P3 cross-reference correction and original-enactment/formal-conflict component

Fresh public-web access session: October 25, 2026 UTC / October 24, 2026 Pacific Mode: Regular Chat Model: GPT-5.6 Sol Pro, authorized quality-first fallback Review posture: Focused work by the same coordinator; not an independent review

PASS-01, PASS-02, and PASS-03 remain preserved. This pass does not rerun their fees, examples, federal context, Chapter 33 section matrix, operational directories, administrative-code file failures, or broader Louisiana coverage.

Part A — exact correction to P3 claim C023

Claim ID Precise assertion Corrected source cross-reference Conditions and confidence limits
S_LA-P3-C023 No named provider was shown to possess current Louisiana Chapter 33 authority. S_LA-P3-S031–S033 and S_LA-P3-S037 High-confidence evidence limitation: the public licenses directory, Boards and Commissions directory, and bounded official-domain searches did not produce a named-provider authorization record. Those routes were nonexhaustive, and no provider-specific audit was undertaken.

Reason for correction: P3-S019 is R.S. 37:13, concerning residual Department of Occupational Standards advisory and field-force architecture. It is not provider-status or directory evidence. P3-S031 is the Louisiana licenses directory; P3-S032 and S033 are the Boards and Commissions landing page and entity list; P3-S037 is the bounded official-domain search set. Those are the actual records supporting the limited claim.

This is a source-cross-reference correction only. It does not alter C023’s meaning, prove that no provider is licensed, establish that no license can issue, or rewrite the immutable P3 source and claim history.

Part B — original enactments and formal conflict

1. Bounded result

The original 1970 and 1972 session acts were not recovered and read. Consequently, this pass cannot establish whether Acts 1970, No. 423 or Acts 1972, No. 451 contained a noncodified repealer, savings clause, transition provision, special effective-date provision, or other operative language that resolves the apparent conflict.

The evidence does establish the following:

  1. The published Chapter 33 history attributes R.S. 37:2581–2600 to Acts 1970, No. 423.
  2. The published R.S. 14:331 history attributes that prohibition to Acts 1972, No. 451, §§1–3.
  3. No Chapter 33 provision previously read expressly mentions R.S. 14:331, overrides it, or gives a Chapter 33 licensee an express R.S. 14:331 exception.
  4. A 2013 bill proposed repealing both regimes and replacing them with a new debt-relief statute, but the bill failed House final passage. Louisiana law expressly says an introduced bill that does not become law is not competent evidence of legislative intent.
  5. A newly enacted 2026 money-transmission statute expressly uses R.S. 14:331’s definition and subsection C permission structure. It says a money-transmission license cannot authorize, facilitate, or expand debt-adjusting activities. This confirms present legislative reliance on R.S. 14:331 for that specific regulatory layer, but it does not resolve Chapter 33’s separate facial licensing architecture.
  6. No Louisiana court opinion, Attorney General opinion, declaratory ruling, or other formal interpretation directly resolving R.S. 14:331 versus R.S. 37:2581–2600 was recovered from the bounded official searches.

The resulting classification remains:

Express reconciliation unresolved. Chapter 33 presents a facial licensing architecture, while R.S. 14:331 presents a separate prohibition with its own exceptions. No primary authority recovered in PASS-04 authorizes treating a Chapter 33 license as an exception to R.S. 14:331.

That is not a holding that Chapter 33 was impliedly repealed, that the statutes cannot be harmonized, that either regime is unconstitutional or dormant, or that a modern provider may or may not operate.

2. Facial statutory relationship

2.1 Chapter 33

Previously reviewed R.S. 37:2582 defines “financial planning and management service” around:

  • Planning and managing an individual’s financial affairs and distributing money to creditors; or
  • Acting as the individual’s agent in distributing income to creditors;
  • Whether or not the person receives a fee.

