PASS-19 through PASS-22 remain saved but unreviewed and are not adopted as premises. The limited judgment-entry, stay, lien, assignment, and execution provisions necessary for this pass were freshly read.
This pass does not determine any actual title, occupancy, judgment balance, mortgage payoff, lien priority, property value, county filing, abandonment, spouse consent, sale date, redemption date, or authority to collect. It does not complete mortgage foreclosure, tax sale, probate, partition, bankruptcy, fraudulent-transfer law, support enforcement, local law, tribal law, or foreign-country enforcement.
Kansas sharply separates five events that are often blurred together:
A judgment lien is not a writ, a levy is not a completed sale, and a sale does not become final merely because a bidder appeared. Kansas Legislature+3
Kansas homestead protection is unusually strong. It is not based on a dollar or equity cap. The current protection covers:
when occupied as a residence by the owner, the owner’s family, or both, with the improvements included. The exemption has no statutory inflation adjustment because it has no dollar amount to adjust. Kansas Legislature+1
For an ordinary unsecured judgment:
Kansas does not generally require a previously recorded homestead declaration. If land is levied on before the homestead has been formally selected and set apart, the householder, spouse, agent, or attorney may give the officer a written designation at levy or any time before sale, and only the remainder is subject to sale. Kansas Legislature
For nonexempt real estate, the ordinary sale route includes:
| Stage | Actor | Required event | Immediate legal effect | What it does not do automatically |
|---|---|---|---|---|
| Judgment entry | Judge and clerk | Signed journal entry or judgment form filed | Judgment becomes effective | Does not itself seize land |
| Automatic enforcement stay | Court by statute | Judgment entered | Ordinary execution barred for 14 days unless an exception/order applies | Does not erase the judgment |
| Original-county Chapter 60 lien | Statute/clerk record | Chapter 60 judgment rendered | Lien on debtor’s nonexempt real estate in that county | Does not attach to a homestead; does not itself levy |
| Other-county lien | Creditor/clerk | Attested journal entry, costs statement, fee, and filing in other county | Lien begins in that county on filing | No statewide automatic lien |
| Chapter 61 conversion | Creditor/clerk | Statutory fee and renumbering under K.S.A. 60-2418 | Limited judgment can use Chapter 60 real-estate route | Chapter 61 writ alone cannot levy real estate |
| Execution or order of sale | Clerk and judge | Interested person requests writ; clerk issues; judge signs | Authorizes officer to proceed | Does not conclusively establish title or exemption status |
| Levy | Sheriff/officer | Writ served; property identified; copy left with occupant or posted | Brings described debtor interest into execution process | Does not transfer ownership |
| Publication and party notice | Officer/creditor | Three weekly publications plus required direct notice | Permits sale process to proceed | Publication alone is not enough for parties entitled to actual notice |
| Sheriff’s sale | Officer | Public sale under writ | Purchaser receives certificate if redemption applies | Does not finally transfer title before confirmation/deed |
| Confirmation | Court | Review of legality, equity, notice, and price | Sale approved or rejected; fair-value adjustment possible | Not automatic from highest bid |
| Redemption | Owner or qualifying creditor | Statutory payment through proper process | Reclaims property/right from certificate holder | Does not occur through informal promise |
| Sheriff’s deed | Sheriff under court order | Confirmation plus expiration/nonexistence of redemption | Transfers debtor’s estate in property | Transfers no greater estate than debtor owned |
| Distribution/satisfaction | Court, sheriff, creditor | Costs, taxes, liens, credits, and balance accounted for | Judgment reduced or paid | Sale price alone does not prove full satisfaction |

A Kansas judgment is effective when the judge signs and the clerk files the journal entry or judgment form. Ordinary execution is then stayed for 14 days unless a statute or court order provides otherwise. Postjudgment motions, an appeal bond, or a specific stay order can extend that protection. A private settlement discussion, collection complaint, or appeal notice by itself is not equivalent to a court stay. Kansas Legislature
