Federal ADA Title II effective-communication framework

The complete displayed bodies of 28 CFR §§ 35.160–35.164 were readable, and all five sections are substantive provisions. They establish communication duties, rules for selecting and supplying auxiliary aids, limits on using accompanying adults or children, telecommunications and emergency-access duties, information and signage requirements, and a specific procedure for asserting fundamental alteration or undue financial and administrative burdens. None of the five selected sections is reserved. The reserved range displayed immediately afterward is §§ 35.165–35.169. C001; S001. ecfr.gov

The central distinctions are between qualification for an underlying public service, effective communication about or within that service, the particular method used, and a demonstrated exception to a requested action. Those questions do not establish a benefit award, professional representation, debt cancellation, a rights violation, or a remedy in an actual matter. C007–C010, C038–C044, C058–C066.

Actual access date: October 27, 2026, America/Los_Angeles, during the evening PDT. The corresponding observed UTC date was October 28, 2026. The current statutory pages displayed laws in effect through Public Law 119-134, October 20, 2026. The readable eCFR pages displayed Title 28 current through October 23, 2026, with a title-wide last-amended label of September 30, 2026. Those labels are compilation information; they do not certify an exhaustive subsequent enactment, correction, or judicial-status chain. C002, C075.

The findings below are independent of the earlier reports in this conversation. They use the public sources opened for this pass. No actual or invented individual, institution, program, communication, disability, financial fact, dispute, or record was used.

Reference convention

Every source and claim has its full identifier in its register. Elsewhere, S001 means R078-P1-S001, C001 means R078-P1-C001, and similarly for the remaining identifiers. Branches and measurements are numbered B01+ and M01+. References to another row incorporate that row’s stated conditions and limitations.

2. Atomic claim register

A. Statutory scope, authority, and indispensable definitions

Claim ID Supported proposition and cumulative qualifications Exact authority; limits
R078-P1-C001 The selected range contains five operative-text sections: General; Telecommunications; Telephone emergency services; Information and signage; Duties. Section 35.160 contains paragraphs (a)–(d). No selected section is reserved. S001, §§ 35.160–35.164 and adjacent reserved label. This is an organization/read finding, not certification of every later legal development.
R078-P1-C002 Currentness displayed by the opened sources is October 23, 2026 for eCFR Title 28 and P.L. 119-134/October 20, 2026 for OLRC. The separate September 30, 2026 eCFR label concerns Title 28 generally. S001–S009, displayed headers. A title-wide amendment date does not identify an amendment to these selected sections.
R078-P1-C003 Section 12134(a) directs the Attorney General to issue accessible-format implementing regulations, historically within one year after enactment, excluding matters assigned there to the Secretary of Transportation. Section 12205a expressly includes authority to implement ADA disability/additional definitions and construction rules consistently with ADAAA. S003, § 12134(a); S006, § 12205a. General administrative authority citations were observed, but no particular official’s delegation was adjudicated. uscode.house.gov+1
R078-P1-C004 Part 35 implements Title II, Subtitle A, and applies to services, programs, and activities provided or made available by public entities. Section 35.102(b) excludes the public-transportation services covered by Subtitle B from this part’s application. S002, §§ 35.101–35.102. The selected text does not supply a universal definition making every financially connected, licensed, funded, or contracted private activity a public-entity activity.
R078-P1-C005 The public-entity definition covers State/local governments; their departments, agencies, special-purpose districts and other instrumentalities; and the expressly specified passenger-rail/commuter-authority category. S003, § 12131(1)(A)–(C); S002, § 35.104, “Public entity.” No actual institution is classified here.
R078-P1-C006 The statutory State definition enumerates the States, District of Columbia, Puerto Rico, Guam, American Samoa, U.S. Virgin Islands, the Trust Territory of the Pacific Islands, and Northern Mariana Islands. S004, § 12103(2); S002, § 35.104. This reports the statutory wording; it does not resolve present territorial succession, tribal status, or foreign-law coverage.
R078-P1-C007 A qualified individual with a disability must meet the service/program/activity’s essential eligibility requirements, with or without the specified modifications, barrier removal, or auxiliary aids/services. S003, § 12131(2); S002, § 35.104. Disability status and communication need do not themselves establish underlying eligibility.
R078-P1-C008 Subject to Title II’s provisions, § 12132 prohibits excluding a qualified individual from participation, denying public-entity service/program/activity benefits, or subjecting the individual to discrimination by reason of disability. S003, complete § 12132. No actual exclusion, causation, qualification, or violation is established.
R078-P1-C009 Section 12133 incorporates the remedies, procedures, and rights in 29 USC § 794a for an allegation of discrimination violating § 12132. S003, complete § 12133. The incorporated remedies chain, standing, exhaustion, immunity, damages, and enforcement outcome are not resolved.
R078-P1-C010 Section 12134(b) uses Part 39 regulations/analysis as the consistency reference for communications and existing-facility program accessibility; other specified regulations use Part 41’s referenced historical coordination rules. Subsection (c) separately addresses facility/vehicle standards, with its Subtitle B exclusion and Access Board reference. S003, § 12134(b)–(c); S009, § 39.160. These are distinct statutory instructions, not permission to replace Part 35’s actual communication language with another regime.
R078-P1-C011 The selected public-entity texts contain differently expressed rail cross-references. Current § 12131(1)(C) displays a § 24102(4) reference and an explanatory note; the current commuter-authority definition appears at § 24102(2). The regulation retains the older Rail Passenger Service Act reference. S003, § 12131(1)(C) and reference note; S007, § 24102(2)–(3); S002, § 35.104. The full enacted alignment chain and any transportation application remain unresolved.
R078-P1-C012 Disability has alternative actual-impairment, record-of-impairment, and regarded-as routes. The definition is construed broadly to the maximum extent permitted by the ADA; these routes are not interchangeable for every requested consequence. S004, § 12102(1), (3)–(4); S002, § 35.108(a).
R078-P1-C013 The regulatory impairment definition includes physiological disorders/conditions, cosmetic disfigurement or anatomical loss affecting the specified kinds of body systems, and mental/psychological disorders. Its disease/condition examples are nonexclusive. S002, § 35.108(b)(1)–(2). The examples do not authorize a diagnosis or establish an actual individual’s facts.
R078-P1-C014 Major life activities include, nonexclusively, seeing, hearing, speaking, reading, writing, communicating and other listed activities, plus major bodily functions and individual-organ operation. “Major” is not a demanding central-importance-to-daily-life test. S004, § 12102(2); S002, § 35.108(c). The regulation’s examples are more detailed than the statute’s nonexclusive list.
R078-P1-C015 Substantial limitation is assessed broadly against most people in the general population. Prevention or severe/significant restriction is unnecessary; not every impairment qualifies. Assessment remains individualized, ordinarily without demanding scientific, medical, or statistical comparison evidence, though such evidence is not prohibited. S002, § 35.108(d)(1)(i)–(vii). No individualized assessment is performed here.
R078-P1-C016 Limitation of one major life activity can suffice. An episodic or remitting impairment is assessed when active. Effects lasting less than six months can qualify under actual-disability or record-of routes; the regarded-as duration exclusion is not a minimum-duration requirement for those routes. S004, § 12102(4)(C)–(D); S002, § 35.108(d)(1)(iii)–(iv), (ix).
R078-P1-C017 Ameliorative effects of mitigating measures generally are disregarded in the substantial-limitation inquiry. Ordinary eyeglasses/contact lenses are the express exception: their ameliorative effects are considered. They mean lenses intended fully to correct acuity or eliminate refractive error; low-vision devices instead magnify, enhance, or augment an image. S004, § 12102(4)(E); S002, § 35.108(d)(1)(viii), (d)(4). No treatment or device recommendation follows.
R078-P1-C018 Appropriate assessment can consider condition, manner, duration, effort, pain, time, bodily-function effects, and non-ameliorative treatment effects. The focus is limitation of activity, not achievement alone; extensive assessment of every factor often is unnecessary. S002, § 35.108(d)(3)(i)–(iv). No academic, medical, or functional history is invented.
R078-P1-C019 The predictable-assessment examples connect deafness/hearing; blindness/seeing; intellectual disability, autism and cerebral palsy/brain function; specified limb or mobility impairments/musculoskeletal function; cancer/cell growth; diabetes/endocrine function; specified neurological conditions/neurological function; HIV/immune function; and listed mental/brain conditions/brain function. The regulation describes these assessments as ordinarily straightforward and does not replace the necessary factual predicates. S002, § 35.108(d)(2)(i)–(iii)(A)–(K). These are the regulation’s generic categories, not actual diagnoses or a screening instrument.
R078-P1-C020 Record-of coverage includes a history of, or misclassification as having, a substantially limiting impairment, applying the stated broad-construction principles. A related, needed reasonable modification may be available for a past disability. S002, § 35.108(e)(1)–(3). No record, need, or modification entitlement is established.
R078-P1-C021 Regarded-as coverage concerns a prohibited action because of an actual or perceived impairment, without requiring that it limit or be perceived to limit a major life activity. S004, § 12102(3)(A); S002, § 35.108(f)(1). The remaining exception and liability qualification must also be retained.
R078-P1-C022 The regarded-as exclusion requires the impairment to be both transitory and minor. Transitory means an actual or expected duration of six months or less. Under the regulation, the entity must demonstrate those characteristics objectively; its subjective belief is insufficient. S004, § 12102(3)(B); S002, § 35.108(f)(2). Duration alone does not establish the combined exception.
R078-P1-C023 Establishing regarded-as coverage alone does not establish liability; the regulatory text separately requires proof of discrimination within Title II. S002, § 35.108(f)(3). This is a definition-versus-violation boundary.
R078-P1-C024 A person meeting the disability definition solely through the regarded-as route is not entitled on that basis to the reasonable accommodation/modification described by § 12201(h); § 35.130(b)(7)(ii) addresses reasonable modification. S006, § 12201(h); S010, § 35.130(b)(7); S016, instruction 5. This is not converted into a categorical resolution of every auxiliary-aid question.
R078-P1-C025 The selected statutory/regulatory text excludes homosexuality and bisexuality as impairments and separately lists transvestism, transsexualism, pedophilia, exhibitionism, voyeurism, gender-identity disorders not resulting from physical impairments, and other sexual-behavior disorders. S005, § 12211(a), (b)(1); S002, § 35.108(b)(3), (g)(1). Exact qualifications are retained; no conclusion about an identity, diagnosis, person, or later judicial treatment is made.
R078-P1-C026 Other listed exclusions are compulsive gambling, kleptomania, pyromania, and psychoactive-substance-use disorders resulting from current illegal use of drugs. S005, § 12211(b)(2)–(3); S002, § 35.108(g)(2)–(3). C027–C030 preserve the related limitations and exceptions.
R078-P1-C027 The current-illegal-use exclusion is tied to action on the basis of that use. The statute preserves the specified successful-rehabilitation/no-current-use, supervised-rehabilitation/no-current-use, and erroneous-perception/no-use categories. S005, § 12210(a)–(b); S002, § 35.104; S010, § 35.131(a). No blanket exclusion of every person with a history of addiction follows.
R078-P1-C028 Illegal-use terminology incorporates controlled-substance law and excludes supervised professional use and other federally authorized uses. The regulation’s “current” formulation asks whether use was recent enough to justify the stated reasonable belief; it supplies no fixed number of days. S005, § 12210(d); S002, § 35.104. Substance schedules and actual legality remain held.
R078-P1-C029 Otherwise-entitled health or drug-rehabilitation services cannot be denied on the stated current-use ground under § 12210(c). The DOJ regulatory text separately permits a rehabilitation/treatment program to deny participation for illegal use while in the program. S005, § 12210(c); S010, § 35.131(b)(1)–(2). Underlying entitlement and program facts remain absent.
R078-P1-C030 The selected text preserves specified reasonable policies/procedures aimed at determining whether former use has ceased, while expressly declining to encourage, prohibit, restrict, or authorize drug testing itself. S005, § 12210(b), concluding clause; S010, § 35.131(c). No testing authority or recommendation is inferred.