R.S. 37:2583 then makes it unlawful to engage in the Chapter-defined business without the Chapter-prescribed license. Other Chapter 33 sections establish application, bond, issuance, renewal, contract, fee, remittance, investigation, and enforcement architecture. These are reused PASS-02 findings, not new PASS-04 section readings. (legis.la.gov) Louisiana Legislature

2.2 R.S. 14:331

Previously reviewed R.S. 14:331 prohibits engaging in debt adjusting except as otherwise provided in that provision. Its definition covers both:

  • Periodic debtor-payment arrangements in which the provider distributes value among specified creditors for consideration; and
  • Fee-based contracts to adjust, compromise, or discharge debt, or to receive value from a debtor and disburse it to creditors.

Subsection C supplies nine conditional exclusions. A Chapter 33 licensee is not listed as an exclusion merely because it holds that license. (legis.la.gov) Louisiana Legislature

2.3 Direct overlap

The clearest overlap is a fee-charging provider that receives an individual’s money and distributes it among creditors:

  • Chapter 33 facially contemplates licensing that distribution-centered service.
  • R.S. 14:331 facially includes the same type of compensated distribution arrangement in “debt adjusting.”
  • R.S. 14:331(C) contains no express “licensed under Chapter 33” exception.

That is a genuine textual tension. It cannot be eliminated merely by labeling one statute “licensing” and the other “criminal.”

2.4 Areas that may not overlap completely

The texts also have possible non-overlapping applications:

Activity Chapter 33 published text R.S. 14:331 published text PASS-04 boundary
No-fee management plus creditor distribution Expressly included because Chapter 33 applies whether or not a fee is charged The definition’s relevant branches use consideration or fee concepts Possible Chapter 33-only space; no operational permission conclusion
Fee-based receipt and creditor distribution Covered Covered Strongest facial overlap and conflict
Fee-based principal-reduction negotiation without receiving or distributing funds Not clearly within Chapter 33’s distribution-centered definition Expressly may fall within adjustment, compromise, or discharge language Possible R.S. 14:331-only or broader space; modern classification remains later work
Nonprofit debt management Chapter 33 has its own exclusion R.S. 14:331 has a separate nonprofit/charitable exclusion Elements must be satisfied independently; lists are not merged
Attorney, bank, fiduciary, employer, or other excluded conduct Chapter-specific exclusion language Separate R.S. 14:331(C) language No automatic cross-statute equivalence

These possible areas of separate operation may matter to a future harmonization analysis, but they do not resolve the overlapping fee-based distribution model.

3. Original 1970 and 1972 enactment investigation

3.1 Acts 1970, No. 423

The Law Library of Louisiana’s official legislative-acts guide identifies two 1970 regular-session volumes and links them through HathiTrust. The previously recorded Volume I and II routes were:

Those viewers were already inaccessible in PASS-02 and were not retried. The Law Library guide was read only to confirm the official location and volume structure. (lasc.libguides.com) Law Library of Louisiana

No materially new public route produced the text of Act 423. Searches for the act number and relevant statutory phrases returned current codified sections, not the original act.

Therefore, the following remain unknown:

  • Act 423’s complete title and enacting clauses.
  • Any general or specific repealer.
  • Any savings clause.
  • Any uncodified transition or implementation provision.
  • Its complete effective-date language.
  • Whether any act section was omitted from current codification.
  • Whether the act addressed other debt-adjusting statutes then in existence.

The current code’s attribution to Act 423 supports codifier history, not a complete original-enactment audit.

3.2 Acts 1972, No. 451

The Law Library’s 1972 guide identifies:

  • Volume I, regular session.
  • Volume II, regular and extraordinary sessions.

Its HathiTrust links resolved to:

Both redirected to HathiTrust viewers that were inaccessible through the available public-web tool. They were not bypassed or retried. (lasc.libguides.com) Law Library of Louisiana

The original Act 451 was therefore not read. In particular, the notation “§§1 to 3” in R.S. 14:331’s history cannot safely be treated as proof that all three original sections are embodied in the presently displayed statute. Without the act, it remains unknown whether one of those sections contained:

  • An express repeal of some or all of Act 423.
  • A savings clause for then-existing licenses or contracts.
  • A delayed or conditional effective date.
  • A separate offense, enforcement, or transition clause.
  • Other noncodified operative language.

The sequence “1970 licensing chapter, then 1972 prohibition” is supported by the published history lines. The legal effect of that sequence is not resolved without the original enactments or controlling interpretation.

