Bankruptcy-related discriminatory treatment: 11 U.S.C. § 525

The complete current official § 525 body was read. It contains subsections (a), (b), and (c). The government, private-employment, and student-financing provisions differ in their actors, protected recipients, prohibited actions, and causal wording. Those differences must remain separate. In particular, subsection (a) expressly includes denial of employment; subsection (b) does not repeat that phrase. Subsections (a) and (b) use “solely because,” whereas subsection (c)(1) uses “because.” These are verified textual differences, not conclusions about an actual hiring decision or a judicial causation test. C001, C022–C030, C037–C049. uscode.house.gov

Historical authentication is partial. The published 2005 amendment and its complete general effective/application clause were readable, as was the published 1984 renumbering Act. An official enrolled version supplied the selected complete 1994 amendment and application clauses. Several original publication endpoints for 1978, 1984, 1994, and 2020 failed. Their failures remain below; compiled notes and enrolled text are not relabeled as successful reads of those failed original publications. C059–C075. govinfo.gov+3

All source checks reported here occurred October 28, 2026, America/Los_Angeles (PDT). The principal official Code pages displayed coverage through Public Law 119-134, October 20, 2026. That compilation statement is narrower than a certification that every intervening enactment, application issue, or judicial development through the access date has been examined. No prior report supplies evidence for this pass. C002–C003, C074–C076.

2. Complete statutory comparison

Every row below depends on the relevant actor, recipient, action, reason, causal connection, and applicable exception. No row establishes those predicates for an actual situation.

Element Governmental branch — § 525(a) Private-employment branch — § 525(b) Specialized student-financing branch — § 525(c)
Regulated actor A governmental unit, subject to the express agricultural exceptions. A private employer. A governmental unit operating a student grant or loan program; and the separately described person whose business includes making loans guaranteed or insured under a student loan program.
Protected recipient A person who is or has been a Title 11 debtor or a former-Act bankrupt/debtor; or another person with whom that bankrupt/debtor has been associated. An individual with the specified bankruptcy status, or an individual associated with that debtor/bankrupt. A person with the specified bankruptcy status, or another person with whom that debtor/bankrupt has been associated.
Objects/actions License, permit, charter, franchise, or similar grant: denial, revocation, suspension, refusal to renew, conditioning, or discrimination respecting the grant. Employment: denial, termination, or discrimination respecting employment. Termination of employment or discrimination respecting employment. The separate phrase deny employment is absent. Denial of a student grant, loan, loan guarantee, or loan insurance.
Bankruptcy-status reason Present or past Title 11 debtor status, or former Bankruptcy Act bankrupt/debtor status. Same categories, in (b)(1). Same categories in (c)(1).
Insolvency reason Insolvency before commencement of the Title 11 case, or during it but before grant or denial of discharge. Before commencement of a Title 11 case, or during it but before grant or denial of discharge, in (b)(2). Before commencement, or during pendency, but before grant or denial of discharge.
Nonpayment reason Nonpayment of a debt dischargeable in the Title 11 case, or discharged under the former Bankruptcy Act. Same distinction in (b)(3). Same distinction in (c)(1).
Causal language Solely because. Solely because. Because. No “solely” appears in this clause.
Express special qualification Named PACA, Packers and Stockyards Act, and 1943 appropriation provision. No repetition of subsection (a)’s agricultural opening exception. That textual observation does not settle other-law interactions. Definition in (c)(2): any Title IV Higher Education Act program, or a similar State/local-law program. Actor and denial-object conditions still matter.
Unresolved construction “Similar grant,” association, actual governmental status, causation, and application of the agricultural exceptions. Meaning of discrimination respecting employment, including the significance of the hiring-wording difference; actual employer/individual status and causation. Program classification, similarity, qualifying business activity, causal standard, and underlying eligibility/terms.

3A. Organization, construction, and indispensable definitions

Claim ID Supported proposition Conditions, qualifications, and limits Exact evidence
R092-P1-C001 Current § 525 is titled Protection against discriminatory treatment and contains (a), (b)(1)–(3), and (c)(1)–(2), within Chapter 5, Subchapter II. No current subsection (d) is printed in the operative body. Historical (d) must not be inserted into it. S001, complete body and Title 11 organization index.
R092-P1-C002 The official body displayed coverage through P.L. 119-134, October 20, 2026; it was accessed October 28, 2026 PDT. Compilation cutoff, access date, enactment, and legal application are different dates. Unexamined later law remains held. S001, currency statement; research access record.
R092-P1-C003 The current body, source credit, editorial references, legislative-history excerpt, and application notes serve different functions. A historical report excerpt does not amend or override current enacted wording. S001, operative body versus separately headed notes.
R092-P1-C004 Title 11’s construction rule makes may not prohibitory. It does not by itself supply a cause of action, forum, remedy, or proof of breach. S003, § 102(4).
R092-P1-C005 “Includes” and “including” are nonlimiting; “or” is not exclusive; singular includes plural. Express exclusions and particular subsection conditions still control. These construction rules do not erase § 525’s actor/action/reason requirements. S003, § 102(3), (5), (7)–(8).
R092-P1-C006 A debtor under § 101(13) is a person or municipality concerning which a Title 11 case has commenced. Financial difficulty alone does not establish that defined status. Eligibility to commence a case is a different inquiry. S002, § 101(13).
R092-P1-C007 Person includes an individual, partnership, and corporation, but generally excludes a governmental unit. This is not interchangeable with § 525(b)’s narrower word individual. S002, § 101(41); S001(b).
R092-P1-C008 The governmental-unit exceptions in § 101(41) concern acquiring an asset through a loan guarantee or as receiver/liquidating agent; guaranteeing specified debtor/affiliate pension benefits; or owning assets of the specified governmental pension/deferred-compensation plans. The concluding clause treats the governmental unit as a person for § 1102, and only respecting the asset or benefit. It is not a general governmental-unit inclusion for § 525. The tax-plan and committee regimes are not independently analyzed. S002, § 101(41)(A)–(C), concluding clause.
R092-P1-C009 Corporation includes the specified corporate-privilege association, capital-only-liability partnership association, joint-stock company, unincorporated company/association, and business trust; it excludes a limited partnership. The detailed association qualifications remain necessary. No actual organizational classification is made. S002, § 101(9)(A)(i)–(v), (B).
R092-P1-C010 Entity includes person, estate, trust, governmental unit, and United States trustee. A broader defined entity is not automatically a “person” or “individual” for each § 525 branch. S002, § 101(15).
R092-P1-C011 Governmental unit includes the United States; State; Commonwealth; District; Territory; municipality; foreign state; their specified departments, agencies, or instrumentalities; and other foreign or domestic government. The definition expressly excludes a United States trustee while serving as trustee in a Title 11 case from the stated federal category. Definition alone does not resolve jurisdiction, immunity, or territorial application. S002, § 101(27).
R092-P1-C012 A municipality is a political subdivision, public agency, or instrumentality of a State. “State” includes the District of Columbia and Puerto Rico, subject to the exception concerning who may be a Chapter 9 debtor. The Chapter 9 exception is retained; it is not a universal exclusion of those jurisdictions from Title 11 terminology. S002, § 101(40), (52).
R092-P1-C013 Claim includes a right to payment whether reduced to judgment or not, liquidated or unliquidated, fixed or contingent, matured or unmatured, disputed or undisputed, legal or equitable, secured or unsecured. It also includes an equitable breach remedy giving rise to payment, with the separately listed judgment/fixed/contingent/maturity/dispute/security alternatives. A label or asserted obligation does not establish the existence, amount, validity, or dischargeability of such a right. S002, § 101(5)(A)–(B).
R092-P1-C014 Debt means liability on a claim. The definition does not establish an actual liability or make every debt dischargeable. S002, § 101(12).
R092-P1-C015 For an entity other than a partnership or municipality, § 101(32)(A) defines insolvency through debts greater than property at fair valuation, excluding property transferred/concealed/removed with the specified intent and property potentially exemptible under § 522. Both exclusions matter. No valuation, intent, exemption, or actual insolvency finding is made. S002, § 101(32)(A)(i)–(ii).
R092-P1-C016 Partnership insolvency compares debts with the fair-valued aggregate of partnership property, excluding the specified fraud-related property, plus the sum of each general partner’s nonpartnership-property excess over nonpartnership debts, with the stated property exclusions. No missing value, aggregation convention, or § 522 determination is supplied. S002, § 101(32)(B)(i)–(ii).
R092-P1-C017 Municipal insolvency uses alternatives: generally not paying debts as they become due, unless those debts are subject to a bona fide dispute; or inability to pay debts as they become due. This category-specific definition is not a general test for every debtor, and does not resolve § 525’s chapter/recipient application. S002, § 101(32)(C)(i)–(ii).
R092-P1-C018 The insolvency definition cannot be replaced by an ordinary description of hardship, low income, delinquency, or an unaffordable payment. § 522’s incorporated exemption rules and all factual valuations remain held. S002, § 101(32); C015–C017.
R092-P1-C019 § 103(a) applies Chapters 1, 3, and 5 in Chapter 7, 11, 12, or 13 cases, subject to § 1161. The current § 1161 exclusion list does not list § 525. This is a chapter-application statement, not a finding about any case or railroad category. S004, § 103(a); entire § 1161.
R092-P1-C020 Chapter 9 and Chapter 15 have separate application structures. § 901(a)’s incorporation list and § 103(a)’s Chapter 15 list do not list § 525. That observation is not converted into a complete determination of external post-bankruptcy protection, municipal status, foreign proceedings, or constitutional rights. S004, § 103(a), (f); § 901(a)–(c).
R092-P1-C021 § 525 does not itself define “private employer,” “employment,” “associated,” or “other similar grant.” No ordinary label, family link, ownership link, or employment label is treated as completing their legal construction. S001, complete body.

