SettleADebt — S_AL PASS-07
Ordinary money-judgment bank-account garnishment and property-exemption claims
Actual access date: October 27, 2026, Pacific.
Individual source-opening times: UNKNOWN; they were not logged.
This report treats bank-held money separately from employer wage withholding. PASS-06 remains unreviewed and is not adopted as an authority or accepted premise. The P01–P05 findings and holds remain preserved.
Principal result: Three protections must be analyzed separately:
- Ownership: A judgment against one person does not establish that every dollar in a jointly titled account belongs to that person.
- Automatic federal bank protection: For qualifying direct deposits, 31 C.F.R. Part 212 requires a bank to calculate and preserve a protected amount without first requiring an exemption claim.
- Court-claimed exemptions: Additional Alabama or federal protection may require a properly supported claim, inventory, service, and adjudication. Funds outside the bank’s automatic protected amount are not therefore conclusively collectible.
The current Alabama Treasurer’s schedule was obtained. The complete current official Alabama Code and final operative constitutional recompilation/amendment chain were not. Those distinctions materially limit several conclusions below.
Identifier convention: S001 means S_AL-P07-S001; C001 means S_AL-P07-C001. Full identifiers appear in the registers.
A. Substantive findings
1. Alabama’s published amount is not an automatic bank-account allowance
The Treasurer publishes $9,400 as the July 2023 personal-property adjustment and $10,225 as the July 2026 adjustment. The published application rule is April 1 following the adjustment date. Thus, the schedule places the latter amount’s application at April 1, 2027, not July 1, 2026. C005–C006. Alabama Treasurer Office
That schedule must be read with the governing exemption law and debt date. Act 2026-203, approved March 5, 2026 and effective June 1, 2026, retains the ordinary rule that exemption rights are governed by the law in force when the debt or demand was created, while adding a separate bankruptcy-filing rule. It does not establish universal retroactive application of the latest amount to every ordinary judgment. C007. Alabama Secretary of State+1
The statutory personal-property provision examined is selection-based and limited to the resident’s interest in property. Its treatment of wages is different from its treatment of ordinary non-wage property. Necessary clothing and specified family items have separate treatment; that does not create a blanket exemption for all household assets. C003–C004.
Accordingly:
- A qualifying non-wage account balance can be considered within a personal-property selection.
- The current schedule alone does not establish eligibility, ownership, debt-date applicability, absence of waiver, or a valid claim.
- No separate universal Alabama automatic bank-account minimum was established in this pass.
- The examples use $9,400 only where the hypothetical facts expressly satisfy the applicable version and date conditions. Otherwise the state amount remains a variable, S.
2. Depositing wages does not automatically preserve employer-withholding treatment
The Supreme Court’s Kokoszka decision concerned a tax refund, not an ordinary paycheck in a bank. It nevertheless rejects the proposition that the CCPA necessarily protects every asset traceable to wages. The relevant statutory definitions concern compensation and withholding of earnings; they do not supply a universal percentage exemption for an accumulated deposit balance. C069, C072. GovInfo+1
The Eleventh Circuit’s published Citronelle-Mobile Gathering opinion actually addressed an Alabama bank account. It rejected the claimed wage protection on its unusual facts, including a large purported salary payment and commingled funds. Importantly, its footnote 7 acknowledged that Alabama courts had not then decided the deposited-and-commingled-wage question. This is a dated federal decision applying Alabama law—not a newly discovered Alabama Supreme Court resolution of every modern payroll account. C070. Law Resource+1
Renter’s Realty held that the Legislature could not redefine wages out of constitutional personal property through §6-10-6.1. But the process there was directed to an employer, and the opinion does not itself establish the classification of every accumulated or commingled bank deposit. C008–C009. Justia Law
Result: No automatic full-paycheck bank exemption, no universal $1,000 bank-wage ceiling, and no automatic application of employer withholding percentages to a deposit account is established.