S002, § 35.104, “Auxiliary aids and services” (1); S004, § 12103(1)(A); S013, instruction 2. This is a nonexclusive category list, not a finding that each method is effective in every context.
R078-P1-C032 The visual-information category includes qualified readers, taped texts/audio recordings, Brailled materials/displays, screen readers, magnification software, optical readers, secondary auditory programs, large print, accessible electronic/information technology, and other effective methods. S002, same definition (2); S004, § 12103(1)(B). No particular format is selected.
R078-P1-C033 Acquisition or modification of equipment/devices, and other similar services/actions, are additional auxiliary-aid/service categories. S002, same definition (3)–(4); S004, § 12103(1)(C)–(D). Inclusion is not an automatic entitlement to every requested item.
R078-P1-C034 A qualified interpreter must interpret effectively, accurately, impartially, receptively and expressively, using necessary specialized vocabulary, on-site or through VRI. The listed sign-language/oral/cued-language examples do not make a label or presence sufficient. S002, § 35.104, “Qualified interpreter”; S013, instruction 2. No credential, professional, or actual performance is evaluated.
R078-P1-C035 A qualified reader must read effectively, accurately and impartially, using necessary specialized vocabulary. S002, § 35.104, “Qualified reader”; S013, instruction 2. This is distinct from selecting a reader or establishing a right to personal-use reading services.
R078-P1-C036 VRI is an interpreting service using video-conference technology over dedicated lines or wireless technology with the stated high-speed, wide-bandwidth, high-quality connection, subject to § 35.160(d). S002, § 35.104, “Video remote interpreting”; S013, instruction 2. A video link alone does not satisfy C034, C040–C044, or C050.
R078-P1-C037 DOJ’s § 35.135 text distinguishes required access measures from personal devices, individually prescribed devices, readers for personal use/study, and specified personal services that Part 35 does not require. S010, complete § 35.135. Current eCFR access to this supporting section failed; the republication’s currentness limit remains visible. It does not negate necessary program-related communication aids under § 35.160.
R078-P1-C038 Public entities must take appropriate steps so communications with applicants, participants, members of the public and companions with disabilities are as effective as communications with others. S001, § 35.160(a)(1). This is a comparative communication duty, not a promised substantive outcome.
R078-P1-C039 A companion is a family member, friend or associate of someone seeking public-service/program/activity access who, along with that individual, is an appropriate person for the entity to communicate with. DOJ’s analysis explains that the companion’s communication protection does not require the underlying participant also to have a disability or always to be physically present. S001, § 35.160(a)(2); S010, 2010 § 35.160 analysis, companion discussion. The definition does not establish representative authority or permission to disclose otherwise protected information.
R078-P1-C040 Appropriate auxiliary aids/services must be furnished where necessary to provide individuals with disabilities, including the specified participant categories, equal opportunity to participate in and enjoy the public service/program/activity’s benefits. S001, § 35.160(b)(1). Necessity and appropriateness remain distinct from underlying eligibility and preferred outcome.
R078-P1-C041 The necessary aid varies with the individual’s communication method and the communication’s nature, length, complexity, and context. S001, § 35.160(b)(2), first sentence. No universal device or interpreter rule is inferred from a disability label.
R078-P1-C042 The entity must give primary consideration to requests of individuals with disabilities when determining necessary aids/services. S001, § 35.160(b)(2). Primary consideration is more than disregarding the request, but the text does not guarantee every requested method.
R078-P1-C043 DOJ’s published explanation says the choice is to be honored unless the entity demonstrates another effective means or establishes that the chosen means is not required under § 35.164. S010, 1991 and 2010 § 35.160 analyses; S011, Title II choice discussion. A demonstrated equally effective alternative and a § 35.164 exception are different routes; not every method decision is automatically a burden determination.
R078-P1-C044 To be effective, aids/services must use accessible formats, arrive in a timely manner, and protect the individual’s privacy and independence. S001, § 35.160(b)(2), final sentence. These conditions remain relevant when an alternative method is used.
R078-P1-C045 An entity may not require an individual with a disability to bring another individual to interpret. S001, § 35.160(c)(1). This is separate from the limited circumstances permitting reliance on an accompanying person.
R078-P1-C046 Outside the emergency route, reliance on an accompanying adult requires all three: the individual specifically requests that assistance; the adult agrees; and reliance is appropriate under the circumstances. S001, § 35.160(c)(2)(ii). Accompaniment, relationship, availability, or agreement alone is insufficient.
R078-P1-C047 The adult emergency route requires an emergency involving an imminent threat to the safety or welfare of an individual or the public, with no interpreter available. S001, § 35.160(c)(2)(i). The regulation does not say that every interaction in an emergency-service setting meets this test.
R078-P1-C048 Reliance on a minor child is prohibited except for the same stated imminent-threat/no-interpreter emergency condition. There is no parallel ordinary-request/agreement exception for a minor child in this section. S001, § 35.160(c)(3). No numerical age definition is supplied in the selected communication text.
R078-P1-C049 DOJ’s 2010 explanation requires freely and voluntarily provided consent in the ordinary adult route, rejects coercion, and describes the emergency route narrowly as genuinely exigent circumstances, rather than typical foreseeable operational emergencies. It also distinguishes situations where an interpreter is not otherwise necessary. S010, 2010 § 35.160 analysis, accompanying-adult/child and emergency discussions. This is official explanation of the rule, not a new actual-emergency finding.
R078-P1-C050 When qualified interpreters are provided through VRI, all specified conditions apply: real-time full-motion video/audio over the stated quality connection without listed image/communication defects; a sufficiently large, sharply defined image showing both participants’ specified facial/upper-body features regardless of body position; clear audible voices; and adequate user/involved-person training for quick, efficient setup and operation. S001, § 35.160(d)(1)–(4); S013, instruction 12. No fixed bandwidth, frame rate, screen dimension or latency number is supplied.
R078-P1-C051 Where the entity communicates by telephone with applicants and beneficiaries, it must use TTYs or equally effective telecommunications systems for individuals who are deaf, hard of hearing, or have speech impairments. S001, § 35.161(a). The rule does not require one identical device for every context.
R078-P1-C052 An automated-attendant or interactive-voice-response system receiving/directing incoming calls must permit effective real-time communication with auxiliary-aid users, including TTYs and all forms of FCC-approved relay, including Internet-based relay. S001, § 35.161(b). No actual system, technical compatibility, or FCC approval was tested.
R078-P1-C053 Calls from a Title IV telecommunications relay service must receive a response in the same manner as other telephone calls. S001, § 35.161(c). This is not a finding about a particular relay provider or call.
R078-P1-C054 Section 225 defines TDD through graphic coded-signal communication and defines relay services through telephone transmission enabling the specified disability categories to communicate with others in a functionally equivalent manner to the identified voice-communication comparator. S008, § 225(a)(2)–(3). Broader FCC operating, fee, privacy, and enforcement rules are held.
R078-P1-C055 Telephone emergency services, including 911, must provide direct access for TDD and computer-modem users. DOJ’s published analysis distinguishes direct access from access through a third party or relay. S001, § 35.162; S010, 1991 § 35.162 analysis. This does not establish a universal text-message-to-emergency-service rule or a complete technical standard.
R078-P1-C056 Interested persons, including those with impaired vision or hearing, must be able to obtain information about the existence and location of accessible services, activities and facilities. S001, § 35.163(a). Providing information is distinct from proving all underlying facilities satisfy applicable physical standards.
R078-P1-C057 Signage is required at all inaccessible entrances to each facility, directing users to an accessible entrance or a location supplying accessible-facility information. The accessibility symbol is required at each accessible entrance. S001, § 35.163(b). No actual entrance or sign was inspected; technical design standards remain separate.
R078-P1-C058 Section 35.164 limits required actions only where the entity can demonstrate fundamental alteration of the service/program/activity or undue financial and administrative burdens. The entity bears the proof burden when its personnel assert those grounds. S001, § 35.164, first and second sentences. A cost assertion or staff preference is not itself the prescribed demonstration.
R078-P1-C059 That decision must be made by the head of the public entity or designee, after considering all resources available for funding and operating the service/program/activity, and accompanied by written reasons. S001, § 35.164, third sentence. The resource qualifier is retained; no actual resource universe, delegation or written decision is established.
R078-P1-C060 If the specified action would cause such alteration or burdens, the entity must take other action avoiding those consequences while ensuring, to the maximum extent possible, receipt of its benefits/services by individuals with disabilities. S001, § 35.164, final sentence. The exception does not erase the residual duty.
R078-P1-C061 DOJ’s published burden explanation identifies a high-level official, no lower than a department head, with budgetary/spending responsibility. The § 35.164 explanation expressly incorporates that § 35.150(a) discussion. S010, 1991 analyses of §§ 35.150(a), 35.164; S011, Title II limitations discussion. This explains the regulation’s head/designee language; the explanatory wording is not silently substituted for the codified sentence.
R078-P1-C062 DOJ’s § 35.130(f) text prohibits a surcharge on the particular individual or disability group to cover measures required for the ADA’s nondiscriminatory treatment, including required auxiliary aids. S010, complete § 35.130(f). This does not promise all professional services, all requested measures, or representation without charge. Supporting-section current-access limitation remains.
R078-P1-C063 Part 39’s comparator uses agency/Attorney General language and a primary-entrance signage formulation; Part 35 uses its own public-entity decision-maker and all/each entrance wording. S009, § 39.160(c)–(d); S001, §§ 35.163–35.164. The texts were compared, not assumed identical.
R078-P1-C064 The short DOJ guide describes emergency accompanying-interpreter situations using no qualified interpreter available; the codified § 35.160(c)(2)(i)/(3) says no interpreter available. S011, accompanying-adult/child discussion; S001, exact clauses. The difference is preserved. This pass does not decide a hypothetical case involving an available but unqualified person.

