The short answer

Idaho’s Collection Agency Act also covers debt and credit counselors. Section 26-2229 distinguishes fee limits for custodial and noncustodial services and includes refund rules for fees tied to unresolved debts after early cancellation. Confirm the company’s current license, which schedule applies, and how cancellation changes your total fee. The state schedule does not eliminate federal advance-fee restrictions.

Separate the fee amount from the time it can be charged

For debt-relief services covered by the federal Telemarketing Sales Rule, a company generally cannot collect its fee until it has changed at least one debt, you have agreed to the result and you have made a payment under that agreement. Fees for multiple debts must follow the required proportional or consistent-savings allocation. State law can add separate conditions.

Money deposited into your own savings account is not automatically a fee earned by the provider. Ask who owns that account, whether you can withdraw, which administrator charges apply and what happens if you cancel.

The right path may not be settlement

Someone who can repay principal with lower interest may need hardship or a debt-management plan. Someone disputing charges should investigate the balance before negotiating it away. Someone unable to cover essentials or facing several lawsuits may need qualified legal advice, including whether bankruptcy should be compared.

Do not deliberately stop affordable payments solely to meet a program’s enrollment rules. A hoped-for discount does not prevent fees, collection or a lawsuit. Keep any court response separate from sales discussions.

If the quote or fee seems wrong

Use the Idaho authority linked below to check the applicable regime and ask where to verify the company. Keep the advertisement, contract, fee ledger and communications. If the business claims an exception, request its explanation in writing. A listing or registration is not a guarantee of results.

Common questions

Is every settlement company allowed to serve my state?

No. Coverage, licensing, registration and exceptions depend on the actual service and state framework. This page does not certify a provider or establish that one is available.

Does a state-listed fee mean it can be charged upfront?

No. The amount and the timing are separate questions. Federal law may prohibit collection earlier than a state schedule appears to allow.

Can a company guarantee that a creditor will settle?

No. A creditor’s participation and terms are account-specific. Ask what happens to your fees and remaining balances if an account is never resolved.
