Federal disposal of consumer report information: 16 CFR Part 682

Actual research access date: October 27, 2026, America/Los_Angeles. The complete Part 682 body examined contains five sections, including the operative disposal standard, five illustrative examples, the other-law provisions, and the effective-date provision. Its central requirement concerns reasonable protection in connection with disposal. Part 682 itself supplies no record-retention period. Those conclusions do not establish that any actual information may be destroyed, that a particular person is covered, or that any disposal practice complies. C001–C005, C024–C044. ecfr.gov

The incorporated consumer-report definition contains consequential exclusions and cross-references. Some require additional regimes that remain expressly unresolved below. The narrow Safeguards Rule comparison also matters: a separately applicable provision contains a qualified two-year disposal requirement. That provision must not be attributed to Part 682 or applied to every record covered by Part 682. C009–C023, C047–C051. uscode.house.gov+1

Identifier convention: S001 means R083-P1-S001, C001 means R083-P1-C001, and so forth. M01–M27 are measurement entries; B01–B36 are conditional legal-category branches. The claims, comparisons, branches, and coverage table form the complete question-to-evidence crosswalk.

R083-P1-C001 Actual access occurred October 27, 2026, America/Los_Angeles. Access, compilation, publication and effectiveness are different dates. Session time check; S001–S022.
R083-P1-C002 The eCFR views displayed differing cutoffs: whole Part October 23; individual views October 22, 23 or 26. The October 19 Title 16 amendment banner does not prove a Part 682 amendment. S001 banners; source register records each.
R083-P1-C003 Current Part 682 contains §682.1 Definitions; §682.2 Purpose and scope; §682.3 Proper disposal of consumer information; §682.4 Relation to other laws; §682.5 Effective date. Section .3 contains five illustrative examples. No reserved/repealed/transferred section appears in this current Part body. S001 complete Part. Present-body inventory, not an exhaustive historical conclusion. ecfr.gov
R083-P1-C004 The authority is PL 108-159 §216; the source credit is 69 FR 68697, November 24, 2004. These credits identify leads; S009–S010 authenticate the actual bodies. S001 notes; S009 §216; S010 adopted amendment.
R083-P1-C005 eCFR is authoritative but unofficial. The annual-edition endpoint failed, while the original official final-rule PDF was readable. No annual-edition inspection is claimed. S001 status notice; S010; S020.
R083-P1-C006 The statutory pages display laws in effect through PL 119-124, October 15, 2026. This is not a complete later-law or judicial audit. S002–S008 and S015 version banners.
R083-P1-C007 Part 682 imports FCRA meanings except as modified by the Part or where context otherwise requires. It does not create a free-standing definition of every term it uses. S001 §682.1(a).
R083-P1-C008 FCRA person includes an individual, partnership, corporation, trust, estate, cooperative, association, government or governmental subdivision/agency, or other entity. Consumer means an individual. Inclusion in “person” alone does not establish FTC jurisdiction or Part 682 coverage. S003 §1681a(b)–(c); S001 §682.2(b). uscode.house.gov
R083-P1-C009 The positive consumer-report definition requires a written, oral or other communication by a consumer reporting agency, bearing on the listed credit, character, reputation, personal-characteristic or mode-of-living matters, and used, expected to be used, or collected wholly or partly as an eligibility factor for primarily personal/family/household credit or insurance, employment, or another §1681b-authorized purpose. Exclusions and exceptions remain necessary. S003 §1681a(d)(1)(A)–(C). The other-purpose route is not a completed authorization analysis.
R083-P1-C010 A consumer reporting agency is a person that, for fees, dues or on a cooperative nonprofit basis, regularly engages wholly or partly in assembling/evaluating consumer credit or other consumer information to furnish consumer reports to third parties, using a means/facility of interstate commerce to prepare or furnish reports. S003 complete §1681a(f). No actual person is classified.
R083-P1-C011 Employment purposes concerns evaluating a consumer for employment, promotion, reassignment or retention as an employee. It is not a definition of every employment-related record. S003 complete §1681a(h).
R083-P1-C012 Subject to §1681s–3 and the medical-information qualification in (d)(3), (d)(2)(A) excludes: information solely about transactions/experiences between consumer and report-maker; communication of that information among common-ownership/control affiliates; and other information communicated among such affiliates when the specified clear/conspicuous disclosure and prior opportunity to prohibit communication are provided. S003 complete §1681a(d)(2)(A)(i)–(iii); S005. No affiliate-sharing permission or actual exclusion is established.
R083-P1-C013 The definition excludes an authorization/approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device, subject to (d)(3). S003 §1681a(d)(2)(B). This does not exclude every credit-related communication.
R083-P1-C014 The specific-credit-decision exclusion requires a third-party request for a specific extension, a report conveying the requested person’s decision, the third party’s advice to the consumer of that person’s name/address, and the requested person’s required §1681m disclosures; (d)(3) also remains relevant. S003 §1681a(d)(2)(C); S007. The complete disclosure-incorporation chain was not finished, so this exclusion is not applied.
R083-P1-C015 Current (d)(2)(D) literally refers to communications in (o) or (x). Current (x) concerns nationwide specialty reporting agencies; employee-investigation communications appear in (y). The editorial note and actual renumbering enactment explain the history, but the text is not silently rewritten here. S003 (d)(2)(D), (x), (y) and reference note; S009 §611; S012 §1088(a)(1). See C061.
R083-P1-C016 An investigative consumer report is the defined report/portion obtaining specified character, reputation, personal-characteristic or mode-of-living information through personal interviews with the listed knowledgeable categories. The definition excludes specified factual credit-record information obtained directly from a creditor, or through a reporting agency when sourced directly from the creditor or consumer. S003 complete §1681a(e). Necessary to understand the narrow (o) route.
R083-P1-C017 Subsection (o)’s procurement communication must otherwise be an investigative consumer report; go to a prospective employer to procure an employee or work opportunity; be made by a person regularly performing that procurement; and be used only for those procurement purposes. Its remaining conditions in C018–C019 are cumulative. S003 §1681a(o)(1)–(4).
R083-P1-C018 The (o) route requires consent to the communication’s nature/scope before collection, and consent to communication to the prospective employer before communication. Either consent may be oral or written; oral consent requires written confirmation no later than three business days after receipt of that consent. S003 §1681a(o)(5)(A)(i)–(iii). These are definition-route conditions, not Part 682 disposal deadlines. uscode.house.gov
R083-P1-C019 The (o) route also prohibits inquiries that would violate applicable equal-employment law if made by the prospective employer. It requires written notice of the disclosure-request right and, upon request, written disclosure within five business days of the nature/substance of all information in the file at request time. Sources acquired solely for, and actually used only for, that communication may be withheld except through the specified competent-court discovery route. S003 §1681a(o)(5)(B)–(C); “file” in (g). Applicable employment law and discovery were not investigated.
R083-P1-C020 The text now in (y)(1) requires a communication that otherwise would be a consumer report, made to an employer for an investigation of suspected employment misconduct or compliance with listed laws, self-regulatory rules or preexisting written policies; not to investigate creditworthiness/standing/capacity; and disclosed only to the enumerated employer/agent, governmental, authorized self-regulatory, legally required or §1681f recipients. S003 complete §1681a(y)(1)(A)–(D). The stale (d)(2)(D) reference and outside definitions prevent an unqualified exclusion conclusion.
R083-P1-C021 Subsection (y)(2) separately requires a nature/substance summary after an adverse action based wholly or partly on the described communication, with its specific source-protection exception. Subsection (y)(3) defines self-regulatory organization through listed statutory categories. Section 1681f permits only its enumerated identifying-information disclosure to government; it is not general records-access or disposal authority. S003 §1681a(y)(2)–(3); S006 complete §1681f. Adverse-action and self-regulatory incorporations are not fully completed. No conclusion is made about whether a breach of (y)(2) changes exclusion status.
R083-P1-C022 Paragraph (d)(3) withdraws the (d)(2) exclusions for specified medical information, individualized medical-payment descriptions, and identified-consumer medical-payment aggregates disclosed to affiliates, except as provided by §1681b(g)(3). It does not dispense with the positive report definition. The medical definition includes health, care and payment information, while excluding the stated non-health demographic and insurance-existence/value information. The (g)(3) insurance, permitted-disclosure and regulatory-determination routes contain further incorporations not completed here. S003 complete §1681a(d)(3), (i); S004 complete §1681b(g)(3)(A)–(C). No universal medical-data inclusion or exclusion is concluded.
R083-P1-C023 Disposal coverage does not authorize obtaining, furnishing, using or marketing information. The purpose, certification, affiliate-solicitation and disclosure cross-references are separate conditions. Reading selected clauses does not establish an actual consumer-report classification or compliance with those separate regimes. S001 §§682.1–682.3; S004 §1681b(a), (f), (g); S005; S007.

