action is not deemed commenced against that defendant under the reproduced provision. C006. Justia Law
3.2 Service on garnishee
The garnishee is served under Wisconsin’s general civil-service chapter. The creditor also pays the garnishee the reproduced $3 fee; the garnishee need not answer until that fee is paid. C007–C008. Justia Law+1
3.3 Service on debtor
No later than 10 days after service on the garnishee, the debtor must receive the garnishee summons and complaint together with the principal summons. Failure to accomplish the required debtor service requires dismissal under the reproduced statute. C007. Justia Law
The official small-claims guide describes sheriff or private-process-server service and warns that local rules differ. It is guidance rather than a substitute for chapter 801 or current chapter 812. Wisconsin Court System+1
4. Financial-institution implementation point
Under the reproduced §812.19(4), a financial institution’s liability is measured from the time it is first reasonably able to put the garnishment into effect, but no later than the end of the second business day after the business day on which the summons and complaint are received.
Property leaving the institution before implementation during that permitted interval is not subject to the garnishment, and the institution has no duty to recover it or liability to the creditor for it. Safe-deposit-box contents are not treated as property in the bank’s possession or control under this garnishment subchapter. C009–C010. Justia Law
This Wisconsin implementation clock is distinct from the federal benefit-review clock under 31 C.F.R. part 212. The two regimes must both be applied where relevant.
5. Garnishee answer
The garnishee ordinarily has 20 days, excluding the day of service, to serve its answer on the creditor or creditor’s attorney and file the answer with the clerk. The answer must address, as applicable:
- debts due or potentially due to the debtor;
- amount and interest;
- whether the obligation is absolute or contingent;
- property held, its title, possession, and debtor interest;
- the garnishee’s setoff, defense, lien, or other claim;
- known exemptions or objections; and
- known third-party claimants.
C011. Justia Law
The official CV-302 form operationalizes this disclosure by separating gross property or debt, exemptions and other deductions, and the amount the bank believes remains subject. It is not a final adjudication of a disputed exemption. Wisconsin Court System
6. Debtor answer and creditor response
The debtor may answer within 20 days after service and may raise any ground available to the garnishee, including exemption, lack of ownership, setoff-related facts, or other defenses. The debtor may participate in the resulting trial. C012. Justia Law
The official CV-303 and SC-303 forms expressly identify the deposit-account exemption and provide an answer mechanism. Wisconsin Court System+2
A garnishee’s answer is taken as true unless the creditor serves a reply within 20 days after receiving it. A timely reply joins the issue, and the resulting dispute is tried to the court as an ordinary civil matter. C013. Justia Law
The court forms provide a creditor-objection and hearing mechanism for garnishee or debtor answers. No universal current statutory deadline for objecting to every debtor exemption answer was independently verified in the bodies read; county scheduling practices remain held.
7. Default and failure to answer
A garnishee’s failure to answer can expose the garnishee to judgment for the amount of the creditor’s judgment against the debtor plus allowable costs. That exposure is not described here as an automatic electronic transfer; a judicial default process and legally sufficient notice remain necessary. C014. Justia Law+2
The creditor’s complaint does not establish that the garnishee actually held funds merely because no timely answer was filed.