The selected definitions and construction provisions were read directly; they do not establish actual actor or financial status. uscode.house.gov+8

3B. Governmental actions, reasons, and exceptions

Claim ID Supported proposition Conditions, qualifications, and limits Exact evidence
R092-P1-C022 § 525(a) identifies a license, permit, charter, franchise, or other similar grant. “Similar” is a condition; the list is not silently expanded to every government benefit, contract, payment, or financing decision. S001(a), grant-object clause.
R092-P1-C023 For those grants, the listed actions are denial, revocation, suspension, refusal to renew, conditioning, and discrimination respecting the grant. Protected recipient, specified reason, sole-cause language, and agricultural exceptions remain cumulative. S001(a), action clauses.
R092-P1-C024 The governmental-employment language expressly includes denial of employment, termination, and discrimination respecting employment. It does not establish that every adverse employment result was caused by a protected reason. S001(a), employment clauses.
R092-P1-C025 Subsection (a) protects the specified present/former debtor or bankrupt person, and another person with whom that debtor/bankrupt has been associated. The protected-reason inquiry refers to the specified debtor/bankrupt. Association and its legal scope are not established by a label. S001(a), recipient and association clauses.
R092-P1-C026 The status ground covers being or having been a Title 11 debtor, or a bankrupt/debtor under the former Bankruptcy Act. A grant of discharge is not written as a prerequisite to this status ground. Former-Act classification remains a separate historical question. S001(a), first reason clause.
R092-P1-C027 The insolvency ground concerns insolvency before commencement of the Title 11 case, or during it before the debtor is granted or denied discharge. The temporal words qualify the insolvency ground; actual commencement and discharge events are absent. S001(a), insolvency clause.
R092-P1-C028 The nonpayment ground distinguishes a debt dischargeable in the Title 11 case from a debt discharged under the former Bankruptcy Act. It does not say that every unpaid debt qualifies, or that current-Code dischargeability and former-Act discharge are interchangeable. S001(a), final clause.
R092-P1-C029 Subsection (a) uses solely because for the specified bankruptcy, insolvency, or nonpayment reason. Actual causation, independent reasons, pretext, evidentiary standards, and mixed-reason adjudication are not resolved. S001(a), causal connector and reason series.
R092-P1-C030 The grant-or-denial-of-discharge endpoint is attached to the insolvency wording, not expressed as a universal termination of every § 525 protection. No indefinite universal protection or actual post-discharge result is inferred either. S001(a), (b)(1)–(3), (c)(1).
R092-P1-C031 Subsection (a) expressly preserves what is provided in PACA, the Packers and Stockyards Act, and § 1 of the specified July 12, 1943 Agriculture appropriation Act. This is not an unqualified exemption for all agricultural actors or all their actions. The wording is located in (a); it is not silently copied into other subsections. S001(a), opening exception; references note.
R092-P1-C032 PACA § 499d(a)’s final proviso contains bankruptcy-discharge-related license termination language, but also a circumstances exception. The Secretary must examine those circumstances if the licensee requests it. The statutory predicate concerns the licensee, or a partner when the licensee is a partnership; the exception concerns a finding that the bankruptcy circumstances do not warrant termination. No actual status or result is established. S006, § 499d(a), final proviso.
R092-P1-C033 § 499d(e) permits refusal where the specified applicant, general partner, corporate officer, or holder of more than 10% of stock has the stated bankruptcy connection within three years before application, and the Secretary finds the circumstances warrant refusal, unless the prescribed bond or satisfactory assurance is furnished. It also covers the specified role in a partnership/corporation adjudicated or discharged bankrupt. All role, timing, finding, and assurance predicates matter. No actual licensing conclusion follows. S006, entire § 499d(e).
R092-P1-C034 Other § 499d licensing grounds and its § 499h employment cross-reference have distinct conditions. The complete selected bodies were read, but PACA category definitions, appeals, related provisions, and implementation were not fully traced. The complete agricultural exception remains partial, not a blanket authorization. S006, § 499d(b)–(d); § 499h(a)–(e).
R092-P1-C035 Under the relevant § 204 clause, after due notice and hearing, a Secretary’s finding that a registrant is insolvent or violated the chapter permits suspension for a reasonable specified period. The next sentence says the order takes effect “within not less than five days,” unless suspended, modified, or set aside by the Secretary or a competent court. The quoted timing is not converted into a service-based deadline or an application instruction. Registrant definitions, counting, and procedural implementation remain held. S007, first paragraph’s suspension clause and second paragraph.
R092-P1-C036 § 204 separately addresses an insolvent packer through notice/hearing and an order under § 193 concerning livestock purchases while insolvent, including purchases under prescribed conditions. § 193 and the category definitions were not fully read. Neither this clause nor § 204 exhausts the separately named Packers and Stockyards Act exception. S007, final paragraph; S001(a).

