Take the product apart before comparing the price
| Part | Find it in the documents |
|---|---|
| Obligation | Is this a loan, sale, advance, subscription, investment or a combination? Who can demand repayment? |
| Price | Interest, fees, tips, subscription cost, spread, penalties and renewal charges |
| Collateral | What can be sold or seized, and when can a sale of the collateral (liquidation) occur? |
| Control | Who can debit funds, change a limit, freeze access or make a binding agreement? |
| Failure | What happens if the platform, custodian, payment partner or software stops working? |
| Remedy | Which entity receives complaints and which law, forum or regulator applies? |
Embedded checkout credit, wage-linked products and digital-asset borrowing can use different legal structures. A familiar payment screen does not establish identical fees, cancellation rights or insolvency protections.
Keep a trail when software makes or assists a decision
AI can summarize a statement, suggest a response, negotiate within permitted limits or help a lender evaluate an application. Ask what it is allowed to decide, what data it uses and how a person can correct an error. Do not give it authority to accept a settlement merely because it can draft an offer.
For covered credit decisions, Regulation B requires the applicable notice or reasons process after an unfavorable credit decision, known as adverse action. A statement of reasons must identify the principal reasons specifically; a vague reference to internal standards or failing a qualifying score is insufficient under the rule. Product and applicant categories can affect the procedure.
Preserve the decision record
Application or request version
Data or documents submitted
Decision date and notice
Specific reason given
Correction request and supporting evidence
Human review or complaint response
An AI explanation should be checked against the actual notice and account record. A fluent answer is not evidence that the debt, legal deadline or proposed agreement is correct.
Watch collateral mechanics and the law’s actual date
Digital-asset lending can add price volatility, automated liquidation, asset-custody, software-rule and platform-failure risks. A low initial ratio of the borrowed amount to collateral value (loan-to-value) is not a promise that collateral cannot be sold after a rapid price change. Review the actual threshold, price source, fees and whether you remain liable beyond the collateral.
The SEC’s 2022 investor bulletin explains risks of crypto interest accounts, including platform failure and the distinction from ordinary insured deposits. It is risk education about a product category, not a current authorization or solvency assessment of any platform.
Check which technology law applies on the decision date
A dated example shows why current-law checks matter: Colorado’s enacted 2026 automated-decision law replaces an earlier framework and generally applies to covered decisions about important services, including lending and housing, from January 1, 2027, with qualifications and earlier-effective provisions. A 2024 headline or a future start date alone does not describe every obligation operative today.
Compare the contract and current local rules before transferring funds or granting access. Keep uncertainty visible: no tool can guarantee creditor participation, a legal outcome, a safe platform or a particular credit score.
