R087 PASS-01 — Federal Rule of Civil Procedure 4, Summons

1. Identified text, scope, and currentness

The current judiciary-linked compilation is the Federal Rules of Civil Procedure, amended through December 1, 2025, published as a House Judiciary Committee print by the Government Publishing Office in 2026. Rule 4 is titled “Summons.” Its complete body contains subdivisions (a) through (n), followed by the Notice of a Lawsuit and Request to Waive Service of Summons, the Waiver of the Service of Summons, and the accompanying statement concerning unnecessary service expenses. All of that selected text was read. The compilation’s Rule 4 amendment credit ends with the amendment effective December 1, 2017. That is a Rule 4 amendment date, not the compilation date or this research access date. Actual access: October 28, 2026, America/Los_Angeles. [C001, C012–C018.] uscourts.gov+4

The judiciary’s current-rules page identifies civil-rule changes effective December 1, 2025, and its pending-amendments page does not list a Rule 4 amendment in the displayed future packages. Those pages support a bounded currentness check; they do not establish an exhaustive intervening legislative, judicial, or emergency-order history. Some related rules appear in future proposal listings. Those listings were not treated as operative amendments. [C018, C085.] uscourts.gov+2

The governing distinctions are procedural. Commencement, issuance, service, a waiver request, return and filing of a waiver, proof of service, a responsive pleading, and judgment are distinct events. Rule 4 does not establish the validity of an underlying debt or prove that any actual document was issued, delivered, waived, answered, or adjudicated. Rules 1, 3, 4, 12, 81, and 82 supply the bounded distinctions used below. [C002–C003, C020–C023, C027–C038, C061–C078, C084.] uscourts.gov+5

A. Authority, applicability, and amendment status

Claim ID Supported proposition, with material qualifications Exact authority and scope
C001 The current selected Rule 4 has fourteen subdivisions, (a)–(n), and the two appended blank forms plus expense statement identified above. Its current compilation is amended through December 1, 2025; its Rule 4 amendment credit ends in 2017. S001, Rule 4 complete, printed 1–8; foreword. This does not certify all later legislation or adjudication. uscourts.gov+2
C002 Rule 1 governs procedure in civil actions and proceedings in United States district courts, subject to Rule 81. Rule 82 says the rules do not extend or limit district-court jurisdiction or venue; its admiralty/maritime sentence separately points to §1390. S001, Rules 1, 81, 82. Subject-matter jurisdiction, immunity, venue, and specialized statutes are not established by recognizing a summons category.
C003 Rule 3 identifies filing a complaint with the court as commencement of a civil action. This is distinct from subsequent issuance and service under Rule 4. S001, Rule 3; 4(b)–(c). uscourts.gov
C004 Section 2072 authorizes Supreme Court rules of practice, procedure, and evidence for the specified federal courts, including district-court proceedings before magistrate judges. Such rules must not abridge, enlarge, or modify substantive rights. Its conflict provision applies after rules take effect; subsection (c) separately addresses defining finality for §1291 appeals. S003, complete §2072(a)–(c). No general constitutional, conflict-of-laws, or appellate analysis follows. uscode.house.gov
C005 Section 2074 generally requires transmission to Congress not later than May 1 of the effective year and effectiveness no earlier than December 1 that year, unless law provides otherwise. Pending application cannot be required where the receiving court finds it infeasible or unjust; the former rule then applies. A rule creating, abolishing, or modifying an evidentiary privilege needs congressional enactment. S004, complete §2074(a)–(b). These are rulemaking conditions, not litigant response periods. uscode.house.gov
C006 Generic local-rule authority requires consistency with governing statutes/national rules. Section 2071 provides notice/comment, effective-date and pending-case authority, supervisory modification, public availability, and an immediate-need exception followed promptly by notice/comment. Rule 83(a) requires action by a majority of district judges, consistency without duplication, and prescribed numbering. A nonwillful form failure cannot be enforced to cause loss of a right. Under 83(b), otherwise-unregulated practice must remain consistent; an unpublished additional requirement cannot support sanction or disadvantage without actual notice in the particular case. S005, §2071(a)–(f); S001, complete Rule 83. No actual local rule or directive was inspected. uscode.house.gov+3
C007 For these rules, State “law” includes statutes and judicial decisions. “State” includes, where appropriate, the District of Columbia and United States commonwealths or territories. For the federal district court in the District of Columbia, “federal statute” includes Acts of Congress applicable locally there. S001, complete Rule 81(d)(1)–(3). This identifies dependencies; it does not supply the unexamined State decisions or territorial law.
C008 Rule 81 contains distinct treatment for prize, bankruptcy, citizenship, habeas/quo-warranto, federal-subpoena, and specified statutory proceedings. Its incorporation of other procedures is qualified, not a blanket statement that ordinary civil procedure controls every such proceeding. S001, complete 81(a)(1)–(6), (b). Incorporated bodies—including the printed prize citation, citizenship law, bankruptcy rules, special-writ rules, and listed review/arbitration statutes—remain held. uscourts.gov+2
C009 The rules apply after removal from State court. Repleading is unnecessary unless ordered. For a defendant who did not answer before removal, Rule 81(c)(2) uses the longest of its three stated periods: 21 days after receipt of the initial pleading through service or otherwise; 21 days after service of the summons for an initial pleading already on file; or 7 days after filing the notice of removal. S001, complete 81(c), specifically (1)–(2). Removal authority and jury-demand procedure are separate holds; no actual removal is inferred. uscourts.gov
C010 Rule 86(a) applies effective rules to later-commenced actions and later proceedings in pending actions, unless the Supreme Court provides otherwise or the court finds application infeasible or unjust. Rule 86(b) preserves the specified preexisting priority-in-time relationship for the December 1, 2007 restyling. S001, complete Rule 86; S004. The original 2007 order was not separately authenticated here.
C011 The original 1988 Rules Enabling Act clauses read here took effect December 1, 1988. Section 406 preserved rules lawfully prescribed and in force at that time until changed under the amended law. S006, §§401(a), 403(a)(1), 406–407. This is a selected enactment check, not a complete historical chain. govinfo.gov+3
C012 The 2015 adopted Rule 4 changes reduced the presumptive service period from 120 to 90 days, added the specified condemnation-notice exception, and directly incorporated the waiver forms as the general forms appendix was abrogated. The order’s effective date was December 1, 2015, with qualified pending application. S009, adoption order; adopted 4(d), 4(m), forms; Rule 84/Appendix clauses; complete selected committee notes. The 120-day figure is historical only. uscourts.gov+3
C013 The 2016 adopted package added an express 4(h)(2) foreign-service reference to 4(m), but its displayed replacement text omitted the condemnation clause. The August clarification letter explained an intended combined effect; that letter was explanatory, not a replacement adoption order. S010, adopted 4(m) and complete committee note; S011, complete substantive letter. The package release date and blank parsed order-date line are kept separate. uscourts.gov+3
C014 The April 27, 2017 order adopted the combined Rule 4(m) text effective December 1, 2017, subject to its pending-proceeding qualification. Its committee note calls the change a technical integration of the intended effects of the preceding amendments. S012, complete order, complete adopted 4(m), complete committee note. No judicial resolution of the historical interim discrepancy is asserted. uscourts.gov+1
C015 The April 24, 2023 order adopted Rule 87 and the selected Rule 6 holiday amendment effective December 1, 2023, with qualified pending application. Rule 87 can affect specified Rule 4 methods despite not being an amendment within Rule 4 itself. S013, complete order, selected Rule 6 clause, complete Rule 87.
C016 The April 2, 2024 order adopted Rule 12(a)’s current opening statutory-time qualification, effective December 1, 2024, with qualified pending application. S014, complete order and amendatory clause; current S001, 12(a). supremecourt.gov
C017 The selected 2009 order and amendments authenticate the revised general day-counting framework and selected responsive-pleading periods, effective December 1, 2009, with the order’s just-and-practicable pending qualification. Later amendments must still be applied, including the selected 2023 and 2024 changes. S008, order and selected Rule 6/12 amendatory bodies; S013–S014.
C018 The current/pending indexes support the identified 2025 compilation and distinguish future proposals. The displayed future lists do not supply a new operative Rule 4. They list possible future changes to related Rules 81 and 6, but those proposal bodies were not adopted as premises here. S002. No inference that no unexamined law, future revision, or relevant order exists. uscourts.gov
C019 A public rule’s prerequisites are not evidence that any corresponding factual event occurred. No document identity, issuance, service, waiver, authority, residence, legal capacity, court order, or deadline is established by this report. Bounded application of S001, Rules 3–4, 6, 12, 81–87; absence of actual facts in the requested scope.