3C. Private employment and student-financing provisions

Claim ID Supported proposition Conditions, qualifications, and limits Exact evidence
R092-P1-C037 Subsection (b) regulates a private employer and protects the described individual, including an associated individual. It does not use the broader recipient word “person” found in (a) and (c). No actual employment relationship is established. S001(b), introductory clause.
R092-P1-C038 Subsection (b) lists employment termination and discrimination respecting employment; it omits (a)’s separate phrase denying employment. This verifies a textual difference. It does not establish a categorical rule that every private refusal to hire is allowed, or settle the judicial meaning of discrimination respecting employment. S001(a), (b), compared.
R092-P1-C039 Subsection (b)(1) identifies present/past Title 11 debtor status and former-Act debtor/bankrupt status. Status is a reason category, not actual proof of the reason for an employment act. S001(b)(1).
R092-P1-C040 Subsection (b)(2) identifies insolvency before case commencement, or during the case but before grant or denial of discharge. The legal insolvency definition and temporal predicates remain necessary. S001(b)(2); S002(32).
R092-P1-C041 Subsection (b)(3) identifies nonpayment of a debt dischargeable in a Title 11 case or discharged under the former Act. No dischargeability or nonpayment fact is established. S001(b)(3).
R092-P1-C042 The introductory solely because qualification governs (b)’s listed grounds and associated-individual protection. The underlying reason is the debtor/bankrupt’s specified status, insolvency, or nonpayment. Actual association and causation remain unknown. S001(b), introductory clause and (1)–(3).
R092-P1-C043 The governmental actor in (c)(1) must operate a student grant or loan program. Governmental status alone does not establish this particular program-operator predicate. S001(c)(1), first actor clause.
R092-P1-C044 The other actor category is a person engaged in a business that includes making loans guaranteed or insured under a student loan program. It is not every private lender, guarantor, school, creditor, or business merely associated with education. Business activity and program/guarantee/insurance predicates remain necessary. S001(c)(1), second actor clause.
R092-P1-C045 The listed denial objects are a student grant, loan, loan guarantee, or loan insurance, to a person with the specified bankruptcy status or associated person. A loan guarantee or insurance category is not a determination of another person’s liability. A protected denial reason is not approval of terms or eligibility. S001(c)(1), denial and recipient clauses.
R092-P1-C046 Subsection (c)(1) repeats the bankruptcy-status, temporally qualified insolvency, and precisely differentiated nonpayment grounds. It retains the period before grant or denial of discharge and the current-Code dischargeable versus former-Act discharged distinction. S001(c)(1), complete reason series.
R092-P1-C047 Subsection (c)(1) says because, without the word solely used in (a) and (b). No judicial burden-of-proof, mixed-motive, or causation formula is derived from that difference in this text-only pass. S001(a), (b), (c)(1).
R092-P1-C048 The defined student loan program is any program operated under Title IV of the Higher Education Act of 1965, or a similar program operated under State or local law. Both the source-of-law and similarity language are retained. A generic education or loan label does not establish either alternative. S001(c)(2).
R092-P1-C049 The definition says “In this section,” not merely “in this paragraph.” Full Title IV program provisions and any State/local similarity analysis were not read. Program-specific coverage and eligibility therefore remain held; the definition is not a finding about a real program. S001(c)(2); references note.
R092-P1-C050 Section 525 contains specified prohibitions, including a specialized financing provision; it does not state a universal entitlement to new private credit, a particular loan term, funding, or approval. This bounded conclusion does not declare all other denials lawful, determine “similar grant,” or resolve other credit laws. S001, complete (a)–(c).
R092-P1-C051 Section 525’s nonpayment language depends on dischargeability or former-Act discharge; it does not itself adjudicate either or issue a discharge. The necessary chapter-discharge and § 523 chains, actual discharge orders, and § 524 effects remain held. S001(a), (b)(3), (c)(1).

3D. Legal effect, process, and remedy limits

Claim ID Supported proposition Conditions, qualifications, and limits Exact evidence
R092-P1-C052 Section 106(a) expressly lists § 525 among provisions for which governmental-unit sovereign immunity is abrogated to the extent set forth in § 106. It is not an unqualified immunity waiver for every claim, actor, forum, or remedy. Constitutional/judicial construction is unexamined. S005, § 106(a), (a)(1).
R092-P1-C053 Section 106(a)(2)–(3) addresses court determination and orders/process/judgments, including money recovery but excluding punitive damages under that clause; costs/fees must conform to the incorporated 28 U.S.C. § 2412(d)(2)(A) limits. The complete incorporated fee and procedural chains were not read. No award, damages entitlement, fee amount, or actual cause of action is established. S005, § 106(a)(2)–(3).
R092-P1-C054 Enforcement under § 106(a)(4) must be consistent with appropriate nonbankruptcy law; a money judgment against the United States has the stated district-court-judgment payment treatment. Appropriate enforcement/payment authorities were not traced. No collection or payment outcome follows. S005, § 106(a)(4).
R092-P1-C055 Section 106 expressly does not create a substantive claim for relief or cause of action not otherwise existing under the identified law or rules. Listing § 525 in § 106 does not alone complete a remedy chain. S005, § 106(a)(5).
R092-P1-C056 Sections 106(b) and (c) separately address a governmental proof of claim, estate-property claims, same-transaction/occurrence conditions for the specified waiver, and an estate-claim offset. No proof of claim, estate claim, transaction, or offset predicate is supplied. These routes are not treated as necessary facts or available remedies in an actual § 525 matter. S005, complete § 106(b)–(c).
R092-P1-C057 Actual standing, jurisdiction, procedural vehicle, proof, limitation, enforcement competence, relief, and judicial construction remain unresolved. Section 525’s prohibition cannot substitute for those unexamined authorities. No automatic reinstatement, license, financing, damages, injunction, cancellation, or contract invalidity is found. S001, complete body; S005(a)(2)–(5).
R092-P1-C058 The historical/revision note on the § 525 page is legislative explanation, not the present operative text. Its broader description, historical references, and discussion of further judicial development are not adopted as current holdings or as a substitute for the express agricultural exceptions. No referenced opinion was investigated. S001, historical/revision note compared with current (a)–(c).

3E. History, application, and source-status claims

Claim ID Supported proposition Conditions, qualifications, and limits Exact evidence
R092-P1-C059 The current source credit identifies original § 525 with P.L. 95-598, November 6, 1978, 92 Stat. 2593. The original enactment body was not successfully opened. An exact original-to-current word comparison is therefore incomplete. S001 source credit; S009 failure.
R092-P1-C060 The official front matter reproduces § 402 as amended: an October 1, 1979 general effective date, subject to the stated title-level exceptions; separate treatment of Title II amendments and specified sections is retained. This compiled amended transition provision is not represented as an original 1978 read. Intervening transition amendments were not all opened. S008, complete displayed § 402(a)–(e).
R092-P1-C061 The compiled § 403(a) preserves former-Act case administration and substantive rights, with the separate qualifications in (b)–(e). The complete displayed savings provision was read; railroad, retirement, criminal-law, and fund/fee qualifications were not applied. Former-Act definitions and an actual historical case remain unresolved. S008, complete displayed § 403(a)–(e).
R092-P1-C062 The current amendment note records that the 1984 Act designated the existing text as (a), inserted the article before PACA’s title, and added (b). This is a verified compiled-note finding; the original § 309 publication failed. S001, 1984 amendment note; S010.
R092-P1-C063 The compiled 1984 application clause uses 90 days after July 10, 1984, with exceptions for § 426(b) and subtitle J. The exact “effective to cases filed” wording is preserved; it is not converted into a consumer waiting period or actual case-date calculation. S002, complete reproduced § 552(a)–(c).
R092-P1-C064 P.L. 98-531 § 1 struck the earlier § 552 and redesignated § 553 as § 552. Its § 3 makes the Act effective July 10, 1984 except for § 2 amendments, assigned March 31, 1984. This renumbering/effect Act was directly read. It does not cure failure to read P.L. 98-353 § 309 or its original effective clause. S011, §§ 1–3, printed 2704/index 0.
R092-P1-C065 The official 1994 enrolled § 313 adds (c), including both actor categories and a then-definition limited to programs under Parts B, D, or E of Title IV, or a similar State/local program. Historical wording; current (c)(2) is broader after the 2005 amendment. Original published Act comparison remains incomplete. S012, complete § 313, enrolled pp. 35–36/indices 34–35.
R092-P1-C066 The enrolled § 501(d)(15) removes the parenthetical Code/Statutes citations after the agricultural references in (a). It does not direct deletion of the named Acts or exception itself. S012, § 501(d) command and (d)(15)(A)–(C), pp. 38, 40/indices 37, 39.
R092-P1-C067 The enrolled § 702(a), (b)(1) sets enactment-date effect, subject to (b), and generally excludes cases commenced before enactment. The selected § 525 amendments are not listed among § 702(b)(2)’s exceptions. Actual case application remains absent. S012, § 702(a), (b)(1)–(2); S001/S002 identifying October 22, 1994.
R092-P1-C068 The complete § 702(b)(2) exceptions concern § 111; §§ 113 and 117 before/on/after enactment; specified § 1110 leases connected with settlements in cases pending at enactment; and § 305 agreements entered after enactment. Those other substantive regimes and the incorporated lease definition were not applied. Their presence prevents an unqualified statement that the whole Act has one application rule. S012, § 702(b)(2)(A)–(D).
R092-P1-C069 Enrolled § 701 provides severability if a provision/amendment or its application is held unconstitutional, preserving the specified remaining provisions and applications. No constitutional holding or actual severability question is established. S012, complete § 701.
R092-P1-C070 Published 2005 § 1211 inserts student at the specified grant reference in (c)(1) and replaces the Parts B/D/E restriction in (c)(2) with any program operated under Title IV. These are adopted textual changes, not proof that every educational loan or applicant is covered. S013, complete § 1211(1)–(2), 119 Stat. 194/index 171.
R092-P1-C071 Published § 1501(a), (b)(1) generally provides effect 180 days after enactment, and excludes cases commenced before that effective date, subject to its express “otherwise provided” qualifications. Enactment was April 20, 2005. No actual calendar deadline or case application is calculated. S013, § 1501(a), (b)(1), 119 Stat. 216/index 193.
R092-P1-C072 Section 1501(b)(2) applies amendments made by §§ 308, 322, and 330 to cases commenced on or after enactment. Section 1211 is not in this listed exception. The other amendments are not substantively investigated here. S013, complete § 1501(b)(2).
R092-P1-C073 Current § 525 notes report that P.L. 116-260 added temporary (d), concerning the cited CARES Act relief, and removed it effective one year after December 27, 2020. The original § 1001(c)(1)–(2) could not be read. Its full adopted text/application is therefore not independently authenticated here. No underlying CARES entitlement is evaluated. S001, 2020 amendment/effective notes; S014 failure.
R092-P1-C074 Current (a)–(c), rather than the historical (d), are the directly read § 525 body. This does not certify the absence of unexamined later enactments, judicial changes, or application issues beyond the declared compilation. S001, body and currency; C002, C073.
R092-P1-C075 Access failures were source-specific; some current Code endpoints later became readable, while identified original enactment endpoints remained unreadable. Failure is not repeal, absence of protection, or proof about a model, quota, or security condition. Source/failure log below.
R092-P1-C076 The investigation supports conditional statutory distinctions, not an actual actor classification, violation, remedy, approval, financial outcome, or resolution of other law. All individual facts and remaining A092 dimensions stay held. Silence in this selected law is not authorization under every other law. S001–S005, read bounds; C021, C050–C058, C074–C075.