K.S.A. 60-2202 makes a Chapter 60 Kansas district-court judgment—or a qualifying federal judgment rendered in Kansas—a lien on the debtor’s real estate in the county where judgment was rendered. Subject to statutory qualifications, the lien can relate back to the petition-filing date, but not more than four months before judgment entry. Kansas Legislature
That lien rule is subject to the homestead rule. A general judgment creditor cannot rely on K.S.A. 60-2202 to place a dormant or contingent lien on a qualifying homestead for later use; Rooney holds that the lien does not attach to or affect the homestead in the first place. Justia Law
A Kansas judgment is not an automatic statewide real-estate lien. To create a lien in another county, the creditor must file with that county’s district-court clerk:
The lien in the additional county begins on that filing date. Execution itself remains issued from the court that rendered the judgment. Kansas Legislature
A Chapter 61 execution or order of sale cannot be levied on real property unless the creditor follows K.S.A. 60-2418. That requires payment of the statutory fee, renumbering of the case as a Chapter 60 case, and then filing the judgment in the county where real property is located under K.S.A. 60-2202. Kansas Legislature+1
Small claims is supplemental to Chapter 61, so an ordinary small-claims money judgment uses that conversion route before real-estate execution unless a more specific provision controls.
A successor claiming through assignment, operation of law, or personal representation must file the assignment or transfer documentation with the clerk before using the predecessor’s judgment remedies in its own name. If succession is contested, the court determines it on reasonable notice. A collection placement, database notation, or debt-buyer label does not substitute for the required chain. Kansas Legislature
The current general-execution statute directs the officer to seize any nonexempt property sufficient to satisfy the judgment. This pass did not locate a current general rule requiring every creditor first to exhaust personal property before reaching nonhomestead real property. Older Kansas writ practice sometimes used a goods-first sequence, but the current text does not state a universal personal-property-first hierarchy. Court orders, special judgments, liens, exemptions, and proportionality can still affect asset selection. Kansas Legislature+1
The Kansas Constitution protects 160 acres of farming land or one acre within an incorporated town or city, occupied as the family residence, with improvements. The current statute extends the protection to occupancy by the owner, the owner’s family, or both, and expressly includes manufactured and mobile homes. Kansas Secretary of State+1
| Property type | Current maximum protected extent | Dollar/equity cap |
|---|---|---|
| Farming or rural land | 160 acres | None |
| Land within incorporated town or city | 1 acre | None |
| Manufactured or mobile home | Qualifying home and improvements under statutory facts | None stated |
| Rural land later annexed | Prior homestead acreage right continues until sale after annexation | None |
K.S.A. 12-524a preserves pre-annexation homestead rights after city annexation until the land is sold after annexation. Kansas Legislature
Kansas does not cap the homestead at $50,000, $125,000, $250,000, or any other dollar figure. A qualifying one-acre urban homestead with $100,000 of equity and one with $1 million of equity are treated the same under the ordinary unsecured-judgment exemption. The acreage and occupancy rules—not market value—set the ordinary limit. Kansas Legislature+1
That does not eliminate:
The temporal effect of a preexisting nonhomestead judgment lien later followed by homestead occupancy remains fact-specific and was not resolved in this pass.
The current statute protects a residence occupied by:
Kansas interprets “owner” broadly enough to include certain equitable interests. A qualifying homestead can rest on cotenancy, equitable title, an executory purchase interest, a leasehold, a life estate, or a self-settled revocable trust interest, if the claimant has a sufficient ownership interest and actual qualifying occupancy. Justia Law+1
A title label alone is not enough. The claimant must establish:
The statute expressly includes owner occupancy, so a single owner can qualify. The constitutional provision refers to family occupancy, but Kansas’s statute was amended to cover single owners. Rooney recognizes that statutory expansion. Justia Law
For a married homestead:
The spouses do not receive two acreage exemptions.
