Provider financial assurance, bonds, fiduciary safeguards, and failure-claim priority
Actual fresh source-access date: October 27, 2026, Pacific.
Historical baseline: October 22, 2026—not a current-verification date.
Scope: This report addresses the security and failure-priority remainder only. P02 and P03 are not adopted as verified foundations. Necessary ownership, professional-rule, and money-transmission interfaces were freshly examined; their broader agreement, custody, remittance, and operational investigations are not repeated or accepted here.
Result: Several distinct protection regimes were authenticated, but no generic Wyoming debt-settlement bond was established. The collector bond, money-transmitter security, sandbox bond, conditional federal credit-counseling security, trustee bond, and discretionary Client Protection Fund protect different interests under different conditions. None independently authorizes otherwise prohibited debt adjustment.
In the findings, S001 means S_WY-P4-S001, and C001 means S_WY-P4-C001. Full identifiers appear in the registers.
A. Substantive findings
1. Which branches actually carry financial-assurance requirements?
1.1 Classification remains the first gate
Fresh inspection of the complete Chapter 14 confirms the reviewed foundation: covered, nonexcluded fee-based debt adjustment remains prohibited. The chapter’s conditional nonprofit and attorney exclusions do not themselves prescribe a bond, minimum capital, insurance policy, reserve, or consumer-compensation fund. That is a statement about this chapter’s text, not an exemption from every other applicable law. C001–C002; S001. Wyoming Legislature+1
A collector acting for a creditor is not interchangeable with a consumer-retained settlement advisor. Chapter 11’s definitions and exclusions—including its business-debt treatment—remain in that chapter’s context. A collection license or bond cannot be used as debtor-side settlement permission. C003. Wyoming Legislature+1

1.2 Professional form is not financial assurance
The January 26, 2026 Rule 10 amendment preserves lawyers’ responsibility for their own professional activities in the permitted professional forms. It does not establish a fixed professional bond, minimum insurance limit, or universal capital reserve. The employee-benefit language allowing health, accident, insurance, or welfare plans is not a professional-liability insurance mandate. C044; S010. Wyoming Courts+1
No universal malpractice or fidelity-insurance requirement was authenticated in the selected professional authorities. That bounded finding must not be expanded into “Wyoming never requires insurance for any lawyer, fiduciary, entity, contract, or court-appointed role.”
2. Authenticated security instruments: amount, parties, maintenance, and cancellation
2.1 Collection-agency bond or cash substitute
Under W.S. §33-11-108:
| Element |
Statutory result |
| Principal |
Applicant/licensee |
| Surety |
Company licensed and authorized to do business in Wyoming |
| Obligee/protected parties |
State of Wyoming and qualifying claimants |
| Protected transaction |
Debts placed with the licensee for collection |
| Covered obligation |
Turning over collected proceeds, less collection charges authorized by the claimant’s agreement |
| Amount |
$10,000 |
| Alternative |
$10,000 cash deposited with the State Treasurer |
| Filing trigger |
Within 20 days after notification of application approval |
| Approval |
Board and Attorney General approval of the bond |
| Execution |
Applicant executes and acknowledges as principal |
| Maintenance |
Security must thereafter be maintained |
| Aggregate |
Surety liability for all claims under the bond cannot exceed its penalty |
| Replacement |
Following the specified withdrawal/revocation notice, new satisfactory bond within 30 days from notification or operating right terminates |
These are security amounts and procedural periods—not consumer-fee allowances, government filing charges, or promised recoveries. C004–C012; S001, §§33-11-107–109. Wyoming Legislature
Each office must be separately licensed, and the reproduced branch rule applies the chapter’s licensing requirements to branches. Nevertheless, without the authenticated bond form and actual instrument language, this report does not assume that a single blanket instrument supplies separate $10,000 limits for every location or that renewal creates a fresh aggregate automatically. C013. Wyoming Legislature+1
The statute requires financial soundness but does not state a numerical net-worth floor in §33-11-107(b). The reproduced rule requires the prescribed financial statement and rejects statements more than six months old. C004, C015. Wyoming Legislature+1
The reproduced trust-account rule requires sufficient funds for sums due clients and includes a narrowly stated exception for a business engaged solely in debt buying, with the required attestations. That exception is not an independently established exemption from the bond. C014. Legal Information Institute
2.2 Money-transmitter security, net worth, and investments
This is a separate conditional activity-based regime. A Chapter 14 exclusion does not prove a Chapter 22 exemption.
