SettleADebt R094 PASS-02

The § 103(e)/(f) redesignation and retained references in §§ 901(b) and 902

The original-publication gap is closed for the selected redesignating command and its enacting wrapper. The official published Act directly establishes that Congress redesignated former § 103(e)–(i) as § 103(f)–(j), respectively, and separately inserted a new subsection (e). The current official Code bodies examined here still print “section 103(e)” in § 901(b) and § 902(1) and (5). Their editorial reference notes explain the redesignation. The original command authenticates that history; it does not, within the clauses read, amend those three retained references or authorize this report to replace them with “103(f).” C001–C013 below. govinfo.gov+5

This is an authentication improvement, not an established substantive correction to pass-01. The selected later technical-correction clauses examined here concern § 103(a) and § 901(a). They do not supply a replacement of the retained references at issue. The broader amendment chain, operative construction, and every actual Chapter 9 or other bankruptcy outcome remain unresolved. 2. Substantive findings

2.1 The current literal references remain visible

The fresh current-text read establishes the following distinct propositions:

Current location Complete material relationship preserved What this does not establish
§ 103(e) The current subsection concerns the application of Chapter 7, Subchapter V, to the specified liquidation category: an uninsured State member bank, or a corporation organized under Federal Reserve Act § 25A, with the stated multilateral-clearing-organization language and reference to FDICIA § 409. No actual category, eligibility, or operative effect of the remote references is determined. The current editorial note concerning the remote § 409 reference is not an independently authenticated repeal/application analysis in this pass.
§ 103(f) Subject to the exception for § 901, only Chapters 1 and 9 apply in a case under Chapter 9. No complete list of incorporated provisions, Chapter 9 eligibility rule, or actual applicability outcome is supplied.
§ 901(b) A term in a Title 11 section made applicable in a Chapter 9 case by § 901(a) or “section 103(e)” has the meaning defined for that applicable section, unless otherwise defined in § 902. The printed reference is preserved. The report does not silently substitute § 103(f).
§ 902(1) “Property of the estate,” when used in a section made applicable in the Chapter 9 case by “section 103(e)” or § 901, means property of the debtor. This is not an unrestricted definition of estate property for every chapter or purpose.
§ 902(5) “Trustee,” in the same stated incorporation context using “section 103(e)” or § 901, means debtor, except as provided in § 926. The exception is retained. Its complete operation is not analyzed, and no actual trustee/debtor-role determination is made.

These are current-body observations, supported by the selected official HTML clauses. The explanatory notes appear under “Editorial Notes—References in Text.” They say that the referenced former § 103(e) was redesignated § 103(f) and that a new § 103(e) was added by the cited 2000 Act. That explanation identifies the historical issue; it is not a separately enacted replacement command printed in §§ 901(b) or 902. C002–C007. uscode.house.gov+4

2.2 The original publication authenticates two separate commands

The correct route through the consolidated publication is:

Level Authenticated identity or command Exact original pinpoint
Enacting wrapper P.L. 106-554 § 1(a) enacts the provisions of the listed bills; paragraph (5) identifies H.R. 5660 as introduced on December 14, 2000. 114 Stat. 2763 / P0
Publication instruction Section 1(b) directs the Archivist to include the incorporated bill texts as appendixes in the published Act. 114 Stat. 2763 / P0
Appendix identification The publication identifies Appendix E—H.R. 5660; its short title is the Commodity Futures Modernization Act of 2000. 114 Stat. 2763A-365 / P366
Relevant location Title I, § 112 is “Derivatives clearing”; subsection (c) addresses technical and conforming amendments to Title 11. 2763A-391 / P392; 2763A-393 / P394
Redesignation Section 112(c)(5)(A)(i) moves former subsections (e) through (i) to (f) through (j), respectively. 2763A-394 / P395
Addition Section 112(c)(5)(A)(ii) inserts a new subsection (e) after subsection (d) and prints its complete scope text. 2763A-394 / P395

The respective label mapping is:

Former label Label assigned by the 2000 command
§ 103(e) § 103(f)
§ 103(f) § 103(g)
§ 103(g) § 103(h)
§ 103(h) § 103(i)
§ 103(i) § 103(j)

This is a historical mapping of the 2000 command, not a statement that every later subsection label or body remained unchanged. Nor is the new subsection (e) merely a new caption attached to the former Chapter 9 clause: the Act separately commands redesignation and insertion. C008–C013. govinfo.gov+3

2.3 Enactment is authenticated; broader application is not inferred

The approved Act directly authenticates December 21, 2000 as the enactment/approval date. The selected wrapper and redesignating command contain no express waiting period, case-filing cutoff, or future event that must occur before the command operates. The conditions printed in the newly inserted § 103(e) describe that subsection’s scope; they are not textually framed as a future event that must occur before the separate redesignation instruction can be carried out. C012–C014. govinfo.gov+2

That does not justify a broader assertion about every pending matter, retroactivity question, remote incorporation, or provision in the consolidated Act. The identified Appendix E construction and savings clauses were read. They concern preservation of laws governing the SEC and the absence of an implied classification of swap agreements; they do not provide a replacement instruction for the retained §§ 901/902 references. No separate case-application date is calculated or declared. C014–C015. govinfo.gov+1

2.4 The selected later correction lead does not resolve the retained references

The 2010 Act’s selected commands are precise:

  • § 2(a)(2) changes “362(n)” to “362(o)” in § 103(a).
  • § 2(a)(29) inserts references to §§ 333 and 351 in § 901(a).

