Remaining Chapter 33 operational-administration and rules evidence
Actual access date: October 25, 2026, Pacific
Model: GPT-5.6 Sol Pro, authorized quality-first fallback
Review posture: Focused continuation by the same coordinator; not an independent review
Scope: Operational succession, administrative rules, current forms, filing instructions, and public licensing evidence for Louisiana R.S. 37:2581–2600 only
PASS-01 and PASS-02 remain preserved. Their fee calculations, examples, source and claim tables, statutory-conflict hold, Title 37 currentness hold, and all broader Louisiana gaps are unchanged.

The strongest new primary evidence is current R.S. 36:4.1(D). It states that the Department of Occupational Standards “is hereby abolished” and its functions are “transferred to the governor, through the commissioner of administration,” to be exercised under R.S. 36:921 et seq. The section history attributes that transfer to Acts 2001, No. 8, §11, effective July 1, 2001, with later amendments through 2025. Louisiana Legislature
That establishes a general department-level statutory successor. It does not, on the evidence recovered here, establish a currently operating Chapter 33 licensing unit. The transfer provision identifies the abolished department parenthetically by its organic provisions, R.S. 37:1–15; it does not expressly name R.S. 37:2581–2600. More importantly, Chapter 33 defines its actor as the director of the Division of Occupational Standards, while R.S. 36:4.1 abolishes the Department of Occupational Standards. No transfer order, organization plan, rule, or authoritative operational document was recovered that expressly equates those two entities or assigns the Chapter 33 function to a current office.
Accordingly:
The office of the governor through the commissioner of administration is the verified general statutory transferee of the abolished Department of Occupational Standards, but the current Chapter 33 administering office and operational license pathway remain unverified.
This is not a conclusion that Chapter 33 is repealed, dormant, unavailable, or currently administered by no one.
2. Agency succession and present-actor analysis
2.1 Express 2001 statutory transfer
R.S. 36:4.1 supplies the following legal structure:
- For agencies transferred or placed under that section, “Department” means the office of the governor.
- “Secretary” means the governor through the commissioner of administration.
- “Undersecretary” means the commissioner of administration.
- The Office of Financial Institutions is separately placed within the office of the governor under its own statutory authority.
- The Department of Occupational Standards, identified parenthetically by R.S. 37:1–15, is abolished and its functions transferred to the governor through the commissioner of administration under R.S. 36:921 et seq. Louisiana Legislature
The separate treatment of the Office of Financial Institutions is important. Nothing in R.S. 36:4.1 assigns Chapter 33 to OFI merely because Chapter 33 concerns financial services. OFI cannot be substituted as the licensing authority by subject-matter resemblance alone.
2.2 General consequences under R.S. 36:921–927
R.S. 36:921 places an abolished agency’s powers, duties, functions, programs, and operations under the secretary of the transferee department. The secretary may assign those functions to the undersecretary, another transferred agency, an office within the department, or another legally consistent administrative arrangement. Louisiana Legislature
R.S. 36:922 provides that pending business is taken over by the transferee and that the transferee department and secretary become the abolished agency’s successor. R.S. 36:923 generally substitutes the transferee department or secretary for references to an abolished agency in laws, contracts, and other documents. Louisiana Legislature+1
R.S. 36:924–927 continue or transfer, as applicable:
- Pending legal proceedings and related documents.
- Existing obligations.
- Books, papers, records, money, property, and related assets.
- Employees deemed necessary by the receiving secretary. Louisiana Legislature+3
These are meaningful continuity provisions, but they remain general transfer mechanics. They do not identify which modern office, division, employee, or public portal presently performs Chapter 33 licensing.
2.3 Why R.S. 36:923 does not close the Chapter 33 actor gap
R.S. 36:923 replaces references to an abolished agency with references to the transferee department or secretary. Chapter 33, however, defines “director” as the director of the Division of Occupational Standards, not the director of the Department of Occupational Standards.
A possible interpretation is that the Division was part of the abolished Department and its Chapter 33 functions therefore followed the Department’s general transfer. But PASS-03 did not recover:
- A statute identifying the Chapter 33 Division as a component of that Department.
- A governor-approved division organization under R.S. 37:7.
- A departmental organization plan under R.S. 37:8.
- An assignment by the governor or commissioner under R.S. 36:921.
- An administrative rule, order, or public program document expressly assigning Chapter 33.
- A current application or registry identifying the administering office.
Applying R.S. 36:923 directly to the Chapter 33 “Division” reference would therefore require an unverified organizational premise. PASS-03 does not make that inference as a settled conclusion.
2.4 Residual Title 37 organizational text
The current published Title 37 still contains provisions that:
- Create a Department of Occupational Standards.
- Establish a director and divisions.
- Allow internal combination, division, renaming, and reassignment of divisions.
- Require an organizational plan and standard practice instructions.
- Authorize general departmental rulemaking.
- Describe broad licensing and regulatory functions.
- Address staff, receipts, appropriations, and reports. Louisiana Legislature+5
In particular:
- R.S. 37:7 permits the governor, on recommendation of the director, to authorize the combining, dividing, creation, renaming, and internal transfer of divisions and functions.
- R.S. 37:8 contemplates an organizational plan allocating functions to divisions.
- R.S. 37:9 authorizes the governor and director to prescribe administrative rules.
- R.S. 37:11 describes the Department’s general functions in relation to licensing and regulating professions and vocations, subject to listed exceptions. Louisiana Legislature+3
No actual organization plan, gubernatorial authorization, assignment instrument, standard practice instruction, or current annual report was recovered.
The result is a published-text coexistence:
- Title 37 retains organic provisions creating and organizing the Department.
- R.S. 36:4.1(D) expressly says that Department was abolished and its functions transferred.
PASS-03 does not decide how a court or agency would reconcile that residual text. It treats R.S. 36:4.1 as the express transfer evidence and the Title 37 provisions as historical or residual statutory architecture that does not itself prove a presently staffed Department.

