R082 PASS-01 — Federal Guides Against Bait Advertising

Findings and scope of this pass

The current Part 238 contains five sections, §§ 238.0–238.4. It is an FTC interpretive guide, not an independently binding legislative rule. Its descriptions inform the application of laws administered by the FTC; corrective action requires the applicable statutory basis. The current statutory authority distinguishes interpretive statements from rules that define prohibited practices with specificity. Those categories must not be collapsed merely because a guide appears in the CFR or on an agency page labeled “Rules.” C001–C015. ecfr.gov+3

The express compensation provision is § 238.3(f). It identifies a sales plan, method of compensation, or penalizing of sales personnel designed to prevent or discourage sales of the advertised product. The provision appears among practices considered when assessing whether an advertisement is a bona-fide offer. It does not declare every commission, referral payment, fee, or commercial incentive unlawful. No compensation amount, percentage, formula, or sales-performance threshold appears in Part 238. C024, C031–C032, C042–C043. ecfr.gov

The definition expressly includes an offer of a product or service. Nevertheless, several subsequent provisions describe merchandise, physical stock, outlets, demonstrations, delivery, repairs, and parts. The definition therefore does not support a blanket exclusion of services, while the merchandise-specific illustrations do not establish how every service or debt-relief arrangement would be analyzed. That application remains unresolved. C016, C026–C030, C040. ecfr.gov+1

Later disclosure or a completed sale is not an automatic answer to the original solicitation. Section 238.2(b) states the agency’s interpretation concerning a first contact obtained through deception despite later disclosure. Section 238.4 addresses post-sale switching and expressly cautions that sales of advertised merchandise do not preclude a bait-and-switch scheme. These statements do not establish an actual violation, injury, refund entitlement, private claim, or debt-related remedy. C023, C033–C041. ecfr.gov+1

Access and evidentiary boundaries

The public-source openings for this pass occurred on October 27, 2026, America/Los_Angeles, PDT. The corresponding clock checks were on October 28 UTC. “Current” below refers to the displayed compilation actually opened, subject to its stated cutoff—not to an exhaustive certification of all later enactments, agency actions, or judicial treatment.

The complete present Part 238 body was read. The associated statutes, historical publications, and official explanations were read only to the expressly identified bounds below. No actual advertisement, business, compensation arrangement, transaction, consumer encounter, record, or dispute was investigated. No earlier conversation or report supplies evidence for this pass.

In the tables, S001 means R082-P1-S001, C001 means R082-P1-C001, and similarly for subsequent numbers. These abbreviations refer exclusively to this report.

2.2 Defined, used, and absent terms

Category Treatment in the selected text Limit
Bait advertising Expressly defined in § 238.0 through an insincere offer, advertiser intention/want, switching purpose, and lead-attraction description. Not a finding about an actual offer.
Advertising Footnote includes public notice regardless of dissemination or use. No actual medium, website, campaign, or communication was inspected.
Product; service; merchandise Used; product or service appears expressly in § 238.0, while later illustrations frequently use merchandise and physical-product language. No separately supplied Part 238 definition resolves every service application.
Bona fide; initial offer; disparagement; switch; good faith Used in operative guide descriptions and headings. Part 238 supplies no separate exhaustive definitions or universal evidentiary formula for them.
Sales personnel; sales plan; method of compensation; penalizing Expressly addressed by § 238.3(f), using the historical term salesmen. No employment-status, agency-law, payroll, or compensation-contract definition is supplied.
Sales commission; reward; affiliate/referral payment; attorney fee; creditor contribution; lead-resale fee No express scheme of these specific types is set out in Part 238. Their absence does not create an exemption under other law or establish that a particular arrangement cannot fall within a described compensation method.
Deposit; delivery; refund Expressly used in § 238.4(a)–(b). Their evidentiary role is not a complete consumer-remedies code.
Trade-in; product-return procedure; damages; debt discharge No corresponding operative mechanism is supplied in Part 238. Other legal regimes remain unexamined.

R082-P1-C001 Present Part 238 consists of §§ 238.0–238.4, including the advertising footnote and final sales note. All were read; no reserved body appears within the part. S001, complete part, table of contents and bodies. ecfr.gov
R082-P1-C002 The principal current eCFR presentation was current through October 26, 2026. Its Title 16 amendment date is title-wide metadata. eCFR expressly identifies itself as authoritative but unofficial. S001, displayed currency and legal-status statements. ecfr.gov
R082-P1-C003 Part 238 cites FTC Act §§ 5 and 6, 15 USC §§ 45 and 46, as authority, and 32 FR 15540, November 8, 1967, as its source. A source credit is not a complete amendment-history finding. S001, authority/source lines; S008, selected publication.
R082-P1-C004 The opened Code bodies displayed laws in effect through P.L. 119-134, October 20, 2026. This authenticates the displayed compilation boundary, not a complete subsequent-law audit. S004–S007, compilation banners. uscode.house.gov+2
R082-P1-C005 Section 1.5 characterizes industry guides as administrative interpretations intended to guide conformity with law and support voluntary, simultaneous abandonment of unlawful practices. S002, complete § 1.5. ecfr.gov
R082-P1-C006 Noncompliance with guides may lead to corrective action under applicable statutes. The FTC’s generic explanation says guidance is advisory and lacks independent force as a substantive rule. Neither statement supplies an actual enforcement result. S002, § 1.5; S003, introductory paragraph. ecfr.gov+1
R082-P1-C007 Section 45(a)(1) declares unfair competition and unfair or deceptive acts or practices in or affecting commerce unlawful. Part 238 does not replace that statutory foundation. S004, § 45(a)(1). uscode.house.gov
R082-P1-C008 Section 45(a)(2) directs FTC prevention activity concerning persons, partnerships, and corporations, subject to its listed exclusions: banks; specified savings-and-loan institutions and federal credit unions; covered common carriers; covered domestic/foreign air carriers; and persons insofar as subject to the Packers and Stockyards Act, with its express § 406(b), 7 USC § 227(b) qualification. Actual classification and the incorporated regimes remain unresolved. S004, complete § 45(a)(2); S006–S007, narrow definition references.
R082-P1-C009 Section 44 defines commerce through interstate, foreign, territorial, and District of Columbia connections, including commerce within a territory or DC and the listed connections among territories, states, DC, and foreign nations. This definition does not eliminate § 45’s separate affecting-commerce wording. S007, complete commerce definition; S004, § 45(a)(1). uscode.house.gov
R082-P1-C010 The statutory corporation definition includes incorporated or unincorporated companies, trusts—including the named trust category—and associations organized for their own or members’ profit with the specified ownership interests; it also includes such profit-purpose bodies without those interests, except partnerships in that latter clause. An entity label alone does not resolve jurisdiction. S007, complete corporation definition.
R082-P1-C011 Section 46(g) authorizes classification of corporations and rules/regulations to carry out the subchapter, expressly subject to § 57a(a)(2). The section’s insurance limitation must also be preserved; see C054. S005, § 46(g) and final paragraphs. uscode.house.gov+1
R082-P1-C012 Section 57a(a)(1) distinguishes interpretive rules/general policy statements from rules defining unfair or deceptive practices with specificity. It is subject to subsection (h); the substantive-rule branch also contains the stated limitation concerning regulation of standards-development and certification activities. S006, complete § 57a(a)(1)(A)–(B). uscode.house.gov
R082-P1-C013 Incorporated § 57a(h) restricts rulemaking in the children’s-advertising proceeding pending May 28, 1980, or a substantially similar proceeding, where based on a determination that such advertising is unfair. This narrow restriction is not a general exemption from deception law. S006, complete § 57a(h). uscode.house.gov
R082-P1-C014 Section 57a(a)(2) limits the Commission’s authority under the subchapter to prescribe unfair-or-deceptive-practice rules to that section, while expressly preserving the identified authority concerning unfair methods of competition. S006, complete § 57a(a)(2).
R082-P1-C015 For a rule actually within § 57a(a)(1)(B), § 57a(d)(3) gives a subsequent violation the specified § 45(a)(1) effect after the rule takes effect, unless the FTC expressly provides otherwise. That clause does not itself transform Part 238 into such a rule. S006, complete § 57a(d)(3); S002–S003, guide status.

