Louisiana Chapter 33 licensing-architecture patch

Actual research access: October 25, 2026, Pacific time Scope: Louisiana R.S. 37:2581–2600 only, plus the minimum currentness, amendment, and R.S. 14:331 comparison needed to evaluate that chapter. Review status: Same coordinator’s focused continuation; not an independent review. Both PASS-01 responses, tables, claims, examples, and limitations remain immutable. PASS-01 remains unaccepted as extensive Louisiana provider coverage.

1. Bounded result

The individually opened Chapter 33 provisions establish a facial statutory licensing architecture, not merely a fee provision. The published text contains:

  • A covered-service definition and exclusions.
  • A license requirement.
  • A sworn application, two government application charges, and financial assurance.
  • Applicant qualifications and issuance language.
  • Annual expiration and renewal mechanics.
  • License display and location provisions.
  • Denial and revocation procedures.
  • Contract, record, cancellation, receipt, and feasibility-analysis duties.
  • Consumer-fee provisions already reviewed in PASS-01.
  • Advertising and fee-security prohibitions.
  • Remittance duties.
  • Rulemaking authority.
  • Criminal, contract-invalidity, injunction, review, and investigation provisions. Louisiana Legislature+12

That finding establishes published statutory architecture only. It does not establish:

  • The current operational identity of the statutory “director.”
  • A presently available application form or filing route.
  • A current licensing office, successor agency, registry, or active licensee.
  • That an ordinary commercial debt-settlement provider qualifies for this chapter.
  • That a Chapter 33 license expressly overrides or creates an exception to R.S. 14:331.
  • That the published Title 37 text incorporates every 2026 legislative change.

A notable locator correction: R.S. 37:2581 is not the short-title section. Its actual title is “Declaration of policy.” The chapter’s title is supplied by R.S. 37:2600. Louisiana Legislature+1

2. Government charges and financial assurance are separate from consumer fees

Item Published Chapter 33 requirement Classification and limitation
Application investigation charge $30 paid to the director when applying Provider-to-government application charge; not a debtor fee
Initial license charge Additional $100 paid to the director when applying Provider-to-government license charge; not a debtor fee
Financial assurance $10,500 surety bond, subject to specified substitute forms accepted by the director Security/financial assurance, not a consumer charge and not necessarily a nonrefundable government fee
Renewal charge $100 with renewal application Provider-to-government renewal charge
Renewal assurance Bond “as required in the case of an original application” Continuing provider assurance requirement
Historical transition Bond plus an “annual fee” R.S. 37:2588 does not itself state the amount or expressly identify which neighboring fee provision supplies it
Consumer charges R.S. 37:2592 PASS-01 consumer-fee findings and all collectibility/currentness holds remain unchanged and are not recalculated here

These distinctions follow from R.S. 37:2584, 2586, 2588, and 2592. Louisiana Legislature+3