3.3 Other archive routes

The University of Pennsylvania Online Books Page identifies Acts Passed by the Legislature of the State of Louisiana as the official legislative-act record but provides no accessible 1970 or 1972 complete issue through that catalog page. (onlinebooks.library.upenn.edu) [Online Books

A bounded State Library/public-digital-archive search also did not recover either act’s body. It produced catalog or holdings references rather than readable Act 423 or Act 451 text. This is a failed public-route result, not proof that no accessible copy exists elsewhere.

4. Later enactment evidence

4.1 Failed 2013 HB 567

The original version of 2013 HB 567 proposed a new Title 51 debt-management and debt-settlement regime and proposed repealing both:

  • R.S. 14:331; and
  • R.S. 37:2581–2600.

The official bill history shows that HB 567 failed House final passage on May 8, 2013, by 18 yeas to 70 nays, and reconsideration was tabled. (legis.la.gov; bill history) Louisiana Legislature+1

R.S. 24:177(D) expressly provides that a bill introduced but not enacted is not competent evidence of legislative intent. The failed proposal therefore cannot establish:

  • That the Legislature believed both existing statutes were operative.
  • That one had repealed the other.
  • That either statute was obsolete.
  • That the proposal’s replacement structure states current law.

At most, HB 567 is a historical record that a proposed replacement and dual repeal was considered and rejected procedurally. It does not resolve current meaning. Louisiana Legislature

4.2 Enacted 2026 Act 888

Act 888 of 2026, originating as HB 1230, enacted a new Louisiana Money Transmission Act. Its R.S. 6:1055 provides, in relevant part:

  • A person may not engage in money transmission when it is undertaken for debt adjusting “as defined in R.S. 14:331.”
  • The covered activity includes direct or indirect roles as agent, processor, custodian, or intermediary and receipt, holding, distribution, or disbursement of debtor funds.
  • Anti-evasion provisions address divided functions, relabeling debtor funds as fees, and pooled, pass-through, trust, custodial, or similar accounts.
  • The provision preserves activities “expressly permitted pursuant to R.S. 14:331(C).”
  • A money-transmission license may not authorize, facilitate, or expand debt-adjusting activity. (legis.la.gov, enrolled Act 888, R.S. 6:1055(B)–(E), PDF pp. 37–38) Louisiana Legislature+3

The official bill history shows gubernatorial signature on June 9, 2026, Act 888 status, and a July 1, 2026 effective date. Section 8 of the enrolled act states the same effective date. (legis.la.gov) Louisiana Legislature+1

Effect of the 2026 enactment

This enacted provision establishes a narrow but consequential point:

For the money-transmission layer, a money-transmission license is not an independent authorization for debt adjusting. The statute directs the inquiry back to R.S. 14:331 and, expressly, to the activities permitted by subsection C.

It does not:

  • Mention Chapter 33.
  • Add Chapter 33 licensees to R.S. 14:331(C).
  • Repeal or amend R.S. 37:2581–2600.
  • Resolve whether a particular Chapter 33 activity is “money transmission.”
  • Resolve noncustodial negotiation models.
  • Establish that Chapter 33 has a current administrator.
  • Decide the broader statutory conflict.

As an inference, Act 888 materially weakens any unsupported characterization of R.S. 14:331 as an obsolete or ignored provision: the 2026 Legislature affirmatively incorporated it into newly enacted law. That inference is limited to legislative use of the statute, not judicial validation of every possible application.

Transition

Section 3(A) provides that a person already licensed for money transmission is not subject to provisions that conflict with, or create new requirements beyond, prior law until:

  • The current license is renewed; or
  • Twelve months after July 1, 2026;

whichever is later. PASS-04 does not decide which aspects of R.S. 6:1055 qualify as new or conflicting requirements for a particular licensee. (legis.la.gov, §3(A), PDF p. 62) Louisiana Legislature