B. Summons, issuance, responsibility, and waiver

Claim ID Supported conditional rule Exact authority and limits
C020 A summons must identify the court and parties; be directed to the defendant; provide the plaintiff’s attorney’s name/address or the unrepresented plaintiff’s; state the time to appear and defend; contain the specified default-judgment warning; carry the clerk’s signature; and bear the court seal. S001, complete 4(a)(1)(A)–(G). These content requirements do not authenticate any apparent signature or seal or establish default. uscourts.gov
C021 The court may permit amendment of a summons. The text does not make every defect automatically curable or every amendment self-executing. S001, 4(a)(2).
C022 On or after filing the complaint, the plaintiff may present a summons for signature/seal. If properly completed, the clerk must sign, seal, and issue it for service. A summons—or an appropriately addressed copy of a summons addressed to multiple defendants—must issue for each defendant to be served. S001, complete 4(b). Issuance is distinct from service.
C023 The summons must be served with a complaint copy. The plaintiff is responsible for service within the time allowed by 4(m) and must supply necessary copies to the server. S001, 4(c)(1), read with complete 4(m).
C024 Rule 4(c)(2)’s general server qualification is cumulative: at least 18 years old and not a party. This age concerns the server; it is not a definition of a minor recipient or “suitable age and discretion.” S001, 4(c)(2), 4(e)(2)(B), 4(g).
C025 At the plaintiff’s request, the court may order service by a United States marshal, deputy marshal, or specially appointed person; it must so order when the plaintiff is authorized under §1915 or §1916. Section 1915(d) separately directs court officers to issue and serve process and perform duties in such cases. S001, complete 4(c)(3); S007, complete §1915(d). Actual statutory authorization is absent; poverty, fee, and prisoner-litigation determinations are held.
C026 Section 1916 concerns suits/appeals brought by seamen in their own names and for their own benefit for wages, salvage, or enforcement of health/safety laws, without prepaying fees/costs or furnishing security. A role label alone does not establish those predicates. S007, complete §1916; S001, 4(c)(3). uscode.house.gov
C027 Rule 4(d)(1) places an unnecessary-service-expense avoidance duty on an individual, corporation, or association subject to service under 4(e), (f), or (h). The plaintiff may notify that defendant that an action has commenced and request waiver. S001, 4(d)(1) opening. This is not an unrestricted waiver rule for every governmental or other recipient category.
C028 The waiver notice/request must be written; addressed to the individual or, for a 4(h) defendant, the specified officer/managing or general agent/authorized service agent; and identify the court where the complaint was filed. S001, 4(d)(1)(A)–(B). Actual agency or authority is not established.
C029 The request must include a complaint copy, two copies of the appended waiver form, and prepaid return means; it must explain the consequences using the appended form. S001, 4(d)(1)(C)–(D), complete appended forms. These are legal content categories, not a prepared packet.
C030 The request must state when it is sent and be sent by first-class mail or another reliable means. This is a waiver-request provision; it is not a universal authorization to serve a summons by ordinary mail. S001, 4(d)(1)(E), (G), compared with 4(e)–(j).
C031 The request must allow a reasonable return period of at least 30 days after sending, or at least 60 days if sent to the defendant outside every United States judicial district. These are minimums within a reasonableness requirement, not a single universally fixed return deadline. S001, 4(d)(1)(F); Rule 6(a). uscourts.gov+1
C032 If a defendant located within the United States fails without good cause to sign and return a waiver requested by a plaintiff located within the United States, the court must impose later service expenses and reasonable expenses, including attorney’s fees, of a motion required to collect those service expenses. S001, complete 4(d)(2)(A)–(B), read with a qualifying request under (d)(1). No amount, entitlement determination, or collection authority is supplied.
C033 The appended expense statement says a belief that the suit lacks merit, venue is improper, or jurisdiction is lacking does not constitute the specified good cause for failing to return the waiver. S001, complete appended expense statement, printed 8. This is not a finding about any defense or other possible good cause.
C034 A defendant who timely returns the waiver before being served with process need not answer until 60 days after the request was sent, or 90 days when sent outside every United States judicial district. S001, 4(d)(3); complete 12(a). Sending, return, filing, and service dates are distinct.
C035 When the plaintiff files a waiver, proof of service is unnecessary and the rules operate as though summons and complaint were served at the time the waiver was filed. S001, 4(d)(4). The special answer period still uses the sending trigger under (d)(3)/12(a), not a new period measured from filing.
C036 Waiving service does not waive objections to personal jurisdiction or venue. The appended waiver preserves defenses/objections generally while relinquishing objection to the absence of a summons or service. Separate Rule 12 preservation/waiver requirements remain relevant. S001, 4(d)(5), appended waiver/statement, complete Rule 12. This is not blanket consent to jurisdiction or admission of the merits.
C037 The appended request expressly distinguishes itself from a summons or official court notice. The appended waiver concerns receipt of the request/materials and agreement to dispense with formal service. The printed fields concern caption, legal recipient, sending date, signature capacity, and contact information; none were completed. S001, both complete appended forms and statement; S009, 2015 incorporation. Their functions differ from proof that a real form was issued or authorized.
C038 The appended waiver uses the shorthand “outside the United States” for its longer response period, while 4(d)(3), 12(a)(1)(A)(ii), and the appended request use outside any United States judicial district. This wording difference is preserved; the report does not establish that those territorial expressions are interchangeable. S001, printed 3, 6–7, 19; S009 shows the same adopted form wording. Any consequential territorial application remains unresolved. uscourts.gov+3

C. Recipient categories and methods

Claim ID Supported conditional rule Exact authority and limits
C039 Unless federal law provides otherwise, 4(e) concerns an individual within a United States judicial district, excluding a minor, incompetent person, or person whose waiver has been filed. One alternative follows service law of the State where the district court sits or where service occurs. S001, complete 4(e) opening and (1); 81(d). No State method is supplied or validated.
C040 A separate federal alternative is personal delivery of both summons and complaint copies to the individual. S001, 4(e)(2)(A), subject to the opening qualifications.
C041 The dwelling alternative requires leaving copies at the individual’s dwelling or usual abode with a person of suitable age and discretion who resides there. All those conditions matter. S001, 4(e)(2)(B). The rule supplies no universal numerical recipient age or factual definition of a particular abode.
C042 Another alternative is delivery of both copies to an agent authorized by appointment or by law to receive process. S001, 4(e)(2)(C). Employment, kinship, general assistance, or a representative label does not itself prove that authority.
C043 Unless federal law provides otherwise, 4(f) addresses an individual outside every United States judicial district, with the same minor/incompetence/filed-waiver exclusions. Paragraph (1) permits internationally agreed service reasonably calculated to give notice, identifying the service convention as an example. S001, 4(f) opening and (1). No treaty’s applicability, declarations, or method was investigated.
C044 Paragraph 4(f)(2) applies when no internationally agreed means exists, or an agreement permits but does not specify other means. The method must be reasonably calculated to give notice. Alternatives (A) and (B) refer respectively to qualifying foreign law or a foreign authority’s direction in response to a letter rogatory/request. S001, complete 4(f)(2) opening, (A)–(B). Those incorporated bodies and directions remain absent.
C045 Under 4(f)(2)(C), and unless foreign-country law prohibits, the specified alternatives are personal delivery of both documents or mail addressed and sent by the clerk that requires a signed receipt. The paragraph (2) threshold conditions also apply. S001, 4(f)(2)(C)(i)–(ii). This is not permission for any sender to use any international mailing method.
C046 Paragraph 4(f)(3) permits other means not prohibited by international agreement, as the court orders. The text does not itself select a method or establish an actual order, and this report does not infer judicial sequencing requirements. S001, complete 4(f)(3).
C047 For a minor or incompetent person within a United States judicial district, 4(g) requires the applicable service law of the State where service is made. Outside every such district, it specifies 4(f)(2)(A), (f)(2)(B), or (f)(3). It does not simply incorporate every 4(f) method. S001, complete 4(g). Capacity, age classification, guardianship, and incorporated law remain unestablished.
C048 Unless federal law provides otherwise or a waiver has been filed, 4(h) covers domestic/foreign corporations and partnerships or other unincorporated associations subject to suit in a common name. Within a judicial district, one alternative incorporates 4(e)(1)’s State-law route. S001, complete 4(h) opening, (1)(A). The organization’s label alone is insufficient.
C049 The other 4(h)(1) alternative delivers both copies to an officer, managing/general agent, or other agent authorized by appointment or law. If the agent is statutorily authorized and that statute requires it, copies must also be mailed to the defendant. S001, complete 4(h)(1)(B). The additional mailing is conditional, not universal.
C050 Outside every United States judicial district, 4(h)(2) incorporates 4(f)’s individual methods except personal delivery under 4(f)(2)(C)(i). S001, complete 4(h)(2). Foreign formation and foreign service location are different predicates. uscourts.gov
C051 Service on the United States requires the 4(i)(1)(A) route and (B), plus (C) when applicable: delivery to the relevant United States attorney or a qualifying written designee, or registered/certified mail to that office’s civil-process clerk; registered/certified mail to the Attorney General in Washington, D.C.; and, when challenging a nonparty federal agency/officer’s order, registered/certified mail to that agency/officer. S001, complete 4(i)(1)(A)(i)–(ii), (B), (C). These are generic statutory office categories; no occupant or address was researched.
C052 For a United States agency/corporation, or federal officer/employee sued only officially, 4(i)(2) requires service on the United States and registered/certified mailing of both documents to the specified agency, corporation, officer, or employee. S001, complete 4(i)(2).
C053 For a federal officer/employee sued individually for an act/omission connected with duties on the United States’ behalf, 4(i)(3) requires service on the United States and on the officer/employee under 4(e), (f), or (g), whether or not official-capacity claims are also asserted. S001, complete 4(i)(3). No actual capacity-of-suit or official-duty finding.
C054 The court must allow a reasonable cure period for failure to serve a person required by 4(i)(2) if either the United States attorney or Attorney General was served; or failure to serve the United States under 4(i)(3) if the officer/employee was served. S001, complete 4(i)(4)(A)–(B). No fixed number of cure days is supplied. uscourts.gov
C055 A foreign State or its political subdivision, agency, or instrumentality must be served under 28 U.S.C. §1608. Rule 4(j)(1) does not reproduce that statute’s full conditions. S001, complete 4(j)(1). §1608, necessary §1603 definitions, immunity, and related treaty questions are explicit dependencies, not completed analyses.
C056 A State, municipal corporation, or other State-created governmental organization subject to suit must receive both documents through delivery to its chief executive officer or the method that State law prescribes for such a defendant. S001, complete 4(j)(2)(A)–(B). Suitability of category, amenability to suit, and actual executive authority remain absent.