Under §§40-22-105–107:
- Net worth must be at least $25,000, determined under generally accepted accounting principles.
- Security may be a surety bond, irrevocable letter of credit, or other acceptable device.
- The statutory amount is the greater of $10,000 or 2.5 times outstanding payment instruments, capped at $500,000. The commissioner may increase the requirement up to that maximum on the stated impaired-financial-condition grounds.
- The reproduced renewal rule uses the preceding July 1–June 30 average daily balance of outstanding payment instruments for Wyoming residents. That annual regulatory measurement must not be silently substituted for, or confused with, the statute’s broader definition.
- Separate permissible investments must generally cover the face amount of outstanding instruments issued or sold in the United States, unless the commissioner grants the express statutory waiver.
C017–C020, C025; S005–S007. Wyoming Legislature+1
The security runs to the state for claimants and secures faithful receipt, handling, transmission, and payment obligations. For a surety bond, aggregate liability cannot exceed the principal sum. The statute permits direct claimant suit or commissioner suit on claimants’ behalf. It does not impose the collector bond’s Board-notice/30-day waiting procedure. C021. Wyoming Legislature
Permitted substitute deposits are valued at the lower of principal amount or market value and secure the same obligations. The depositor retains the stated interest/dividend rights; substitutions require approval or may be ordered for good cause. C022. Wyoming Legislature
Cancellation requires 30 days’ prior written notice to the commissioner and does not eliminate liability incurred or accrued during that period. Section 106(d) says security remains in place “no longer than” five years after cessation, with possible earlier reduction, elimination, or substitution under the stated conditions. It is not a five-year minimum and is not itself a five-year claim limitation. C023–C024. Wyoming Legislature
2.3 Sandbox bond
Section 40-29-104(h) requires an authorized participant’s consumer-protection bond of at least $10,000, with the actual amount based on risk and subject to adjustment. Unless enforced under §109(b)(ii), the bond is to cancel or expire two years after the end of participation. Section 109 provides regulator enforcement to offset consumer losses and associated administrative process. C027–C029. Wyoming Legislature+2
The examined provisions did not establish a consumer’s standalone direct bond action, a universal claim-allocation formula, a qualifying issuer specification, or complete bond-form language. Those remain instrument/procedure gaps. The sandbox’s waiver list and retained criminal/consumer-law obligations also prevent treating the bond or application as Chapter 14 permission. C030. Wyoming Legislature
2.4 Federal bankruptcy-counseling agency security
A materially different branch arises under 11 U.S.C. §111 and 28 C.F.R. Part 58. It concerns the defined nonprofit applicant/approved agency—not every nonprofit counselor. Section 58.23 applies where that agency offers or has offered debt repayment plans. C031. US Code+1
Let:
- D12 = qualifying disbursements during the 12 months before application;
- A6 = qualifying average daily trust-account balance during the preceding six months.
The required calculations are:
Initial surety amount B0 = max($5,000, min(0.02 × D12, A6))
Initial employee-bond/fidelity amount F0 = max($5,000, 0.50 × B0)
The fidelity calculation uses the surety amount before any state-security offset. Geography, attribution, eligible credits, and actual instrument conditions matter. C033–C036. GovInfo+1
A state-security credit is conditional on qualifying security obtained under the relevant state licensing requirements, protecting the agency’s clients, and written in favor of the state or appropriate agency. A collector bond protecting creditors who placed debts is not automatically a qualifying credit for debtor-client protection. C034. GovInfo
The contractor provisions are also specific. A contractor must satisfy the approved-agency/coverage/own-bond alternatives and required audit access, subject to the stated exceptions. For the specified contractor holding transmission funds five days or less, the prescribed own-bond amount is $500,000. The electronic-transfer exception requires the exact stated conditions, including the specified ACH-system authorization; “payment processor” is not enough. C037. GovInfo+1
Prior U.S. Trustee approval is required for cancellation or amount changes in the surety or employee fidelity security. Stopping new plans does not automatically end protection for existing plans. A waiver may be sought under the written-transfer/60-day/client-notice conditions or the separate undue-hardship determination. C038–C039. eCFR+1
The regulations and instructions establish security requirements, but no complete authenticated generic bond instrument was recovered establishing every consumer’s direct-action right, issuer condition, claim notice, aggregate renewal treatment, or contractual defense. Those details remain held. C040.