5. Original 2001 Act 8 attribution

5.1 Current published attribution

Current R.S. 36:4.1(D) says the Department of Occupational Standards is abolished and its powers, duties, functions, and responsibilities are transferred to the governor through the commissioner of administration. Its history line attributes that provision to Acts 2001, No. 8, §11, effective July 1, 2001, among later amendments. This remains supported as current published statutory text and history, not as an original-act audit. (legis.la.gov) Louisiana Legislature

5.2 Contemporaneous official legislative records

The April 4, 2001 Official House Journal identifies HB 1448 and records House Committee Amendment No. 17 inserting language that:

  • Abolished the Department of Occupational Standards, identified by R.S. 37:1–15.
  • Transferred its powers, duties, functions, and responsibilities to the governor through the commissioner of administration.
  • Directed that those functions thereafter be exercised under the general abolished-agency transfer provisions. (house.louisiana.gov, journal PDF pp. 15–17) Louisiana House+2

The April 26, 2001 Official House Journal records HB 1448’s return with Senate amendments and House concurrence by 100–0. The displayed Senate amendment package included lettering and other organizational changes but did not, in the recovered passage, delete the Department of Occupational Standards transfer. (house.louisiana.gov, journal PDF pp. 25–28) Louisiana House+2

An official Louisiana Department of Revenue list of 2001 enrolled bills identifies Act 8 / HB 1448 and gives an effective date of July 1, 2001. (dam.ldr.la.gov, PDF p. 1) Louisiana Dam Safety+1

5.3 Precise qualification of P3-C002

P3-C002 may now be stated more precisely:

The present R.S. 36:4.1 history attributes the transfer to Acts 2001, No. 8, §11, effective July 1, 2001. Contemporaneous official House Journals corroborate the HB 1448 abolition-and-transfer wording and final House concurrence, and an official Department of Revenue enrolled-bill list identifies HB 1448 as Act 8 effective July 1, 2001. The enrolled Act 8 itself was not recovered and read.

This is substantial corroboration, but still not a complete original-act audit.

Nothing recovered in these records expressly states that the Chapter 33 “Division of Occupational Standards” was organizationally identical to the abolished “Department of Occupational Standards,” or expressly assigns Chapter 33 to a current office. The PASS-03 operational hold remains intact.

6. Controlling interpretation framework

6.1 Primary statutory construction provisions

Louisiana Civil Code article 9 requires a clear, unambiguous law producing no absurd consequences to be applied as written. Article 13 requires laws on the same subject to be interpreted in reference to one another. Article 8 recognizes express and implied repeal and limits implied repeal to provisions that are contrary to or irreconcilable with the earlier law. (legis.la.gov; article 13; article 8) Louisiana Legislature+2

R.S. 1:12 says that the classification and placement of Revised Statute sections creates no implication or presumption of legislative construction. Therefore, placement of one regime in Title 14 and the other in Title 37 does not itself resolve their relationship. (legis.la.gov) Louisiana Legislature

R.S. 24:177 provides that statutory text is the best evidence of intent; allows consideration of specified contemporaneous legislative history when meaning cannot otherwise be ascertained; presumes a new statute is enacted in light of preceding same-subject law and relevant decisions; and rejects failed bills as competent evidence of intent. Louisiana Legislature

6.2 Silver Dollar Liquor

In Silver Dollar Liquor, Inc. v. Red River Parish Police Jury, No. 2010-C-2776 (La. Sept. 7, 2011), the Louisiana Supreme Court considered two statutes governing Sunday alcohol regulation. It affirmed the court of appeal and held the alcohol-specific provision controlling to the extent of conflict. The Court stated that implied repeals are disfavored and arise only when two enactments are irreconcilably inconsistent or repugnant; it otherwise sought to harmonize statutes that operated in separate realms. (lasc.org, majority pp. 1, 13–15) LASC+2

Scope: This is controlling Louisiana Supreme Court authority on general statutory construction. It did not address debt adjustment, Chapter 33, or R.S. 14:331.

Bounded application: A court confronting the Louisiana debt-adjustment statutes would first test whether they can operate in separate applications and whether any overlap is irreconcilable. Silver Dollar does not determine which debt-adjustment provision would be treated as more specific or whether partial implied repeal occurred.