3. Complete section-by-section Chapter 33 matrix

3.1 R.S. 37:2581–2590

Section Complete consequential elements actually read Relationship, limitations, and claim IDs
37:2581 — Declaration of policy Declares financial-planning and management services rendered to individuals to be matters of public interest and concern, subject to regulation and control in the public interest. The history line is Acts 1970, No. 423, §1. This is a policy declaration, not a short-title provision and not an independent licensing standard. The short title appears in §2600. C001. Louisiana Legislature
37:2582 — Definitions Defines the covered service around planning and managing an individual’s financial affairs and distributing money to creditors, or acting as the individual’s agent in distributing income to creditors, whether or not compensation is received. It deems persons, partnerships, associations, and corporations so engaged to be rendering the service. It separately excludes, when acting in the regular course of their businesses or professions: attorneys; specified authorized banks, fiduciaries, financing and lending institutions; title insurers and abstract companies doing escrow business; employees of Chapter 33 licensees; judicial officers and others acting under court order; nonprofit organizations providing debt-management service; employers for employees; and associations for members. “Director” is defined as the director of the Division of Occupational Standards. “Individual” and “person” are separately defined. The section also says the chapter does not authorize covered licensees to practice law. The definition is distribution-centered and is not automatically coextensive with R.S. 14:331’s broader fee-based compromise language. These eight exclusions belong to Chapter 33 and must not be silently merged with R.S. 14:331’s different nine exclusions. The page was reopened and fully read in PASS-02; alias to reviewed P1 source context. C002, C027. Louisiana Legislature
37:2583 — Requirement of license Beginning 30 days after the chapter’s effective date, it is unlawful for any person to operate or engage in the Chapter-defined business except as authorized by the chapter and without first obtaining the prescribed license. History: Acts 1970, No. 423, §3. The exact 1970 effective date was not established because the original session act could not be opened. The provision applies through the Chapter 33 definition and exclusions; it does not itself identify a modern filing office or address R.S. 14:331. C003, C030. Louisiana Legislature
37:2584 — Application for license The application is made to the director, in writing and under oath, using the director’s prescribed form. It must provide the applicant’s full name and address; every member’s identity if a copartnership or association; every officer and director if a corporation; the parish, municipality, street, and number, if any, where business will be conducted; and other pertinent information required by the director. At application, the applicant pays a $30 investigation charge and an additional $100 license charge. The applicant also submits a $10,500 bond, with the applicant as obligor and an insurer authorized in Louisiana for fidelity and surety business as surety. The director may accept instead cash, a certified check payable to the director of the Division of Occupational Standards, or United States government bonds. The bond runs to Louisiana for the use of the state and persons with a Chapter-based cause of action. It is conditioned on compliance with the chapter and lawful rules, regulations, and directions, and on payment of money becoming due to the state or protected persons under the chapter. History: Acts 1970, No. 423, §4. The $30 and $100 amounts are government charges, not consumer fees. The $10,500 requirement is financial assurance. The statute does not address LLC applications expressly, identify a present form, or establish the current successor to the named director. The substitute-security clause does not separately restate the amount because it refers back to the bond being replaced. C004–C006. Louisiana Legislature
37:2585 — Qualifications for license After application, bond approval, and fee payment, the director investigates. Paragraph (1) requires findings concerning financial responsibility, experience, character, and general fitness of the applicant and specified members, officers, or directors sufficient to support confidence and a belief that the business will operate fairly, honestly, and efficiently. Paragraph (2), following the 2024 amendment, addresses whether those persons have a record of defaulting in the payment of money collected for others, including discharge of such obligations through bankruptcy. If the findings are made, the director “shall” issue and deliver a license for business at the application location. The text says the license remains effective until surrender or revocation but then expressly states that it expires on the next January 1 unless renewed. Act 644 of 2024 removed the former moral-turpitude language from paragraph (2), effective August 1, 2024. The resulting published sentence retains the awkward connective “or if” before the no-default language; this pass does not silently rewrite that grammar. Act 644 also enacted R.S. 37:2950(C), restricting licensing boards’ use of vague or generic terms, but whether and how that provision applies to this chapter’s “director” or its remaining “character and general fitness” language was not resolved. The 2024 amendment proves legislative amendment of the text, not current operational licensing. C007, C008, C031. Louisiana Legislature+4
37:2586 — Renewal of license A licensee may apply on or before December 1 for renewal on the director’s prescribed form. The application must include a $100 fee and a bond meeting the original-application requirement. History: Acts 1970, No. 423, §6. Read with §2585’s January 1 expiration. No current form, filing address, renewal portal, grace period, late renewal rule, or actual renewal practice was verified. C009. Louisiana Legislature+1
37:2587 — License display and location The license must be conspicuously posted in the licensee’s place of business. The published text says a business address may be changed by “any license” on 10 days’ prior written notice to the director. History: Acts 1970, No. 423, §7. The phrase “any license” is preserved rather than repaired to “licensee.” Together with §§2584 and 2585, the architecture is facially tied to a specified business location. The section does not expressly resolve branches, multiple locations, remote-only operations, or whether each location requires a separate license. C010, C032. Louisiana Legislature
37:2588 — Historical transition A person, firm, or corporation lawfully engaged in Louisiana in credit and financial adjusting for at least one year immediately before the chapter’s effective date was entitled to a license by applying within one year after passage, furnishing the required bond, and paying the annual fee. History: Acts 1970, No. 423, §8. This is a 1970 transition clause, not text granting a perpetual grandfather route. Its exact historical calendar dates were not verified because the original 1970 act was inaccessible. The provision does not itself identify the “annual fee” amount or explain whether all §2585 findings were displaced. C011, C030. Louisiana Legislature
37:2589 — Denial of license The director must approve or deny an application within 60 days after filing. If denied, the applicant must be notified by registered United States mail and given an opportunity to be heard within 60 days after denial. History: Acts 1970, No. 423, §9. The section does not provide a final post-hearing decision deadline, hearing mechanics, evidentiary standard, or computation convention. It must be read with §2585’s qualification findings and §2598’s judicial-review provision, whose reference to a “licensee” creates a textual question for a denied applicant. C012. Louisiana Legislature+1
37:2590 — Revocation of license The director must give five days’ notice by registered United States mail to the address shown on the license. The notice must state the contemplated action and general grounds, and the licensee must have a reasonable opportunity to be heard before revocation. Revocation follows if the director finds: failure to pay the annual license fee or maintain the bond; willful failure to comply with an authorized director order, decision, or finding; willful violation of the chapter or an authorized rule, regulation, or direction; a fact or condition that would have justified refusal at original application; or a false statement or representation by an applicant or application party. History: Acts 1970, No. 423, §10. The section uses mandatory revocation language once a listed ground is found. It does not expressly provide emergency suspension, probation, lesser discipline, cure periods, or reinstatement. Current hearing rules were not reviewed. C013. Louisiana Legislature