B. Consumer information, disposal and the operative standard

Claim Supported finding and qualifications Exact authority
R083-P1-C024 Consumer information is a record about an individual, in paper, electronic or another form, that is a consumer report or derives from one; compilations of those records are included. The duty is therefore not limited to an intact report obtained directly from its producer. S001 §682.1(b). ecfr.gov
R083-P1-C025 The definition excludes information that does not identify individuals, with aggregate information and blind data as examples. A label, removal of a name, or aggregation alone does not establish the exclusion. S001 §682.1(b); S010 III, consumer-information discussion; S014 selected explanation.
R083-P1-C026 The FTC’s explanation includes extracted, manipulated and combined report-derived information and explains that data elements can identify someone in combination. Public availability or a “non-sensitive” description is not a categorical exclusion in the adopted text. Sensitivity can bear on reasonable measures. Agency interpretation: S010 III, pp.68691–68692/indices 1–2; S014 pp.52847–52848/indices 1–2.
R083-P1-C027 The first disposal branch is discarding or abandonment of consumer information. It does not require that the actor label the event “destruction.” S001 §682.1(c)(1).
R083-P1-C028 The second branch is sale, donation or transfer of a medium, including computer equipment, on which consumer information is stored. It concerns the information-bearing medium; no particular technology is singled out as the sole covered medium. S001 §682.1(c)(2).
R083-P1-C029 The preamble distinguishes sale/donation/transfer of information by itself from disposal under this definition. That explanation does not authorize sharing or sale, nor negate the medium-transfer branch where its conditions are met. Agency interpretation: S010 III, “Disposal,” pp.68692–68693/indices 2–3; S001 §682.1(c).
R083-P1-C030 Coverage requires a person within FTC jurisdiction, maintaining or otherwise possessing consumer information, for a business purpose. These are cumulative conditions. The rule is not confined to the original report producer, purchaser or a named industry, and no actual actor is classified. S001 §682.2(b) and §682.3(a); S008.
R083-P1-C031 Part 682 does not separately define “business purpose.” The preamble reads it broadly and distinguishes an individual consumer’s own report/file disclosure from business-purpose possession. This is an agency explanation, not permission to infer purpose from an actor’s label. S010 III, §682.2 discussion, p.68693/index 3.
R083-P1-C032 A covered person must properly dispose by taking reasonable measures protecting against unauthorized access to or use of the information in connection with disposal. The standard is mandatory; a particular disposal technology is not universally prescribed. S001 §682.3(a), read with §§682.1–682.2 and .4.
R083-P1-C033 The examples are expressly illustrative, nonexclusive and nonexhaustive. They are not automatically sufficient safe harbors, exhaustive minimum methods or government certification of an actual practice. S001 §682.3(b) introductory paragraph; S010 explanation. ecfr.gov
R083-P1-C034 The paper example combines implementation and monitoring of compliance with policies/procedures requiring the listed burning, pulverizing or shredding categories, with the result that information cannot practicably be read or reconstructed. Listing a method without the implementation, monitoring and result conditions does not reproduce the example. S001 complete §682.3(b)(1). These are legal categories, not destruction instructions.
R083-P1-C035 The electronic example similarly combines implementation and monitoring with policies/procedures requiring destruction or erasure of electronic media, so information cannot practicably be read or reconstructed. It specifies no software, overwrite count, algorithm or universal hardware requirement. S001 complete §682.3(b)(2).
R083-P1-C036 The contractor example calls for due diligence first, then entering into and monitoring compliance with a contract with a party in the business of record destruction, covering material specifically identified as consumer information, for disposal consistently with the rule. S001 complete first sentence of §682.3(b)(3).
R083-P1-C037 Due diligence could include an independent audit of operations and/or rule compliance; information from several references or other reliable sources; certification by a recognized trade association or similar third party; review/evaluation of security policies or procedures; or other appropriate measures to determine competency and integrity. These alternatives are not a prescribed universal checklist. S001 complete second sentence of §682.3(b)(3).
R083-P1-C038 The example does not establish that one audit, certificate, reference, assurance or contract necessarily satisfies reasonableness. Its text does not specify a universal written-assurance form, contract wording, certification scheme or monitoring frequency. The absence of those specifications does not make contracting unnecessary in every context. S001 §682.3(a), (b), (b)(3); S010 III, contractor explanation.
R083-P1-C039 The direct-service example applies to persons/entities possessing consumer information through services directly to a covered person. It combines implementing/monitoring policies against unauthorized or unintentional disposal with disposal in accordance with examples (b)(1) and (2). The direct-service wording does not create immunity for every other possessor satisfying the general coverage rule. S001 complete §682.3(b)(4) and general §§682.2(b), .3(a).
R083-P1-C040 The FTC explains that a covered service provider and record owner can each bear disposal responsibility. It rejected knowledge as a prerequisite to the duty, but identifies missing owner notice/contracting, actual or constructive knowledge, course of dealing and contextual reasonableness factors as relevant to evaluating a provider’s conduct. This is not a completed damages or mental-state analysis. Agency interpretation: S010 III, pp.68692 and 68694/indices 2 and 4. federalregister.gov
R083-P1-C041 The preamble’s reasonableness factors include sensitivity, nature/size of operations, costs/benefits of methods and relevant technological changes. It discusses policies and training, rejects a perfect-destruction guarantee, and explains “in connection with” as reaching during and after disposal. No actual risk or practice is assessed. S010 III, §682.3 discussion, pp.68693–68694/indices 3–4.
R083-P1-C042 Part 682 does not itself require a record to be maintained or destroyed independently of other law, and does not alter another law’s keep/destroy requirement. It supplies no particular retention period or general deletion-on-request right. Its disposal standard must be read with that limitation. S001 complete §682.4(a)–(b); S010 III, §682.4 explanation.
R083-P1-C043 Current §1681w directs the named FTC, securities, commodities, banking and credit-union authorities to issue disposal regulations for persons within their respective §1681s enforcement authority. Coordination must seek consistent/comparable rules and consistency with GLBA and other federal law. The statute permits appropriately purposed person/class exemptions; no actual exemption is established here. S002 complete §1681w(a)(1)–(3). uscode.house.gov
R083-P1-C044 The statutory construction provisions likewise preserve other-law retention/destruction requirements and do not independently impose a keep/destroy command. S002 complete §1681w(b)(1)–(2); compare C042.

C. Enforcement allocation and the narrow Safeguards comparison

Claim Supported finding and qualifications Exact authority
R083-P1-C045 FCRA §1681s(a)(1) gives the FTC enforcement authority subject to the specified other-agency assignments and CFPA qualification. For persons subject to that FTC enforcement authority, its enforcement language applies irrespective of ordinary FTC Act commerce or other jurisdictional tests. Ordinary FTC Act coverage assumptions therefore cannot replace this FCRA inquiry. S008 complete §1681s(a)(1); S012 corresponding adopted amendment. uscode.house.gov
R083-P1-C046 Section 1681s(b)(1) allocates functions across the listed banking, credit-union, transportation, agricultural, commodities, securities and Bureau regimes; (b)(2) incorporates further definitions. Section (e)(1) expressly excepts §1681w from the Bureau’s general FCRA rulemaking provision. Full sector and CFPA jurisdiction remain unclassified. S008 complete §1681s(b)(1)–(2), (e)(1).
R083-P1-C047 Example (b)(5) applies when the person is subject to both the named GLBA regime and the FTC Safeguards Rule. It illustrates incorporating proper consumer-information disposal into the required information-security program. It is not an exemption from Part 682 or proof of full Safeguards compliance. S001 complete §682.3(b)(5); S015–S016.
R083-P1-C048 The selected Safeguards provisions require a written comprehensive program with appropriate administrative, technical and physical safeguards and the stated security objectives. Their separately defined customer information and financial-institution scope are not synonymous with Part 682 consumer information and business-purpose possession. Full application of the incorporated financial-activity/customer definitions remains held. S016 complete §314.1, §314.2(d), §314.3; S015 §6801.
R083-P1-C049 For a person and information actually subject to §314.4(c)(6), procedures must address secure disposal in any format no later than two years after the information’s last use in providing the related customer a product/service, unless needed for business operations/other legitimate business purposes, required to be retained by law/regulation, or targeted disposal is not reasonably feasible because of how it is maintained. Periodic retention-policy review to minimize unnecessary retention is an additional conjunctive requirement. S016 complete §314.4(c)(6)(i)–(ii); S017 adopted text. This is a separate rule, not Part 682’s general retention period. ecfr.gov+1
R083-P1-C050 Section 314.6’s fewer-than-five-thousand-consumers exception covers only its listed paragraphs (b)(1), (d)(2), (h), and (i). It does not list (c)(6) and supplies no Part 682 exemption. No actual count or financial-institution status is supplied. S016 complete §314.6; S017 adopted text.
R083-P1-C051 The 2004 preamble’s harmonization explanation cannot establish present compliance with every later Safeguards requirement. The current separately adopted disposal/timing clause must be considered only if its own scope applies. Comparison of S010 III with S016–S019; C047–C050.
R083-P1-C052 This report establishes no private claim, standing, current penalty, damages, limitations period, refund, cancellation, contract invalidity, deletion entitlement or recovery. Separate FCRA liability/procedure provisions and other law would require their own complete analysis. S001 complete Part; S008’s bounded enforcement reading. Next pointers include 15 USC §§1681n, 1681o, 1681p, 1681s, and applicable current penalty-adjustment authority. No amount is inferred.

