SettleADebt R004 PASS-03

Federal closed-end prepayment, unearned-interest refunds, and sum-of-digits/actuarial comparisons

The federal refund duty, the restriction on the refund method, and the duty to disclose prepayment terms are separate rules. Under the text read, 15 U.S.C. §1615(a) requires a prompt refund of unearned interest when its full-prepayment trigger is met, subject to its less-than-$1 exception. Section 1615(b) imposes an additional actuarial-method floor for specified precomputed transactions exceeding 61 months and consummated after September 30, 1993. That threshold is not a general permission to use Rule of 78s on shorter transactions, and neither provision establishes a universal right to make a partial principal payment. uscode.house.gov

Regulation Z’s prepayment disclosures identify whether a penalty or rebate applies under the relevant branch. They do not themselves establish that a charge is lawful, supply a complete payoff calculation, or determine every consequence of an extra payment. The applicable legal obligation and other applicable law remain necessary. ecfr.gov+2

Actual research date: October 27, 2026, America/Los_Angeles. Clock observations bracketed this pass from 2:26:28 p.m. through 2:36:14 p.m. PDT—21:26:28 through 21:36:14 UTC. Source-check dates below refer to that date, not to a document’s effective date.

Foundation and result status

Item Treatment in this pass
Reviewed P01 mathematics Preserved as user-supplied reviewed premises. The six models and their schedules were not rerun.
Reviewed P01 extra-principal comparison Retained: modeled interest falls from $661.86 to $491.29, saving $170.57, under the stipulated original convention and allocation assumptions. This remains a model result.
Reviewed P02 Preserved. No Appendix J image-placeholder recovery routes were repeated.
Current legal APR Still held. This pass does not establish current Appendix J equation identity, resolve the prior edition/amendment gap, or relabel any numerical root as a legal APR.
New work Complete §1615 body and notes read; relevant disclosure rules and commentary read; official generic allocation explanations read; eight worked branches supplied, including a new finite-payment arithmetic comparison.
Actual prepayment/refund/charge determination Unresolved and not approved. No actual transaction, contract, payoff, refund award, fee, eligibility, or release determination was made.
Review and provenance This is a researcher self-check, not independent review. The prior coordinator reviews are reused as described by the user. I have not verified unseen UI model family or power settings.

2. Atomic claim table: federal statutory triggers

Area A004 applies to every claim in this report. “Established” below means supported at the stated general level and within the source/version bounds; it does not mean an actual transaction satisfies the predicates.

Claim ID Exact assertion Source and pinpoint Conditions, status, jurisdiction, and limits
R004-P3-C001 P01’s reviewed models and P02’s legal-APR hold remain unchanged. S013; current user-supplied foundation. Reviewed reuse. No new acceptance or rerun.
R004-P3-C002 §1615 was enacted through §933 of the 1992 Housing and Community Development Act, not as part of the Consumer Credit Protection Act itself. S001/S002, source credit and codification note. Established federal source fact. Enactment date is October28,1992; historical applicability is not inferred solely from that date.
R004-P3-C003 The incorporated consumer concept concerns a natural person and primarily personal, family, or household purposes. S001 §1615(d)(2); S003 §1602(i). Established definition. Not every debt or business-purpose transaction qualifies.
R004-P3-C004 The ordinary statutory creditor definition requires regular extension of qualifying consumer credit and initial-payee status, with statutory special cases. S003 §1602(g), complete paragraph. Established definition. Finance charge or agreement for more than four installments is relevant. No actual actor classification made.
R004-P3-C005 For §1615, creditor also includes an assignee and subsequent assignee of the described consumer credit. S001 §1615(d)(3)(A)–(B). Established federal inclusion. Do not stop at §1602’s original-payee wording.
R004-P3-C006 When a consumer prepays in full the financed amount under the covered consumer credit transaction, §1615(a)(1) requires the creditor promptly to refund unearned interest. S001 §1615(a)(1); S002 same provision. Established conditional duty. It concerns unearned interest, not an automatic refund of every finance-charge component. “Promptly” is not converted here into a numerical refund deadline.
R004-P3-C007 The subsection (a)(1) refund is not required by that provision when the total refund would be less than $1. S001 §1615(a)(2). Established exception. Exactly $1 is not “less than $1.” Other law or contract may provide more.
R004-P3-C008 Subsection (a) applies to the described full prepayment regardless of manner or reason, expressly including refinancing, consolidation, restructuring, and prepayment resulting from acceleration. S001 §1615(a)(3)(A)–(B). Established conditional scope. Acceleration or restructuring without the required prepayment is a different factual branch.
R004-P3-C009 For the required refund on a precomputed consumer credit transaction with a term exceeding 61 months, consummated after September30,1993, the method must be at least as favorable to the consumer as the actuarial method. S001 §1615(b). Established conjunctive test. The transaction term, date, structure, and refund trigger all matter.
R004-P3-C010 The express 61-month/date restrictions occur in subsection (b), not in the wording of (a) or (c); their failure does not establish permission to use Rule of 78s or a universal prepayment right. S001 §1615(a)–(c), read together. Textual inference. Earlier-transaction retroactivity and other applicable restrictions remain unresolved.
R004-P3-C011 For the specified request concerning a precomputed consumer credit account, the creditor or assignee must provide the full-prepayment amount and identify a required refund included in that amount before the end of the statutory five-day period beginning with receipt. S001 §1615(c)(1)(A)–(B). Established conditional statement duty. Oral or written request; no actual request or deadline calculated. This is not the refund deadline in (a).
R004-P3-C012 A written request under subsection (c) requires a written statement. S001 §1615(c)(2). Established. No assertion that every oral request requires a written response under this clause.
R004-P3-C013 The consumer is entitled to one subsection (c)(1) statement each year without charge. S001 §1615(c)(3). Established. No invented calendar-year interpretation or actual entitlement determination.
R004-P3-C014 Additional statements may carry a reasonable cost-covering fee if its amount is disclosed before furnishing the statement. S001 §1615(c)(4). Established statutory conditions. No dollar cap or actual fee approval inferred; other applicable restrictions remain relevant.
R004-P3-C015 The statutory actuarial definition applies a payment first to accumulated finance charge, subtracts a remainder from unpaid amount financed, and adds a deficiency to that unpaid balance. S001 §1615(d)(1), complete definition. Established definition. Allocation description only; not a freestanding authorization for servicing capitalization.
R004-P3-C016 That definition does not itself specify the complete rate-selection, day-count, off-cycle timing, or rounding rules needed to calculate an actual refund. S001 §1615(d)(1); S009’s expressly conditional generic examples. Read-boundary finding. No Appendix J formula is substituted for those missing inputs.
R004-P3-C017 No separate generally applicable implementing refund formula was established in the bounded official-source investigation. §1026.18 commentary references §1615(d) for disclosure/classification purposes. S001 complete section; S006 comment18(k)(2)-1.i.A; discovery/read log below. Partial research result, not proof that no other implementing or product-specific authority exists.
R004-P3-C018 TILA/Regulation Z exemption screens and §1615’s own predicates must be kept distinct; the complete effect of every TILA exemption on separately enacted §1615 is not resolved here. S001 codification note and (d); S003 §1603; S008 §1026.3. Applicability hold. No automatic importation of a dollar, product, or actor exemption into §1615.