Those clauses do not amend § 103(e)/(f), § 901(b), or § 902(1)/(5). This is a bounded finding about the adopted commands actually read, not proof that no other amendment or construction exists. C016–C018. govinfo.gov+1

R094-P2-C001 The selected OLRC pages display a compilation through P.L. 119-134, October 20, 2026. S001, each page’s currency statement. Actual access was October 28, 2026 PDT. No exhaustive post-cutoff or judicial audit follows. uscode.house.gov+2
R094-P2-C002 Current § 103(e) contains the specified Chapter 7/Subchapter V liquidation-scope clause, including the uninsured-State-member-bank/corporation alternatives, clearing-organization language, and remote statutory references. S001 § 103(e), complete clause. It is read for text identity, not to classify an entity or complete the incorporated banking regime. uscode.house.gov
R094-P2-C003 Current § 103(f) states the Chapters 1-and-9 rule for a Chapter 9 case, except as provided in § 901. S001 § 103(f), complete clause. The § 901 exception is preserved; no entire Chapter 9 applicability result is inferred. uscode.house.gov
R094-P2-C004 Current § 901(b) retains “section 103(e)” and supplies a term-meaning rule for the stated incorporated sections, subject to definitions otherwise supplied by § 902. S001 § 901(b), complete sentence. Both incorporation alternatives and the § 902 qualification are material. uscode.house.gov
R094-P2-C005 Current § 902(1) retains “section 103(e)” and defines “property of the estate” as property of the debtor in its specified Chapter 9 incorporation context. S001 § 902 introductory language and paragraph (1). No general estate-property rule for every chapter is asserted. uscode.house.gov
R094-P2-C006 Current § 902(5) retains the same reference and defines “trustee” as debtor in that context, except as provided in § 926. S001 § 902(5), complete paragraph. The § 926 exception remains express and substantively unexamined. uscode.house.gov
R094-P2-C007 The editorial reference notes identify the former § 103(e) → § 103(f) redesignation and addition of a new subsection (e). S001 §§ 901 and 902, “References in Text”; § 103, 2000 amendment note. This authenticates what the notes say; the original command is separately authenticated by S002. uscode.house.gov+2
R094-P2-C008 Outer § 1(a)(5) of P.L. 106-554 enacts H.R. 5660 in the version introduced December 14, 2000. S002 § 1(a) opening and (5), 114 Stat. 2763/P0. The separate exception in paragraph (4) concerns a different listed bill and is not transferred to paragraph (5). govinfo.gov
R094-P2-C009 Section 1(b) directs publication of the incorporated texts as appendixes, and the approval line states December 21, 2000. S002 § 1(b), 2763/P0; approval and endnote, 2764/P1. The publication instruction and approval date are distinct from the date of a particular printed or digital copy. No broader evidentiary rule under 1 U.S.C. § 112 is asserted. govinfo.gov+1
R094-P2-C010 The relevant incorporated text is Appendix E—H.R. 5660, titled the Commodity Futures Modernization Act of 2000; the relevant § 112 is “Derivatives clearing.” S002 Appendix E opening, 2763A-365/P366; § 112 heading, 2763A-391/P392; § 112(c) heading, 2763A-393/P394. Other appendixes’ identically numbered sections are not used. govinfo.gov+2
R094-P2-C011 The complete enacted § 112(c)(5)(A)(i) redesignates former subsections (e)–(i) as (f)–(j), respectively. S002, 2763A-394/P395. This directly authenticates the historical label changes previously supported only by the compiled note in the supplied row. govinfo.gov
R094-P2-C012 The next clause separately inserts a new subsection (e) after subsection (d) and supplies its complete scope text. S002 § 112(c)(5)(A)(ii), 2763A-394/P395. The inserted text corresponds to the selected current § 103(e) body. This comparison does not certify an uninterrupted amendment history. govinfo.gov+1
R094-P2-C013 The selected § 112(c)(5)(A) command amends § 103; it does not contain an amendment to the references printed in § 901(b) or § 902(1)/(5). S002, complete § 112(c)(5)(A), compared with S001’s literal clauses. This is a bounded command-level observation, not an Act-wide or all-later-law absence claim.
R094-P2-C014 The selected wrapper and redesignating command contain no express waiting period, case-filing cutoff, or future activation event; December 21, 2000 is directly authenticated as approval/enactment. S002 § 1(a)–(b), approval line, and § 112(c)(5)(A). No independent pending-case, retroactivity, or universal application conclusion is drawn. Scope predicates inside the inserted subsection are kept separate from the redesignating command.
R094-P2-C015 The complete identified construction/savings clauses do not themselves rewrite the retained references or state a case-commencement rule for this redesignation. S002 Appendix E § 122, 2763A-405/P406; § 304, 2763A-457/P458. Their SEC-law and swap-classification limits are acknowledged without completing those separate regimes. govinfo.gov+1
R094-P2-C016 P.L. 111-327 § 2(a)(2) changes a reference in § 103(a) from 362(n) to 362(o). S003, 124 Stat. 3557/P0, complete selected command and § 2(a) lead-in. It is not a correction of § 103(e)/(f) or the retained Chapter 9 references. govinfo.gov
R094-P2-C017 P.L. 111-327 § 2(a)(29)(A)–(B) inserts 333 and 351 in § 901(a). S003, 124 Stat. 3560/P3, complete paragraph (29). It does not amend § 901(b) or § 902 in that command. govinfo.gov
R094-P2-C018 The 2010 technical-correction Act was approved December 22, 2010; its title or approval date alone does not establish a correction of every older reference. S003 identity/short title, 3557/P0; approval, 3563/P6; C016–C017. No broader retroactive application is supplied. govinfo.gov+1
R094-P2-C019 The SEC-hosted document is a dated committee-print excerpt, not the original complete published redesignating body. S004, “Notes to the Reader,” P0, and opening P1. Its September 30, 2004 revision date and editorial conventions are source-status facts, not the amendment’s effective date. sec.gov
R094-P2-C020 The bounded searches and selected adopted commands did not authenticate a later replacement of the three retained references. Exact search/read log in § 9. This does not establish that no correction, construction, or other material authority exists. Search snippets and notes were leads, not substitutes for adopted text.
R094-P2-C021 The substantive PDF evidence is parsed-text evidence; page-image verification was not completed. Page-image requests for S002 P0, P366, P395, and P397 returned display markers without inspectable pixels. No visual assertion is made. This did not prevent complete parsed-text reading of the selected command.
R094-P2-C022 The specific original-source qualification in the supplied S008/C005/M024 rows is improved prospectively by this supplement. S002; C008–C014. The old statement that the original was not read remains a true historical record of pass-01 and is not rewritten.
R094-P2-C023 The supplied C005’s literal-reference and property-of-the-debtor propositions are confirmed within their stated limits; no material substantive correction is established. S001; C004–C007, with original history now independently supported by S002. The new § 902(5) read supplies parallel context, not a correction to the old property proposition.
R094-P2-C024 The full-history gap remains open, although this particular redesignating command is now authenticated. C011–C020; supplied coverage 6.6 and G07. Other renumberings, remote amendments, application exceptions, later law, and judicial construction were not completed.
R094-P2-C025 No actual classification, enforceability, priority, claim allowance, lien, recovery, remedy, or Chapter 9 outcome follows from this supplement. The positive findings concern selected public text and source history only. All broader A094 and actual-application predicates remain outside the investigation.