8. Scope of property held
From service, and subject to the special financial-institution timing rule, the garnishee is potentially liable for:
- property in its possession or control belonging to the debtor;
- property in which the debtor has an interest, but only to the extent of that right or interest; and
- debts due or to become due to the debtor,
excluding exempt property and the other identified statutory exceptions. Liability does not exceed the creditor’s claim. C015. Justia Law
If the garnishee holds enough money to cover the claim and authorized disbursements, excess property ceases to be subject. If it holds less, subject property is generally held pending further court order, and the debtor can petition to release property not reasonably required to secure the claim. C016. Justia Law
9. Payment to the clerk and disposition
Where an answer admits a debt already due, the garnishee may pay the clerk up to the claim and allowed disbursements. On the creditor’s written request, the reproduced statute requires payment within five days; the clerk’s receipt discharges the garnishee to that extent. If the debt is not yet due, the payment rule applies when it becomes due. Without voluntary payment or a written request, the garnishee generally holds the property pending court order. C017. Justia Law
GF-105 is the official court-order vehicle for directing payment or releasing the garnishee. The form includes branches involving the creditor’s failure to contest or seek disposition within specified periods, but the form is not treated as independent statutory authority for every local case. C018. Wisconsin Court System
10. Third-party claimant and release bond
A third person claiming the garnished property may be impleaded and ordinarily receives 20 days to answer the asserted claim and defenses. C019. Justia Law
The debtor can seek release of the garnishment by a bond ordinarily set at 1.5 times the debt, or a lower court-approved amount, with the surety requirements stated in §812.21. The creditor may object to sureties within three days. C020.
That bond procedure is separate from claiming an exemption and does not establish that the frozen funds were nonexempt.
G2. Deposit-account exemption and ownership gateway
11. Wisconsin depository-account exemption
The official Wisconsin Legislature index currently exposes the substance of §815.18(3)(k): depository accounts are exempt in an aggregate value of $5,000, but only to the extent the account is for the debtor’s personal use and is not used as a business account. The integrated official §815.18 body could not be retrieved; the current official snippet and official court forms nevertheless corroborate the same $5,000 amount. C021–C022. Wisconsin Legislative Documents+2
The reproduced definitions provide that:
- “aggregate value” is the sum of the debtor’s equity in the property claimed exempt;
- a “debtor” is an individual, not a corporation, partnership, association, cooperative, or political body;
- a “depository account” includes certificates of deposit, demand accounts, NOW accounts, savings, share, time, and similar accounts at listed financial institutions;
- safe-deposit boxes and their contents are excluded from that definition; and
- “exempt” means free from a judicial lien and not subject to seizure, sale, or other judicial process. C021. Justia Law
Deposit-account exemption conditions
| Predicate |
Result established |
| Account used personally, not as a business account |
Potentially within §815.18(3)(k) |
| Aggregate debtor equity across qualifying depository accounts ≤ $5,000 |
Potentially fully exempt under this branch |
| Aggregate debtor equity > $5,000 |
Only the claimed exempt portion is protected under this branch; other exemptions may also apply |
| Corporate or business entity account |
Not within the reproduced individual-debtor exemption |
| Safe-deposit-box contents |
Not a “depository account”; also not treated as bank possession/control under §812.19(5) |
| Joint account |
Only the debtor’s actual interest is subject under §812.18; title and ownership require separate analysis |
| Consumer-credit judgment |
Debtor may need to elect between §425.106 exemptions and §815.18 exemptions rather than stack both sets |
No indexing or inflation-adjustment mechanism for the $5,000 amount was located in the reproduced §815.18 text or current official forms. Because the current integrated body remains unread, this is a bounded finding rather than a categorical conclusion that no future adjustment mechanism exists.
12. Exemption must generally be claimed
The reproduced §815.18 procedure says that a debtor must affirmatively claim an exemption or select the specific property to which it applies. The claim may be made at seizure or within a reasonable time afterward, but must be made before disposition by sale or court order. The debtor or a person acting on the debtor’s behalf may make the claim orally or in writing to the creditor, creditor’s attorney, or officer seeking the judicial lien. Failure to comply can waive the exemption; a prejudgment contractual waiver is void. C023. Justia Law
For a non-earnings garnishment, the official debtor-answer forms provide the practical written route. The bank’s initial hold does not itself waive or decide the exemption.