3. Joint ownership and exemption are different questions
In Amarlite, the Alabama Supreme Court held that a joint account is garnishable to the extent of the debtor’s ownership, with a rebuttable presumption that the funds belong to the debtor and a burden on the depositors to prove otherwise. House applied that rule to evidence that the money belonged to the debtor’s wife and affirmed release. Neither case adopts an automatic 50/50 division. C012–C013. Justia Law+1
Part 212 requires the bank to perform its benefit review without treating co-ownership or commingling as reasons to omit the review. That operational rule does not adjudicate ownership of the unprotected remainder. C048–C050.
4. Federal automatic protection is a bank duty, not a debtor filing prerequisite
For an ordinary order within Part 212, the bank generally must:
- Examine the order and conduct the required account review within the applicable business-day periods.
- Identify qualifying, properly coded direct deposits during the two-month lookback.
- Protect the lesser of those qualifying deposits or the balance when the review is performed.
- Preserve full customary access to that protected amount.
- Apply the calculation separately to each account, without tracing transfers between accounts.
- Avoid continuing freezes of later deposits under the same reviewed order where §212.6 applies.
A correctly established protected amount is conclusively exempt under the regulation. C041–C055. eCFR+2
The rule does not automatically cover every government payment, paper check, transfer, payroll deposit, account owner, or order. A qualifying United States or state-child-support-agency notice changes the regulatory procedure; that exception does not itself establish that every benefit is substantively reachable. C042, C045, C066.
5. Protection beyond Part 212 requires a separate analysis
Section 407 protects Social Security money paid or payable and restricts implied statutory displacement. Philpott held that readily withdrawable deposited benefits retained their protected character. Porter similarly addressed veterans’ benefits retaining the qualities of money rather than becoming permanent investments. C062–C068. U.S. Code+2
There is a material adverse-authority qualification. Citronelle also denied a Social Security claim using a “basic needs” rationale on exceptional United States restitution/receivership facts. The later Supreme Court opinion in Keffeler reaffirmed the antiattachment reasoning of Philpott and Bennett while distinguishing lawful representative-payee expenditures. No primary decision expressly resolving Citronelle’s continuing reach was obtained here. C071. Law Resource+1
That unresolved merits issue does not authorize a bank to perform a financial-means test instead of complying with Part 212’s automatic protected-amount requirements.
B. Court and bank process
1. The necessary sequence
| Stage |
Actor and required distinction |
Finding and limits |
| Enforceability |
Creditor must have an enforceable judgment and present entitlement to execution. |
Judgment validity, balance, stay, and satisfaction are not assumed. C015–C018. |
| Application |
Creditor supplies the required sworn amount and statutory grounds to the judgment court. |
Actual affidavit and current complete statutory chain remain unverified. C016. |
| Issuance/service |
Issuing officer issues process; proper service on the bank is required. |
Rule 5 service of later papers is not a substitute for service of the garnishment process. C019–C020. |
| Federal review |
Bank examines the order and account under Part 212 when applicable. |
Review precedes account action affecting funds; the protected amount remains accessible. C045–C052. |
| Bank answer |
Bank answers under the applicable oath and corporate-authority requirements. |
The answer addresses specified service-to-answer periods and relevant obligations; it is not merely a snapshot label. C020, C023. |
| Debtor notice |
Nonappeared debtor receives Rule 64A notice; substitute posting requires its own predicates and order. |
Failed delivery alone is not completed substitute service. C021–C022. |
| Answer contest |
Creditor or debtor may use the applicable answer-contest route. |
This differs from an exemption claim and from challenging the original judgment. C024–C027. |
| Exemption claim |
Debtor files a verified claim and required inventory in the pending garnishment court and serves it. |
Filing a claim is not itself a bank release order. C031–C039. |
| Condemnation |
Court resolves the legally available funds and authorizes disposition. |
Held funds, court deposits, condemnation, and creditor payment are different events. C029–C030. |
| Release/satisfaction |
Court and parties reconcile the garnishee’s discharge, exempt-fund release, and judgment balance. |
Releasing one bank or depositing money in the registry does not necessarily satisfy the entire judgment. C040. |
2. Circuit, District, and Small Claims differences
Rule 62 ordinarily provides a 30-day circuit-court enforcement stay, subject to its exceptions and authority for earlier execution. District Rule 62(dc) substitutes 14 days and modifies specified postjudgment-motion treatment. Small Claims Rules L and N use the district enforcement framework where applicable and consistent. No actual deadline is calculated here. C017–C018.