4. Enactment and application comparison

Stage Verified change or historical information Application/effect distinction Authentication result and exact gap
Original 1978 enactment Current credit attributes § 525 to P.L. 95-598. The original published § 525 was not successfully read. Compiled amended § 402 supplies the general October 1, 1979 commencement rule with exceptions; compiled § 403 preserves former-Act matters subject to its qualifications. Partial. C059–C061; S008–S009. Original § 525, original transition text, and complete intervening transition amendments remain unverified at their original publications.
1984 private-employment addition Current amendment note identifies addition of (b) and designation of the previous text as (a). Reproduced effective clause uses the 90-day formulation, with separate § 426(b)/subtitle-J exceptions. Partial. C062–C063; S001–S002, S010. Original § 309 and original effective clause failed.
1984 renumbering correction Published Act strikes the earlier § 552 and redesignates § 553 as § 552. Approval October 19, 1984; § 3(a) assigns July 10, 1984 effect, while § 2 amendments have a separate date. Answered for the selected published Act. C064; S011. This explains numbering; it does not authenticate an unread earlier clause.
1994 student-financing addition Enrolled § 313 adds (c), originally using Parts B/D/E; enrolled § 501(d)(15) deletes parenthetical citations without deleting the agricultural exception. Enrolled § 702 contains enactment-date effect, a general exclusion of pre-enactment cases, and the complete exceptions summarized in C068. Partial original authentication; complete selected enrolled clauses. C065–C069; S012. Published Statutes at Large original failed.
2005 revision Published § 1211 adds the specified “student” qualifier and changes the program definition from Parts B/D/E to any Title IV program. Complete published § 1501 supplies the 180-day general effect, pending-case exclusion, and listed enactment-date exceptions. Answered for selected adopted clauses. C070–C072; S013. No exhaustive entire-Act or later-history conclusion.
2020 temporary subsection Current notes record temporary (d) and its removal. Current body omits it. Notes state one-year removal trigger after December 27, 2020. Partial. C073–C074; S001, S014. Original addition/removal clauses failed; no CARES-program analysis or survival/retroactivity determination.

The dates in this table identify legal sources and their stated application rules. They are not dates assigned to any actual case, application, or adverse action.

M21 P.L. 109-8 § 1501(b)(2) Cases commenced on or after enactment for §§ 308, 322, 330 amendments. Inclusive “on or after”; not an exception naming § 1211. Other amendments and actual application held. C072.
M22 § 525 2020 compiled notes Enactment December 27, 2020; removal trigger one year after enactment. Original § 1001(c)(2) failed; this is reported as a compiled-note rule. No conversion into an actual calendar deadline. Original adopted clause and complete application history unresolved. C073.
M23 § 525(a) titles and references note PACA 1930; Packers and Stockyards Act 1921; appropriation Act approved July 12, 1943, for fiscal year ending June 30, 1944; former Act July 1, 1898; Higher Education Act 1965. Identifies referenced enactments. These dates are not universal commencement dates or waiting periods for § 525 protection. Complete incorporated regimes and their application histories not established. C031, C048, C059–C061.
M24 Complete § 525(a)–(c) No financial amount, percentage, damages schedule, or universal post-bankruptcy waiting period is specified in that body. Bounded absence statement only; history clauses, agricultural provisions, other law, and procedural limitations are separate. No general “no waiting period under any law” or remedy conclusion. C001, C050, C057, C076.

7. Conditional branches and branch-level coverage

These are qualitative legal categories. They contain no actual or invented person, employer, lender, application, transaction, or case. This table also supplies coverage status for each branch.