A detail preserved from the literal read: §1615(d)(2)’s heading refers to “Consumer, credit,” while its operative sentence imports consumer and creditor. This report follows the operative sentence and subsection (d)(3); it does not silently rewrite the statute. uscode.house.gov

What the 61-month rule does—and does not—decide

A stipulated 62-month precomputed transaction consummated October1,1993 passes the term/date portion of §1615(b). A 61-month transaction does not. A 62-month transaction consummated September30,1993 does not satisfy “after” that date. These comparisons do not decide the other predicates, any more protective law, or whether a particular prepayment is contractually permitted.

Likewise, the relevant term cannot simply be replaced with the number of payments remaining when an early payment is contemplated. A modification, refinancing, or disputed consummation date requires its own legal characterization. The report does not resolve historical application merely because the current compiled section lacks an additional date limitation in (a) or (c). C009–C010; S001.

3. Atomic claim table: disclosures, classifications, and contract control

The statutory disclosure foundation is §1638(a)(11), with a contract-reference requirement in (a)(12). Regulation Z then supplies the operative disclosure branches and commentary. uscode.house.gov

Claim ID Exact assertion Source and pinpoint Conditions, status, jurisdiction, and limits
R004-P3-C019 §1638(a)(11) distinguishes the rebate statement for precomputed finance charges from the penalty statement for charges computed periodically on unpaid principal; (a)(12) calls for a contract reference. S004 §1638(a)(11)–(12). Established federal disclosure framework. Not substantive permission to impose a penalty.
R004-P3-C020 §1026.18 excludes mortgage transactions subject to §1026.19(e) and (f); its scope commentary identifies unsecured credit, specified personal-property secured credit, and reverse-mortgage branches. S005 chapeau; S006 comment18-3.i–iii. Established general disclosure routing. Special exceptions such as §3(h) must also be considered; no full mortgage survey.
R004-P3-C021 When the finance charge is computed from time to time by applying a rate to unpaid principal, §18(k)(1) requires a statement whether a charge may be imposed for early payment of all or part of principal. S005 §1026.18(k)(1). Established conditional disclosure duty. It does not establish the lawful amount or authority for the charge.
R004-P3-C022 For other finance-charge structures, §18(k)(2) requires a statement whether a rebate is available upon full or partial prepayment. S005 §1026.18(k)(2); S006 comment18(k)(2)-1.i. Established conditional duty. Includes charges not reflecting every principal reduction, such as precomputed/add-on charges.
R004-P3-C023 The disclosure must be definitive; absence of a penalty disclosure cannot be used to imply that no penalty applies. S006 comment18(k)-1 and -1.i. Established disclosure rule. A representation still is not a complete payoff calculation.
R004-P3-C024 If a penalty or rebate is possible for any type of prepayment, the positive disclosure is required; voluntary/involuntary differences are not placed in the segregated disclosures. S006 comment18(k)-1.ii–iii. Established. Includes acceleration-related prepayment; does not decide acceleration’s substantive consequences.
R004-P3-C025 One transaction can require both rebate and penalty disclosures when both charge structures are present. S006 comment18(k)-2. Established mixed-structure rule. A single “simple interest” label does not classify all charges.
R004-P3-C026 A prepaid finance charge alone does not require a §18(k) disclosure and is not, solely for that reason, a §18(k)(1) penalty; optional rebate disclosure is permitted. S006 comment18(k)-3. Established classification/disclosure rule. Not a universal nonrefundability rule.
R004-P3-C027 Treating a fully prepaid balance as outstanding afterward and charging interest on it is an example of a §18(k)(1) prepayment penalty. S006 comment18(k)(1)-1.i, complete explanation and example. Established label for this provision. Contract wording about monthly accrual does not remove the example’s classification.
R004-P3-C028 A minimum finance charge in a simple-interest transaction is an example of a prepayment penalty. S006 comment18(k)(1)-1.iii. Established classification. No minimum amount or authority to collect one established.
R004-P3-C029 Recapture of a conditionally waived origination/closing fee is a penalty example, subject to the commentary’s specific exception for waived bona fide third-party charges on full prepayment of a covered transaction sooner than 36 months after consummation. S006 comment18(k)(1)-1.ii; S008 §43(b)(1), context only. Established conditional classification. Exception does not encompass every third-party fee, partial payment, later payment, or excess recapture. No actual mortgage application or charging permission decided.
R004-P3-C030 Document-preparation/provision fees imposed upon full payoff whether or not early, and loan-guarantee fees, are examples of fees not classified as penalties under §18(k)(1). S006 comment18(k)(1)-2.i–ii. Established classification examples. “Not a penalty” does not mean otherwise authorized or automatically collectible.
R004-P3-C031 For the referenced refund/penalty classification, commentary directs use of an applicable state actuarial definition when it produces a greater refund than the federal definition. S006 comment18(k)(2)-1.i.A. Established instruction in this context. No state definition was selected or applied here.
R004-P3-C032 A description of the earned/unearned finance-charge computation method is neither required nor permitted within the segregated §18(k)(2) disclosures. S006 comment18(k)(2)-1.ii. Established placement rule. It does not prohibit relevant contract terms or separately supplied information.
R004-P3-C033 Disclosures reflect the legal obligation; an informal principal-reduction arrangement does not automatically replace the contractual payment schedule. S007 §17(c)(1), comments -1 and -2.ii; S005 §18(p). Established disclosure basis; related inference. Extra money alone does not establish a legally effective recast or due-date change.
R004-P3-C034 Regulation Z has consumer-purpose, regular-extension, finance-charge/installment, actor, and exemption gates. Its 2026 amount threshold is $73,400, with real-property/principal-dwelling and private-education exceptions to that threshold exemption. S008 §1(c)(1), §3(a), §3(b)(1), comment3(b)-3.xvii; S003 §1603 and inflation note. Established Regulation Z screen. Not a universal debt threshold or automatic §1615 exclusion.
R004-P3-C035 Qualifying §3(h) assistance transactions may use the specified §18 disclosure route instead of §19(e)/(f); the exception requires all listed conditions. S008 §3(h)(1)–(6), comments3(h)-1–2. Established conditional alternative. Subordinate lien, specified assistance purpose, no interest, specified forgiveness/deferral, restricted costs, fee condition, and compliant disclosures are required. No eligibility determination.
R004-P3-C036 The Title IV student-loan exemption does not cover private education loans; Subpart F generally adds requirements and incorporates §18 disclosures at specified stages. S008 §3(f), comment3(f)-1; §46(a)(1), (b)(5), (c)(2). Gateway only. Private-education charging/prepayment law is not investigated or approved here.
R004-P3-C037 Note face amount, principal, amount financed, and consumer proceeds can differ; precomputed interest in a gross obligation is not thereby all principal. S004 §1638(a)(2); S005 §18(b); S006 comment18(b)(3)-2. Established disclosure/accounting distinction. The new model makes them equal only where expressly stipulated.
R004-P3-C038 These sources do not establish that an increased payment alone releases a lien, discharges every obligation, or changes maturity; those conclusions require the applicable obligation and governing rules. S005 §18(p); S007 comment17(c)(1)-1–2; scope of S001. Bounded inference/hold. A mathematical zero under assumed components is not proof of legal satisfaction of every secured obligation.