13. Partial exemption, spouses, residency, and consumer-credit election
The reproduced statute provides:
- partially exempt property is divided into exempt and nonexempt portions;
- each spouse can claim an exemption, subject to the statute’s marital-property and maximum-value rules;
- a Wisconsin resident uses Wisconsin’s exemptions, while a nonresident is directed to the exemption law of the residence jurisdiction;
- property traceable to exempt property is not exempt unless the statute expressly says so;
- proceeds from partially exempt property paid to the debtor can retain the specified protection while held as cash or in a depository account; and
- for an obligation arising from a consumer-credit transaction, the debtor may claim either the §425.106 exemptions or §815.18 exemptions. C024–C026. Justia Law+2
The §425.106 read-aid does not list a general deposit-account dollar exemption. It instead identifies unpaid earnings, certain household property, limited residence equity, and restitution-related property. A real consumer-credit debtor’s election requires complete transaction and asset facts; this report does not select an exemption set. Justia Law
14. Deposited wages are not automatically CCPA “earnings”
In John O. Melby & Co. Bank v. Anderson, the Wisconsin Supreme Court held that the federal Consumer Credit Protection Act’s wage-garnishment percentages did not follow wages after the employee received and deposited them into a bank account—even where the funds were directly traceable to payroll. The court confined the federal wage restriction to the ordinary employer-payroll garnishment process. C027. Justia Law
That does not mean deposited wages are always garnishable in full. Wisconsin’s deposit-account exemption and any independently applicable source-based exemption still must be tested. PASS-11’s earnings calculations are not adopted here.
15. Joint accounts, liens, setoff, and competing claims
The state procedure reaches only property belonging to the debtor or the debtor’s actual interest. A garnishee answer must disclose its own setoff, defense, lien, or claim and identify known third-party claimants. A third party may be impleaded and litigate ownership. C015, C019, C028. Justia Law+2
This pass does not establish:
- a fixed percentage ownership rule for every joint account;
- whether a specific bank setoff has priority;
- priority among multiple garnishment orders;
- marital-property ownership;
- survivorship effects;
- resulting-trust or agency ownership;
- tracing of every mixed deposit; or
- the effect of a contractual bank lien.
Those require actual account agreements, transaction histories, ownership evidence, and separate priority law.
G3. Federal-benefit bank-review gateway
16. Scope of 31 C.F.R. part 212
Part 212 applies to all covered financial institutions and to specifically listed federal benefit payments protected under:
- Social Security and SSI;
- VA benefit law;
- Railroad Retirement and Railroad Unemployment Insurance law; and
- Civil Service Retirement System and Federal Employees Retirement System law.
C029. eCFR
The automated protections do not cover every payment made by the federal government. Military retired pay, tax refunds, federal vendor payments, ordinary payroll, and other federal payments require their own classification.
17. Definitions that control the automated review
For part 212:
- an account holder is a natural person against whom the order is issued and who appears in the institution’s records as direct or beneficial owner;
- a benefit payment is one of the covered federal benefits deposited by direct deposit with the specified ACH coding;
- the lookback period is the two-month period beginning the day before account review and ending on the corresponding date two months earlier—or the last day of that month if no corresponding date exists; and
- the protected amount is the lesser of the sum of covered benefit payments posted during the lookback period or the balance at account review.
C030–C032. eCFR+2
A paper benefit check, cash deposit, consumer-initiated transfer from another account, or direct deposit lacking the specified federal coding does not qualify as a “benefit payment” for this automated calculation merely because the money originated from a federal program.
18. First review: special federal or child-support notice
Before taking any other garnishment-related action and no later than two business days after receiving an order, the institution checks whether the order includes the Appendix B Notice of Right to Garnish Federal Benefits.
- If the notice is present and properly issued by the United States or a state child-support enforcement agency, the institution follows its ordinary process and does not use §§212.5 and 212.6.
- If the notice is absent, it proceeds to the account review.
C033. eCFR+1
Appendix B is limited to the federal and state-support authorities identified in the notice. It is not a general certification that every government creditor may bypass the benefit review.
19. Account review timing and method
Where no Appendix B notice applies, the bank must perform account review no later than two business days after receiving:
- the order; and
- enough information to determine whether the debtor is an account holder, if the order did not already provide it.