Branch; status Supported conditional rule and exact claims/sources Missing predicate or authority Adverse inference to avoid Next permissible generic public-law inquiry
B01 — Current version; partial Use the read (a)–(c) body with its declared cutoff. C001–C003, C074; S001. Unexamined law after compilation and judicial history. Access date proves exhaustive current law. Read any officially adopted § 525 change after the displayed cutoff, including its application clause.
B02 — Governmental-unit category; answered definition, application held Apply the complete § 101(27) category, not an ordinary public/private label. C011; S002(27). Actual legal constitution/classification; jurisdiction. Government funding or a public function alone proves coverage. Read the generic governing classification authority only if that category becomes necessary.
B03 — United States trustee qualification; answered boundary Preserve the exclusion while serving as trustee in a Title 11 case. C011; S002(27). Capacity and applicable legal theory absent. Every act associated with the title “trustee” has identical status. Read the narrow generic capacity and authority provision relevant to the asserted category.
B04 — Person versus individual; answered boundary (a)/(c) use person; (b) uses individual. The § 1102-only exception is not generalized. C007–C010, C037; S001–S002. Actual recipient category. Every entity can invoke the private-employment branch. Read only a necessary generic classification provision; retain § 101(41)’s limiting clause.
B05 — Association; partial The specified associated recipients are included, with the respective wording of (a), (b), and (c). C021, C025, C042, C045; S001. Meaning and actual association. A relationship label conclusively establishes protection or another party’s liability. Examine a generic public legal construction of “associated” only within a separately authorized scope.
B06 — Debtor status; answered definition, application held § 101(13) requires a commenced Title 11 case concerning the person/municipality. C006; S002. Actual status; § 109 eligibility if relevant. Hardship or an intention to file equals debtor status. Read the indispensable generic commencement/eligibility clause before stating its effect.
B07 — Former Bankruptcy Act; partial § 525 expressly retains former-Act debtor/bankrupt and discharge references. C026, C028, C061; S001, S008. Former-Act definitions, historical version, application chain. Former references can be ignored or modern definitions automatically substituted. Read the exact former-Act definition and original savings provision relevant to the legal category.
B08 — Chapter application; partial § 103, § 901, and § 1161 have different application lists; they were read. C019–C020; S004. Any particular chapter/status and external-protection construction. Every chapter has identical incorporation or automatic exclusion from every § 525-related protection. Read only the indispensable chapter-specific application/definition clause.
B09 — Similar grant; partial (a) names license, permit, charter, franchise, or similar grant. C022; S001(a). Legal meaning of similarity and actual object. Every government payment, loan, or contract is necessarily a similar grant. Seek a generic official construction of the category; judicial construction remains separately held.
B10 — Grant action; answered text, application held Denial, revocation, suspension, nonrenewal, conditioning, and discrimination respecting the grant are listed, with remaining predicates. C023, C025–C031; S001(a). Action, recipient, reason, causation, exception. One listed action alone proves a violation. Read the narrow public authority for any unresolved object or exception, without a record search.
B11 — Government employment; answered text Denial, termination, and discrimination respecting employment are expressly listed. C024, C029; S001(a). Actor, individual facts, causation, remedy. Express inclusion guarantees hiring or reinstatement. Examine only necessary generic employment-category or remedy authority.
B12 — Private employer; partial (b) requires the private-employer category and the protected individual/association conditions. C021, C037; S001(b). Employer and employment construction. Every nongovernmental adverse actor is a private employer. Read a narrow generic construction of the actor and relationship.
B13 — Private hiring wording; partial (b) lacks (a)’s separate denial-of-employment phrase. C038; S001(a)–(b). Judicial meaning and other-law protections. All private refusals to hire are lawful, or the omission has no legal significance. A separately scoped generic judicial-construction inquiry would be needed; no case query was made here.
B14 — Private termination/treatment; answered text (b) prohibits the listed employment conduct solely because of its specified reasons. C037–C042; S001(b). Actual act, protected recipient, reason, sole causation. Any unfavorable workplace treatment proves bankruptcy discrimination. Read the narrow public proof/process authority only if needed in a later component.
B15 — Independent reason/sole cause; partial (a)/(b) retain sole-cause language. C029, C042; S001. Actual reasons, pretext, evidentiary and causation standards. Stating an alternative reason proves compliance, or bankruptcy status proves causation. Examine generic official causation/proof authority within separately defined scope.
B16 — Nonpartnership insolvency; partial Debts must exceed fair-valued property with both specified exclusions. C015, C018; S002(32)(A). Values, intent, § 522 exemption chain. Low cash or debt alone establishes statutory insolvency. Read only the indispensable § 522 clause if an abstract exemption issue becomes material; no calculation.
B17 — Partnership insolvency; partial The aggregate includes the specified general-partner nonpartnership excesses. C016; S002(32)(B). Full classifications, exclusions, values. The ordinary entity test can simply be copied. Trace the exact incorporated exclusion and partnership category; no financial fact gathering.
B18 — Municipal insolvency; partial The due-debt alternatives and bona fide dispute qualification differ from the fair-valuation tests. C017, C020; S002, S004. Municipal classification, chapter/application law, facts. A municipal definition itself establishes § 525 protection in a particular setting. Read the necessary generic Chapter 9/category provision before any broader proposition.
B19 — Precommencement insolvency; answered sequence The protected insolvency reason includes the precommencement period. C027, C040, C046; S001. Legal insolvency and actual sequence. A fixed statutory lookback in days or years exists in § 525. Read any proposed additional temporal authority expressly; do not invent one.
B20 — During-case insolvency; answered sequence The period ends, for this ground’s wording, before grant or denial of discharge. C027, C030, C040, C046; S001. Case/discharge events; exact application. “Denied discharge” is omitted or treated as identical to granted discharge. Read the indispensable discharge-decision provision only if a generic category issue requires it.
B21 — Later status; answered boundary Present/past debtor-status wording is distinct from the insolvency period. C026, C030, C039; S001. Later action/reason and governing construction. Every protection automatically ends at discharge, or every later adverse result is prohibited. Examine the particular protected reason and action, then any necessary generic construction.
B22 — Qualifying unpaid debt; partial Preserve current-case dischargeability versus former-Act discharge. C028, C041, C046, C051; S001. Applicable chapter, § 523 chain, former-Act law; no debt facts. Every unpaid debt is protected, or § 525 itself discharges it. Read the exact necessary dischargeability clause and its incorporated definitions in a separate narrow inquiry.
B23 — PACA discharge termination; partial § 499d(a)’s final proviso has a bankruptcy predicate and a circumstances exception, including requested examination. C032, C034; S006. Category, circumstances, request, further PACA chain. Termination is universally inevitable or universally forbidden. Read necessary § 499a definitions and the relevant public procedural clause.
B24 — PACA refusal; partial § 499d(e)’s role, lookback, circumstances finding, and bond/assurance exception are cumulative as written. C033–C034; S006. Role, timing, findings, assurance and complete category law. Bankruptcy alone automatically permits refusal. Trace only the necessary statutory category and assurance authority, not an application.
B25 — Packers/1943 provision; partial § 525(a) preserves the named Acts; § 204 has notice/hearing, insolvency, order, and timing qualifications. C031, C035–C036; S001, S007. Definitions, § 193, entire relevant exception chain. Every agricultural actor is exempt from every § 525 branch. Read exact necessary 7 U.S.C. definitions and § 193 before extending the proposition.
B26 — Government student-program operator; partial Governmental status plus operation of the specified grant/loan program is required by this actor clause. C043, C048–C049; S001(c). Program authority and actual operation absent. Any government credit decision falls within (c). Read the exact public enabling provision for the generic program category.
B27 — Loan-making business category; partial The business must include making loans guaranteed or insured under a defined student loan program. C044, C048; S001(c). Qualifying activity and program/guarantee/insurance authority. Every creditor, guarantor, school, or education-related business qualifies. Trace the narrow statutory program and guarantee/insurance clauses.
B28 — Financing denial object/recipient; answered text, application held Listed objects and bankruptcy/association recipient conditions must coexist with actor and causal conditions. C045–C047; S001(c)(1). Object, recipient, reason, causation. Protection against a reason guarantees approval, terms, or another person’s liability. Read only the generic eligibility/terms provision needed to distinguish the separate question.
B29 — Title IV category; partial Current definition uses any Title IV program; old Parts B/D/E wording is not the current definition. C048–C049, C065, C070; S001, S012–S013. Complete program-specific Title IV chain. Every educational loan or every applicant is covered. Read the complete narrow Title IV program provision and definitions relevant to the category.
B30 — State/local similarity; partial The alternative requires a similar program operated under State or local law. C048–C049; S001(c)(2). Governing public program law and legal similarity. A matching label proves statutory similarity. Read only the generic State/local program authority if separately authorized.
B31 — “Because” in (c); partial Preserve the actual causal word without adding “solely.” C047; S001(c)(1). Governing judicial standard and actual proof. Textual difference alone establishes an automatic mixed-motive result. A separately scoped generic construction inquiry is required.
B32 — Ordinary new private credit; answered boundary The selected text supplies no universal new-private-credit entitlement; (c)’s specialized prohibition remains intact. C050; S001. Other credit laws, object/actor categories, facts. Every private credit denial is permitted or all credit is protected. Read only the distinct generic credit authority if a later component requires it.
B33 — 1978 original/savings; partial Credit and compiled amended transition clauses are readable; original body failed. C059–C061; S008–S009. Original § 525/§§ 401–403 and intervening transition amendments. Compiled notes equal direct original authentication. Reopen an ordinarily accessible official original publication, without a gate workaround.
B34 — 1984 effect/renumbering; partial Renumbering Act is directly read; original addition/effect Act remains failed. C062–C064; S010–S011. Original § 309 and original § 553 text. Wrong section number or a universal consumer waiting period. Read the original published §§ 309 and 553 and compare with the adopted renumbering.
B35 — 1994 version/application; partial Complete selected enrolled clauses distinguish addition, technical deletion, default application, and exceptions. C065–C069; S012. Published original comparison. Every amendment applies identically to every pending matter. Obtain the ordinarily readable published Act’s exact selected clauses.
B36 — 2005 version/application; answered selected text § 1211’s changes and complete § 1501 were directly read. C070–C072; S013. Actual case timing; exhaustive other-Act exceptions/later history. An enactment date alone determines every application, or 180 days is an applicant waiting period. Read only any specifically implicated additional application clause.
B37 — Historical (d); partial history, answered current organization Current body omits (d); compiled notes describe addition and one-year removal. C073–C074; S001, S014. Original § 1001(c) and temporal construction. Historical text is current, or removal proves no other relief exists. Read the exact original addition/removal clauses; keep underlying CARES remedies separate.
B38 — Immunity/cause/remedy; partial § 106 lists § 525 but limits effect and disclaims creation of a new substantive cause. C052–C057; S005. Underlying cause, jurisdiction, rules, fees, enforcement, judicial construction. Automatic money award, injunction, reinstatement, or universal waiver. Read the complete narrow remedy/process chain only in a separately bounded component.
B39 — Other law and A092 outcomes; excluded application Selected prohibitions do not settle actual liabilities, records, employment, credit, housing, insurance, or rebuilding outcomes. C050–C058, C076; S001–S005. All actual facts and other regimes. Silence authorizes conduct or guarantees life-after-resolution success. Define a separate generic public-law component before expanding.
B40 — Access failure; answered source limit A failed endpoint is unavailable evidence; recovered bodies are identified separately. C075; read/failure log. Unread original text and any missing dependencies. Failure means repeal, absence of protection, or permission to bypass a gate. Use an ordinary official alternative and preserve its actual status/read bounds.