Rule 64B expressly applies in district court. A small-claims judgment does not eliminate the bank’s federal duties or the debtor’s exemption process. Alabama Judicial System+3
3. The three contest routes
| Route |
Subject |
Trigger or required act |
Not interchangeable with |
| Creditor oral examination / answer traverse |
Accuracy and extent of bank liability |
§6-6-450 examination request and §6-6-458 sworn contest have their own notice-based periods. |
Debtor exemption selection. |
| Debtor contest of bank answer |
Assertion that the bank owes or holds more than it admits |
§6-6-459 requires sworn particulars and its notice-based period. |
A general stay, original-debt defense, or exemption claim. |
| Exemption claim and creditor contest |
Whether identified debtor property is protected |
Rule 64B verified claim, inventory, service, and contest/hearing framework. |
Proof that the bank’s answer is false or that the judgment itself is invalid. |
The reproduced §6-6-459 expressly says that its debtor-answer contest does not prevent judgment for the creditor on the answer. That reinforces why “an objection was filed” cannot be treated as a universal stay. C026, C039.
4. Exemption timing and current service rules
Rule 64B requires a verified claim and inventory. With notice, the claim must precede condemnation; without notice, condemnation does not itself impair the claim. The rule’s 15-calendar-day provision concerns dismissal or modification after failure to make a timely contest following notice—not a universal debtor filing deadline. A timely contest must initially be scheduled for hearing within the rule’s seven-calendar-day period or stated next-open-day alternative. C031–C038. Alabama Judicial System
The actual 2026 adoption orders were read:
- Rules 5/11: order dated September 24, effective October 1, 2026.
- Rule 6: order dated March 26, effective April 9, 2026.
Direct email under Rule 5(b)(2)(F) differs from court-system service under Rule 5(b)(2)(E). Rule 6’s additional three days for specified service methods must not be added indiscriminately to every email or every clock. C034–C035, C076. Alabama Judicial System+1

Readable federal form material: S018 Appendix A was actually read. It identifies notice fields for the order, account, review, protected amount, frozen amount, fee, and additional-exemption information. Material posture and actual holding used |
Separate writing, later treatment, and boundary |
| Amarlite, S015 |
Competing judgment creditors sought joint-account construction funds. After evidence, the court found the surety owned the money; affirmance. |
No separate disagreement shown. General/special-deposit issue expressly bypassed. House supplies later Alabama application actually read. |

Both other panel members concurred. No automatic spouse exemption or 50/50 presumption. |

No separate writing shown. Footnote 7 acknowledges the then-unresolved Alabama deposit question. Its unusual Social Security reasoning is disclosed, not silently adopted as a general bank rule. |

Bankruptcy tax-refund claim; CCPA did not remove the refund from the estate merely because traceable to wages. |
Unanimous opinion; later bank application read in Citronelle. No independent current-bank formula inferred. |

State sought reimbursement from deposited retroactive Social Security disability benefits; reversed. |
Unanimous. Later discussion read in Citronelle and Keffeler. |

Unanimous reversal/remand. It reaffirmed Philpott/Bennett’s treatment of judicial attachments but did not expressly decide Citronelle. |
No unpublished or no-opinion disposition is relied upon. No full citator, docket, finality, or all-subsequent-history certification is made. C077.

This pass addresses only the bank/property-exemption slice of the exact P01 deferred row. |
Supplied foundation below. |
P1–P5 holds preserved; P06 unreviewed; no acceptance. |
F. Three fully worked conditional money models
All figures are fictional U.S. dollars. Calculations are exact to cents; no rounding is necessary. No fee is assumed lawful merely because an arithmetic model includes it.
