S_CA Correction-01 — California Provider Regulation and Source Provenance
Assigned area: A066-CA-1, with collection-licensing overlap under A066-CA-2
Baseline and correction check date: October 22, 2026, America/Los_Angeles
Status: Focused correction; not a replacement for the original 63-claim report.
The original report has a material coverage omission: California's CCFPL debt-settlement registration framework must be evaluated independently of the Fair Debt Settlement Act, Proraters Law, and Debt Collection Licensing Act.
That omission prevents treating the original provider-licensing coverage cell as fully answered. It does not, by itself, invalidate every original consumer-conduct or fee claim.
The correction also preserves three evidence distinctions:
- A source URL being correctly extracted does not establish that its legal text was read.
- Reading a 2025 codified mirror does not independently establish the entire operative California rule as of October 22, 2026.
- A DFPI registration application, pending status, approval, exemption, and separate professional license are not interchangeable.
No original claim or source ID is reassigned. New correction records use S_CA-R1-S001 and S_CA-R1-C001 onward.
1. Corrected regulatory framework
The additional research identifies the operative registration rule as California Code of Regulations, title 10, section 1010, with debt-settlement definitions in section 1001.
The adopted registration regulations were filed October 11, 2024, with an operative date of February 15, 2025. DFPI identifies the underlying rulemaking as PRO 01-21. The statutory CCFPL itself predates these registration regulations.
A significant coverage distinction appears in section 1001: its definition expressly includes certain negotiations intended to reduce a consumer's interest rate or payment amount, not only settlements for less than the outstanding balance. That means an FDSA-only coverage screen can miss activity requiring CCFPL analysis. DFPI+2
Registration timing
DFPI's published interpretation distinguishes the transitional application process from subsequent applications:
| Situation |
Registration consequence |
Evidence status |
| Application properly submitted before February 15, 2025 |
Transitional treatment may permit continued operations while approval is pending, subject to the regulatory conditions |
Official DFPI FAQ; full subsection reconciliation pending |
| Application filed on or after February 15, 2025 |
DFPI states that approval is required before engaging in covered business |
Official DFPI FAQ; supported by §1010 framework |
| No application and no applicable exemption |
The general registration prohibition applies |
§1010(a), mirror text |
| Existing Proraters Law license |
Registration exception depends on debt-settlement services being within that license's scope |
§1010(b)(1) |
| Nonprofit using Financial Code §12104 |
Exception requires compliance with §12104 and the specified recent audit-report condition |
§1010(b)(1) |
| California attorney |
The activity must be performed under the authority of the qualifying professional license; no blanket occupational exemption |
DFPI interpretation; complete statutory reconciliation held |
The transitional filing rule is particularly important for auditing businesses that began operations in 2025. A historical pending application must not be represented as a current approved registration.
Regulatory fees are not consumer settlement fees
DFPI identifies a $350 registration application fee, a separate annual NMLS renewal charge, and an annual DFPI registration assessment based on the registrant's share of administration costs, subject to a $500 minimum in specified circumstances. Examination costs may also be assessed.
These are provider regulatory obligations, not amounts a provider may automatically charge its customers. The applicable consumer fee rules must be analyzed separately under the FDSA, Proraters Law, federal law, and the actual contract. DFPI+1
Sunset and later developments
DFPI identifies January 1, 2029 as the scheduled inoperative date for this registration rulemaking absent legislative action extending or replacing the framework. That is a conditional future event, not an October 2026 exemption.
DFPI also reports that SB 825 became effective January 1, 2026, addressing CCFPL unfair, deceptive, or abusive conduct authority over certain otherwise exempt licensees. This reinforces why an exemption from registration must not be described as an exemption from every CCFPL substantive obligation. DFPI+1
The final approved order, subsequent amendments, and any relevant court orders have not all been independently reconciled in this pass. Those remain publication holds.
2. Actor/activity/exemption matrix
The following matrix is a classification tool, not a determination about any particular business. Each row requires the actual entity, services, funds flow, licenses, and California-resident nexus.
| Actor/activity |
FDSA |
Proraters Law |
CCFPL registration |
DCLA |
| For-profit negotiator of reduced consumer debt balances, no custody of customer funds |
Usually analyze coverage |
No prorater conclusion from negotiation alone |
Generally required unless a specific exception applies |
Not automatically a debt collector |
| Provider negotiating reduced interest rates or payment amounts |
Check FDSA's narrower statutory definition |
Depends on receipt/distribution of funds |
Expressly included in §1001(b)(1), subject to exclusions |
Activity-dependent |
| Licensed prorater providing settlement services |
Independently assess FDSA |
License governs qualifying prorater activity |
§1010(b)(1) exception only within license scope |
Separate test |
| Nonprofit operating under §12104 |
Conditional FDSA exclusion |
Conditional exemption, including audit and operational duties |
§1010(b)(1) requires a recent qualifying audit and services solely under §12104 |
Separate test |
| Tax-exempt nonprofit offering settlement services entirely free to consumers |
Check FDSA exclusion |
Funds-flow analysis still necessary |
Express §1010(b)(7) exception |
Separate test |
| Attorney providing legal services |
Conditional §1788.304 analysis |
Conditional §12100 analysis |
Professional-license and statutory authority analysis |
Separate activity test |
| Debt collector negotiating its own assigned receivable |
Not automatically a consumer's settlement-service provider |
Ordinarily different from distributing consumer funds among creditors |
Depends on whether it also offers covered consumer-facing services |
DCLA and Rosenthal analysis |
| Original creditor collecting its own debt |
Generally different from acting on behalf of consumer |
No automatic prorater status |
Ordinary collection does not itself prove registration duty |
Rosenthal may apply; DCLA exemptions separately |
Important newly verified detail: Section 1010(b)(7) expressly exempts a federally tax-exempt nonprofit that provides the specified debt-settlement or student-debt-relief services free of charge. That exception is distinct from the section 1010(b)(1) route for an organization complying with Financial Code section 12104. LII / Legal Information Institute+1
A business using an attorney, nonprofit affiliate, or licensed entity cannot safely assume that the exemption transfers to a separate operating company. The actual contracting party and the entity performing each service matter.