A creditor can permit a later date for a large batch of orders, and the institution must retain records of that permission. C034. eCFR
The review is conducted regardless of:
- commingled nonbenefit funds;
- a co-owner;
- multiple beneficiaries or benefit programs;
- instructions in the garnishment order;
- the nature of the underlying debt; or
- the balance, so long as it is above zero at review.
Each account is reviewed separately, and the bank does not trace transfers from one account to another. C035–C036. eCFR
20. No coded payment in lookback
If the review finds no covered, correctly coded benefit payment in the lookback period, the bank follows its ordinary garnishment procedures and does not establish the automatic protected amount under §212.6. C037. eCFR
That result does not mean the funds are legally nonexempt. Older benefit deposits, paper checks, transferred benefit funds, or other protected property can remain exempt under underlying federal or state law and may need to be asserted separately.
21. Coded benefit found: automatic protected amount
If a benefit agency deposited a qualifying benefit payment during the lookback period, the institution must immediately calculate and establish the protected amount. The account holder gets full and customary access without having to assert an exemption first, and that calculated amount is conclusively exempt under part 212. C038–C039. eCFR
The calculation is performed separately for each account:
Protected amount = lesser of:
qualifying coded benefit deposits during the lookback period; or
balance when account review is performed.
22. Funds above the protected amount
Funds above the federally calculated protected amount are handled under the otherwise applicable garnishment process, including a Wisconsin hold where appropriate. But part 212 expressly preserves the individual’s right to assert a further federal exemption for amounts above the protected amount and does not alter the exempt status of funds protected by another federal law. C040. eCFR+1
Thus, “not included in the automated protected amount” does not equal “finally garnishable.”
23. One review, later deposits, and multiple orders
For a given garnishment order:
- the bank performs the review once;
- re-service of the same order does not trigger another review;
- a new or different order triggers a new review; and
- the institution does not continually freeze later deposits in response to the old order.
C041. eCFR
This federal rule does not by itself decide Wisconsin priority between multiple valid orders.
24. Garnishment fees
A bank may not charge a garnishment fee against the protected amount. It may charge a fee during the five business days after review if nonbenefit funds are deposited during that period, but the fee cannot exceed the amount of the nonbenefit deposit. C042. eCFR
The rule does not authorize every fee permitted by a private account agreement; the fee must also be lawful under other applicable law.
25. Federal notice to account holder
The institution sends the federal notice only where:
- a qualifying benefit payment was deposited during the lookback period;
- the balance was above zero and a protected amount was established; and
- funds remain above the protected amount.
The notice must explain, among other things:
- receipt and service date of the order;
- the account and protected amount;
- the amount frozen;
- any fee;
- covered benefit types;
- the right to assert further exemptions;
- the applicable procedure or deadline where known; and
- creditor information.
It must be sent within three business days after account review. C043. eCFR+1
Appendix A provides an optional model. Proper use gives the specified notice safe harbor, but the model is not mandatory and is not a Wisconsin exemption form. eCFR
26. Preemption, safe harbor, and records
Part 212 preempts inconsistent state law only to the extent of actual conflict. A state requirement protecting a greater amount is not inconsistent if the bank can comply with both. C044. eCFR
A financial institution complying in good faith receives specified safe-harbor protections for:
- account activity during the review period;
- protected or properly frozen amounts;
- bona fide errors despite reasonable procedures;
- ordinary clearing adjustments; and
- honoring the account holder’s post-service written instruction to use protected funds.
