R091 PASS-03 — Literal statutory reference in 12 CFR 1070.2(i)(4)

The printed reference is confirmed, but an authoritative numerical substitution remains unestablished. The current eCFR definition and the original 2020 adopted definition both print “12 U.S.C. 5414(b)(1)(C)”. The current statutory §5414 exists, but its paragraph (b)(1) has no subparagraph (C). The separately examined §5514(b)(1)(C) contains the risk-assessment language. ecfr.gov+2

This supplement adds material context: the 2020 final-rule preamble expressly identifies §5514(b)(1)(C) when explaining the supervisory authority the revision was intended to retain. That is authenticated agency explanation, not an instruction replacing the number printed in the adopted definition. The earlier 2016 proposed definition also printed 5414, and the examined 2024 amendment changes paragraph (a), not paragraph (i)(4). federalregister.gov+2

Actual access date: October 28, 2026, America/Los_Angeles. This is a separate supplement. The supplied pass-01 propositions remain quoted historical context; neither earlier report is rewritten or accepted wholesale.

Throughout the tables, S001 means R091-P3-S001, C001 means R091-P3-C001, and similarly for the other numbered entries. P denotes printed pagination; I denotes the zero-based PDF page index.

2. Atomic claim register and substantive findings

A. Current definition and indispensable context

These entries preserve the complete branches of paragraph (i), rather than treating its fourth item as the entire definition.

Claim ID Supported finding, qualifications, and limits Exact authority
R091-P3-C001 The retrieved current section is official-hosted eCFR text with the status and cutoff stated in S001. Its banner is not proof of all law or agency action after that cutoff. S001, status banner and §1070.2 source note. ecfr.gov
R091-P3-C002 The section credit identifies the 2020 revision and 2024 amendment. The Part authority note lists 12 USC5481 et seq.; 5 USC552 and552a; 18 USC1905 and641; 44 USC chapters31 and35; and12 USC3401 et seq. This is an inventory of cited authority, not completed analysis of those regimes. S001, Part1070 authority/source; S002 instruction1; S005 instruction1.
R091-P3-C003 Current §1070.2(i)(4) literally prints 5414(b)(1)(C). It must not be transcribed as5514 without identifying a separate basis for that change. S001, §1070.2(i)(4). ecfr.gov
R091-P3-C004 Item(i)(1) covers examination, inspection and visitation reports; nonpublic operating, condition and compliance reports; supervisory letters or similar documents; and information contained in, derived from, or related to them. S001/S002, §1070.2(i)(1); original P75216/I22.
R091-P3-C005 Item(i)(2) covers documents, materials or records—including examination reports—prepared by, on behalf of, or for the use of CFPB or another federal, State or foreign governmental agency in exercising supervisory authority over a financial institution, plus derived information. S002, §1070.2(i)(2), P75216–75217/I22–23.
R091-P3-C006 Item(i)(3) addresses communications between CFPB and a supervised financial institution or federal, State or foreign governmental agency, related to CFPB supervision of the institution. S002, §1070.2(i)(3), P75217/I23.
R091-P3-C007 The first branch of(i)(4) concerns information provided to CFPB by a financial institution, for detecting and assessing risks to consumers and markets for consumer financial products or services, pursuant to the printed alternatives 5414(b)(1)(C),5515(b)(1)(C), or5516(b). The reference issue does not eliminate the stated provider, purpose or authority predicates. S001, §1070.2(i)(4).
R091-P3-C008 The same item also addresses assessing whether an institution should be considered a covered person under12 USC5481 or is subject to CFPB supervisory authority. It ends with “and/or” before item(5). The definition cannot be restated as requiring every numbered item cumulatively. S002, §1070.2(i)(4), P75217/I23.
R091-P3-C009 Item(i)(5) incorporates information exempt under5 USC552(b)(8). This pass preserves that dependency; it does not decide a FOIA exemption or disclosure result. S001, §1070.2(i)(5).
R091-P3-C010 Under(f), confidential information encompasses the defined complaint, investigative and supervisory categories and other CFPB information potentially exempt under FOIA. The definition excludes CFPB-authorized public availability/disclosure, while retaining its stated treatment when information reaches or enters third-party records. Mere public circulation is not the express exclusion. S002, agency-posted instruction2, §1070.2(f), P86/I85; same adopted clause in original P75216/I22. files.consumerfinance.gov
R091-P3-C011 These definitions apply for purposes of Part1070. Paragraph(l) links “financial institution” to offering or providing a financial product or service and to §5481 categories. Paragraph(n) includes individuals and the enumerated organizational/entity forms. Paragraph(o) defines a CFPB examination report; paragraph(q) includes an institution that is or may become subject to supervision. Actual classification, and the full §5481 incorporation, remain held. S002, agency-posted instruction2 introductory text and(l),(n),(o),(q), P85–88/I84–87; S001 corresponding clauses.