Remaining gaps

Gap What is established What is not established Exact next generic inquiry
G01 — Original enactment authentication Current § 525; selected 2005 adopted text; 1984 renumbering Act; selected 1994 enrolled text; compiled historical notes. Complete direct original reads for the failed 1978, 1984, 1994, and 2020 publications. Read the exact failed selected clauses from an ordinarily accessible official publication and preserve format/status differences.
G02 — Later-law/currentness chain Official displayed compilation cutoff and actual access date. Exhaustive post-cutoff enactment, contingent-effect, judicial, or later-history certification. Examine only a materially implicated adopted change and its complete application clause.
G03 — Agricultural exceptions All named exceptions; complete selected §§ 499d, 499h, 204 bodies. Full definitions, regulatory implementation, proceedings, other incorporated provisions, and actual applicability. Read indispensable generic 7 U.S.C. category and procedural clauses before any extension.
G04 — Student-program incorporation Exact current § 525(c)(2) definition and adopted 2005 textual change. Complete Title IV program law, State/local similarity, program eligibility, underwriting, terms, or funding. Read a complete narrow program enabling/definition clause; no actual program or provider inquiry.
G05 — Insolvency and discharge predicates Complete selected § 101 definitions and exact § 525 reason wording. § 522-dependent exemption conclusions, actual insolvency, chapter-discharge scope, § 523 exceptions, former-Act discharge, or § 524 consequences. Separately scope the exact indispensable statutory dependency; no financial facts or case records.
G06 — Undefined terms and judicial construction Exact wording and textual differences. Controlling meaning of similar grant, association, private-employment hiring coverage, causation, immunity, and relief. A separately authorized generic legal-construction component; none was undertaken here.
G07 — Process and remedies Complete § 106 text, including its limits and no-new-cause clause. Actual cause, standing, forum, procedure, time bar, award, reinstatement, licensing or financing remedy. Read the complete narrow remedy/process authority and its incorporations before asserting a positive consequence.
G08 — Actual facts and A092 parent dimensions Conditional public-law categories only. Every actual actor, recipient, event, reason, relationship, debt, loan, employment action, outcome, and all remaining life-after-resolution issues. No factual inquiry is authorized by this worksheet or report. A different generic public-law component would require its own scope.

Researcher self-check — not independent review

R092-P1-C001Current § 525 is titled Protection against discriminatory treatment and contains (a), (b)(1)–(3), and (c)(1)–(2), within Chapter 5, Subchapter II.No current subsection (d) is printed in the operative body. Historical (d) must not be inserted into it.S001, complete body and Title 11 organization index.

R092-P1-C003The current body, source credit, editorial references, legislative-history excerpt, and application notes serve different functions.A historical report excerpt does not amend or override current enacted wording.S001, operative body versus separately headed notes.
R092-P1-C004Title 11’s construction rule makes may not prohibitory. It does not by itself supply a cause of action, forum, remedy, or proof of breach.S003, § 102(4).
R092-P1-C005“Includes” and “including” are nonlimiting; “or” is not exclusive; singular includes plural.Express exclusions and particular subsection conditions still control. These construction rules do not erase § 525’s actor/action/reason requirements.S003, § 102(3), (5), (7)–(8).
R092-P1-C006A debtor under § 101(13) is a person or municipality concerning which a Title 11 case has commenced.Financial difficulty alone does not establish that defined status. Eligibility to commence a case is a different inquiry.S002, § 101(13).
R092-P1-C007Person includes an individual, partnership, and corporation, but generally excludes a governmental unit. This is not interchangeable with § 525(b)’s narrower word individual.S002, § 101(41); S001(b).
R092-P1-C008The governmental-unit exceptions in § 101(41) concern acquiring an asset through a loan guarantee or as receiver/liquidating agent; guaranteeing specified debtor/affiliate pension benefits; or owning assets of the specified governmental pension/deferred-compensation plans. The concluding clause treats the governmental unit as a person for § 1102, and only respecting the asset or benefit. It is not a general governmental-unit inclusion for § 525. The tax-plan and committee regimes are not independently analyzed.S002, § 101(41)(A)–(C), concluding clause.
R092-P1-C009Corporation includes the specified corporate-privilege association, capital-only-liability partnership association, joint-stock company, unincorporated company/association, and business trust; it excludes a limited partnership. The detailed association qualifications remain necessary. No actual organizational classification is made.S002, § 101(9)(A)(i)–(v), (B).
R092-P1-C010Entity includes person, estate, trust, governmental unit, and United States trustee.A broader defined entity is not automatically a “person” or “individual” for each § 525 branch.S002, § 101(15).
R092-P1-C011Governmental unit includes the United States; State; Commonwealth; District; Territory; municipality; foreign state; their specified departments, agencies, or instrumentalities; and other foreign or domestic government. The definition expressly excludes a United States trustee while serving as trustee in a Title 11 case from the stated federal category. Definition alone does not resolve jurisdiction, immunity, or territorial application.S002, § 101(27).
R092-P1-C012A municipality is a political subdivision, public agency, or instrumentality of a State. “State” includes the District of Columbia and Puerto Rico, subject to the exception concerning who may be a Chapter 9 debtor. The Chapter 9 exception is retained; it is not a universal exclusion of those jurisdictions from Title 11 terminology.S002, § 101(40), (52).
R092-P1-C013Claim includes a right to payment whether reduced to judgment or not, liquidated or unliquidated, fixed or contingent, matured or unmatured, disputed or undisputed, legal or equitable, secured or unsecured. It also includes an equitable breach remedy giving rise to payment, with the separately listed judgment/fixed/contingent/maturity/dispute/security alternatives.A label or asserted obligation does not establish the existence, amount, validity, or dischargeability of such a right.S002, § 101(5)(A)–(B).
R092-P1-C014Debt means liability on a claim. The definition does not establish an actual liability or make every debt dischargeable.S002, § 101(12).
R092-P1-C015For an entity other than a partnership or municipality, § 101(32)(A) defines insolvency through debts greater than property at fair valuation, excluding property transferred/concealed/removed with the specified intent and property potentially exemptible under § 522.Both exclusions matter. No valuation, intent, exemption, or actual insolvency finding is made.S002, § 101(32)(A)(i)–(ii).
R092-P1-C016Partnership insolvency compares debts with the fair-valued aggregate of partnership property, excluding the specified fraud-related property, plus the sum of each general partner’s nonpartnership-property excess over nonpartnership debts, with the stated property exclusions. No missing value, aggregation convention, or § 522 determination is supplied.S002, § 101(32)(B)(i)–(ii).
R092-P1-C017Municipal insolvency uses alternatives: generally not paying debts as they become due, unless those debts are subject to a bona fide dispute; or inability to pay debts as they become due. This category-specific definition is not a general test for every debtor, and does not resolve § 525’s chapter/recipient application.S002, § 101(32)(C)(i)–(ii).
R092-P1-C018The insolvency definition cannot be replaced by an ordinary description of hardship, low income, delinquency, or an unaffordable payment.§ 522’s incorporated exemption rules and all factual valuations remain held.S002, § 101(32); C015–C017.
R092-P1-C019§ 103(a) applies Chapters 1, 3, and 5 in Chapter 7, 11, 12, or 13 cases, subject to § 1161. The current § 1161 exclusion list does not list § 525.This is a chapter-application statement, not a finding about any case or railroad category.S004, § 103(a); entire § 1161.
R092-P1-C020Chapter 9 and Chapter 15 have separate application structures. § 901(a)’s incorporation list and § 103(a)’s Chapter 15 list do not list § 525.That observation is not converted into a complete determination of external post-bankruptcy protection, municipal status, foreign proceedings, or constitutional rights.S004, § 103(a), (f); § 901(a)–(c).
R092-P1-C021§ 525 does not itself define “private employer,” “employment,” “associated,” or “other similar grant.”No ordinary label, family link, ownership link, or employment label is treated as completing their legal construction.S001, complete body.