3.2 R.S. 37:2591–2600

Section Complete consequential elements actually read Relationship, limitations, and claim IDs
37:2591 — Contracts, books, records, and cancellation A licensee must provide the director with a contract copy when requested. The debtor must receive a written contract stating the agreed charges. An individual may cancel on 30 days’ written notice, with the licensee entitled only to charges provided by §2592. Records and accounts must permit the individual, at any reasonable time, to determine amounts paid to creditors. Within seven days after an individual’s written request, the licensee must provide a statement showing total funds received and total disbursements to each creditor. A receipt is required for every cash payment. The licensee must prepare and retain in each debtor’s file a written income-and-expense analysis supporting the feasibility and practicality of the payment plan. History: Acts 1970, No. 423, §11. The section does not state a record-retention period, specify electronic versus paper form, establish a contract-signature sequence, or define whether cancellation becomes effective when notice is sent, received, or after 30 days. Cancellation charges remain subject to §2592 and all PASS-01 holds. C014, C015, C032. Louisiana Legislature
37:2592 — Fees and charges of licensees Reused solely as Chapter 33’s consumer-fee and cancellation-charge cross-reference. It is expressly limited to a “licensee” and is referenced by §2591’s cancellation clause and §2594’s withholding language. PASS-01’s complete three-paragraph reading, numeric analysis, examples, federal separation, and unresolved currentness and collectibility issues are preserved and not repeated. No new consumer-fee approval results from reading the rest of the chapter. C016. Louisiana Legislature
37:2593 — Prohibitions A licensee may not make false, misleading, or deceptive advertising representations concerning service rates, terms, or conditions. A licensee also may not take or charge a fee in the form of a promissory note or other promise to pay, and may not accept a mortgage or other real- or personal-property security for a fee. History: Acts 1970, No. 423, §13. The text governs licensees and fee security; it does not establish current license status. The reach of “other promise to pay” to specific payment instruments or arrangements was not adjudicated here. C017. Louisiana Legislature
37:2594 — Remittance to creditors The licensee must remit received funds to creditors promptly after receipt, less fees and charges withheld as previously provided by the chapter. History: Acts 1970, No. 423, §14. “Promptly” has no stated number of days. The withholding reference points back to the chapter’s fee provisions but does not independently authorize unearned or otherwise unlawful fees. No express trust-account, segregated-account, reconciliation, deposit-location, or interest rule appears in this section. No separate Chapter 33 provision actually read supplied such an account requirement. Other law and unreviewed rules remain open. C018, C032. Louisiana Legislature+1
37:2595 — Rules and regulations The published page says the director shall “make and find, as required by law,” and enforce reasonable rules and regulations necessary to administer the chapter. History: Acts 1970, No. 423, §15. The unusual phrase “make and find” is recorded exactly rather than silently corrected. The section delegates rulemaking authority but does not prove that rules currently exist, identify their location, or establish the current rulemaking actor. No administrative rules or adoption orders were read in PASS-02. C019. Louisiana Legislature
37:2596 — Penalties A person who willfully violates the chapter commits a misdemeanor punishable by a fine up to $2,500, parish-jail imprisonment up to six months, or both. A Chapter-defined financial-planning and management contract made by an unlicensed person is null, void, and without legal effect. History: Acts 1970, No. 423, §16. Willfulness expressly modifies the misdemeanor sentence. The separate contract-invalidity sentence does not expressly repeat a willfulness condition. Civil recovery, restitution, private causes of action, and case application were not investigated. C020. Louisiana Legislature
37:2597 — Injunction Unlicensed engagement in the covered business, rendering covered financial service, or accepting individuals’ funds as defined by the chapter is declared contrary to public welfare and a public nuisance. The director may proceed in Louisiana’s name through the attorney general or the published text’s “state’s attorney” of any parish and seek an injunction from a court of competent jurisdiction. Temporary or permanent relief may issue; violations may be punished as contempt for each violation. This remedy is cumulative, not a substitute for the chapter’s other penalties and remedies. History: Acts 1970, No. 423, §17. The unusual actor term “state’s attorney” is preserved rather than modernized. Current enforcement allocation and procedural implementation were not verified. C021. Louisiana Legislature
37:2598 — Review Final administrative decisions of the director are subject to judicial review in the district court of the parish where the licensee is doing business. History: Acts 1970, No. 423, §18. The section does not state a filing deadline, standard of review, record requirements, or stay rule. Its use of “licensee” leaves an interpretive question concerning review after an initial application denial. No Administrative Procedure Act reconciliation or case law was reviewed. C022. Louisiana Legislature
37:2599 — Investigation At any reasonable time, the director may investigate and examine the books and records of every licensee and also any person, firm, association, or corporation engaged in the §2582-defined business and not expressly exempted. History: Acts 1970, No. 423, §20. The inspection authority therefore facially reaches both licensees and unlicensed, nonexempt persons engaged in covered conduct. The section does not state subpoena, copying, confidentiality, notice, privilege, or warrant procedures. C023. Louisiana Legislature
37:2600 — Title of chapter Names the chapter the “Financial Planning and Management Service Law.” History: Acts 1970, No. 423, §22. This, not §2581, is the chapter-title provision. C024. Louisiana Legislature

