Types of debt

A bank balance you cannot pay: identify the loan or overdraft

Separate an installment loan, credit line, and negative deposit account before treating them as the same bank debt.

A bank may hold your loan, checking account, credit line, and savings collateral. Identify the agreement behind each balance and how the accounts interact before moving money or accepting a plan.

Which balance are you trying to resolve?

Installment loan

Find principal, interest method, remaining term, payment schedule, and dated payoff. Check whether a missed payment triggered a demand for the entire remaining balance (acceleration) or whether a hardship change is available.

Revolving line

Separate the amount drawn from the unused limit. Identify the minimum formula, variable-rate terms, draw restrictions, and maturity.

Deposit-secured borrowing

Identify the pledged savings or certificate, the lender's rights against it, and when the hold is released. A savings balance under a hold may not be available for ordinary spending.

Negative deposit account

Rebuild the transactions and fees that produced the negative balance. Distinguish an authorized overdraft service, linked transfer, credit advance, and alleged error.

Audit an overdraft fee by transaction type

Regulation E section 1005.17 generally requires specified notice, an opportunity to opt in, affirmative consent, and confirmation before charging for paying an ATM or one-time debit-card overdraft. That is a defined fee protection; it is not a universal prohibition on negative balances.

  1. Identify the transaction: one-time debit, ATM, recurring debit, check, Automated Clearing House (ACH) bank transfer, or another type.
  2. Match authorization, settlement, and fee dates to the ledger.
  3. Request the opt-in record and confirmation if the fee falls within that branch.
  4. Check whether the account used linked savings or a credit agreement instead.
  5. Ask for correction or waiver with the specific transaction and reason identified.

The rule permits revoking opt-in, subject to its implementation provisions. Revocation does not erase an existing valid negative balance or guarantee all later transactions will be paid.

Ask for a ledger that explains the balance

List the starting balance, each debit and credit, each fee, any returned item, and later correction. An available balance can differ from a posted balance because of holds or pending transactions. Ask which balance the institution used for the challenged charge.

If a transaction is unauthorized or incorrectly processed, use the bank's applicable error process promptly and retain the written record. A request for financial hardship is a different request from an error notice; make both clear when both apply.

Compare a proposed plan with access to essential cash

Ask whether the plan closes or freezes the account, stops fees, carries interest, affects other bank products, or authorizes withdrawals. Review any contractual or legal setoff or security rights rather than assuming the bank can—or cannot—apply a deposit to the debt.

For online lenders and credit unions, preserve the same core documents and identify the correct regulated entity. A recognizable app name may be a broker or platform rather than the creditor. If a new loan would repay the balance, compare its full fees, rate, repayment dates, and collateral risk with the current obligation.