C045. eCFR
Federal banking agencies enforce part 212, and institutions must retain account-activity and response records sufficient to show compliance for at least two years after receiving the order. C046. eCFR
27. Underlying federal benefit protections
Social Security
42 U.S.C. §407 protects Social Security money paid or payable from execution, levy, attachment, garnishment, and other legal process, and requires an express statutory reference to §407 before another law can modify that protection. C047. U.S. Code
SSI
42 U.S.C. §1383(d)(1) applies §407 to SSI to the same extent as Title II benefits. C048. U.S. Code
VA benefits
38 U.S.C. §5301 generally protects covered VA payments from creditor claims and legal process before and after receipt, while containing specific United States, tax-levy, purchased-property, assignment, and related exceptions. C049. U.S. Code
Railroad and OPM benefits
Part 212 identifies the Railroad Retirement, Railroad Unemployment, CSRS, and FERS statutes that support automated protection. Those underlying statutory bodies were not separately read in this pass. Their full exceptions, federal-claim rules, tax rules, and program-specific tracing questions remain held. C050. eCFR
G4. Fictional workflows and calculations
All facts below are invented. No actual account, judgment, creditor, bank, benefit, or exemption is evaluated.
Example 1 — Ordinary unprotected personal funds
Facts
- Ordinary private consumer judgment.
- Bank account balance at implementation: $8,000.
- No coded federal benefits.
- Funds are stipulated to be personal-use money.
- One Wisconsin debtor claims the reproduced §815.18 exemption.
- No other account or spouse exemption is assumed.
State calculation
- Aggregate deposit exemption: $5,000.
- Potential nonexempt balance under this branch:
$8,000 − $5,000 = $3,000.
Conditional result
The bank may hold the potentially garnishable amount, but the debtor must affirmatively claim the exemption and the court remains the decision-maker if contested. The $3,000 calculation does not account for another statutory exemption, ownership dispute, lien, setoff, consumer-credit exemption election, or prior order. C021–C026.
Adverse branch: If the account is used as a business account, the $5,000 personal-use branch may not apply.
Missing records: All account statements, other accounts, source of funds, exemption election, ownership, creditor claim, and court order.
Example 2 — Coded federal benefit deposits; entire balance protected
Facts
- Account review: Wednesday, November 18, 2026.
- Lookback period: Tuesday, November 17 through Thursday, September 17.
- Qualifying coded benefit deposits in that period: $2,400.
- Balance at review: $1,900.
- No Appendix B notice.
Calculation
Protected amount = min($2,400, $1,900) = $1,900.
Conditional result
The full $1,900 is automatically accessible and cannot be frozen under the ordinary order. Because there are no funds above the protected amount, the federal excess-funds notice is not required. C030–C039.
Missing facts: Actual ACH codes, order, account-holder identity, bank review time, and any post-review transactions.
Example 3 — Coded benefits plus $500 excess
This mirrors the structure of Appendix C’s official example.
Facts
- Review date: Wednesday, December 2, 2026.
- Lookback: Tuesday, December 1 through Thursday, October 1.
- Coded benefits: $4,500.
- Balance at review: $5,000.
Calculation
- Protected: min($4,500, $5,000) = $4,500.
- Excess: $5,000 − $4,500 = $500.
Conditional result
The bank preserves access to $4,500, may freeze the $500 under otherwise applicable state procedure, and must issue the federal notice within three business days after review. The $500 may still be subject to another federal or Wisconsin exemption. C038–C043. eCFR+1
Example 4 — Older benefit funds outside the automated lookback
Facts
- Account contains $3,200 traceable to Social Security deposited more than two months before review.
- No qualifying coded benefit deposit occurred in the federal lookback period.
- No Appendix B notice.
Result
The bank does not establish an automatic protected amount under §212.6. It follows ordinary garnishment procedures. But §212.8 and 42 U.S.C. §407 preserve the possibility of a broader federal exemption for the older funds. The account holder may need to claim and trace them in the Wisconsin proceeding. C037, C040, C047.
Adverse branch: If the funds were spent, transferred through multiple accounts, commingled beyond provable tracing, or converted into other property, the exemption analysis may change.
Example 5 — Benefit paid by paper check
Facts
- A $1,500 Social Security check is deposited manually.
- The deposit lacks the ACH coding required by part 212.
- Account balance at review: $1,700.
Result
The manual deposit does not qualify as a part 212 “benefit payment” for the automatic review. Nevertheless, §407 may still protect identifiable benefit funds. The bank’s automated system and the court’s underlying exemption decision are separate. C030, C037, C047.