4. Current/editorial/original comparison

Comparison Supported result Claim/source/pinpoint Missing authority or predicate; adverse inference to avoid
Current § 103(e) versus current § 103(f) They are different printed subsections with different subject matter. C002–C003; S001 § 103(e)–(f). No actual application. Do not treat the letters as interchangeable merely because older references remain.
Current §§ 901/902 text versus their editorial notes The bodies retain “103(e)”; the notes explain former (e)’s redesignation to (f). C004–C007; S001. Operative construction is not resolved by silently editing the body.
Editorial history versus adopted command The original published command now directly verifies the redesignation and insertion described by the note. C007–C012; S002, 2763A-394/P395. This improves authentication; it does not establish every later amendment or interpretation.
Enacting wrapper versus incorporated appendix The wrapper enacts a specified bill version; the appendix supplies that incorporated text. C008–C010; S002 § 1(a)(5), § 1(b), Appendix E. Do not treat the appendix as merely an unadopted bill, or use another appendix’s § 112.
Redesignation versus insertion Former labels move; a separate command adds a new subsection (e). C011–C012; S002 § 112(c)(5)(A)(i)–(ii). Do not describe the new (e) as the former clause with a changed heading.
Redesignation of § 103 versus correction of references elsewhere The selected command targets § 103 and contains no replacement of the three references at issue. C013; S002 compared with S001. Do not infer an automatic textual correction or an Act-wide absence of other commands.
Enactment versus conditional application Approval/enactment is authenticated; the selected commands state no delayed activation or filing cutoff. C009, C014; S002. No universal pending-case or retroactivity conclusion; no calculated effective date beyond the source’s approval fact.
New subsection’s scope predicates versus amendment timing The inserted clause’s case/category conditions qualify that clause’s scope. C002, C012, C014. Do not make the existence of an actual liquidation event a prerequisite to Congress’s separate relabeling command.
2010 technical correction versus this retained-reference issue The read commands concern § 103(a) and § 901(a). C016–C018; S003 § 2(a)(2), (29). Do not assume an Act called “Technical Corrections” corrected every older reference.
Official compiled excerpt versus original published Act The SEC-hosted excerpt is expressly a later revised committee-print extract. C019; S004 reader notes. Official hosting does not make it a complete original or a current Code edition.
Authenticated history versus operative construction The historical label change is now directly supported; treatment of the retained references remains a separate question. C020, C024; S001–S003. No typographical-error determination, automatic correction, repeal, or judicial resolution is supplied.
Narrow source improvement versus whole-report acceptance Only the selected source/history gap is improved. C022–C025; § 5 below. No reopening or acceptance of § 510, the other definitions, or the parent report.

The original redesignating-body gap is now closed for the specified command and wrapper. The displayed current cutoff and retained literal references are confirmed. The fresh read is not relabeled as a repeat of all the broader old read bounds. Chapter eligibility, remote regimes, later history, and application remain held.
R094-P1-C005. “Section 902(1) defines ‘property of the estate,’ when used in an incorporated provision, as property of the debtor. The text/reference difference is preserved; the original redesignating Act was not read. Do not assume ordinary estate terminology applies identically in every chapter.” C004–C007 confirm the selected current text and notes. C008–C013 / S002 § 112(c)(5)(A) add direct enacted support for the historical redesignation and insertion. No material substantive correction established. The proposition is supported; the earlier source limitation is improved for future reliance through this supplement. The retained references are not rewritten. No application of ordinary estate terminology to every chapter, or operative resolution of the reference discrepancy, follows.