The general §18 scope commentary routes ordinary real-property/cooperative-unit transactions subject to §19(e)/(f) to the integrated mortgage disclosures, while retaining specified personal-property and reverse-mortgage branches under §18. Section3(h) creates a narrow alternative for qualifying assistance transactions.

For that alternative, the conditions actually read include a subordinate lien; a listed housing-assistance purpose; no contractual interest; specified forgiveness or deferral—including the stated 20-year, sale, or principal-residence alternatives; restricted closing costs; the stated application/counseling-fee condition; and compliant disclosures. These conditions are recorded to prevent a false “all mortgages are excluded from §18” inference. Their application and all substantive mortgage prepayment restrictions remain held. 4. What the allocation methods actually calculate

Sum of digits

For the equal-period, equal-installment model used below:

Plain text

n = original number of stipulated monthly installments
k = number of full model periods elapsed, with scheduled installments paid
F = total precomputed interest charge
S(n) = 1 + 2 + ... + n = n * (n + 1) / 2

Period-j allocated interest = F * (n - j + 1) / S(n)

Unearned amount after period k:
R_digits(k) = F * S(n - k) / S(n)

Allocated earned amount:
E_digits(k) = F - R_digits(k)

The familiar denominator is 78 only when n = 12. For three installments it is 6; for six it is 21. The official Wisconsin explanation uses descending installment weights and expressly discusses terms other than twelve months. The generalized notation above is a mathematical restatement of that construction. dfi.wi.gov

This calculation allocates a specified precomputed charge. It does not establish the charge’s legality, identify the correct contractual refund method, determine whether payment was received on time, or say that every extra remittance changes k. In this illustration, elapsed periods and paid scheduled installments coincide. Irregular timing, unequal payments, extensions, and partial prepayments require further rules.

Constant-rate balance allocation

The Federal Reserve’s generic constant-yield explanation allocates interest using outstanding principal times a periodic rate, with the remainder of a payment credited to principal. Its example expressly warns that law, contracts, and implementations may differ. federalreserve.gov+1

For this pass’s stipulated model:

Plain text

I_k = r * B_(k-1)
principal_component_k = C_k - I_k
B_k = B_(k-1) + I_k - C_k

G_k = sum of remaining scheduled payments
R_balance(k) = G_k - B_k

Here:

  • B_k is a model net balance used for the comparison.
  • G_k is the remaining gross precomputed obligation.
  • r is a stipulated rate per model month.
  • The refund comparison is made immediately after an on-time installment, with no additional elapsed fraction.

This is an actuarial-style mathematical benchmark, consistent with the read payment-allocation concept. It is not a determination of the legally required §1615 refund. The statute’s definition has been read completely, but no actual contract, applicable refund rate, timing convention, state definition, or complete transaction-specific method has been established. The definition’s deficiency language also does not authorize real-world capitalization.

5. Eight worked branches

There are eight branches: four new arithmetic branches—W02, W03, W04, W06—one reviewed numerical reuse, W01, and three qualitative/trigger branches, W05, W07, W08. W03 compares two allocation rules for one new stipulated set of cash flows. It does not rerun a P01 schedule.