D. Adoption, application, discrepancies and currentness

Claim Supported finding and qualifications Exact authority
R083-P1-C053 FACT Act §216, enacted December 4, 2003, originally directed issuance of final regulations within one year of enactment. That was an agency rulemaking instruction, not a record-retention period. The original wording was later amended. S009 complete §216; S012 §1088(a)(12)–(13); S002 current body.
R083-P1-C054 FACT Act §3’s general effective-date delegation contains its own two-month and ten-month limits and an express otherwise-provided qualification. The joint 2004 explanation treats §216 as tied to implementing-rule effectiveness, not the generic dates assigned to other provisions. Former §602.1(c)(2)(v) separately assigned March 31, 2004 to §611. S009 §3; S011 selected explanation and complete adopted effective-date list. No generic FACT Act date is substituted for Part 682’s express date.
R083-P1-C055 The final Disposal Rule was published November 24, 2004, and the DATES clause and adopted §682.5 specify June 1, 2005. The preamble’s general six-month description is not used to calculate a different date. S010 DATES, III §682.5 discussion and complete adopted text; S001 §682.5.
R083-P1-C056 The actual 2010 amendment changed the agency wording in §1681w, including adding the commodities regulator and replacing the old one-year introductory language. It also renumbered former §1681a(w)/(x) to (x)/(y) and added the Bureau definition. S012 complete §1088(a)(1)–(2), (12)–(13); current S002–S003.
R083-P1-C057 Section 1100H uses the designated transfer date, subject to its otherwise-provided qualification and exclusion of §§1081–1082. The authenticated notice designates July 21, 2011. This does not mean every statute or every CFPB/FTC function commenced or transferred identically. S012 complete §1100H; S013 Summary/DATES.
R083-P1-C058 The 2017 action expressly retained the Disposal Rule without amendment; its action date was November 15, 2017. It did not replace the original June 1, 2005 effective date with a new commencement of the disposal duty. S014 Summary, DATES, introduction and conclusion.
R083-P1-C059 Current §682.3(b)(5) and the original adopted text print “15 U.S.C. 6081” alongside the named Gramm-Leach-Bliley Act. The relevant safeguards provision freshly read is 15 USC §6801. The discrepancy is recorded; no formal correction or legal invalidity is inferred. S001; S010 p.68697/index 7; S015.
R083-P1-C060 The 2017 notice’s heading prints 16 CFR Part 314, but its body/footnotes discuss Part 682 and retaining the Disposal Rule without amendment. The heading is not treated as an adopted transfer or renumbering of Part 682. S014 header, footnotes and conclusion; S001 current organization.
R083-P1-C061 The original §611 inserted employee-investigation subsection (x) and the matching (d)(2)(D) reference. The 2010 Act expressly moved (x) to (y); current (d)(2)(D) still prints (x). That chain is authenticated, but the legal effect of the uncorrected reference is not adjudicated here. S009 §611(a)–(b); S012 §1088(a)(1); S003 reference note and current body.
R083-P1-C062 The 2021 Safeguards final rule adopted the examined disposal provision. It separated general effectiveness January 10, 2022 from initial applicability December 9, 2022 for the listed provisions including (c)(6). S017 DATES and former §314.5.
R083-P1-C063 The 2022 final delay rule, published/effective November 23, 2022, changed the listed provisions’ applicability to June 9, 2023. The complete revised list includes §314.4(c)(1)–(8). S018 complete DATES and adopted §314.5.
R083-P1-C064 Current §314.5, and its authenticated 2023 amendment, address §314.4(j) with May 13, 2024. That separate later date is not a new start for (c)(6)’s disposal provision. No notification-duty dossier is supplied. S016 current whole-Part view; S019 complete selected amendment.
R083-P1-C065 Annual-CFR and other access failures remain gaps. Differing compilation banners, source credits, and selected history do not certify an exhaustive later-law, judicial, technical-correction or exemption history. S001–S022; read/failure log below.
R083-P1-C066 No actual information, person, business purpose, possession, disposal, contract, vendor practice, jurisdiction, event, violation or remedy was supplied or investigated. The report is neither a compliance finding nor operational implementation. Scope of this investigation; C007–C052.
R083-P1-C067 Part 682 specifies no numerical retention period, mandatory audit interval, fixed number of references, technology-performance count, monetary threshold or current penalty. “Several references” and monitoring language are not converted into invented numerical requirements. S001 complete Part, especially §682.3(b)(3) and §682.4.

3. Provision-specific comparisons

Comparison Legal distinction established Limit on inference Claims/sources
Consumer report / consumer information A consumer report has statutory source, subject-matter, purpose and exclusion conditions. Consumer information additionally reaches records derived from reports and compilations. Failure to reproduce an intact report does not establish exclusion; no actual provenance was examined. C009–C024; S001, S003–S007.
Identifying / nonidentifying aggregates The regulatory exclusion turns on not identifying individuals. “Aggregate,” “blind,” or absence of a name is not an established result. An identified-consumer aggregate is a different category. C022, C025–C026; S001, S003, S010, S014.
Possession / obtaining or furnishing Part 682’s scope concerns business-purpose maintenance or possession; acquisition, furnishing, use and marketing have separate rules. A disposal duty neither validates acquisition nor supplies permission to disclose. C023–C024, C030; S001, S004–S007.
Disposal / retention The disposal definition and reasonable-measures duty operate alongside express preservation of other keep/destroy law. No destruction date or right follows merely because Part 682 does not set a period. C027–C032, C042–C044; S001–S002.
Information transfer / medium transfer The medium-transfer branch is explicit; the preamble distinguishes transfer of information by itself. This distinction supplies no sharing or sale authorization. C028–C029; S001, S010.
Standard / examples Reasonableness is the general requirement; examples are illustrative. An example is neither an exhaustive technology list nor automatic certification. C032–C041; S001, S010.
Paper / electronic media The examples use different listed method categories but both include implementation, monitoring and the practicability result. No operational procedure, software or destruction specification is supplied. C034–C035; S001.
In-house / third-party responsibility The general standard remains; the contractor and direct-service examples address additional relationships. Outsourcing alone does not prove that either covered actor has discharged responsibility. C036–C040; S001, S010.
Due diligence / safe harbor Audit, references, certification, policy review and other measures are illustrative routes to assessing competence/integrity. None automatically proves compliance; no vendor was evaluated. C037–C038; S001.
Part 682 / Safeguards Rule Both may apply, but their scope and information categories differ. Current §314.4(c)(6) has separate conditional timing and exceptions. The two-year rule is not a universal Part 682 retention period; full Part 314 applicability is held. C047–C051; S015–S019.
Publication / effectiveness / applicability The original publication, Part 682 commencement, confirmation action, and later separate Safeguards application dates have different legal functions. A later confirmation or unrelated subsection date does not restart the original duty. C053–C064; S009–S019.
Legal duty / actual proof The report states legal categories and qualifications. No actual classification, reasonable-measures finding, breach or compliance result follows. C030–C041, C066.
Duty / remedy Administrative enforcement authority is separate from private standing, liability, penalty adjustment and relief. No recovery, cancellation, deletion entitlement or payment consequence is established. C045–C046, C052; S008.
Federal / other-law boundary The selected statute and rule preserve other retention/destruction requirements. State, tribal, territorial, foreign, litigation-hold, sector, privacy and breach regimes remain separate. C042–C044, C052, C065.

4. Measurement register

This register covers quantities and dates relied on in the findings, not incidental numbers in unadopted or out-of-scope passages. Citation numbers, page numbers, PDF indices and provision labels are locators rather than legal measurements.

5. Conditional legal-category branches

For every Part 682 duty branch below, the linked coverage conditions remain cumulative: the information must qualify, the actor must fall within the relevant FTC jurisdiction, possession/maintenance must be for a business purpose, and the pertinent disposal relationship must exist. No row supplies those facts.