In Commerce Bank v. Odell, two co-owners of a 240-acre farm attempted to claim 120 acres each. The court held that the property could support only one 160-acre homestead; the remaining 80 acres was subject to execution. The expansion of eligibility to more persons did not expand the quantity of exempt land. Justia Law
Thus:
Plain text
Rural parcel: 240 acres
Homestead maximum: 160 acres
Potential nonhomestead excess: 80 acres
Ownership fractions and legal descriptions still matter. A co-owner’s exemption is tied to that owner’s interest in the qualifying homestead area, not to a second full tract.
A recorded declaration is not a universal prerequisite.
If a levy is made before the homestead has been selected and set apart, the following may give the officer a written homestead designation:
The designation can be made at levy or any time before sale and must describe the claimed homestead. Only the remainder is subject to sale. Kansas Legislature
A late claim after sale presents materially different issues. K.S.A. 60-2302 expressly protects designation through the period before sale, not an unlimited post-sale rescission right.
The claimant initially must establish a homestead interest through ownership or equitable interest, occupancy, location, and acreage.
Once a homestead is established, Kansas presumes it continues. The party seeking to defeat it bears the burden of proving abandonment by positive and clear evidence. Abandonment requires both:
Temporary absence, hospitalization, nursing-home residence, military absence, or another definite-purpose removal does not alone establish abandonment. Justia Law+1
In Chaney v. Armitage, moving to a care facility did not destroy the homestead during the owner’s lifetime because he intended to return. Justia Law
A self-settled revocable trust does not automatically destroy homestead protection. Redmond v. Kester held that an equitable interest in property held by such a trust can be sufficient when the debtor occupies the property. Justia Law
But that does not turn every trust residence into a homestead:
Chaney distinguishes the owner’s lifetime exemption from the post-death result. During the owner’s lifetime, the homestead remained protected despite trust ownership and care-facility absence. After death, no spouse or child continuously occupied the property, and the revocable-trust assets became subject to creditor claims under the trust statute. Justia Law
Kansas probate law can continue homestead protection for a surviving spouse and children under qualifying occupancy facts, but full probate administration is outside this pass.
A qualifying homestead is not exempt from process for:
| Exception | What must be established |
|---|---|
| Taxes | Valid tax obligation and process |
| Purchase-money obligation | Obligation contracted for purchase of the premises |
| Improvements | Obligation contracted for erection of improvements on the premises |
| Consensual lien | Valid lien with required spouse consent where married |
These are narrow exceptions. An ordinary unsecured credit-card, debt-relief, medical, installment, or collection judgment does not become a purchase-money or consensual homestead lien merely because the creditor obtained judgment. Kansas Legislature+1
Deutsche Bank v. Rooney squarely holds that a general judgment lien under K.S.A. 60-2202 does not attach to or affect a homestead. The lien does not sit invisibly against the homestead awaiting a later mortgage foreclosure or sale. Justia Law
This has an important proceeds consequence. When a mortgage creditor validly forecloses, an ordinary judgment creditor whose lien never attached to the homestead does not automatically acquire the surplus merely because the homestead has been sold.
Kansas has no general statutory rule saying all proceeds from a homestead sale remain exempt indefinitely.