C. Legal effect, history, and source-status limits

Claim ID Supported proposition and conditions Exact authority; limits
R078-P1-C065 The selected construction provisions preserve equal or greater protections under other federal/State/local law and identify a Rehabilitation Act standards relationship. S002, § 35.103; S006, § 12201(a)–(b). No universal preemption or complete interaction finding follows.
R078-P1-C066 Section 12201(e) expressly leaves standards for workers’ compensation and State/federal disability-benefit eligibility unchanged. The selected communication provisions likewise do not themselves determine an actual service award or legal/financial result. S006, § 12201(e); S003, § 12131(2); S001, §§ 35.160–35.164. Debt, tax, credit, collection and bankruptcy consequences remain outside this investigation.
R078-P1-C067 The original Title II Subtitle A effective clause distinguishes an 18-month-after-enactment general trigger from immediate-on-enactment effectiveness for § 204, the regulation-making section. S003, effective-date notes; S017, complete reproduced § 205(a)–(b). The original Statutes at Large pages were not successfully read; no original-publication authentication is claimed.
R078-P1-C068 The archived 1991 final rule identifies publication on July 26, 1991, effectiveness on January 26, 1992, and its historical replacement boundary beginning March 15, 2011. S012, header and original selected bodies. Historical text does not displace current S001.
R078-P1-C069 The 2010 final rule’s selected instructions revise § 35.160(a)/(b), add (c)/(d), revise § 35.161, and update specified aid/interpreter definitions. Its stated effective date is March 15, 2011. S013, DATES and instructions 2, 12–13. No different physical-design compliance period is transposed to these communication clauses.
R078-P1-C070 The complete 2011 correction was published March 11, 2011, effective March 15, 2011. Its enumerated corrections do not alter §§ 35.160–35.164. S014, DATES and instructions 1–10. This checks a source-credit lead, not every later correction.
R078-P1-C071 ADAAA’s selected enacted clauses change disability definitions/construction and related authority, with effectiveness on January 1, 2009. S015, §§ 2, 4, 6(a), 8. Enactment was September 25, 2008.
R078-P1-C072 DOJ’s 2016 final rule installs the current § 35.108 structure and related Part 35 changes, effective October 11, 2016. S016, DATES and Part 35 instructions 1–5. Publication was August 11, 2016.
R078-P1-C073 The DOJ effective-communication guide displays original issuance January 1, 2014, update February 28, 2020, and an express nonbinding status statement. S011, date/status statements. Its explanatory text does not create independent enforceable duties beyond applicable law.
R078-P1-C074 The guide discusses reasonable advance notice based on time needed to obtain aids, rejects excessive notice requirements, and addresses walk-in requests to the extent possible. S011, operational guidance. No fixed notice or provision deadline is supplied; this explanation is not converted into a universal prerequisite to the codified duty.
R078-P1-C075 Successful current-body access, historical adoption access, failed supporting endpoints and unexamined later history are different evidence states. The record establishes selected displayed texts, not absence of later law, repeal, withdrawal, judicial invalidation or a complete legal-status chain. S001–S017 and failure log. This is a research-status limitation.
R078-P1-C076 The readable COMPS-803 alternative identifies its amended-through law and production date but expressly disclaims being an official statutory version. S017, printed p. 1/index 0. It supports the bounded reading of reproduced §§ 201–205; it does not cure original-publication access failure.
R078-P1-C077 The selected communication text supplies no numerical minor/adult age, fixed aid-delivery deadline, standard cost percentage, universal resource amount, or fixed VRI bandwidth/frame-rate/latency specification. S001, complete selected bodies. This is a limited negative-text finding, not a statement that no other applicable authority could supply a standard.
R078-P1-C078 Broader modification, private-entity, employment, education, language-access, technical-web, physical-access, enforcement and financial regimes require their own authorities and facts. Scope boundary supported by S003, §§ 12131–12134; S002, §§ 35.102–35.103; S006, § 12201; exact next-authority pointers below. No actual application or acceptance is supplied.

3. Provision-specific comparisons

The following comparisons use the complete conditions in the claim register. They do not create additional exceptions or decide which method should be used in an actual communication.

