The federal wage limit is only a starting point

For ordinary debts, the federal Consumer Credit Protection Act generally limits a wage garnishment to the lesser of 25% of disposable earnings or the amount above 30 times the federal minimum hourly wage for a weekly pay period. A more protective applicable state limit controls. Support, taxes and certain other debts have different rules.

Disposable earnings means earnings after legally required deductions, not simply the amount left after every voluntary payroll deduction. This federal wage formula is not a universal bank-account exemption.

Support an exemption or calculation objection

  • Keep the complete writ, notice, envelope and date of delivery.
  • Match payroll records to the deduction and identify legally required deductions.
  • Trace Social Security, veterans benefits or other potentially protected deposits with statements.
  • Collect household expense evidence if the applicable exemption requires a necessity or hardship showing.
  • Use the current state form and serve the required parties; keep filing and delivery proof.

An agreement does not automatically release a writ

If a creditor agrees to a payment plan or settlement, obtain written terms addressing the existing garnishment or levy and the filing needed to release it. Confirm the bank or employer received the release before assuming deductions will stop. A complaint to a regulator does not itself stay court enforcement.

Questions worth asking

  1. Does a judgment mean all my income can be taken?
  2. Is a bank levy the same as wage garnishment?
  3. Will talking to a settlement company stop it?

Common questions

Does a judgment mean all my income can be taken?

No. Exemption rules and collection procedures can still protect particular income or property. A claim or objection may be required, so follow the notice and current state instructions.

Is a bank levy the same as wage garnishment?

No. A payroll limit and an exemption for money already deposited can be different. Trace the source of account funds and use the procedure for the actual writ.

Will talking to a settlement company stop it?

Not automatically. A court order, applicable legal stay or properly implemented creditor release is needed; enrollment in a program is not itself a stay.