Authority: “§§ 901, 902 editorial reference notes.” Relationship: “Dec. 21, 2000, credited redesignation source.” Trigger/boundary: “Historical explanation of § 103(e)/(f) reference.” Limit: “Original redesignating clause not read; date is credited editorial history, not independently authenticated transition application. C005.” S002, approval line 114 Stat. 2764/P1, and enacted command 2763A-394/P395. C009, C011–C014. December 21, 2000 is now directly authenticated as the Act’s approval/enactment date, and the original command is directly read. That improvement does not turn the date into an independently adjudicated application date for every pending matter. No calendar computation or universal retroactivity rule is supplied.
Coverage 6.6 — Definition renumbering and applicability cross-reference history. “Partial. Current wording and selected notes read; original full chain unverified.” Links: “C005, C084; S002, S008; B01, B34.” Next inquiry: “Read the exact relevant original redesignation/amendment only.” S002 / C008–C014 answer that exact original-command inquiry. S003 / C016–C018 examine the narrowly relevant later correction lead. The specified original redesignation is answered. The broader “full chain” remains partial. The separately referenced old C084/S002/B01/B34 were not supplied in full and are not adopted or newly reviewed here. No full definition or applicability-history acceptance.
G07 — Full definition/application history. “All historical renumberings, remote amendments, Act-specific exceptions, and later law were not authenticated.” Consequence: “Selected verified changes do not establish an exhaustive history.” Next inquiry: “Read the exact adopted clause necessary to resolve a specified discrepancy.” S002 authenticates this particular adopted clause; S001 and S003 preserve the present literal wording and the limits of the selected correction lead. G07 is narrowed, not closed. The specific original-command absence is removed from this supplement’s evidence gaps; the full-history limitation remains. No absence-of-all-amendments claim, operative construction, remote-incorporation completion, or parent acceptance.

7. Conditional legal-category branches

Branch Supported conditional rule and exact support Missing predicate or authority Adverse inference to avoid Next permissible generic inquiry
B01 — Current version boundary The selected OLRC bodies display the specified cutoff. C001; S001. Any material post-cutoff adopted change. Treating the access date as proof of exhaustive currentness. Read a specifically identified later adopted amendment affecting these clauses.
B02 — Current subsection identity Current (e) and (f) contain different rules. C002–C003; S001 § 103(e)–(f). Complete remote definitions and actual applicability facts, all outside this pass. Treating the subsection letters as interchangeable in every use. Read a narrow incorporation only if a later authorized generic scope question requires it.
B03 — Term-meaning rule Section 901(b) uses the applicable section’s definition unless § 902 otherwise defines the term. C004. Any proposed term’s precise incorporation route and § 902 treatment. Ignoring the definitional override or silently correcting the printed reference. Read only the exact term and incorporation needed for a separate generic question.
B04 — Property terminology Section 902(1)’s substitution is limited to its stated Chapter 9 incorporation context. C005. A complete application chain, not supplied here. Applying it as a universal estate-property definition. Examine the precise incorporated clause if separately authorized.
B05 — Trustee terminology and exception Section 902(5) includes an express § 926 exception. C006. Complete § 926 operation. Treating “trustee means debtor” as unconditional. Read complete § 926 only if the substantive exception becomes the authorized question.
B06 — Editorial note located The note explains the historical redesignation. C007. An adopted command, now supplied by S002, and any separate operative construction. Treating a note as an enacted instruction to rewrite §§ 901/902. Use the adopted command for history; identify separate construction authority before asserting legal effect.
B07 — Incorporated bill version The wrapper enacts the version identified in § 1(a)(5). C008. A conflicting enacted version or material amendment, if identified. Treating another version or another appendix as the adopted source. Verify the exact wrapper item and appendix identity of any candidate.
B08 — Appendix publication Section 1(b) directs publication of the incorporated texts as appendixes. C009–C010. No further incorporation is needed for the selected command’s identity; broader evidentiary doctrines are unexamined. Calling the appended text merely an unadopted proposal. Read only a disputed publication/identity provision if an actual source discrepancy emerges.
B09 — Redesignation command Former (e)–(i) are redesignated (f)–(j), respectively. C011. Any later command altering a particular label. Assuming all current labels thereafter remained unchanged. Read the exact later redesignation only if needed for a specified comparison.
B10 — New subsection insertion A separate instruction inserts a new (e). C012. Remote meaning/application of the new scope clause. Describing the change as only a renaming of the old (e). Preserve the distinct commands; investigate the new subsection’s regime only under separate authorization.
B11 — Scope condition versus commencement The inserted subsection’s legal-category conditions are not phrased as an activation condition for the separate redesignation instruction. C012–C014. Any materially applicable external commencement or transition authority. Requiring an actual liquidation before the legislative labels change, or inventing a filing cutoff. Read an identified transition clause expressly tied to this amendment.
B12 — Enactment date The approval line directly supports December 21, 2000. C009, C014. A complete basis for any broader pending-case or retroactivity claim. Converting enactment authentication into every application outcome. Identify and read the precise application authority necessary for that separate question.
B13 — Construction/savings lead Complete §§ 122 and 304 address their stated SEC-law and classification boundaries. C015. No cross-reference replacement or case-commencement rule is supplied by them. Using a generic “savings” heading as if it resolves this reference issue. Follow only a clause whose actual text materially reaches the retained reference.
B14 — Later technical correction identified The read 2010 commands target § 103(a) and § 901(a). C016–C018. An adopted command reaching § 901(b) or § 902(1)/(5). Assuming the title “Technical Corrections” proves this particular correction. Read the exact adopted correction if a specific lead is found.
B15 — Literal reference remains Current bodies still print “103(e).” C004–C007, C013. Operative construction or an express replacement command. Declaring a typo, automatic correction, repeal, or universal Chapter 9 result. A separately authorized generic construction inquiry; no case or opinion investigation was conducted here.
B16 — Search yields no authenticated replacement Bounded searches did not authenticate a replacement of these references. C020. Exhaustive later-law and construction evidence. Treating nonlocation as proof no amendment or construction exists. Consult a precise official amendment/classification lead rather than claim absence from search silence.
B17 — Official-hosted excerpt S004 identifies itself as a revised committee-print extract. C019. Complete original command, supplied independently by S002. Promoting hosting or a revision date into original-publication authentication. Use the published enacted body and retain the excerpt’s actual status.
B18 — Page-image limitation Parsed text was readable; pixel inspection was not completed. C021. Inspectable official page images. Claiming visual verification from a display marker or parsed text. If visual authentication becomes necessary, use an ordinary readable official image route without access bypass.
B19 — Source gap versus substantive correction Original authentication improves while the supplied C005 proposition remains supported. C022–C023. Any separately demonstrated substantive error. Declaring a correction merely because a previously unread source is now available. Preserve the old record and attach the new source-qualified supplement.
B20 — Full history and actual outcomes One authenticated redesignation does not complete all historical or application questions. C024–C025. Other specifically material amendments, remote authorities, judicial construction, and all actual facts. Whole-report acceptance or any claim, lien, priority, recovery, or remedy result. State the next precise generic authority question before opening another component.