3. Louisiana Administrative Code and rule-history investigation
3.1 Official rule corpus identified
The Louisiana Office of State Register states that it publishes the state’s rulemaking documents. Its Louisiana Administrative Code page describes the LAC as the state-certified publication of rules formally adopted or amended through promulgation in the Louisiana Register. The Office further states that finalized rules appear in the LAC, while proposed rules, emergency rules, final rules, and related notices appear in the monthly Register. Louisiana Division of Administration+2
The Office identifies three relevant research tools:
- The compiled Louisiana Administrative Code.
- The Administrative Code Update, which records LAC citations, actions, Register months, and page numbers.
- The Cumulative Index and the historical notes attached to LAC sections. Louisiana Division of Administration
These are the proper official routes for determining whether Chapter 33 rules were adopted, transferred, amended, or repealed.
3.2 Current LAC index result
The official current LAC index was successfully opened through the Louisiana Division of Administration’s doa.louisiana.gov host. It identifies, among other potentially relevant compilations:
- Title 4, Administration, last amended August 2026.
- Title 10, Financial Institutions, Consumer Credit, Investment Securities and UCC, last amended April 2024.
- Numerous separately indexed parts of Title 46, Professional and Occupational Standards. Louisiana Division of Administration+1
The official index contains no separately identified part titled:
- Financial Planning and Management Service.
- Financial Planning and Management Service Law.
- Debt Adjuster.
- Debt Management.
- Credit and Financial Adjusting.
Exact-term searches of the official index returned no matches for “Financial Planning,” “Debt Adjuster,” or “Debt Management.” “Occupational Standards” appeared only as the general subject label for the numerous profession-specific Title 46 parts. Louisiana Division of Administration+3
This establishes only that no standalone current LAC part bearing those names appears in the official index. It does not establish that no rule exists inside another title or generically named part.
3.3 Full-text access limitation
The current official compilations are linked as Microsoft Word documents. The following official files were opened through the public web tool but could not be parsed because that content type was unsupported:
No claim is made that these files were read. Title 46:XXXVII was also shown by the official index to concern embalmers and funeral directors, not Chapter 33. Louisiana Division of Administration
Because the relevant compilations were not full-text readable in the permitted public-web route, PASS-03 cannot make a corpus-wide negative finding.
3.4 Register archive and history search
The official Office of State Register archive was opened. It provides monthly Louisiana Register volumes from 1975 forward, including every month of 2001. The archive landing page itself contains no matching text for “Financial Planning,” “Debt Adjuster,” or “Occupational Standards.” Louisiana Division of Administration+4
The individual monthly issues and their cumulative indices were not all read. Therefore:
- No complete historical promulgation audit was performed.
- No conclusion is reached that Chapter 33 rules were never adopted.
- No conclusion is reached that any historical rules were repealed, transferred, or omitted.
- No rule effective date, historical LAC citation, or promulgating entity can be stated.
A search for “R.S. 37:2595” produced misleading results containing strings such as “LR 37:2595.” In those results, “LR 37:2595” means Louisiana Register volume 37, page 2595—not Revised Statutes section 37:2595. The returned material concerned education rules and was rejected as nonresponsive. Louisiana Division of Administration+1
3.5 Exact official-corpus searches performed
The following exact or near-exact searches were run against official Louisiana domains on October 25, 2026:
- "Financial Planning and Management Service"
- "Financial Planning and Management Service Law"
- "credit and financial adjusting"
- "debt adjuster" license Louisiana
- "R.S. 37:2595"
- "37:2581"
- "37:2582"
- "37:2584"
- "37:2585"
- "Division of Occupational Standards" "37:258"
- "Financial Planning and Management Service" license application
- "credit and financial adjusting" application
- "Division of Occupational Standards" "financial planning"
Searches were confined principally to:
- doa.la.gov
- doa.louisiana.gov
- louisiana.gov
- legis.la.gov
No responsive official rule, notice of intent, final rule, repeal notice, transfer notice, application, bond form, renewal form, registry, or Chapter 33 program page was recovered.
This is an evidence-trail result, not proof that no such record exists.
3.6 Rules conclusion
No actually recovered and read administrative rule adds to or modifies the Chapter 33 statutory architecture. Consequently, PASS-03 does not establish any rule-based:
