A. Principal findings
1. There is no single “Alabama wage-garnishment formula”
Three separate questions must be answered:
First, can this judgment presently be enforced through this court and this garnishee? The judgment, enforcement stay, affidavit, issuance, service, employer answer, and debtor notice are separate requirements. An existing judgment does not eliminate those steps. C002–C017.
Second, what is the maximum withholding allowed by independently applicable law? Federal law generally limits ordinary garnishment to the lesser of 25% of disposable earnings or earnings above the minimum-wage measure. Alabama’s resident-employee statute, consumer-credit statute, and constitutional selection rules have different predicates. A private payroll deduction is not automatically a deduction “required by law.” C018, C024–C037. Justia Law+3
Third, has an additional Alabama exemption been properly claimed and adjudicated? Rule 64B requires a verified claim and inventory in the pending garnishment court. It distinguishes the creditor’s contest period, the court’s dismissal/modification mechanism, and the hearing schedule. Its 15-day provision is not a universal deadline for the debtor to claim an exemption. C047–C057. Alabama Judicial System
2. The constitutional wage cases reject two opposite shortcuts
The read appellate decisions do not establish either:
- A lifetime exemption of only the first $1,000 ever earned or garnished; or
- An automatic fresh $1,000 exemption every payday, irrespective of accumulated property, selection, use, claim sufficiency, or waiver.
Pruett distinguishes property disclosed in the inventory from property actually selected. Gibbons requires sufficient inventory information and rejects an unconditional continuing payday allowance. Merrida applies the replenishment principle where wages were used for necessities and did not accumulate. Renter’s Realty rejects the Legislature’s attempt to remove wages from the constitutional category through §6-10-6.1. C038–C044. Justia Law+3
The constitutional text actually obtained was an official proposed/recompilation document, not a verified complete final 2022 Constitution and amendment chain. The judicial holdings are meaningful primary authority, but they do not certify that entire 2026 constitutional chain. C061–C064.
3. Employer liability and debtor exemptions are different proceedings
An employer’s failure to answer can expose the employer to a conditional judgment. That is not an admission by the debtor, a waiver of the debtor’s exemptions, or proof that every dollar of wages is collectible.
Conversely, an employer’s termination report or release request does not necessarily permit immediate release without preserving a timely creditor examination or contest. The Alabama Supreme Court addressed that distinction in June 2026. C011–C023. Justia Law+1
4. Two actual 2026 rule amendments matter
The March 26, 2026 order, effective April 9, 2026, supplies current Rule 6 computation language. The September 24, 2026 order, effective October 1, 2026, supplies current Rules 5 and 11.
Direct email to an unrepresented party under Rule 5(b)(2)(F) is distinct from service through the court’s electronic-filing system under Rule 5(b)(2)(E). Rule 6(d)’s additional three days expressly covers mail and the court’s electronic-filing system—not every electronic transmission. C055–C057, C063. Alabama Judicial System+1
A stale screenshot from the standalone Rule 5 compilation was encountered. The actual September 2026 adoption order was then read and visually inspected; that order, rather than the stale image, supports the current-rule findings.
B. Court and process findings
1. Judgment, court, issuance, and service
For the ordinary postjudgment route examined here, the statutory reproduction identifies a judgment plaintiff or assignee entitled to execution, an affidavit stating the amount due and the required grounds, and filing in the court where judgment was entered. The issuing process commands the employer’s answer. Those statutory bodies were read in a 2025 secondary reproduction, with selected propositions corroborated by current primary rules and reported opinions. They are not represented as fully verified current official Code text. C003–C007, C061.
The ordinary enforcement waiting periods differ:
| Court route |
Verified rule distinction |
Limitation |
| Circuit Court |
Rule 62 ordinarily stays execution/enforcement for 30 days after entry, subject to its exceptions and court authority. |
A posttrial or Rule 60 motion does not universally create an automatic stay. |
| District Court |
Rule 62(dc) substitutes 14 days and changes treatment of specified posttrial motions. |
Do not import the circuit rule without its district modifications. |
| Small Claims |
Small Claims Rule L uses the district-court enforcement framework; Rule N incorporates district civil rules where necessary and consistent. |
No original-claim jurisdictional dollar limit or full appeal procedure was researched here. |
C005–C006; S003, S008. Alabama Judicial System+2
Rule 4.1 supplies the ordinary service-of-process framework for process other than a summons. The linked method-specific proof provisions and every corporate, interstate, substituted, or electronic-service application were not fully resolved. A defective or unknown return is therefore a factual and legal hold, not presumed valid service. C007, C066.