6.3 Pickard v. Amazon.com

In Pickard v. Amazon.com, Inc., No. 2023-CQ-01596 (La. June 28, 2024), the Louisiana Supreme Court answered certified questions from the Western District of Louisiana. In discussing in-pari-materia construction, the Court explained that laws concern the same subject when they relate to the same persons or things, the same class, or a common purpose; laws with distinct and unconnected scope and aim are not treated that way. It also repeated R.S. 1:12’s rule that code placement creates no construction presumption. (lasc.org, majority pp. 1, 7–9, 16) LASC+3

Scope: This is controlling general construction authority arising from a products-liability case. It does not interpret either Louisiana debt-adjustment regime.

Bounded application: Chapter 33 and R.S. 14:331 plainly involve overlapping persons and conduct in the creditor-distribution branch, making article 13 relevant as a construction framework. Whether the statutes share the same scope and purpose in every application remains unresolved.

6.4 What the general rules do—and do not—permit here

The general authorities support this sequence of analysis:

  1. Apply unambiguous text where possible.
  2. Identify genuinely overlapping conduct.
  3. Read same-subject provisions together.
  4. Preserve separate fields of operation where reasonably possible.
  5. Find implied repeal only for irreconcilable provisions.
  6. Apply a more-specific provision to a conflict only after determining which provision is more specific in the relevant setting.

They do not permit this report to choose among the following outcomes without the original enactments or a directly controlling decision:

  • Chapter 33 survives completely as an exception to R.S. 14:331.
  • R.S. 14:331 impliedly repealed all of Chapter 33.
  • R.S. 14:331 partially superseded Chapter 33 only for compensated services.
  • Chapter 33 applies only outside R.S. 14:331’s prohibited-for-profit field.
  • The two statutes are irreconcilable and require judicial or legislative correction.

7. Court, Attorney General, and formal-interpretation search

7.1 Court decisions

Bounded searches were conducted for exact references to:

  • R.S. 14:331
  • La. R.S. 14:331
  • R.S. 37:2581
  • R.S. 37:2582
  • R.S. 37:2592
  • Financial Planning and Management Service Law
  • debt adjusting

The searches covered the Louisiana Supreme Court official opinion domain and several official Louisiana appellate-court domains. No directly responsive published opinion resolving the relationship between R.S. 14:331 and Chapter 33 was recovered.

This is a bounded search result. It is not a representation that every reported, unpublished, trial-court, historical paper, or commercial-database decision was searched.

7.2 Attorney General opinions

The Louisiana Attorney General’s official opinions page says its opinions are advisory, do not carry the force of law, are fact-bound, and may be revised following legislative or judicial developments. (ag.state.la.us) Louisiana Attorney General

Official-domain searches were conducted using:

  • R.S. 14:331
  • debt adjusting
  • debt adjuster
  • Financial Planning and Management Service
  • credit and financial adjusting
  • R.S. 37:2581
  • R.S. 37:2592
  • debt management service

No responsive public Attorney General opinion was recovered.

The Attorney General’s internal search form was not submitted through browser control, no opinion request was made, and no conclusion is drawn that no responsive opinion exists.

7.3 Agency declaratory rulings and formal interpretations

No public declaratory ruling, formal interpretive bulletin, adjudication, enforcement order, or successor-agency statement directly addressing the two statutes was recovered. PASS-03’s unresolved rules, office, forms, registry, and administrator findings remain unchanged.