Branch Conditional rule and precise claim/source links Missing predicate or authority Adverse inference to avoid Next permissible generic public-law inquiry
B01 — Jurisdiction unknown Apply §682.2(b) with the FCRA-specific enforcement allocation. C030, C045–C046; S001, S008. Sector and CFPA incorporations; actual status absent. Ordinary FTC Act assumptions alone settle coverage. Read the exact implicated §1681s(b) incorporation, without an entity search.
B02 — Current version unknown Preserve each displayed cutoff and the selected-history limit. C001–C006, C065; S001–S022. Complete post-cutoff and judicial history. A host date proves currentness of every clause. Reopen current official bodies and later published amendments/corrections.
B03 — Person/consumer category Use imported definitions subject to modification/context. C007–C008; S001, S003. Actual category and jurisdiction. “Person” inclusion alone proves coverage. Re-read §682.1(a), §1681a(b)–(c), and §682.2(b) together.
B04 — Consumer-report category Positive source/content/purpose requirements and exclusions all matter. C009–C023; S003–S007. Purpose, provenance and dependent incorporations. Any consumer-related record is a consumer report. Complete only the particular unresolved statutory purpose/exclusion route.
B05 — Reporting-agency category The complete §1681a(f) elements must be met. C010; S003. Regular activity, purpose, compensation/cooperative basis and commerce predicates. A database or business label establishes reporting-agency status. Examine generic official interpretation of §1681a(f), not a roster.
B06 — Transaction/affiliate exclusion The specified exclusions retain medical and §1681s–3 qualifications. C012, C022–C023; S003–S005. Notice/opportunity conditions and applicable sharing rules. Common ownership automatically excludes all information. Trace the specific §1681a(d)(2)(A) branch and necessary implementing clause.
B07 — Credit-approval/decision exclusion Card-issuer approval and third-party-requested decisions have different conditions. C013–C014; S003, S007. Applicable disclosures and exact communication category. Every credit decision is excluded. Complete the relevant §1681m incorporation before any exclusion conclusion.
B08 — Procurement communication All (o) predicates, consents, confirmations, inquiry restrictions and disclosure conditions remain cumulative. C016–C019; S003. Employment-law incorporation and all actual events. Employment-related material is categorically excluded. Read the exact remaining public-law incorporation; do not request employment records.
B09 — Investigation communication/reference mismatch Historical (x) was moved to (y), while (d)(2)(D) still prints (x). C015, C020–C021, C061; S003, S009, S012. Technical correction or authoritative generic treatment; external definitions. Silently rewrite the statute or exclude all internal investigations. Check subsequent corrective legislation or official generic interpretation of that exact reference.
B10 — Medical qualification The affiliate-medical restriction and its (g)(3) exceptions require complete predicates. C022; S003–S004. Incorporated model, HIPAA/GLBA provisions or applicable regulation/order. All medical information is included—or excluded—automatically. Trace only the implicated §1681b(g)(3) incorporation.
B11 — Report-derived information Records derived from reports and compilations can qualify. C024, C026; S001, S010. Provenance and identifiability, both absent. Extraction, transformation or mixing necessarily removes coverage. Re-read §682.1(b) and the complete selected derivation explanation.
B12 — Aggregate/blind information The exclusion requires nonidentification, not merely a descriptive label. C025–C026; S001, S010, S014. No dataset or identification determination is supplied. Aggregation or removal of a name guarantees exclusion. Examine only generic official interpretation of identification under §682.1(b).
B13 — Business-purpose possession Maintenance or possession for business purpose is distinct from ownership or original acquisition. C030–C031; S001, S010. Possession, purpose and jurisdiction. Lack of ownership or purchase necessarily defeats coverage. Read the scope clause and agency’s business-purpose explanation.
B14 — Obtaining/furnishing versus disposal Disposal duties confer no acquisition, use or disclosure permission. C023; S004–S007. Complete separate permissible-purpose rules. Proper disposal validates an otherwise unexamined acquisition. Separately scope the precise public-law purpose question.
B15 — Discarding/abandonment Either can be disposal if consumer information and coverage predicates exist. C027, C030–C032; S001. Actual action and information category. Only deliberate physical destruction triggers the framework. Re-read §682.1(c)(1) with the standard.
B16 — Medium transfer Sale/donation/transfer of an information-bearing medium is a separate branch. C028–C029; S001, S010. Medium, stored information and event absent. A transfer label either proves disposal or authorizes sharing. Compare §682.1(c)(2) with the preamble’s information-transfer distinction.
B17 — Retention decision unknown Part 682 preserves other keep/destroy law and supplies no general period. C042–C044; S001–S002. Applicable retention/hold/destruction authority. No Part 682 period means immediate destruction is permitted. Identify the separately governing public retention authority, without records review.
B18 — Reasonable-measures standard Apply the general standard in context; examples are illustrative. C032–C033, C041; S001, S010. Context and practices absent. A listed method guarantees compliance or perfect destruction is required. Read the complete standard and selected official reasonableness explanation.
B19 — Paper category The example includes implementation, monitoring, listed alternatives and the practicability result. C034; S001. No paper, method or result exists for evaluation. Naming a method completes the example. Public-text comparison only; no procedures or equipment instructions.
B20 — Electronic-media category Destruction/erasure is qualified by policies, monitoring and the same result standard. C035; S001. No media, system or outcome facts. A software label or fixed overwrite count is mandated by Part 682. Re-read §682.3(b)(2); hold technology selection.
B21 — Contractor relationship Due diligence precedes the described contract; monitoring and identification of consumer information remain part of the example. C036; S001. Contract, diligence and performance absent. Outsourcing or signing alone completes the standard. Examine the exact connectors in §682.3(b)(3), without drafting a contract.
B22 — Diligence alternatives The listed methods are possible approaches to competence/integrity, not exclusive requirements. C037–C038; S001. No audit, certification or reputation evidence. One certificate/reference is an automatic safe harbor. Read the entire diligence sentence with §682.3(a) and (b).
B23 — Monitoring Implementation and monitoring are conjunctive in the relevant examples; no fixed interval is supplied. C034–C039, C067; S001. No policies or monitoring events. A written policy alone proves implementation. Determine only what the text states; do not invent a schedule.
B24 — Direct-service provider The example addresses direct service possession and prevention of unauthorized/unintentional disposal, while general coverage remains separate. C039–C040; S001, S010. Relationship, possession and jurisdiction. Every indirect service provider is exempt. Compare the specific example with the general scope/standard.
B25 — Knowledge and notice absent The preamble distinguishes duty from factors used to evaluate service-provider conduct. C040; S010. Knowledge, notice, course of dealing and remedy predicates. Missing notice automatically exempts a provider or establishes owner liability. Read the complete selected explanation; hold liability adjudication.
B26 — Both GLBA and Safeguards applicability unknown Example (b)(5) is conditional on both regimes applying. C047–C048; S001, S015–S016. Financial-institution, customer and jurisdictional definitions. Every Part 682 actor is a Safeguards-covered financial institution. Trace §314.1 and only necessary incorporated scope definitions.
B27 — Separate two-year provision If §314.4(c)(6) applies, retain its last-use trigger, exceptions and periodic-review requirement. C049–C051; S016–S018. Scope, last use, business need, legal retention and feasibility. Two years is a universal Part 682 deletion command. Read complete (c)(6) and applicable scope, without calculating an event date.
B28 — Agency division/exemption Statutory rulemaking/enforcement allocation and exemption authority have their own conditions. C043, C045–C046; S002, S008. Sector definitions and any relevant published exemption. One federal rule governs every regulated category identically. Read the specific agency-allocation clause and narrow incorporation.
B29 — Access/deletion/privacy rights The selected disposal standard does not complete those separate regimes. C023, C042–C044, C052. Separate rights and procedures. Disposal law creates a general access, erasure or correction entitlement. Separately identify the precise public-law right; no request or account action.
B30 — Historical application Original agency issuance periods, rule commencement and later amendments differ. C053–C058; S009–S014. Actual event chronology absent; full later history incomplete. An agency rulemaking deadline becomes a record-retention period. Re-read the exact enacted/effective clauses relevant to the legal question.
B31 — Preamble versus adopted date Use the fixed adopted date and distinguish generic delay descriptions and confirmation actions. C054–C055, C058; S010–S011, S014. No actual calendar. A generalized month description overrides §682.5. Compare DATES and complete adopted text; perform no date calculation.
B32 — Printed cross-reference discrepancies Record the GLBA citation, notice heading and statutory renumbering separately. C059–C061; S001, S003, S009–S015. Any formal correction or controlling generic interpretation. A typo proves repeal, transfer or authority to ignore the rule. Check an official correction or exact amendatory instrument only.
B33 — Enforcement/remedy Administrative authority does not establish a private outcome or current amount. C045–C046, C052; S008. Full remedy, standing, limitation and adjustment chain. Automatic damages, deletion, cancellation or penalty. Separately examine the complete relevant FCRA remedy provision and incorporations.
B34 — Failed or partial source access Keep failed annual/HTML/discovery access visible; use only actually read alternatives. C005, C065; S020–S022 and alternatives. Annual-edition body and complete later history. Failure means absence of law or permission to bypass access controls. Try an ordinary official publication route and retain the result.
B35 — Duty versus actual proof The report supplies legal categories only. C066. Every actual information, event and practice fact. A category table is a compliance or breach finding. Continue public-law research only; no implementation assessment follows.
B36 — Remaining A083 Intake, suitability, enrollment, verification, negotiations, payments, service, complaints, referrals, staffing, broader vendor/security and continuity work remain held. C052, C065–C066. Separately scoped authorities and authorization. This pass completes A083 or approves an operating model. Define a later generic public-law component without importing an actual dossier.