Missing records: Check image, source, deposit date, transaction history, commingling, and exemption claim.
Example 6 — Wages deposited before bank garnishment
Facts
- Employer paid wages to the debtor.
- Debtor deposited the paycheck into a checking account.
- Bank later received a non-earnings garnishment.
- No federal benefit deposits.
Result
The federal CCPA earnings percentage does not automatically follow the wages into the bank account. The account must instead be tested under the Wisconsin deposit-account exemption and any other applicable source-specific protection. C027. Justia Law
Adverse branch: A Wisconsin exemption may still protect some or all funds; this result does not make every deposited wage dollar garnishable.
Example 7 — Joint account and nondebtor ownership claim
Facts
- Joint account balance: $9,000.
- Order names only Debtor A.
- Co-owner B claims that $7,000 belongs exclusively to B.
- Coded benefits totaling $4,000 for B were deposited during the federal lookback.
Federal automated review
Part 212 disregards the existence of the co-owner and the identity of the benefit recipient when calculating the automated protected amount. If the $4,000 coded benefits remain within the balance, the federal review can protect that amount mechanically. C035–C039.
Wisconsin ownership layer
The remaining balance is subject only to the extent of A’s actual interest. B’s ownership can be identified in the bank’s answer or litigated through the third-party-claim procedure. C015, C019, C028.
Adverse branch: Federal mechanical protection does not judicially establish ownership of the unprotected excess.
Example 8 — Debtor claims Wisconsin deposit exemption
Facts
- Bank holds $6,400.
- Debtor receives the summons and files the official answer within the stated 20-day period.
- Debtor claims $5,000 under the personal deposit-account exemption.
- Creditor contests whether the account is used for business.
Process
- Bank discloses the account and exemption claim.
- Funds remain held pending disposition.
- Creditor can contest through the reply/objection process.
- Court decides use, aggregate equity, election, and amount.
- Court’s order directs payment or release.
Conditional arithmetic: If the exemption applies in full and there are no other accounts, potentially nonexempt funds are $6,400 − $5,000 = $1,400.
C011–C018, C021–C026.
Example 9 — Garnishee fails to answer
Facts
- Bank was properly served and paid the $3 fee.
- No answer is filed within the reproduced 20-day period.
Result
The bank is exposed to a default judgment measured by the creditor’s underlying judgment and allowable costs, subject to legally sufficient default procedure. The bank’s silence does not prove that it held the debtor’s full judgment amount. C008, C011, C014.
Missing facts: Service, fee payment, excusable neglect, notice of motion, actual account balance, and any federal protected amount.
Example 10 — Federal review clock and account-holder notice
Facts
- Ordinary garnishment order received Monday, November 2, 2026.
- Order contains no Appendix B notice.
- Order includes enough information to identify the account holder.
- Review occurs Wednesday, November 4.
- The review establishes protected and excess funds, so notice is required.
- Assume “business day” means Monday through Friday and no holiday intervenes.
Modeled federal deadlines
- Order/Appendix B examination: no later than Wednesday, November 4.
- Account review: no later than Wednesday, November 4.
- Three business days after Wednesday review:Thursday, November 5 — day 1Friday, November 6 — day 2Monday, November 9 — day 3
Modeled notice deadline: Monday, November 9, 2026.
The provisions read do not define “business day”; this is an explicit modeling convention, not an individualized deadline. C033–C034, C043.
Example 11 — Two orders and bank setoff claim
Facts
- Bank receives Order 1, performs the federal review, and establishes a protected amount.
- The same Order 1 is served again.
- Later, a genuinely new Order 2 arrives.
- Bank also asserts a contractual setoff.
Federal result
- No new review for re-service of Order 1.
- New review for Order 2.
- No continuing freeze of future deposits under Order 1 alone. C041.