2. Debtor notice
For a judgment defendant who has not appeared, Rule 64A requires the issuing officer to issue debtor notice contemporaneously with service on the garnishee and requires service at least five days before judgment against the garnishee. The ordinary-debt exemption notice is distinct from support proceedings. C008.
For a defendant who has appeared, the Rule 64B comments direct attention to Rule 5. That does not erase the separate requirements governing service of the original garnishment process on the employer. C009. Alabama Judicial System+1
The December 2, 2022 Supreme Court order expressly links Rule 64A to Act 2022-397, effective July 1, 2022, and §6-6-394.1. The reproduced statute requires more than a failed delivery before posting: a verified motion, court order, prescribed posting and mailing, and compliance evidence before condemnation. The signed act and complete current statutory chain remain unread. C010. Alabama Judicial System+1
3. Three different contests must not be combined
| Proceeding |
Who acts and what is challenged |
Trigger/clock reflected in the sources |
Distinction |
| Creditor examination or contest of employer answer |
Creditor tests the garnishee’s answer and liabilities. |
§6-6-450 oral-examination request and §6-6-458 sworn contest use their respective notice-of-answer triggers. |
Not a debtor exemption claim. |
| Debtor contest of employer answer |
Debtor alleges the garnishee owes more or holds more than admitted. |
§6-6-459 uses notice of the answer and requires particulars. |
Not a general reopening of the original debt judgment. |
| Debtor exemption claim / creditor exemption contest |
Debtor selects and claims protected property or earnings; creditor contests that claim. |
Rule 64B, §6-10-26, Rule 5, and Rule 6 interact. |
Not the same 30-day answer-contest procedure. |
C013–C015, C047–C057.
4. Withholding, remittance, condemnation, release, and satisfaction
These are distinct stages:
- Withholding: Employer retains only what applicable law and the operative order permit.
- Remittance: The reproduced §6-10-7(b) directs payment into court after the initial retention period and subsequently at least monthly.
- Condemnation/disbursement: A court order authorizes application of funds to the creditor; the statute refers to a written creditor request.
- Release or modification: May follow a successful exemption claim, changed employment facts, a stay, satisfaction, or another legally sufficient ground.
- Satisfaction: Requires an accurate judgment accounting and appropriate court-record treatment; releasing one garnishee is not necessarily satisfying the debtor’s judgment.
The complete administrative satisfaction-entry mechanism and current release-form fields were not retrieved. C019–C023, C052, C058–C060, C070. Justia Law+2

| Decision actually read |
Posture, amount source, and holding used |
Order / separate writing / limits |
| Pruett v. Worldwide Asset Purchasing, LLC, 140 So. 3d 481 (Ala. Civ. App. 2013), S015 |
The opinion reports biweekly wages of $600 and other listed property worth $2,080. The debtor selected the wages, not the other property. The court rejected treating ownership of unselected property as automatically defeating the wage selection. |
Reversed/remanded; concurrence shown in the opinion. No automatic stacking of the statutory percentage exemption with another constitutional allowance. Printed pp. 4–6; PDF indices 3–5. C039. |
| Alabama Telco Credit Union v. Gibbons (2015), S016 |
Opinion-reported $13,551.90 judgment; $1,000 weekly wages and $11,500 other listed property. Inadequate descriptions/location information affected the claim. The court rejected an unconditional $1,000 exemption every future pay period. |
Reversed/remanded. Discusses debt date, inventory, accumulation, and reselection after consumption for necessities or qualifying loss. Printed pp. 4–13; PDF indices 3–12. C040, C044. |
| Merrida/Nettles v. Credit Acceptance Corp., 238 So. 3d 1249 (Ala. Civ. App. 2017), S017 |
Opinion reports judgments of $10,469.89 and $13,529.53 and biweekly net wages of $500 and $424. The evidence described use for necessities and no accumulation. The trial court’s “first $1,000, then resume” treatment was reversed. |
