S_CT PASS-01 — Connecticut provider market access and consumer fees

Connecticut provides licensing routes for both debt adjustment and debt negotiation. The retrieved law does not support treating all for-profit debt settlement as prohibited. It also does not support treating every debt-management, counseling, settlement, or attorney-affiliated business as operating under the same permission or fee rules. The activity performed, receipt and distribution of debtor funds, consumer purpose, Connecticut nexus, and any qualifying exemption determine the applicable route. [C001–C019] prdext3.cga.ct.gov+3

For a nonexempt unsecured-debt negotiator, the published schedule specifies a reasonable setup fee up to $50; monthly service fees up to $8 per listed creditor, capped at $40 per month; and total aggregate fees, including those charges, capped at 10% of the debt reduction achieved in each settlement. These are ceilings, subject to performance and collection conditions. [C020–C026] portal.ct.gov

Baseline: October 22, 2026, Pacific. Actual research/access date: October 23, 2026, Pacific and UTC.

Currentness qualification: I read the official 2025 statutes together with the 2026 supplement, relevant enacted changes, current agency materials, and an October 6, 2026 final administrative order. Targeted searches found no later amendment to the provisions at issue. An exhaustive check of all 2026 enactments remains open: the official amended-statutes and conversion-table indexes still stopped at 2025, although the acts list covered 2026. Consequently, this report does not certify that every enacted 2026 provision has been excluded as a possible amendment. [C037] prdext3.cga.ct.gov+2

This is the provider-access and consumer-fees component only. No whole-state or A066 acceptance follows.

ID convention: In the discussion, C001 means S_CT-P1-C001, and S001 means S_CT-P1-S001. The registers below give the full unique IDs.

A. Substantive answers to the seven scope questions

1. Classification depends on conduct

The central division is between receiving debtor funds for distribution and assisting with negotiation of obligations.

Actual conduct Connecticut classification and consequence Claims
Compensated receipt, as the debtor’s agent, of money or evidence of money for distribution among creditors Debt adjustment. A conventional custodial DMP can qualify even if creditors receive full principal and no concession is negotiated. C001
Compensated assistance negotiating, or attempting to negotiate, a debtor’s obligations Debt negotiation. Custody of funds and a successful principal reduction are not prerequisites. C002
Obtaining interest, payment-term, fee, or other concessions without handling debtor funds Potential debt negotiation. The breadth of coverage does not resolve how every concession is valued under the savings-based fee ceiling. C002, C026
General education or budgeting without the statutory negotiation assistance or fund-distribution activity Not established as either regulated activity on those facts alone. “Coaching” that actually assists negotiation, or an offer made with expected later compensation, requires further classification. C004
Paid correction of adverse credit-report information, or advice about accomplishing that correction Potential “credit clinic” conduct under §36a-700, with its own performance-before-fee rule. C005
Genuine business-purpose obligations or debts of an entity Outside the particular consumer-debtor definitions examined here. This is not a clearance under commercial, collection, lending, or other law. C003
A creditor adjusting its own receivable in its creditor capacity Ordinarily different from acting as the debtor’s adjustment agent or paid negotiation representative; this is a functional inference, not an express general self-creditor exemption in the two exemption sections. C016

The definitions use compensation or its expectation. A free introductory stage, a different payment label, or compensation from another source does not by itself establish an exclusion. S001 §36a-655(5)–(6); S002 §36a-671(a)(4)–(5). prdext3.cga.ct.gov+1

For debt negotiation, §36a-671(b) expressly reaches a Connecticut business location, an out-of-state provider contracting with a Connecticut resident through the specified in-person or remote channels, and an out-of-state provider dealing with debt secured by Connecticut property. For debt adjustment, §36a-656 uses “in this state,” and §36a-659 expressly addresses Connecticut-resident funds; I did not substitute the negotiation statute’s three-part test for the adjustment statute. [C006–C007] prdext3.cga.ct.gov+1

2. Permission, prohibitions, and exemptions

The issuing authority is the Connecticut Banking Commissioner, Department of Banking. Nonexempt adjustment and negotiation require the applicable license; filing an application is not permission to operate. The statutes provide main-office and branch licensing, fitness and financial-responsibility requirements, solvency requirements, and bonding conditions. For-profit and nonprofit adjustment licensing are both recognized. [C008; S001 §36a-656; S002 §36a-671(b)–(d)] prdext3.cga.ct.gov+2