D. Jurisdiction, proof, service period, and property

Claim ID Supported conditional rule Exact authority and limits
C057 Under 4(k)(1)(A), service or filing a waiver establishes personal jurisdiction over a defendant subject to a general-jurisdiction court’s jurisdiction in the State where the district court is located. S001, 4(k)(1) opening and (A). That underlying jurisdictional predicate is not established.
C058 The 4(k)(1)(B) alternative requires a party joined under Rule 14 or 19, service within a United States judicial district, and service not more than 100 miles from issuance. S001, complete 4(k)(1)(B). Proper joinder, measuring convention, and actual distance are unresolved; this is not a universal 100-mile service radius.
C059 Another personal-jurisdiction route applies when a federal statute authorizes it. S001, 4(k)(1)(C). No particular authorizing statute is assumed.
C060 For a claim arising under federal law, 4(k)(2) requires both absence of jurisdiction in any State’s courts of general jurisdiction and consistency of federal jurisdiction with the Constitution and United States laws, in addition to service or filing a waiver. S001, complete 4(k)(2)(A)–(B). This is not an independent finding of subject-matter jurisdiction or constitutional sufficiency.
C061 Unless service is waived, proof must be made to the court. Except for service by a United States marshal/deputy, 4(l)(1) requires the server’s affidavit; foreign-service proof has the specific treatment in (l)(2). S001, 4(l)(1)–(2). No affidavit or service event was examined.
C062 Service outside every United States judicial district under 4(f)(1) is proved as the applicable treaty/convention provides. Under 4(f)(2) or (3), proof is a receipt signed by the addressee or other evidence satisfying the court that both documents were delivered. S001, complete 4(l)(2). Proof criteria do not independently establish that the chosen service method was lawful.
C063 Failure to prove service does not affect service’s validity; the court may allow proof to be amended. S001, 4(l)(3). Conversely, filing proof does not itself prove that all service prerequisites were met.
C064 If service has not occurred within 90 days after complaint filing, 4(m), where applicable, requires a court response: dismissal without prejudice against that defendant or an order for service within a specified time. The rule describes action on motion or on the court’s own initiative after notice to the plaintiff. S001, complete 4(m). It is not an automatic factual dismissal or a defendant’s answer period.
C065 If the plaintiff shows good cause for the failure, the court must extend service time for an appropriate period. The rule’s alternative court response also prevents treating absence of a proven good-cause showing as textually requiring dismissal in every instance. S001, complete 4(m); S009, attributed committee explanation. No actual good cause, extension, or expiration is decided.
C066 Rule 4(m) excludes foreign-country service under 4(f), 4(h)(2), or 4(j)(1) and service of a notice under 71.1(d)(3)(A). The latter is a specified condemnation notice served under Rule 4 without a complaint copy when its residence/address predicates hold. S001, complete 4(m), complete selected 71.1(d). No universal foreign-service deadline or condemnation procedure is supplied. uscourts.gov+1
C067 Under 4(n)(1), the court may assert jurisdiction over property if authorized by federal statute; claimants must receive notice as the statute provides or through summons service under Rule 4. S001, complete 4(n)(1). The authorizing statute and property facts are absent.
C068 Under 4(n)(2), a showing must establish inability to obtain personal jurisdiction in the district through reasonable efforts at Rule 4 service before the court may assert jurisdiction over assets found there. Acquisition of jurisdiction depends on seizure under the circumstances and manner provided by the district’s State law. S001, complete 4(n)(2). No asset location, seizure right, lien, exemption, collection remedy, or debt validity is determined.

E. Indispensable response, computation, and emergency boundaries

Claim ID Supported conditional rule Exact authority and limits
C069 Rule 12(a)’s ordinary answer period is 21 days after service of summons and complaint, subject to a different federal statutory time and the rule’s special routes. Timely waiver instead invokes the 60/90-day sending-based periods. S001, complete 12(a), especially (1)(A); S014. Merely receiving a letter is not established service.
C070 Rule 12(a)(1)(B) gives 21 days after service of a counterclaim/crossclaim pleading for the answer to it. Paragraph (C) gives 21 days after service of an order to reply to an answer, unless that order sets another time. S001, complete 12(a)(1). These are different documents/triggers, not additional summons periods.
C071 Rule 12(a)(2) uses 60 days after service on the United States attorney for the United States, a federal agency, or an officer/employee sued only officially. Paragraph (3), for qualifying individual-capacity official-duty suits, uses 60 days after service on the officer/employee or United States attorney, whichever is later. S001, complete 12(a)(2)–(3), subject to 12(a)’s federal-statute qualification. The list should not be expanded by analogy to every organizational defendant.
C072 Unless the court sets another time, serving a Rule 12 motion alters the stated responsive-pleading periods: denial or postponement until trial produces a 14-day period after notice of the court’s action; granting a more-definite-statement motion produces a 14-day period after service of that statement. S001, complete 12(a)(4)(A)–(B). Filing, service, notice of action, and service of the statement must not be conflated. uscourts.gov+2
C073 Rule 12 distinguishes subject-matter jurisdiction, personal jurisdiction, venue, insufficient process, insufficient service, merits sufficiency, and joinder. Under 12(g)–(h), certain defenses can be lost through specified omissions even though signing a Rule 4 waiver did not itself surrender them. The permitted Rule 15(a)(1) amendment route has its own once-only and 21-day alternatives. S001, complete Rule 12, especially (b), (g), (h); complete selected 15(a)(1). All actual preservation, motion, amendment, and defense decisions remain held. uscourts.gov+2
C074 For rule periods in days or longer units, Rule 6(a)(1) excludes the triggering day, counts intermediate weekends/holidays, and includes the last day unless it falls on a weekend/legal holiday, when the period continues to the next qualifying day. Rule 6(a)’s scope also covers local rules/orders and statutes lacking their own computation method. S001, complete 6(a), particularly opening and (1). No actual calendar is supplied.
C075 Rule 6(a) separately addresses hour periods, clerk-office inaccessibility, filing cutoffs, forward/backward counting, and legal holidays. Electronic filing ordinarily ends at midnight in the court’s time zone; other filing at scheduled clerk closing, unless statute/local rule/order sets another time. The holiday definition includes the listed statutory observances, President/Congress-declared holidays, and—only for periods measured after an event—other holidays declared by the relevant State. S001, complete 6(a)(2)–(6); S013. Filing cutoffs are not silently made universal service-completion times.
C076 Under ordinary Rule 6(b)(1), extensions require good cause. Before expiry, the court may act with or without motion/notice if it acts or receives the request before the original/extended period expires. After expiry, a motion and failure because of excusable neglect are required. Rule 6(b)(2) separately restricts specified postjudgment periods; the special Rule 87(c)(2) regime is not generalized into ordinary extension power. S001, complete 6(b), complete 87 read for context. Postjudgment motions and appellate consequences are held.
C077 Rule 6(d)’s additional 3 days requires an act due a specified time after being served and service under Rule 5(b)(2)(C), (D), or (F). It is not a general addition to every mailed Rule 4 document or to a period measured from sending a waiver request. S001, complete 6(d), 5(b); S010, adopted 2016 clause.
C078 Rule 5 addresses specified later papers and its own methods, including attorney service, conditional mailing/electronic/consented methods, and exceptions. In particular, a new claim against a party in default for failing to appear must be served under Rule 4. Rule 5 methods are not automatically substituted for initial Rule 4 service. S001, complete 5(a)–(c), reliance principally (a)(2), (b). Full filing/service practice remains held. uscourts.gov+3
C079 Rule 87 requires a Judicial Conference determination of extraordinary public-health/safety or access circumstances substantially impairing a court’s ability to comply. A declaration must designate affected courts, specify a period no longer than 90 days, and adopt the emergency rules unless excepted. Early termination and additional declarations are permitted. S001, complete 87(a)–(b); S013. No actual emergency or declaration is assumed.
C080 Under an applicable declaration, Rule 87(c)(1) lets the court order a notice-reasonable service method for the specified 4(e), (h)(1), (i), and (j)(2) recipients and minors/incompetent persons within a judicial district. Completion may occur after the declaration ends unless the court modifies/rescinds the order after notice and opportunity to be heard. S001, complete 87(c)(1), read with (a)–(b); S013. The declaration alone does not select a service method. uscourts.gov+2
C081 A generic period does not determine an actual deadline without the relevant sending, service, filing, notice, order, statutory override, computation, and exception predicates. S001, 4(d), 4(i)(4), 4(m), 6, 12(a), 81(c), 87. No deadline calculated.
C082 Rule 4 uses such terms as dwelling/usual abode, suitable age/discretion, authorized agent, minor, incompetent person, good cause, reasonable time, and reasonable service efforts without providing a complete general definition for each. S001, complete Rule 4. No medical, capacity, agency, residence, or universal age conclusion is inferred.
C083 Rule 4 contains waiver-return requirements and proof provisions but does not supply a separate universally fixed “return of summons” period or a fixed monetary service-fee schedule. S001, complete Rule 4, especially (d), (l), (m). Other applicable law/order/fee authority remains held.
C084 The required default warning is document content. It does not establish that default or judgment has occurred, that liability is admitted, or that collection may begin. Debt merits, Rule 55 adjudication, judgment enforcement, satisfaction, garnishment, and other A087 pathways remain outside the selected component. S001, 4(a)(1)(E), appended forms, Rules 12 and 82; S003, §2072(b).
C085 Currentness is bounded by the successful compilation/index and codification reads. Failed newer endpoints, the unavailable original 1990 amendment, selected historical reading, unexamined incorporated regimes, and absence of judicial review prevent an exhaustive currentness or application certification. S001–S017 and read/failure log. This is a researcher limitation, not a proposition that an inaccessible authority is absent or ineffective.