Comparison Verified distinction Consequence that remains unresolved Claims/sources
Public entity / other regulated actors The Title II category is statutory. Private involvement, public funding, licensing, or a public-facing function alone does not identify the applicable category. Whether any actual actor is an instrumentality, contractor subject to a particular obligation, private public accommodation, or another regulated actor. C004–C006, C011; S002–S003, S007
Underlying qualification / communication access Essential program eligibility and communication obligations are separate predicates. Communication may concern applicants, the public, or an appropriate companion, not merely approved beneficiaries. Eligibility, benefit approval, or a substantive administrative result. C007–C008, C038–C040; S001, S003
Disability definition / violation A definitional route supplies coverage criteria; it does not prove discrimination or the necessary aid. Disability facts, necessity, causation, compliance and liability. C012–C030, C023, C040; S002, S004–S006
Effective communication / a named method Effectiveness depends on context, the person’s method, and the nature, length and complexity of communication. Whether any device, written exchange, reader, interpreter or VRI method works in a particular setting. C031–C044; S001–S004
Preference / selection The individual’s request receives primary consideration. DOJ explains the conditions for honoring it or demonstrating another effective means. A preferred method is neither automatically guaranteed nor freely disregarded. C042–C043; S001, S010–S011
Qualified interpreter / accompanying adult Interpreter qualification is performance-based. Ordinary reliance on an accompanying adult requires the three separate conditions in C046. A relationship, label, or willingness does not establish qualification or appropriate reliance. C034, C045–C049; S001–S002, S010
Accompanying adult / minor child The adult provision has an ordinary requested-assistance route and an emergency route. The minor-child provision has only the stated emergency exception. No general parental/family-consent exception for minor interpretation is created. C046–C049; S001
Ordinary context / emergency context The emergency exception is tied to imminent threat and interpreter unavailability. The published explanation narrows it further than a generic emergency-service label. No actual emergency or availability determination; guidance/regulation wording difference remains visible. C047–C049, C064; S001, S010–S011
VRI capability / effective VRI The definition, qualified-interpreter standard, communication conditions and all four performance requirements operate together. A technically connected system is not a compliance finding. C034, C036, C040–C044, C050; S001–S002
Ordinary telephone / automated system / relay / emergency telephone Sections 35.161(a), (b), (c) and 35.162 address different functions. Emergency direct access is not replaced by assuming ordinary relay access suffices. Particular technology, approval, compatibility, service availability and technical standards. C051–C055; S001, S008, S010
Accessible-service information / accessible facility The information and directional-signage duties have their own express text. Compliance with construction, alteration, program-access or technical sign-design standards. C056–C057; S001
Requested action / demonstrated exception A belief that an action is costly or changes a program triggers neither a self-proving defense nor automatic termination of the communication duty. Whether the entity can make the required demonstration. C058–C060; S001
Codified decision-maker / explanatory decision-maker language The regulation says head or designee; the incorporated explanation describes a high-level official with spending authority. The identity, authority or sufficiency of any actual decision-maker or reasons. C059, C061; S001, S010–S011
Exception / residual action A demonstrated exception concerns an action; the regulation retains a duty to take other qualifying action preserving access to the maximum extent possible. What alternatives exist and whether they are effective and permissible. C058–C060; S001
Part 35 / Part 39 consistency comparator Part 39 is an incorporated consistency reference, but its actor and signage text are not word-for-word identical to Part 35. Full historical consistency, other federal-agency coverage and judicial reconciliation. C010, C063; S003, S009
Communication access / legal or financial outcome Access measures concern communication and participation. Underlying substantive law continues to supply eligibility and outcome rules. Representation, debt validity, collection consequences, relief, benefits, damages, tax, credit or bankruptcy results. C007, C009, C062, C066, C078

Three interpretation distinctions that should remain visible

  1. Primary consideration: the operative regulation establishes the consideration requirement; the published analysis explains honoring the choice unless another effective means or § 35.164 is demonstrated. Treating every departure as unrestricted discretion would omit that explanation. Treating every request as conclusive would omit its alternatives. C042–C043.
  2. Emergency interpreter wording: the regulation’s availability wording and the guide’s qualified-interpreter wording differ. This pass preserves both and does not decide whether any actual available person defeats or satisfies the exception. C047–C049, C064.
  3. Burden decision-maker: the guide’s high-level-official formulation has a traceable basis in the published explanation incorporated by the § 35.164 analysis. That does not eliminate the need to distinguish codified text from interpretation or establish any actual delegation. C059, C061.

4. Complete relied-on measurement and timing register

Legal section numbers, publication citations, source IDs and PDF page indices are identifiers, not eligibility measurements. The register below covers the quantities and timing formulations relied on in this answer. Quantities appearing only in unrelated displayed material or rejected historical proposals are not adopted as rules.

Measurement ID Exact authority; actor/object Quantity, unit, boundary or base Trigger, cumulative conditions and exceptions Counting/application limit
M01 § 12102(1)(A), (4)(C); § 35.108(d)(1)(iii); C012, C016 One or more major life activities; one can suffice. Actual substantial-limitation route; broad-construction rules still apply. No activities or functional facts supplied.
M02 § 12102(3)(B); § 35.108(f)(2); C022 Six months or less, inclusive, actual or expected duration. Only the transitory component of the transitory-and-minor regarded-as exclusion; objective entity demonstration required. No onset/end date, prediction, or “minor” finding; no calendar conversion.
M03 § 35.108(d)(1)(ix); C016 Less than six months can still qualify under actual/record routes. Substantial limitation remains necessary under the applicable route. Not a waiting period or minimum-duration rule.
M04 § 35.160(d)(1)–(4); C050 Four cumulative performance clauses. Entity chooses to furnish qualified interpreters by VRI; all general effectiveness predicates remain. A logical conjunction, not a score, percentage, or technical certification.
M05 § 35.163(b); C057 All inaccessible entrances; each accessible entrance. Directional-information alternatives and accessibility-symbol clauses have different objects. No facility/entrance count supplied; no physical-design calculation.
M06 § 35.164, third sentence; C059 All resources available for funding and operation of the service/program/activity. Head/designee considers this resource base for the asserted alteration/burdens decision. No amount, percentage, fiscal period, or actual resource inventory supplied.
M07 § 35.160(b)(2); C044 Timely provision; no fixed day/hour period in selected text. Accessible format, privacy and independence also required. No universal request-to-delivery deadline computed.
M08 § 35.160(c)(2)(i), (c)(3); C047–C048 Imminent threat; no numerical imminence interval. Emergency, specified safety/welfare threat, and no interpreter available are cumulative. No actual event, expected duration or availability finding.
M09 § 35.160(c)(2)–(3); C046–C048, C077 Adult/minor-child categories; no numerical age cutoff supplied here. Different reliance routes apply to the categories. No age threshold is invented or imported from another jurisdiction.
M10 § 35.160(d); § 35.161(b); C050, C052 Real-time/full-motion/high-speed/wide-bandwidth and image/audio quality requirements; no numeric bandwidth, frame rate, pixel size or latency limit. Functional conditions apply to the specified systems. No technical implementation test or calculation.
M11 § 12134(a); C003 Not later than one year after enactment; historical regulation-making deadline. Attorney General; accessible-format implementing regulations; transportation-authority exclusion. Not an individual accommodation-request deadline.
M12 § 12134(b); C010 January 13, 1978 identifies the referenced historical Part 41 coordination regulations. Communications/existing-facility program accessibility instead use the separately stated Part 39 reference. No current Part 41 dossier or date arithmetic.
M13 ADA § 205(a)–(b); C067 General subtitle: 18 months after enactment. Section 204: date of enactment. Enactment identified as July 26, 1990; express exception preserved. Complete clause read in S017 alternative and OLRC notes, not successfully in original publication. No calculated date substituted for the clause.
M14 1991 rule header; C068 Published July 26, 1991; effective January 26, 1992. Historical rule’s stated dates. Effective date is directly stated, not calculated here.
M15 2010 final rule DATES; C069 Published September 15, 2010; effective March 15, 2011. Selected communication/definition amendments. No physical-design compliance period or unverified early-implementation rule imported.
M16 2011 correction DATES; C070 Published March 11, 2011; effective March 15, 2011. Enumerated corrections only. No selected communication amendment created by that correction.
M17 P.L. 110-325 § 8; C071 Enacted September 25, 2008; effective January 1, 2009. Act and amendments made by it. Enactment and effectiveness remain distinct.
M18 2016 final rule DATES; C072 Published August 11, 2016; effective October 11, 2016. Selected Part 35 definition/construction amendments. No retroactivity determination.
M19 DOJ guide dates; C073–C074 Issued January 1, 2014; updated February 28, 2020. Reasonable advance notice has no fixed period. Nonbinding guidance; acquisition-time and walk-in qualifications retained. Publication/update dates are not statutory effective dates.
M20 DOJ integrated-page header; S010, C075 Displayed June 24, 2024. Composite publication containing text and analyses of different vintages. Does not authenticate every later amendment.
M21 eCFR headers; C002 Current-through October 23, 2026; Title 28 amendment label September 30, 2026. Source-compilation metadata. Not selected-section effective dates or proof of no intervening law.
M22 OLRC headers; C002 P.L. 119-134, October 20, 2026. Displayed laws-in-effect compilation boundary. Post-boundary history remains unexamined.
M23 Research access record October 27, 2026 PDT, corresponding UTC date October 28. Actual public-source access in this pass. Research date only; no legal deadline calculation.
M24 COMPS-803 title/status page; C076 Amended-through December 19, 2014 law; production date January 30, 2020. Bounded government-hosted compilation. Neither date is a newly enacted ADA communication rule.
M25 § 35.162; C055 911 is the service designation expressly mentioned. Telephone-emergency direct-access rule. It is not a count, age, duration or response-time guarantee.
M26 § 225(a)(3); C054 Communication with one or more other individuals. Part of the relay-service definition and its functional comparator. No actual call participants, service or operational performance supplied.

No numerical illustration is justified. The component supplies no actual event, resource base, technical measurement, or communication facts, and its principal standards are conditional and functional. A calendar, cost or performance model would add conventions the selected text does not supply. C041, C050, C058–C060, C077.