B. Adoption, explanation, statutes and limits

Claim ID Supported finding, qualifications, and limits Exact authority
R091-P3-C012 The2020 adopted instruction2 replaces §1070.2 in full and prints5414 in(i)(4). The examined current paragraph(i) matches that adopted definition. Publication was November24,2020; the stated effective date was December24,2020. No separate(i)(4) application or savings qualification appears in DATES or instruction2. This is not a claim about every passage of the final-rule document. S002, DATES P75194/I0; instruction2 P75216–75217/I22–23; S001(i).
R091-P3-C013 The2020 preamble expressly names 5514(b)(1)(C),5515(b)(1)(C), and5516(b) when explaining the supervisory-authority coverage intended to be retained while separating market-monitoring information. That authenticated explanation strengthens the contextual comparison. It is not an express instruction to replace5414 in the adopted text. S002, complete preamble discussion headed §1070.2(i), particularly P75198/I4; continuation P75199/I5. federalregister.gov
R091-P3-C014 The same explanation distinguishes internally held business documents from information derived from supervisory material. Its stated own-business exclusion requires the documents not to contain supervisory-process communications/information and not to be possessed by CFPB. Submission of copies does not, by itself, convert the institution’s retained copies into Bureau confidential information. This is attributed preamble explanation, not an actual-record determination. S002, §1070.2(i) preamble, P75198–75199/I4–5. govinfo.gov
R091-P3-C015 The2016 proposed CSI definition was numbered(j), and proposed(j)(4) already printed5414(b)(1)(C). Thus the number is not first observable only in the current compiler. The proposal establishes historical wording, not operative adoption. S006, proposed §1070.2(j)(1)–(5), P58323/I13. govinfo.gov
R091-P3-C016 The2024 Part1070 instructions retain the authority citation, replace(a) with the Supervision Director definition, and replace the former official-title terminology in§1070.42. Instruction2 does not revise(i). Its express effect date is November29,2024. No numerical correction of(i)(4) is accomplished by those instructions. S005, DATES P94600/I0; instructions1–3 P94601/I1. govinfo.gov
R091-P3-C017 The agency-hosted format whose filename includes “updated” also retains5414 in(i)(4). Its first page contains an unfilled effective-date placeholder referring to30days after Federal Register publication. Neither the filename nor that placeholder is an authenticated later numerical correction or a substitute for the published DATES. S002, agency format P1/I0 andP87/I86. files.consumerfinance.gov+1
R091-P3-C018 Section5414 exists and is titled Savings provisions. Its(b) concerns continuation of enumerated OTS issuances/materials, subject to transferred-function, pre-transfer-effectiveness and later-modification conditions. Its(b)(1) is an undivided Board-of-Governors branch; there is no(b)(1)(C) in the complete body read. This is a structural comparison, not application of the OTS transition regime. S003, complete §5414, especially(b) chapeau and(1)–(3). uscode.house.gov
R091-P3-C019 Section5514(b)(1) directs periodic reports and examinations of persons described in(a)(1), for compliance assessment, information about activities/compliance systems, and—in(C)—consumer/market risk assessment. Paragraph(a)’s coverage qualifications remain material. The statute says financial products “and” services; the regulatory risk phrase says products “or” services. They should not be presented as a verbatim-identical quotation. S004, complete(a)(1)–(3),(b)(1)(A)–(C), with adjacent(b)(2); S001(i)(4). uscode.house.gov
R091-P3-C020 Section5512(c)(6)(A) directs CFPB to prescribe confidentiality rules for information obtained from persons in exercising federal consumer-financial-law authority. Complete(c)(6)(B)–(C) contains separately qualified inter-regulator access provisions. Neither this rulemaking direction nor this pass establishes an actual disclosure authorization or repairs(i)(4). S007, complete(c)(6)(A)–(C). uscode.house.gov
R091-P3-C021 No§1070.2 entry appeared in the examined Title12 portions of the2020–2026 eCFR correction indexes. Those indexes expressly omit issuing-agency errors. Their bounded negative result cannot establish that no agency correction, interpretation or other relevant authority exists. S008, scope statements and selected Title12 entries.
R091-P3-C022 No adopted instruction or explicit authoritative numerical-repair explanation was authenticated in the selected publications and targeted searches. This is a research-result limitation, not a finding that no such authority exists. The specific remaining question is whether a public adopted operation or authoritative explanation establishes how5414 in(i)(4) is to be treated. S001–S009; read/failure log below.
R091-P3-C023 The failed initial OLRC URLs do not establish an absent statute: readable current OLRC bodies were subsequently obtained. The2013 citation resolver’s unsuccessful result does not establish absence of the earlier publication. S003/S004 successful bodies; S009; failure logF01–F03.
R091-P3-C024 Currentness is bounded by the actual eCFR and OLRC displays and selected history read. The complete intervening statutory, regulatory and judicial chain was not certified. A title-wide update does not establish a section-specific amendment. S001–S008, their stated read bounds.
R091-P3-C025 The sources establish a literal-reference difference and relevant agency explanation. They do not establish, in this pass, an authoritative substitution, actual CSI classification, privilege, disclosure permission, supervision determination, remedy or private right. Those are distinct questions requiring additional authority and predicates. C003,C007–C013,C018–C024; bounded textual inference, not judicial construction.

