S_MS PASS-02 — focused precision and currentness addendum

Actual research/access date: October 25, 2026, America/Los_Angeles. Relationship to PASS-01: bounded correction only. PASS-01 remains preserved except for the replacement language, source-use qualifications, and claim/coverage deltas below. This is not an independent review, a full Mississippi audit, provider approval, state acceptance, parent-project acceptance, or A066 acceptance.

1. Exact federal timing replacements

Replacement for A.19 and S_MS-P1-C037

When the Telemarketing Sales Rule applies to goods or services represented as removing derogatory information from, or improving, a person’s credit history, credit record, or credit rating, 16 C.F.R. § 310.4(a)(2) prohibits requesting or receiving payment until both conditions have been satisfied:

  1. The entire period during which the seller represented that all of the goods or services would be provided has expired; and
  2. The seller has provided the person documentation in the form of a consumer report from a consumer reporting agency demonstrating that the promised results were achieved, and that report was issued more than six months after those results were achieved.

The rule also expressly preserves the Fair Credit Reporting Act requirement that a consumer report may be obtained only for a specified permissible purpose. This is a conditional federal telemarketing rule—not universal credit-repair coverage, not Mississippi fee authority, and not a determination that CROA applies to every debt-relief representation. The separate CROA definitions, exclusions, and full-performance issue preserved in PASS-01 remain unresolved as applied to any particular model. The eCFR text was freshly read on October 25, 2026; it displayed Title 16 as current through October 22, 2026. eCFR+2

Replacement for S_MS-P1-C030

When 16 C.F.R. § 310.4(a)(5) applies, a seller or telemarketer may not request or receive a debt-relief fee until:

  • The seller or telemarketer has renegotiated, settled, reduced, or otherwise altered at least one debt pursuant to a settlement agreement, debt-management plan, or other valid contractual agreement executed by the customer;
  • The customer has made at least one payment pursuant to that agreement between the customer and the creditor or debt collector; and
  • To the extent enrolled debts are altered individually, the fee satisfies the complete proportional-balance or uniform-percentage-of-savings allocation requirements in § 310.4(a)(5)(i)(C).

This remains conditional federal timing. It does not establish universal TSR coverage, Mississippi permission to charge a fee, or satisfaction of Mississippi’s separate for-profit exclusion. eCFR+2

Example preservation: E01–E03 remain state-only numerical illustrations and do not establish federal earning or collection timing where the TSR, CROA, or another rule independently applies. E04–E11 and all arithmetic remain unchanged.

2. HB 1265 currentness follow-up

Bounded conclusion

The present record strongly supports the qualified conclusion that the Mississippi Debt Management Services Act did not expire on July 1, 2026. The Mississippi Department of Banking and Consumer Finance’s actually read 2026 legislative summary states that HB 1265 removed the July 1, 2026 repeal date and became effective from and after July 1, 2026. The summary is an official agency enactment summary, although it is not the complete operative enrolled act. Its PDF metadata/title string referring to “2019” does not displace the document’s visible body heading, “Legislative Updates: 2026 Regular Session,” or its HB 1265 entry. MS Banking & Consumer Finance+1

Official Mississippi Legislature search rendering independently exposes the SG bill title and Section 1’s repeal of § 81-22-31; a separate official search result exposes the July 1, 2026 effective clause. The Legislature’s post-session summary search rendering also reports “Signed 3/30/26” and “Effective 7/1/26.” Those are official-domain search-rendered records, not a freshly opened status XML or signed enrolled image. Bill Status+3

The official SG PDF, SG HTML, and bill-history XML each returned 502 when directly opened on October 25, 2026. A full LegiScan-hosted reproduction, labeled “Enrolled” by the host while retaining the Legislature document heading “As Sent to Governor,” reproduces Section 1 repealing § 81-22-31, Section 3 bringing forward § 81-22-3, Section 8 bringing forward § 81-22-13, and Section 17 making the act effective July 1, 2026. That reproduction supports text comparison but is not itself an official signed session law, authenticated code page, or primary status record. LegiScan

Accordingly:

  • Continuation after July 1, 2026 is strongly supported and is not held as wholly unknown.
  • The exact complete current official codification of all Chapter 22 provisions has not been audited.
  • No official signed/enrolled image, session-law chapter number, or usable primary bill-history/status record was recovered.
  • This pass does not claim that no later amendment, order, regulation, or bulletin exists.
  • Within the specifically compared text, the reproduced 2026 SG versions of § 81-22-3 and § 81-22-13 show no substantive change from the older DBCF compilation; that comparison is narrower than a complete official version audit.