Historical Kansas authority recognizes a narrow equitable protection where the owner sells a homestead with a contemporaneous intention to reinvest promptly in another homestead. But where there was no such intention when the property was sold, the proceeds were not exempt; forming the intention only after a creditor action began did not cure the issue. Justia Law
Kansas also holds that repayment of a loan originally made from homestead-sale proceeds is not itself exempt as homestead property. Justia Law
No universal reinvestment period was verified. The necessary facts include:
| Stage | Actor | Required document or act | Relative timing | Consequence |
|---|---|---|---|---|
| 1. Effective judgment | Court/clerk | Signed and filed judgment | Event 0 | Judgment effective |
| 2. Enforcement stay | Statute/court | Ordinary no-execution period | 14 days | No ordinary writ during stay |
| 3. County lien | Creditor/clerk | Judgment record in original or additional county | Before levy | Creates lien on nonexempt debtor real estate |
| 4. Assignee substitution | Successor creditor | Assignment/transfer documents filed | Before successor enforcement | Successor may proceed in own name |
| 5. Writ request | Interested person | General or special execution request | After stay | Clerk issues; judge signs |
| 6. Writ service | Sheriff/officer | Personal service or authorized alternate method | Promptly | Starts execution process |
| 7. Exemption notice | Officer | K.S.A. 60-2420 notice | With writ | Advises debtor of exemptions/hearing rights |
| 8. Real-estate levy | Officer | Leave copy with occupant or post conspicuously | At levy | Identifies property in execution |
| 9. Homestead designation | Debtor/spouse/agent/attorney | Written description to officer | At levy or before sale | Only nonhomestead remainder remains |
| 10. Party notice | Parties | K.S.A. 60-205 service of motions/notices | As proceedings occur | Gives actual notice to litigating parties |
| 11. Public sale notice | Officer/creditor | Newspaper publication | Weekly × 3; final notice 7–14 days pre-sale | Public sale may proceed |
| 12. Sale | Sheriff | Public courthouse sale unless court orders another location | Advertised date | Highest bid subject to confirmation/redemption |
| 13. Return | Sheriff | Sale return; taxes noted | Immediately after sale | Court reviews transaction |

A general execution directs the officer to seize sufficient nonexempt debtor property and cause it to be sold. A special execution or order of sale directs action regarding specified property. At an interested person’s request, the clerk issues and a judge signs the writ. Execution under K.S.A. 60-2401 is personally served; if personal service cannot be obtained, another authorized service method may be used. The officer must return the writ within 60 days. Kansas Legislature
The statute does not state a universal separate sworn affidavit for every real-estate execution request. Actual court and local filing requirements can require a balance statement, legal description, assignment proof, proposed order, title evidence, or other support.
When real property is levied upon, the officer leaves a copy of the order with the occupant. If no occupant is present, the copy is placed conspicuously on the property. The officer’s return identifies the occupant, if any. Kansas Legislature
This step is distinct from service on parties, public sale publication, and title notice.
Kansas’s direct real-estate levy provision does not require the two-appraiser inventory used for tangible personal property. For ordinary real-estate execution, valuation becomes especially important at confirmation, where the court may:
A creditor’s appraisal, broker opinion, tax value, or sheriff’s estimate is evidence—not a conclusive valuation.
Real estate may not be sold until the officer gives public notice:
The last publication must be no fewer than 7 and no more than 14 days before sale. Kansas Legislature
The statutory agricultural-parcel subsection on the current page expired July 1, 1992 and cannot be treated as current authority. Kansas Legislature
The sale ordinarily occurs at the courthouse in the county seat of the county where judgment was rendered. On application and good cause, a district judge whose district includes that county can designate the property or another location. Kansas Legislature
Publication under K.S.A. 60-2410 is notice to the public. It does not displace K.S.A. 60-205’s requirement to serve written notices and papers on parties to the civil action.
In Alliance Mortgage v. Pastine, publication alone was constitutionally insufficient for a junior lienholder that was a party to the case. Kansas requires both public publication and actual party notice where the rules apply. Justia Law+1
For a spouse, co-owner, or lienholder who is not already a party, the required route depends on:
This pass did not locate a single Article 24 provision requiring restricted-mail notice to every possible nonparty lienholder in every ordinary execution sale. Due process and joinder remain necessary.