3. Version and instruction comparison

Examined version or authority What it actually prints or does What this establishes What remains unestablished
2016 proposed definition Proposed§1070.2(j)(4):5414(b)(1)(C). Earlier occurrence of the literal number in a public proposed body. C015/S006. Adoption at that time; an explanation of the digit choice; a current rule.
2020 final-rule explanatory discussion Names5514(b)(1)(C) in describing supervisory risk-assessment authority. Agency-provided context for the revision’s stated purpose. C013/S002. An express correction command or controlling resolution of the printed reference.
2020 adopted instruction2 Replaces§1070.2; adopted(i)(4) prints5414(b)(1)(C). Original published adopted wording, independently checked in PDF text and page images. C012/S002. Authority to rewrite the adopted number on the strength of the preamble alone.
Agency-posted “updated” format Same5414 reference; publication-relative date placeholder. This format is not evidence of a numerical change. C017/S002. A separate corrective instrument or replacement effective date.
2024 adopted instructions Within§1070.2, instruction2 changes(a). The later amendment listed in the current source credit does not change(i)(4). C016/S005. An unexamined later operation elsewhere.
Current eCFR Paragraph(i)(4) still prints5414. Current displayed wording at the stated cutoff. C001,C003/S001. Exhaustive law after the cutoff or authoritative treatment of the reference issue.
Current statutory§5414 Savings provisions; undivided(b)(1), without(C). The exact printed regulatory subparagraph locator does not correspond to that subdivision structure. C018/S003. Repeal, invalidity of the regulation, or an intended substitute inferred solely from this mismatch.
Current statutory§5514 Actual(b)(1)(C) contains risk-assessment wording, within qualified supervision provisions. Positive textual comparison, reinforced by the final-rule explanation. C019/S004;C013/S002. Automatic substitution or actual application to information or an institution.
Editorial correction indexes No selected§1070.2 entry; stated scope excludes agency errors. Limited editorial-history check. C021/S008. A complete agency-correction or interpretive-history search result.

The precise unresolved legal question

The open question is not whether5414 exists or whether5514 contains risk-assessment wording; those textual questions were answered. It is whether an authenticated adopted correction, explicit authoritative explanation, or other controlling authority establishes the operative treatment of the reference as printed in§1070.2(i)(4). This pass supplies neither a silent substitution nor a conclusion about the consequences of leaving the printed number unrepaired. C018,C019,C022,C025.

4. Exact old/new material-change crosswalk

The quoted old propositions below come from the user-supplied immutable rows. Their inclusion does not represent access to the underlying saved report.