Unanimous reversal. Not a rule that every low paycheck is automatically exempt. Printed opinion pp. 6–9 visible in HTML; PDF index unknown. C041. |
| Renter’s Realty v. Smith, 322 So. 3d 1060 (Ala. Civ. App. 2020), S018 |
Opinion reports a $5,145 rent judgment and biweekly net wages of $900 or less. Following the constitutional-notice proceedings described in the opinion, the court held §6-10-6.1 unconstitutional insofar as it attempted to remove wages from constitutional personal property. |
Affirmed; no separate disagreement shown. Printed pp. 6–8 and 12; PDF indices 5–7 and 11. It does not certify all later constitutional amendments. C042. |
| Townsquare Media v. Moore (Oct. 7, 2022), S019 |
Employer-default dispute arising from a support judgment. A later answer did not compel automatic vacation of a conditional employer judgment. |
Affirmed $25,000 employer judgment; two judges concurred only in the result. Used solely for procedural treatment of conditional judgment, not ordinary-debt wage percentages. Printed pp. 6–9, 15; PDF index unknown. C017. |
| Moore v. Capesius, SC-2026-0037 (June 26, 2026), S020 |
A $1.5 million tort judgment supplied the procedural setting. The employer’s release motion was treated as an amended answer; releasing it before honoring a timely oral-examination request was error. |
Reversed with instructions. Sellers wrote the main opinion; Cook’s separate writing, joined by Parker, disputed the need to decide the oath/substantial-compliance issue. Do not convert the main discussion into a universal cure for unsworn corporate answers. Printed pp. 4–14; PDF indices 3–13. C012, C020–C022. |
| Bachus v. Kenington, CL-2026-0035 (Oct. 23, 2026), S021 |
The court quashed wage garnishment and deemed a judgment satisfied on a theory raised outside the exemption issue set for hearing. The appellate court required notice and a reasonable opportunity to address the actual ground. |
Unanimous reversal/remand. The opinion did not decide the claimed $1,000-paycheck exemption. Its reference to the 2022 Constitution appears in the account of a party’s position, not a complete constitutional-currentness holding. Printed pp. 12–16 in HTML; PDF index unknown. C023, C064, C070. |
The first four decisions establish the relevant constitutional-versus-statutory distinction and its factual limitations. The later procedural decisions do not silently extend their underlying support or tort facts into the ordinary consumer-debt calculation. Justia Law+6

F. Three conditional models
Model 1 — Federal ordinary-garnishment maximum
Assumptions: qualifying earnings; ordinary debt; correctly identified legally required deductions; one relevant pay-period ledger; no support, tax, bankruptcy-order, or other special regime.
Let:
- E = qualifying earnings for the period, dollars.
- R = amounts required by law to be withheld, dollars.
- D = max(E − R, 0), disposable earnings.
- q = weekly-equivalent period factor.
- H = 30 × $7.25 × q.
- F = min(0.25 × D, max(D − H, 0)).
Verified conversion factors:
- Weekly: q = 1; H = $217.50.
- Biweekly: q = 2; H = $435.00.
- Semimonthly: q = 13/6; H = $471.25.
- Monthly: q = 13/3; H = $942.50.
F is a federal maximum, not automatic permission to withhold F. State protection, an exemption order, a stay, invalid service, or a smaller balance can change the result. C027–C034.
Rounding: exact-cent results below require no rounding. If a maximum produces a fraction of a cent, rounding downward is a conservative implementation assumption used here—not a newly asserted statutory rounding rule. U.S. Code+2
Model 2 — Multiple ordinary orders against the same period
Assumptions: Model 1 applies and all amounts concern the same relevant earnings ledger.
Let:
- F = aggregate ordinary ceiling.
- G = ordinary garnishment already allocated against that ceiling.
- B = verified remaining amount collectible under the new order.
- Remaining capacity = max(F − G, 0).
- New withholding cannot exceed min(remaining capacity, B).
This model does not choose which creditor has priority. It does not automatically combine separate employers or mix support/tax orders with ordinary orders. C032, C069.
Model 3 — State-law and court-order gates
Let:
- F = federal ceiling from Model 1.
- S = applicable Alabama statutory ceiling, determined under the correct statute and compensation base.