8. Source-read and failure log

Event Actual result/read extent Treatment
Current Part 682 and section views Complete legal body read; differing displayed cutoffs recorded. Same codification grouped; no false corroboration or uniform-date claim.
Current statutory definitions and disposal authority §1681w complete; selected §1681a clauses complete; narrow other incorporations as listed. Uncompleted external regimes remain explicit dependencies.
Original FACT Act Complete selected §§3, 216 and 611 read. No whole-Act claim.
Original 2004 final rule Complete adopted amendment and DATES; complete material section-by-section analysis. Preamble interpretation kept distinct from adopted text.
Joint 2004 effective-date rule Relevant §216 discussion and complete selected adopted date list read. Historical generic dates not imported into Part 682.
2010 statutory amendments Selected complete renumbering, enforcement, disposal-authority and effective clauses read. No full Dodd-Frank or transfer-regime investigation.
Transfer-date notice Selected Summary/DATES readable in official PDF material. HTML endpoint inaccessible; no whole-notice or visual-page claim.
2017 confirmation Header, action date, relevant explanation and concluding retention decision read. Printed Part 314/Part 682 discrepancy preserved; no amendment inferred.
Narrow current Part 314 comparison Named clauses read; complete disposal clause, exception list and current §314.5 obtained. Full financial-institution scope and security program not investigated.
Standalone §314.5 endpoint Returned navigation/version material without operative body. Whole-Part view supplied the clause. No repeal inference.
2021/2022/2023 selected amendments Exact disposal/date clauses and relevant adopted instructions read. Separate applicability dates retained; notification framework excluded.
Annual Part 682 endpoint “Not accessible via this tool.” Honest annual-edition gap; no legal-absence inference.
Transfer-notice HTML endpoint “Not accessible via this tool.” PDF selected clauses used; failure retained.
87 FR 71506 discovery routes Did not yield the required relevant body. Correct delay instrument authenticated as 87 FR 71509, not inferred from the failed lead.
FTC prepublication file Initial material showed a different notification-related instrument and a date placeholder. Rejected as evidence of the selected disposal clause’s commencement.
Generic searches Search hits and indexes used only for discovery. Unrelated case, provider, filing and third-party results were not opened as evidence.
Public-instrument references to comments/cases No underlying named comments, opinions, enforcement matters or actual records were investigated. No participant or provider research was conducted.
PDF presentation Parsed text and page/index metadata used. Screenshot calls returned references rather than inspectable image content. No claim of viewed pixels or unseen complete documents.

9. Explicit gaps and held dimensions

  1. Consumer-report classification is not fully resolved for every incorporated route. The positive definition and selected exclusions were read, but complete permissible-purpose, disclosure, medical/insurance, employment-law and self-regulatory incorporations were not all completed. Those routes remain conditional rather than being silently treated as satisfied. C009–C023.
  2. The statutory employee-investigation cross-reference is not silently repaired. The original and renumbering clauses establish the history; this report does not adjudicate the effect of the current uncorrected reference. C015, C061.
  3. FTC jurisdiction is not assumed from business status. FCRA has its own enforcement allocation and jurisdiction language. Sector and CFPA application remain unresolved for any actual category. C030, C045–C046.
  4. No record-retention decision follows. Other retention, destruction, litigation-hold, sector and nonfederal law remains unexamined. The separate Safeguards timing clause is conditional and is not imported into Part 682. C042–C051.
  5. No full safeguards or vendor program was evaluated. The narrow integration and disposal clauses do not complete financial-institution classification, customer-information definitions, security controls, incident notification, outsourcing, audits or operational continuity. C047–C051, C064, C066.
  6. Remedies remain held. No current penalty, damages, private standing, limitation period, deletion entitlement, cancellation, discharge, contract consequence or actual recovery has been established. C052.
  7. Currentness is bounded. Different eCFR cutoffs, the annual-edition access failure, selected rather than exhaustive amendment history, and absence of a judicial audit remain visible. C002, C005–C006, C065.
  8. All actual facts and broader A083 operations remain absent. No consumer information, report, contract, vendor, device, system, practice, incident, event chronology or organization was inspected or invented. This pass does not complete A083 or confer component, operational or publication acceptance. C066.

10. Researcher self-check — not independent review

Check Result
Independent research basis No earlier report’s conclusions were used as premises.
Complete selected core All current Part 682 sections, nested clauses, examples, authority/source notes and effective provision were read.
Definitions and exclusions Positive report definition, relevant exclusions, derivative-information coverage and nonidentifying exclusion are distinguished; unresolved incorporations remain explicit.
Standards versus examples Mandatory reasonable-measures standard is separated from illustrative methods and diligence options.
Contractor responsibilities Due diligence, identification, contract, monitoring and the direct-service example retain their connectors and qualifications.
Retention boundary Part 682’s absence of a retention period is not treated as permission to destroy or as absence of other law.
Separate Safeguards provision Its scope, two-year trigger, exceptions, review requirement and selected application history are kept separate.
Source discrepancies GLBA citation, 2017 heading and statutory renumbering discrepancy are retained without unsupported reconciliation.
Quantities All quantities and dates relied on in findings are in the measurement register; no actual calculation was performed.
Primary evidence Adopted text and original selected amendment/effective clauses support the report; snippets and filenames do not.
Access honesty Failed and partial accesses remain visible; ordinary readable alternatives are identified.
Actual records and operations No identifying query, record inspection, vendor assessment, deployment instruction, software command, filing or contact was performed.
Worksheet All authority-entry, evidence-entry, analysis and result cells remain blank.
Review status This is the researcher’s own consistency and scope check, not independent review, legal adjudication, compliance certification or acceptance.

R083-P1-C007Part 682 imports FCRA meanings except as modified by the Part or where context otherwise requires. It does not create a free-standing definition of every term it uses.S001 §682.1(a).
R083-P1-C008FCRA person includes an individual, partnership, corporation, trust, estate, cooperative, association, government or governmental subdivision/agency, or other entity. Consumer means an individual. Inclusion in “person” alone does not establish FTC jurisdiction or Part 682 coverage.S003 §1681a(b)–(c); S001 §682.2(b). uscode.house.gov
R083-P1-C009The positive consumer-report definition requires a written, oral or other communication by a consumer reporting agency, bearing on the listed credit, character, reputation, personal-characteristic or mode-of-living matters, and used, expected to be used, or collected wholly or partly as an eligibility factor for primarily personal/family/household credit or insurance, employment, or another §1681b-authorized purpose. Exclusions and exceptions remain necessary.S003 §1681a(d)(1)(A)–(C). The other-purpose route is not a completed authorization analysis.
R083-P1-C010A consumer reporting agency is a person that, for fees, dues or on a cooperative nonprofit basis, regularly engages wholly or partly in assembling/evaluating consumer credit or other consumer information to furnish consumer reports to third parties, using a means/facility of interstate commerce to prepare or furnish reports.S003 complete §1681a(f). No actual person is classified.
R083-P1-C011Employment purposes concerns evaluating a consumer for employment, promotion, reassignment or retention as an employee. It is not a definition of every employment-related record.S003 complete §1681a(h).
R083-P1-C012Subject to §1681s–3 and the medical-information qualification in (d)(3), (d)(2)(A) excludes: information solely about transactions/experiences between consumer and report-maker; communication of that information among common-ownership/control affiliates; and other information communicated among such affiliates when the specified clear/conspicuous disclosure and prior opportunity to prohibit communication are provided.S003 complete §1681a(d)(2)(A)(i)–(iii); S005. No affiliate-sharing permission or actual exclusion is established.
R083-P1-C013The definition excludes an authorization/approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device, subject to (d)(3).S003 §1681a(d)(2)(B). This does not exclude every credit-related communication.
R083-P1-C014The specific-credit-decision exclusion requires a third-party request for a specific extension, a report conveying the requested person’s decision, the third party’s advice to the consumer of that person’s name/address, and the requested person’s required §1681m disclosures; (d)(3) also remains relevant.S003 §1681a(d)(2)(C); S007. The complete disclosure-incorporation chain was not finished, so this exclusion is not applied.
R083-P1-C015Current (d)(2)(D) literally refers to communications in (o) or (x). Current (x) concerns nationwide specialty reporting agencies; employee-investigation communications appear in (y). The editorial note and actual renumbering enactment explain the history, but the text is not silently rewritten here.S003 (d)(2)(D), (x), (y) and reference note; S009 §611; S012 §1088(a)(1). See C061.
R083-P1-C016An investigative consumer report is the defined report/portion obtaining specified character, reputation, personal-characteristic or mode-of-living information through personal interviews with the listed knowledgeable categories. The definition excludes specified factual credit-record information obtained directly from a creditor, or through a reporting agency when sourced directly from the creditor or consumer.S003 complete §1681a(e). Necessary to understand the narrow (o) route.
R083-P1-C017Subsection (o)’s procurement communication must otherwise be an investigative consumer report; go to a prospective employer to procure an employee or work opportunity; be made by a person regularly performing that procurement; and be used only for those procurement purposes. Its remaining conditions in C018–C019 are cumulative.S003 §1681a(o)(1)–(4).
R083-P1-C018The (o) route requires consent to the communication’s nature/scope before collection, and consent to communication to the prospective employer before communication. Either consent may be oral or written; oral consent requires written confirmation no later than three business days after receipt of that consent.S003 §1681a(o)(5)(A)(i)–(iii). These are definition-route conditions, not Part 682 disposal deadlines. uscode.house.gov
R083-P1-C019The (o) route also prohibits inquiries that would violate applicable equal-employment law if made by the prospective employer. It requires written notice of the disclosure-request right and, upon request, written disclosure within five business days of the nature/substance of all information in the file at request time. Sources acquired solely for, and actually used only for, that communication may be withheld except through the specified competent-court discovery route.S003 §1681a(o)(5)(B)–(C); “file” in (g). Applicable employment law and discovery were not investigated.
R083-P1-C020The text now in (y)(1) requires a communication that otherwise would be a consumer report, made to an employer for an investigation of suspected employment misconduct or compliance with listed laws, self-regulatory rules or preexisting written policies; not to investigate creditworthiness/standing/capacity; and disclosed only to the enumerated employer/agent, governmental, authorized self-regulatory, legally required or §1681f recipients.S003 complete §1681a(y)(1)(A)–(D). The stale (d)(2)(D) reference and outside definitions prevent an unqualified exclusion conclusion.
R083-P1-C021Subsection (y)(2) separately requires a nature/substance summary after an adverse action based wholly or partly on the described communication, with its specific source-protection exception. Subsection (y)(3) defines self-regulatory organization through listed statutory categories. Section 1681f permits only its enumerated identifying-information disclosure to government; it is not general records-access or disposal authority.S003 §1681a(y)(2)–(3); S006 complete §1681f. Adverse-action and self-regulatory incorporations are not fully completed. No conclusion is made about whether a breach of (y)(2) changes exclusion status.
R083-P1-C022Paragraph (d)(3) withdraws the (d)(2) exclusions for specified medical information, individualized medical-payment descriptions, and identified-consumer medical-payment aggregates disclosed to affiliates, except as provided by §1681b(g)(3). It does not dispense with the positive report definition. The medical definition includes health, care and payment information, while excluding the stated non-health demographic and insurance-existence/value information. The (g)(3) insurance, permitted-disclosure and regulatory-determination routes contain further incorporations not completed here.S003 complete §1681a(d)(3), (i); S004 complete §1681b(g)(3)(A)–(C). No universal medical-data inclusion or exclusion is concluded.
R083-P1-C023Disposal coverage does not authorize obtaining, furnishing, using or marketing information. The purpose, certification, affiliate-solicitation and disclosure cross-references are separate conditions. Reading selected clauses does not establish an actual consumer-report classification or compliance with those separate regimes.S001 §§682.1–682.3; S004 §1681b(a), (f), (g); S005; S007.