4. Provision-specific comparison for generic document analysis

Distinction Supported comparison Boundary that remains unresolved Claims
Letter versus summons Rule 4(a)–(b) describes required summons content and issuance. The appended waiver request expressly identifies a different document function. Rule 4 does not classify every collector letter or authenticate any document from appearance. C020–C022, C037, C084
Complaint filing versus issuance Filing commences the civil action under Rule 3; issuance under 4(b) follows on or after filing and requires proper completion. No actual filing or issuance established. C003, C022
Issuance versus service Clerk issuance supplies a summons for service; 4(c) separately allocates service responsibility. Issuance does not prove delivery by an authorized method. C022–C024
Service versus proof Rule 4(l) governs proof; failure to prove does not itself invalidate service. Neither a missing affidavit nor a filed affidavit alone resolves actual validity. C061–C063
Waiver request versus waiver A qualifying request offers a formal-service waiver; timely return and filing have separate consequences. A request, receipt, silence, signature, and filed waiver are different absent events. C027–C035
Waiver of service versus defenses Rule 4 preserves jurisdiction/venue objections; the form relinquishes objections to absence of summons/service. Separate Rule 12 preservation rules may matter; no defense is adjudicated. C036, C073
Recipient category versus qualification Rule 4(e)–(j) uses different persons, locations, capacities, and legal roles. Labels do not establish minority, incompetence, agency authority, governmental status, or capacity of suit. C039–C056, C082
Federal alternative versus State-law incorporation Rule 4(e) supplies alternatives; 4(g), 4(h), and 4(j) incorporate State law differently. State law includes judicial decisions; no jurisdiction-specific rule or decision was researched. C007, C039–C049, C056
Foreign-service route versus domestic route Rule 4(f), (g), (h)(2), and (j)(1) contain distinct incorporation and exclusion conditions. Treaty, foreign law, §1608, territorial terminology, and actual court orders remain unresolved. C038, C043–C055
Personal jurisdiction versus subject-matter jurisdiction Rule 4(k) concerns effective service’s personal-jurisdiction consequences under cumulative predicates; Rule 82 limits what procedural rules establish. No jurisdictional predicate is proved by the report. C002, C057–C060
Minimum return time versus answer period The waiver request must allow a reasonable minimum return period; the special answer period uses a separate sending-based rule. Neither period can be calculated without facts and applicable qualifications. C031, C034–C035, C069–C072
Mandatory versus discretionary action Examples include mandatory clerk issuance when properly completed, discretionary summons amendment, mandatory qualified cure/good-cause extensions, and alternative court responses under 4(m). “Must,” “may,” alternatives, and exceptions cannot be converted into an actual order. C021–C022, C054, C064–C065
Ordinary method versus emergency order Rule 87 supplies a qualified declaration-and-order route for specified recipients. An emergency concern alone is not an operative declaration or service order. C079–C080
Current text versus history/proposal Current 4(m) combines provisions authenticated in the 2015–2017 sequence. Future index entries are not operative amendments. Full later-law, original-history, and judicial audits remain incomplete. C012–C018, C085
Procedure versus debt outcome Service and response rules concern civil procedure. Debt validity, affordability, cancellation, settlement, collection defenses, garnishment, or payment decisions do not follow. C004, C084

5. Complete relied-on measurement register

No actual calculation, hypothetical calendar, financial model, or distance calculation is provided. For day periods governed by Rule 6(a), the triggering day is excluded, intermediate days are counted, and the terminal-day qualifications apply. That convention does not fill missing service, sending, filing, receipt, notice, or order facts. Rule 4 does not supply a distance-measurement or rounding convention for its 100-mile provision. [C058, C074–C081.]

6. Conditional evidence-category branches

These branches are qualitative public-law categories. “Missing” identifies why no application finding follows; it is not a request to collect actual records.