R092-P1-C022§ 525(a) identifies a license, permit, charter, franchise, or other similar grant.“Similar” is a condition; the list is not silently expanded to every government benefit, contract, payment, or financing decision.S001(a), grant-object clause.
R092-P1-C023For those grants, the listed actions are denial, revocation, suspension, refusal to renew, conditioning, and discrimination respecting the grant.Protected recipient, specified reason, sole-cause language, and agricultural exceptions remain cumulative.S001(a), action clauses.
R092-P1-C024The governmental-employment language expressly includes denial of employment, termination, and discrimination respecting employment. It does not establish that every adverse employment result was caused by a protected reason.S001(a), employment clauses.
R092-P1-C025Subsection (a) protects the specified present/former debtor or bankrupt person, and another person with whom that debtor/bankrupt has been associated. The protected-reason inquiry refers to the specified debtor/bankrupt. Association and its legal scope are not established by a label.S001(a), recipient and association clauses.
R092-P1-C026The status ground covers being or having been a Title 11 debtor, or a bankrupt/debtor under the former Bankruptcy Act.A grant of discharge is not written as a prerequisite to this status ground. Former-Act classification remains a separate historical question.S001(a), first reason clause.
R092-P1-C027The insolvency ground concerns insolvency before commencement of the Title 11 case, or during it before the debtor is granted or denied discharge. The temporal words qualify the insolvency ground; actual commencement and discharge events are absent.S001(a), insolvency clause.
R092-P1-C028The nonpayment ground distinguishes a debt dischargeable in the Title 11 case from a debt discharged under the former Bankruptcy Act.It does not say that every unpaid debt qualifies, or that current-Code dischargeability and former-Act discharge are interchangeable.S001(a), final clause.
R092-P1-C029Subsection (a) uses solely because for the specified bankruptcy, insolvency, or nonpayment reason.Actual causation, independent reasons, pretext, evidentiary standards, and mixed-reason adjudication are not resolved.S001(a), causal connector and reason series.
R092-P1-C030The grant-or-denial-of-discharge endpoint is attached to the insolvency wording, not expressed as a universal termination of every § 525 protection. No indefinite universal protection or actual post-discharge result is inferred either.S001(a), (b)(1)–(3), (c)(1).
R092-P1-C031Subsection (a) expressly preserves what is provided in PACA, the Packers and Stockyards Act, and § 1 of the specified July 12, 1943 Agriculture appropriation Act.This is not an unqualified exemption for all agricultural actors or all their actions. The wording is located in (a); it is not silently copied into other subsections.S001(a), opening exception; references note.
R092-P1-C032PACA § 499d(a)’s final proviso contains bankruptcy-discharge-related license termination language, but also a circumstances exception. The Secretary must examine those circumstances if the licensee requests it.The statutory predicate concerns the licensee, or a partner when the licensee is a partnership; the exception concerns a finding that the bankruptcy circumstances do not warrant termination. No actual status or result is established.S006, § 499d(a), final proviso.
R092-P1-C033§ 499d(e) permits refusal where the specified applicant, general partner, corporate officer, or holder of more than 10% of stock has the stated bankruptcy connection within three years before application, and the Secretary finds the circumstances warrant refusal, unless the prescribed bond or satisfactory assurance is furnished. It also covers the specified role in a partnership/corporation adjudicated or discharged bankrupt. All role, timing, finding, and assurance predicates matter. No actual licensing conclusion follows.S006, entire § 499d(e).
R092-P1-C034Other § 499d licensing grounds and its § 499h employment cross-reference have distinct conditions. The complete selected bodies were read, but PACA category definitions, appeals, related provisions, and implementation were not fully traced. The complete agricultural exception remains partial, not a blanket authorization.S006, § 499d(b)–(d); § 499h(a)–(e).
R092-P1-C035Under the relevant § 204 clause, after due notice and hearing, a Secretary’s finding that a registrant is insolvent or violated the chapter permits suspension for a reasonable specified period. The next sentence says the order takes effect “within not less than five days,” unless suspended, modified, or set aside by the Secretary or a competent court. The quoted timing is not converted into a service-based deadline or an application instruction. Registrant definitions, counting, and procedural implementation remain held.S007, first paragraph’s suspension clause and second paragraph.
R092-P1-C036§ 204 separately addresses an insolvent packer through notice/hearing and an order under § 193 concerning livestock purchases while insolvent, including purchases under prescribed conditions.§ 193 and the category definitions were not fully read. Neither this clause nor § 204 exhausts the separately named Packers and Stockyards Act exception.S007, final paragraph; S001(a).

R092-P1-C037Subsection (b) regulates a private employer and protects the described individual, including an associated individual. It does not use the broader recipient word “person” found in (a) and (c). No actual employment relationship is established.S001(b), introductory clause.
R092-P1-C038Subsection (b) lists employment termination and discrimination respecting employment; it omits (a)’s separate phrase denying employment. This verifies a textual difference. It does not establish a categorical rule that every private refusal to hire is allowed, or settle the judicial meaning of discrimination respecting employment.S001(a), (b), compared.
R092-P1-C039Subsection (b)(1) identifies present/past Title 11 debtor status and former-Act debtor/bankrupt status.Status is a reason category, not actual proof of the reason for an employment act.S001(b)(1).
R092-P1-C040Subsection (b)(2) identifies insolvency before case commencement, or during the case but before grant or denial of discharge. The legal insolvency definition and temporal predicates remain necessary.S001(b)(2); S002(32).
R092-P1-C041Subsection (b)(3) identifies nonpayment of a debt dischargeable in a Title 11 case or discharged under the former Act.No dischargeability or nonpayment fact is established.S001(b)(3).
R092-P1-C042The introductory solely because qualification governs (b)’s listed grounds and associated-individual protection. The underlying reason is the debtor/bankrupt’s specified status, insolvency, or nonpayment. Actual association and causation remain unknown.S001(b), introductory clause and (1)–(3).
R092-P1-C043The governmental actor in (c)(1) must operate a student grant or loan program.Governmental status alone does not establish this particular program-operator predicate.S001(c)(1), first actor clause.
R092-P1-C044The other actor category is a person engaged in a business that includes making loans guaranteed or insured under a student loan program. It is not every private lender, guarantor, school, creditor, or business merely associated with education. Business activity and program/guarantee/insurance predicates remain necessary.S001(c)(1), second actor clause.
R092-P1-C045The listed denial objects are a student grant, loan, loan guarantee, or loan insurance, to a person with the specified bankruptcy status or associated person.A loan guarantee or insurance category is not a determination of another person’s liability. A protected denial reason is not approval of terms or eligibility.S001(c)(1), denial and recipient clauses.
R092-P1-C046Subsection (c)(1) repeats the bankruptcy-status, temporally qualified insolvency, and precisely differentiated nonpayment grounds. It retains the period before grant or denial of discharge and the current-Code dischargeable versus former-Act discharged distinction.S001(c)(1), complete reason series.
R092-P1-C047Subsection (c)(1) says because, without the word solely used in (a) and (b).No judicial burden-of-proof, mixed-motive, or causation formula is derived from that difference in this text-only pass.S001(a), (b), (c)(1).
R092-P1-C048The defined student loan program is any program operated under Title IV of the Higher Education Act of 1965, or a similar program operated under State or local law. Both the source-of-law and similarity language are retained. A generic education or loan label does not establish either alternative.S001(c)(2).
R092-P1-C049The definition says “In this section,” not merely “in this paragraph.”Full Title IV program provisions and any State/local similarity analysis were not read. Program-specific coverage and eligibility therefore remain held; the definition is not a finding about a real program.S001(c)(2); references note.
R092-P1-C050Section 525 contains specified prohibitions, including a specialized financing provision; it does not state a universal entitlement to new private credit, a particular loan term, funding, or approval. This bounded conclusion does not declare all other denials lawful, determine “similar grant,” or resolve other credit laws.S001, complete (a)–(c).
R092-P1-C051Section 525’s nonpayment language depends on dischargeability or former-Act discharge; it does not itself adjudicate either or issue a discharge. The necessary chapter-discharge and § 523 chains, actual discharge orders, and § 524 effects remain held.S001(a), (b)(3), (c)(1).