Wisconsin result
The bank discloses its setoff and competing-order facts in its answer. Priority, setoff validity, and ownership require separate adjudication. C011, C028.
Example 12 — United States or child-support Appendix B order
Facts
- A federal agency or state child-support enforcement agency attaches the exact Appendix B notice on official letterhead.
- The notice identifies qualifying statutory authority.
Result
The bank does not apply §§212.5 and 212.6 and instead follows the order and otherwise applicable law. This does not mean every federal benefit is substantively reachable under every federal or support order; the authority and benefit-specific exception still matter. C033, C050. eCFR

28. PASS-08 D5 crosswalk
| Prior reviewed row |
PASS-13 disposition |
Status |
| P08 D5: “Earnings and non-earnings garnishment — Mechanisms and exemptions deferred.” |
Ordinary consumer-judgment non-earnings garnishment of deposit accounts is now researched in PASS-13 |
Separately reviewable; not retroactively accepted in P08 |
| Earnings component |
Remains in saved PASS-11, which is unreviewed |
No PASS-11 conclusion adopted |
| P08 D6 execution levy, sheriff sale, and priority |

29. Evidence-backed article and tool opportunities
A. Wisconsin bank-garnishment process map
A safe article can distinguish:
- filing a separate garnishment action;
- bank implementation and answer;
- debtor answer and exemption claim;
- creditor reply or objection;
- third-party ownership claim;
- court disposition; and
- actual release or payment order.
B. Deposit-account exemption checklist
A checklist should ask:
- Wisconsin residency;
- personal versus business use;
- all deposit accounts and aggregate equity;
- spouse or co-owner interests;
- source-specific exemptions;
- consumer-credit exemption election;
- judgment creditor’s lien or purchase-money claim;
- setoff or other bank lien; and
- whether the exemption was timely claimed.
C. Federal benefit protected-amount calculator
A conditional tool can accept:
- account-review date;
- qualifying coded deposits during the statutory lookback;
- account balance at review;
- whether an Appendix B notice accompanied the order; and
- whether a new or previously reviewed order is involved.
Its output should show:
protected amount = min(qualifying coded deposits, review-time balance)
It must separately warn that older, paper-check, transferred, or excess benefit funds may retain a legal exemption outside the automated amount.
D. Clock checklist
A procedural checklist can display, without calculating a real case:
- Wisconsin 60-day commencement/service limit;
- 10-day debtor-service sequence;
- 20-day garnishee answer;
- 20-day debtor answer;
- 20-day creditor reply to garnishee answer;
- Wisconsin financial-institution implementation ceiling;
- federal two-business-day Appendix B/account review;
- federal three-business-day notice; and
- two-year federal record retention.
No tool, form, package, calculator, or publication was built or approved in this pass.

The key PDF page images listed in the source register were visually inspected. No form was completed or submitted.
Currentness and evidence limits
- The official integrated current chapter 812 body was not rendered.
- The official integrated current §815.18 body was not rendered.
- The $5,000 amount is supported by an official Legislature snippet and current official court forms, with a reproduced statutory body supplying the surrounding conditions.
- No commercial citator, comprehensive unpublished-order search, or 72-county survey was performed.
- No absence conclusion is based solely on a failed source.
Calculation check
The numerical examples used only stipulated amounts:
- $8,000 − $5,000 = $3,000;
- min($2,400, $1,900) = $1,900;
- min($4,500, $5,000) = $4,500;
- $5,000 − $4,500 = $500; and
- $6,400 − $5,000 = $1,400.
None establishes an actual exemption, bank balance, judgment amount, creditor right, fee, award, or release.

The modeled federal dates are correct under the stated Monday-through-Friday/no-holiday convention:
- November 2, 2026 was Monday;
- November 4 was Wednesday;
- November 9 was Monday;
- November 18 was Wednesday;
- the corresponding lookback endpoints used were September 17 and October 1.
Part 212 did not supply a “business day” definition in the provisions read. The examples are conditional models, not actual deadlines.