Branch Supported conditional rule and claim/source Missing predicate or authority Adverse inference to avoid Next permissible generic public-instruction inquiry
B01 — Federal scope unknown Rule 1 applies subject to Rule 81; Rule 82 preserves jurisdiction limits. C002; S001. Proceeding category and governing jurisdictional law. Every document titled summons is governed by federal Rule 4. Which Rule 81 qualification or separate federal procedural authority governs the legal category?
B02 — Current original unavailable A failed endpoint supplies no rule body. C085; S015–S017. Readable latest/original authority for the failed item. Failure proves repeal or absence. Is another ordinary official publication of the same instrument readable?
B03 — History incomplete Selected enactments/orders authenticate specified changes, not the entire chain. C010–C018, C085. Unread original amendments and later-law history. One compilation proves exhaustive currentness. Which specific unverified amendment/application clause could change the selected proposition?
B04 — Complaint filing unknown Filing is commencement; issuance may follow on or after. C003, C022; S001. No commencement or issuance event. A private communication proves an action commenced. What distinction do Rules 3 and 4(b) make between filing and issuance?
B05 — Summons contents All 4(a)(1) elements apply cumulatively. C020. No document; no authenticity evidence. Apparent seal or missing field conclusively resolves validity. What does 4(a)(2) permit, and which validity issue requires authority beyond the rule’s text?
B06 — Amendment Court may permit summons amendment. C021. Permission, defect category, and applicable law. A defect is automatically cured or fatal. What issue remains for generic amendment/validity authority beyond 4(a)(2)?
B07 — Issuance for each recipient Properly completed summons must issue for each defendant to be served. C022. No issuance or recipient facts. A multiple-addressee caption proves issuance for all. How does 4(b) distinguish an issued summons from a qualifying copy?
B08 — Responsibility Plaintiff bears service/copy responsibility subject to 4(m). C023. No service or copying facts. Clerk issuance completes service. Which distinct duties appear in 4(b), (c), and (m)?
B09 — Server qualification General server must be at least 18 and not a party. C024. No server category or age fact. Adult status alone establishes proper service. Which additional method/recipient predicates remain after 4(c)(2)?
B10 — Court-directed service Court may order the specified service; must so order for qualified statutory authorization. C025–C026; S007. Authorization/order; full eligibility questions held. A poverty or occupation label guarantees appointment or free litigation. What does the authorization dependency in 4(c)(3) require without deciding eligibility?
B11 — Waiver coverage 4(d)(1) is tied to recipients subject to 4(e), (f), or (h). C027. Recipient legal category. Every governmental defendant has identical waiver duties. Does the relevant generic category fall within the rule’s express cross-references?
B12 — Request recipient Written request must reach the specified individual or organizational recipient category. C028. Agency/role authority. Any employee or adviser can receive or authorize waiver. What authority category does 4(d)(1)(A) actually name?
B13 — Request completeness Complaint, two waiver copies, prepaid return, prescribed explanation, court identification, sending date, and reliable means are required. C028–C030. No request or sending facts. A bare request triggers all waiver consequences. Which conjunctive request elements govern under complete 4(d)(1)?
B14 — Return minimum Reasonable return time has a 30/60-day floor according to the specified location predicate. C031. Sending/location facts; actual allowed time. Minimum equals a universal fixed deadline. How do reasonableness and the location-dependent minimum interact?
B15 — Waiver expenses Domestic plaintiff/defendant location, qualifying request, failure without good cause, later expenses, and required collection motion qualify cost shifting. C032–C033. Every application predicate and amount. Refusal automatically creates a fixed debt or merits admission. Which elements of 4(d)(2) must remain separate?
B16 — Timely pre-service return Special answer treatment requires timely return before process service. C034. Sending, return, and service events absent. Any signed waiver, however timed, receives the same answer period. What temporal conditions distinguish 4(d)(3) from (d)(4)?
B17 — Filing waiver Filing creates the rule’s deemed-service point and dispenses with proof. C035. No filed waiver. Receipt or signature alone equals filing. Which consequence attaches to filing rather than signing or sending?
B18 — Defense preservation Rule 4 waiver preserves jurisdiction/venue objections, while Rule 12 has independent omission rules. C036, C073. No pleading/motion or preservation facts. Waiver admits liability, or preserves every defense indefinitely. How do 4(d)(5), 12(g)–(h), and the narrow 15(a)(1) reference differ?
B19 — Territorial wording Body and appended waiver use different geographic formulations. C038. Authoritative territorial reconciliation. “Outside the United States” always equals outside every judicial district. What generic authority resolves that precise territorial distinction?
B20 — Individual/State alternative 4(e)(1) permits either specified State’s service law, subject to its opening exclusions. C039. Applicable State law and category. All States authorize one uniform method. Which incorporated State-law body would have to be read before a method claim?
B21 — Personal delivery 4(e)(2)(A) concerns delivery of both documents to the individual. C040. Actual delivery and recipient identity absent. Receipt of an unrelated paper is equivalent. What document and recipient elements distinguish this alternative?
B22 — Dwelling delivery Dwelling/usual abode, suitable age/discretion, and resident recipient are cumulative. C041. All residence and qualification facts. Any family member or occupant suffices. Which terms remain undefined by Rule 4 itself?
B23 — Agent Appointment or law must authorize receipt of process. C042. Actual authority and governing agency law. General assistance, employment, or a power label proves service authority. What separate public authority would define the claimed process-receiving authority?
B24 — International agreement 4(f)(1) requires qualifying agreed means reasonably calculated to notify. C043. Agreement applicability and operative clauses. International service is one uniform mailing route. Which complete treaty/service provision and qualifications would be indispensable?
B25 — Foreign-law alternatives 4(f)(2)’s threshold and notice standard qualify its alternatives. C044–C045. Foreign law/agreement/direction. Listing an alternative proves its availability. Does the governing agreement permit the route before foreign-law details are considered?
B26 — Foreign court-ordered route 4(f)(3) requires an order and no international-agreement prohibition. C046. Order and agreement predicates. Any apparently reliable method is authorized. What does the text leave unresolved about the proposed legal category of method?
B27 — Minor/incompetent category 4(g) supplies a distinct State-law or limited foreign-route framework. C047. Legal classification; applicable law. Age, illness, or assistance need alone establishes this category. Which public capacity/classification and service authorities are indispensable, without assessing anyone?
B28 — Organization within district 4(h)’s category and alternatives require their own predicates. C048–C049. Suitability of common-name category; recipient authority; statutory mailing condition. Delivery to any organizational location or worker suffices. What does the chosen 4(h)(1) alternative require in addition to organizational status?
B29 — Organization outside district 4(h)(2) excludes one particular personal-delivery route. C050. Location, agreement, law, and method predicates. All 4(f) options transfer unchanged to organizations. Which incorporated method is expressly excluded?
B30 — United States 4(i)(1) has alternative first-stage service but cumulative additional recipients. C051. No service or challenged-order facts. Serving one federal office completes every requirement. Which connectors in 4(i)(1)(A)–(C) are alternatives and which are cumulative?
B31 — Official versus individual capacity 4(i)(2) and (3) impose different additional service requirements. C052–C053. Capacity-of-suit and official-duty predicates. All claims against federal personnel use one method. What difference does the rule expressly attach to capacity and duty connection?
B32 — Qualified cure Reasonable cure time is mandatory only under the stated partial-service predicates. C054. Partial service and court response absent. Any incomplete federal service automatically qualifies. Which exact 4(i)(4) condition activates the cure requirement?
B33 — Foreign government 4(j)(1) mandates the §1608 route. C055. Complete §1608/§1603 and other necessary authority. Private-organization methods automatically apply. Read those complete public statutory clauses in a separately bounded inquiry before describing their methods.
B34 — State/local government Executive delivery or the specified State-law method applies to a qualifying entity subject to suit. C056. Entity category, amenability, method law. A governmental label proves amenability or recipient authority. What State-law method or status predicate is incorporated by 4(j)(2)?
B35 — General personal jurisdiction 4(k)(1)(A) depends on the specified State-court jurisdictional predicate. C057. Underlying jurisdiction law. Valid-looking service creates jurisdiction in every case. What independent public jurisdictional authority supplies that predicate?
B36 — Limited distance route Rule 14/19 joinder, judicial-district service, and ≤100 miles must coexist. C058. Joinder law/facts and measurement convention. A universal national 100-mile service rule exists. Which complete joinder provision and distance convention would be needed for a dependent claim?
B37 — Federal statutory/federal-claim routes 4(k)(1)(C) requires statutory authorization; (k)(2) has separate federal-claim, no-State-jurisdiction, and constitutional/legal conditions. C059–C060. Authorizing statute and jurisdictional predicates. A federal claim alone establishes every form of jurisdiction. Which of these distinct legal routes is being described, and what public authority remains missing?
B38 — Proof 4(l) distinguishes affidavit, foreign proof, and validity. C061–C063. No proof or delivery evidence. Missing proof conclusively means no service, or proof conclusively means valid service. Which proof clause applies to the generic method category?
B39 — Ordinary service period Applicable 4(m) period runs from complaint filing with qualified court responses. C064–C065. Filing/service/notice/order facts. Expiry automatically produces dismissal or liability. How do the alternatives and mandatory good-cause extension qualify the rule?
B40 — Express service-period exclusions Foreign-service and specified condemnation-notice routes are excluded from 4(m). C066. Qualifying route and separate governing authority. Exclusion means no time control or no court supervision. Which separate public provision controls the excluded category?
B41 — Property/assets 4(n) requires statutory authority or its specified reasonable-efforts/State-law predicates. C067–C068. Authorization, jurisdiction, location, and seizure law. Rule 4 itself validates debt or authorizes collection against any asset. What separate public statute/State-law authority is indispensable to the asserted jurisdictional route?
B42 — Answer period Rule 12(a) differentiates ordinary, waiver, federal-government, and motion-related periods. C069–C072. Applicable category and trigger facts. Every civil paper permits the same response time. Which complete 12(a) clause governs the legal category, subject to statutory override?
B43 — Computation/additional days Rule 6’s computation, extension, and limited extra-days provisions differ. C074–C077. Trigger, governing order, holiday/inaccessibility circumstances. Every mailing adds three days or every act ends at midnight. Which precise computation provision applies to the stated kind of period and act?
B44 — Removed action Rule 81(c)(2) uses a longest-of relationship for a defendant who had not answered. C009. Removal and pleading predicates. Ordinary Rule 12 timing transfers without qualification. What does complete 81(c)(2) change in the generic removed-action category?
B45 — Emergency service Declaration predicates plus an applicable court order are required. C079–C080. No declaration, covered court, exception, or order. An emergency concern suspends or changes service rules automatically. What does complete Rule 87 require before its service provision operates?
B46 — Local or other-law boundary Generic authority permits consistent local regulation; actual local practice remains unexamined. C006, C008, C085. Applicable local/specialized authority. National Rule 4 is the entire procedure. Identify the exact unresolved public rule or statutory incorporation without querying a proceeding.
B47 — Judgment/debt merits Service warnings and procedural duties do not establish an actual judgment or financial result. C084. Merits, default adjudication, judgment, and enforcement authority. An apparent summons proves debt validity, a payment duty, or collection authority. Which separate generic public-law component would address the unresolved merits or remedy question?
B48 — Remaining A087 pathways This component supplies public procedural categories only. C019, C084–C085. Collector-letter law, inability-to-pay issues, defenses, garnishment, completion, urgent routing, and actual outcomes. Completion of this pass validates a live pathway or recommends action. Keep each outside dimension separately scoped; no actual document or personal decision is inferred.

Generic searches Search hits used only to locate public authorities. Incidental unrelated or case-specific search results were not opened or relied on.
PDF format Parsed text only. No claim of viewed page pixels, authenticated signature/seal, or whole-publication review from selected pages.
Actual-document or record work None undertaken. No summons, pleading, service record, waiver, notice, order, docket, calendar, party, server, or local court program was queried or created.

10. Explicit unresolved boundaries

  1. Actual application remains wholly unresolved. No court, proceeding, document, filing, issuance, service, waiver, role, residence, capacity, authority, expense, order, or date is established. The conditional rules cannot determine validity, liability, default, or a due date. [C019, C081, C084.]
  2. Incorporated State law is not uniform federal text. Rule 81(d) includes State judicial decisions within State law. Rules 4(e), (g), (h), (j), and (n) incorporate different State-law questions. None was silently answered from federal Rule 4 alone. [C007, C039, C047–C049, C056, C068.]
  3. Foreign and foreign-government service require further authority. International agreements, foreign service law, foreign-authority directions, §1608 and necessary §1603 definitions are held. Rule 4’s references are established; their complete dependent regimes are not. [C043–C055.]
  4. Personal-jurisdiction routes are cumulative. Rule 4(k)’s State-jurisdiction, joinder/distance, statutory-authorization, and federal-claim alternatives do not prove subject-matter jurisdiction or constitutional sufficiency. The 100-mile rule is limited to its expressed category and has no authenticated measurement convention here. [C057–C060.]
  5. The waiver form’s territorial shorthand is not silently reconciled. The difference identified in C038 needs exact generic authority before any consequence is assigned to a territorial category.
  6. Historical authentication is selective. Current codification is readable, but the original 1990 amendment bodies were not. The 2016 official package’s parsed order-date line is blank. The 2009 Supreme Court order and GPO transmittal show different dates. None of those gaps was converted into a conclusion about invalidity or an actual proceeding. [C013, C017, C085.]
  7. Emergency power is conditional. Rule 87 is current adopted authority, but no declaration, covered court, exception, or implementing order was investigated. No departure from ordinary service is established. [C079–C080.]
  8. No downstream legal or financial outcome follows. The full default, merits, motion, local-practice, appeal, judgment-enforcement, satisfaction, garnishment, bankruptcy, debt, and consumer-protection regimes remain held. This component does not determine what any visitor should do with a document or whether a debt should be paid, disputed, settled, or ignored. [C002, C004, C084–C085.]