Model M1 — State personal-property selection
Assumptions
A resident natural person owns an $8,000 account containing completed gift money—not wages or benefits. The ordinary consumer obligation arose in May 2025; the hypothetical exemption claim is made in October 2026. Assume the applicable law and court accept the $9,400 schedule amount, no effective waiver, a sufficient inventory, and $2,400 of other property selected within the same statutory pool. Necessary clothing and other separately treated items are not included in that $2,400. Verified remaining judgment: $5,000. No bank fee or setoff.
Inputs:
- State limit S = $9,400
- Other selected property O = $2,400
- Debtor-owned account money B = $8,000
- Remaining judgment J = $5,000
Calculation:
- Remaining selection capacity: S − O = $9,400 − $2,400 = $7,000
- Selected account exemption: min(B, $7,000) = $7,000
- Unprotected remainder under these assumptions: $8,000 − $7,000 = $1,000
- Maximum candidate for condemnation: min(J, $1,000) = $1,000
Result: $1,000 is only a conditional candidate for condemnation—not an instruction to transfer it.
Adverse branches: Different debt date, waiver, ownership, selection, or classification changes the result. Selecting different property could change the allocation. If the applicable amount is unknown, substitute S_applicable; do not insert $9,400 automatically. C003–C011, C029–C040.
Model M2 — Federal direct deposits mixed with other funds
Assumptions
A covered natural-person account is reviewed on fictional October 20, 2026 under a new ordinary order without the Appendix B exception notice. The lookback runs backward from October 19 to August 19, using §212.3’s posting boundaries. Properly coded Social Security direct deposits of $1,200 posted September 3 and October 3. Actual review balance: $3,500. No transfer, joint-owner dispute, or fee. The court later accepts $600 of distinct non-benefit residual money under an otherwise applicable state exemption.
Inputs:
- Qualifying deposits D = $1,200 + $1,200 = $2,400
- Review balance B = $3,500
- Separate accepted state protection on residual money S_residual = $600
Calculation:
- Automatic protected amount: P = min(D, B) = min($2,400, $3,500) = $2,400
- Residual account money: R = B − P = $1,100
- Additional distinct protection: min(R, $600) = $600
- Total nonoverlapping protection: $2,400 + $600 = $3,000
- Candidate remainder: $3,500 − $3,000 = $500
Result: The bank must preserve access to the $2,400 automatic amount without waiting for the state claim. The additional $600 depends on the assumed court-accepted claim. Only the $500 remainder is a candidate for further lawful process.
Adverse branches: A missing qualifying code, different review balance, exceptional order, or unsuccessful state claim changes the result. The same dollars cannot be counted twice as both automatic and additional protection. C041–C059.
Model M3 — Transfer between accounts and a separate fee branch
Assumptions
Account A received one properly coded $2,000 covered benefit deposit on September 30. Before the October 20 review, $800 moved to Account B. No other spending occurred.
- A review balance: $2,000 − $800 = $1,200
- B contains the $800 transfer + $500 ordinary money = $1,300
- B received no qualifying direct deposit.
- Both accounts are otherwise within the same ordinary-order scenario.
- Initial fee: $0.
Automatic calculations:
- A: P_A = min($2,000, $1,200) = $1,200
- B: P_B = $0 under the automatic direct-deposit test.
- The bank does not transfer A’s unused $800 benefit total into B’s automatic allowance.
Assume a court separately determines that the transferred $800 retains an applicable federal exemption after the required tracing and legal analysis, and accepts $300 of distinct ordinary money under state law:
- B additional protection: $800 + $300 = $1,100
- B candidate remainder: $1,300 − $1,100 = $200
Merits branch: Without that separate determination, B’s $800 protection is unresolved—not automatically lost, and not automatically established.
Fee branch for A: Suppose $50 of non-benefit money is deposited within the rule’s five-business-day window and an otherwise lawful processing fee is $75.
- Part 212 ceiling from that new non-benefit deposit: min($75, $50) = $50
- Protected A amount remains $1,200
- If the fee is not otherwise authorized, the permissible fee may instead be $0.
- More protective law or an applicable order can further constrain the fee.
C050–C061, C062–C071.