The exemptions differ materially:

  • Adjustment: §36a-663 covers the specified Connecticut attorney activity ancillary to representation; qualifying financial institutions acting in their regular principal business; qualifying title/abstract companies doing escrow business; and persons acting pursuant to specified law or court order. There is no general nonprofit exception in this section.
  • Negotiation: §36a-671c covers the specified attorney category, subject to Persels; enumerated banks and credit unions; qualifying subsidiaries; licensed debt adjusters while performing adjustment services; court-ordered actors; and qualifying bona fide §501(c)(3) nonprofits. Its stated exclusion applies to §§36a-671 through 36a-671d. [C009–C012] Regulated Activities+1

Thus, a qualifying nonprofit’s noncustodial negotiation activity and its custodial DMP activity can have different licensing results. Likewise, an adjustment license does not establish an exemption for every separate settlement service the company might sell.

Attorney qualification requires the controlling cases. In Persels, the Connecticut Supreme Court held the negotiation scheme unenforceable against Connecticut attorneys engaged in bona fide legal practice. It identified real legal services, a genuine attorney-client relationship, and meaningful supervision as relevant; an attorney serving as a front does not establish protection. The court also expected disciplinary review of fees to consider the statutory schedule. [C013] cases.justia.com

The 2025 Commonwealth Servicing Group decision addressed judicial jurisdiction to resolve the Persels issue. It expressly did not decide whether the commissioner ultimately could regulate the plaintiffs. The later December 17, 2025 agreement resolved the dispute without admissions or a merits adjudication. Neither establishes a universal exemption for law-firm affiliates. [C014–C015] cases.justia.com+1

I have not extended Persels automatically to the separate adjustment exemption in §36a-663. [C017]

3. Applicable fee structures, amounts, bases, and remaining holds

Structure Verified rule Consequential limitation
Unsecured negotiation setup Reasonable one-time initial/setup fee, maximum $50 Counts toward the aggregate ceiling; its name does not authorize advance collection.
Unsecured negotiation monthly service Maximum $8 per creditor listed in the contract, maximum $40 per debtor per month Creditor is the stated unit. Multiple accounts do not automatically create multiple creditor units.
Unsecured negotiation aggregate Maximum 10% of the debt reduction in each settlement, including initial and service fees, as the settlement is achieved and as agreed in the contract Not 10% of enrolled debt. Joint household obligations do not permit a higher percentage.
Separate settlement/success fee No separate additional dollar allowance is stated in the schedule Remaining space below the aggregate ceiling is not, by itself, proof that a separately structured success fee is earned or authorized.
Secured negotiation Debtor/mortgagor fee maximum $500 Collectible only after successful completion of all contracted services. The schedule does not prohibit mortgagee/assignee compensation. Other applicable secured-debt rules remain open.
Adjustment/DMP preliminary counseling Required individualized counseling and budgeting before agreement: $0 Applies to adjustment licensees under §36a-660(2).
Other adjustment/DMP fees Written fee disclosure and prorated deductions are addressed by statute A complete current numerical cap was not established. No “unlimited fee” conclusion is warranted.
Credit clinic No charge or receipt before the promised service is fully performed This limited boundary finding is not full credit-repair compliance clearance.

[C020–C030; S004, S001 §§36a-660–661a, 36a-700.] portal.ct.gov+3

Historical reconciliation. The September 28, 2009 announcement states that the new law would take effect October 1, 2009 and reproduces the same schedule. It also identifies the expansion allowing for-profit adjusters. A pre-change prohibition or nonprofit-only table cannot establish present access. No indexing clause or subsequent adjusted-amount notice was found in the fee authority and materials read; I did not calculate an assumed CPI adjustment. [C024] portal.ct.gov

The October 6, 2026 CDS final default order adopted findings concerning a contract fee of 25% of verified debt and its violation of the 10%-of-reduction aggregate limit. That is current administrative application of the limit, with the weight of a default order rather than a contested appellate holding. [C038] Temp CD, Rest, Disg, NOI CD-CP+2