The sheriff immediately returns the sale to the court and notes taxes due or delinquent. The court confirms only if the proceedings were regular and conformed to law and equity. Kansas Legislature
The court may reject the sale for substantial price inadequacy. It can also set a minimum or upset price or require a fair-value credit. A bid covering the full judgment, taxes, interest, and costs is statutorily deemed adequate, but procedural and notice defects can still prevent confirmation. Kansas Legislature+1
K.S.A. 60-2410 generally protects a purchaser’s title from later judgment reversal and instead directs restitution against the judgment creditor, subject to the section’s publication-service exception. This underscores why a stay must be obtained before sale rather than assumed from a pending appeal. Kansas Legislature
If property is subject to redemption, the purchaser receives a certificate stating the property, purchase amount, costs, and conditional right to a deed if no redemption occurs. If no redemption applies, the sheriff executes a deed under court order. Kansas Legislature
The deed transfers only the estate vested in the debtor when the property became liable to the judgment. It does not eliminate a nondebtor co-owner’s interest or convey rights the debtor never held. Kansas Legislature
Unless a specific exception applies, the defendant owner can redeem real property sold under execution within 12 months from sale by paying:
Plain text
Purchase certificate amount
+ allowed and documented certificate-holder expenses
+ interest at the applicable K.S.A. 16-204(e)(1) rate
+ costs
+ taxes through redemption
The owner is entitled to possession during the redemption period. Kansas Legislature+1
No current numeric interest rate is inserted here because the applicable rate depends on the actual redemption interval.
The court can shorten or extinguish the owner’s redemption period if, after a hearing on at least 21 days’ notice to all parties, it finds:
This is a post-sale redemption rule and is separate from whether the property qualified as a homestead before sale. Kansas Legislature
The first three months of the ordinary redemption period generally belong exclusively to the owner and successors. If the owner does not redeem, qualifying creditors with liens before the creditor-redemption deadline can redeem during the remaining period. Kansas Legislature
The mortgage-foreclosure-specific shortened period in subsection (m) is not automatically applicable to an ordinary unsecured judgment sale.
A nonhomestead parcel can still be redeemed after execution sale. A homestead protected from an ordinary unsecured judgment should ordinarily never reach that sale in the first place. Redemption is therefore not a substitute for asserting the homestead exemption before sale.
For analytical purposes:
Plain text
V = supported property value
O = debtor’s ownership fraction
M = senior consensual mortgages and liens
T = taxes and superior governmental charges
C = court, sheriff, publication, and sale costs
E = debtor’s gross equity
N = potential value available to the judgment
A screening formula is:
Plain text
E = max(0, (V × O) − M − T)
N = max(0, E − C)
This is not an automatic distribution order. Actual lien priority, foreclosure status, taxes, redemption, co-owner rights, and sale instructions determine the final result.
For a qualifying homestead and an ordinary unsecured judgment:
Plain text
Potential value available to ordinary
judgment creditor from homestead equity = $0
That remains true whether equity is $20,000 or $900,000, because the exemption is not dollar-capped. A valid tax, purchase-money, improvement, or consensual homestead lien follows a different branch. Kansas Legislature+1
Execution generally reaches only the debtor’s interest and remains subject to existing liens. The sheriff’s deed transfers no more than the debtor owned. Kansas Legislature
For a jointly owned nonhomestead parcel:
Among ordinary judgment liens, attachment and priority depend on:
No creditor can acquire priority through a lien that never attached to the homestead.
If a mortgage validly forecloses a homestead, that does not give a general judgment creditor a lien it never had. Rooney rejects the theory that a general lien waits behind the exemption and springs into effect when another creditor forces the sale. Justia Law
Actual surplus distribution in foreclosure requires the foreclosure pleadings, parties, lien adjudication, and order and remains outside this ordinary-execution pass.