3.2 Definition, initial offer, and discouragement practices

Claim ID Supported proposition and necessary qualifications Exact evidence
R082-P1-C016 Bait advertising is defined through an attractive but insincere offer to sell a product or service that the advertiser does not truly intend or want to sell. S001, § 238.0, first sentence.
R082-P1-C017 The defined purpose is switching consumers away from advertised merchandise to something else, ordinarily described as higher priced or otherwise more advantageous to the advertiser. A higher price is not stated as an invariant requirement throughout the guide. S001, § 238.0, second sentence.
R082-P1-C018 Section 238.0 describes the primary aim as obtaining leads concerning people interested in merchandise of the advertised type. It does not establish a general prohibition on every lead-generating activity. S001, § 238.0, final sentence.
R082-P1-C019 For this part, advertising includes public notice however disseminated or used. No particular delivery technology is made a prerequisite by the footnote. S001, § 238.0 footnote.
R082-P1-C020 Apart from the bait-advertising definition and advertising footnote, the selected part uses rather than separately exhaustively defines the principal product, service, good-faith, switching, disparagement, and compensation terms discussed here. S001, complete §§ 238.0–238.4; bounded textual finding.
R082-P1-C021 Section 238.1 says an advertisement offering a product should not be published where the offer is not a bona-fide effort to sell that product. This is guide language, not a separately specified penalty provision. S001, complete § 238.1. ecfr.gov
R082-P1-C022 Section 238.2(a) addresses false impressions of grade, quality, make, value, currency of model, size, color, usability, or origin, and other product misrepresentation that may enable a later switch when the true facts are disclosed. An actual completed switch is not stated as the wording’s prerequisite. S001, complete § 238.2(a). ecfr.gov
R082-P1-C023 Section 238.2(b) states that later disclosure of true facts does not cure the described violation where deception secured the first contact or interview. Whether deception and statutory coverage exist remains unestablished here. S001, complete § 238.2(b); S004, § 45(a).
R082-P1-C024 Section 238.3 addresses discouragement of advertised-merchandise purchases as part of a bait scheme to sell other merchandise. Its ensuing list is nonexclusive and identifies practices considered in assessing a bona-fide offer; it is not a statement that every isolated listed fact automatically proves a violation. S001, § 238.3 introduction; S008, introductory explanation. ecfr.gov
R082-P1-C025 The first indicium is refusal to show, demonstrate, or sell the offered product in accordance with the offer’s terms, within C024’s framework. S001, § 238.3(a).
R082-P1-C026 The next indicium covers disparagement by words or acts of the advertised product or its guarantee, credit terms, service availability, repairs, parts, or other connected respect. S001, § 238.3(b).
R082-P1-C027 The availability indicium concerns insufficient advertised-product supply at all advertised outlets to meet reasonably anticipated demand, subject to C028. It is not an unlimited-stock requirement. S001, § 238.3(c), first clause.
R082-P1-C028 The express qualification requires the advertisement clearly and adequately to disclose limited supply and/or availability only at designated outlets. It qualifies the stock/outlet provision; it is not a universal cure for other deceptive inducement or switching conduct. S001, § 238.3(c), unless clause.
R082-P1-C029 Refusal to accept orders for advertised merchandise deliverable within a reasonable period is another listed indicium. No number of days is supplied. S001, § 238.3(d).
R082-P1-C030 Showing or demonstrating a product that is defective, unusable, or impractical for the advertisement’s represented or implied purpose is a listed indicium. The represented or implied purpose matters. S001, § 238.3(e).
R082-P1-C031 Section 238.3(f) covers use of a sales plan or compensation method, or penalizing sales personnel, designed to prevent or discourage their selling the advertised product. The design relationship to advertised-product sales is material. S001, complete § 238.3(f), read with introduction. ecfr.gov
R082-P1-C032 A compensation label alone does not establish C031’s design predicate or C024’s bait-scheme context. The selected text supplies neither a general commission prohibition nor a compensation-based exemption. S001, § 238.3 introduction and (f); bounded comparison, not a finding about an arrangement.