9.3 Source-read and failure record

Log ID Route/body Result Consequence
L01 Three version-specific OLRC URLs in S001 Successful current-body and material-note retrieval. Selected current wording and cutoff authenticated within the stated bounds.
L02 Original P.L. 106-554 GovInfo PDF Successful. Complete selected wrapper and redesignating command read, with actual printed pagination and PDF indices. The specified original-publication gap is closed.
L03 Original Act’s Appendix E identity and construction/savings leads Identity and complete §§ 122 and 304 read; other headings and neighboring material screened only. No wrong-appendix § 112 used; no whole-Appendix E or whole-Act claim.
L04 Original P.L. 111-327 GovInfo PDF Successful selected reads of § 2(a)(2), § 2(a)(29), closing § 3, and approval. Bounded later-correction evidence; no correction of the retained references authenticated.
L05 SEC-hosted cfma.pdf Readable, but reader notes identify a revised committee-print excerpt. Not an original-publication failure; it is an unsuitable substitute for the complete original command and was not used as one.
L06 S002 screenshot requests Display markers were returned without inspectable page pixels. Visual verification remains incomplete. Parsed-text success is not relabeled a pixel read.
L07 Early narrow text windows Some returns showed only small excerpts. Subsequent pinpoint reads supplied the complete relied-on command and wrapper. Initial excerpts alone were not treated as complete bodies.
L08 Search-result-only materials Historical compilations, committee materials, and other-subject regulatory results were encountered. No adopted-law conclusion rests on a snippet or an unexamined result.
L09 Supplied pass-01 provenance and rows Read only as supplied in the prompt. No local-file, prior-full-report, or linked-chat access claimed.
L10 Earlier 1978/1984 access failures and other excluded history Not retried or reopened. Their original status and limits remain unchanged. This pass does not retroactively repair them.

There was no failed original text retrieval for the relied-on 2000 redesignating command. The principal evidence limitation is now the scope of the subsequent-history and operative-construction inquiry, together with the uncompleted pixel inspection—not continued inability to read that original command.

P2-G01 — Operative treatment of the retained references How the literal references are to be construed in an actual legal application. Original redesignation authenticated; no textual substitution made by this report. Identify separately authorized generic construction authority. Judicial/case investigation remains outside this pass.
P2-G02 — Complete later amendment chain Whether another material adopted amendment, correction, or application provision affects the issue. Selected current notes and 2010 commands examined; no exhaustive absence claim. Read a specific official amendment/classification lead reaching the retained references.
P2-G03 — Broader temporal application Pending-matter, retroactivity, and other application questions beyond the selected command’s text. Approval/enactment and absence of an express delayed trigger in the selected clauses authenticated. Read only the exact application authority needed for a separately stated proposition.
P2-G04 — Remote incorporations The new § 103(e)’s banking/clearing references, § 926, and other chapter-specific provisions. References and qualifications preserved without importing their full regimes. A narrow complete read only if one becomes indispensable to a new authorized generic question.
P2-G05 — Page pixels Visual confirmation of the printed pages. Complete relied-on parsed text and its page labels available; no pixel review claimed. An ordinary inspectable official page-image route, if visual authentication is needed.
P2-G06 — Broader pass-01 history and actual outcomes All remaining G07 history and every actual contract, claim, lien, classification, ranking, recovery, remedy, or financial/legal fact. This one original-source gap is closed. Nothing else is accepted or decided. State the exact separate public-law component before any further research.

§ 103(e)The current subsection concerns the application of Chapter 7, Subchapter V, to the specified liquidation category: an uninsured State member bank, or a corporation organized under Federal Reserve Act § 25A, with the stated multilateral-clearing-organization language and reference to FDICIA § 409.No actual category, eligibility, or operative effect of the remote references is determined. The current editorial note concerning the remote § 409 reference is not an independently authenticated repeal/application analysis in this pass.
§ 103(f)Subject to the exception for § 901, only Chapters 1 and 9 apply in a case under Chapter 9.No complete list of incorporated provisions, Chapter 9 eligibility rule, or actual applicability outcome is supplied.
§ 901(b)A term in a Title 11 section made applicable in a Chapter 9 case by § 901(a) or “section 103(e)” has the meaning defined for that applicable section, unless otherwise defined in § 902.The printed reference is preserved. The report does not silently substitute § 103(f).
§ 902(1)“Property of the estate,” when used in a section made applicable in the Chapter 9 case by “section 103(e)” or § 901, means property of the debtor. This is not an unrestricted definition of estate property for every chapter or purpose.
§ 902(5)“Trustee,” in the same stated incorporation context using “section 103(e)” or § 901, means debtor, except as provided in § 926.The exception is retained. Its complete operation is not analyzed, and no actual trustee/debtor-role determination is made.