R083-P1-C024Consumer information is a record about an individual, in paper, electronic or another form, that is a consumer report or derives from one; compilations of those records are included. The duty is therefore not limited to an intact report obtained directly from its producer.S001 §682.1(b). ecfr.gov
R083-P1-C025The definition excludes information that does not identify individuals, with aggregate information and blind data as examples. A label, removal of a name, or aggregation alone does not establish the exclusion.S001 §682.1(b); S010 III, consumer-information discussion; S014 selected explanation.
R083-P1-C026The FTC’s explanation includes extracted, manipulated and combined report-derived information and explains that data elements can identify someone in combination. Public availability or a “non-sensitive” description is not a categorical exclusion in the adopted text. Sensitivity can bear on reasonable measures.Agency interpretation: S010 III, pp.68691–68692/indices 1–2; S014 pp.52847–52848/indices 1–2.
R083-P1-C027The first disposal branch is discarding or abandonment of consumer information. It does not require that the actor label the event “destruction.”S001 §682.1(c)(1).
R083-P1-C028The second branch is sale, donation or transfer of a medium, including computer equipment, on which consumer information is stored. It concerns the information-bearing medium; no particular technology is singled out as the sole covered medium.S001 §682.1(c)(2).
R083-P1-C029The preamble distinguishes sale/donation/transfer of information by itself from disposal under this definition. That explanation does not authorize sharing or sale, nor negate the medium-transfer branch where its conditions are met.Agency interpretation: S010 III, “Disposal,” pp.68692–68693/indices 2–3; S001 §682.1(c).
R083-P1-C030Coverage requires a person within FTC jurisdiction, maintaining or otherwise possessing consumer information, for a business purpose. These are cumulative conditions. The rule is not confined to the original report producer, purchaser or a named industry, and no actual actor is classified.S001 §682.2(b) and §682.3(a); S008.
R083-P1-C031Part 682 does not separately define “business purpose.” The preamble reads it broadly and distinguishes an individual consumer’s own report/file disclosure from business-purpose possession. This is an agency explanation, not permission to infer purpose from an actor’s label.S010 III, §682.2 discussion, p.68693/index 3.
R083-P1-C032A covered person must properly dispose by taking reasonable measures protecting against unauthorized access to or use of the information in connection with disposal. The standard is mandatory; a particular disposal technology is not universally prescribed.S001 §682.3(a), read with §§682.1–682.2 and .4.
R083-P1-C033The examples are expressly illustrative, nonexclusive and nonexhaustive. They are not automatically sufficient safe harbors, exhaustive minimum methods or government certification of an actual practice.S001 §682.3(b) introductory paragraph; S010 explanation. ecfr.gov
R083-P1-C034The paper example combines implementation and monitoring of compliance with policies/procedures requiring the listed burning, pulverizing or shredding categories, with the result that information cannot practicably be read or reconstructed. Listing a method without the implementation, monitoring and result conditions does not reproduce the example.S001 complete §682.3(b)(1). These are legal categories, not destruction instructions.
R083-P1-C035The electronic example similarly combines implementation and monitoring with policies/procedures requiring destruction or erasure of electronic media, so information cannot practicably be read or reconstructed. It specifies no software, overwrite count, algorithm or universal hardware requirement.S001 complete §682.3(b)(2).
R083-P1-C036The contractor example calls for due diligence first, then entering into and monitoring compliance with a contract with a party in the business of record destruction, covering material specifically identified as consumer information, for disposal consistently with the rule.S001 complete first sentence of §682.3(b)(3).
R083-P1-C037Due diligence could include an independent audit of operations and/or rule compliance; information from several references or other reliable sources; certification by a recognized trade association or similar third party; review/evaluation of security policies or procedures; or other appropriate measures to determine competency and integrity. These alternatives are not a prescribed universal checklist.S001 complete second sentence of §682.3(b)(3).
R083-P1-C038The example does not establish that one audit, certificate, reference, assurance or contract necessarily satisfies reasonableness. Its text does not specify a universal written-assurance form, contract wording, certification scheme or monitoring frequency. The absence of those specifications does not make contracting unnecessary in every context.S001 §682.3(a), (b), (b)(3); S010 III, contractor explanation.
R083-P1-C039The direct-service example applies to persons/entities possessing consumer information through services directly to a covered person. It combines implementing/monitoring policies against unauthorized or unintentional disposal with disposal in accordance with examples (b)(1) and (2). The direct-service wording does not create immunity for every other possessor satisfying the general coverage rule.S001 complete §682.3(b)(4) and general §§682.2(b), .3(a).
R083-P1-C040The FTC explains that a covered service provider and record owner can each bear disposal responsibility. It rejected knowledge as a prerequisite to the duty, but identifies missing owner notice/contracting, actual or constructive knowledge, course of dealing and contextual reasonableness factors as relevant to evaluating a provider’s conduct. This is not a completed damages or mental-state analysis.Agency interpretation: S010 III, pp.68692 and 68694/indices 2 and 4. federalregister.gov
R083-P1-C041The preamble’s reasonableness factors include sensitivity, nature/size of operations, costs/benefits of methods and relevant technological changes. It discusses policies and training, rejects a perfect-destruction guarantee, and explains “in connection with” as reaching during and after disposal. No actual risk or practice is assessed.S010 III, §682.3 discussion, pp.68693–68694/indices 3–4.
R083-P1-C042Part 682 does not itself require a record to be maintained or destroyed independently of other law, and does not alter another law’s keep/destroy requirement. It supplies no particular retention period or general deletion-on-request right. Its disposal standard must be read with that limitation.S001 complete §682.4(a)–(b); S010 III, §682.4 explanation.
R083-P1-C043Current §1681w directs the named FTC, securities, commodities, banking and credit-union authorities to issue disposal regulations for persons within their respective §1681s enforcement authority. Coordination must seek consistent/comparable rules and consistency with GLBA and other federal law. The statute permits appropriately purposed person/class exemptions; no actual exemption is established here.S002 complete §1681w(a)(1)–(3). uscode.house.gov
R083-P1-C044The statutory construction provisions likewise preserve other-law retention/destruction requirements and do not independently impose a keep/destroy command.S002 complete §1681w(b)(1)–(2); compare C042.

R083-P1-C045FCRA §1681s(a)(1) gives the FTC enforcement authority subject to the specified other-agency assignments and CFPA qualification. For persons subject to that FTC enforcement authority, its enforcement language applies irrespective of ordinary FTC Act commerce or other jurisdictional tests. Ordinary FTC Act coverage assumptions therefore cannot replace this FCRA inquiry.S008 complete §1681s(a)(1); S012 corresponding adopted amendment. uscode.house.gov
R083-P1-C046Section 1681s(b)(1) allocates functions across the listed banking, credit-union, transportation, agricultural, commodities, securities and Bureau regimes; (b)(2) incorporates further definitions. Section (e)(1) expressly excepts §1681w from the Bureau’s general FCRA rulemaking provision. Full sector and CFPA jurisdiction remain unclassified.S008 complete §1681s(b)(1)–(2), (e)(1).
R083-P1-C047Example (b)(5) applies when the person is subject to both the named GLBA regime and the FTC Safeguards Rule. It illustrates incorporating proper consumer-information disposal into the required information-security program. It is not an exemption from Part 682 or proof of full Safeguards compliance.S001 complete §682.3(b)(5); S015–S016.
R083-P1-C048The selected Safeguards provisions require a written comprehensive program with appropriate administrative, technical and physical safeguards and the stated security objectives. Their separately defined customer information and financial-institution scope are not synonymous with Part 682 consumer information and business-purpose possession. Full application of the incorporated financial-activity/customer definitions remains held.S016 complete §314.1, §314.2(d), §314.3; S015 §6801.
R083-P1-C049For a person and information actually subject to §314.4(c)(6), procedures must address secure disposal in any format no later than two years after the information’s last use in providing the related customer a product/service, unless needed for business operations/other legitimate business purposes, required to be retained by law/regulation, or targeted disposal is not reasonably feasible because of how it is maintained. Periodic retention-policy review to minimize unnecessary retention is an additional conjunctive requirement.S016 complete §314.4(c)(6)(i)–(ii); S017 adopted text. This is a separate rule, not Part 682’s general retention period. ecfr.gov +1
R083-P1-C050Section 314.6’s fewer-than-five-thousand-consumers exception covers only its listed paragraphs (b)(1), (d)(2), (h), and (i). It does not list (c)(6) and supplies no Part 682 exemption. No actual count or financial-institution status is supplied.S016 complete §314.6; S017 adopted text.
R083-P1-C051The 2004 preamble’s harmonization explanation cannot establish present compliance with every later Safeguards requirement. The current separately adopted disposal/timing clause must be considered only if its own scope applies.Comparison of S010 III with S016–S019; C047–C050.
R083-P1-C052This report establishes no private claim, standing, current penalty, damages, limitations period, refund, cancellation, contract invalidity, deletion entitlement or recovery. Separate FCRA liability/procedure provisions and other law would require their own complete analysis.S001 complete Part; S008’s bounded enforcement reading. Next pointers include 15 USC §§1681n, 1681o, 1681p, 1681s, and applicable current penalty-adjustment authority. No amount is inferred.