C001The current selected Rule 4 has fourteen subdivisions, (a)–(n), and the two appended blank forms plus expense statement identified above. Its current compilation is amended through December 1, 2025; its Rule 4 amendment credit ends in 2017.S001, Rule 4 complete, printed 1–8; foreword. This does not certify all later legislation or adjudication. uscourts.gov +2
C002Rule 1 governs procedure in civil actions and proceedings in United States district courts, subject to Rule 81. Rule 82 says the rules do not extend or limit district-court jurisdiction or venue; its admiralty/maritime sentence separately points to §1390.S001, Rules 1, 81, 82. Subject-matter jurisdiction, immunity, venue, and specialized statutes are not established by recognizing a summons category.
C003Rule 3 identifies filing a complaint with the court as commencement of a civil action. This is distinct from subsequent issuance and service under Rule 4.S001, Rule 3; 4(b)–(c). uscourts.gov
C004Section 2072 authorizes Supreme Court rules of practice, procedure, and evidence for the specified federal courts, including district-court proceedings before magistrate judges. Such rules must not abridge, enlarge, or modify substantive rights. Its conflict provision applies after rules take effect; subsection (c) separately addresses defining finality for §1291 appeals.S003, complete §2072(a)–(c). No general constitutional, conflict-of-laws, or appellate analysis follows. uscode.house.gov
C005Section 2074 generally requires transmission to Congress not later than May 1 of the effective year and effectiveness no earlier than December 1 that year, unless law provides otherwise. Pending application cannot be required where the receiving court finds it infeasible or unjust; the former rule then applies. A rule creating, abolishing, or modifying an evidentiary privilege needs congressional enactment.S004, complete §2074(a)–(b). These are rulemaking conditions, not litigant response periods. uscode.house.gov
C006Generic local-rule authority requires consistency with governing statutes/national rules. Under 83(b), otherwise-unregulated practice must remain consistent; an unpublished additional requirement cannot support sanction or disadvantage without actual notice in the particular case.S005, §2071(a)–(f); S001, complete Rule 83. No actual local rule or directive was inspected. uscode.house.gov +3
C007For these rules, State “law” includes statutes and judicial decisions. “State” includes, where appropriate, the District of Columbia and United States commonwealths or territories. For the federal district court in the District of Columbia, “federal statute” includes Acts of Congress applicable locally there.S001, complete Rule 81(d)(1)–(3). This identifies dependencies; it does not supply the unexamined State decisions or territorial law.
C008Rule 81 contains distinct treatment for prize, bankruptcy, citizenship, habeas/quo-warranto, federal-subpoena, and specified statutory proceedings. Its incorporation of other procedures is qualified, not a blanket statement that ordinary civil procedure controls every such proceeding.S001, complete 81(a)(1)–(6), (b). Incorporated bodies—including the printed prize citation, citizenship law, bankruptcy rules, special-writ rules, and listed review/arbitration statutes—remain held. uscourts.gov +2
C009The rules apply after removal from State court. Repleading is unnecessary unless ordered. For a defendant who did not answer before removal, Rule 81(c)(2) uses the longest of its three stated periods: 21 days after receipt of the initial pleading through service or otherwise; 21 days after service of the summons for an initial pleading already on file; or 7 days after filing the notice of removal.S001, complete 81(c), specifically (1)–(2). Removal authority and jury-demand procedure are separate holds; no actual removal is inferred. uscourts.gov
C010Rule 86(a) applies effective rules to later-commenced actions and later proceedings in pending actions, unless the Supreme Court provides otherwise or the court finds application infeasible or unjust. Rule 86(b) preserves the specified preexisting priority-in-time relationship for the December 1, 2007 restyling.S001, complete Rule 86; S004. The original 2007 order was not separately authenticated here.
C011The original 1988 Rules Enabling Act clauses read here took effect December 1, 1988. Section 406 preserved rules lawfully prescribed and in force at that time until changed under the amended law.S006, §§401(a), 403(a)(1), 406–407. This is a selected enactment check, not a complete historical chain. govinfo.gov +3
C012The 2015 adopted Rule 4 changes reduced the presumptive service period from 120 to 90 days, added the specified condemnation-notice exception, and directly incorporated the waiver forms as the general forms appendix was abrogated. The order’s effective date was December 1, 2015, with qualified pending application.S009, adoption order; adopted 4(d), 4(m), forms; Rule 84/Appendix clauses; complete selected committee notes. The 120-day figure is historical only. uscourts.gov +3
C013The 2016 adopted package added an express 4(h)(2) foreign-service reference to 4(m), but its displayed replacement text omitted the condemnation clause. The August clarification letter explained an intended combined effect; that letter was explanatory, not a replacement adoption order.S010, adopted 4(m) and complete committee note; S011, complete substantive letter. The package release date and blank parsed order-date line are kept separate. uscourts.gov +3
C014The April 27, 2017 order adopted the combined Rule 4(m) text effective December 1, 2017, subject to its pending-proceeding qualification. Its committee note calls the change a technical integration of the intended effects of the preceding amendments.S012, complete order, complete adopted 4(m), complete committee note. No judicial resolution of the historical interim discrepancy is asserted. uscourts.gov +1
C015The April 24, 2023 order adopted Rule 87 and the selected Rule 6 holiday amendment effective December 1, 2023, with qualified pending application. Rule 87 can affect specified Rule 4 methods despite not being an amendment within Rule 4 itself.S013, complete order, selected Rule 6 clause, complete Rule 87.
C016The April 2, 2024 order adopted Rule 12(a)’s current opening statutory-time qualification, effective December 1, 2024, with qualified pending application.S014, complete order and amendatory clause; current S001, 12(a). supremecourt.gov
C017The selected 2009 order and amendments authenticate the revised general day-counting framework and selected responsive-pleading periods, effective December 1, 2009, with the order’s just-and-practicable pending qualification. Later amendments must still be applied, including the selected 2023 and 2024 changes.S008, order and selected Rule 6/12 amendatory bodies; S013–S014.
C018The current/pending indexes support the identified 2025 compilation and distinguish future proposals. The displayed future lists do not supply a new operative Rule 4. They list possible future changes to related Rules 81 and 6, but those proposal bodies were not adopted as premises here.S002. No inference that no unexamined law, future revision, or relevant order exists. uscourts.gov
C019A public rule’s prerequisites are not evidence that any corresponding factual event occurred. No document identity, issuance, service, waiver, authority, residence, legal capacity, court order, or deadline is established by this report.Bounded application of S001, Rules 3–4, 6, 12, 81–87; absence of actual facts in the requested scope.

C020A summons must identify the court and parties; be directed to the defendant; provide the plaintiff’s attorney’s name/address or the unrepresented plaintiff’s; state the time to appear and defend; contain the specified default-judgment warning; carry the clerk’s signature; and bear the court seal.S001, complete 4(a)(1)(A)–(G). These content requirements do not authenticate any apparent signature or seal or establish default. uscourts.gov
C021The court may permit amendment of a summons. The text does not make every defect automatically curable or every amendment self-executing.S001, 4(a)(2).
C022On or after filing the complaint, the plaintiff may present a summons for signature/seal. If properly completed, the clerk must sign, seal, and issue it for service. A summons—or an appropriately addressed copy of a summons addressed to multiple defendants—must issue for each defendant to be served.S001, complete 4(b). Issuance is distinct from service.
C023The summons must be served with a complaint copy. The plaintiff is responsible for service within the time allowed by 4(m) and must supply necessary copies to the server.S001, 4(c)(1), read with complete 4(m).
C024Rule 4(c)(2)’s general server qualification is cumulative: at least 18 years old and not a party. This age concerns the server; it is not a definition of a minor recipient or “suitable age and discretion.”S001, 4(c)(2), 4(e)(2)(B), 4(g).
C025At the plaintiff’s request, the court may order service by a United States marshal, deputy marshal, or specially appointed person; it must so order when the plaintiff is authorized under §1915 or §1916. Section 1915(d) separately directs court officers to issue and serve process and perform duties in such cases.S001, complete 4(c)(3); S007, complete §1915(d). Actual statutory authorization is absent; poverty, fee, and prisoner-litigation determinations are held.
C026Section 1916 concerns suits/appeals brought by seamen in their own names and for their own benefit for wages, salvage, or enforcement of health/safety laws, without prepaying fees/costs or furnishing security. A role label alone does not establish those predicates.S007, complete §1916; S001, 4(c)(3). uscode.house.gov
C027Rule 4(d)(1) places an unnecessary-service-expense avoidance duty on an individual, corporation, or association subject to service under 4(e), (f), or (h). The plaintiff may notify that defendant that an action has commenced and request waiver.S001, 4(d)(1) opening. This is not an unrestricted waiver rule for every governmental or other recipient category.
C028The waiver notice/request must be written; addressed to the individual or, for a 4(h) defendant, the specified officer/managing or general agent/authorized service agent; and identify the court where the complaint was filed.S001, 4(d)(1)(A)–(B). Actual agency or authority is not established.
C029The request must include a complaint copy, two copies of the appended waiver form, and prepaid return means; it must explain the consequences using the appended form.S001, 4(d)(1)(C)–(D), complete appended forms. These are legal content categories, not a prepared packet.
C030The request must state when it is sent and be sent by first-class mail or another reliable means. This is a waiver-request provision; it is not a universal authorization to serve a summons by ordinary mail.S001, 4(d)(1)(E), (G), compared with 4(e)–(j).
C031The request must allow a reasonable return period of at least 30 days after sending, or at least 60 days if sent to the defendant outside every United States judicial district. These are minimums within a reasonableness requirement, not a single universally fixed return deadline.S001, 4(d)(1)(F); Rule 6(a). uscourts.gov +1
C032If a defendant located within the United States fails without good cause to sign and return a waiver requested by a plaintiff located within the United States, the court must impose later service expenses and reasonable expenses, including attorney’s fees, of a motion required to collect those service expenses.S001, complete 4(d)(2)(A)–(B), read with a qualifying request under (d)(1). No amount, entitlement determination, or collection authority is supplied.
C033The appended expense statement says a belief that the suit lacks merit, venue is improper, or jurisdiction is lacking does not constitute the specified good cause for failing to return the waiver.S001, complete appended expense statement, printed 8. This is not a finding about any defense or other possible good cause.
C034A defendant who timely returns the waiver before being served with process need not answer until 60 days after the request was sent, or 90 days when sent outside every United States judicial district.S001, 4(d)(3); complete 12(a). Sending, return, filing, and service dates are distinct.
C035When the plaintiff files a waiver, proof of service is unnecessary and the rules operate as though summons and complaint were served at the time the waiver was filed.S001, 4(d)(4). The special answer period still uses the sending trigger under (d)(3)/12(a), not a new period measured from filing.
C036Waiving service does not waive objections to personal jurisdiction or venue. The appended waiver preserves defenses/objections generally while relinquishing objection to the absence of a summons or service. Separate Rule 12 preservation/waiver requirements remain relevant.S001, 4(d)(5), appended waiver/statement, complete Rule 12. This is not blanket consent to jurisdiction or admission of the merits.
C037The appended request expressly distinguishes itself from a summons or official court notice. The appended waiver concerns receipt of the request/materials and agreement to dispense with formal service. The printed fields concern caption, legal recipient, sending date, signature capacity, and contact information; none were completed.S001, both complete appended forms and statement; S009, 2015 incorporation. Their functions differ from proof that a real form was issued or authorized.
C038The appended waiver uses the shorthand “outside the United States” for its longer response period, while 4(d)(3), 12(a)(1)(A)(ii), and the appended request use outside any United States judicial district. This wording difference is preserved; the report does not establish that those territorial expressions are interchangeable.S001, printed 3, 6–7, 19; S009 shows the same adopted form wording. Any consequential territorial application remains unresolved. uscourts.gov +3