3. Application, annual reporting, and compliance process
The directly opened regulatory mirror adds concrete requirements missing from the original provider chapter.
Under 10 CCR §1021, a covered applicant files NMLS Form MU1, with applicable MU2 filings for specified responsible individuals. The application includes legal-entity information, ownership and management details, regulatory disclosures, business descriptions, consumer charges, websites, marketing channels, and third-party lead-generation information.
A provider offering more than one separately registered subject product must obtain the required separate registrations. The regulatory text specifies a $350 application fee and $100 annual NMLS renewal fee. Filing alone does not establish approval. Section 1021 also specifies deficiency notices, response periods, abandonment procedures, and review periods, including the special treatment of transitional applicants. LII / Legal Information Institute+1
For ongoing compliance, the debt-settlement annual report under §1042 requires data covering California contracts, enrolled debts and balances, consumer charges, settlements meeting the statutory reporting definition, average settlement amounts, and timing to first settlement payment. These reporting figures are not proof of an individual provider's settlement performance.
Under §1040, the annual DFPI fee is calculated using the registrant's share of relevant reported gross income relative to the aggregate for registrants, with a statutory $500 minimum for the specified cases. Assessment notice is due by November 30 and payment by December 31 under the opened text. Nonpayment can trigger summary revocation, with narrowly conditioned extension and hearing procedures. LII / Legal Information Institute+1
Bounded fee example: Suppose a registrant reports $2 million of relevant California gross income, all registrants together report $100 million, and DFPI's assessable program costs and deficit total $500,000.
- Registrant share = $2,000,000 / $100,000,000 = 0.02
- Allocated assessment = 0.02 × $500,000 = $10,000
- Minimum-fee comparison = greater of $10,000 or $500 = $10,000
That is an illustration of §1040's allocation approach, not an actual DFPI invoice or a consumer-facing settlement charge. The calculation requires actual DFPI assessments and reported income, and any current amendments must be checked.
4. Source register — correction evidence
All entries below are California authorities or California regulatory materials. The check date for this correction is 2026-10-22. “Mirror opened” means the actual regulatory text was retrieved from Cornell's Legal Information Institute; it does not mean the official DFPI PDF or the Secretary of State's current CCR compilation was opened. The original S_CA-S001–S050 register remains separate.

8. Source provenance and original-register reconciliation
Several actual mirror URLs are recoverable from the original report's source references. They should be associated only with their corresponding original source IDs, not copied into other rows with the same link label.
These are recovered provenance mappings, not newly verified 2026 legal propositions. The original official Legislature URLs remain authoritative endpoints, separately from the actual mirrors accessed. The remaining original source rows retain their prior access limitations and missing URLs; none is accepted merely because a related mirror appears here.
9. Necessary corrections to worked examples
The coordinator's arithmetic findings remain preserved. This correction does not rerun all 17 quantities.
| Original example |
Disposition |
Necessary legal-condition correction |
| §12104 nonprofit settlement fee |
Arithmetic retained |
Fee ceiling = 0.15 × qualifying forgiven amount only for a nonprofit satisfying §12104; not a universal for-profit cap |
| Licensed-prorater bracket |
Arithmetic retained |
Apply only when §12314 governs the actual licensed activity and all fee/consent exceptions are met |
| Wage garnishment |
Arithmetic retained; inputs held |
Withholding = max(0, min(0.20 × disposable earnings, 0.40 × max(0, disposable earnings − protected threshold))), subject to the applicable ordinary-judgment rule |
| Judgment interest |
Arithmetic retained; inputs held |
Rate depends on judgment category, amount, dates and statutory exceptions |
| Foreclosure 30/90/21 |
Arithmetic retained; legal prediction held |
141 days is illustrative component arithmetic, not an exact sale forecast |
| FTB installment plan |
Arithmetic retained; inputs held |
$24,000 / 60 = $400 is principal-only arithmetic, not the complete required monthly payment |
The nonprofit example has stronger support from the reopened Financial Code §12104(d) text. The other examples were not substantively re-reviewed within this correction.

Researcher self-check
This correction directly opened and read the operative text of 10 CCR §§1001, 1010, 1011, 1021, 1023, 1031, 1040, 1041, 1042 and 1050 through identified mirrors, plus 2025 Financial Code §12104 and Civil Code §1788.304. It separately attempted the supplied DFPI official endpoints, which returned HTTP 403, and recovered additional official indexed material without mislabeling that material as a full direct opening.
The correction verifies the existence and substantial content of the omitted CCFPL registration layer, including conditional exceptions, transitional filings, application requirements, regulatory fees and annual reporting. It does not certify a complete current official consolidation, all 2026 amendments, all relevant court orders, any individual provider's status, or the original 50-source/63-claim report.
The original report and coordinator's audit remain unchanged. No private borrower information was accessed, no outreach or publication occurred, and no local library write is claimed.
Publication disposition: Provider-regulation coverage is materially improved but remains PARTIAL — PUBLICATION HOLD pending the official-source, amendment, case-law and entity-specific checks identified above.