Example Stipulated facts and steps Result or conditional conclusion Missing evidence and adverse error to avoid
W01 — Reviewed simple-interest extra principal Reuse P01: $10,000; 1% per stipulated month; rounded accrued interest; $888.49 regular payment. Baseline ends with $888.47 at month12. Additional $2,000 principal immediately after month3 produces month10 payoff with $494.88 final payment. Reused totals: baseline cash $10,661.86, interest $661.86; accelerated cash $10,491.29, interest $491.29; saving $170.57. Permission, actual allocation, penalties, receipt/accrual rules, and contract consequences remain unknown. Error: calling the saving a legal entitlement or assuming a recast/due-date advance. S013; C001, C033, C038.
W02 — Full prepayment, refund method unresolved New model: advance $331; three payments of $133.10; all excess over advance stipulated to be precomputed interest. After the first scheduled payment, gross remaining payments are $266.20. Let lawful refund be R. Conditional net payment: 266.20 - R. Cumulative net outflow: 399.30 - R. Retained interest: 68.30 - R. No numerical legal R selected. Need applicable refund method, law, and contract. A three-month term does not satisfy §1615(b)’s term condition, but that does not authorize any particular method. Error: equating remaining gross installments with principal.
W03 — Competing allocations Same new $331 advance and three $133.10 payments. Compare descending weights 3,2,1 with a stipulated constant-rate allocation at 10% per model month. Complete calculations follow. After installment1: sum-of-digits net payment $232.05; balance-method benchmark $231.00. Difference $1.05. After installment2, with stipulated cash rounding: $121.72 versus $121.00. These are alternative mathematical allocations, not an authorized method switch or legal refund award. No APR is calculated or certified.
W04 — Partial payment is not the full-payment trigger Immediately after W03 installment1, an additional $50 is tendered. Branch A: assume lawful immediate principal application in a balance-accrual model: 231 - 50 = 181; next model-period interest 181 * .10 = 18.10. Branch B: assume only a $50 credit against the gross precomputed obligation: 266.20 - 50 = 216.20. Branch A’s next-period modeled interest is $5 below $23.10. Branch B establishes only the gross credit; it does not establish a refund or changed interest allocation. Need permission, allocation order, and partial-prepayment terms. §1615(a)’s full-prepayment condition is not demonstrated by this $50 alone. Error: importing Branch A’s interest saving into Branch B.
W05 — Term/date/scope boundaries Compare stipulated transaction terms of exactly61 versus62 months; consummation on September30 versusOctober1,1993; or unknown purpose, creditor status, term, and date. Only the term > 61 and date after September30,1993 combination passes those two §1615(b) predicates. Other predicates still must be met. Unknown facts produce an applicability hold. Need legally relevant term and consummation characterization, consumer purpose, creditor/assignee status, and precomputed structure. Error: treating a failed floor predicate as affirmative permission.
W06 — Minimum-charge disclosure versus authority Separate hypothetical simple-interest branch using W03’s first-period paid interest of $33.10 and remaining principal $231. Assume a proposed total minimum interest charge of $40, solely to test accounting. Incremental amount would be 40 - 33.10 = 6.90; conditional payoff 231 + 6.90 = 237.90; cumulative cash $371, consisting of $331 principal plus $40 interest/charge. Commentary classifies a simple-interest minimum finance charge as a penalty example. Lawfulness of the $40 term is unresolved. It is not a permitted amount or cap. Error: adding the full $40 again, or treating disclosure as authorization.
W07 — Refinancing/acceleration versus settlement/write-off Full prepayment is made through refinancing, consolidation, restructuring, or following acceleration; alternatively, only acceleration, a settlement label, or an accounting write-off occurs. The first group is expressly addressed by §1615(a)(3) when the required prepayment occurs. The alternative facts do not, by label alone, establish that trigger or its consequences. Need actual legal characterization, full-prepayment facts, and any separate applicable rule. Error: treating acceleration alone, settlement, write-off, and full payment as interchangeable events.
W08 — Small refund and statement duties Assume the otherwise-computed total refund is $0.99 or $1.00. Separately, assume a written request satisfying §1615(c), with no actual calendar. $0.99 falls within §1615(a)(2); $1.00 does not. A qualifying written request requires a written statement; one annual statement is free under (c)(3). No consumer deadline or request is generated. Error: calling the five-day statement period the refund deadline, splitting a total refund into sub-$1 components, or inventing a permissible statement fee.

W03: fully specified new arithmetic illustration

The 10% monthly factor is deliberately artificial to produce transparent exact-dollar arithmetic. It is not a live quote, lawful-rate finding, annual note rate, disclosed APR, or effective annual yield.

Input Stipulation
Principal advanced at model time0 $331.00
Model amount financed $331.00, because the illustration assumes no other charges or adjustments
Gross scheduled obligation Three end-of-month payments of $133.10
Total precomputed interest 3 * 133.10 - 331.00 = 68.30
Time units Three equal relative model months; no calendar dates, holidays, or receipt conventions
Balance-method periodic factor r = 0.10 per model month
Allocation Model interest first; remainder to principal; no unpaid-interest deficiency
Other items No penalties, minimum charges, taxes, insurance, credits, or costs in W03
Rounding Balance-method rows happen to be exact cents. Sum-of-digits calculations retain fractional cents until the specified payoff refund is rounded to the nearest cent; no half-cent tie occurs.
Balance-method steps
Period Beginning model balance Interest: beginning balance × .10 Payment Principal component Ending model balance
1 $331.00 $33.10 $133.10 $100.00 $231.00
2 $231.00 $23.10 $133.10 $110.00 $121.00
3 $121.00 $12.10 $133.10 $121.00 $0.00
Total — $68.30 $399.30 $331.00 $0.00

After installment1:

Plain text

Remaining gross scheduled payments = 133.10 + 133.10 = 266.20
Balance-method unearned amount = 266.20 - 231.00 = 35.20
Net prepayment benchmark = 266.20 - 35.20 = 231.00

Sum-of-digits denominator = 3 + 2 + 1 = 6
Sum-of-digits unearned amount = 68.30 * (2 + 1) / 6 = 34.15
Net prepayment under that model = 266.20 - 34.15 = 232.05

The difference is $1.05. Under these inputs, the sum-of-digits allocation retains more interest at that point. This is not a universal numerical relationship for every possible transaction.

