R038 — Targeted Evidence Supplement
SettleADebt.com · Area A038 Consumer Bankruptcy · Baseline October 22, 2026, America/Los_Angeles · Scoped supplement to the original 38-source, 74-claim, 59-coverage-row investigation
1. Confirmed findings and evidence status
The DOJ's February 17, 2026 notice confirms that designation of Chapter 7 and Chapter 13 cases for debtor audits resumed effective February 20, 2026, after a suspension of new audit designations in June 2025. The separate statutory duty to cooperate with an applicable audit should not be confused with a claim that every bankruptcy petition is audited. United States Department of Justice+1
The U.S. Courts pending-amendments page identifies Bankruptcy Rules 1007, 3018, 5009, 9006, 9014, 9017 and new Rule 7043 in the December 1, 2026 package. At the October 22 baseline, these are future-effective amendments, not rules already operative merely because the Supreme Court transmitted them. The same page separately identifies changes to Official Forms 101 and 106C scheduled for December 1, 2026. uscourts.gov+1
The CFPB's official withdrawn-guidance list includes its 2023-01 bulletin concerning unfair billing and collection after bankruptcy discharge of certain student loans, withdrawn May 12, 2025. That withdrawal affects the bulletin's guidance status; it does not repeal the Bankruptcy Code's discharge injunction or the Fair Debt Collection Practices Act. Consumer Financial Protection Bureau
The coordinator's subsequent official-source verification also resolves the selected current petition-fee arithmetic:
| Chapter |
Statutory base |
Administrative fee |
Trustee fee |
Current total |
| Chapter 7 |
$245 |
$78 |
$15 |
$338 |
| Chapter 13 |
$235 |
$78 |
$0 |
$313 |
These totals apply to the selected October 22, 2026 fee baseline, not automatically to the future December 1 schedule. The original statutory and administrative source identities R038-S013 and R038-S012 remain intact.
2. Recovered source register — nine original identities
Access convention: “Opened” means the actual page or document was retrieved and its relevant passage read in this supplement. “Discovery only” means a source was identified without verification of the necessary underlying proposition. All new live retrievals below occurred on October 22, 2026 Pacific. Historical source IDs are preserved.

DOJ USTP, USTP to Resume Debtor Audits, notice dated February 17, 2026; Debtor Audit Information, introductory paragraphs and February 2026 notice |
Federal Chapter 7/13; designation resumed February 20, 2026 |
Opened/read. Actual official notice recovered. July standards are separately covered by S006–S008, not by the audit-resumption notice. |
| R038-S020 |
CFPB, How long does information stay on my credit report?, “Negative information,” lines 34–44 |
Last reviewed September 2, 2026; federal consumer-reporting explanation |
Opened/read. Confirms generally seven years for most negative information and up to ten years for bankruptcy, subject to stated exceptions. Underlying FCRA remains original S019. |
| R038-S022 |
CFPB, Can a debt collector try to collect on a debt that was discharged in bankruptcy?, lines 20–27 |
Last reviewed August 24, 2022; page modified March 12, 2024; federal agency guidance |
Opened/read. Supports general stay/discharge explanation and surviving collateral rights, but does not establish every statutory exception. Withdrawn-guidance review performed separately. |

| R038-S036 |
Alabama Code §6-10-11 (2025), Justia, lines 45–68, especially 60–65 |
Alabama; 2025 secondary statutory presentation |
Opened/read. Text excludes federal §522(d) exemptions for qualifying Alabama bankruptcy cases. Current official state codification remains unverified. |
| R038-S037 |
Arkansas Code §16-66-217 (2025), Justia, lines 45–69, especially 59–65 |
Arkansas; 2025 secondary statutory presentation |
Opened/read. Text provides an election between state exemptions and federal §522(d), subject to applicable federal eligibility rules. Current official state codification remains unverified. |
The recovered S020 page has the exact September 2, 2026 review date. S022 is an older CFPB consumer explanation; describing it as newly updated in 2026 would be incorrect. Consumer Financial Protection Bureau+1
2.1 S031 and S033 — precise unresolved identities
For S031, an unspecified California bankruptcy opinion is not a usable case citation. The next retrieval must identify the case caption, docket or reporter citation, issuing court, decision date and the exact §522 holding. Current California exemption-election law requires independent statutory verification; a historical decision cannot substitute for it.
For S033, the exact AllLaw article and its complete list remain unverified. Even a recovered secondary list would be discovery material, not sufficient proof of current election rights across all states. This supplement makes no nationwide exemption-election classification.

3.1 February 25, 2025 erratum — exact correction
The Judicial Conference correction to the February 4, 2025 notice states:
- On page 8942, second column, final table line: $25,700 is corrected to $27,750.
- On page 8942, third column, second line from the bottom: $27,750 is corrected to $25,700.
These are positional corrections to two table entries. The erratum does not establish that the previously checked §707 consumer means-test figures are wrong. The corrected entries must be mapped to their original table labels before any venue-specific amount is republished. federalregister.gov
3.2 Future-effective authority — source discrepancy
The Southern District of Georgia announcement is headed “Effective December 1, 2026,” but one sentence inside it says December 1, 2025. That sentence conflicts with the heading, publication date and national pending-amendments page. It should be treated as an apparent date error, not independent evidence of a 2025 effective date.
The U.S. Courts national page is the stronger source for the scheduled 2026 package. It expressly cautions that pending amendments may be delayed or withdrawn. United States Bankruptcy Court+1

The PDF's note expressly limits item 14's change to the additional direct-appeal component, not the ordinary notice-of-appeal fee.
Importantly, items 8 and 9, which support the selected current administrative and Chapter 7 trustee components, are not listed among these adjustments. The reviewed announcement therefore does not support changing the $338/$313 petition totals on December 1. A later operative nationwide schedule still requires confirmation.

6. Publication holds and researcher self-check
Publication holds remain for the unidentified S031 judicial decision, the unidentified S033 AllLaw article, current official Alabama and Arkansas codification, complete December 2026 rule/form texts, operative future fee schedules, and the precise original table labels affected by the February 2025 erratum.
The CFPB withdrawal review adds a separate editorial safeguard: do not cite withdrawn Bulletin 2023-01 as current agency guidance. Equally, do not suggest that its withdrawal authorizes collecting discharged debts.
This supplement directly opened the DOJ audit notice, CFPB consumer pages and withdrawn-guidance list, Federal Register correction, U.S. Courts pending-amendments index, Georgia bankruptcy-court announcement and fee PDF, and the two Justia code presentations. Selected fee, rule and DOJ dataset findings from the coordinator remain attributed subsequent reuse, not independent original-access proof.
Of the nine source identities, seven now have recovered and opened supporting documents; two remain unresolved at the precise source-identity level. Some of the seven are only partially verified for final legal publication, as identified above.
No model fallback was invoked or independently verified. This is a researcher self-check, not an independent review of the full R038 investigation. No external publication, outreach, account change, private borrower access or local-library write was performed.