2.5 Trustee bond
For an actual trust within the Wyoming Trust Code, §4-10-702 requires a bond only when the court finds it necessary to protect beneficiaries or the trust terms require it and the court has not dispensed with it. The court controls the amount, liabilities, sureties, modification, and termination. A regulated financial institution qualified to do trust business has the stated exception unless trust terms require a bond. C045. Wyoming Legislature
Trustee resignation does not itself discharge prior trustee or surety liability. No universal dollar limit, cancellation form, or bond-claim deadline follows from the mere existence of a trust account. C046. Wyoming Legislature

Claims: C008–C012, C021–C024, C029, C040, C045–C058. Wyoming Legislature+3
Where a statute says “days”, this report preserves that wording. It does not silently convert the period to business days or supply a holiday-extension rule.
The collector’s two-year period is keyed to license revocation or expiration, not discovery of loss, the debtor’s payment, or a generic bond-cancellation date. The effect of uninterrupted annual renewal or replacement on a particular instrument’s coverage period remains a contract/interpretation hold. C011–C013. Wyoming Legislature
No examined collector provision prescribes first-come-first-paid treatment or mandatory pro-rata distribution when eligible losses exceed the remaining penalty. Arithmetic can establish maximum remaining exposure, not the allocation rule.
4. Property, shortfalls, insolvency, and priority
4.1 Separate the assets before discussing priority
| Asset or claim |
Necessary legal inquiry |
| Provider’s general assets |
Ownership, secured claims, insolvency forum, allowed claims and applicable priority |
| Identifiable client-owned/trust property |
Valid ownership/trust relationship, governing law, actual property and tracing |
| Commingled fund |
Respective interests, records, withdrawals, replenishments and applicable tracing principles |
| Missing client money |
Personal claim against responsible parties; possible bond, insurance or Fund claim only if independently eligible |
| Bond proceeds |
Protected claimant, covered breach, instrument period, remaining penalty and enforcement process |
| Insurance proceeds |
Insured risk, claimant rights, exclusions, deductible, limits and actual policy terms |
| Client Protection Fund payment |
Discretionary reimbursement, not ownership of a preexisting insured fund or guaranteed debt |
| Statutory permissible investments |
State statutory protection plus federal bankruptcy/avoidance analysis where applicable |
Wyoming §4-10-509 states that trust property is not subject to the trustee’s personal obligations, even upon insolvency or bankruptcy. But application requires an actual trust and identified trust property; an account label alone supplies neither. The Code’s recordkeeping and separation rules support proof but do not cure missing assets. C047–C048. Wyoming Legislature+2
4.2 Federal bankruptcy prevents an automatic “trust means first paid” conclusion
Section 541(a) generally brings the debtor’s legal and equitable interests into the estate. Section 541(d) distinguishes property in which the debtor holds only legal title from equitable interests belonging to another. Section 544 supplies separate avoidance powers. These provisions require analysis of the actual interest and applicable law; they do not permit a provider to select a priority simply by naming an account “trust.” C059–C060. US Code+1
The Wyoming money-transmitter investment trust arises by statutory wording in the event of bankruptcy. Its interaction with federal estate, bankruptcy-triggered modification, and avoidance rules is a specific unresolved legal issue in this pass. No controlling decision validating or invalidating that particular Wyoming provision was located and read. C026, C060.
Two examined published opinions reinforce the distinction:
- Butner requires state-law property analysis absent a controlling federal reason for a different result; it does not itself determine Wyoming client-fund ownership.
- Foster rejects use of a tracing fiction without considering similarly situated fraud victims. It does not establish a universal prohibition on constructive trusts or a universal allocation formula.
C064–C065; case table below. GovInfo+2
4.3 Nonprofit dissolution is not automatic distribution to clients
Section 17-19-1406 directs winding up, provision for liabilities, return of conditionally held assets, and legally/contractually compliant distribution. Dissolution does not itself transfer title. It therefore does not automatically turn general nonprofit assets into client trust property or erase creditor claims. C061. Wyoming Legislature+1
The separate known/unknown-claim dissolution procedures were inspected only as an interface. They are not converted here into a universal deadline for all bond, trust, insurance, or bankruptcy claims.