Old ID and exact supplied proposition New supported finding and pinpoint Effect on the specifically dependent statement
R091-P1-S020 — version/status proposition: “Final displays through 10/26/2026. Official-hosted, unofficial codification. Selected 2020 adopted text authenticated in S021. A printed statutory cross-reference discrepancy remains visible below.” Fresh S001 again displays the section through10/26/2026 and retains5414. The separately retrieved Part banner displays10/23/2026. Fresh S002 authenticates the selected2020 adopted text. C001–C003,C012,C024. The reference observation is supported anew. No change to pass-01. Its stated reading of§§1070.40 and.41 is not reverified by this supplement; no dependent disclosure proposition is reaffirmed here.
R091-P1-S021 — publication/status proposition: “Published November 24, 2020; effective December 24, 2020. Adopted text contains the same §1070.2(i)(4) numerical cross-reference problem visible in current eCFR.” The original PDF’s DATES and complete instruction2 confirm those dates and the literal5414 reference: P75194/I0;P75216–75217/I22–23. The newly examined complete CSI preamble discussion expressly names5514: P75198–75199/I4–5. C012–C014. Original-text authentication is freshly supported and explanatory context is added. The old characterization “problem” is preserved as quoted context; this supplement makes the narrower finding of a documented reference difference without presuming a legally established correction.
R091-P1-C090: “Both the current §1070.2(i)(4) and the examined 2020 adopted text print ‘12 U.S.C. 5414(b)(1)(C)’. Section5514(b)(1)(C) separately contains the relevant risk-assessment language. The apparent numerical mismatch is recorded, not judicially or editorially repaired here.” Fresh current and adopted bodies confirm the first sentence. Complete§5414 confirms that its(b)(1) lacks(C); complete§5514(b)(1) confirms the risk-assessment clause in context. The2020 preamble expressly connects the revision to5514; the2016 proposal already printed5414; the2024 selected amendment does not change it. C003,C012,C013,C015,C016,C018,C019. The documentary basis is stronger. The no-repair qualification remains. This is more than an availability-only improvement, because additional explanatory and historical text was authenticated. It is not an operative numerical correction, whole-report review or acceptance.

Unchanged scope boundary: pass-02’s annual-receipts (ii)(B)/(ii) question remains separate and open. Nothing here resolves it or any other A091 classification, accounting, supervision or provider-profile question.

M12 Five numbered CSI items, (i)(1)–(5) S001/S002; C004–C009. Structural count. The connector before(5) is “and/or.” Not five cumulative eligibility findings or a score.
M13 Three listed purposes, (b)(1)(A)–(C); periodic reporting/examination S004; C019. Chapeau concerns persons described in(a)(1), subject to its qualifications. No fixed interval stated in(b)(1). No actual cycle, examination date or period established.
M14 Day before the transfer date; continuation until specified later action S003§5414(b); C018. Conditions on the OTS continuation text: transferred function, qualifying material then in effect, later modification/termination/set-aside/supersession under applicable authority. No transfer date assigned; no historical issuance or modification event investigated.
M15 2020–2026, inclusive index-year range S008; C021. Selected Title12 portions of seven annual editorial indexes;2026 only as available on access. Agency errors excluded by the indexes’ own scope. Not a complete agency-correction or future-year record.
M16 Unknown correction/interpretation date and operation C022,C025. No material numerical-repair instrument authenticated. Publication, effective date, application scope and any savings qualification cannot be supplied.
M17 Unknown collection, disclosure or supervisory event C007–C011,C019,C020,C025. Definition and statutory predicates require their own facts and incorporated authority. No event, receipt, consent, actor classification or counting trigger is provided.

No amount, percentage, receipts calculation, response deadline, formula or financial example is supplied. The statutory source/effective-date notes were read as notes; this supplement does not independently derive an original statutory commencement date from them.

6. Substantive conditional branches

These are public-law research branches. They do not classify an actual institution, communication or record.