- O = amount permitted by the actual exemption/stay/modification order.
- B = verified remaining balance.
Only after each legal predicate is established:
Final withholding cannot exceed min(F, S, O, B).
There is no substitution of “paycheck minus $1,000” for O. Constitutional selection, inventory, accumulation, necessities, debt date, residence, and waiver require their own analysis. Nor is the 75% statutory exemption automatically stacked with another $1,000 wage exemption.
If a necessary judgment, service, classification, or order fact is unknown, the model returns HOLD, not a manufactured dollar authorization. C018, C024, C038–C059, C066–C072.
G. Nineteen fictional worked postures
These are anonymous teaching inputs, not borrower stories, actual legal calendars, filings, or outcomes.
E01 — Weekly disposable earnings below the federal threshold
D = $200/week. H = $217.50/week.
25% branch: $200 × 0.25 = $50.
Threshold branch: max($200 − $217.50, 0) = $0.
F = min($50, $0) = $0/week.
Adverse branch: first verify the income and deductions. A mistaken D cannot establish the result. C028–C031.
E02 — Exactly at the weekly threshold
D = $217.50/week.
25% branch = $54.375. Threshold branch = $0.
F = $0/week. No rounding affects the result.
This does not resolve whether a different kind of order uses a different statutory limit. C029–C034.
E03 — Above the threshold but below the full-25% region
D = $250/week.
25% branch = $62.50.
Threshold branch = $250 − $217.50 = $32.50.
F = min($62.50, $32.50) = $32.50/week.
A flat 25% deduction would exceed this ordinary federal maximum by $30. C029–C031.
E04 — Voluntary deduction is not automatically “required by law”
E = $1,000/week. Assumed legally required deductions R = $200.
D = $1,000 − $200 = $800.
A separate voluntary retirement deduction is $100.
F = min($800 × 0.25, $800 − $217.50)
= min($200, $582.50) = $200/week.
Incorrectly subtracting the voluntary $100 would produce D = $700 and $175. The $25 difference demonstrates why the deduction’s legal character matters. State protection may still reduce withholding. C028–C031.
E05 — Biweekly pay
D = $500 per two-week period.
H = 30 × $7.25 × 2 = $435.
25% branch = $125. Threshold branch = $65.
F = $65 per biweekly period.
Do not subtract only $217.50 from a biweekly paycheck. C031.
E06 — Semimonthly pay
D = $600 per semimonthly period.
H = 30 × $7.25 × 13/6 = $471.25.
25% branch = $150. Threshold branch = $128.75.
F = $128.75 per semimonthly period.
Semimonthly is not the same as every two weeks. C031.
E07 — Monthly pay
D = $1,000/month.
H = 30 × $7.25 × 13/3 = $942.50.
25% branch = $250. Threshold branch = $57.50.
F = $57.50/month.
The fraction 13/3 is retained in the calculation; no early rounding is needed. C031.
E08 — Additional constitutional exemption actually granted
Assume D = $900/week. Model 1 yields min($225, $682.50) = $225.
Assume additionally that a legally sufficient claim establishes qualifying selection, no disqualifying accumulation, applicable contract/residence predicates, and a court order exempting all targeted wages.
Model 3 then gives min($225, applicable S, $0, B) = $0 under that order.
Without the claim facts and order, the report cannot simply replace $225 with zero. C038–C054.
E09 — Accumulation changes the analysis
Assume retained selected wages of $150 plus newly selected wages of $900.
Potential selected total = $150 + $900 = $1,050.
That exceeds $1,000 by $50. The conclusion is not automatically “all $900 is garnishable” or “only $50 may be withheld.” Selection, available statutory protection, accumulation, and the court’s determination must be resolved. C038–C041.
E10 — Owned property versus selected property
Assume wages of $600 are selected; other property worth $2,080 is disclosed but not selected.
Inventory total = $600 + $2,080 = $2,680 disclosed.
Selected wage amount = $600, not $2,680.
The distinction matters under Pruett. It does not excuse an incomplete inventory or permit duplicate exemption stacking. C039–C040, C048.
E11 — Before/after the material 2015 date
Two hypothetical obligations have identical current wage facts, but one arose before June 11, 2015 and the other afterward.