4.4 A limited consumer-deposit priority may exist—but not for every program balance
Section 507(a)(7) addresses qualifying unsecured claims of individuals arising from prepetition deposits for personal/family/household property or services not delivered or provided. The authenticated adjusted ceiling is $3,800, applicable to cases commenced on or after April 1, 2025. It is a priority ceiling, not a guaranteed payment or universal cap on the underlying claim. C062. US Code+1
Money held solely for creditor payment is not automatically a purchase deposit for the provider’s unperformed services. Nor should the same money simultaneously be treated as proven third-party property outside the estate and as a fully duplicative estate claim.
Section 726’s Chapter 7 distribution and within-class rules apply to that federal distribution context. They do not establish a pro-rata collector-bond rule. C063. US Code
5. Attorney safeguards, insurance, and the Client Protection Fund
5.1 Professional safeguards are not insurance
The current Rule 1.15 body expressly bears the effective date September 21, 2026. Its separation, unearned-advance, disputed-property and accounting provisions were freshly read for this security interface. The older body printed in the compilation was not substituted for it. The separate July 21, 2026 amendment order remains unrecovered. C041–C042. Wyoming Courts+1
The overdraft-notification arrangement is a monitoring safeguard. The rule expressly states that it does not create a third-party-beneficiary contract or the described duty of care. Required institution approval and deposit insurance are not malpractice or fidelity coverage for lawyer theft. C043, C066. Wyoming Courts+1
5.2 Fund eligibility and exclusions
The court rules require a loss caused by defined lawyer dishonesty arising from a lawyer-client relationship. The definition includes theft, embezzlement, conversion and the specified failure to refund an advance. Death or incapacity alone does not eliminate the rule’s eligibility inquiry. C049. Wyoming Courts+1
The claim must be filed within four years after the claimant knew or should have known of the dishonest conduct. Exclusions include specified relatives and business associates, covered bond/insurance losses to the extent covered, specified financial-institution losses, controlled entities, governmental entities, nonrelationship investments, and consequential/incidental losses. The rules also contain a discretionary hardship/special-circumstances provision. C050–C052. Wyoming Courts
The rules require satisfactory evidence and disclosure of recovery attempts and other coverage. They do not establish a universal prerequisite that every claimant first obtain a civil judgment or criminal conviction. The Committee may determine dishonesty for Fund purposes without making a disciplinary determination. C053, C056. Wyoming Courts
5.3 The $15,000 number is not an absolute cap
Rule 6 permits the Committee to fix maximum reimbursements from time to time and gives it discretion over amount, timing and installments. It prohibits approval of more than $15,000 to one claimant per calendar year without prior Board of Officers and Commissioners approval.
That is an approval threshold—not an authenticated lifetime cap, universal per-loss cap, or guaranteed annual payment. No separate current policy establishing a different maximum or per-lawyer aggregate was recovered. Rule 7 expressly denies a legal right to reimbursement. C054–C055. Wyoming Courts
The claimant or lawyer may request written reconsideration within 30 days under Rule 5(g); the rules then provide finality/no further appeal. This is the Fund’s internal rule, not a conclusion about every conceivable external legal challenge. C056.
5.4 Later recoveries and Fund reimbursement
Rule 10 requires assignment/subrogation to the extent of Fund payment. Later recovery triggers repayment only to the extent it exceeds the claimant’s unreimbursed loss, capped by the Fund’s payment. This prevents double recovery without requiring repayment of every later dollar regardless of the remaining loss. C057. Wyoming Courts
5.5 Insurance-failure and deposit-insurance limits
Wyoming’s Insurance Guaranty Association Act expressly excludes surety from its applicability. A surety’s failure therefore cannot be assumed to activate that Act. This pass does not decide every fidelity-policy classification or other insurer-insolvency regime. C067. Wyoming Legislature
Under the freshly read FDIC regulations, fiduciary recognition and pass-through treatment require the applicable ownership disclosures and ascertainable beneficial interests. Coverage is measured as if deposited by the principal under the applicable category; an intermediary does not create a new insurance category or automatic separate coverage. Actual account facts and aggregation remain held. C066. eCFR+1
6. Public forms, electronic procedures, and authenticated limits
6.1 Procedure established without an account
Official collection and banking pages establish NMLS application/renewal routes. They do not, by themselves, prove that a particular electronic bond form, cancellation workflow, issuer, or blanket bond configuration is accepted. No authenticated Wyoming collector or transmitter blank bond was recovered. C069. Wyoming Collection Agency Board+2
The Secretary of State sandbox rules were read in full. They are a final two-page rule package effective January 1, 2020, but they do not supply the missing detailed consumer-protection bond instrument. The public application page directs a person to obtain a form by contacting the office; no contact was made. C030, C069. Wyoming Secretary of State+2
6.2 Complete public blank form actually examined
The five-page Client Protection Fund Statement of Claim, labeled “Revised 10/25,” was read in full, including page images. It is a claim form, not an insurance policy or bond.