- Additional definition or exemption.
- Waiver.
- Application procedure.
- Bond form or substitute-security procedure.
- Consumer-fee qualification.
- Government filing charge.
- Fund custody or account requirement.
- Renewal procedure.
- Branch or remote-location rule.
- Record-retention period.
- Hearing procedure.
- Transfer or repeal provision.
The PASS-02 observation that the statute itself does not supply a trust or segregated-account mandate, branch-license rule, general retention period, or detailed hearing procedure remains unchanged. PASS-03 did not find an administrative rule filling those gaps.
4. Current forms, public instructions, and registry evidence
4.1 Louisiana licenses portal
Louisiana’s current official licenses page describes its Professional/Occupational Licensing directory as a route to licensing organizations, applications, and license searches. The full directory page was opened and searched. It contained no matching text for:
- Financial Planning and Management.
- Debt Adjuster.
- Debt Management.
- Occupational Standards. Louisiana.gov+4
This is relevant operational evidence but is not dispositive. The portal describes access to Louisiana’s “many” licensing boards; it does not state that it is a legally exhaustive inventory of every direct executive licensing function.
4.2 Boards and Commissions directory
The official Boards and Commissions directory was opened and its listed entities reviewed. Searches found no board named for:
- Financial planning and management services.
- Debt adjustment or debt management.
- Occupational Standards. Louisiana Ag & Forestry+2
That absence does not resolve Chapter 33 because Chapter 33 assigns functions to a director rather than expressly creating a separate board. A direct office-of-the-governor function could therefore be absent from a boards directory.
4.3 No current operating documents recovered
PASS-03 did not recover:
- A current Chapter 33 initial application.
- A renewal form.
- A surety-bond form.
- Instructions for cash, certified-check, or federal-bond substitutes.
- An online filing portal.
- A mailing address.
- A payee instruction for the statutory government charges.
- A current filing checklist.
- A current license specimen.
- A public license lookup.
- A current licensee list.
- A disciplinary or enforcement database tied to Chapter 33.
- A current annual report for the program.
- A budget or staffing entry identifying an active Chapter 33 unit.
- An authoritative agency statement that Chapter 33 licenses are presently issued.
- An authoritative statement that no licenses are presently issued.
No named provider was searched or classified as authorized. A provider’s marketing statement would not have been sufficient in any event.
4.4 Operational conclusion
The general statutory transferee can be identified, but the actual modern licensing program cannot.
The evidence supports this precise formulation:
At the department-successor level, R.S. 36:4.1 assigns the abolished Department of Occupational Standards’ functions to the office of the governor through the commissioner of administration. Public evidence recovered in PASS-03 does not identify a current office, employee, division, form, rule, registry, or filing route administering Chapter 33 specifically.
That is an unresolved operational record—not proof that the chapter has no administrator or that a license cannot legally issue.

The Chapter 33 actor is styled director of the “Division of Occupational Standards,” while R.S. 36:4.1 abolishes the “Department of Occupational Standards.” |
S038 compared with S001 |
High for textual distinction; historical organizational relationship was not established. |

Highest-priority exact next official evidence
- An assignment instrument under R.S. 36:921 or organizational plan under R.S. 37:7–8 that identifies who received the Chapter 33 function after the Department’s abolition.
- A readable certified or official full-text LAC corpus, followed by OSR Administrative Code Update and cumulative-index review using the service name, R.S. 37:2581–2600, “credit and financial adjusting,” and both Department and Division actor names.
- A current official application or license record expressly tied to the Financial Planning and Management Service Law. This would establish administration more reliably than a generic occupational-license portal entry.

No filing, application, contact, public-record request, account change, purchase, CAPTCHA workaround, Chrome control, new browser tab, Work mode, Deep Research, Codex research generation, API, private borrower data, website change, or publication occurred.
PASS-03 establishes a general statutory successor for the abolished Department but does not establish a presently operating Chapter 33 licensing program. It supplies no Louisiana market-access approval, fee approval, provider authorization, state acceptance, parent acceptance, A066 acceptance, or publication readiness.