Three fee questions remain specifically held: pre-first-settlement initial/monthly collection under state law; valuation of interest-only or other non-principal concessions; and any independent entitlement to a separately structured success fee. Allocation of shared prior fees between individual settlements also needs an authoritative resolution. [C026]

4. When fees may be requested or received

State negotiation rule: §36a-671b(b) prohibits receipt of consideration for a promised service until that service is fully performed, while expressly allowing reasonable periodic payments as services are rendered if clearly stated in the contract. Both sentences matter. The schedule’s settlement-based aggregate language must also be satisfied. A ceiling alone does not resolve collection timing. [C025–C026] Regulated Activities

The provision says “receive”; it does not supply a general affirmative permission to demand advance payment. Federal timing, where independently applicable, also controls requests.

Under 16 C.F.R. §310.4(a)(5), a covered debt-relief seller/telemarketer may request or receive fees only after the required alteration of a debt under a customer-executed agreement and a customer payment under the creditor agreement. Individually resolved debts must use the prescribed proportional-fee or uniform-savings-percentage allocation. State licensing does not replace those conditions. [C033] ecfr.gov

The federal dedicated-account provision is a separate conditional allowance, not fee ownership: insured institution, consumer ownership, independent administration, no prohibited referral compensation, and the specified withdrawal/refund conditions. [C034]

Cancellation and fee recovery: Negotiation contracts must provide the three-business-day cancellation right under the current statutory definition. Noncompliant contracts are voidable, and the commissioner can reduce or order repayment of excessive fees upon complaint. Adjustment law separately provides voidability and fee recovery for undisclosed charges. These provisions do not establish a universal state five-day or seven-day refund deadline. [C030–C032] Regulated Activities+2

5. Actual public application and authorization verification

I read the Department’s How to Apply passages for both license types. They direct applicants to Connecticut jurisdiction-specific requirements and NMLS filings using MU1, MU2, and relevant MU3 records, with additional jurisdiction materials. These are actual instructions supporting a statutory licensing route. [C035] portal.ct.gov+1

The license pages also identify public lists dated October 6, 2026 and NMLS Consumer Access. The linked spreadsheets were not readable through the public web tool, Consumer Access failed, and the jurisdiction/checklist routes redirected to unreadable or blank migrated pages. No named provider’s current authorization—including SettleADebt.com’s—was verified. A marketing statement, NMLS identifier, or submitted application would not cure that evidentiary gap. [C036; S022–S028]

The operative remote-office order and dual-licensing memorandum were read. They establish conditional operational routes, not permission for an unlicensed enterprise to operate remotely. [C018–C019]

6. Bounded worked examples

The examples in Part D distinguish calculations from permission, performance, and payment triggers. They include lower-debt, partial-settlement, previous-fee, cancellation, secured-fee, and unresolved DMP-boundary cases.

7. Component coverage and subsequent investigations

The coverage table in Part D preserves each answered, partial, unresolved, and excluded topic. Agreement terms beyond the necessary fee provisions, funds administration, bond calculations, remedies, collection/litigation/limitations, exempt property, secured-debt regimes, sectors, local and tribal issues, contract questions, and comprehensive case-law coverage remain open.