| Form portion |
Fields/undertakings actually examined |
| Claimant information |
Name, address, city/state/ZIP, telephone contacts, occupation, employer, work/contact information and email; office-use claim-number/receipt/amount fields |
| Questions 1–5 |
Lawyer identity; services; efforts to recover; amounts paid and supporting evidence; written/oral fee agreement |
| Questions 6–9 |
Amount/type/date of loss; discovery; alleged diversion and persons with knowledge |
| Questions 10–14 |
Current lawyer; litigation/judgment; bond/insurance/other recovery; relevant company/employment relationships; additional facts |
| Final-page undertakings |
Sworn statement; cooperation/assignment; release/subrogation; certification; signature/date lines and notarial acknowledgment |
Material document discrepancies: The instructions refer to three signature places, while the final page displays four signature lines. Rule 4’s enumerated information includes a Social Security number, but the examined form did not supply a corresponding field. The form’s broader repayment wording must be read with Rule 10(e)’s specific no-double-recovery formula. The form’s terminology concerning approval of an assisting lawyer’s compensation differs from Rule 12’s Committee wording. These are preserved as form/rule reconciliation issues—not instructions to collect or submit personal information. C058; S012–S014. Wyoming State Bar+3
The U.S. Trustee instructions were selectively read for security calculations and attachments. They are not represented as a fully examined application or generic bond form. Their example tables support the calculation methodology but do not establish the legal status of any actual agency. Department of Justice+1

| Butner v. United States, U.S. Supreme Court, February21,1979,440U.S.48 |
Second mortgagee claimed rents collected during bankruptcy. Bankruptcy judge denied secured treatment; district court reversed; Fourth Circuit restored denial. |
Property/security interests ordinarily derive from state law absent a controlling federal reason otherwise. Supreme Court declined to redecide the particular North Carolina issue and affirmed. Relevant pp.55,57–58. |
Official reporter recovered; selected majority facts, reasoning and disposition read, with images. Historical Bankruptcy Act context. Foster’s later reliance was actually read; no comprehensive citator. |

Ponzi-scheme funds commingled; one investor received postpetition transfers. Bankruptcy court imposed constructive trust using lowest-intermediate-balance reasoning; district court affirmed. |
Bankruptcy court failed to assess whether tracing fiction unfairly elevated one victim over similarly situated creditors. Reversed and remanded. Footnote2 expressly declined the broader per-se argument. |
Entire majority and footnotes read from reproduced judicial text. Colorado trust law, not a Wyoming-specific trust holding. No complete later-history review. |

E. Worked hypothetical security and failure branches
All amounts are USD, rounded to cents. No real provider, bond, account, claimant, policy, award, or calendar is assumed.
Model 1 — Collector bond versus prohibited debtor-side adjuster
Branch A: creditor-side collector
Assumptions: A creditor places an $8,000 debt with a properly classified collector. The collector actually receives $6,000. A valid agreement permits a $600 deduction; this is an assumed lawful deduction, not a fee approval.
Collected proceeds = $6,000.00
Assumed authorized collection charge = $600.00
Amount owed to placing creditor = $6,000 − $600 = $5,400.00
The $5,400 is within the type of obligation §33-11-108(b) secures, subject to coverage period, proof, prior payments, defenses and the statutory claim process.
Required generic process: Present the bond claim to the Board; the Board notifies the surety; the statutory suit branch arises if the claim remains unpaid/unsettled after the specified 30-day period.