Depending on the defect and timing, a debtor, spouse, co-owner, or lienholder may seek:
The correct route depends on whether the dispute concerns:
None of the following automatically stays a writ or sale:
An enforceable stay requires statute, court order, bond, agreement recognized by the court, or another valid legal mechanism. Kansas Legislature
A nondebtor title owner has a protectable interest and can seek a stay, injunction, or other relief before a sheriff’s sale clouds title. Kansas authority rejects forcing the true owner to wait until after sale and deed issuance. Justia Law+1
Unlike the personal-property third-party-claim statute, K.S.A. 60-2407 is written for goods and chattels. Real-estate ownership disputes ordinarily proceed through intervention, motion, injunction, quiet-title, or other court process.
| Issue | Initial burden |
|---|---|
| Qualifying homestead | Claimant establishes ownership/equitable interest, occupancy, location, and extent |
| Abandonment | Creditor or challenger proves removal plus intent not to return with positive and clear evidence |
| Excess acreage | Creditor identifies acreage beyond statutory maximum; claimant designates protected portion |
| Judgment assignment | Successor creditor establishes documented transfer |
| Nondebtor co-ownership | Claimant establishes ownership share and title |
| Senior lien | Lienholder establishes lien validity, priority, and payoff |
| Notice defect | Objector establishes party status, required notice, and failure |
| Inadequate sale price | Objector presents valuation and inequity evidence |
| Satisfaction | Party asserting payment establishes credits and resulting balance |

$250,000 − $80,000 − $5,000
= $165,000
The large disparity does not automatically void the sale, but it supports a confirmation hearing. The court can reject the bid, order resale, set an upset price, or require fair value to be credited. Kansas Legislature

Fixed reinvestment period Not verified
The controlling questions include intent at the time of sale, promptness, segregation, tracing, and actual replacement steps. A later-formed intention after creditor action does not create retroactive protection. Justia Law
Assumptions

Judgment balance before sale $70,000
Confirmed sale credit 62,000
Later voluntary payment 8,000
Remaining balance 0
Arithmetic:

The sheriff’s return and court accounting must establish the $62,000 net credit after taxes, liens, interest, and costs. Once full satisfaction is established and the creditor receives a proper restricted-mail demand, the creditor has 21 days to file satisfaction in the entry court and every court where the judgment was filed. The examples were recalculated:
Plain text
Nonhomestead equity:
$260,000 − $140,000 − $5,000 = $115,000
After assumed $10,000 costs:
$115,000 − $10,000 = $105,000
Modest homestead equity:
$240,000 − $180,000 = $60,000
Ordinary judgment availability = $0
High-value homestead equity:
$1,200,000 − $250,000 = $950,000
Ordinary judgment availability = $0
Excess rural acreage:
220 − 160 = 60 acres
Joint rural parcel:
240 − 160 = 80 acres
Bid-based remainder:
$120,000 − $80,000 − $5,000 − C
= $35,000 − C
Market equity:
$250,000 − $80,000 − $5,000
= $165,000
Redemption:
$150,000 + $4,000 + $3,000 + $2,000 + I
= $159,000 + I
Satisfaction:
$70,000 − $62,000 − $8,000 = $0
These calculations establish arithmetic only. They do not establish title, homestead eligibility, lien priority, sale adequacy, redeemability, or collection authority.
Kansas protects a qualifying homestead by acreage and occupancy, not by equity. Up to 160 acres of rural farming land, one acre in an incorporated city or town, or a qualifying manufactured/mobile home can be completely insulated from an ordinary unsecured judgment regardless of value. A general judgment lien does not attach, spouses do not double the acreage, and only the narrow constitutional and statutory exceptions can penetrate the exemption.
Nonhomestead real estate follows a multi-stage court process. A county-specific judgment lien must exist; Chapter 61 judgments must first be converted; a judge-signed writ must issue; the sheriff must levy; the property and parties must receive the required notices; the sale must be publicly advertised for three weeks; and the court must independently confirm that the proceeding was lawful and equitable. The owner then generally has 12 months to redeem while retaining possession.
The real questions are therefore factual and document-driven: where the property is, how much land it includes, who owns it, who occupies it, whether the homestead was abandoned, what liens predate the judgment, what notices were served, what the property is worth, and whether the court confirmed the sale. Until those facts and records are established, neither a lien nor an execution result can responsibly be assumed.