Reconciliation at the two hypothetical payoff points
Payoff point and allocation Cumulative scheduled payments already made Allocated earned interest, cash-rounded where necessary Unearned amount/refund used Remaining gross payments Net prepayment Total net cash outflow
After1: balance benchmark $133.10 $33.10 $35.20 $266.20 $231.00 $364.10
After1: sum of digits $133.10 $34.15 $34.15 $266.20 $232.05 $365.15
After2: balance benchmark $266.20 $56.20 $12.10 $133.10 $121.00 $387.20
After2: sum of digits $266.20 $56.92 $11.38 $133.10 $121.72 $387.92

For the second sum-of-digits point:

Plain text

Unrounded unearned amount = 68.30 / 6 = 11.383333...
Cash-rounded unearned amount = 11.38
Net prepayment = 133.10 - 11.38 = 121.72
Total net cash = 266.20 + 121.72 = 387.92
Retained charge = 387.92 - 331.00 = 56.92

The cent adjustment is disclosed; the report does not pretend that the fractional-cent ledger amount and cash refund are identical.

Cash conservation at the first payoff point is:

Plain text

Balance benchmark:
133.10 + 231.00 = 331.00 + 33.10 = 364.10

Sum of digits:
133.10 + 232.05 = 331.00 + 34.15 = 365.15

If the remaining gross amount were paid first and the refund returned separately, the nominal net cash would instead be:

Plain text

prior cash + gross prepayment - refund

If the refund is deducted in calculating the payment, it is:

Plain text

prior cash + (gross prepayment - refund)

The refund appears once in either accounting route. A later cash refund can have different timing consequences from an immediate deduction; nominal equality does not certify equal present value or lawful delivery timing. The Federal Reserve’s generic explanation describes both refund and deduction structures, subject to its limitations. federalreserve.gov

6. Reconciliation and blank generic prepayment audit worksheet

Two different starting balances must not be mixed.

Accruing-balance route:

Plain text

Conditional payoff =
  outstanding principal
+ accrued, unpaid earned interest through the applicable endpoint
+ separately authorized amounts not already included
- applicable credits/refunds not already applied

Gross precomputed-obligation route:

Plain text

Remaining gross obligation =
  original scheduled gross obligation
- payments already credited against that obligation
- adjustments already credited

Conditional net prepayment =
  remaining gross obligation
- applicable unearned-charge refund
- other unapplied credits
+ separately authorized penalty
+ any lawful incremental minimum-charge adjustment
+ other authorized amounts not already included

These are reconciliation structures, not legal payoff formulas valid for every debt. Prior payments must not be subtracted again from an already-net principal balance. Future unearned interest must not be subtracted from a balance that never included it. A refund already netted into a payoff must not also be counted as a second cash receipt.

For a fee-free precomputed model, the check is:

Plain text

prior payments + net prepayment = original principal + retained earned interest

Other charges, credits, and separate cash flows must be added explicitly if they exist and are legally applicable.

GovInfo2024 HTML/PDF in S002 Complete §1615 text obtained; PDF’s printed page/index identified from extraction. Historical official comparison available. No pixel inspection or2026 currentness claim.
OLRC raw-law viewer: https://uscode.house.gov/statviewer.html?page=3891&volume=106 Navigation and notice returned; no readable statutory image content. Original-law pixels not inspected.
Raw-law PDF: https://www.govinfo.gov/content/pkg/STATUTE-106/pdf/STATUTE-106-Pg3672.pdf 400; content too large:70,080,456 bytes. Complete surrounding1992 enactment not read. Next bounded route, if needed, is a smaller official public §933 extract or accessible official enactment text—not repeated oversized fetches.
Current eCFR §18, CFPB §18, annual2025 §18 PDF Relevant operative body read successfully; annual pinpoint p.57/index2 for(k)/(p). Supports the disclosure text, with respective currentness limits.
Current eCFR Supplement I: https://www.ecfr.gov/current/title-12/chapter-X/part-1026/appendix-Supplement%20I%20to%20Part%201026 400; content too large:4,194,305+ bytes. No full current eCFR commentary read claimed. Complete targeted commentary was available on CFPB’s current integrated and standalone pages. A smaller official commentary extract would close this access-format gap.
CFPB standalone commentary: https://www.consumerfinance.gov/rules-policy/regulations/1026/Interp-18/ Redirected to https://www.consumerfinance.gov/rules-policy/regulations/1026/interp-18/; targeted18(k) commentary read completely. Same interpretation as integrated page; not independent corroboration.
Federal Reserve Rule-of-78 example: https://www.federalreserve.gov/pubs/leasing/resource/different/early_exp4.htm Complete short body read. First-month balance line inconsistent with its own printed subtraction; K32 documents it. No silent correction and no adoption of that example as a validated schedule, legal refund, or legal APR.
Bounded implementing-authority searches Official-domain searches surfaced disclosure references, product-specific mortgage materials, historical proposals/final rules, and unrelated results. Search-only items were not adopted. A Congress-domain search reported a non-retryable robots restriction; no bypass attempted. No exhaustive “no implementing rule exists” conclusion. Product-specific authority remains a future packet.
P01/P02 materials Reviewed premises reused from the supplied chat instruction; no model regeneration or Appendix J placeholder retries. Old provenance and holds preserved.