Missing evidence: Actual bond, covered period, valid deduction, collection and nonpayment, remaining aggregate, and license-expiration/revocation dates. No recovery is assumed.
Branch B: debtor-side adjustment company
A debtor instead pays $6,000 to a nonexcluded commercial company to settle the debtor’s obligations. The company presents a collection bond.
Result: The collection bond does not establish Chapter14 permission. Nor is that debtor automatically a claimant who placed a debt for collection under §108(b).
This does not mean the debtor has no possible remedy. It means this collector-bond theory and lawful-provider premise have not been established. C001–C003,C008–C011.
Model 2 — Two eligible collector claimants after prior bond payments
Assumptions: One applicable surety bond has a $10,000 aggregate penalty. Prior valid payments under that same aggregate total $3,000. Claimants A and B have otherwise eligible losses of $5,000 and $4,000.
Original aggregate = $10,000.00
Prior aggregate payments = $3,000.00
Remaining possible aggregate exposure = $10,000 − $3,000 = $7,000.00
New eligible losses = $5,000 + $4,000 = $9,000.00
Loss exceeding remaining aggregate = $9,000 − $7,000 = $2,000.00
Let x and y be amounts ultimately payable to A and B:
0 ≤ x ≤ $5,000
0 ≤ y ≤ $4,000
x + y ≤ $7,000
No statutory pro-rata or first-filed allocation was established. The arithmetic therefore does not select x or y.
Conservation: Prior payments plus all new payments cannot exceed the authenticated $10,000 aggregate under the assumed single instrument.
Missing evidence: Instrument period, renewal/reinstatement terms, competing claims, valid prior payments, allocation procedure and adjudication. C009,C011–C013.
Model 3 — Lawyer-owned assets versus client shortfall and Fund eligibility
Inputs:
- Client’s established beneficial entitlement: $20,000.00.
- Identifiable client money actually returned: $12,000.00.
- Remaining shortfall: $8,000.00.
$20,000 − $12,000 = $8,000.00
The $8,000 does not become insured merely because the missing money once belonged in trust.
Eligibility branch
Assume the $8,000 resulted from defined lawyer dishonesty in a lawyer-client relationship, the claim is timely, and no exclusion or other coverage defeats eligibility. The Fund still retains discretion.
For calculation only, assume a Fund payment of $5,000.00:
Unreimbursed loss = $8,000 − $5,000 = $3,000.00
Later, the claimant recovers $4,000.00 from another source:
Excess above remaining loss = $4,000 − $3,000 = $1,000.00
Repayment to Fund = min($5,000, $1,000) = $1,000.00
Conservation:
Client total = $12,000 + $5,000 + $4,000 − $1,000 = $20,000.00
Fund net outlay = $5,000 − $1,000 = $4,000.00
This applies Rule10(e)’s stated relationship; it does not assume a real award.
Failure branches
An ordinary unresolved fee dispute, negligence allegation, death alone, covered insurance loss, or excluded investment does not automatically satisfy Fund eligibility. The hypothetical $5,000 payment is neither mandatory nor a finding that the $15,000 approval threshold is a coverage cap. C042,C049–C058.
Model 4 — Nonprofit insolvency with mixed and missing property
Inputs:
- Customer A’s asserted entrusted balance: $18,000.00.
- Customer B’s asserted entrusted balance: $12,000.00.
- Total asserted customer property: $30,000.00.
- Current mixed account: $20,000.00.
- Other provider assets: $5,000.00.
- Other creditor claims and expenses: unknown.
Asserted customer balances = $18,000 + $12,000 = $30,000.00
Visible assets in hypothetical = $20,000 + $5,000 = $25,000.00
Arithmetic difference = $30,000 − $25,000 = $5,000.00
That $5,000 difference is not a completed legal shortfall allocation. The $5,000 of general assets may be subject to other valid claims and priorities.
Proven-property branch
If a valid trust and tracing establish $20,000 as customer equitable property, §541(d) and applicable state law require that interest to be analyzed accordingly. Allocation between A and B still requires proof and governing law.
Unproved-property branch
If the claimed trust, records or tracing fail, the customers may instead have claims against estate property, subject to allowance, security and priority rules. Neither a nonprofit label nor the account’s “trust” title resolves that question.