No numerical exemption is assigned merely from the writ’s 2026 date. The debt-date rule, applicable enactment, and Renter’s Realty’s constitutional holding must be reconciled. Post-2015 timing does not, by itself, make the invalidated wage exclusion controlling. C042–C044.
E12 — Two ordinary garnishments
D = $800/week. Aggregate F = $200.
Existing ordinary allocation G = $150.
Remaining capacity = $200 − $150 = $50/week.
A second ordinary order cannot independently take another $200 from this same ledger. Whether the new creditor receives the $50 is a priority question not answered by the arithmetic. C032, C069.
E13 — Claim filed, but service unknown
Assume a debtor says 15 calendar days have elapsed since filing a claim.
No numerical release result follows without knowing whether the creditor received proper notice and whether a timely contest was filed. The claim’s filing date, service method, service completion, and condemnation posture are required. C049–C057.
E14 — Employer fails to answer
Assume proper employer service is alleged but not established, and no answer appears.
The next inquiry is the conditional-judgment and notice procedure—not whether the debtor admitted the debt or waived exemptions. A later employer answer does not automatically resolve every conditional-judgment consequence. C011–C017.
E15 — Allegedly protected benefits mixed with wages
Assume $400 weekly wages and a separate $200 payment alleged to be protected benefits.
For the wage component alone, assuming D = $400:
F = min($100, $182.50) = $100/week.
No total withholding amount is assigned to the additional $200 without identifying the program, legal protection, payment character, and whether the process targets payroll or a bank account. C026–C029, C068.
E16 — Self-employed invoice
Assume a $1,000 invoice includes $600 attributed to materials and $400 to labor.
$1,000 − $600 = $400 is an arithmetic margin, not automatically statutory disposable earnings. The personal-service, employee, business-receipt, and deduction classifications must be established before any 25% calculation. C067.
E17 — Stay or discharge alleged
Assume a debtor states that bankruptcy was filed or a discharge entered.
No withholding outcome is assigned from the assertion alone. A qualifying stay or discharge may prohibit collection, but actual order scope, dates, exceptions, relief, and debt treatment are necessary. No private bankruptcy record was searched. C058–C059.
E18 — Waiver unknown
Assume the creditor alleges an exemption waiver but supplies no instrument or judgment language.
There is no automatic waiver and no automatic declaration that every possible waiver is invalid. The writing, scope, execution, pleaded issue, judgment treatment, and potentially applicable FTC restriction must be examined. Federal withholding limits remain independently relevant. C037, C045–C046.
E19 — Small remaining balance
Assume aggregate lawful capacity is $200, but the correctly verified remaining collectible balance is $80.
min($200, $80) = $80, before any still-more-protective order.
A payroll calculation does not itself enter satisfaction in the court record or resolve whether already-held funds, costs, or credits were correctly accounted for. C020, C070.

K. Researcher self-check
Actual primary reading
Actual bodies were read for the identified Alabama rules, the 2026 Rules 5/6 adoption orders, the 2022 Rule 64A comments order, the enrolled 2015 legislative instrument, the specified judicial opinions, federal operative provisions and regulations, the original CCPA enactment, and the limited bankruptcy provisions.
The newer Moore and Bachus opinions were used for their actual procedural holdings, not as proof of an unrelated blanket wage exemption. Separate writings and different underlying support/tort postures were retained.
Dated reproduction and failed-access discipline
The 18 Alabama Code bodies were read as an expressly 2025 secondary compilation. Failed official routes were not promoted to current-text verification and were not used to infer absence or permission.
The constitutional text obtained was identified as proposed/recompilation material. Final 2022 adoption and later amendment completeness remain held.
Current federal §§1676–1677 bodies were not successfully obtained; original enacted provisions were read and clearly labeled historical. Form-index titles and dates were not converted into invented fields.
Images and version conflicts
PDF screenshots were used where available. Some requested pages returned cache misses; those failures were retained rather than described as visual inspection. The stale Rule 5 image was resolved for the provisions used by reading and inspecting the actual September 24, 2026 adoption order.
Unread/private matters
No actual borrower, employer, creditor, provider, account, property, contract, payroll record, judgment file, service return, docket, licence, or private case record was searched. No named entity was cleared. The 67-county list is administrative inventory only.
Process
This was regular-chat public-source research.