3.3 Conditional architecture-only deadline example

Assume solely for illustrating the published mechanics that:

  • The chapter is operative through a functioning issuing authority.
  • A qualifying license is issued on July 15, 2026 at the application address.
  • No rule or order changes the statutory dates.

Under the text:

  1. The license expires on January 1, 2027 unless renewed.
  2. The renewal application is due on or before December 1, 2026.
  3. The renewal filing includes the $100 government renewal charge and the original-type bond.
  4. The license must remain conspicuously posted at the licensed place of business.
  5. An address change requires 10 days’ prior written notice to the director.

This example illustrates §§2585–2587 only. It does not establish that a current application can be filed or that any provider is authorized. Louisiana Legislature+2

4. Express R.S. 14:331 reconciliation result

4.1 What the Chapter 33 text does establish

R.S. 37:2583 expressly contemplates authorization and licensing for the service defined by Chapter 33. R.S. 37:2585 supplies issuance criteria, and R.S. 37:2592 contemplates consumer fees charged by a “licensee.” Those provisions form a coherent licensing architecture on their own published terms. Louisiana Legislature+2

4.2 What it does not expressly establish

No provision actually read in R.S. 37:2581–2600:

  • Mentions R.S. 14:331.
  • Says a Chapter 33 licensee is excluded from R.S. 14:331.
  • Adds “licensed financial planning and management service” to R.S. 14:331(C).
  • States that Chapter 33 controls over a conflicting criminal prohibition.
  • Limits R.S. 14:331 to unlicensed providers.
  • Resolves how the statutes apply when a provider negotiates principal reduction but does not receive and distribute debtor funds.