Check Result
Complete §1615 read Complete(a)–(d), exceptions, source credit, and codification note read from current OLRC body; historical official edition also read.
Distinct triggers maintained Full-prepayment refund, method floor, statement duty, and disclosure duties kept separate.
No false universal threshold “Exceeding61 months” and September1993 condition confined to the identified subsection; no shorter-term permission inferred.
No disclosure-as-permission inference Penalty/rebate labels do not approve charging, establish refund amount, or prove a prepayment right.
No APR substitution P02 equations/roots not rerun or repurposed as a refund rule; current legal APR remains held.
Mathematical checks 32 explicit arithmetic checks shown; new three-period balance reaches zero and reconciles total principal/interest/cash.
Rounding Fractional-cent sum-of-digits amount and cash-rounded refund distinguished.
Reviewed work preserved W01 is reviewed reuse; no new P01 schedule claim.
Source quality Current bodies, historical editions, generic education, metadata, failures, and source inconsistency separately labeled.
Guidance Withdrawn Guidance register checked; no substantive CFPB circular/bulletin/advisory relied on.
Owner limits No actual or hypothetical identifier lookup, borrower/provider/entity/account/property/case search, contact, filing, records request, account change, subagent, browser control, API workaround, or file write performed.
Acceptance No A004/component/parent/calculator/operations/publication acceptance asserted.

Precise remaining packets and boundaries

Remaining area What remains held
Current legal APR / Appendix J Current equation identity, adequate official-edition/amendment comparison, and legal APR application remain exactly as held after P02.
Actual prepayment/refund application Applicable jurisdiction and product rules; actual agreement; lawful permission and allocation; refund rate/timing/rounding; penalties, minimum charges, credits, payoff, and release consequences. Generic research cannot establish an actual agreement within these owner limits.
Broader prepayment law Complete state/local/tribal/country rules; product-specific mortgage, auto, student, payday, BNPL, business/commercial rules; irregular or modified precomputed obligations; additional rebate/penalty restrictions and their effective-date histories.
Interest and payment mechanics Complete compound interest/capitalization; open-end/cards/grace; minimum-payment and negative-amortization law; variable/penalty/deferred interest; receipt, day-count, allocation, accrual, and late/collection-cost rules.
Historical/currentness completion Comprehensive post-October15,2026 session-law audit; original1992 surrounding enactment/effective-context inspection where historical application matters; smaller official current commentary rendering if required for an edition comparison.
Tools and intersections Production-tool validation/error handling; bankruptcy, tax, settlement, credit, eligibility, operating permission, publication, and all other unaddressed A004 dimensions.

The supported result of this pass is a federal trigger and disclosure framework plus transparent conditional arithmetic. The reviewed $170.57 simple-interest saving remains intact. The new comparison shows how two specified allocations can produce different retained-interest and net-payment amounts from the same original scheduled cash flows. Neither result determines an actual lawful charge or refund.

R004-P3-C001P01’s reviewed models and P02’s legal-APR hold remain unchanged.S013; current user-supplied foundation.Reviewed reuse. No new acceptance or rerun.
R004-P3-C002§1615 was enacted through §933 of the 1992 Housing and Community Development Act, not as part of the Consumer Credit Protection Act itself.S001/S002, source credit and codification note.Established federal source fact. Enactment date is October28,1992; historical applicability is not inferred solely from that date.
R004-P3-C003The incorporated consumer concept concerns a natural person and primarily personal, family, or household purposes.S001 §1615(d)(2); S003 §1602(i).Established definition. Not every debt or business-purpose transaction qualifies.
R004-P3-C004The ordinary statutory creditor definition requires regular extension of qualifying consumer credit and initial-payee status, with statutory special cases.S003 §1602(g), complete paragraph.Established definition. Finance charge or agreement for more than four installments is relevant. No actual actor classification made.
R004-P3-C005For §1615, creditor also includes an assignee and subsequent assignee of the described consumer credit.S001 §1615(d)(3)(A)–(B).Established federal inclusion. Do not stop at §1602’s original-payee wording.
R004-P3-C006When a consumer prepays in full the financed amount under the covered consumer credit transaction, §1615(a)(1) requires the creditor promptly to refund unearned interest.S001 §1615(a)(1); S002 same provision.Established conditional duty. It concerns unearned interest, not an automatic refund of every finance-charge component. “Promptly” is not converted here into a numerical refund deadline.
R004-P3-C007The subsection (a)(1) refund is not required by that provision when the total refund would be less than $1.S001 §1615(a)(2).Established exception. Exactly $1 is not “less than $1.” Other law or contract may provide more.
R004-P3-C008Subsection (a) applies to the described full prepayment regardless of manner or reason, expressly including refinancing, consolidation, restructuring, and prepayment resulting from acceleration.S001 §1615(a)(3)(A)–(B).Established conditional scope. Acceleration or restructuring without the required prepayment is a different factual branch.
R004-P3-C009For the required refund on a precomputed consumer credit transaction with a term exceeding 61 months, consummated after September30,1993, the method must be at least as favorable to the consumer as the actuarial method.S001 §1615(b).Established conjunctive test. The transaction term, date, structure, and refund trigger all matter.
R004-P3-C010The express 61-month/date restrictions occur in subsection (b), not in the wording of (a) or (c); their failure does not establish permission to use Rule of 78s or a universal prepayment right.S001 §1615(a)–(c), read together.Textual inference. Earlier-transaction retroactivity and other applicable restrictions remain unresolved.
R004-P3-C011For the specified request concerning a precomputed consumer credit account, the creditor or assignee must provide the full-prepayment amount and identify a required refund included in that amount before the end of the statutory five-day period beginning with receipt.S001 §1615(c)(1)(A)–(B).Established conditional statement duty. Oral or written request; no actual request or deadline calculated. This is not the refund deadline in (a).
R004-P3-C012A written request under subsection (c) requires a written statement.S001 §1615(c)(2).Established. No assertion that every oral request requires a written response under this clause.
R004-P3-C013The consumer is entitled to one subsection (c)(1) statement each year without charge.S001 §1615(c)(3).Established. No invented calendar-year interpretation or actual entitlement determination.
R004-P3-C014Additional statements may carry a reasonable cost-covering fee if its amount is disclosed before furnishing the statement.S001 §1615(c)(4).Established statutory conditions. No dollar cap or actual fee approval inferred; other applicable restrictions remain relevant.
R004-P3-C015The statutory actuarial definition applies a payment first to accumulated finance charge, subtracts a remainder from unpaid amount financed, and adds a deficiency to that unpaid balance.S001 §1615(d)(1), complete definition.Established definition. Allocation description only; not a freestanding authorization for servicing capitalization.
R004-P3-C016That definition does not itself specify the complete rate-selection, day-count, off-cycle timing, or rounding rules needed to calculate an actual refund.S001 §1615(d)(1); S009’s expressly conditional generic examples.Read-boundary finding. No Appendix J formula is substituted for those missing inputs.
R004-P3-C017No separate generally applicable implementing refund formula was established in the bounded official-source investigation. §1026.18 commentary references §1615(d) for disclosure/classification purposes.S001 complete section; S006 comment18(k)(2)-1.i.A; discovery/read log below.Partial research result, not proof that no other implementing or product-specific authority exists.
R004-P3-C018TILA/Regulation Z exemption screens and §1615’s own predicates must be kept distinct; the complete effect of every TILA exemption on separately enacted §1615 is not resolved here.S001 codification note and (d); S003 §1603; S008 §1026.3.Applicability hold. No automatic importation of a dollar, product, or actor exemption into §1615.