3.3 Post-sale practices, scope limits, and history

Claim ID Supported proposition and necessary qualifications Exact evidence
R082-P1-C033 Section 238.4 addresses an advertiser’s post-sale effort to undo the advertised sale with the intention and purpose of selling other merchandise instead. Its list concerns whether the initial sale was in good faith rather than a switching stratagem. S001, § 238.4 introduction. ecfr.gov
R082-P1-C034 Accepting a deposit for the advertised product and then switching the purchaser to a higher-priced product is a listed post-sale indicium. The sequence and comparison matter. S001, § 238.4(a).
R082-P1-C035 Section 238.4(b) lists failure to deliver the advertised product within a reasonable time or to make a refund. It supplies no numeric period or comprehensive refund procedure. S001, § 238.4(b).
R082-P1-C036 Post-sale disparagement includes the product, guarantee, credit terms, service availability, repairs, and other connected respects. Unlike § 238.3(b), this paragraph does not expressly enumerate parts; its catchall remains. S001, § 238.4(c), compared with § 238.3(b).
R082-P1-C037 Delivery of an advertised product that is defective, unusable, or impractical for the represented or implied advertised purpose is a listed post-sale indicium. S001, § 238.4(d).
R082-P1-C038 The concluding note says actual sales of advertised merchandise do not preclude a bait-and-switch scheme; it describes occasions when such sales are incidental and intended to lend legitimacy. It does not say every completed sale proves a scheme. S001, note following § 238.4(d).
R082-P1-C039 The guide distinguishes pre-sale showing/demonstration from delivery after sale, and distinguishes sale completion from the sincerity of the original solicitation. No numerical safe harbor based on successful advertised sales is stated. S001, §§ 238.3(e), 238.4 introduction, (d), and note.
R082-P1-C040 Services are expressly present in § 238.0, but a service-specific application of merchandise, inventory, outlet, parts, and delivery indicia is not resolved by that inclusion alone. Debt-relief-service application remains held. S001, § 238.0 compared with §§ 238.1–238.4.
R082-P1-C041 Part 238’s deposit, delivery, and refund references do not supply a standalone cancellation right, damages award, private cause, debt discharge, collection defense, or penalty. Any such result requires separate applicable authority and facts. S001, complete part, particularly § 238.4(a)–(b); S002–S006, status/authority distinction.
R082-P1-C042 The complete part does not expressly describe a sales-commission schedule, reward formula, affiliate/referral arrangement, attorney fee, creditor contribution, lead-resale payment, trade-in procedure, or product-return procedure. These subjects are not resolved by omission. S001, complete part; textual absence finding limited to that body.
R082-P1-C043 No fixed price difference, commission rate, profit amount, stock count, delivery/refund deadline, injury amount, or loss threshold is supplied in Part 238. Its relative and reasonableness language must not be converted into invented numbers. S001, complete part, especially §§ 238.0, 238.3(c)–(f), 238.4(a)–(b).
R082-P1-C044 The complete 1967 publication records adoption on November 24, 1959; explains staff evaluation, public education, voluntary cooperation, and nonexhaustive major indications; and identifies FTC Act enforcement as the statutory route. Publication occurred November 8, 1967. S008, introductory paragraphs, adoption line, issue date. tile.loc.gov+1
R082-P1-C045 The historical publication states that the guides do not relieve compliance with an FTC order or stipulation and do not constitute a finding in, or determine disposition of, a formal or informal matter. These are publication-level reservations, not actual-order findings here. S008, concluding paragraphs, printed 15541/PDF index 22.
R082-P1-C046 The 1967 introduction’s older commerce wording must not replace current § 45 wording. P.L. 93-637 § 201(a) expressly changed the former wording to cover commerce and effects on commerce. S008, introduction; S009, complete § 201(a); S004, current § 45(a). govinfo.gov
R082-P1-C047 P.L. 93-637 § 202(a) enacted the selected interpretive/substantive rulemaking distinction and authority limitation; § 202(b) inserted the corresponding exception into § 46(g). This establishes those selected changes, not every later amendment. S009, § 202(a), inserted § 18(a)(1)–(2), and § 202(b).
R082-P1-C048 Section 202(c)(1) preserves the validity of previously promulgated § 6(g) rules and addresses proposed rules whose presentation of material was substantially completed before enactment. Under (c)(2), a valid covered rule’s later substantive change must follow § 18 if § 18 would have applied to a post-enactment promulgation. This is not a finding that Part 238 is a legislative rule or that every historical predicate is established. S009, complete § 202(c)(1)–(2). govinfo.gov
R082-P1-C049 The 2023 review notice lists Part 238 for initiation of review in 2027, reserves schedule changes, and disclaims an inference about need or substance. It is not a repeal, amendment, new guide effective date, or guarantee of a future action. S010, summary, dates, scheduling reservation, appendix Part 238 row. govinfo.gov
R082-P1-C050 The separate 1959 original was not successfully opened. The adoption-date finding rests on the complete 1967 primary publication, not an asserted independent reading of the earlier original. S008, adoption line; S013, failed openings.
R082-P1-C051 The successful current compilations and selected enacted/publication bodies establish bounded text and history. They do not certify an exhaustive later-law, withdrawal, judicial-treatment, or full jurisdictional chain. S001–S010, expressly limited read bounds and currentness labels.
R082-P1-C052 This source set supplies legal descriptions and agency interpretations, not measured causal evidence about incentives, business outcomes, consumer losses, or suitability. No actual application facts or economic results are supplied in this pass. S001, complete guide; S008, stated publication purpose; research-scope limitation.
R082-P1-C053 The separate § 238.0 endpoint encountered an access gate, but § 238.0 and its footnote were fully readable in the whole-part eCFR and annual CFR bodies. The failed endpoint remains logged; no gate was bypassed. S001, whole-part and annual bodies; failure F03 below.
R082-P1-C054 Section 46’s final paragraphs exclude the insurance business from that section except clauses (c) and (d), while separately permitting insurance studies/reports only following a request agreed to by a majority of the members of either specified congressional committee; that study authority expires at the end of the Congress in which the request was made. This qualification prevents treating § 46(g) as unlimited authority; no insurance-jurisdiction or study finding is made. S005, complete final two insurance paragraphs. uscode.house.gov
R082-P1-C055 The January 1, 2026 annual CFR presents the complete selected Part 238 on printed pages 193–194. Its selected text agrees with the current eCFR reading, but the annual edition alone cannot establish developments after its edition date. S001, annual CFR, printed 193–194/PDF indices 0–1. govinfo.gov

4. Provision-specific comparisons

Comparison What the selected text establishes What remains distinct or unresolved Claims/sources
Bona-fide offer / attracting prospects The definition connects insincerity, an offer the advertiser does not intend or want to sell, and switching purpose. Attractiveness or lead generation alone does not establish those predicates. C016–C018, C021; S001 § 238.0–.1
Later disclosure / original inducement The initial-contact provision addresses deception despite later disclosure. A later explanation is not an automatic cure; whether the original contact was deceptive remains a separate factual/legal question. C022–C023; S001 § 238.2
Listed indicium / established violation Sections 238.3 and .4 identify practices considered in assessing bona fides and good faith. The list is not a universal one-fact liability formula or an exhaustive set of necessary elements. C024, C033; S001; S008 introduction
Commercial incentive / described compensation method The specific compensation provision links the scheme’s design to discouraging advertised-product sales. The presence of an incentive, without its design and context, does not establish the described conduct. C031–C032; S001 § 238.3(f)
General commission / listed scheme A commission could be a compensation method as a generic category; the text does not expressly prescribe or ban commission structures generally. No actual commission contract, intent, behavior, or payment is established. C020, C031–C032, C042
Adequate supply / disclosed limitation The guide considers reasonably anticipated demand at advertised outlets and specifies a disclosure qualification. There is no fixed stock count and no blanket disclosure immunity. C027–C028; S001 § 238.3(c)
Defective demonstration / defective delivery Both appear, at different stages, with the represented or implied advertised purpose as the reference. A showing and an actual delivery are not interchangeable facts. C030, C037, C039
Advertised product conduct / service application The definition expressly includes services; subsequent indicia often concern merchandise logistics. A particular debt-relief or other service application requires additional generic interpretive authority and facts. C016, C040
Completed sale / original sincerity Actual advertised-item sales do not preclude the scheme described in the final note. Their existence is neither a universal defense nor universal proof of wrongdoing. C033–C039
Refund mention / remedy entitlement Failure to refund appears in a post-sale indicium. Refund procedure, cancellation, damages, standing, penalties, and debt consequences are not established. C035, C041
Guide / legislative rule / statute Guidance status, statutory prohibitions, and the effect of a qualifying substantive rule are different legal categories. CFR placement and a “Rules” webpage label do not collapse them. C005–C015; S002–S006, S011
Federal legal description / actual proof / other law The selected text describes federal categories subject to statutory authority. Actual proof, exemptions, other federal/state law, broader incentives, and remedies remain open. C008–C014, C040–C043, C051–C054

5. Complete measurement and sequence register

This register includes the quantities, dates, comparative quantities, and timing expressions relied on here. Section numbers, statutory citation numbers, and PDF pagination are locators rather than substantive legal thresholds. No financial or calendar model is warranted: Part 238 supplies no numeric commission, stock, delivery, refund, profit, or loss threshold. C043.