R094-P2-C002Current § 103(e) contains the specified Chapter 7/Subchapter V liquidation-scope clause, including the uninsured-State-member-bank/corporation alternatives, clearing-organization language, and remote statutory references.S001 § 103(e), complete clause. It is read for text identity, not to classify an entity or complete the incorporated banking regime. uscode.house.gov
R094-P2-C003Current § 103(f) states the Chapters 1-and-9 rule for a Chapter 9 case, except as provided in § 901.S001 § 103(f), complete clause. The § 901 exception is preserved; no entire Chapter 9 applicability result is inferred. uscode.house.gov
R094-P2-C004Current § 901(b) retains “section 103(e)” and supplies a term-meaning rule for the stated incorporated sections, subject to definitions otherwise supplied by § 902.S001 § 901(b), complete sentence. Both incorporation alternatives and the § 902 qualification are material. uscode.house.gov
R094-P2-C005Current § 902(1) retains “section 103(e)” and defines “property of the estate” as property of the debtor in its specified Chapter 9 incorporation context.S001 § 902 introductory language and paragraph (1). No general estate-property rule for every chapter is asserted. uscode.house.gov
R094-P2-C006Current § 902(5) retains the same reference and defines “trustee” as debtor in that context, except as provided in § 926.S001 § 902(5), complete paragraph. The § 926 exception remains express and substantively unexamined. uscode.house.gov
R094-P2-C007The editorial reference notes identify the former § 103(e) → § 103(f) redesignation and addition of a new subsection (e).S001 §§ 901 and 902, “References in Text”; § 103, 2000 amendment note. This authenticates what the notes say; the original command is separately authenticated by S002. uscode.house.gov +2
R094-P2-C008Outer § 1(a)(5) of P.L. 106-554 enacts H.R. 5660 in the version introduced December 14, 2000.S002 § 1(a) opening and (5), 114 Stat. 2763/P0. The separate exception in paragraph (4) concerns a different listed bill and is not transferred to paragraph (5). govinfo.gov
R094-P2-C009Section 1(b) directs publication of the incorporated texts as appendixes, and the approval line states December 21, 2000.S002 § 1(b), 2763/P0; approval and endnote, 2764/P1. The publication instruction and approval date are distinct from the date of a particular printed or digital copy. No broader evidentiary rule under 1 U.S.C. § 112 is asserted. govinfo.gov +1
R094-P2-C010The relevant incorporated text is Appendix E—H.R. 5660, titled the Commodity Futures Modernization Act of 2000; the relevant § 112 is “Derivatives clearing.”S002 Appendix E opening, 2763A-365/P366; § 112 heading, 2763A-391/P392; § 112(c) heading, 2763A-393/P394. Other appendixes’ identically numbered sections are not used. govinfo.gov +2
R094-P2-C011The complete enacted § 112(c)(5)(A)(i) redesignates former subsections (e)–(i) as (f)–(j), respectively.S002, 2763A-394/P395. This directly authenticates the historical label changes previously supported only by the compiled note in the supplied row. govinfo.gov
R094-P2-C012The next clause separately inserts a new subsection (e) after subsection (d) and supplies its complete scope text.S002 § 112(c)(5)(A)(ii), 2763A-394/P395. The inserted text corresponds to the selected current § 103(e) body. This comparison does not certify an uninterrupted amendment history. govinfo.gov +1
R094-P2-C013The selected § 112(c)(5)(A) command amends § 103; it does not contain an amendment to the references printed in § 901(b) or § 902(1)/(5).S002, complete § 112(c)(5)(A), compared with S001’s literal clauses. This is a bounded command-level observation, not an Act-wide or all-later-law absence claim.
R094-P2-C014The selected wrapper and redesignating command contain no express waiting period, case-filing cutoff, or future activation event; December 21, 2000 is directly authenticated as approval/enactment.S002 § 1(a)–(b), approval line, and § 112(c)(5)(A). No independent pending-case, retroactivity, or universal application conclusion is drawn. Scope predicates inside the inserted subsection are kept separate from the redesignating command.
R094-P2-C015The complete identified construction/savings clauses do not themselves rewrite the retained references or state a case-commencement rule for this redesignation.S002 Appendix E § 122, 2763A-405/P406; § 304, 2763A-457/P458. R094-P2-C016P.L. 111-327 § 2(a)(2) changes a reference in § 103(a) from 362(n) to 362(o).S003, 124 Stat. 3557/P0, complete selected command and § 2(a) lead-in. It is not a correction of § 103(e)/(f) or the retained Chapter 9 references. govinfo.gov
R094-P2-C017P.L. 111-327 § 2(a)(29)(A)–(B) inserts 333 and 351 in § 901(a).S003, 124 Stat. 3560/P3, complete paragraph (29). It does not amend § 901(b) or § 902 in that command. govinfo.gov
R094-P2-C018The 2010 technical-correction Act was approved December 22, 2010; its title or approval date alone does not establish a correction of every older reference.S003 identity/short title, 3557/P0; approval, 3563/P6; C016–C017. No broader retroactive application is supplied. govinfo.gov +1
R094-P2-C019The SEC-hosted document is a dated committee-print excerpt, not the original complete published redesignating body.S004, “Notes to the Reader,” P0, and opening P1. Its September 30, 2004 revision date and editorial conventions are source-status facts, not the amendment’s effective date. sec.gov
R094-P2-C020The bounded searches and selected adopted commands did not authenticate a later replacement of the three retained references.Exact search/read log in § 9. This does not establish that no correction, construction, or other material authority exists. Search snippets and notes were leads, not substitutes for adopted text.
R094-P2-C021The substantive PDF evidence is parsed-text evidence; page-image verification was not completed.Page-image requests for S002 P0, P366, P395, and P397 returned display markers without inspectable pixels. No visual assertion is made. This did not prevent complete parsed-text reading of the selected command.
R094-P2-C022The specific original-source qualification in the supplied S008/C005/M024 rows is improved prospectively by this supplement.S002; C008–C014. The old statement that the original was not read remains a true historical record of pass-01 and is not rewritten.
R094-P2-C023The supplied C005’s literal-reference and property-of-the-debtor propositions are confirmed within their stated limits; no material substantive correction is established.S001; C004–C007, with original history now independently supported by S002. The new § 902(5) read supplies parallel context, not a correction to the old property proposition.
R094-P2-C024The full-history gap remains open, although this particular redesignating command is now authenticated.C011–C020; supplied coverage 6.6 and G07. Other renumberings, remote amendments, application exceptions, later law, and judicial construction were not completed.
R094-P2-C025No actual classification, enforceability, priority, claim allowance, lien, recovery, remedy, or Chapter 9 outcome follows from this supplement. The positive findings concern selected public text and source history only. All broader A094 and actual-application predicates remain outside the investigation.

