SettleADebt.com — R001 Correction Supplement 01
A001: California Judgment Satisfaction, Acknowledgment Deadlines, and Lien Release
Target: R001-C023 / R001-S032 | Baseline: October 22, 2026 | Jurisdiction: California | Status: Correction required
1. Correction determination
The universal “14 days after payment” rule must be withdrawn from R001-C023. It conflates three legally different requirements:
- General civil judgments — CCP § 724.030: The judgment creditor's obligation to file an acknowledgment arises immediately upon satisfaction, subject to the statutory exception for satisfaction pursuant to a writ of execution.
- General civil judgments — CCP § 724.050: A separate written-demand procedure includes a 15-day period measured from actual receipt of a qualifying demand. Its prerequisites and remedies must not be reduced to an automatic penalty for missing 15 days.
- Small-claims judgments — CCP § 116.850: Immediate filing following full satisfaction is distinct from the 14-day period following receipt of the judgment debtor's written request that is relevant to the section's specified failure-liability rule.
These are not interchangeable deadlines. The governing statute, procedural setting, triggering event, and available remedy must be identified before applying any particular period.
Evidence qualification: The coordinator reports having opened and read all three statutes and the originally cited court page. In this correction session, direct requests to those four URLs returned HTTP 403. That is a reader-access failure, not evidence that the authorities do not exist. Additional official Judicial Council form materials were independently retrieved. The statutory distinctions above are therefore supported by the coordinator's supplied primary-source findings, with direct statutory access independently attempted but not completed.
The original source attribution also needs correction: R001-S032 is an official California Courts self-help explanation, not the controlling statute. Its language cannot support the asserted universal 14-day rule.
2. Scope of this correction
This supplement addresses only the California judgment-satisfaction portion of R001. It does not reopen the debt terminology investigation, survey other states, or independently validate the other 34 claims.
It distinguishes:
- Satisfaction of the judgment obligation.
- Acknowledgment and court filing of that satisfaction.
- Demand-based remedies for failure to acknowledge.
- Release or termination of liens created by judgment enforcement.
- The procedural differences between general civil and small-claims judgments.
No case-specific payment history, service date, creditor contract, or borrower information has been accessed.
3. Replacement findings
R001-C023 — Corrected finding
For a California money judgment, satisfaction of the judgment and the filing of an acknowledgment are related but distinct events. Under CCP § 724.030, the judgment creditor must immediately file an acknowledgment when the judgment is satisfied, except when the judgment is satisfied in full pursuant to a writ. Under CCP § 724.050(a)–(c), an eligible person may make a qualifying written demand; the creditor then has 15 days after actual receipt to comply if the judgment has been satisfied. In California small claims, CCP § 116.850(a) imposes an immediate filing duty upon full payment, while subdivision (b) establishes a separate 14-day period after receipt of the debtor's written request, with liability for damages and $50 if the statutory requirements are met and failure is without good cause.
Neither the 15-day nor 14-day demand period should be described as a grace period permitting delayed filing after satisfaction.
Disposition: Replace the prior R001-C023 entirely. Retain its original ID with a corrected-version annotation. The general concept of judgment satisfaction remains valid; the previously asserted universal deadline does not.
General civil judgments: exact demand procedure
Under CCP § 724.050, the demand mechanism is more specific than simply sending a letter.
- Subdivision (a) identifies eligible demanders, including the judgment debtor, an owner of property subject to the judgment lien, and certain holders of security interests or liens on affected personal property. The demand may seek court filing, execution and delivery, or both.
- Subdivision (b) requires prescribed warning language in the written demand.
- Subdivision (c) uses 15 days after actual receipt, not 15 days after payment or merely after mailing.
- Subdivision (d) provides a noticed-motion procedure to obtain compliance or court-directed entry of satisfaction.
- Subdivision (e) addresses resulting damages and a $100 forfeiture when the creditor fails without just cause to comply within the statutory period. Attorney-fee consequences require their own statutory findings.
A 2025 statutory text reproduction was retrieved and supports these distinctions, but the current official legislative page could not be independently opened in this session. law.justia.com+1
Small claims: distinct requirements
CCP § 116.850(a) applies when the judgment creditor or assignee receives full payment of a small-claims judgment. The acknowledgment must be filed immediately.
Subdivision (b) separately requires full payment, a written demand from the judgment debtor, failure to execute and file within 14 days after receiving the request, and lack of good cause before its damages-plus-$50 liability rule applies.
Subdivision (c)–(d) also provides a route to court-entered satisfaction using prescribed payment evidence and a declaration. This is important where the creditor refuses to cooperate or cannot be located.
The official Judicial Council SC-290 instructions independently distinguish immediate filing from the 14-day period after the debtor's request. FindLaw+1
Applicable forms and lien clearing
Form EJ-100 — Acknowledgment of Satisfaction of Judgment
Used for general civil judgment satisfaction and for small-claims matters involving a recorded abstract or partial satisfaction. It distinguishes full, partial, and matured-installment satisfaction. Item 6 identifies recorded abstracts or certified judgments by county and instrument number; item 7 identifies a Secretary of State judgment lien filing. courts.ca.gov+1
Form SC-290 — Small Claims Acknowledgment
Appropriate for full satisfaction of a small-claims judgment when no abstract of judgment has been recorded. The July 1, 2025 instructions direct use of EJ-100 if the judgment is only partially paid or an abstract has been recorded. courts.ca.gov+1
Court filing does not necessarily clear a recorded lien by itself. EJ-100 expressly instructs that a full-satisfaction acknowledgment must also be recorded in each county identified in item 6 to release the associated real-property judgment lien, and filed with the Secretary of State to terminate the identified personal-property judgment lien. A recorded abstract, county, instrument number, and any state filing number therefore matter independently of the court docket entry. courts.ca.gov+1
The court's small-claims instructions describe obtaining a certified EJ-100 and recording it in the counties where liens were created. Filing, service, notarization, certification, and recording may each be separate procedural steps. Self Help Guide

7. Worked comparisons and examples
These examples are illustrative only. They do not calculate legal due dates.
| Hypothetical event |
Applicable rule |
Correct interpretation |
| A general civil money judgment is fully satisfied directly on October 22, 2026. |
§ 724.030 |
Filing duty arises immediately, absent the writ exception. No automatic 14-day grace period. |
| A qualifying § 724.050 written demand is actually received on October 26, 2026. |
§ 724.050(c) |
The 15-day period is tied to actual receipt, not the earlier satisfaction date. Exact final day is not calculated here. |
| A small-claims judgment is fully paid October 22, and a written request is received October 28. |
§ 116.850(a)–(b) |
Immediate filing duty follows payment; the separate 14-day failure-liability period is measured from receipt of the request. |
| A judgment is satisfied and EJ-100 is filed, but an abstract remains recorded in two counties. |
EJ-100 items 6–7 |
Court filing and lien clearing remain distinct; recording is required in each affected county. |
For a settlement example, assume a hypothetical judgment balance of $10,000 and a creditor's documented agreement to accept $7,000 in full satisfaction.
The arithmetic is:
- Judgment balance assumed: $10,000
- Agreed payment assumed: $7,000
- Difference: $10,000 − $7,000 = $3,000
- Payment as percentage of assumed balance: $7,000 ÷ $10,000 × 100 = 70%
That arithmetic does not establish a typical settlement percentage, tax result, or lien release. Whether the $7,000 actually satisfies the judgment depends on the enforceable agreement and performance. EJ-100 item 1(a)(2) specifically accommodates accepted alternative payment or performance in full satisfaction.