Measurement ID Exact source and actor/object Unit, base, trigger, boundary, and qualifications Missing facts / counting limit
M01 — Structure S001, complete Part 238 Five sections; § 238.2 has (a)–(b); § 238.3 has (a)–(f); § 238.4 has (a)–(d), plus its note. These are structural counts, not required numbers of violations. No inference that all listed practices must occur.
M02 — Relative price/advantage in definition § 238.0; advertiser’s intended substitute Higher price is qualified as usual, with an alternative of a more advantageous basis. No amount, percentage, denominator, or frequency is given. No prices, economic benefit, or probability supplied. C017.
M03 — All advertised outlets § 238.3(c); availability at outlets listed in the advertisement Universal relative to the advertisement’s outlet set, subject to the express disclosure qualification. No fixed outlet count. No advertisement or outlet set examined. C027–C028.
M04 — Sufficient supply § 238.3(c); quantity of advertised product Sufficiency is relative to reasonably anticipated demand, with the stated disclosure qualification. No ratio or minimum inventory formula. Demand and inventory absent; neither can be inferred from the guide.
M05 — Limited supply/designated outlets § 238.3(c), unless clause Disclosure must be clear and adequate; limited supply and/or designated-outlet availability are the stated subjects. No numeric scarcity limit or disclosure-size metric. C028.
M06 — Order-delivery period § 238.3(d); orders for advertised merchandise A reasonable period; no stated day/week unit, fixed starting event, or counting rule beyond the order/delivery context. No deadline may be calculated. C029.
M07 — Post-sale delivery time § 238.4(b); delivery of advertised product A reasonable time; refund appears as the alternative failure in the clause. No numerical duration or refund deadline. No actual sale, due date, or delivery facts. C035.
M08 — Higher-priced substitute after deposit § 238.4(a); advertised versus substituted product A strict relative price description; no minimum price difference or percentage. Deposit acceptance precedes switching. No prices or transaction sequence supplied. C034.
M09 — First contact and later disclosure § 238.2(a)–(b) Ordinal/sequence conditions: original contact or interview; later true-fact disclosure. No elapsed-time requirement. No actual communication or event. C022–C023.
M10 — Sale before post-sale switching conduct § 238.4 introduction Advertised-product sale is the stated stage; intent/purpose of selling other merchandise remains material. No event or duration inferred. C033.
M11 — Occasional advertised sales § 238.4 note The source describes occasions, not a rate, percentage, sample size, or minimum number of sales. No numerical safe harbor or empirical probability. C038–C039.
M12 — Recorded adoption and publication S008, adoption and publication lines Adoption recorded as November 24, 1959; filing November 7, 1967; publication November 8, 1967. Different institutional events. No separate prospective compliance deadline established; 1959 original inaccessible. C044, C050.
M13 — 1975 enactment and transition S009, approval; § 202(c)(1)–(2) January 4, 1975 enactment. Prior promulgation and substantial completion before enactment are the transition predicates; later substantive changes carry the stated conditional requirement. No actual historical rulemaking classified or deadline computed. C047–C048.
M14 — Incorporated historical proceeding reference S006, § 57a(h) Proceeding pending May 28, 1980, or substantially similar proceeding; restriction tied to the stated unfairness basis. Not a new filing period or general advertising exemption. C013.
M15 — Insurance-study request/expiry S005, final insurance paragraphs Request agreed to by a majority of the members of either named committee; authority ends at the end of the Congress during which the request was made. No membership count, request, Congress-specific event, or study authority established. C054.
M16 — Review notification S010, dates and Part 238 appendix row Schedule applicable November 30, 2023; Part 238 review initiation listed for 2027. FTC reserves modification/reordering. Historical planning entry, not a guaranteed deadline or Part 238 substantive effective date. C049.
M17 — Current regulatory display S001–S002, eCFR banners Principal whole-part bodies through October 26, 2026; title-wide amendment October 19, 2026. Earlier individual displays: October 22/23 and, for § 1.6, October 2. Display dates do not prove when Part 238 changed. C002, C051.

6. Conditional legal-category branches

Status convention: “Answered text; application unresolved” means the selected public text answers the generic category question while the facts necessary to apply it remain absent. “Partial” identifies a remaining public-authority or history gap. Each row also constitutes the granular coverage entry for Question 10, branch Bxx.