10. PASS-04 claim register

Claim ID Precise assertion Sources and pinpoint Conditions, exceptions, and confidence limits
S_LA-P4-C001 P3-C023’s correct evidence is P3-S031–S033 and P3-S037, not P3-S019. P4-S024; immutable P3 records High; source-reference correction only
S_LA-P4-C002 Published histories place Chapter 33 in Act 423 of 1970 and R.S. 14:331 in Act 451 of 1972. P4-S001–S002 High for published history lines; not an original-act audit
S_LA-P4-C003 No previously read Chapter 33 section expressly references, overrides, or creates a licensee exception to R.S. 14:331. P4-S001–S002; P2 complete chapter reading High as bounded textual finding
S_LA-P4-C004 Fee-based receipt and distribution of debtor funds is the clearest conduct facially covered by both regimes. P4-S001–S002 High for textual overlap; application to facts requires classification
S_LA-P4-C005 The statutes also have possible separate fields: Chapter 33’s no-fee distribution language and R.S. 14:331’s broader fee-based compromise language. P4-S001–S002 Supported textual comparison; not a permission holding
S_LA-P4-C006 Original Acts 1970 No. 423 and 1972 No. 451 were not recovered or read. P4-S004–S007 Explicit unresolved gap
S_LA-P4-C007 Without the original acts, noncodified repealers, savings clauses, transitions, effective conditions, and omitted clauses cannot be ruled in or out. P4-S004–S007 High-confidence evidence limitation
S_LA-P4-C008 2013 HB 567 proposed repealing both regimes and replacing them, but failed House final passage. P4-S013–S014 High for proposal and status
S_LA-P4-C009 Failed HB 567 is not competent evidence of legislative intent under R.S. 24:177(D). P4-S019 High; proposal may be described historically but not used to construe existing law
S_LA-P4-C010 Act 888 of 2026 expressly incorporates debt adjusting “as defined in R.S. 14:331” into the money-transmission prohibition. P4-S015, R.S. 6:1055(B)–(C) High; applies to money-transmission layer
S_LA-P4-C011 Act 888 preserves activities expressly permitted by R.S. 14:331(C) and says a money-transmission license cannot authorize, facilitate, or expand debt adjusting. P4-S015, R.S. 6:1055(E) High for text; does not classify a specific provider
S_LA-P4-C012 Act 888 became effective July 1, 2026, with a transition for existing money-transmission licensees tied to renewal or twelve months after that date, whichever is later. P4-S015 §3(A), §8; P4-S016 High for text; applicability to a particular requirement remains fact- and license-dependent
S_LA-P4-C013 Act 888 is strong current evidence of legislative use of R.S. 14:331 but does not reconcile or repeal Chapter 33. P4-S015–S016 Supported inference; not a court holding
S_LA-P4-C014 Current R.S. 36:4.1’s Act 8 attribution is corroborated by contemporaneous House Journals and an official enrolled-bill list. P4-S008–S011 High for corroboration; enrolled Act 8 remains unread
S_LA-P4-C015 No recovered 2001 instrument expressly equates Chapter 33’s Division with the abolished Department or assigns Chapter 33 to a current office. P4-S008–S012 High-confidence evidence limitation
S_LA-P4-C016 Civil Code article 8 and Silver Dollar make implied repeal dependent on irreconcilable conflict and disfavor inferring repeal where statutes can operate separately. P4-S017, P4-S020 High as general law; no direct application adjudicated
S_LA-P4-C017 Civil Code article 13 and Pickard supply the same-subject framework, while R.S. 1:12 bars reliance on code placement. P4-S017–S018, P4-S021 High as general law
S_LA-P4-C018 General construction rules do not identify which debt-adjustment provision is more specific in the overlapping fee-distribution setting. P4-S017–S021 High as a limitation; requires direct adjudication or stronger enactment evidence
S_LA-P4-C019 No directly responsive controlling court opinion was recovered in the bounded official searches. P4-S020–S023 Search limitation, not proof no decision exists
S_LA-P4-C020 No responsive public AG opinion, declaratory ruling, or formal agency interpretation was recovered. P4-S022–S023 Search limitation; AG opinions would be advisory in any event
S_LA-P4-C021 The facial statutory conflict remains unresolved for overlapping compensated distribution activity. P4-C002–C020 High-confidence bounded conclusion
S_LA-P4-C022 PASS-04 establishes no current office, form, registry, provider authorization, modern-model permission, or fee-collection approval. Scope plus P3/P4 evidence High; all operational and provider-specific holds remain
S_LA-P4-C023 Title 37’s full currency through the 2026 Regular Session remains unverified. P4-S003 High for currentness limitation; no no-amendment inference
S_LA-P4-C024 The evidence does not support declaring either Chapter 33 or R.S. 14:331 repealed, dormant, unenforceable, or wholly controlling across every model. P4-C002–C023 High-confidence boundary statement