One alternative follows service law of the State where the district court sits or where service occurs.S001, complete 4(e) opening and (1); 81(d). No State method is supplied or validated.
C040A separate federal alternative is personal delivery of both summons and complaint copies to the individual.S001, 4(e)(2)(A), subject to the opening qualifications.
C041The dwelling alternative requires leaving copies at the individual’s dwelling or usual abode with a person of suitable age and discretion who resides there. All those conditions matter.S001, 4(e)(2)(B). The rule supplies no universal numerical recipient age or factual definition of a particular abode.
C042Another alternative is delivery of both copies to an agent authorized by appointment or by law to receive process.S001, 4(e)(2)(C). Employment, kinship, general assistance, or a representative label does not itself prove that authority.
C043Unless federal law provides otherwise, 4(f) addresses an individual outside every United States judicial district, with the same minor/incompetence/filed-waiver exclusions. Paragraph (1) permits internationally agreed service reasonably calculated to give notice, identifying the service convention as an example.S001, 4(f) opening and (1). No treaty’s applicability, declarations, or method was investigated.
C044Paragraph 4(f)(2) applies when no internationally agreed means exists, or an agreement permits but does not specify other means. The method must be reasonably calculated to give notice. Alternatives (A) and (B) refer respectively to qualifying foreign law or a foreign authority’s direction in response to a letter rogatory/request.S001, complete 4(f)(2) opening, (A)–(B). Those incorporated bodies and directions remain absent.
C045Under 4(f)(2)(C), and unless foreign-country law prohibits, the specified alternatives are personal delivery of both documents or mail addressed and sent by the clerk that requires a signed receipt. The paragraph (2) threshold conditions also apply.S001, 4(f)(2)(C)(i)–(ii). This is not permission for any sender to use any international mailing method.
C046Paragraph 4(f)(3) permits other means not prohibited by international agreement, as the court orders. The text does not itself select a method or establish an actual order, and this report does not infer judicial sequencing requirements.S001, complete 4(f)(3).
C047For a minor or incompetent person within a United States judicial district, 4(g) requires the applicable service law of the State where service is made. Outside every such district, it specifies 4(f)(2)(A), (f)(2)(B), or (f)(3). It does not simply incorporate every 4(f) method.S001, complete 4(g). Capacity, age classification, guardianship, and incorporated law remain unestablished.
C048Unless federal law provides otherwise or a waiver has been filed, 4(h) covers domestic/foreign corporations and partnerships or other unincorporated associations subject to suit in a common name. Within a judicial district, one alternative incorporates 4(e)(1)’s State-law route.S001, complete 4(h) opening, (1)(A). The organization’s label alone is insufficient.
C049The other 4(h)(1) alternative delivers both copies to an officer, managing/general agent, or other agent authorized by appointment or law. If the agent is statutorily authorized and that statute requires it, copies must also be mailed to the defendant.S001, complete 4(h)(1)(B). The additional mailing is conditional, not universal.
C050Outside every United States judicial district, 4(h)(2) incorporates 4(f)’s individual methods except personal delivery under 4(f)(2)(C)(i).S001, complete 4(h)(2). Foreign formation and foreign service location are different predicates. uscourts.gov
C051Service on the United States requires the 4(i)(1)(A) route and (B), plus (C) when applicable: delivery to the relevant United States attorney or a qualifying written designee, or registered/certified mail to that office’s civil-process clerk; registered/certified mail to the Attorney General in Washington, D.C.; and, when challenging a nonparty federal agency/officer’s order, registered/certified mail to that agency/officer.S001, complete 4(i)(1)(A)(i)–(ii), (B), (C). These are generic statutory office categories; no occupant or address was researched.
C052For a United States agency/corporation, or federal officer/employee sued only officially, 4(i)(2) requires service on the United States and registered/certified mailing of both documents to the specified agency, corporation, officer, or employee.S001, complete 4(i)(2).
C053For a federal officer/employee sued individually for an act/omission connected with duties on the United States’ behalf, 4(i)(3) requires service on the United States and on the officer/employee under 4(e), (f), or (g), whether or not official-capacity claims are also asserted.S001, complete 4(i)(3). No actual capacity-of-suit or official-duty finding.
C054The court must allow a reasonable cure period for failure to serve a person required by 4(i)(2) if either the United States attorney or Attorney General was served; or failure to serve the United States under 4(i)(3) if the officer/employee was served.S001, complete 4(i)(4)(A)–(B). No fixed number of cure days is supplied. uscourts.gov
C055A foreign State or its political subdivision, agency, or instrumentality must be served under 28 U.S.C. §1608. Rule 4(j)(1) does not reproduce that statute’s full conditions.S001, complete 4(j)(1). §1608, necessary §1603 definitions, immunity, and related treaty questions are explicit dependencies, not completed analyses.
C056A State, municipal corporation, or other State-created governmental organization subject to suit must receive both documents through delivery to its chief executive officer or the method that State law prescribes for such a defendant.S001, complete 4(j)(2)(A)–(B). Suitability of category, amenability to suit, and actual executive authority remain absent.

C057Under 4(k)(1)(A), service or filing a waiver establishes personal jurisdiction over a defendant subject to a general-jurisdiction court’s jurisdiction in the State where the district court is located.S001, 4(k)(1) opening and (A). That underlying jurisdictional predicate is not established.
C058The 4(k)(1)(B) alternative requires a party joined under Rule 14 or 19, service within a United States judicial district, and service not more than 100 miles from issuance.S001, complete 4(k)(1)(B). Proper joinder, measuring convention, and actual distance are unresolved; this is not a universal 100-mile service radius.
C059Another personal-jurisdiction route applies when a federal statute authorizes it.S001, 4(k)(1)(C). No particular authorizing statute is assumed.
C060For a claim arising under federal law, 4(k)(2) requires both absence of jurisdiction in any State’s courts of general jurisdiction and consistency of federal jurisdiction with the Constitution and United States laws, in addition to service or filing a waiver.S001, complete 4(k)(2)(A)–(B). This is not an independent finding of subject-matter jurisdiction or constitutional sufficiency.
C061Unless service is waived, proof must be made to the court. Except for service by a United States marshal/deputy, 4(l)(1) requires the server’s affidavit; foreign-service proof has the specific treatment in (l)(2).S001, 4(l)(1)–(2). No affidavit or service event was examined.
C062Service outside every United States judicial district under 4(f)(1) is proved as the applicable treaty/convention provides. Under 4(f)(2) or (3), proof is a receipt signed by the addressee or other evidence satisfying the court that both documents were delivered.S001, complete 4(l)(2). Proof criteria do not independently establish that the chosen service method was lawful.
C063Failure to prove service does not affect service’s validity; the court may allow proof to be amended.S001, 4(l)(3). Conversely, filing proof does not itself prove that all service prerequisites were met.
C064If service has not occurred within 90 days after complaint filing, 4(m), where applicable, requires a court response: dismissal without prejudice against that defendant or an order for service within a specified time. The rule describes action on motion or on the court’s own initiative after notice to the plaintiff.S001, complete 4(m). It is not an automatic factual dismissal or a defendant’s answer period.
C065If the plaintiff shows good cause for the failure, the court must extend service time for an appropriate period. The rule’s alternative court response also prevents treating absence of a proven good-cause showing as textually requiring dismissal in every instance.S001, complete 4(m); S009, attributed committee explanation. No actual good cause, extension, or expiration is decided.
C066Rule 4(m) excludes foreign-country service under 4(f), 4(h)(2), or 4(j)(1) and service of a notice under 71.1(d)(3)(A). The latter is a specified condemnation notice served under Rule 4 without a complaint copy when its residence/address predicates hold.S001, complete 4(m), complete selected 71.1(d). No universal foreign-service deadline or condemnation procedure is supplied. uscourts.gov +1
C067Under 4(n)(1), the court may assert jurisdiction over property if authorized by federal statute; claimants must receive notice as the statute provides or through summons service under Rule 4.S001, complete 4(n)(1). The authorizing statute and property facts are absent.
C068Under 4(n)(2), a showing must establish inability to obtain personal jurisdiction in the district through reasonable efforts at Rule 4 service before the court may assert jurisdiction over assets found there. Acquisition of jurisdiction depends on seizure under the circumstances and manner provided by the district’s State law.S001, complete 4(n)(2). No asset location, seizure right, lien, exemption, collection remedy, or debt validity is determined.