Branch / status Supported conditional instruction or boundary, including qualifications Missing predicate or authority Adverse inference to avoid Next permissible generic public-law inquiry
B01 — Version/status unknown. Partial. If relying on this part, use the complete current guide and distinguish eCFR currency, annual edition, historical publication, and guide status. C001–C006, C051, C055; S001–S003. Complete post-cutoff amendment/judicial chain. A current webpage label makes the guide an independently binding rule or proves no later law. Check later official Part 238 amendatory or withdrawal publications, without party/case research.
B02 — Defined versus merely used term. Answered text; application unresolved. Apply § 238.0 and its footnote as supplied definitions; do not invent separate exhaustive definitions for every other label. C016–C020, C042; S001. Any indispensable later official interpretation of a disputed term. Ordinary labels establish all legal predicates. Examine a generic FTC interpretation expressly addressing that term, if one exists.
B03 — Initial bona-fide intent unknown. Answered text; application unresolved. The offer must be evaluated against the insincerity/intention description and bona-fide-sale principle. C016, C021; S001 §§ 238.0–.1. Offer, intent, and applicable statutory proof. An attractive offer or low price alone proves bait advertising. Read any generic official clarification of bona fides under these provisions; do not investigate an advertiser.
B04 — Attraction versus switching. Answered text; application unresolved. The definition connects lead attraction to the described purpose of selling something else; the price qualification and alternative advantage remain material. C017–C018; S001 § 238.0. Actual switching purpose and relationship between solicitation and substitute. All lead generation, upselling, or favorable commercial terms are prohibited. Identify official generic discussion of the § 238.0 purpose language.
B05 — Initial statement/illustration unknown. Answered text; application unresolved. Section 238.2(a) addresses the specified false product impressions and other switch-enabling misrepresentation. C022; S001. Communication, falsity, and context. Every omission or product comparison satisfies the clause. Examine generic FTC interpretation of § 238.2(a); broader deception standards remain a separate component.
B06 — Later disclosure. Answered text; application unresolved. If deception secured the first contact/interview, later true-fact disclosure does not supply the cure described in § 238.2(b). C023; S001. Whether the first contact was deceptive and within statutory jurisdiction. Later explanation automatically cures the original inducement, or automatically proves a violation. Read generic official treatment of initial-contact deception, without actual encounters or cases.
B07 — Refusal to show/demonstrate/sell. Answered text; application unresolved. The listed refusal concerns the offered product on the offer’s terms and operates within the bait-scheme assessment. C024–C025; S001 § 238.3(a). Offer terms, refusal, and scheme context. Any refusal, regardless of terms or context, is a per-se violation. Review any official generic clarification of the offer-terms qualification.
B08 — Disparagement before sale. Answered text; application unresolved. Words or acts concerning the product and enumerated connected attributes are indicia under § 238.3(b). C024, C026; S001. Conduct, connection, and purpose/context. Every unfavorable statement or repair discussion is unlawful. Read generic official interpretation of disparagement in this provision.
B09 — Stock or outlet availability. Answered text; application unresolved. Assess availability at all advertised outlets relative to reasonably anticipated demand, subject to the express disclosure clause. C027–C028; S001 § 238.3(c). Advertisement, demand, supply, and relevant locations—all held. A stockout necessarily proves bait advertising, or unlimited inventory is required. Examine generic official explanation of anticipated demand and the disclosed-limitation qualification.
B10 — Stock disclosure qualification. Answered text; application unresolved. The stated limitation must be disclosed clearly and adequately, with the supply/outlet subject matching the clause. C028; S001 § 238.3(c). Content, adequacy, and relevance of disclosure. Any scarcity wording excuses every other misleading feature. Read official generic clarification of this particular unless clause; do not draft an advertisement.
B11 — Order acceptance and reasonable delivery period. Answered text; timing unresolved. Refusal to take orders deliverable within a reasonable period is an indicium; no fixed period is provided. C024, C029, C043; S001 § 238.3(d). Reasonableness authority and all application facts. A universal delivery deadline can be inferred. Identify a generic official interpretation of reasonable time under this clause; any other delivery rule requires a separate scope check.
B12 — Demonstration defect. Answered text; application unresolved. Showing/demonstrating the described defective, unusable, or impractical product is tied to the advertised represented/implied purpose. C030; S001 § 238.3(e). Product condition, presentation, and represented purpose. Any defect or consumer dissatisfaction automatically establishes the listed scheme. Examine generic interpretation of the represented/implied-purpose qualification.
B13 — Compensation method. Answered text; application unresolved. A plan or compensation method falls within the indicium only with the stated design to prevent/discourage advertised-product sales, within § 238.3’s framework. C024, C031–C032; S001 § 238.3(f). Scheme design and context; no actual contract or payroll facts. Every commission or incentive is unlawful. Identify generic FTC interpretation specifically of § 238.3(f), not compensation records.
B14 — Penalizing sales personnel. Answered text; application unresolved. Penalizing is expressly included, with the same design relationship to advertised-product sales. C031; S001 § 238.3(f). Purpose/design and conduct. Every workplace penalty is bait advertising, or this text decides employment rights. Read generic interpretation of the penalty indicium; employment law remains held.
B15 — Conduct versus intent/evidence. Answered text; application unresolved. Listed acts inform bona-fide/good-faith assessment; the scheme and intent language cannot be replaced by an isolated label. C024, C031, C033; S001. Applicable proof and actual conduct. One fact automatically proves intent, or every listed fact must coexist. Examine generic FTC explanation of these evidentiary formulations; no case search.
B16 — Actual offer or harm absent. Unresolved application. The guide supplies descriptions, not an actual offer, injury, or loss finding. No quantified harm threshold is stated here. C041, C043, C052; S001. All transaction and harm facts; any separate remedy authority. This report proves wrongdoing or proves no harm requirement under every applicable law. If separately authorized, read the precise generic statutory elements for the proposed legal consequence.
B17 — Product versus service. Partial. Services are expressly included in the definition, but particular merchandise-specific indicia need a supported service application. C016, C040; S001. Official generic service-specific interpretation and relevant predicates. All services are excluded, or every inventory/repair clause mechanically applies to debt-relief services. Seek an official generic interpretation expressly addressing services under Part 238.
B18 — Deposit followed by higher-priced switch. Answered text; application unresolved. The sequence is deposit for the advertised product, then a higher-priced substitution, within the post-sale switching framework. C033–C034; S001 § 238.4(a). Deposit, sequence, relative price, and purpose. Every deposit or substitute sale is a violation. Review generic interpretation of § 238.4(a); no transaction creation or calculation.
B19 — Delivery/refund conduct. Answered text; remedy/timing unresolved. Failure to deliver within a reasonable time or to refund is an indicium, preserving the clause’s alternative wording. C035, C041; S001 § 238.4(b). Applicable reasonableness and any independent refund/remedy authority. Automatic cancellation, a fixed refund deadline, or a complete delivery-or-refund safe harbor. Read a generic official interpretation of this clause; separately identify any actual remedial statute before stating a remedy.
B20 — Post-sale disparagement. Answered text; application unresolved. The post-sale list has its stated connected categories and catchall; parts are not separately enumerated there. C033, C036; S001 § 238.4(c). Stage, conduct, connection, and switching purpose. The two disparagement paragraphs have identical enumerations, or omission of a word creates categorical immunity. Compare generic official interpretations of §§ 238.3(b) and .4(c).
B21 — Defective delivery. Answered text; application unresolved. Actual delivery is the described event, with defect/usability/practicality related to the represented or implied purpose. C033, C037; S001 § 238.4(d). Delivery and purpose/condition facts. A demonstration and delivery are interchangeable, or every defect proves the entire scheme. Read generic interpretation of § 238.4(d); warranty remedies remain separate.
B22 — Advertised sales occurred. Answered text; application unresolved. Such sales do not preclude a scheme; the note’s occasional-incidental-sales explanation is qualified. C038–C039; S001 final note. Overall plan and role of those sales. A completed sale proves legitimacy, or itself proves illegitimacy. Examine generic official explanation of the final note, without actual sales data.
B23 — Guide versus rule. Answered boundary. Apply the administrative-interpretation status and distinguish § 57a(a)(1)(B) rules and their specified statutory effect. C005–C006, C012–C015; S002–S006. Any separate rule and its own promulgation/effectiveness predicates. CFR placement alone supports an independent guide-violation penalty. Read the exact generic authority for any separately proposed rule-based consequence.
B24 — Statutory jurisdiction unknown. Partial. §§ 45, 46, and incorporated definitions contain coverage limitations; the insurance qualification also remains material. C007–C014, C054; S004–S007. Exact incorporated category and jurisdictional facts. Every advertiser, financial provider, or insurer is covered identically. Read only the indispensable complete category definition or exception—such as the relevant § 57a(f) incorporation—if that generic boundary becomes necessary.
B25 — Remedy or penalty sought. Excluded from resolution. This pass establishes no freestanding refund, damages, private-action, debt-release, or penalty result. C006, C015, C041; S001–S006. Complete remedy/standing/procedure authority and facts. A guide indicium automatically produces financial relief. A separate generic inquiry could read the relevant current FTC Act remedy provision, including its conditions; no actual complaint or case.
B26 — Original/history/currentness failure. Partial. Current bodies and selected history were read, but the 1959 original and exhaustive later chain remain gaps; a review schedule is not an amendment. C044–C051, C053, C055; S008–S013. Readable original and any materially later official action. Failure proves repeal, absence of authority, or permission to bypass access controls. Try an ordinarily accessible official archival format of the 1959 publication or a later generic amendatory publication; no gate workaround.
B27 — Other law and broader incentives. Excluded from resolution. Part 238 does not settle affiliate/referral arrangements, attorney fees, creditor contributions, lead resale, or broader recommendation conflicts. C032, C040–C042, C052. The separate applicable legal framework and all application facts. Silence is approval, exemption, or a finding of illegality. Identify the narrow generic public authority governing the particular category before opening a separate component.
B28 — Numeric standard proposed. Answered absence; application unresolved. Part 238 contains relative price, anticipated-demand, sequence, and reasonableness descriptions, not the missing numeric thresholds. C017, C027–C029, C034–C035, C043; S001. Any separate authority expressly supplying a quantity or counting convention. Inventing a stock percentage, commission cap, profit threshold, or number of days. Read the exact separate generic quantity/trigger clause, if one is legally relevant; do not calculate absent predicates.

6.2 Deposit and higher-priced substitution Answered. Sequence and relative comparison preserved. C034; B18; M08 No deposit or price facts; no calculation.
6.3 Delivery/refund Answered text; remedy unresolved. Alternative wording preserved. C035, C041; B19; M07 Exact separate remedy/timing authority before any consumer consequence.
6.4 Post-sale disparagement/defective delivery Answered. Complete categories and purpose qualification retained. C036–C037; B20/B21 No actual condition, statement, or delivery.
6.5 Trade-in/return/injury/loss Excluded or unresolved as specified. No trade-in/return system or quantified injury/loss rule in Part 238. C041–C043; B16/B25/B28 Identify separate generic authority; do not import remedies.
6.6 Cancellation/damages/private suit/debt consequences Excluded from resolution. No outcome inferred. C041; B25/B27 Complete relevant current statutory remedy and procedure would require a new scoped inquiry.
7.1 Statutory authority Answered narrow clauses. §§ 45(a), 46(g), 57a(a), and related limits read. C007–C015, C054; S004–S007 Full FTC Act jurisdiction/enforcement remains held.
7.2 Indispensable definitions and exceptions Partial by scope. Material definitions read; broad incorporated regimes not resolved. C008–C010, C054; B24 Open only the exact remaining incorporated category clause if necessary.
7.3 Guide versus independently enforceable rule Answered. Status and statutory rule effect distinguished. C005–C006, C012–C015; B23 No actual rule-based enforcement conclusion.
7.4 Penalty/standing/remedy systems Excluded. No amount or private cause stated. C041; B25 Separate exact generic remedy authority, not actual proceedings.