5. Substantive conditional branches

Coverage notation: “Answered boundary; application unresolved” means the generic selected rule is identified, while the absent actual predicates remain absent. It is not an eligibility or compliance result.

Branch; coverage status Supported conditional rule, including material conditions Missing evidence or authority Adverse inference to avoid Next permissible generic public-law inquiry
B01 — Public-entity scope unknown. Answered boundary; application unresolved. If the statutory public-entity category is met, the selected Part 35 scope must still be distinguished from its Subtitle B transportation exclusion. C004–C006, C011; S002–S003, S007. Entity category, instrumentality relationship, activity and transportation classification. Every publicly connected, licensed or funded private actor is covered by this particular rule. Trace § 12131(1), § 35.102 and the specific generic instrumentality/transportation category; no institution lookup.
B02 — Underlying qualification unknown. Answered boundary; application unresolved. Essential eligibility is assessed with or without the statutory modifications/barrier removal/aids; the communication duty does not itself establish the underlying award. C007, C038–C040, C066. Generic service’s eligibility authority and all application facts. Need for accessible communication proves entitlement to the service or financial benefit. Read the governing public eligibility provision only after the generic program category is identified; keep it separate from § 35.160.
B03 — Necessary definition incomplete. Partial if an unexamined incorporation becomes decisive. Coverage must use the applicable disability route, construction rules and exceptions, rather than an ordinary label. C012–C030; S002, S004–S006. Any decisive unexamined controlled-substance, territorial, or other incorporated rule; actual predicates. A familiar label supplies every statutory element. Open only the exact incorporated definition that becomes necessary, such as the referenced clause of 21 USC § 812; no substance/person lookup.
B04 — Communication participant unknown. Answered boundary; application unresolved. Applicants, participants, members of the public and qualifying companions with disabilities are within § 35.160(a)’s stated categories. Companion status additionally requires the defined relationship and appropriate-communication role. C038–C039; S001, S010. Participant role, relationship and appropriateness of communication. Only approved beneficiaries are protected, or every accompanying person automatically is a covered companion. Review § 35.160(a)(1)–(2) and the companion portion of its published analysis.
B05 — Communication context unknown. Answered boundary; application unresolved. Necessary means depend cumulatively on the communication method and nature, length, complexity and context. C040–C041; S001. Those contextual facts and the purpose of the communication. One method always works for a generic disability category. Examine § 35.160(b) and its official method-selection analysis, without constructing a personal scenario.
B06 — Auxiliary aid needed. Answered boundary; application unresolved. An appropriate aid is required where necessary for equal participation/enjoyment, using the broad aid categories while retaining the personal-device boundary. C031–C033, C037, C040. Necessity, appropriateness, program connection; current supporting-section history if decisive. Every requested device or personal service must be supplied. Reopen current § 35.135 when ordinarily accessible and compare its complete boundary with § 35.160(b)(1).
B07 — Qualified interpreter category. Answered boundary; application unresolved. Qualification requires effective, accurate, impartial receptive and expressive interpretation with necessary specialized vocabulary; on-site/VRI form does not remove those requirements. C034, C036; S002. Actual competence and communication fit; any additional applicable public qualification rule. Job title, presence, family status, or a generic credential alone proves the selected standard. Read § 35.104’s complete definition and any indispensable generic qualification authority; no provider search.
B08 — Preferred method/primary consideration. Answered boundary; application unresolved. Give the individual’s request primary consideration; DOJ explains honoring it unless another effective means or a § 35.164 ground is demonstrated. C042–C043. Request, effectiveness of alternatives, or complete exception predicates. Preference is either irrelevant or an unconditional veto over every alternative. Compare § 35.160(b)(2), its published analysis, and § 35.164 if an exception—not merely an effective alternative—is asserted.
B09 — Timeliness unknown. Answered boundary; application unresolved. Aids must be timely; guide discussion of advance notice does not supply a universal fixed deadline or universal request prerequisite. C044, C074, C077. Timing context, acquisition constraints and effectiveness; no actual events supplied. A standard number of days or an excessive advance-notice condition is established here. Read the complete timing discussion in the official guide alongside § 35.160(b)(2); identify any separate public procedural deadline only in a later scoped component.
B10 — Privacy/independence unknown. Answered boundary; application unresolved. Effective provision must protect both privacy and independence. C044; S001. Method, disclosure context, independence implications and separate confidentiality authority. Convenience, accompaniment or information access authorizes disclosure or representative control. Compare § 35.160(b)(2) with the exact separate confidentiality authority if indispensable; no records or consents.
B11 — Accompanying adult, ordinary setting. Answered boundary; application unresolved. Specific individual request and adult agreement and appropriateness are required; the published explanation rejects coercion. C045–C046, C049. Each separate predicate and context. Relationship or willingness alone allows reliance, or the entity can require the individual to bring help. Read § 35.160(c)(1), (c)(2)(ii) and the voluntary-assistance analysis together.
B12 — Accompanying minor. Answered boundary; application unresolved. Minor-child reliance is barred except for the stated emergency/imminent-threat/no-interpreter conditions. No ordinary requested-assistance route is stated. C048. Legal category and every emergency predicate; numerical age definition absent here. Adult-rule consent conditions can be transferred to children. Read § 35.160(c)(3); investigate a generic age-definition authority only if that narrow interpretive issue becomes necessary.
B13 — Emergency condition asserted. Answered boundary; application unresolved. The relevant adult/minor exception requires the specified imminent safety/welfare threat and interpreter unavailability; the explanation rejects treating ordinary foreseeable operations as sufficient. C047–C049, C064. Threat, urgency, availability and meaning of the guide/regulation wording difference. An emergency-service label automatically excuses ordinary communication duties. Review the complete § 35.160(c) analysis and any later official generic clarification of the availability wording; no incident or case inquiry.
B14 — VRI proposed or assumed. Answered boundary; application unresolved. Qualified interpretation, necessary/effective method selection, timely/privacy/independence conditions, and all four VRI performance clauses must coexist. C034, C036, C040–C044, C050. All operational and contextual facts; no technical specifications tested. A video connection or available equipment establishes effective communication. Read § 35.160(d) with § 35.104; any technical-standard investigation would require separate scope.
B15 — Ordinary telephone/automated/relay category. Answered boundary; application unresolved. Apply the correct § 35.161 paragraph: effective telephone means, accessible real-time automated handling, and same-manner relay response have distinct predicates. C051–C054. System function, user method, service category and FCC approval. Any telephone system or relay label satisfies all three paragraphs. Read § 35.161(a)–(c), then only the indispensable generic clause of 47 USC § 225 or 47 CFR Part 64, Subpart F.
B16 — Emergency telephone access. Answered boundary; application unresolved. Telephone emergency services must provide the specified direct TDD/modem access; ordinary relay access is not simply substituted for direct access. C055. Actual service/technology and any separately applicable technical authority. A universal text-to-emergency-service requirement or response time is proved here. Examine § 35.162 and its direct-access analysis; hold new technical emergency-communications standards for a separate pass.
B17 — Information and signage. Answered boundary; application unresolved. Supply accessible-service existence/location information, all-inaccessible-entrance directions and each-accessible-entrance symbols as the separate clauses require. C056–C057. Facility/entrance facts and separate technical sign standards. Information or a symbol proves complete building accessibility. Read § 35.163; next inspect only necessary public design/program-access provisions in §§ 35.149–35.151 if separately authorized.
B18 — Fundamental alteration asserted. Answered boundary; application unresolved. Entity demonstration, prescribed decision-maker/resource consideration/written reasons, and residual action all remain necessary under § 35.164. C058–C060. Nature of alteration, proof, authority, resources, reasons and alternatives. Staff disagreement or any program change is a complete defense. Read all sentences of § 35.164 and the incorporated burden explanation; no program-specific decision.
B19 — Financial/administrative burdens asserted. Answered boundary; application unresolved. Use Title II’s own financial-and-administrative-burdens formulation, complete resource base and decision procedure. C058–C061. Available resources, asserted burden, decision and alternatives. Cost, absence of a budget line, or another ADA title’s hardship test alone establishes an exception. Compare § 35.164 with its published § 35.150(a) explanation; do not import Title I/III tests.
B20 — Decision-maker/resources/reasons missing. Answered boundary; application unresolved. The codified head/designee decision follows consideration of all available program-operating/funding resources and must have written reasons; the published explanation adds its high-level/budget-authority description. C059, C061. Delegation, resource scope, actual consideration and statement. An informal refusal is the prescribed determination. Examine the generic decision-authority text and current official explanation; actual delegations remain held.
B21 — Residual action unknown. Answered boundary; application unresolved. Even when the particular action would cause the stated alteration/burdens, other action avoiding them must preserve benefits/services to the maximum extent possible. C060. Feasible alternatives and their effectiveness/limitations. Denial of one method ends every communication obligation. Read § 35.164’s final sentence together with § 35.160(b), without selecting an actual alternative.
B22 — Charge or personal service assumed. Answered boundary; supporting currentness partial. Required nondiscriminatory measures cannot be surcharged under the republished § 35.130(f); the separate § 35.135 personal-device/service boundary remains. C037, C062. Whether the measure is required; its program/personal character; supporting-section currentness after the accessible republication. All assistance is free professional representation, or every personal device is a required aid. Reopen the complete current §§ 35.130(f), 35.135 through ordinary public access.
B23 — Regarded-as or exclusion issue. Answered boundary; application unresolved. Preserve the applicable prong, objective transitory-and-minor exception, sole-regarded-as modification limitation and every relevant exclusion qualification. C021–C030. Actual predicates and any indispensable later interpretation. A duration, identity label, diagnosis label or history alone determines coverage or liability. Read the precise § 12102/§ 12210/§ 12211 clause and § 35.108 subdivision implicated; no patient or case query.
B24 — Current source inaccessible. Partial. An access failure establishes a source-access limitation only. A historical/republication alternative must retain its own date and legal status. C075–C076. Unread current supporting bodies or original enactment pages. Failure proves repeal, no protection, withdrawal or a technical quota. Retry the exact public original through ordinary access, or identify a clearly dated official publication; no gate workaround.
B25 — History/cross-reference transition incomplete. Partial. Current compilation, actual amendment, historical republication and unresolved reference alignment are separate evidence states. C011, C067–C076. Rail recodification chain; original 1990 pages; later amendment/judicial chain. A host timestamp or source credit proves the whole legal history. Read the exact enacted renumbering or amendment/date clause implicated by the discrepancy; no opinion/docket inquiry in this pass.
B26 — Other title, web or language-access regime. Excluded beyond boundary. The selected communication duty does not complete separate private-entity, employment, technical-web, translation or other access regimes. C004, C065, C078. Separate jurisdiction, actor, activity and governing authority. All access barriers use the same test, or exclusion from this selected component means no other protection. Generic next leads: 28 CFR § 36.303; 42 USC §§ 12111–12117; Part 35 Subpart H; 29 USC § 794; 42 USC § 2000d, as appropriate to a separately authorized category.
B27 — Actual remedy or financial outcome. Unresolved/excluded. Definition, communication duty and remedy are distinct; § 12133’s incorporated remedy chain and substantive financial/benefit law remain separate. C007, C009, C066, C078. Every actual qualification, act, decision, obligation, jurisdiction and remedy predicate. Accessible communication proves cancellation, immunity from collection, damages, approval or permission to ignore notices. Read the narrow generic remedy or substantive program provision in a separately scoped pass; no actual record or action.
B28 — Companion treated as representative. Answered boundary; application unresolved. Companion status concerns an appropriate communication participant; it does not itself establish agency, consent, privilege, disclosure authority or power to make decisions. C039, C044. Separate representation/confidentiality authority and all actual facts. Family/friend/associate status creates universal authority over legal, medical or financial decisions. Identify the exact generic representation/confidentiality authority only if indispensable to a later component.