Current § 103(e) versus current § 103(f)They are different printed subsections with different subject matter.C002–C003; S001 § 103(e)–(f).No actual application. Do not treat the letters as interchangeable merely because older references remain.
Current §§ 901/902 text versus their editorial notesThe bodies retain “103(e)”; the notes explain former (e)’s redesignation to (f).C004–C007; S001.Operative construction is not resolved by silently editing the body.
Editorial history versus adopted commandThe original published command now directly verifies the redesignation and insertion described by the note.C007–C012; S002, 2763A-394/P395.This improves authentication; it does not establish every later amendment or interpretation.
Enacting wrapper versus incorporated appendixThe wrapper enacts a specified bill version; the appendix supplies that incorporated text.C008–C010; S002 § 1(a)(5), § 1(b), Appendix E.Do not treat the appendix as merely an unadopted bill, or use another appendix’s § 112.
Redesignation versus insertionFormer labels move; a separate command adds a new subsection (e).C011–C012; S002 § 112(c)(5)(A)(i)–(ii).Do not describe the new (e) as the former clause with a changed heading.
Redesignation of § 103 versus correction of references elsewhereThe selected command targets § 103 and contains no replacement of the three references at issue.C013; S002 compared with S001.Do not infer an automatic textual correction or an Act-wide absence of other commands.
Enactment versus conditional applicationApproval/enactment is authenticated; the selected commands state no delayed activation or filing cutoff.C009, C014; S002.No universal pending-case or retroactivity conclusion; no calculated effective date beyond the source’s approval fact.
New subsection’s scope predicates versus amendment timingThe inserted clause’s case/category conditions qualify that clause’s scope.C002, C012, C014.Do not make the existence of an actual liquidation event a prerequisite to Congress’s separate relabeling command.
2010 technical correction versus this retained-reference issueThe read commands concern § 103(a) and § 901(a).C016–C018; S003 § 2(a)(2), (29).Do not assume an Act called “Technical Corrections” corrected every older reference.
Official compiled excerpt versus original published ActThe SEC-hosted excerpt is expressly a later revised committee-print extract.C019; S004 reader notes.Official hosting does not make it a complete original or a current Code edition.
Authenticated history versus operative constructionThe historical label change is now directly supported; treatment of the retained references remains a separate question.C020, C024; S001–S003.No typographical-error determination, automatic correction, repeal, or judicial resolution is supplied.
Narrow source improvement versus whole-report acceptanceOnly the selected source/history gap is improved.C022–C025; § 5 below. No reopening or acceptance of § 510, the other definitions, or the parent report.