S_CT-P1-C002 Compensated negotiation assistance or attempted negotiation of obligation terms is debt negotiation, including the specified mortgage-related conduct. S002 §36a-671(a)(4); S030 §67 High/text. No custody or successful-reduction prerequisite; expected compensation is sufficient.
S_CT-P1-C003 Both examined debtor definitions concern individuals with personal, family, or household obligations. S001 §655(6); S002 §671(a)(5) High/text. Business/entity obligations fall outside these definitions, not necessarily outside other law; mixed-purpose facts remain untested.
S_CT-P1-C004 Pure education is not shown covered without the operative activity elements; paid coaching/offers may satisfy negotiation coverage. S001 §655(5); S002 §671(a)(4), (b) Conditional inference. No blanket coaching, lead-generation, or software exclusion established.
S_CT-P1-C005 Paid adverse-credit-record correction/advice may be credit-clinic conduct; charge/receipt requires full service performance. Noncompliant specified contracts are void with payments returned. S001 §700(a), (d), (e) High/text. Statutory exclusions include credit rating agencies, qualifying Connecticut legal practice, and §501(c)(3) organizations. Full credit-repair pass remains open.
S_CT-P1-C006 Negotiation nexus expressly includes Connecticut offices, specified dealings with Connecticut residents from elsewhere, and Connecticut-secured property. S002 §671(b)(1)–(3); S030 §67 High/text. Remote contracting does not itself avoid Connecticut coverage.
S_CT-P1-C007 Adjustment requires licensing for business “in this state”; resident funds are expressly addressed. S001 §§656(a), 659 High/text / limited inference. No claim that negotiation’s exact three nexus tests appear in adjustment law.
S_CT-P1-C008 Nonexempt adjustment and negotiation are licensable through the Banking Commissioner; main/branch licensing and statutory qualification conditions apply. S001 §656(a)–(c); S002 §671(b)–(d); S007–S010 High/text. For-profit/nonprofit adjustment routes exist. Approval, required bond, and continuing conditions matter; application is insufficient.
S_CT-P1-C009 Adjustment exclusions cover the four specified attorney, institutional, escrow, and law/court-authorized categories. S001 §663(1)–(4) High/text. Attorney activity is textually ancillary; institutions require authorization and regular-principal-business activity; escrow exception is activity-specific.
S_CT-P1-C010 Negotiation exclusions cover qualifying attorneys, enumerated banks/credit unions, specified subsidiaries, licensed adjusters in adjustment activity, court-ordered actors, and bona fide §501(c)(3) nonprofits. S001 §671c(1)–(7) High/text, with C013. Exclusion expressly spans §§671–671d, including §671b; it is not merely a filing waiver or a blanket exclusion from every other law.
S_CT-P1-C011 Nonprofit status is treated differently under adjustment and negotiation law. S001 §§655(2), 656, 663, 671c(7); S009 High/text. Nonprofit incorporation or branding alone does not prove the qualifying negotiation exclusion; custodial nonprofit DMP activity may require adjustment licensing.
S_CT-P1-C012 A licensed adjuster’s negotiation exclusion applies while performing adjustment services. S001 §671c(5) High/text. It does not establish that unrelated noncustodial settlement services are exempt.
S_CT-P1-C013 Persels protects bona fide Connecticut legal practice from the negotiation scheme, with a rebuttable presumption and meaningful-supervision/real-legal-service conditions. S013 PDF pp.18–20; S001 §671c annotation High judicial holding. Attorney façade can defeat protection. Fee ethics remain; schedule is relevant to disciplinary reasonableness, not automatically a direct cap on every exempt lawyer.
S_CT-P1-C014 Commonwealth decided jurisdiction/exhaustion, not ultimate entitlement to the claimed attorney protection. S015 PDF p.8 n.3; pp.19–22 High judicial holding. Allegations accepted for jurisdiction were not merits findings.
S_CT-P1-C015 The later Commonwealth agreement resolved allegations without admissions or merits adjudication and imposed party-specific future notice/documentation conditions. S016 p.2 recitals; p.3 ¶¶1–6 High/document. Binding agreement dated December 17, 2025; actual court withdrawal entry not retrieved; no industry-wide affiliate clearance.
S_CT-P1-C016 A creditor’s own-account workout can differ from providing debtor-side adjustment/negotiation services; no general self-creditor carveout appears in the two exemption lists. S001 §§655(5), 663, 671c; S002 §671(a)(4) Conditional inference. Separately paid debtor-side services need separate analysis; collection legality not determined.
S_CT-P1-C017 Automatic extension of Persels to §663’s separate adjustment exemption was not established. S001 §663(1); S013 holding Held. Requires directly relevant authority or analysis of actual adjustment/legal-practice facts.
S_CT-P1-C018 The 2021 remote-office order conditionally permits individuals to work from qualifying U.S. residential/noncommercial locations on behalf of licensees. S011 II.1–4, III High/order. Requires supervision, location/person records, security, regulatory access, applicable individual licensure, no public meetings/holding out, and no activity records retained there.
S_CT-P1-C019 Activities meeting both adjustment and money-transmission definitions may require both licenses; the memorandum contains a narrow processor policy. S012 p.1 and n.1; p.2 conclusion High/agency interpretation. Processor must be Connecticut-licensed as transmitter and act solely in support of duly licensed/exempt providers. Complete transmission-law analysis deferred.