L15 — Citation/format bounds HTML, parsed PDF, current compilation and historical republication Different access forms and pagination systems encountered. Related formats are grouped; parsed text is not described as pixels; no unseen whole-source or whole-regime read.

9. Remaining gaps

Gap Why it remains open Exact bounded next inquiry
Original 1990 enacted-page authentication Original selected Statutes at Large pages did not become readable. Current OLRC notes and the complete clause in a government-hosted compilation were available, with their own statuses. Ordinary access to P.L. 101-336 §§ 201–205 in the original official publication; no change to the presently recorded failure.
Current supporting §§ 35.130(f), 35.131 and 35.135 access Their direct eCFR openings failed; DOJ’s accessible integrated text was read instead. Reopen the exact current public bodies without bypassing the access gate; compare any actual changes with the recorded republication.
Rail-reference alignment Current statutory/regulatory wording uses references from different codification stages. Trace the exact enacted recodification and renumbering clauses associated with § 12131(1)(C) and § 24102, without investigating an actual entity.
Emergency availability wording The short guide adds a qualification word not present in the exact codified emergency clause. Any current generic official clarification specifically addressing that wording; no hypothetical factual resolution or actual case search.
Complete later-law and judicial chain Current compilation labels and selected adoption instruments are not exhaustive subsequent-law or judicial-status proof. Only materially necessary later public enactments, final corrections or generic official interpretations; judicial/case investigation remains outside this pass.
Broader disability and incorporated regimes Complete definitions were read, but not every controlled-substance, territorial, transportation, federal-agency or remedies regime they reference. The exact indispensable incorporated clause, if a later bounded question makes it necessary.
Every actual application No entity, qualification, disability, communication, request, aid, emergency, resource, decision or financial fact exists in this record. No generic source reading can manufacture those facts. They remain held rather than requested or invented.
Downstream legal and financial effects Communication access does not supply the separate substantive law or facts for benefits, representation, remedies, debt or protected-fund outcomes. A separately authorized public-law component using the precise authority for that generic issue.

10. Researcher self-check — not independent review

Check Result
Independent foundation Earlier R032/R040/R049/R072/R074/R076 or other reports were not used as premises or source evidence.
Selected current bodies Complete displayed §§ 35.160–35.164 and §§ 12131–12134 read; actual organization verified.
Necessary definitions Complete selected disability, aid, participant and material incorporated definition clauses read; unexamined regimes expressly held.
Exceptions Adult and minor routes separated; all cumulative conditions preserved; no invented age cutoff.
Primary consideration Regulation, published explanation, equally effective alternative and § 35.164 exception distinguished.