R.S. 14:331, as currently published, prohibits for-profit debt adjusting subject to its own exclusions and includes both distribution arrangements and fee contracts to adjust, compromise, or discharge debts. Its express exclusions do not list a Chapter 33 licensee merely because it holds that license. Louisiana Legislature

4.3 Bounded conclusion

No actually read Chapter 33 provision expressly reconciles the two regimes or creates an express exception to R.S. 14:331.

At the same time, Chapter 33 affirmatively describes licensed operation and licensee fees. The result is an unresolved statutory tension—not a basis in this pass to declare:

  • Implied repeal.
  • Harmonization.
  • Unconstitutionality.
  • Supersession.
  • A currently available commercial license.
  • Permission for modern noncustodial settlement.
  • That Chapter 33 is dormant or unenforceable.

Resolution requires the original 1970 and 1972 enactments, subsequent history, controlling decisions, formal interpretations, and operational regulator evidence. C025–C028. Louisiana Legislature+2

5. Source, version, access, reuse, and failure register

The individual Title 37 pages below were accessed on October 25, 2026 Pacific. Unless otherwise stated, each page was opened and its complete operative section text was read.

The Louisiana Legislature’s law-search page says its laws are generally updated through the 2025 First Extraordinary Session. Its October 15, 2026 list of titles updated through the 2026 Regular Session includes Title 14 but does not include Title 37. The site also disclaims official or authoritative status. Title 37 therefore retains a 2026 currentness hold; omission from the list does not prove that no 2026 amendment occurred. Louisiana Legislature

S_LA-P2-C025 Published Chapter 33 contains a complete facial application, issuance, renewal, operating-duty, and enforcement architecture. S003–S021. Louisiana Legislature+7 High as a description of the published text; not proof of a functioning modern program.
S_LA-P2-C026 No actually read Chapter 33 provision expressly references, overrides, or creates a licensee exception to R.S. 14:331. S002–S021 compared with S022. Louisiana Legislature+2 High as bounded textual finding; no implied-repeal or harmonization conclusion.
S_LA-P2-C027 Chapter 33’s exclusions and R.S. 14:331’s exclusions are separate statutory lists and cannot be merged by assumption. S003 and S022. Louisiana Legislature+1 High for text; overlap or incorporation requires authority not reviewed.
S_LA-P2-C028 No current issuing office, successor, form, application channel, registry, or active provider license was verified. Evidence limitation after S002–S027. High-confidence limitation, not proof that no license can issue.
S_LA-P2-C029 The official site’s general baseline is through the 2025 First Extraordinary Session; Title 37 is absent from the October 15, 2026 selected-title update list, and the online text is nonauthoritative. S023, lines 82–105 and disclaimer. Louisiana Legislature High for notice; does not prove absence of a 2026 Title 37 amendment.
S_LA-P2-C030 The exact passage and effective dates needed to calendar §§2583 and 2588 were not verified because the original 1970 act volumes were inaccessible. S028–S030. Law Library of Louisiana Explicit unresolved evidence gap.
S_LA-P2-C031 The Legislature amended §2585 in 2024, but that amendment does not itself prove an active licensing office or operational pathway. S024–S027. Louisiana Legislature+2 Supported inference; operational evidence still required.
S_LA-P2-C032 The Chapter 33 text read here does not expressly supply a trust/segregated-account mandate, branch-license rule, general record-retention period, or detailed hearing procedure. S005–S020. Louisiana Legislature+4 Bounded negative observation limited to the read chapter; administrative rules and other law remain open.

  • The official HB954 bill-history page establishing signature, Act number, and August 1, 2024 effective date.
  • The current published R.S. 37:2950 page because Act 644 simultaneously enacted subsection C while amending §2585.
  • The Law Library of Louisiana’s locator page for the 1970 session-law volumes.

Reused but not treated as newly discovered

  • PASS-01’s complete R.S. 14:331 and R.S. 37:2592 findings.
  • The coordinator’s complete prior reading of R.S. 37:2582 and 2585.
  • PASS-01’s federal common context, fee arithmetic, six examples, claims, and coverage table.
  • The supplied ODR, DOJ, proposed-2004-bill, and federal-source limitations. None was rerun or expanded.