C069Rule 12(a)’s ordinary answer period is 21 days after service of summons and complaint, subject to a different federal statutory time and the rule’s special routes. Timely waiver instead invokes the 60/90-day sending-based periods.S001, complete 12(a), especially (1)(A); S014. Merely receiving a letter is not established service.
C070Rule 12(a)(1)(B) gives 21 days after service of a counterclaim/crossclaim pleading for the answer to it. Paragraph (C) gives 21 days after service of an order to reply to an answer, unless that order sets another time.S001, complete 12(a)(1). These are different documents/triggers, not additional summons periods.
C071Rule 12(a)(2) uses 60 days after service on the United States attorney for the United States, a federal agency, or an officer/employee sued only officially. Paragraph (3), for qualifying individual-capacity official-duty suits, uses 60 days after service on the officer/employee or United States attorney, whichever is later.S001, complete 12(a)(2)–(3), subject to 12(a)’s federal-statute qualification. The list should not be expanded by analogy to every organizational defendant.
C072Unless the court sets another time, serving a Rule 12 motion alters the stated responsive-pleading periods: denial or postponement until trial produces a 14-day period after notice of the court’s action; granting a more-definite-statement motion produces a 14-day period after service of that statement.S001, complete 12(a)(4)(A)–(B). Filing, service, notice of action, and service of the statement must not be conflated. uscourts.gov +2
C073Rule 12 distinguishes subject-matter jurisdiction, personal jurisdiction, venue, insufficient process, insufficient service, merits sufficiency, and joinder. Under 12(g)–(h), certain defenses can be lost through specified omissions even though signing a Rule 4 waiver did not itself surrender them. The permitted Rule 15(a)(1) amendment route has its own once-only and 21-day alternatives.S001, complete Rule 12, especially (b), (g), (h); complete selected 15(a)(1). All actual preservation, motion, amendment, and defense decisions remain held. uscourts.gov +2
C074For rule periods in days or longer units, Rule 6(a)(1) excludes the triggering day, counts intermediate weekends/holidays, and includes the last day unless it falls on a weekend/legal holiday, when the period continues to the next qualifying day. Rule 6(a)’s scope also covers local rules/orders and statutes lacking their own computation method.S001, complete 6(a), particularly opening and (1). No actual calendar is supplied.
C075Rule 6(a) separately addresses hour periods, clerk-office inaccessibility, filing cutoffs, forward/backward counting, and legal holidays. Electronic filing ordinarily ends at midnight in the court’s time zone; other filing at scheduled clerk closing, unless statute/local rule/order sets another time. The holiday definition includes the listed statutory observances, President/Congress-declared holidays, and—only for periods measured after an event—other holidays declared by the relevant State.S001, complete 6(a)(2)–(6); S013. Filing cutoffs are not silently made universal service-completion times.
C076Under ordinary Rule 6(b)(1), extensions require good cause. Before expiry, the court may act with or without motion/notice if it acts or receives the request before the original/extended period expires. After expiry, a motion and failure because of excusable neglect are required. Rule 6(b)(2) separately restricts specified postjudgment periods; the special Rule 87(c)(2) regime is not generalized into ordinary extension power.S001, complete 6(b), complete 87 read for context. Postjudgment motions and appellate consequences are held.
C077Rule 6(d)’s additional 3 days requires an act due a specified time after being served and service under Rule 5(b)(2)(C), (D), or (F). It is not a general addition to every mailed Rule 4 document or to a period measured from sending a waiver request.S001, complete 6(d), 5(b); S010, adopted 2016 clause.
C078Rule 5 addresses specified later papers and its own methods, including attorney service, conditional mailing/electronic/consented methods, and exceptions. In particular, a new claim against a party in default for failing to appear must be served under Rule 4. Rule 5 methods are not automatically substituted for initial Rule 4 service.S001, complete 5(a)–(c), reliance principally (a)(2), (b). Full filing/service practice remains held. uscourts.gov +3
C079Rule 87 requires a Judicial Conference determination of extraordinary public-health/safety or access circumstances substantially impairing a court’s ability to comply. A declaration must designate affected courts, specify a period no longer than 90 days, and adopt the emergency rules unless excepted. Early termination and additional declarations are permitted.S001, complete 87(a)–(b); S013. No actual emergency or declaration is assumed.
C080Under an applicable declaration, Rule 87(c)(1) lets the court order a notice-reasonable service method for the specified 4(e), (h)(1), (i), and (j)(2) recipients and minors/incompetent persons within a judicial district. Completion may occur after the declaration ends unless the court modifies/rescinds the order after notice and opportunity to be heard.S001, complete 87(c)(1), read with (a)–(b); S013. The declaration alone does not select a service method. uscourts.gov +2
C081A generic period does not determine an actual deadline without the relevant sending, service, filing, notice, order, statutory override, computation, and exception predicates.S001, 4(d), 4(i)(4), 4(m), 6, 12(a), 81(c), 87. No deadline calculated.
C082Rule 4 uses such terms as dwelling/usual abode, suitable age/discretion, authorized agent, minor, incompetent person, good cause, reasonable time, and reasonable service efforts without providing a complete general definition for each.S001, complete Rule 4. No medical, capacity, agency, residence, or universal age conclusion is inferred.
C083Rule 4 contains waiver-return requirements and proof provisions but does not supply a separate universally fixed “return of summons” period or a fixed monetary service-fee schedule.S001, complete Rule 4, especially (d), (l), (m). Other applicable law/order/fee authority remains held.
C084The required default warning is document content. It does not establish that default or judgment has occurred, that liability is admitted, or that collection may begin. Debt merits, Rule 55 adjudication, judgment enforcement, satisfaction, garnishment, and other A087 pathways remain outside the selected component.S001, 4(a)(1)(E), appended forms, Rules 12 and 82; S003, §2072(b).
C085Currentness is bounded by the successful compilation/index and codification reads. Failed newer endpoints, the unavailable original 1990 amendment, selected historical reading, unexamined incorporated regimes, and absence of judicial review prevent an exhaustive currentness or application certification.S001–S017 and read/failure log. This is a researcher limitation, not a proposition that an inaccessible authority is absent or ineffective.

Letter versus summonsRule 4(a)–(b) describes required summons content and issuance. The appended waiver request expressly identifies a different document function.Rule 4 does not classify every collector letter or authenticate any document from appearance.C020–C022, C037, C084
Complaint filing versus issuanceFiling commences the civil action under Rule 3; issuance under 4(b) follows on or after filing and requires proper completion. No actual filing or issuance established.C003, C022
Issuance versus serviceClerk issuance supplies a summons for service; 4(c) separately allocates service responsibility.Issuance does not prove delivery by an authorized method.C022–C024
Service versus proofRule 4(l) governs proof; failure to prove does not itself invalidate service.Neither a missing affidavit nor a filed affidavit alone resolves actual validity.C061–C063
Waiver request versus waiverA qualifying request offers a formal-service waiver; timely return and filing have separate consequences.A request, receipt, silence, signature, and filed waiver are different absent events.C027–C035
Waiver of service versus defensesRule 4 preserves jurisdiction/venue objections; the form relinquishes objections to absence of summons/service.Separate Rule 12 preservation rules may matter; no defense is adjudicated.C036, C073
Recipient category versus qualificationRule 4(e)–(j) uses different persons, locations, capacities, and legal roles.Labels do not establish minority, incompetence, agency authority, governmental status, or capacity of suit.C039–C056, C082
Federal alternative versus State-law incorporationRule 4(e) supplies alternatives; 4(g), 4(h), and 4(j) incorporate State law differently.State law includes judicial decisions; no jurisdiction-specific rule or decision was researched.C007, C039–C049, C056
Foreign-service route versus domestic routeRule 4(f), (g), (h)(2), and (j)(1) contain distinct incorporation and exclusion conditions.Treaty, foreign law, §1608, territorial terminology, and actual court orders remain unresolved.C038, C043–C055

Ordinary method versus emergency orderRule 87 supplies a qualified declaration-and-order route for specified recipients. An emergency concern alone is not an operative declaration or service order.C079–C080
Current text versus history/proposalCurrent 4(m) combines provisions authenticated in the 2015–2017 sequence. Future index entries are not operative amendments.Full later-law, original-history, and judicial audits remain incomplete.C012–C018, C085

Under an applicable declaration, Rule 87(c)(1) lets the court order a notice-reasonable service method for the specified 4(e), (h)(1), (i), and (j)(2) recipients and minors/incompetent persons within a judicial district. Completion may occur after the declaration ends unless the court modifies/rescinds the order after notice and opportunity to be heard.

Rule 4 uses such terms as dwelling/usual abode, suitable age/discretion, authorized agent, minor, incompetent person, good cause, reasonable time, and reasonable service efforts without providing a complete general definition for each.

Recorded check status: whole report reviewed selected primary checks only see exact source bounds

Exact authority and limits
S001, complete Rule 4. No medical, capacity, agency, residence, or universal age conclusion is inferred.
R087-C083 Saved research record

Rule 4 contains waiver-return requirements and proof provisions but does not supply a separate universally fixed “return of summons” period or a fixed monetary service-fee schedule.

The required default warning is document content. It does not establish that default or judgment has occurred, that liability is admitted, or that collection may begin. Debt merits, Rule 55 adjudication, judgment enforcement, satisfaction, garnishment, and other A087 pathways remain outside the selected component.

Recorded check status: whole report reviewed selected primary checks only see exact source bounds

Currentness is bounded by the successful compilation/index and codification reads. Failed newer endpoints, the unavailable original 1990 amendment, selected historical reading, unexamined incorporated regimes, and absence of judicial review prevent an exhaustive currentness or application certification.

Recorded check status: whole report reviewed selected primary checks only see exact source bounds

Exact authority and limits
S001–S017 and read/failure log. This is a researcher limitation, not a proposition that an inaccessible authority is absent or ineffective.

Sources, pinpoints and access limits

Keep the source version, actual read extent and jurisdiction with the proposition. A link or researcher access claim is not a substitute for an operative primary passage.