Branch Supported conditional proposition and exact link Missing authority or predicate Adverse inference to avoid Precise next permissible generic inquiry
B01 — Current displayed version If relying on the retrieved current definition, retain its stated cutoff and status. C001,C024;S001. Post-cutoff adopted history. Access date equals complete law-currentness date. Check later official adopted instructions affecting§1070.2 specifically.
B02 — Literal citation A transcription of current(i)(4) must preserve5414. C003;S001(i)(4). Authority for a substituted number. A plausible correction is the printed rule. Locate an express public correction or authoritative numerical explanation.
B03 — Other CSI items Items(i)(1)–(3),(5) have their own stated subjects and predicates. C004–C006,C009;S001/S002. Predicate-specific authority and facts, all absent. The reference issue determines the whole definition’s application or validity. Examine only a separately scoped incorporation necessary to the selected item.
B04 — Risk-assessment branch The first(i)(4) branch retains its provider, purpose and cited-authority qualifications. C007;S001. Applicable statutory authority and qualifying information category. All information sent to CFPB meets this branch. Resolve the printed-reference question before any dependent legal interpretation.
B05 — Status-assessment branch The other(i)(4) wording concerns assessment of covered-person or supervisory status. C008;S002. Full§5481 and relevant supervision incorporations. Assessment of status proves that status. Read the exact necessary definition only under a separately authorized classification inquiry.
B06 — FOIA incorporation Item(i)(5) expressly depends on§552(b)(8). C009;S001. Complete necessary FOIA provisions and application predicates. The reference alone decides access, withholding or privilege. Identify the complete narrow FOIA incorporation; preserve full disclosure procedures separately.
B07 — Public/third-party qualification Paragraph(f)’s public-disclosure qualification requires the authority specified there; its third-party sentence remains part of the text. C010;S002. Any actual authorized-publication or third-party circumstance. A leak or public availability establishes loss of all protection. Reopen(f) and any indispensable public authority for a separately scoped issue.
B08 — Defined institution/person Part-specific definitions and incorporations control the categories used in(i). C011;S001/S002. Completed external definitions and actual category predicates. A commercial label or prospective supervisory possibility proves jurisdiction. Read the specific incorporated§5481 clause needed, without investigating an entity.
B09 — Adopted2020 body The original adopted instruction supports the literal5414 finding and stated effective date. C012;S002. A separate operative correction. The number originated only in eCFR processing. Examine an identified later adopted correction, if one is located.
B10 — Preamble explanation The authenticated discussion expressly identifies5514 as supervisory risk-assessment authority. C013;S002,P75198/I4. Authority establishing the legal treatment of the differing adopted reference. Explanatory purpose silently changes adopted digits. Seek a public official explanation specifically addressing that difference.
B11 — Internal-document qualification The preamble’s own-business discussion is conditional and distinguishes copies and derived information. C014;S002. Any actual document facts; full application law. Every internal document is CSI, or none can be CSI. Keep any future generic interpretation tied to the complete qualifying discussion.
B12 — Earlier proposal Proposed(j)(4) establishes historical5414 wording only. C015;S006. Any earlier adopted operation material to an expanded history question. A proposal was operative law. Authenticate the relevant earlier adopted definition if that additional history becomes necessary.
B13 — Later listed amendment The2024 instruction changes(a), not(i). C016;S005. A different later adopted instruction affecting(i). Every new section source credit alters every paragraph. Read the complete targeted instruction of any newly identified publication.
B14 — “Updated” agency format The examined format retains5414 and has a drafting date placeholder. C017;S002. A separate adopted corrective instrument. Filename wording proves a legal amendment or commencement. Compare any alleged correction with its published adopted body and DATES.
B15 — Actual§5414 target The section exists, while the specific(b)(1)(C) subdivision is absent from the body read. C018;S003. An authoritative explanation connecting the regulatory locator to another provision. The entire statute is nonexistent or the regulation is automatically invalid. Search public correction/interpretive instruments addressing the exact locator.
B16 — Actual§5514 comparator The risk clause exists within a qualified statutory supervision paragraph. C019;S004. Any authority making it the operative replacement in(i)(4). Topic similarity alone authorizes substitution. Preserve the comparison and seek an explicit public explanation of the printed number.
B17 — Rulemaking authority Section5512(c)(6)(A) supplies the narrow confidentiality-rulemaking direction. C020;S007. Complete authority for any actual access or disclosure consequence. Rulemaking authority is a personal disclosure permission. Identify the particular legal-effect question before opening another regime.
B18 — Correction-index limitation Absence from these selected index entries is bounded by the indexes’ exclusion of agency errors. C021;S008. Complete adopted agency-correction history. No index entry means no correction exists anywhere. Consult official adopted publications, not only editorial-error indexes.
B19 — Failed route Failed access or a failed locator supplies no substantive-law conclusion. C023;S003/S004/S009. Original2013 body through an ordinary readable official route. Failure proves absence, repeal or interpretation. Use the official issue contents or another ordinary government publication locator.
B20 — Application and parent boundary C025 preserves the separation between source findings and actual confidentiality, supervision, remedy or disclosure decisions. Actual facts and separately authorized legal regimes. This supplement permits disclosure, assures confidentiality or resolves a firm’s status. Keep those matters held; pursue only a separately scoped generic public-law question.