R004-P3-C019§1638(a)(11) distinguishes the rebate statement for precomputed finance charges from the penalty statement for charges computed periodically on unpaid principal; (a)(12) calls for a contract reference.S004 §1638(a)(11)–(12).Established federal disclosure framework. Not substantive permission to impose a penalty.
R004-P3-C020§1026.18 excludes mortgage transactions subject to §1026.19(e) and (f); its scope commentary identifies unsecured credit, specified personal-property secured credit, and reverse-mortgage branches.S005 chapeau; S006 comment18-3.i–iii.Established general disclosure routing. Special exceptions such as §3(h) must also be considered; no full mortgage survey.
R004-P3-C021When the finance charge is computed from time to time by applying a rate to unpaid principal, §18(k)(1) requires a statement whether a charge may be imposed for early payment of all or part of principal.S005 §1026.18(k)(1).Established conditional disclosure duty. It does not establish the lawful amount or authority for the charge.
R004-P3-C022For other finance-charge structures, §18(k)(2) requires a statement whether a rebate is available upon full or partial prepayment.S005 §1026.18(k)(2); S006 comment18(k)(2)-1.i.Established conditional duty. Includes charges not reflecting every principal reduction, such as precomputed/add-on charges.
R004-P3-C023The disclosure must be definitive; absence of a penalty disclosure cannot be used to imply that no penalty applies.S006 comment18(k)-1 and -1.i.Established disclosure rule. A representation still is not a complete payoff calculation.
R004-P3-C024If a penalty or rebate is possible for any type of prepayment, the positive disclosure is required; voluntary/involuntary differences are not placed in the segregated disclosures.S006 comment18(k)-1.ii–iii.Established. Includes acceleration-related prepayment; does not decide acceleration’s substantive consequences.
R004-P3-C025One transaction can require both rebate and penalty disclosures when both charge structures are present.S006 comment18(k)-2.Established mixed-structure rule. A single “simple interest” label does not classify all charges.
R004-P3-C026A prepaid finance charge alone does not require a §18(k) disclosure and is not, solely for that reason, a §18(k)(1) penalty; optional rebate disclosure is permitted.S006 comment18(k)-3.Established classification/disclosure rule. Not a universal nonrefundability rule.
R004-P3-C027Treating a fully prepaid balance as outstanding afterward and charging interest on it is an example of a §18(k)(1) prepayment penalty.S006 comment18(k)(1)-1.i, complete explanation and example.Established label for this provision. Contract wording about monthly accrual does not remove the example’s classification.
R004-P3-C028A minimum finance charge in a simple-interest transaction is an example of a prepayment penalty.S006 comment18(k)(1)-1.iii.Established classification. No minimum amount or authority to collect one established.
R004-P3-C029Recapture of a conditionally waived origination/closing fee is a penalty example, subject to the commentary’s specific exception for waived bona fide third-party charges on full prepayment of a covered transaction sooner than 36 months after consummation.S006 comment18(k)(1)-1.ii; S008 §43(b)(1), context only.Established conditional classification. Exception does not encompass every third-party fee, partial payment, later payment, or excess recapture. No actual mortgage application or charging permission decided.
R004-P3-C030Document-preparation/provision fees imposed upon full payoff whether or not early, and loan-guarantee fees, are examples of fees not classified as penalties under §18(k)(1).S006 comment18(k)(1)-2.i–ii.Established classification examples. “Not a penalty” does not mean otherwise authorized or automatically collectible.
R004-P3-C031For the referenced refund/penalty classification, commentary directs use of an applicable state actuarial definition when it produces a greater refund than the federal definition.S006 comment18(k)(2)-1.i.A.Established instruction in this context. No state definition was selected or applied here.
R004-P3-C032A description of the earned/unearned finance-charge computation method is neither required nor permitted within the segregated §18(k)(2) disclosures.S006 comment18(k)(2)-1.ii.Established placement rule. It does not prohibit relevant contract terms or separately supplied information.
R004-P3-C033Disclosures reflect the legal obligation; an informal principal-reduction arrangement does not automatically replace the contractual payment schedule.S007 §17(c)(1), comments -1 and -2.ii; S005 §18(p).Established disclosure basis; related inference. Extra money alone does not establish a legally effective recast or due-date change.
R004-P3-C034Regulation Z has consumer-purpose, regular-extension, finance-charge/installment, actor, and exemption gates. Its 2026 amount threshold is $73,400, with real-property/principal-dwelling and private-education exceptions to that threshold exemption.S008 §1(c)(1), §3(a), §3(b)(1), comment3(b)-3.xvii; S003 §1603 and inflation note.Established Regulation Z screen. Not a universal debt threshold or automatic §1615 exclusion.
R004-P3-C035Qualifying §3(h) assistance transactions may use the specified §18 disclosure route instead of §19(e)/(f); the exception requires all listed conditions.S008 §3(h)(1)–(6), comments3(h)-1–2.Established conditional alternative. Subordinate lien, specified assistance purpose, no interest, specified forgiveness/deferral, restricted costs, fee condition, and compliant disclosures are required. No eligibility determination.
R004-P3-C036The Title IV student-loan exemption does not cover private education loans; Subpart F generally adds requirements and incorporates §18 disclosures at specified stages.S008 §3(f), comment3(f)-1; §46(a)(1), (b)(5), (c)(2).Gateway only. Private-education charging/prepayment law is not investigated or approved here.
R004-P3-C037Note face amount, principal, amount financed, and consumer proceeds can differ; precomputed interest in a gross obligation is not thereby all principal.S004 §1638(a)(2); S005 §18(b); S006 comment18(b)(3)-2.Established disclosure/accounting distinction. The new model makes them equal only where expressly stipulated.
R004-P3-C038These sources do not establish that an increased payment alone releases a lien, discharges every obligation, or changes maturity; those conclusions require the applicable obligation and governing rules.S005 §18(p); S007 comment17(c)(1)-1–2; scope of S001.Bounded inference/hold. A mathematical zero under assumed components is not proof of legal satisfaction of every secured obligation.