R092-P1-C052Section 106(a) expressly lists § 525 among provisions for which governmental-unit sovereign immunity is abrogated to the extent set forth in § 106.It is not an unqualified immunity waiver for every claim, actor, forum, or remedy. Constitutional/judicial construction is unexamined.S005, § 106(a), (a)(1).
R092-P1-C053Section 106(a)(2)–(3) addresses court determination and orders/process/judgments, including money recovery but excluding punitive damages under that clause; costs/fees must conform to the incorporated 28 U.S.C. § 2412(d)(2)(A) limits. The complete incorporated fee and procedural chains were not read. No award, damages entitlement, fee amount, or actual cause of action is established.S005, § 106(a)(2)–(3).
R092-P1-C054Enforcement under § 106(a)(4) must be consistent with appropriate nonbankruptcy law; a money judgment against the United States has the stated district-court-judgment payment treatment.Appropriate enforcement/payment authorities were not traced. No collection or payment outcome follows.S005, § 106(a)(4).
R092-P1-C055Section 106 expressly does not create a substantive claim for relief or cause of action not otherwise existing under the identified law or rules.Listing § 525 in § 106 does not alone complete a remedy chain.S005, § 106(a)(5).
R092-P1-C056Sections 106(b) and (c) separately address a governmental proof of claim, estate-property claims, same-transaction/occurrence conditions for the specified waiver, and an estate-claim offset. No proof of claim, estate claim, transaction, or offset predicate is supplied. These routes are not treated as necessary facts or available remedies in an actual § 525 matter.S005, complete § 106(b)–(c).
R092-P1-C057Actual standing, jurisdiction, procedural vehicle, proof, limitation, enforcement competence, relief, and judicial construction remain unresolved.Section 525’s prohibition cannot substitute for those unexamined authorities. No automatic reinstatement, license, financing, damages, injunction, cancellation, or contract invalidity is found.S001, complete body; S005(a)(2)–(5).
R092-P1-C058The historical/revision note on the § 525 page is legislative explanation, not the present operative text. Its broader description, historical references, and discussion of further judicial development are not adopted as current holdings or as a substitute for the express agricultural exceptions. No referenced opinion was investigated.S001, historical/revision note compared with current (a)–(c).

R092-P1-C059The current source credit identifies original § 525 with P.L. 95-598, November 6, 1978, 92 Stat. 2593.The original enactment body was not successfully opened. An exact original-to-current word comparison is therefore incomplete.S001 source credit; S009 failure.
R092-P1-C060The official front matter reproduces § 402 as amended: an October 1, 1979 general effective date, subject to the stated title-level exceptions; separate treatment of Title II amendments and specified sections is retained. This compiled amended transition provision is not represented as an original 1978 read. Intervening transition amendments were not all opened.S008, complete displayed § 402(a)–(e).
R092-P1-C061The compiled § 403(a) preserves former-Act case administration and substantive rights, with the separate qualifications in (b)–(e).The complete displayed savings provision was read; railroad, retirement, criminal-law, and fund/fee qualifications were not applied. Former-Act definitions and an actual historical case remain unresolved.S008, complete displayed § 403(a)–(e).
R092-P1-C062The current amendment note records that the 1984 Act designated the existing text as (a), inserted the article before PACA’s title, and added (b).This is a verified compiled-note finding; the original § 309 publication failed.S001, 1984 amendment note; S010.
R092-P1-C063The compiled 1984 application clause uses 90 days after July 10, 1984, with exceptions for § 426(b) and subtitle J.The exact “effective to cases filed” wording is preserved; it is not converted into a consumer waiting period or actual case-date calculation.S002, complete reproduced § 552(a)–(c).
R092-P1-C064P.L. 98-531 § 1 struck the earlier § 552 and redesignated § 553 as § 552. Its § 3 makes the Act effective July 10, 1984 except for § 2 amendments, assigned March 31, 1984.This renumbering/effect Act was directly read. It does not cure failure to read P.L. 98-353 § 309 or its original effective clause.S011, §§ 1–3, printed 2704/index 0.
R092-P1-C065The official 1994 enrolled § 313 adds (c), including both actor categories and a then-definition limited to programs under Parts B, D, or E of Title IV, or a similar State/local program.Historical wording; current (c)(2) is broader after the 2005 amendment. Original published Act comparison remains incomplete.S012, complete § 313, enrolled pp. 35–36/indices 34–35.
R092-P1-C066The enrolled § 501(d)(15) removes the parenthetical Code/Statutes citations after the agricultural references in (a).It does not direct deletion of the named Acts or exception itself.S012, § 501(d) command and (d)(15)(A)–(C), pp. 38, 40/indices 37, 39.
R092-P1-C067The enrolled § 702(a), (b)(1) sets enactment-date effect, subject to (b), and generally excludes cases commenced before enactment.The selected § 525 amendments are not listed among § 702(b)(2)’s exceptions. Actual case application remains absent.S012, § 702(a), (b)(1)–(2); S001/S002 identifying October 22, 1994.
R092-P1-C068The complete § 702(b)(2) exceptions concern § 111; §§ 113 and 117 before/on/after enactment; specified § 1110 leases connected with settlements in cases pending at enactment; and § 305 agreements entered after enactment. Those other substantive regimes and the incorporated lease definition were not applied. Their presence prevents an unqualified statement that the whole Act has one application rule.S012, § 702(b)(2)(A)–(D).
R092-P1-C069Enrolled § 701 provides severability if a provision/amendment or its application is held unconstitutional, preserving the specified remaining provisions and applications. No constitutional holding or actual severability question is established.S012, complete § 701.
R092-P1-C070Published 2005 § 1211 inserts student at the specified grant reference in (c)(1) and replaces the Parts B/D/E restriction in (c)(2) with any program operated under Title IV.These are adopted textual changes, not proof that every educational loan or applicant is covered.S013, complete § 1211(1)–(2), 119 Stat. 194/index 171.
R092-P1-C071Published § 1501(a), (b)(1) generally provides effect 180 days after enactment, and excludes cases commenced before that effective date, subject to its express “otherwise provided” qualifications.Enactment was April 20, 2005. No actual calendar deadline or case application is calculated.S013, § 1501(a), (b)(1), 119 Stat. 216/index 193.
R092-P1-C072Section 1501(b)(2) applies amendments made by §§ 308, 322, and 330 to cases commenced on or after enactment.Section 1211 is not in this listed exception. The other amendments are not substantively investigated here.S013, complete § 1501(b)(2).
R092-P1-C073Current § 525 notes report that P.L. 116-260 added temporary (d), concerning the cited CARES Act relief, and removed it effective one year after December 27, 2020.The original § 1001(c)(1)–(2) could not be read. Its full adopted text/application is therefore not independently authenticated here. No underlying CARES entitlement is evaluated.S001, 2020 amendment/effective notes; S014 failure.
R092-P1-C074Current (a)–(c), rather than the historical (d), are the directly read § 525 body. This does not certify the absence of unexamined later enactments, judicial changes, or application issues beyond the declared compilation.S001, body and currency; C002, C073.
R092-P1-C075Access failures were source-specific; some current Code endpoints later became readable, while identified original enactment endpoints remained unreadable.Failure is not repeal, absence of protection, or proof about a model, quota, or security condition.Source/failure log below.
R092-P1-C076The investigation supports conditional statutory distinctions, not an actual actor classification, violation, remedy, approval, financial outcome, or resolution of other law.All individual facts and remaining A092 dimensions stay held. Silence in this selected law is not authorization under every other law.S001–S005, read bounds; C021, C050–C058, C074–C075.

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