Fees, timing, cancellation, and verification

Unique claim ID Precise assertion Sources / exact pinpoints Conditions, exceptions, and confidence limits
S_CT-P1-C020 Unsecured negotiation initial/setup fee is reasonable, one-time, and at most $50. S004 “Initial Fee”; S005 same heading High/schedule. Included in aggregate cap; not advance-fee permission.
S_CT-P1-C021 Monthly negotiation service fee is at most $8 per listed creditor and $40 total per debtor per month. S004 “Service Fees” High/schedule. Creditor basis, not a verified per-account multiplier; performance/aggregate conditions remain.
S_CT-P1-C022 Total unsecured negotiation fees, including initial/service charges, cannot exceed 10% of reduction in each achieved settlement; joint household obligations cannot increase the percentage. S004 “Aggregate Fees”; S017 ¶17 High/schedule. Reduction basis, not enrollment-balance basis.
S_CT-P1-C023 Secured negotiation debtor/mortgagor fee is capped at $500 and collectible only after all contracted services successfully finish. S004 secured-debt heading; S005 same heading High/schedule. Mortgagee/assignee compensation not prohibited by this schedule; no broader-law clearance inferred.
S_CT-P1-C024 The currently posted amounts match the September 2009 issuance; no applicable automatic indexing or replacement amount was verified. S004; S005 issuance/date/fee headings; S018 High for published values; bounded search for absence. No invented CPI increase; comprehensive regulation currentness remains open.
S_CT-P1-C025 State negotiation law conditions receipt on full performance of the promised service, while allowing reasonable clearly contracted periodic payments as services are rendered. S002 §671b(b) High/text. Must also reconcile schedule; the statute’s operative verb is receipt, not a general authorization to request prepayment.
S_CT-P1-C026 Pre-first-settlement flat-fee collection, non-principal savings valuation, shared-fee allocation, and separate success-fee entitlement were not conclusively resolved. S002 §671b(b); S004 relevant headings Held interpretive questions. Coverage of concessions is established; fee valuation/collection cannot be invented from that coverage.
S_CT-P1-C027 Adjustment licensees must provide individualized preagreement counseling and budgeting without charge. S001 §660(2); S006 protection item 2 High/text. Required service fee is zero.
S_CT-P1-C028 Adjustment law requires written fee disclosure and addresses remittance less prorated fees/costs; a complete current numerical DMP ceiling was not established. S001 §660(1), (6); S019–S020 High for text; held for complete numeric limit. Do not import negotiation caps or infer unlimited fees.
S_CT-P1-C029 Adjustment provisions prohibit conditioned purchases and specified paid referral arrangements. S001 §661(4)–(5) High/text. Applies to the persons/control persons described in the section; relabeling fees does not create permission.
S_CT-P1-C030 Undisclosed adjustment charges permit voiding and recovery of fees; required-but-missing licensure makes the agreement voidable; statutory voiding forecloses the licensee’s breach/restitution claim. S001 §661a(a)–(c) High/text. No general repayment deadline inferred.
S_CT-P1-C031 Negotiation contract cancellation is available within three business days after signing, with the prescribed written-notice provision. S002 §671b(a), history; S029 cancellation passage High/text. Saturday counts; Sunday and nine listed holidays do not. Current definition effective July 1, 2025.
S_CT-P1-C032 Noncompliant negotiation contracts are voidable; upon complaint the commissioner may reduce/order repayment of excessive fees considering comparable charges and consumer benefit. S002 §671b(c); S001 §671a(c); S029 final protection passage High/text. Applies subject to exemptions/judicial limitations; no universal cancellation refund formula established.
S_CT-P1-C033 When TSR coverage exists, fee requests/receipts require the agreement, debt-alteration, customer-payment, and individual-debt allocation conditions. S021 §310.4(a)(5)(i)(A)–(C); §310.2(o), (ii) High/federal text. Proportional enrolled-debt allocation or uniform savings percentage; federal savings uses enrollment debt minus amount paid to satisfy it. Coverage itself is not presumed for every model.
S_CT-P1-C034 The TSR account allowance requires insured custody, consumer ownership, independent administration, no referral compensation, and withdrawal without penalty with the prescribed return of funds within seven business days. S021 §310.4(a)(5)(ii)(A)–(E) High/federal text. Earned-fee exception is limited by (i); not a Connecticut cancellation deadline.
S_CT-P1-C035 Current DOB instructions direct both license categories through NMLS/MU records and Connecticut-specific materials. S007–S008 “How to Apply” High/procedure. Detailed migrated checklists unavailable; mailing/upload specifics need current checklist confirmation.
S_CT-P1-C036 Public lookup routes were identified, but no named provider’s current license was verified. S009–S010; S022–S028 Held provider status. Roster date, NMLS number, and application are not substitutes for reading the relevant active authorization.
S_CT-P1-C037 The 2025 revision/2026 supplement and identified 2025 changes are verified; exhaustive 2026 amendment exclusion is incomplete. S001–S003; S031–S034 Qualified currentness. No target change found in scoped searches; full enacted-acts audit or official 2026 crosswalk still needed.
S_CT-P1-C038 The October 6, 2026 CDS default final order adopted findings applying the aggregate cap against a 25%-of-verified-debt contractual fee. S017 ¶¶16–17, 32; S018 §II ¶1, §III, mailing clause High for order contents/status on its face. Administrative default, not contested appellate precedent; subsequent stay/appeal status held.