G. Sixteen additional fictional postures
| Example |
Facts and calculation/classification |
Adverse branch and exact next check |
| E01 — Balance below qualifying deposits |
Qualifying deposits $2,400; balance $900. P = min($2,400,$900) = $900; residual $0. |
No §212.7 excess-funds notice is required on these facts, but other notice law remains. Verify coding and review balance. C044, C051–C057. |
| E02 — Deposit on the review date |
Prior qualifying lookback deposits $0; a $1,000 payment posts on review day. It is not silently inserted into the preceding-day lookback. |
Review sequence and actual posting matter; underlying exemption may remain even if automatic protection is not established. C043–C047, C058. |
| E03 — Paper benefit check |
A $700 paper Social Security check was deposited. No qualifying coded direct deposit exists. |
Automatic P is not established from the paper check alone. §407 and tracing remain a separate claim. C042, C047, C058, C062, C067. |
| E04 — Older accumulated benefits |
$4,000 alleged older benefits; no qualifying deposit in lookback. |
No automatic two-month amount established. Determine source, retained character, tracing, governing precedent and applicable order. C047, C058, C062–C071. |
| E05 — Accumulated wages |
Account balance $3,000 from payroll and other receipts. |
Do not calculate 25%, 75%, or “balance minus $1,000.” Resolve deposited-fund classification, ownership, selection and governing cases. C008–C009, C070–C072. |
| E06 — Joint ownership unknown |
Joint balance $4,000; automatic protected amount $2,000. |
Remaining $2,000 is not automatically split equally or wholly awarded to the creditor. Ownership evidence and exemptions remain. C012–C013, C048, C053. |
| E07 — Two separately reviewed accounts |
A: deposits $2,000, balance $500 → P_A=$500. B: deposits $1,000, balance $2,000 → P_B=$1,000. Total automatic protection $1,500; residual $1,000 in B. |
A’s unused $1,500 deposit total is not pooled into B. Additional tracing/state protection remains possible. C044, C049–C050. |
| E08 — Competing writs |
Same order is served again; no second review under §212.6(f). A genuinely new order requires a new review. |
Do not invent creditor priority or duplicate collectible balances. Verify order identity and remaining judgment amounts. C054–C055, C079. |
| E09 — Claim filed, service unknown |
Debtor says 15 days elapsed after filing. |
No automatic release result follows without service, contest, and condemnation facts. C031–C037. |
| E10 — Employer versus bank |
$900 reached a bank after payroll. |
Employer withholding rules do not automatically determine the bank’s duties. Check Part 212, source classification and state claim separately. C001, C070–C072. |
| E11 — Bank fails to answer |
Bank balance alleged $100; judgment $10,000; no answer shown. |
Conditional judgment may concern the adjudicated claim, but valid service and statutory further notice/finality steps must be established. Silence alone is not immediate absolute $10,000 liability. C019, C023, C028. |
| E12 — Registry deposit, not creditor payment |
Bank pays $500 into court under appropriate authority. |
That does not itself adjudicate ownership/exemptions or prove total judgment satisfaction. C029–C030, C040. |
| E13 — Stay alleged |
Debtor states bankruptcy was filed; no order or relevant facts supplied. |
Investigate the actual stay predicate, duration, exceptions and relief. No private lookup performed here. C073. |
| E14 — Discharge alleged |
Debtor produces no discharge terms or debt treatment. |
Determine whether this personal liability was discharged and whether collection is within §524. C074. |
| E15 — Waiver and debt date disputed |
Creditor asserts an old waiver; debt-creation date disputed. |
Use S_applicable, not $9,400 or $10,225. Examine instrument, pleaded waiver, judgment and statutory/FTC conditions. C007, C010–C011. |
| E16 — Only $80 remains due |
Otherwise reachable residual is $500; verified collectible balance is $80. min($500,$80)=$80. |
No entitlement to duplicate recovery through another bank or writ; actual satisfaction accounting remains necessary. C030, C040, C079. |
These examples do not authorize a real hold, release, transfer, fee, collection, or exemption entitlement.