The three reused Chapter 33 pages were nevertheless reopened in PASS-02 because they are necessary cross-references for the remaining architecture. That does not rewrite the historical record that the original PASS-01 researcher had only search-rendered access to some of them.

SectionComplete consequential elements actually readRelationship, limitations, and claim IDs
37:2581 — Declaration of policyDeclares financial-planning and management services rendered to individuals to be matters of public interest and concern, subject to regulation and control in the public interest. The history line is Acts 1970, No. 423, §1.This is a policy declaration, not a short-title provision and not an independent licensing standard. The short title appears in §2600. C001. Louisiana Legislature
37:2582 — DefinitionsDefines the covered service around planning and managing an individual’s financial affairs and distributing money to creditors, or acting as the individual’s agent in distributing income to creditors, whether or not compensation is received. The section also says the chapter does not authorize covered licensees to practice law.The definition is distribution-centered and is not automatically coextensive with R.S.
37:2583 — Requirement of licenseBeginning 30 days after the chapter’s effective date, it is unlawful for any person to operate or engage in the Chapter-defined business except as authorized by the chapter and without first obtaining the prescribed license. History: Acts 1970, No. 423, §3.The exact 1970 effective date was not established because the original session act could not be opened. The provision applies through the Chapter 33 definition and exclusions; it does not itself identify a modern filing office or address R.S. 14:331. C003, C030. Louisiana Legislature
37:2584 — Application for licenseThe application is made to the director, in writing and under oath, using the director’s prescribed form. 423, §4.The $30 and $100 amounts are government charges, not consumer fees. The $10,500 requirement is financial assurance. The statute does not address LLC applications expressly, identify a present form, or establish the current successor to the named director. The substitute-security clause does not separately restate the amount because it refers back to the bond being replaced. C004–C006. Louisiana Legislature
37:2585 — Qualifications for licenseAfter application, bond approval, and fee payment, the director investigates. The text says the license remains effective until surrender or revocation but then expressly states that it expires on the next January 1 unless renewed.Act 644 of 2024 removed the former moral-turpitude language from paragraph (2), effective August 1, 2024. Louisiana Legislature +4
37:2586 — Renewal of licenseA licensee may apply on or before December 1 for renewal on the director’s prescribed form. The application must include a $100 fee and a bond meeting the original-application requirement. History: Acts 1970, No. 423, §6.Read with §2585’s January 1 expiration. No current form, filing address, renewal portal, grace period, late renewal rule, or actual renewal practice was verified. C009. Louisiana Legislature +1
37:2587 — License display and locationThe license must be conspicuously posted in the licensee’s place of business. The published text says a business address may be changed by “any license” on 10 days’ prior written notice to the director. History: Acts 1970, No. 423, §7.The phrase “any license” is preserved rather than repaired to “licensee.” Together with §§2584 and 2585, the architecture is facially tied to a specified business location. The section does not expressly resolve branches, multiple locations, remote-only operations, or whether each location requires a separate license. C010, C032. Louisiana Legislature
37:2588 — Historical transitionA person, firm, or corporation lawfully engaged in Louisiana in credit and financial adjusting for at least one year immediately before the chapter’s effective date was entitled to a license by applying within one year after passage, furnishing the required bond, and paying the annual fee. History: Acts 1970, No. 423, §8.This is a 1970 transition clause, not text granting a perpetual grandfather route. Its exact historical calendar dates were not verified because the original 1970 act was inaccessible. The provision does not itself identify the “annual fee” amount or explain whether all §2585 findings were displaced. C011, C030. Louisiana Legislature
37:2589 — Denial of licenseThe director must approve or deny an application within 60 days after filing. If denied, the applicant must be notified by registered United States mail and given an opportunity to be heard within 60 days after denial. History: Acts 1970, No. 423, §9.The section does not provide a final post-hearing decision deadline, hearing mechanics, evidentiary standard, or computation convention. It must be read with §2585’s qualification findings and §2598’s judicial-review provision, whose reference to a “licensee” creates a textual question for a denied applicant. C012. Louisiana Legislature +1
37:2590 — Revocation of licenseThe director must give five days’ notice by registered United States mail to the address shown on the license. 423, §10.The section uses mandatory revocation language once a listed ground is found. It does not expressly provide emergency suspension, probation, lesser discipline, cure periods, or reinstatement. Current hearing rules were not reviewed. C013. Louisiana Legislature