D. Worked examples and component coverage

Worked examples

All monetary amounts below are U.S. dollars. Arithmetic is exact to cents; no fractional-cent rounding is needed.

For unsecured-fee examples, assume a nonexempt, appropriately licensed negotiator, an enforceable compliant agreement, genuinely performed services, no applicable lower contractual fee, and satisfaction of any independently applicable TSR conditions. Where a settlement is used, assume the stated balance is the relevant agreed balance, with no disputed interest accrual or valuation issue. These examples calculate ceilings; they do not establish a fee’s independent entitlement.

Example 1 — Monthly creditor count

Inputs: three distinct listed creditors; $8 per creditor; $40 monthly ceiling. Operator: multiply, then take the lower limit. Intermediate: 3 × $8 = $24. Result: maximum category amount = min($24, $40) = $24 for that month.

For six listed creditors: 6 × $8 = $48; min($48, $40) = $40. The aggregate and performance limits still apply. Two accounts with one creditor are not assumed to be two creditors. [C021–C022, C025]

Example 2 — Low reduction overrides the apparent setup allowance

Inputs: one debt of $1,000; completed settlement for $800; proposed $50 setup plus $8 service fee. Reduction base: $1,000 − $800 = $200. Operator: $200 × 10%. Aggregate result: $20. Proposed fees: $50 + $8 = $58. Excess: $58 − $20 = $38.

The provider cannot collect the entire $58 merely because each category separately fits its category ceiling. Actual recovery mechanics for an amount previously collected require the applicable voidability, repayment, and timing analysis. [C020–C022, C030–C032]

Example 3 — Previously charged fees consume aggregate capacity

Inputs: one $10,000 debt settled and satisfied for $6,000; $100 already lawfully charged and attributable to this same settlement. Reduction: $10,000 − $6,000 = $4,000. Aggregate ceiling: $4,000 × 10% = $400. Remaining capacity: $400 − $100 = $300.

The $300 is remaining ceiling capacity. It is not a finding that a new $300 success fee is authorized or earned. [C022, C026]

Example 4 — Partial program completion

Inputs: enrolled debts A = $10,000 and B = $5,000. Only A has settled and been satisfied, for $6,000. B remains unresolved. A reduction: $10,000 − $6,000 = $4,000. A aggregate ceiling: $4,000 × 10% = $400. Assumed properly attributable prior A fees: $100. A remaining capacity: $400 − $100 = $300.

No fee capacity is assigned to a hoped-for future reduction of B. Shared-fee allocation cannot be assumed from these inputs, and any applicable federal allocation rule must independently be satisfied. [C022, C026, C033]

Example 5 — No settlement/customer payment in a TSR-covered sale

Inputs: a $50 proposed setup fee; no qualifying creditor agreement and no payment pursuant to one. Trigger test: federal conditions A and B are unsatisfied. Result: fee that may be requested or received at that stage under the cited federal rule = $0.