R083-P1-C053FACT Act §216, enacted December 4, 2003, originally directed issuance of final regulations within one year of enactment. That was an agency rulemaking instruction, not a record-retention period. The original wording was later amended.S009 complete §216; S012 §1088(a)(12)–(13); S002 current body.
R083-P1-C054FACT Act §3’s general effective-date delegation contains its own two-month and ten-month limits and an express otherwise-provided qualification. The joint 2004 explanation treats §216 as tied to implementing-rule effectiveness, not the generic dates assigned to other provisions. Former §602.1(c)(2)(v) separately assigned March 31, 2004 to §611.S009 §3; S011 selected explanation and complete adopted effective-date list. R083-P1-C055The final Disposal Rule was published November 24, 2004, and the DATES clause and adopted §682.5 specify June 1, 2005. The preamble’s general six-month description is not used to calculate a different date.S010 DATES, III §682.5 discussion and complete adopted text; S001 §682.5.
R083-P1-C056The actual 2010 amendment changed the agency wording in §1681w, including adding the commodities regulator and replacing the old one-year introductory language. It also renumbered former §1681a(w)/(x) to (x)/(y) and added the Bureau definition.S012 complete §1088(a)(1)–(2), (12)–(13); current S002–S003.
R083-P1-C057Section 1100H uses the designated transfer date, subject to its otherwise-provided qualification and exclusion of §§1081–1082. The authenticated notice designates July 21, 2011. This does not mean every statute or every CFPB/FTC function commenced or transferred identically.S012 complete §1100H; S013 Summary/DATES.
R083-P1-C058The 2017 action expressly retained the Disposal Rule without amendment; its action date was November 15, 2017. It did not replace the original June 1, 2005 effective date with a new commencement of the disposal duty.S014 Summary, DATES, introduction and conclusion.
R083-P1-C059Current §682.3(b)(5) and the original adopted text print “15 U.S.C. 6081” alongside the named Gramm-Leach-Bliley Act. The relevant safeguards provision freshly read is 15 USC §6801. The discrepancy is recorded; no formal correction or legal invalidity is inferred.S001; S010 p.68697/index 7; S015.
R083-P1-C060The 2017 notice’s heading prints 16 CFR Part 314, but its body/footnotes discuss Part 682 and retaining the Disposal Rule without amendment. The heading is not treated as an adopted transfer or renumbering of Part 682.S014 header, footnotes and conclusion; S001 current organization.
R083-P1-C061The original §611 inserted employee-investigation subsection (x) and the matching (d)(2)(D) reference. The 2010 Act expressly moved (x) to (y); current (d)(2)(D) still prints (x). That chain is authenticated, but the legal effect of the uncorrected reference is not adjudicated here.S009 §611(a)–(b); S012 §1088(a)(1); S003 reference note and current body.
R083-P1-C062The 2021 Safeguards final rule adopted the examined disposal provision. It separated general effectiveness January 10, 2022 from initial applicability December 9, 2022 for the listed provisions including (c)(6).S017 DATES and former §314.5.
R083-P1-C063The 2022 final delay rule, published/effective November 23, 2022, changed the listed provisions’ applicability to June 9, 2023. The complete revised list includes §314.4(c)(1)–(8).S018 complete DATES and adopted §314.5.
R083-P1-C064Current §314.5, and its authenticated 2023 amendment, address §314.4(j) with May 13, 2024. That separate later date is not a new start for (c)(6)’s disposal provision. No notification-duty dossier is supplied.S016 current whole-Part view; S019 complete selected amendment.
R083-P1-C065Annual-CFR and other access failures remain gaps. Differing compilation banners, source credits, and selected history do not certify an exhaustive later-law, judicial, technical-correction or exemption history.S001–S022; read/failure log below.
R083-P1-C066No actual information, person, business purpose, possession, disposal, contract, vendor practice, jurisdiction, event, violation or remedy was supplied or investigated. The report is neither a compliance finding nor operational implementation.Scope of this investigation; C007–C052.
R083-P1-C067Part 682 specifies no numerical retention period, mandatory audit interval, fixed number of references, technology-performance count, monetary threshold or current penalty. “Several references” and monitoring language are not converted into invented numerical requirements.S001 complete Part, especially §682.3(b)(3) and §682.4.

ComparisonLegal distinction establishedLimit on inferenceClaims/sources
Consumer report / consumer informationA consumer report has statutory source, subject-matter, purpose and exclusion conditions. Consumer information additionally reaches records derived from reports and compilations.Failure to reproduce an intact report does not establish exclusion; no actual provenance was examined.C009–C024; S001, S003–S007.
Identifying / nonidentifying aggregatesThe regulatory exclusion turns on not identifying individuals.“Aggregate,” “blind,” or absence of a name is not an established result. An identified-consumer aggregate is a different category.C022, C025–C026; S001, S003, S010, S014.
Possession / obtaining or furnishingPart 682’s scope concerns business-purpose maintenance or possession; acquisition, furnishing, use and marketing have separate rules.A disposal duty neither validates acquisition nor supplies permission to disclose.C023–C024, C030; S001, S004–S007.
Disposal / retentionThe disposal definition and reasonable-measures duty operate alongside express preservation of other keep/destroy law.No destruction date or right follows merely because Part 682 does not set a period.C027–C032, C042–C044; S001–S002.
Information transfer / medium transferThe medium-transfer branch is explicit; the preamble distinguishes transfer of information by itself. This distinction supplies no sharing or sale authorization.C028–C029; S001, S010.
Standard / examplesReasonableness is the general requirement; examples are illustrative. An example is neither an exhaustive technology list nor automatic certification.C032–C041; S001, S010.
Paper / electronic mediaThe examples use different listed method categories but both include implementation, monitoring and the practicability result. No operational procedure, software or destruction specification is supplied.C034–C035; S001.
In-house / third-party responsibilityThe general standard remains; the contractor and direct-service examples address additional relationships.Outsourcing alone does not prove that either covered actor has discharged responsibility.C036–C040; S001, S010.
Due diligence / safe harborAudit, references, certification, policy review and other measures are illustrative routes to assessing competence/integrity.None automatically proves compliance; no vendor was evaluated.C037–C038; S001.
Part 682 / Safeguards RuleBoth may apply, but their scope and information categories differ. Current §314.4(c)(6) has separate conditional timing and exceptions. The two-year rule is not a universal Part 682 retention period; full Part 314 applicability is held.C047–C051; S015–S019.
Publication / effectiveness / applicabilityThe original publication, Part 682 commencement, confirmation action, and later separate Safeguards application dates have different legal functions.A later confirmation or unrelated subsection date does not restart the original duty.C053–C064; S009–S019.
Legal duty / actual proofThe report states legal categories and qualifications. No actual classification, reasonable-measures finding, breach or compliance result follows.C030–C041, C066.
Duty / remedyAdministrative enforcement authority is separate from private standing, liability, penalty adjustment and relief. No recovery, cancellation, deletion entitlement or payment consequence is established.C045–C046, C052; S008.
Federal / other-law boundaryThe selected statute and rule preserve other retention/destruction requirements.State, tribal, territorial, foreign, litigation-hold, sector, privacy and breach regimes remain separate.C042–C044, C052, C065.