Separate service-deposit subexample
Assume an individual has a different, qualifying $5,000 prepetition deposit for unprovided personal services in a case commenced after April1,2025:
Potential §507(a)(7) priority portion = min($5,000, $3,800) = $3,800.00
Potential nonpriority remainder = $5,000 − $3,800 = $1,200.00
Both remain subject to allowance and available assets. This does not classify the original $30,000 of creditor-payment funds as service deposits or authorize double recovery. C047–C048,C059–C065.
Model 5 — Transmitter security, capital and investments are separate
Assume the relevant security calculation base is $12,000.00, properly established under the applicable statute/rule and accepted measurement period.
2.5 × $12,000 = $30,000.00
Security = min($500,000, max($10,000, $30,000)) = $30,000.00
The separate net-worth requirement is $25,000.00. A separate permissible-investment calculation remains necessary using its own statutory base and any actual waiver.
Boundary checks:
Base $2,000 → 2.5 × $2,000 = $5,000 → security floor $10,000
Base $300,000 → 2.5 × $300,000 = $750,000 → statutory ceiling $500,000
These amounts are not added together as a guaranteed consumer payout. An impaired-condition order, actual outstanding instruments, renewal measurement, investments, security terms and competing claims remain necessary facts. C018–C026.
Model 6 — Federal nonprofit security and a conditional state credit
Assume an agency actually within §58.23 has:
- Qualifying 12-month disbursements: $1,000,000.00.
- Qualifying six-month average daily balance: $30,000.00.
2% × $1,000,000 = $20,000.00
Lesser of $20,000 and $30,000 = $20,000.00
B0 = max($5,000, $20,000) = $20,000.00
F0 = max($5,000, 50% × $20,000) = $10,000.00
Now assume a separately verified qualifying state security credit of $8,000.00:
Federal surety remaining = $20,000 − $8,000 = $12,000.00
The fidelity baseline remains $10,000.00, not $6,000.00, because it is calculated before the surety credit.
No Wyoming collector bond is assumed to qualify for that credit. Actual protected clients, obligee, state licensing requirement, coverage and approval remain required. C031–C039.

H. Read/failure log and researcher self-check
H1. Material failed or limited routes
H2. Actual read and currentness limits
Complete within the identified unit: Chapter14; the collector bond and claim-limit provisions; listed reproduced collection-rule sections; sandbox Secretary rules; Client Protection Fund Rules1–13; all five pages of the Fund blank form; relevant §58.18 and §58.23 operative provisions; Foster’s majority and footnotes.
Selected reads: Larger Wyoming titles, professional rules, Rule10 order provisions, bankruptcy Code sections, federal final rulemaking, U.S. Trustee instructions/FAQ, FDIC provisions, and Butner’s majority. The entire larger code volumes and rulemaking records were not read.
Version limits: Wyoming compilation currency was not independently certified through October27. Relevant eCFR displays ran through October23. OLRC bankruptcy bodies displayed laws through October15. The 2025 bankruptcy adjustment was authenticated from the published notice, not calculated from inflation. Collector/transmitter rule reproductions do not substitute for an authenticated complete adoption chain.
Historical holds preserved: The 1989 exclusion act’s exact approval/effective dates were not repaired; the 1957 act remains unread. No unprovided coordinator original, hash, import, or review record was claimed.
Guidance: No CFPB circular, bulletin or advisory was relied upon, so no withdrawn CFPB guidance was used as current authority. Agency instructions were kept distinct from statutes, rules and actual instruments.
Not done: No roster, identifier, provider, insurer, lawyer, license, account, policy, claim, property, borrower, docket or case-status lookup; no filing, contact, record request, purchase, account change, browser-control workaround, local write, hash, publication, or independent review.
Final determination
The authenticated protections are specific and conditional. The strongest established distinctions are:
- collector security protects the defined creditor-side proceeds obligation;
- transmitter and sandbox security have different beneficiaries, enforcement mechanisms and continuation rules;
- federal approved-agency surety/fidelity requirements do not attach to all nonprofits;
- lawyer safekeeping rules and the Client Protection Fund are not substitutes for insurance;
- trust ownership, bankruptcy exclusion, claim priority and actual recovery require separate proof.
The unresolved instrument, official-adoption, tracing, coverage, currentness and broader-state questions remain expressly held.