A qualifying dedicated-account deposit does not itself become an earned provider fee. This example does not resolve the separate state-only periodic-payment ambiguity. [C025–C026, C033–C034]

Example 6 — Adjustment counseling versus an unverified DMP price

Inputs: an adjustment licensee proposes $75 for the individualized counseling required before its agreement. Legal limit: required service must be free. Result: permitted charge for that required counseling = $0; proposed excess = $75.

For a proposed $35 monthly custodial DMP fee, this record does not establish a complete current numerical ceiling. Result: hold the fee-clearance conclusion, identify the actual adjustment activity and written fee terms, and obtain the missing current regulatory evidence. The negotiation schedule is not substituted. [C027–C028]

Example 7 — Secured negotiation ceiling

Inputs: proposed debtor fee $650; all contracted services successfully completed; applicable state schedule. Maximum: $500. Excess: $650 − $500 = $150.

Before all contracted services successfully finish, the debtor fee collectible under this schedule is $0. This is a state-schedule calculation only; residential mortgage licensing and other secured-debt requirements remain to be cleared. [C023]

Example 8 — Cancellation date

Input: consumer signs Friday, October 23, 2026. None of the following days is a listed statutory holiday. Saturday, October 24 = business day 1. Sunday, October 25 = excluded. Monday, October 26 = business day 2. Tuesday, October 27 = business day 3. Result: the prescribed notice must be delivered or mailed before midnight Tuesday, October 27, using the statutory notice provision.

The excluded holidays are New Year’s Day, Washington’s Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veterans Day, Thanksgiving Day, and Christmas Day. This calculation establishes the cancellation window, not a universal refund deadline. [C031–C032; S002 §671b(a)]

Example 9 — Nonprofit classification changes with custody

Inputs: an organization claiming §501(c)(3) status offers negotiation and alternatively a program receiving monthly consumer funds for creditors. First test: verify bona fide qualifying nonprofit status. Second test: determine whether the organization actually receives funds as debtor’s agent for distribution.

Result: qualifying noncustodial negotiation may fall within §671c(7); custodial adjustment is not excused by a general nonprofit exemption under §663. No fee amount or provider authorization is invented. [C001–C003, C009–C012]

E. Researcher self-check

I read actual statutory passages, the complete operative fee schedule, the two-page remote-office order and dual-licensing memorandum, relevant judicial-opinion text, the Commonwealth settlement, and operative portions of the CDS initial and final orders. Agency application instructions were read beyond their titles and search snippets.

The court opinions were judicial texts reproduced on Justia; that hosting limitation is disclosed. The official Persels link was inaccessible. I did not treat the unread 2012 ruling, migrated checklists, spreadsheet metadata, license-page titles, or an NMLS identifier as substantive proof.

The current regulation bodies, named-provider records, complete 2026 enacted-law audit, and specified interpretive issues remain held. I did not treat the CDS default order as a contested appellate decision or the Commonwealth jurisdiction ruling as affiliate approval. Historical materials were used for reconciliation, not silently substituted for current law.

Parallel research tasks contributed to this pass. This is a researcher self-check, not an independent review. Ordinary public-web research was used; no Deep Research session or separate Chat conversation was opened. The chatgpt.com model selector was not independently observable, so I do not claim verified use of a separately selected “actual GPT6Pro” mode.

No provider authorization, whole-state completion, A066 acceptance, or publication-readiness determination is made.