R078-P1-C001The selected range contains five operative-text sections: General; Telecommunications; Telephone emergency services; Information and signage; Duties. Section 35.160 contains paragraphs (a)–(d). No selected section is reserved.S001, §§ 35.160–35.164 and adjacent reserved label. This is an organization/read finding, not certification of every later legal development.
R078-P1-C002Currentness displayed by the opened sources is October 23, 2026 for eCFR Title 28 and P.L. 119-134/October 20, 2026 for OLRC. The separate September 30, 2026 eCFR label concerns Title 28 generally.S001–S009, displayed headers. A title-wide amendment date does not identify an amendment to these selected sections.
R078-P1-C003Section 12134(a) directs the Attorney General to issue accessible-format implementing regulations, historically within one year after enactment, excluding matters assigned there to the Secretary of Transportation. Section 12205a expressly includes authority to implement ADA disability/additional definitions and construction rules consistently with ADAAA.S003, § 12134(a); S006, § 12205a. General administrative authority citations were observed, but no particular official’s delegation was adjudicated. uscode.house.gov +1
R078-P1-C004Part 35 implements Title II, Subtitle A, and applies to services, programs, and activities provided or made available by public entities. Section 35.102(b) excludes the public-transportation services covered by Subtitle B from this part’s application.S002, §§ 35.101–35.102. The selected text does not supply a universal definition making every financially connected, licensed, funded, or contracted private activity a public-entity activity.
R078-P1-C005The public-entity definition covers State/local governments; their departments, agencies, special-purpose districts and other instrumentalities; and the expressly specified passenger-rail/commuter-authority category.S003, § 12131(1)(A)–(C); S002, § 35.104, “Public entity.” No actual institution is classified here.
R078-P1-C006The statutory State definition enumerates the States, District of Columbia, Puerto Rico, Guam, American Samoa, U.S. Virgin Islands, the Trust Territory of the Pacific Islands, and Northern Mariana Islands.S004, § 12103(2); S002, § 35.104. This reports the statutory wording; it does not resolve present territorial succession, tribal status, or foreign-law coverage.
R078-P1-C007A qualified individual with a disability must meet the service/program/activity’s essential eligibility requirements, with or without the specified modifications, barrier removal, or auxiliary aids/services.S003, § 12131(2); S002, § 35.104. Disability status and communication need do not themselves establish underlying eligibility.
R078-P1-C008Subject to Title II’s provisions, § 12132 prohibits excluding a qualified individual from participation, denying public-entity service/program/activity benefits, or subjecting the individual to discrimination by reason of disability.S003, complete § 12132. No actual exclusion, causation, qualification, or violation is established.
R078-P1-C009Section 12133 incorporates the remedies, procedures, and rights in 29 USC § 794a for an allegation of discrimination violating § 12132.S003, complete § 12133. The incorporated remedies chain, standing, exhaustion, immunity, damages, and enforcement outcome are not resolved.
R078-P1-C010Section 12134(b) uses Part 39 regulations/analysis as the consistency reference for communications and existing-facility program accessibility; other specified regulations use Part 41’s referenced historical coordination rules. Subsection (c) separately addresses facility/vehicle standards, with its Subtitle B exclusion and Access Board reference.S003, § 12134(b)–(c); S009, § 39.160. These are distinct statutory instructions, not permission to replace Part 35’s actual communication language with another regime.
R078-P1-C011The selected public-entity texts contain differently expressed rail cross-references. Current § 12131(1)(C) displays a § 24102(4) reference and an explanatory note; the current commuter-authority definition appears at § 24102(2). The regulation retains the older Rail Passenger Service Act reference.S003, § 12131(1)(C) and reference note; S007, § 24102(2)–(3); S002, § 35.104. The full enacted alignment chain and any transportation application remain unresolved.
R078-P1-C012Disability has alternative actual-impairment, record-of-impairment, and regarded-as routes. The definition is construed broadly to the maximum extent permitted by the ADA; these routes are not interchangeable for every requested consequence.S004, § 12102(1), (3)–(4); S002, § 35.108(a).
R078-P1-C013The regulatory impairment definition includes physiological disorders/conditions, cosmetic disfigurement or anatomical loss affecting the specified kinds of body systems, and mental/psychological disorders. Its disease/condition examples are nonexclusive.S002, § 35.108(b)(1)–(2). The examples do not authorize a diagnosis or establish an actual individual’s facts.
R078-P1-C014Major life activities include, nonexclusively, seeing, hearing, speaking, reading, writing, communicating and other listed activities, plus major bodily functions and individual-organ operation. “Major” is not a demanding central-importance-to-daily-life test.S004, § 12102(2); S002, § 35.108(c). The regulation’s examples are more detailed than the statute’s nonexclusive list.
R078-P1-C015Substantial limitation is assessed broadly against most people in the general population. Prevention or severe/significant restriction is unnecessary; not every impairment qualifies. Assessment remains individualized, ordinarily without demanding scientific, medical, or statistical comparison evidence, though such evidence is not prohibited.S002, § 35.108(d)(1)(i)–(vii). No individualized assessment is performed here.
R078-P1-C016Limitation of one major life activity can suffice. An episodic or remitting impairment is assessed when active. Effects lasting less than six months can qualify under actual-disability or record-of routes; the regarded-as duration exclusion is not a minimum-duration requirement for those routes.S004, § 12102(4)(C)–(D); S002, § 35.108(d)(1)(iii)–(iv), (ix).
R078-P1-C017Ameliorative effects of mitigating measures generally are disregarded in the substantial-limitation inquiry. Ordinary eyeglasses/contact lenses are the express exception: their ameliorative effects are considered. They mean lenses intended fully to correct acuity or eliminate refractive error; low-vision devices instead magnify, enhance, or augment an image.S004, § 12102(4)(E); S002, § 35.108(d)(1)(viii), (d)(4). No treatment or device recommendation follows.
R078-P1-C018Appropriate assessment can consider condition, manner, duration, effort, pain, time, bodily-function effects, and non-ameliorative treatment effects. The focus is limitation of activity, not achievement alone; extensive assessment of every factor often is unnecessary.S002, § 35.108(d)(3)(i)–(iv). No academic, medical, or functional history is invented.
R078-P1-C019The predictable-assessment examples connect deafness/hearing; blindness/seeing; intellectual disability, autism and cerebral palsy/brain function; specified limb or mobility impairments/musculoskeletal function; cancer/cell growth; diabetes/endocrine function; specified neurological conditions/neurological function; HIV/immune function; and listed mental/brain conditions/brain function. The regulation describes these assessments as ordinarily straightforward and does not replace the necessary factual predicates.S002, § 35.108(d)(2)(i)–(iii)(A)–(K). These are the regulation’s generic categories, not actual diagnoses or a screening instrument.
R078-P1-C020Record-of coverage includes a history of, or misclassification as having, a substantially limiting impairment, applying the stated broad-construction principles. A related, needed reasonable modification may be available for a past disability.S002, § 35.108(e)(1)–(3). No record, need, or modification entitlement is established.
R078-P1-C021Regarded-as coverage concerns a prohibited action because of an actual or perceived impairment, without requiring that it limit or be perceived to limit a major life activity.S004, § 12102(3)(A); S002, § 35.108(f)(1). The remaining exception and liability qualification must also be retained.
R078-P1-C022The regarded-as exclusion requires the impairment to be both transitory and minor. Transitory means an actual or expected duration of six months or less. Under the regulation, the entity must demonstrate those characteristics objectively; its subjective belief is insufficient.S004, § 12102(3)(B); S002, § 35.108(f)(2). Duration alone does not establish the combined exception.
R078-P1-C023Establishing regarded-as coverage alone does not establish liability; the regulatory text separately requires proof of discrimination within Title II.S002, § 35.108(f)(3). This is a definition-versus-violation boundary.
R078-P1-C024A person meeting the disability definition solely through the regarded-as route is not entitled on that basis to the reasonable accommodation/modification described by § 12201(h); § 35.130(b)(7)(ii) addresses reasonable modification.S006, § 12201(h); S010, § 35.130(b)(7); S016, instruction 5. This is not converted into a categorical resolution of every auxiliary-aid question.
R078-P1-C025The selected statutory/regulatory text excludes homosexuality and bisexuality as impairments and separately lists transvestism, transsexualism, pedophilia, exhibitionism, voyeurism, gender-identity disorders not resulting from physical impairments, and other sexual-behavior disorders.S005, § 12211(a), (b)(1); S002, § 35.108(b)(3), (g)(1). Exact qualifications are retained; no conclusion about an identity, diagnosis, person, or later judicial treatment is made.
R078-P1-C026Other listed exclusions are compulsive gambling, kleptomania, pyromania, and psychoactive-substance-use disorders resulting from current illegal use of drugs.S005, § 12211(b)(2)–(3); S002, § 35.108(g)(2)–(3). C027–C030 preserve the related limitations and exceptions.
R078-P1-C027The current-illegal-use exclusion is tied to action on the basis of that use. The statute preserves the specified successful-rehabilitation/no-current-use, supervised-rehabilitation/no-current-use, and erroneous-perception/no-use categories.S005, § 12210(a)–(b); S002, § 35.104; S010, § 35.131(a). No blanket exclusion of every person with a history of addiction follows.
R078-P1-C028Illegal-use terminology incorporates controlled-substance law and excludes supervised professional use and other federally authorized uses. The regulation’s “current” formulation asks whether use was recent enough to justify the stated reasonable belief; it supplies no fixed number of days.S005, § 12210(d); S002, § 35.104. Substance schedules and actual legality remain held.
R078-P1-C029Otherwise-entitled health or drug-rehabilitation services cannot be denied on the stated current-use ground under § 12210(c). The DOJ regulatory text separately permits a rehabilitation/treatment program to deny participation for illegal use while in the program.S005, § 12210(c); S010, § 35.131(b)(1)–(2). Underlying entitlement and program facts remain absent.
R078-P1-C030The selected text preserves specified reasonable policies/procedures aimed at determining whether former use has ceased, while expressly declining to encourage, prohibit, restrict, or authorize drug testing itself.S005, § 12210(b), concluding clause; S010, § 35.131(c). No testing authority or recommendation is inferred.