9. Source-read and failure log

This log records successful boundaries and failures rather than silently replacing failed originals.

Log ID Source/action Result and precise limit
L01 S001 whole current eCFR Part 238 Complete body successfully read, including footnote and final note. This supplied § 238.0 despite its separate endpoint failure.
L02 S001 individual §§ 238.1–.4 Complete material bodies read. Initially differing displayed currency dates were preserved; they were not treated as new enactment dates.
F03 Separate § 238.0 endpoint: https://www.ecfr.gov/current/title-16/chapter-I/subchapter-B/part-238/section-238.0 Redirected to an access-request/CAPTCHA page. No CAPTCHA, access request, API route, or workaround used. The already-readable whole-part body and annual CFR supplied the text. ecfr.gov
L04 S001 annual CFR PDF Complete Part 238 and its footnote read on printed 193–194, PDF indices 0–1. Parsed text only. Adjacent material was excluded from substantive reliance.
L05 S002 § 1.5 and surrounding Part 1 Complete § 1.5 read. § 1.6 read for context; its separate petition and investigation regimes were not pursued or applied.
L06 S003 FTC guidance-status explanation Complete introductory status paragraph read. Index entries were not treated as bodies of the linked documents.
L07 S004–S007 Code bodies Narrow clauses identified in the source register read completely, including § 57a(h) and § 46’s trailing insurance limitation. Broader statutory regimes were not represented as completed.
L08 S008 LOC 1967 Federal Register Complete selected Part 238 publication read. Narrow neighboring recodification/status text was inspected for context, not used to assume that every neighboring instrument or rule was part of Part 238.
F09 S008 GPO 1967 issue PDF Initial retrieval exposed issue/front matter; selected-text find/open attempts returned timeout failures. No claim of complete GPO-format body access. LOC was the readable official archival alternative.
F10 S008 PDF screenshot attempts Returned an image marker without inspectable image content. No pixel or scanned-page visual verification is claimed. Parsed text, pagination metadata, and the issue’s publication/index references were used.
L11 S009 enacted 1975 amendment PDF Selected complete clauses and approval line read at the recorded printed pages/PDF indices. No whole-Act review or imported warranty-title timing rule.
L12 S010 2023 review notification Relevant action, dates, qualification, schedule reservation, and Part 238 row read. Other rules and named contacts were not investigated.
F13 / L13 S011 FTC landing page First open timed out; ordinary retry succeeded. Page supplies a link, not the full guide or proof of substantive-rule status.
L14 S012 FTC retrospective-review page Generic introductory process explanation inspected. No linked case, comment, participant record, or actual review file investigated.
F15 S013 GPO 1959 issue URL Failed with content length too large. No original 1959 body or page read.
F16 S013 attempted LOC 1959 issue URL Tool reported the URL inaccessible. No original-body comparison or effective-date conclusion drawn.
L17 Generic discovery searches Statutory/guide titles, citations, and generic amendment/history terms only. Search snippets, unofficial mirrors, annual-report summaries, and unrelated case or record hits were not promoted into legal evidence or pursued as party investigations.
L18 Final method check Actual access date checked; same-instrument formats grouped; no files, signatures, accounts, contacts, submissions, transactions, or operational changes made for this report.

10. Explicit remaining gaps

  1. Original 1959 publication. Its body was not successfully opened. The complete 1967 primary publication independently records the adoption date, but the earliest publication’s full text and any separate issuance details remain unverified. The exact next inquiry is an ordinarily accessible official archival copy of that original publication. C044–C045, C050; S008/S013; B26.
  2. Exhaustive later history. The current compilations, annual edition, selected 1975 enacted changes, and 2023 review notification do not establish the absence of every later amendment, withdrawal, interpretation, or judicial development. No judicial-status certification is made. C002–C004, C046–C051, C055.
  3. Services and debt-relief offerings. Services are not absent from the definition. What remains open is the supported application of particular merchandise-oriented indicia to a service category, especially any debt-relief application. A generic official interpretation expressly addressing that extension would be the next relevant public-law source. C016, C040; B17.
  4. Complete statutory jurisdiction. The report preserves express statutory limits, including the insurance qualification, but does not complete banking, carrier, insurance, foreign-commerce, or other incorporated jurisdictional regimes. No actual institution or provider is classified. C008–C014, C054; B24.
  5. Undefined standards and proof. Reasonableness, anticipated demand, bona fides, design, purpose, and good faith are not resolved by invented numbers or labels. The selected sources provide no universal quantitative test or evidentiary weighting formula. C020–C043; B03–B22/B28.
  6. Remedies and actual consequences. Refund references remain part of the guide’s post-sale analysis. Cancellation, restitution, damages, private standing, penalties, debt validity, collection defenses, and discharge require their own authority and factual predicates. They are not determined here. C006, C015, C035, C041; B19/B25.
  7. Broader incentive and empirical questions. Affiliate/referral fees, attorney compensation, creditor contributions, lead resale, recommendation conflicts, and measured behavioral or economic effects remain open. Part 238 does not supply their full legal framework or empirical answer. C032, C042, C052; B27.
  8. Every actual application fact. No advertiser, worker, consumer, offer, statement, intent, stock condition, compensation arrangement, transaction, loss, or remedy fact has been supplied or determined. Public-law text cannot fill those factual gaps. B01–B28; worksheet intentionally blank.

R082-P1-C011Section 46(g) authorizes classification of corporations and rules/regulations to carry out the subchapter, expressly subject to § 57a(a)(2). The section’s insurance limitation must also be preserved; see C054.S005, § 46(g) and final paragraphs. uscode.house.gov +1
R082-P1-C012Section 57a(a)(1) distinguishes interpretive rules/general policy statements from rules defining unfair or deceptive practices with specificity. It is subject to subsection (h); the substantive-rule branch also contains the stated limitation concerning regulation of standards-development and certification activities.S006, complete § 57a(a)(1)(A)–(B). uscode.house.gov
R082-P1-C013Incorporated § 57a(h) restricts rulemaking in the children’s-advertising proceeding pending May 28, 1980, or a substantially similar proceeding, where based on a determination that such advertising is unfair. This narrow restriction is not a general exemption from deception law.S006, complete § 57a(h). uscode.house.gov
R082-P1-C014Section 57a(a)(2) limits the Commission’s authority under the subchapter to prescribe unfair-or-deceptive-practice rules to that section, while expressly preserving the identified authority concerning unfair methods of competition.S006, complete § 57a(a)(2).
R082-P1-C015For a rule actually within § 57a(a)(1)(B), § 57a(d)(3) gives a subsequent violation the specified § 45(a)(1) effect after the rule takes effect, unless the FTC expressly provides otherwise. That clause does not itself transform Part 238 into such a rule.S006, complete § 57a(d)(3); S002–S003, guide status.