S_CT-P1-C002Compensated negotiation assistance or attempted negotiation of obligation terms is debt negotiation, including the specified mortgage-related conduct.S002 §36a-671(a)(4); S030 §67High/text. No custody or successful-reduction prerequisite; expected compensation is sufficient.
S_CT-P1-C003Both examined debtor definitions concern individuals with personal, family, or household obligations.S001 §655(6); S002 §671(a)(5)High/text. Business/entity obligations fall outside these definitions, not necessarily outside other law; mixed-purpose facts remain untested.
S_CT-P1-C004Pure education is not shown covered without the operative activity elements; paid coaching/offers may satisfy negotiation coverage.S001 §655(5); S002 §671(a)(4), (b)Conditional inference. No blanket coaching, lead-generation, or software exclusion established.
S_CT-P1-C005Paid adverse-credit-record correction/advice may be credit-clinic conduct; charge/receipt requires full service performance. Noncompliant specified contracts are void with payments returned.S001 §700(a), (d), (e)High/text. Statutory exclusions include credit rating agencies, qualifying Connecticut legal practice, and §501(c)(3) organizations. Full credit-repair pass remains open.
S_CT-P1-C006Negotiation nexus expressly includes Connecticut offices, specified dealings with Connecticut residents from elsewhere, and Connecticut-secured property.S002 §671(b)(1)–(3); S030 §67High/text. Remote contracting does not itself avoid Connecticut coverage.
S_CT-P1-C007Adjustment requires licensing for business “in this state”; resident funds are expressly addressed.S001 §§656(a), 659High/text / limited inference. No claim that negotiation’s exact three nexus tests appear in adjustment law.
S_CT-P1-C008Nonexempt adjustment and negotiation are licensable through the Banking Commissioner; main/branch licensing and statutory qualification conditions apply.S001 §656(a)–(c); S002 §671(b)–(d); S007–S010High/text. For-profit/nonprofit adjustment routes exist. Approval, required bond, and continuing conditions matter; application is insufficient.
S_CT-P1-C009Adjustment exclusions cover the four specified attorney, institutional, escrow, and law/court-authorized categories.S001 §663(1)–(4)High/text. Attorney activity is textually ancillary; institutions require authorization and regular-principal-business activity; escrow exception is activity-specific.
S_CT-P1-C010Negotiation exclusions cover qualifying attorneys, enumerated banks/credit unions, specified subsidiaries, licensed adjusters in adjustment activity, court-ordered actors, and bona fide §501(c)(3) nonprofits.S001 §671c(1)–(7)High/text, with C013. Exclusion expressly spans §§671–671d, including §671b; it is not merely a filing waiver or a blanket exclusion from every other law.
S_CT-P1-C011Nonprofit status is treated differently under adjustment and negotiation law.S001 §§655(2), 656, 663, 671c(7); S009High/text. Nonprofit incorporation or branding alone does not prove the qualifying negotiation exclusion; custodial nonprofit DMP activity may require adjustment licensing.
S_CT-P1-C012A licensed adjuster’s negotiation exclusion applies while performing adjustment services.S001 §671c(5)High/text. It does not establish that unrelated noncustodial settlement services are exempt.
S_CT-P1-C013Persels protects bona fide Connecticut legal practice from the negotiation scheme, with a rebuttable presumption and meaningful-supervision/real-legal-service conditions.S013 PDF pp.18–20; S001 §671c annotationHigh judicial holding. Attorney façade can defeat protection. Fee ethics remain; schedule is relevant to disciplinary reasonableness, not automatically a direct cap on every exempt lawyer.
S_CT-P1-C014Commonwealth decided jurisdiction/exhaustion, not ultimate entitlement to the claimed attorney protection.S015 PDF p.8 n.3; pp.19–22High judicial holding. Allegations accepted for jurisdiction were not merits findings.
S_CT-P1-C015The later Commonwealth agreement resolved allegations without admissions or merits adjudication and imposed party-specific future notice/documentation conditions.S016 p.2 recitals; p.3 ¶¶1–6High/document. Binding agreement dated December 17, 2025; actual court withdrawal entry not retrieved; no industry-wide affiliate clearance.
S_CT-P1-C016A creditor’s own-account workout can differ from providing debtor-side adjustment/negotiation services; no general self-creditor carveout appears in the two exemption lists.S001 §§655(5), 663, 671c; S002 §671(a)(4)Conditional inference. Separately paid debtor-side services need separate analysis; collection legality not determined.
S_CT-P1-C017Automatic extension of Persels to §663’s separate adjustment exemption was not established.S001 §663(1); S013 holdingHeld. Requires directly relevant authority or analysis of actual adjustment/legal-practice facts.
S_CT-P1-C018The 2021 remote-office order conditionally permits individuals to work from qualifying U.S. residential/noncommercial locations on behalf of licensees.S011 II.1–4, IIIHigh/order. S_CT-P1-C030Undisclosed adjustment charges permit voiding and recovery of fees; required-but-missing licensure makes the agreement voidable; statutory voiding forecloses the licensee’s breach/restitution claim.S001 §661a(a)–(c)High/text. No general repayment deadline inferred.