R091-P3-C008The same item also addresses assessing whether an institution should be considered a covered person under12 USC5481 or is subject to CFPB supervisory authority. It ends with “and/or” before item(5). The definition cannot be restated as requiring every numbered item cumulatively.S002, §1070.2(i)(4), P75217/I23.
R091-P3-C009Item(i)(5) incorporates information exempt under5 USC552(b)(8). This pass preserves that dependency; it does not decide a FOIA exemption or disclosure result.S001, §1070.2(i)(5).
R091-P3-C010Under(f), confidential information encompasses the defined complaint, investigative and supervisory categories and other CFPB information potentially exempt under FOIA. The definition excludes CFPB-authorized public availability/disclosure, while retaining its stated treatment when information reaches or enters third-party records. Mere public circulation is not the express exclusion.S002, agency-posted instruction2, §1070.2(f), P86/I85; same adopted clause in original P75216/I22. files.consumerfinance.gov
R091-P3-C011These definitions apply for purposes of Part1070. Actual classification, and the full §5481 incorporation, remain held.S002, agency-posted instruction2 introductory text and(l),(n),(o),(q), P85–88/I84–87; S001 corresponding clauses.

R091-P3-C012The2020 adopted instruction2 replaces §1070.2 in full and prints5414 in(i)(4). The examined current paragraph(i) matches that adopted definition. Publication was November24,2020; the stated effective date was December24,2020. No separate(i)(4) application or savings qualification appears in DATES or instruction2. This is not a claim about every passage of the final-rule document.S002, DATES P75194/I0; instruction2 P75216–75217/I22–23; S001(i).
R091-P3-C013The2020 preamble expressly names 5514(b)(1)(C),5515(b)(1)(C), and5516(b) when explaining the supervisory-authority coverage intended to be retained while separating market-monitoring information. That authenticated explanation strengthens the contextual comparison. It is not an express instruction to replace5414 in the adopted text.S002, complete preamble discussion headed §1070.2(i), particularly P75198/I4; continuation P75199/I5. federalregister.gov
R091-P3-C014The same explanation distinguishes internally held business documents from information derived from supervisory material. Its stated own-business exclusion requires the documents not to contain supervisory-process communications/information and not to be possessed by CFPB. Submission of copies does not, by itself, convert the institution’s retained copies into Bureau confidential information. This is attributed preamble explanation, not an actual-record determination.S002, §1070.2(i) preamble, P75198–75199/I4–5. govinfo.gov
R091-P3-C015The2016 proposed CSI definition was numbered(j), and proposed(j)(4) already printed5414(b)(1)(C). Thus the number is not first observable only in the current compiler. The proposal establishes historical wording, not operative adoption.S006, proposed §1070.2(j)(1)–(5), P58323/I13. govinfo.gov
R091-P3-C016The2024 Part1070 instructions retain the authority citation, replace(a) with the Supervision Director definition, and replace the former official-title terminology in§1070.42. Instruction2 does not revise(i). Its express effect date is November29,2024. No numerical correction of(i)(4) is accomplished by those instructions.S005, DATES P94600/I0; instructions1–3 P94601/I1. govinfo.gov
R091-P3-C017The agency-hosted format whose filename includes “updated” also retains5414 in(i)(4). Its first page contains an unfilled effective-date placeholder referring to30days after Federal Register publication. Neither the filename nor that placeholder is an authenticated later numerical correction or a substitute for the published DATES.S002, agency format P1/I0 andP87/I86. files.consumerfinance.gov +1
R091-P3-C018Section5414 exists and is titled Savings provisions. This is a structural comparison, not application of the OTS transition regime.S003, complete §5414, especially(b) chapeau and(1)–(3). uscode.house.gov
R091-P3-C019Section5514(b)(1) directs periodic reports and examinations of persons described in(a)(1), for compliance assessment, information about activities/compliance systems, and—in(C)—consumer/market risk assessment. Paragraph(a)’s coverage qualifications remain material. The statute says financial products “and” services; the regulatory risk phrase says products “or” services. They should not be presented as a verbatim-identical quotation.S004, complete(a)(1)–(3),(b)(1)(A)–(C), with adjacent(b)(2); S001(i)(4). uscode.house.gov