C002–C003; S001 § 103(e)–(f).Complete remote definitions and actual applicability facts, all outside this pass.Treating the subsection letters as interchangeable in every use.Read a narrow incorporation only if a later authorized generic scope question requires it.
B03 — Term-meaning ruleSection 901(b) uses the applicable section’s definition unless § 902 otherwise defines the term. C004.Any proposed term’s precise incorporation route and § 902 treatment.Ignoring the definitional override or silently correcting the printed reference.Read only the exact term and incorporation needed for a separate generic question.
B04 — Property terminologySection 902(1)’s substitution is limited to its stated Chapter 9 incorporation context. C005.A complete application chain, not supplied here.Applying it as a universal estate-property definition.Examine the precise incorporated clause if separately authorized.
B05 — Trustee terminology and exceptionSection 902(5) includes an express § 926 exception. C006.Complete § 926 operation.Treating “trustee means debtor” as unconditional.Read complete § 926 only if the substantive exception becomes the authorized question.
B06 — Editorial note locatedThe note explains the historical redesignation. C007.An adopted command, now supplied by S002, and any separate operative construction.Treating a note as an enacted instruction to rewrite §§ 901/902.Use the adopted command for history; identify separate construction authority before asserting legal effect.
B07 — Incorporated bill versionThe wrapper enacts the version identified in § 1(a)(5). C008.A conflicting enacted version or material amendment, if identified.Treating another version or another appendix as the adopted source.Verify the exact wrapper item and appendix identity of any candidate.
B08 — Appendix publicationSection 1(b) directs publication of the incorporated texts as appendixes. C009–C010.No further incorporation is needed for the selected command’s identity; broader evidentiary doctrines are unexamined.Calling the appended text merely an unadopted proposal.Read only a disputed publication/identity provision if an actual source discrepancy emerges.
B09 — Redesignation commandFormer (e)–(i) are redesignated (f)–(j), respectively. C011.Any later command altering a particular label.Assuming all current labels thereafter remained unchanged.Read the exact later redesignation only if needed for a specified comparison.
B10 — New subsection insertionA separate instruction inserts a new (e). C012.Remote meaning/application of the new scope clause.Describing the change as only a renaming of the old (e).Preserve the distinct commands; investigate the new subsection’s regime only under separate authorization.
B11 — Scope condition versus commencementThe inserted subsection’s legal-category conditions are not phrased as an activation condition for the separate redesignation instruction. C012–C014.Any materially applicable external commencement or transition authority.Requiring an actual liquidation before the legislative labels change, or inventing a filing cutoff.Read an identified transition clause expressly tied to this amendment.
B12 — Enactment dateThe approval line directly supports December 21, 2000. C009, C014.A complete basis for any broader pending-case or retroactivity claim.Converting enactment authentication into every application outcome.Identify and read the precise application authority necessary for that separate question.
B13 — Construction/savings leadComplete §§ 122 and 304 address their stated SEC-law and classification boundaries. C015.No cross-reference replacement or case-commencement rule is supplied by them.Using a generic “savings” heading as if it resolves this reference issue.Follow only a clause whose actual text materially reaches the retained reference.
B14 — Later technical correction identifiedThe read 2010 commands target § 103(a) and § 901(a). C016–C018.An adopted command reaching § 901(b) or § 902(1)/(5).Assuming the title “Technical Corrections” proves this particular correction.Read the exact adopted correction if a specific lead is found.
B15 — Literal reference remainsCurrent bodies still print “103(e).” C004–C007, C013.Operative construction or an express replacement command.Declaring a typo, automatic correction, repeal, or universal Chapter 9 result.A separately authorized generic construction inquiry; no case or opinion investigation was conducted here.
B16 — Search yields no authenticated replacementBounded searches did not authenticate a replacement of these references. C020.Exhaustive later-law and construction evidence.Treating nonlocation as proof no amendment or construction exists.Consult a precise official amendment/classification lead rather than claim absence from search silence.
B17 — Official-hosted excerptS004 identifies itself as a revised committee-print extract. C019.Complete original command, supplied independently by S002.Promoting hosting or a revision date into original-publication authentication.Use the published enacted body and retain the excerpt’s actual status.
B18 — Page-image limitationParsed text was readable; pixel inspection was not completed. C021.Inspectable official page images.Claiming visual verification from a display marker or parsed text.If visual authentication becomes necessary, use an ordinary readable official image route without access bypass.
B19 — Source gap versus substantive correctionOriginal authentication improves while the supplied C005 proposition remains supported. C022–C023.Any separately demonstrated substantive error.Declaring a correction merely because a previously unread source is now available.Preserve the old record and attach the new source-qualified supplement.
B20 — Full history and actual outcomesOne authenticated redesignation does not complete all historical or application questions. C024–C025.Other specifically material amendments, remote authorities, judicial construction, and all actual facts.Whole-report acceptance or any claim, lien, priority, recovery, or remedy result.State the next precise generic authority question before opening another component.

The bounded searches and selected adopted commands did not authenticate a later replacement of the three retained references.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
Exact search/read log in § 9. This does not establish that no correction, construction, or other material authority exists. Search snippets and notes were leads, not substitutes for adopted text.
R094-P2-C021 Saved research record

The substantive PDF evidence is parsed-text evidence; page-image verification was not completed.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
Page-image requests for S002 P0, P366, P395, and P397 returned display markers without inspectable pixels. No visual assertion is made. This did not prevent complete parsed-text reading of the selected command.
R094-P2-C022 Saved research record

The specific original-source qualification in the supplied S008/C005/M024 rows is improved prospectively by this supplement.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
S002; C008–C014. The old statement that the original was not read remains a true historical record of pass-01 and is not rewritten.
R094-P2-C023 Saved research record

The supplied C005’s literal-reference and property-of-the-debtor propositions are confirmed within their stated limits; no material substantive correction is established.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
S001; C004–C007, with original history now independently supported by S002. The new § 902(5) read supplies parallel context, not a correction to the old property proposition.
R094-P2-C024 Saved research record

The full-history gap remains open, although this particular redesignating command is now authenticated.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
C011–C020; supplied coverage 6.6 and G07. Other renumberings, remote amendments, application exceptions, later law, and judicial construction were not completed.
R094-P2-C025 Saved research record

No actual classification, enforceability, priority, claim allowance, lien, recovery, remedy, or Chapter 9 outcome follows from this supplement.

Recorded check status: whole report reviewed selected primary checks see exact bounds

Exact support and limits
The positive findings concern selected public text and source history only. All broader A094 and actual-application predicates remain outside the investigation.

Sources, pinpoints and access limits

Keep the source version, actual read extent and jurisdiction with the proposition. A link or researcher access claim is not a substitute for an operative primary passage.