ExampleStipulated facts and stepsResult or conditional conclusionMissing evidence and adverse error to avoid
W01 — Reviewed simple-interest extra principalReuse P01: $10,000; 1% per stipulated month; rounded accrued interest; $888.49 regular payment. Baseline ends with $888.47 at month12. Additional $2,000 principal immediately after month3 produces month10 payoff with $494.88 final payment.Reused totals: baseline cash $10,661.86, interest $661.86; accelerated cash $10,491.29, interest $491.29; saving $170.57.Permission, actual allocation, penalties, receipt/accrual rules, and contract consequences remain unknown. Error: calling the saving a legal entitlement or assuming a recast/due-date advance. S013; C001, C033, C038.
W02 — Full prepayment, refund method unresolvedNew model: advance $331; three payments of $133.10; all excess over advance stipulated to be precomputed interest. After the first scheduled payment, gross remaining payments are $266.20. Let lawful refund be R.Conditional net payment: 266.20 - R. Cumulative net outflow: 399.30 - R. Retained interest: 68.30 - R. No numerical legal R selected.Need applicable refund method, law, and contract. A three-month term does not satisfy §1615(b)’s term condition, but that does not authorize any particular method. Error: equating remaining gross installments with principal.
W03 — Competing allocationsSame new $331 advance and three $133.10 payments. Compare descending weights 3,2,1 with a stipulated constant-rate allocation at 10% per model month. Complete calculations follow. After installment1: sum-of-digits net payment $232.05; balance-method benchmark $231.00. Difference $1.05. After installment2, with stipulated cash rounding: $121.72 versus $121.00.These are alternative mathematical allocations, not an authorized method switch or legal refund award. No APR is calculated or certified.
W04 — Partial payment is not the full-payment triggerImmediately after W03 installment1, an additional $50 is tendered. Branch A: assume lawful immediate principal application in a balance-accrual model: 231 - 50 = 181; next model-period interest 181 * .10 = 18.10. Branch B: assume only a $50 credit against the gross precomputed obligation: 266.20 - 50 = 216.20.Branch A’s next-period modeled interest is $5 below $23.10. Branch B establishes only the gross credit; it does not establish a refund or changed interest allocation.Need permission, allocation order, and partial-prepayment terms. §1615(a)’s full-prepayment condition is not demonstrated by this $50 alone. Error: importing Branch A’s interest saving into Branch B.
W05 — Term/date/scope boundariesCompare stipulated transaction terms of exactly61 versus62 months; consummation on September30 versusOctober1,1993; or unknown purpose, creditor status, term, and date.Only the term > 61 and date after September30,1993 combination passes those two §1615(b) predicates. Other predicates still must be met. Unknown facts produce an applicability hold.Need legally relevant term and consummation characterization, consumer purpose, creditor/assignee status, and precomputed structure. Error: treating a failed floor predicate as affirmative permission.
W06 — Minimum-charge disclosure versus authoritySeparate hypothetical simple-interest branch using W03’s first-period paid interest of $33.10 and remaining principal $231. Assume a proposed total minimum interest charge of $40, solely to test accounting.Incremental amount would be 40 - 33.10 = 6.90; conditional payoff 231 + 6.90 = 237.90; cumulative cash $371, consisting of $331 principal plus $40 interest/charge. Commentary classifies a simple-interest minimum finance charge as a penalty example.Lawfulness of the $40 term is unresolved. It is not a permitted amount or cap. Error: adding the full $40 again, or treating disclosure as authorization.
W07 — Refinancing/acceleration versus settlement/write-offFull prepayment is made through refinancing, consolidation, restructuring, or following acceleration; alternatively, only acceleration, a settlement label, or an accounting write-off occurs. The first group is expressly addressed by §1615(a)(3) when the required prepayment occurs. The alternative facts do not, by label alone, establish that trigger or its consequences.Need actual legal characterization, full-prepayment facts, and any separate applicable rule. Error: treating acceleration alone, settlement, write-off, and full payment as interchangeable events.
W08 — Small refund and statement dutiesAssume the otherwise-computed total refund is $0.99 or $1.00. Separately, assume a written request satisfying §1615(c), with no actual calendar.$0.99 falls within §1615(a)(2); $1.00 does not. A qualifying written request requires a written statement; one annual statement is free under (c)(3).No consumer deadline or request is generated. Error: calling the five-day statement period the refund deadline, splitting a total refund into sub-$1 components, or inventing a permissible statement fee.