R091-P3-C020Section5512(c)(6)(A) directs CFPB to prescribe confidentiality rules for information obtained from persons in exercising federal consumer-financial-law authority. Complete(c)(6)(B)–(C) contains separately qualified inter-regulator access provisions. Neither this rulemaking direction nor this pass establishes an actual disclosure authorization or repairs(i)(4).S007, complete(c)(6)(A)–(C). uscode.house.gov
R091-P3-C021No§1070.2 entry appeared in the examined Title12 portions of the2020–2026 eCFR correction indexes. Those indexes expressly omit issuing-agency errors. Their bounded negative result cannot establish that no agency correction, interpretation or other relevant authority exists.S008, scope statements and selected Title12 entries.
R091-P3-C022No adopted instruction or explicit authoritative numerical-repair explanation was authenticated in the selected publications and targeted searches. This is a research-result limitation, not a finding that no such authority exists. The specific remaining question is whether a public adopted operation or authoritative explanation establishes how5414 in(i)(4) is to be treated.S001–S009; read/failure log below.
R091-P3-C023The failed initial OLRC URLs do not establish an absent statute: readable current OLRC bodies were subsequently obtained. The2013 citation resolver’s unsuccessful result does not establish absence of the earlier publication.S003/S004 successful bodies; S009; failure logF01–F03.
R091-P3-C024Currentness is bounded by the actual eCFR and OLRC displays and selected history read. The complete intervening statutory, regulatory and judicial chain was not certified. A title-wide update does not establish a section-specific amendment.S001–S008, their stated read bounds.
R091-P3-C025The sources establish a literal-reference difference and relevant agency explanation. They do not establish, in this pass, an authoritative substitution, actual CSI classification, privilege, disclosure permission, supervision determination, remedy or private right. Those are distinct questions requiring additional authority and predicates.C003,C007–C013,C018–C024; bounded textual inference, not judicial construction.

R091-P1-S020 — version/status proposition: “Final displays through 10/26/2026. Official-hosted, unofficial codification. Selected 2020 adopted text authenticated in S021. A printed statutory cross-reference discrepancy remains visible below.”Fresh S001 again displays the section through10/26/2026 and retains5414. The separately retrieved Part banner displays10/23/2026. Fresh S002 authenticates the selected2020 adopted text. C001–C003,C012,C024.The reference observation is supported anew. No change to pass-01. Its stated reading of§§1070.40 and.41 is not reverified by this supplement; no dependent disclosure proposition is reaffirmed here.
R091-P1-S021 — publication/status proposition: “Published November 24, 2020; effective December 24, 2020. Adopted text contains the same §1070.2(i)(4) numerical cross-reference problem visible in current eCFR.”The original PDF’s DATES and complete instruction2 confirm those dates and the literal5414 reference: P75194/I0;P75216–75217/I22–23. The newly examined complete CSI preamble discussion expressly names5514: P75198–75199/I4–5. C012–C014.Original-text authentication is freshly supported and explanatory context is added.
The apparent numerical mismatch is recorded, not judicially or editorially repaired here.”Fresh current and adopted bodies confirm the first sentence. Complete§5414 confirms that its(b)(1) lacks(C); complete§5514(b)(1) confirms the risk-assessment clause in context. The2020 preamble expressly connects the revision to5514; the2016 proposal already printed5414; the2024 selected amendment does not change it. C003,C012,C013,C015,C016,C018,C019.The documentary basis is stronger. The no-repair qualification remains. This is more than an availability-only improvement, because additional explanatory and historical text was authenticated. It is not an operative numerical correction, whole-report review or acceptance.