Minimal version, effectiveness, and pinpoint matrix

Record/version Exact relevant pinpoint What it establishes Limitation
DBCF agency compilation hosted at the 2020 URL Thirteen PDF pages. § 81-22-3 occupies PDF pages 2–3, indices 1–2; § 81-22-13 is on PDF page 7, index 6; § 81-22-31 is on PDF page 13, index 12. Its histories run through 2019, and its headings state a July 1, 2022 repeal. Historical agency compilation and comparison text for the definitions, exclusions, and fee section. MS Banking & Consumer Finance+3 It is not a current 2026 compilation. Its obsolete 2022 repeal headings cannot establish present effectiveness.
2025 secondary code mirror used in P1 P1 S006, §§ 81-22-3 and 81-22-13; displayed the then-existing July 1, 2026 sunset framework. Preserved intermediate secondary reproduction between the 2019 agency compilation and HB 1265. Not freshly reread in P2; secondary source; not used alone for the currentness conclusion.
Official Mississippi Legislature HB 1265 SG PDF/HTML Title and Section 1 are visible through official search rendering: § 81-22-31 is repealed. Official search also exposes the Section 17 July 1, 2026 effective language and portions of § 81-22-13. Official-domain confirmation of the bill’s repeal mechanism, effective clause, and carried-forward fee text. Bill Status+2 Search-rendered only. Direct SG PDF and HTML returned 502; the entire document was not read from the official server.
DBCF Legislative Updates: 2026 Regular Session PDF page 1/index 0, body lines 9–11: HB 1265 removes the July 1, 2026 repeal date and is effective from and after July 1, 2026. Strong official-agency support that the Act continued after July 1, 2026. MS Banking & Consumer Finance+1 Enactment summary, not complete enacted wording or authenticated code.
Mississippi Legislature, 2026 Summary of General Legislation Official search rendering: “Signed 3/30/26,” “Effective 7/1/26,” and description of repeal of the sunset provision. Official legislative-summary corroboration of signature and effective dates. Mississippi Legislature+1 Search-rendered only; underlying 269-page PDF was not successfully opened at the relevant page. Not a substitute for the bill-history XML or signed enrolled act.
LegiScan-hosted full HB 1265 reproduction Lines 41–54: Legislature heading and § 1 repeal; lines 60–99: brought-forward § 81-22-3; lines 135–144: brought-forward § 81-22-13; line 220: July 1, 2026 effective clause. Complete readable comparison copy of the SG legislative text. It reproduces the same relevant § 81-22-3 and § 81-22-13 language used in P1. LegiScan Nonofficial host. The host labels it “Enrolled,” but the reproduced document itself says “As Sent to Governor.” Host editorial status was not treated as enacted law.
Resulting P2 currentness determination DBCF 2026 summary + official Legislature search rendering + complete SG reproduction. High confidence that § 81-22-31 was repealed effective July 1, 2026 and Chapter 22 did not sunset then. Only medium-high confidence as to the complete present text of every carried-forward provision until an authenticated current code, signed act, or official complete SG copy is read.

Necessary § 81-22-3 and § 81-22-13 comparison

The complete LegiScan-hosted SG reproduction carries forward the relevant definitions and exclusions in § 81-22-3, including subsection (c)(xi), without an observed textual difference from the complete § 81-22-3 appearing in the older DBCF compilation. It likewise carries forward the complete fixed-fee text of § 81-22-13 without an observed textual difference from that older compilation. LegiScan+3

That comparison supports retaining P1’s classification and fixed-fee text. It does not establish that no legislation or regulatory action occurred after HB 1265, and it does not convert the old DBCF compilation into a current source.