R082-P1-C016Bait advertising is defined through an attractive but insincere offer to sell a product or service that the advertiser does not truly intend or want to sell.S001, § 238.0, first sentence.
R082-P1-C017The defined purpose is switching consumers away from advertised merchandise to something else, ordinarily described as higher priced or otherwise more advantageous to the advertiser. A higher price is not stated as an invariant requirement throughout the guide.S001, § 238.0, second sentence.
R082-P1-C018Section 238.0 describes the primary aim as obtaining leads concerning people interested in merchandise of the advertised type. It does not establish a general prohibition on every lead-generating activity.S001, § 238.0, final sentence.
R082-P1-C019For this part, advertising includes public notice however disseminated or used. No particular delivery technology is made a prerequisite by the footnote.S001, § 238.0 footnote.
R082-P1-C020Apart from the bait-advertising definition and advertising footnote, the selected part uses rather than separately exhaustively defines the principal product, service, good-faith, switching, disparagement, and compensation terms discussed here.S001, complete §§ 238.0–238.4; bounded textual finding.
R082-P1-C021Section 238.1 says an advertisement offering a product should not be published where the offer is not a bona-fide effort to sell that product. This is guide language, not a separately specified penalty provision.S001, complete § 238.1. ecfr.gov
R082-P1-C022Section 238.2(a) addresses false impressions of grade, quality, make, value, currency of model, size, color, usability, or origin, and other product misrepresentation that may enable a later switch when the true facts are disclosed. An actual completed switch is not stated as the wording’s prerequisite.S001, complete § 238.2(a). ecfr.gov
R082-P1-C023Section 238.2(b) states that later disclosure of true facts does not cure the described violation where deception secured the first contact or interview. Whether deception and statutory coverage exist remains unestablished here.S001, complete § 238.2(b); S004, § 45(a).
R082-P1-C024Section 238.3 addresses discouragement of advertised-merchandise purchases as part of a bait scheme to sell other merchandise. Its ensuing list is nonexclusive and identifies practices considered in assessing a bona-fide offer; it is not a statement that every isolated listed fact automatically proves a violation.S001, § 238.3 introduction; S008, introductory explanation. ecfr.gov
R082-P1-C025The first indicium is refusal to show, demonstrate, or sell the offered product in accordance with the offer’s terms, within C024’s framework.S001, § 238.3(a).
R082-P1-C026The next indicium covers disparagement by words or acts of the advertised product or its guarantee, credit terms, service availability, repairs, parts, or other connected respect.S001, § 238.3(b).
R082-P1-C027The availability indicium concerns insufficient advertised-product supply at all advertised outlets to meet reasonably anticipated demand, subject to C028. It is not an unlimited-stock requirement.S001, § 238.3(c), first clause.
R082-P1-C028The express qualification requires the advertisement clearly and adequately to disclose limited supply and/or availability only at designated outlets. It qualifies the stock/outlet provision; it is not a universal cure for other deceptive inducement or switching conduct.S001, § 238.3(c), unless clause.
R082-P1-C029Refusal to accept orders for advertised merchandise deliverable within a reasonable period is another listed indicium. No number of days is supplied.S001, § 238.3(d).
R082-P1-C030Showing or demonstrating a product that is defective, unusable, or impractical for the advertisement’s represented or implied purpose is a listed indicium. The represented or implied purpose matters.S001, § 238.3(e).
R082-P1-C031Section 238.3(f) covers use of a sales plan or compensation method, or penalizing sales personnel, designed to prevent or discourage their selling the advertised product. The design relationship to advertised-product sales is material.S001, complete § 238.3(f), read with introduction. ecfr.gov
R082-P1-C032A compensation label alone does not establish C031’s design predicate or C024’s bait-scheme context. The selected text supplies neither a general commission prohibition nor a compensation-based exemption.S001, § 238.3 introduction and (f); bounded comparison, not a finding about an arrangement.

R082-P1-C033Section 238.4 addresses an advertiser’s post-sale effort to undo the advertised sale with the intention and purpose of selling other merchandise instead. Its list concerns whether the initial sale was in good faith rather than a switching stratagem.S001, § 238.4 introduction. ecfr.gov
R082-P1-C034Accepting a deposit for the advertised product and then switching the purchaser to a higher-priced product is a listed post-sale indicium. The sequence and comparison matter.S001, § 238.4(a).
R082-P1-C035Section 238.4(b) lists failure to deliver the advertised product within a reasonable time or to make a refund. It supplies no numeric period or comprehensive refund procedure.S001, § 238.4(b).
R082-P1-C036Post-sale disparagement includes the product, guarantee, credit terms, service availability, repairs, and other connected respects. Unlike § 238.3(b), this paragraph does not expressly enumerate parts; its catchall remains.S001, § 238.4(c), compared with § 238.3(b).
R082-P1-C037Delivery of an advertised product that is defective, unusable, or impractical for the represented or implied advertised purpose is a listed post-sale indicium.S001, § 238.4(d).
R082-P1-C038The concluding note says actual sales of advertised merchandise do not preclude a bait-and-switch scheme; it describes occasions when such sales are incidental and intended to lend legitimacy. It does not say every completed sale proves a scheme.S001, note following § 238.4(d).
R082-P1-C039The guide distinguishes pre-sale showing/demonstration from delivery after sale, and distinguishes sale completion from the sincerity of the original solicitation. No numerical safe harbor based on successful advertised sales is stated.S001, §§ 238.3(e), 238.4 introduction, (d), and note.
R082-P1-C040Services are expressly present in § 238.0, but a service-specific application of merchandise, inventory, outlet, parts, and delivery indicia is not resolved by that inclusion alone. Debt-relief-service application remains held.S001, § 238.0 compared with §§ 238.1–238.4.
R082-P1-C041Part 238’s deposit, delivery, and refund references do not supply a standalone cancellation right, damages award, private cause, debt discharge, collection defense, or penalty. Any such result requires separate applicable authority and facts.S001, complete part, particularly § 238.4(a)–(b); S002–S006, status/authority distinction.
R082-P1-C042The complete part does not expressly describe a sales-commission schedule, reward formula, affiliate/referral arrangement, attorney fee, creditor contribution, lead-resale payment, trade-in procedure, or product-return procedure. These subjects are not resolved by omission.S001, complete part; textual absence finding limited to that body.
R082-P1-C043No fixed price difference, commission rate, profit amount, stock count, delivery/refund deadline, injury amount, or loss threshold is supplied in Part 238. Its relative and reasonableness language must not be converted into invented numbers.S001, complete part, especially §§ 238.0, 238.3(c)–(f), 238.4(a)–(b).
R082-P1-C044The complete 1967 publication records adoption on November 24, 1959; explains staff evaluation, public education, voluntary cooperation, and nonexhaustive major indications; and identifies FTC Act enforcement as the statutory route. Publication occurred November 8, 1967.S008, introductory paragraphs, adoption line, issue date. tile.loc.gov +1
R082-P1-C045The historical publication states that the guides do not relieve compliance with an FTC order or stipulation and do not constitute a finding in, or determine disposition of, a formal or informal matter. These are publication-level reservations, not actual-order findings here.S008, concluding paragraphs, printed 15541/PDF index 22.
R082-P1-C046The 1967 introduction’s older commerce wording must not replace current § 45 wording. P.L. 93-637 § 201(a) expressly changed the former wording to cover commerce and effects on commerce.S008, introduction; S009, complete § 201(a); S004, current § 45(a). govinfo.gov
R082-P1-C047P.L. 93-637 § 202(a) enacted the selected interpretive/substantive rulemaking distinction and authority limitation; § 202(b) inserted the corresponding exception into § 46(g). This establishes those selected changes, not every later amendment.S009, § 202(a), inserted § 18(a)(1)–(2), and § 202(b).
R082-P1-C048Section 202(c)(1) preserves the validity of previously promulgated § 6(g) rules and addresses proposed rules whose presentation of material was substantially completed before enactment. Under (c)(2), a valid covered rule’s later substantive change must follow § 18 if § 18 would have applied to a post-enactment promulgation. This is not a finding that Part 238 is a legislative rule or that every historical predicate is established.S009, complete § 202(c)(1)–(2). govinfo.gov
R082-P1-C049The 2023 review notice lists Part 238 for initiation of review in 2027, reserves schedule changes, and disclaims an inference about need or substance. It is not a repeal, amendment, new guide effective date, or guarantee of a future action.S010, summary, dates, scheduling reservation, appendix Part 238 row. govinfo.gov
R082-P1-C050The separate 1959 original was not successfully opened. The adoption-date finding rests on the complete 1967 primary publication, not an asserted independent reading of the earlier original.S008, adoption line; S013, failed openings.
R082-P1-C051The successful current compilations and selected enacted/publication bodies establish bounded text and history. They do not certify an exhaustive later-law, withdrawal, judicial-treatment, or full jurisdictional chain.S001–S010, expressly limited read bounds and currentness labels.
R082-P1-C052This source set supplies legal descriptions and agency interpretations, not measured causal evidence about incentives, business outcomes, consumer losses, or suitability. No actual application facts or economic results are supplied in this pass.S001, complete guide; S008, stated publication purpose; research-scope limitation.
R082-P1-C053The separate § 238.0 endpoint encountered an access gate, but § 238.0 and its footnote were fully readable in the whole-part eCFR and annual CFR bodies. The failed endpoint remains logged; no gate was bypassed.S001, whole-part and annual bodies; failure F03 below.
R082-P1-C054Section 46’s final paragraphs exclude the insurance business from that section except clauses (c) and (d), while separately permitting insurance studies/reports only following a request agreed to by a majority of the members of either specified congressional committee; that study authority expires at the end of the Congress in which the request was made. This qualification prevents treating § 46(g) as unlimited authority; no insurance-jurisdiction or study finding is made.S005, complete final two insurance paragraphs. uscode.house.gov

