Start with the entered judgment and court file
A default judgment can be entered when the defendant—the person sued—does not respond or appear as required. It can support stronger collection tools than an ordinary demand letter. Get a copy of the actual judgment, complaint, service record, notices and docket before deciding what happened.
Record the court, case number, plaintiff (the party suing), named defendant, entry date, original amount, added interest or costs and all known payments. Ask whether enforcement is active through an employer, bank or recorded lien. A collector’s account summary may not show the complete court history.
Different problems call for different requests
| Problem | Route to investigate | Evidence to locate |
|---|---|---|
| You did not know about the case | Relief based on service or notice issues, where available. | Service affidavit, addresses, actual receipt and discovery dates. |
| You missed a response or hearing | A request to set aside the judgment based on a recognized excuse and any required evidence of a defense. | Reason for the default, relevant dates and support for a defense. |
| The debt was paid, settled or discharged | Correction, satisfaction or other appropriate relief. | Agreement, payment credits, release or bankruptcy documents. |
| The judgment is valid but unaffordable | Exemption review, settlement or bankruptcy assessment. | Income source, assets, enforcement notices and budget. |
For example, New York Courts distinguishes excusable default from lack of personal jurisdiction (the court’s authority over you) and directs people to obtain the service record. Its grounds and procedures are New York-specific. New York Courts: Vacating a default judgment
A challenge and a stay are separate questions
Ask promptly which deadlines apply to the particular ground and whether you also need a stay—an order pausing enforcement. Filing a motion does not universally stop a bank levy or garnishment. Tell legal help and the court about frozen essential funds or an imminent sale.
If relief is granted, read the order for what happens next. Reopening a case may restore the opportunity to defend rather than erase the underlying claim. Calendar the new response or hearing obligations. If military service is relevant, obtain advice about the separate federal protections and required records. Track duration, interest and satisfaction separately
A judgment can have an enforceability period, renewal process, lien duration and interest rule that differ from the original contract’s limitation period. State and federal-government judgments can follow different regimes. Do not apply a “seven-year debt rule” to all of them.
Ask for an accounting through a stated date, including payments, lawful interest and costs. If negotiating, require terms addressing the judgment, active enforcement and any lien. After payment, obtain the appropriate filed satisfaction and recorded release where required.
Lifecycle record: entry → notice/service → challenge or appeal → enforcement/stay → renewal if any → payment or resolution → satisfaction and lien follow-through.
Keep the court records after the balance is resolved. An internal “closed” label does not establish that the public judgment or property record has been updated.