SectionComplete consequential elements actually readRelationship, limitations, and claim IDs
37:2591 — Contracts, books, records, and cancellationA licensee must provide the director with a contract copy when requested. 423, §11.The section does not state a record-retention period, specify electronic versus paper form, establish a contract-signature sequence, or define whether cancellation becomes effective when notice is sent, received, or after 30 days. Cancellation charges remain subject to §2592 and all PASS-01 holds. C014, C015, C032. Louisiana Legislature
37:2592 — Fees and charges of licenseesReused solely as Chapter 33’s consumer-fee and cancellation-charge cross-reference. It is expressly limited to a “licensee” and is referenced by §2591’s cancellation clause and §2594’s withholding language.PASS-01’s complete three-paragraph reading, numeric analysis, examples, federal separation, and unresolved currentness and collectibility issues are preserved and not repeated. No new consumer-fee approval results from reading the rest of the chapter. C016. Louisiana Legislature
37:2593 — ProhibitionsA licensee may not make false, misleading, or deceptive advertising representations concerning service rates, terms, or conditions. A licensee also may not take or charge a fee in the form of a promissory note or other promise to pay, and may not accept a mortgage or other real- or personal-property security for a fee. History: Acts 1970, No. 423, §13.The text governs licensees and fee security; it does not establish current license status. The reach of “other promise to pay” to specific payment instruments or arrangements was not adjudicated here. C017. Louisiana Legislature
37:2594 — Remittance to creditorsThe licensee must remit received funds to creditors promptly after receipt, less fees and charges withheld as previously provided by the chapter. History: Acts 1970, No. 423, §14.“Promptly” has no stated number of days. C018, C032. Louisiana Legislature +1
37:2595 — Rules and regulationsThe published page says the director shall “make and find, as required by law,” and enforce reasonable rules and regulations necessary to administer the chapter. History: Acts 1970, No. 423, §15.The unusual phrase “make and find” is recorded exactly rather than silently corrected. The section delegates rulemaking authority but does not prove that rules currently exist, identify their location, or establish the current rulemaking actor. No administrative rules or adoption orders were read in PASS-02. C019. Louisiana Legislature
37:2596 — PenaltiesA person who willfully violates the chapter commits a misdemeanor punishable by a fine up to $2,500, parish-jail imprisonment up to six months, or both. A Chapter-defined financial-planning and management contract made by an unlicensed person is null, void, and without legal effect. History: Acts 1970, No. 423, §16.Willfulness expressly modifies the misdemeanor sentence. The separate contract-invalidity sentence does not expressly repeat a willfulness condition. Civil recovery, restitution, private causes of action, and case application were not investigated. C020. Louisiana Legislature
37:2597 — InjunctionUnlicensed engagement in the covered business, rendering covered financial service, or accepting individuals’ funds as defined by the chapter is declared contrary to public welfare and a public nuisance. 423, §17.The unusual actor term “state’s attorney” is preserved rather than modernized. Current enforcement allocation and procedural implementation were not verified. C021. Louisiana Legislature
37:2598 — ReviewFinal administrative decisions of the director are subject to judicial review in the district court of the parish where the licensee is doing business. History: Acts 1970, No. 423, §18.The section does not state a filing deadline, standard of review, record requirements, or stay rule. Its use of “licensee” leaves an interpretive question concerning review after an initial application denial. No Administrative Procedure Act reconciliation or case law was reviewed. C022. Louisiana Legislature
37:2599 — InvestigationAt any reasonable time, the director may investigate and examine the books and records of every licensee and also any person, firm, association, or corporation engaged in the §2582-defined business and not expressly exempted. History: Acts 1970, No. 423, §20.The inspection authority therefore facially reaches both licensees and unlicensed, nonexempt persons engaged in covered conduct. The section does not state subpoena, copying, confidentiality, notice, privilege, or warrant procedures. C023. Louisiana Legislature
37:2600 — Title of chapterNames the chapter the “Financial Planning and Management Service Law.” History: Acts 1970, No. 423, §22.This, not §2581, is the chapter-title provision. C024. Louisiana Legislature

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions.