B01 — Jurisdiction unknownApply §682.2(b) with the FCRA-specific enforcement allocation. C030, C045–C046; S001, S008.Sector and CFPA incorporations; actual status absent.Ordinary FTC Act assumptions alone settle coverage.Read the exact implicated §1681s(b) incorporation, without an entity search.
B02 — Current version unknownPreserve each displayed cutoff and the selected-history limit. C001–C006, C065; S001–S022.Complete post-cutoff and judicial history.A host date proves currentness of every clause.Reopen current official bodies and later published amendments/corrections.
B03 — Person/consumer categoryUse imported definitions subject to modification/context. C007–C008; S001, S003.Actual category and jurisdiction.“Person” inclusion alone proves coverage.Re-read §682.1(a), §1681a(b)–(c), and §682.2(b) together.
B04 — Consumer-report categoryPositive source/content/purpose requirements and exclusions all matter. C009–C023; S003–S007.Purpose, provenance and dependent incorporations.Any consumer-related record is a consumer report.Complete only the particular unresolved statutory purpose/exclusion route.
B05 — Reporting-agency categoryThe complete §1681a(f) elements must be met. C010; S003.Regular activity, purpose, compensation/cooperative basis and commerce predicates.A database or business label establishes reporting-agency status.Examine generic official interpretation of §1681a(f), not a roster.
B06 — Transaction/affiliate exclusionThe specified exclusions retain medical and §1681s–3 qualifications. C012, C022–C023; S003–S005.Notice/opportunity conditions and applicable sharing rules.Common ownership automatically excludes all information.Trace the specific §1681a(d)(2)(A) branch and necessary implementing clause.
B07 — Credit-approval/decision exclusionCard-issuer approval and third-party-requested decisions have different conditions. C013–C014; S003, S007.Applicable disclosures and exact communication category.Every credit decision is excluded.Complete the relevant §1681m incorporation before any exclusion conclusion.
B08 — Procurement communicationAll (o) predicates, consents, confirmations, inquiry restrictions and disclosure conditions remain cumulative. C016–C019; S003.Employment-law incorporation and all actual events.Employment-related material is categorically excluded.Read the exact remaining public-law incorporation; do not request employment records.
B09 — Investigation communication/reference mismatchHistorical (x) was moved to (y), while (d)(2)(D) still prints (x). C015, C020–C021, C061; S003, S009, S012.Technical correction or authoritative generic treatment; external definitions.Silently rewrite the statute or exclude all internal investigations.Check subsequent corrective legislation or official generic interpretation of that exact reference.
B10 — Medical qualificationThe affiliate-medical restriction and its (g)(3) exceptions require complete predicates. C022; S003–S004.Incorporated model, HIPAA/GLBA provisions or applicable regulation/order.All medical information is included—or excluded—automatically.Trace only the implicated §1681b(g)(3) incorporation.
B11 — Report-derived informationRecords derived from reports and compilations can qualify. C024, C026; S001, S010.Provenance and identifiability, both absent.Extraction, transformation or mixing necessarily removes coverage.Re-read §682.1(b) and the complete selected derivation explanation.
B12 — Aggregate/blind informationThe exclusion requires nonidentification, not merely a descriptive label. C025–C026; S001, S010, S014.No dataset or identification determination is supplied.Aggregation or removal of a name guarantees exclusion.Examine only generic official interpretation of identification under §682.1(b).
B13 — Business-purpose possessionMaintenance or possession for business purpose is distinct from ownership or original acquisition. C030–C031; S001, S010.Possession, purpose and jurisdiction.Lack of ownership or purchase necessarily defeats coverage.Read the scope clause and agency’s business-purpose explanation.
B14 — Obtaining/furnishing versus disposalDisposal duties confer no acquisition, use or disclosure permission. C023; S004–S007.Complete separate permissible-purpose rules.Proper disposal validates an otherwise unexamined acquisition.Separately scope the precise public-law purpose question.
B15 — Discarding/abandonmentEither can be disposal if consumer information and coverage predicates exist. C027, C030–C032; S001.Actual action and information category.Only deliberate physical destruction triggers the framework.Re-read §682.1(c)(1) with the standard.
B16 — Medium transferSale/donation/transfer of an information-bearing medium is a separate branch. C028–C029; S001, S010.Medium, stored information and event absent.A transfer label either proves disposal or authorizes sharing.Compare §682.1(c)(2) with the preamble’s information-transfer distinction.
B17 — Retention decision unknownPart 682 preserves other keep/destroy law and supplies no general period. C042–C044; S001–S002.Applicable retention/hold/destruction authority. No Part 682 period means immediate destruction is permitted.Identify the separately governing public retention authority, without records review.
B18 — Reasonable-measures standardApply the general standard in context; examples are illustrative. C032–C033, C041; S001, S010.Context and practices absent.A listed method guarantees compliance or perfect destruction is required.Read the complete standard and selected official reasonableness explanation.
B19 — Paper categoryThe example includes implementation, monitoring, listed alternatives and the practicability result. C034; S001.No paper, method or result exists for evaluation.Naming a method completes the example.Public-text comparison only; no procedures or equipment instructions.
B20 — Electronic-media categoryDestruction/erasure is qualified by policies, monitoring and the same result standard. C035; S001.No media, system or outcome facts.A software label or fixed overwrite count is mandated by Part 682.Re-read §682.3(b)(2); hold technology selection.
B21 — Contractor relationshipDue diligence precedes the described contract; monitoring and identification of consumer information remain part of the example. C036; S001.Contract, diligence and performance absent.Outsourcing or signing alone completes the standard.Examine the exact connectors in §682.3(b)(3), without drafting a contract.
B22 — Diligence alternativesThe listed methods are possible approaches to competence/integrity, not exclusive requirements. C037–C038; S001.No audit, certification or reputation evidence. One certificate/reference is an automatic safe harbor.Read the entire diligence sentence with §682.3(a) and (b).
B23 — MonitoringImplementation and monitoring are conjunctive in the relevant examples; no fixed interval is supplied. C034–C039, C067; S001.No policies or monitoring events.A written policy alone proves implementation.Determine only what the text states; do not invent a schedule.
B24 — Direct-service providerThe example addresses direct service possession and prevention of unauthorized/unintentional disposal, while general coverage remains separate. C039–C040; S001, S010.Relationship, possession and jurisdiction.Every indirect service provider is exempt.Compare the specific example with the general scope/standard.
B25 — Knowledge and notice absentThe preamble distinguishes duty from factors used to evaluate service-provider conduct. C040; S010.Knowledge, notice, course of dealing and remedy predicates.Missing notice automatically exempts a provider or establishes owner liability.Read the complete selected explanation; hold liability adjudication.
B26 — Both GLBA and Safeguards applicability unknownExample (b)(5) is conditional on both regimes applying. C047–C048; S001, S015–S016.Financial-institution, customer and jurisdictional definitions.Every Part 682 actor is a Safeguards-covered financial institution.Trace §314.1 and only necessary incorporated scope definitions.
B27 — Separate two-year provisionIf §314.4(c)(6) applies, retain its last-use trigger, exceptions and periodic-review requirement. C049–C051; S016–S018.Scope, last use, business need, legal retention and feasibility. Two years is a universal Part 682 deletion command.Read complete (c)(6) and applicable scope, without calculating an event date.
B28 — Agency division/exemptionStatutory rulemaking/enforcement allocation and exemption authority have their own conditions. C043, C045–C046; S002, S008.Sector definitions and any relevant published exemption. One federal rule governs every regulated category identically.Read the specific agency-allocation clause and narrow incorporation.
B29 — Access/deletion/privacy rightsThe selected disposal standard does not complete those separate regimes. C023, C042–C044, C052.Separate rights and procedures.Disposal law creates a general access, erasure or correction entitlement.Separately identify the precise public-law right; no request or account action.
B30 — Historical applicationOriginal agency issuance periods, rule commencement and later amendments differ. C053–C058; S009–S014.Actual event chronology absent; full later history incomplete. An agency rulemaking deadline becomes a record-retention period.Re-read the exact enacted/effective clauses relevant to the legal question.
B31 — Preamble versus adopted dateUse the fixed adopted date and distinguish generic delay descriptions and confirmation actions. C054–C055, C058; S010–S011, S014.No actual calendar.A generalized month description overrides §682.5.Compare DATES and complete adopted text; perform no date calculation.
B32 — Printed cross-reference discrepanciesRecord the GLBA citation, notice heading and statutory renumbering separately. C059–C061; S001, S003, S009–S015.Any formal correction or controlling generic interpretation.A typo proves repeal, transfer or authority to ignore the rule.Check an official correction or exact amendatory instrument only.
B33 — Enforcement/remedyAdministrative authority does not establish a private outcome or current amount. C045–C046, C052; S008.Full remedy, standing, limitation and adjustment chain.Automatic damages, deletion, cancellation or penalty.Separately examine the complete relevant FCRA remedy provision and incorporations.
B34 — Failed or partial source accessKeep failed annual/HTML/discovery access visible; use only actually read alternatives. C005, C065; S020–S022 and alternatives.Annual-edition body and complete later history.Failure means absence of law or permission to bypass access controls.Try an ordinary official publication route and retain the result.
B35 — Duty versus actual proofThe report supplies legal categories only. C066.Every actual information, event and practice fact.A category table is a compliance or breach finding.Continue public-law research only; no implementation assessment follows.
B36 — Remaining A083Intake, suitability, enrollment, verification, negotiations, payments, service, complaints, referrals, staffing, broader vendor/security and continuity work remain held. C052, C065–C066.Separately scoped authorities and authorization. This pass completes A083 or approves an operating model.Define a later generic public-law component without importing an actual dossier.

Current §1681w directs the named FTC, securities, commodities, banking and credit-union authorities to issue disposal regulations for persons within their respective §1681s enforcement authority. Coordination must seek consistent/comparable rules and consistency with GLBA and other federal law. The statute permits appropriately purposed person/class exemptions; no actual exemption is established here.

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