ComparisonWhat the selected text establishesWhat remains distinct or unresolvedClaims/sources
Bona-fide offer / attracting prospectsThe definition connects insincerity, an offer the advertiser does not intend or want to sell, and switching purpose.Attractiveness or lead generation alone does not establish those predicates.C016–C018, C021; S001 § 238.0–.1
Later disclosure / original inducementThe initial-contact provision addresses deception despite later disclosure.A later explanation is not an automatic cure; whether the original contact was deceptive remains a separate factual/legal question.C022–C023; S001 § 238.2
Listed indicium / established violationSections 238.3 and .4 identify practices considered in assessing bona fides and good faith. The list is not a universal one-fact liability formula or an exhaustive set of necessary elements.C024, C033; S001; S008 introduction
Commercial incentive / described compensation methodThe specific compensation provision links the scheme’s design to discouraging advertised-product sales. The presence of an incentive, without its design and context, does not establish the described conduct.C031–C032; S001 § 238.3(f)
General commission / listed schemeA commission could be a compensation method as a generic category; the text does not expressly prescribe or ban commission structures generally. No actual commission contract, intent, behavior, or payment is established.C020, C031–C032, C042
Adequate supply / disclosed limitationThe guide considers reasonably anticipated demand at advertised outlets and specifies a disclosure qualification. There is no fixed stock count and no blanket disclosure immunity.C027–C028; S001 § 238.3(c)
Defective demonstration / defective deliveryBoth appear, at different stages, with the represented or implied advertised purpose as the reference.A showing and an actual delivery are not interchangeable facts.C030, C037, C039
Advertised product conduct / service applicationThe definition expressly includes services; subsequent indicia often concern merchandise logistics.A particular debt-relief or other service application requires additional generic interpretive authority and facts.C016, C040
Completed sale / original sincerityActual advertised-item sales do not preclude the scheme described in the final note.Their existence is neither a universal defense nor universal proof of wrongdoing.C033–C039
Refund mention / remedy entitlementFailure to refund appears in a post-sale indicium.Refund procedure, cancellation, damages, standing, penalties, and debt consequences are not established.C035, C041
Guide / legislative rule / statuteGuidance status, statutory prohibitions, and the effect of a qualifying substantive rule are different legal categories.CFR placement and a “Rules” webpage label do not collapse them.C005–C015; S002–S006, S011
Federal legal description / actual proof / other lawThe selected text describes federal categories subject to statutory authority.Actual proof, exemptions, other federal/state law, broader incentives, and remedies remain open.C008–C014, C040–C043, C051–C054

B20 — Post-sale disparagement. Answered text; application unresolved. The post-sale list has its stated connected categories and catchall; parts are not separately enumerated there. C033, C036; S001 § 238.4(c).Stage, conduct, connection, and switching purpose. The two disparagement paragraphs have identical enumerations, or omission of a word creates categorical immunity.Compare generic official interpretations of §§ 238.3(b) and .4(c).
B21 — Defective delivery. Answered text; application unresolved.Actual delivery is the described event, with defect/usability/practicality related to the represented or implied purpose. C033, C037; S001 § 238.4(d).Delivery and purpose/condition facts.A demonstration and delivery are interchangeable, or every defect proves the entire scheme.Read generic interpretation of § 238.4(d); warranty remedies remain separate.
B22 — Advertised sales occurred. Answered text; application unresolved.Such sales do not preclude a scheme; the note’s occasional-incidental-sales explanation is qualified. C038–C039; S001 final note.Overall plan and role of those sales.A completed sale proves legitimacy, or itself proves illegitimacy.Examine generic official explanation of the final note, without actual sales data.
B23 — Guide versus rule. Answered boundary.Apply the administrative-interpretation status and distinguish § 57a(a)(1)(B) rules and their specified statutory effect. C005–C006, C012–C015; S002–S006.Any separate rule and its own promulgation/effectiveness predicates.CFR placement alone supports an independent guide-violation penalty.Read the exact generic authority for any separately proposed rule-based consequence.
B24 — Statutory jurisdiction unknown. Partial.§§ 45, 46, and incorporated definitions contain coverage limitations; the insurance qualification also remains material. C007–C014, C054; S004–S007.Exact incorporated category and jurisdictional facts.Every advertiser, financial provider, or insurer is covered identically.Read only the indispensable complete category definition or exception—such as the relevant § 57a(f) incorporation—if that generic boundary becomes necessary.
B25 — Remedy or penalty sought. Excluded from resolution. This pass establishes no freestanding refund, damages, private-action, debt-release, or penalty result. C006, C015, C041; S001–S006.Complete remedy/standing/procedure authority and facts.A guide indicium automatically produces financial relief.A separate generic inquiry could read the relevant current FTC Act remedy provision, including its conditions; no actual complaint or case.
B26 — Original/history/currentness failure. Partial.Current bodies and selected history were read, but the 1959 original and exhaustive later chain remain gaps; a review schedule is not an amendment. C044–C051, C053, C055; S008–S013.Readable original and any materially later official action.Failure proves repeal, absence of authority, or permission to bypass access controls.Try an ordinarily accessible official archival format of the 1959 publication or a later generic amendatory publication; no gate workaround.
B27 — Other law and broader incentives. Excluded from resolution.Part 238 does not settle affiliate/referral arrangements, attorney fees, creditor contributions, lead resale, or broader recommendation conflicts. C032, C040–C042, C052.The separate applicable legal framework and all application facts.Silence is approval, exemption, or a finding of illegality.Identify the narrow generic public authority governing the particular category before opening a separate component.
B28 — Numeric standard proposed. Answered absence; application unresolved.Part 238 contains relative price, anticipated-demand, sequence, and reasonableness descriptions, not the missing numeric thresholds. C017, C027–C029, C034–C035, C043; S001.Any separate authority expressly supplying a quantity or counting convention.Inventing a stock percentage, commission cap, profit threshold, or number of days.Read the exact separate generic quantity/trigger clause, if one is legally relevant; do not calculate absent predicates.