P1 source/use Corrected P2 pinpoint and scope Permitted conclusion Required limitation
P1 S010 / C035 — Administrative Code The PDF is 20 pages. Title 5, Part 4, Rule 1.3(7)(a)–(d) appears on printed pages 5–6, PDF indices 4–5, parsed lines 171–198. It authorizes complaint work, rules, licensee examinations, and nonlicensee investigations. The $300–$600 amount is per in-state office/location, plus actual expense for records outside Mississippi; ordinary examinations are no more frequent than once in two years absent cause. Mississippi Secretary of State+4 Government/licensee examination costs and enforcement powers. These are not consumer fees. No exhaustive search of all administrative rules, amendments, adoption records, orders, or present codification history was performed.
P1 S009 / C020 — 2026 renewal memo Four PDF pages. Header on printed page 1/PDF index 0: October 30, 2025. Renewals were to be submitted November 1–December 31, 2025 to obtain a 2026 license. Selected fee material is on printed page 2/PDF index 1: $475 debt-management renewal, plus $1 EOC, and $120 NMLS company processing fee. MS Banking & Consumer Finance+4 Dated 2026-cycle operational procedure and government/NMLS charges. It is not a 2027 schedule, not a consumer-fee rule, and not proof of any provider’s current status. P1’s “pp. 1–2” description meant selected relevant pages, not that the PDF had only two pages.
P1 S007 — Consumer Finance page Complete debt-management body at lines 113–136: NMLS route, January 1–December 31 license period, $750 initial/$475 renewal, $50,000 security alternatives, and eleven listed application requirements. MS Banking & Consumer Finance Current DBCF public application instructions as displayed October 25, 2026. The actual NMLS checklist, an applicant file, and any provider-specific NMLS result were not read. Procedure does not itself prove legal permission or approval.
P1 S008 — licensee list One-page PDF; all 28 company rows and the “Licensee List as of 02/09/2026” footer were read. Numerous out-of-state addresses demonstrate a historical remote-provider licensing route. MS Banking & Consumer Finance+1 Historical evidence that DBCF issued this license type to remote providers as of February 9, 2026. It cannot establish any listed entity’s status on October 25, 2026 and is not current provider approval.
P1 S001 — DBCF Act compilation Thirteen pages, not eleven. Complete §§ 81-22-3, -5, -7, -9, -11, and -13 were read; selected fair-share material in § 81-22-15 and complete § 81-22-28 were also observed; § 81-22-31 appears on the final page. Historical wording and section comparison. It is a 2019-history compilation with obsolete 2022 repeal headings, not current operative 2026 proof.

S_MS-P2-C008 / P1 C018/C019 source-use clarification DBCF’s current webpage demonstrates the public application route and listed minimum requirements; the February 9, 2026 list demonstrates historical remote-provider licensing. P1 C009 and C011 are unchanged: the for-profit exclusion still requires for-profit status plus all three statutory conditions, and “regulated by the FTC” remains unresolved. Nothing in P2 converts the exclusion into a license, approval, or unlimited-fee pathway.

It authorizes complaint work, rules, licensee examinations, and nonlicensee investigations. The $300–$600 amount is per in-state office/location, plus actual expense for records outside Mississippi; ordinary examinations are no more frequent than once in two years absent cause. Mississippi Secretary of State +4Government/licensee examination costs and enforcement powers. These are not consumer fees. Complete §§ 81-22-3, -5, -7, -9, -11, and -13 were read; selected fair-share material in § 81-22-15 and complete § 81-22-28 were also observed; § 81-22-31 appears on the final page.Historical wording and section comparison. It is a 2019-history compilation with obsolete 2022 repeal headings, not current operative 2026 proof.

What was examined—and what is still missing

The saved component-level coverage record keeps answered, partial, blank and unresolved branches distinct. A coverage label is not acceptance of a whole subject or jurisdiction.

Retrieve a usable official SG/approved/enrolled image and bill-history/status record; identify any session-law chapter number; compare §§ 1, 3, 8, and 17 against S_MS-P2-S005; inspect an authenticated current code; then conduct a bounded post-HB-1265 amendment check for §§ 81-22-3 and -13. Until then, do not downgrade the strong agency-supported continuation conclusion or elevate it to a complete codification audit.

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