R078-P1-C037DOJ’s § 35.135 text distinguishes required access measures from personal devices, individually prescribed devices, readers for personal use/study, and specified personal services that Part 35 does not require.S010, complete § 35.135. Current eCFR access to this supporting section failed; the republication’s currentness limit remains visible. It does not negate necessary program-related communication aids under § 35.160.
R078-P1-C038Public entities must take appropriate steps so communications with applicants, participants, members of the public and companions with disabilities are as effective as communications with others.S001, § 35.160(a)(1). This is a comparative communication duty, not a promised substantive outcome.
R078-P1-C039A companion is a family member, friend or associate of someone seeking public-service/program/activity access who, along with that individual, is an appropriate person for the entity to communicate with. DOJ’s analysis explains that the companion’s communication protection does not require the underlying participant also to have a disability or always to be physically present.S001, § 35.160(a)(2); S010, 2010 § 35.160 analysis, companion discussion. The definition does not establish representative authority or permission to disclose otherwise protected information.
R078-P1-C040Appropriate auxiliary aids/services must be furnished where necessary to provide individuals with disabilities, including the specified participant categories, equal opportunity to participate in and enjoy the public service/program/activity’s benefits.S001, § 35.160(b)(1). Necessity and appropriateness remain distinct from underlying eligibility and preferred outcome.
R078-P1-C041The necessary aid varies with the individual’s communication method and the communication’s nature, length, complexity, and context.S001, § 35.160(b)(2), first sentence. No universal device or interpreter rule is inferred from a disability label.
R078-P1-C042The entity must give primary consideration to requests of individuals with disabilities when determining necessary aids/services.S001, § 35.160(b)(2). Primary consideration is more than disregarding the request, but the text does not guarantee every requested method.
R078-P1-C043DOJ’s published explanation says the choice is to be honored unless the entity demonstrates another effective means or establishes that the chosen means is not required under § 35.164.S010, 1991 and 2010 § 35.160 analyses; S011, Title II choice discussion. A demonstrated equally effective alternative and a § 35.164 exception are different routes; not every method decision is automatically a burden determination.
R078-P1-C044To be effective, aids/services must use accessible formats, arrive in a timely manner, and protect the individual’s privacy and independence.S001, § 35.160(b)(2), final sentence. These conditions remain relevant when an alternative method is used.
R078-P1-C045An entity may not require an individual with a disability to bring another individual to interpret.S001, § 35.160(c)(1). This is separate from the limited circumstances permitting reliance on an accompanying person.
R078-P1-C046Outside the emergency route, reliance on an accompanying adult requires all three: the individual specifically requests that assistance; the adult agrees; and reliance is appropriate under the circumstances.S001, § 35.160(c)(2)(ii). Accompaniment, relationship, availability, or agreement alone is insufficient.
R078-P1-C047The adult emergency route requires an emergency involving an imminent threat to the safety or welfare of an individual or the public, with no interpreter available.S001, § 35.160(c)(2)(i). The regulation does not say that every interaction in an emergency-service setting meets this test.
R078-P1-C048Reliance on a minor child is prohibited except for the same stated imminent-threat/no-interpreter emergency condition. There is no parallel ordinary-request/agreement exception for a minor child in this section.S001, § 35.160(c)(3). No numerical age definition is supplied in the selected communication text.
R078-P1-C049DOJ’s 2010 explanation requires freely and voluntarily provided consent in the ordinary adult route, rejects coercion, and describes the emergency route narrowly as genuinely exigent circumstances, rather than typical foreseeable operational emergencies. It also distinguishes situations where an interpreter is not otherwise necessary.S010, 2010 § 35.160 analysis, accompanying-adult/child and emergency discussions. This is official explanation of the rule, not a new actual-emergency finding.
R078-P1-C050When qualified interpreters are provided through VRI, all specified conditions apply: real-time full-motion video/audio over the stated quality connection without listed image/communication defects; a sufficiently large, sharply defined image showing both participants’ specified facial/upper-body features regardless of body position; clear audible voices; and adequate user/involved-person training for quick, efficient setup and operation.S001, § 35.160(d)(1)–(4); S013, instruction 12. No fixed bandwidth, frame rate, screen dimension or latency number is supplied.
R078-P1-C051Where the entity communicates by telephone with applicants and beneficiaries, it must use TTYs or equally effective telecommunications systems for individuals who are deaf, hard of hearing, or have speech impairments.S001, § 35.161(a). The rule does not require one identical device for every context.
R078-P1-C052An automated-attendant or interactive-voice-response system receiving/directing incoming calls must permit effective real-time communication with auxiliary-aid users, including TTYs and all forms of FCC-approved relay, including Internet-based relay.S001, § 35.161(b). No actual system, technical compatibility, or FCC approval was tested.
R078-P1-C053Calls from a Title IV telecommunications relay service must receive a response in the same manner as other telephone calls.S001, § 35.161(c). This is not a finding about a particular relay provider or call.
R078-P1-C054Section 225 defines TDD through graphic coded-signal communication and defines relay services through telephone transmission enabling the specified disability categories to communicate with others in a functionally equivalent manner to the identified voice-communication comparator.S008, § 225(a)(2)–(3). Broader FCC operating, fee, privacy, and enforcement rules are held.
R078-P1-C055Telephone emergency services, including 911, must provide direct access for TDD and computer-modem users. DOJ’s published analysis distinguishes direct access from access through a third party or relay.S001, § 35.162; S010, 1991 § 35.162 analysis. This does not establish a universal text-message-to-emergency-service rule or a complete technical standard.
R078-P1-C056Interested persons, including those with impaired vision or hearing, must be able to obtain information about the existence and location of accessible services, activities and facilities.S001, § 35.163(a). Providing information is distinct from proving all underlying facilities satisfy applicable physical standards.
R078-P1-C057Signage is required at all inaccessible entrances to each facility, directing users to an accessible entrance or a location supplying accessible-facility information. The accessibility symbol is required at each accessible entrance.S001, § 35.163(b). No actual entrance or sign was inspected; technical design standards remain separate.
R078-P1-C058Section 35.164 limits required actions only where the entity can demonstrate fundamental alteration of the service/program/activity or undue financial and administrative burdens. The entity bears the proof burden when its personnel assert those grounds.S001, § 35.164, first and second sentences. A cost assertion or staff preference is not itself the prescribed demonstration.
R078-P1-C059That decision must be made by the head of the public entity or designee, after considering all resources available for funding and operating the service/program/activity, and accompanied by written reasons.S001, § 35.164, third sentence. The resource qualifier is retained; no actual resource universe, delegation or written decision is established.
R078-P1-C060If the specified action would cause such alteration or burdens, the entity must take other action avoiding those consequences while ensuring, to the maximum extent possible, receipt of its benefits/services by individuals with disabilities.S001, § 35.164, final sentence. The exception does not erase the residual duty.
R078-P1-C061DOJ’s published burden explanation identifies a high-level official, no lower than a department head, with budgetary/spending responsibility. The § 35.164 explanation expressly incorporates that § 35.150(a) discussion.S010, 1991 analyses of §§ 35.150(a), 35.164; S011, Title II limitations discussion. This explains the regulation’s head/designee language; the explanatory wording is not silently substituted for the codified sentence.
R078-P1-C062DOJ’s § 35.130(f) text prohibits a surcharge on the particular individual or disability group to cover measures required for the ADA’s nondiscriminatory treatment, including required auxiliary aids.S010, complete § 35.130(f). This does not promise all professional services, all requested measures, or representation without charge. Supporting-section current-access limitation remains.
R078-P1-C063Part 39’s comparator uses agency/Attorney General language and a primary-entrance signage formulation; Part 35 uses its own public-entity decision-maker and all/each entrance wording.S009, § 39.160(c)–(d); S001, §§ 35.163–35.164. The texts were compared, not assumed identical.
R078-P1-C064The short DOJ guide describes emergency accompanying-interpreter situations using no qualified interpreter available; the codified § 35.160(c)(2)(i)/(3) says no interpreter available.S011, accompanying-adult/child discussion; S001, exact clauses. The difference is preserved. This pass does not decide a hypothetical case involving an available but unqualified person.

R078-P1-C065The selected construction provisions preserve equal or greater protections under other federal/State/local law and identify a Rehabilitation Act standards relationship.S002, § 35.103; S006, § 12201(a)–(b). No universal preemption or complete interaction finding follows.
R078-P1-C066Section 12201(e) expressly leaves standards for workers’ compensation and State/federal disability-benefit eligibility unchanged. The selected communication provisions likewise do not themselves determine an actual service award or legal/financial result.S006, § 12201(e); S003, § 12131(2); S001, §§ 35.160–35.164. Debt, tax, credit, collection and bankruptcy consequences remain outside this investigation.
R078-P1-C067The original Title II Subtitle A effective clause distinguishes an 18-month-after-enactment general trigger from immediate-on-enactment effectiveness for § 204, the regulation-making section.S003, effective-date notes; S017, complete reproduced § 205(a)–(b). The original Statutes at Large pages were not successfully read; no original-publication authentication is claimed.
R078-P1-C068The archived 1991 final rule identifies publication on July 26, 1991, effectiveness on January 26, 1992, and its historical replacement boundary beginning March 15, 2011.S012, header and original selected bodies. Historical text does not displace current S001.
R078-P1-C069The 2010 final rule’s selected instructions revise § 35.160(a)/(b), add (c)/(d), revise § 35.161, and update specified aid/interpreter definitions. Its stated effective date is March 15, 2011.S013, DATES and instructions 2, 12–13. No different physical-design compliance period is transposed to these communication clauses.
R078-P1-C070The complete 2011 correction was published March 11, 2011, effective March 15, 2011. Its enumerated corrections do not alter §§ 35.160–35.164.S014, DATES and instructions 1–10. This checks a source-credit lead, not every later correction.
R078-P1-C071ADAAA’s selected enacted clauses change disability definitions/construction and related authority, with effectiveness on January 1, 2009.S015, §§ 2, 4, 6(a), 8. Enactment was September 25, 2008.
R078-P1-C072DOJ’s 2016 final rule installs the current § 35.108 structure and related Part 35 changes, effective October 11, 2016.S016, DATES and Part 35 instructions 1–5. Publication was August 11, 2016.
R078-P1-C073The DOJ effective-communication guide displays original issuance January 1, 2014, update February 28, 2020, and an express nonbinding status statement.S011, date/status statements. Its explanatory text does not create independent enforceable duties beyond applicable law.
R078-P1-C074The guide discusses reasonable advance notice based on time needed to obtain aids, rejects excessive notice requirements, and addresses walk-in requests to the extent possible.S011, operational guidance. No fixed notice or provision deadline is supplied; this explanation is not converted into a universal prerequisite to the codified duty.
R078-P1-C075Successful current-body access, historical adoption access, failed supporting endpoints and unexamined later history are different evidence states. The record establishes selected displayed texts, not absence of later law, repeal, withdrawal, judicial invalidation or a complete legal-status chain.S001–S017 and failure log. This is a research-status limitation.
R078-P1-C076The readable COMPS-803 alternative identifies its amended-through law and production date but expressly disclaims being an official statutory version.S017, printed p. 1/index 0. It supports the bounded reading of reproduced §§ 201–205; it does not cure original-publication access failure.
R078-P1-C077The selected communication text supplies no numerical minor/adult age, fixed aid-delivery deadline, standard cost percentage, universal resource amount, or fixed VRI bandwidth/frame-rate/latency specification.S001, complete selected bodies. This is a limited negative-text finding, not a statement that no other applicable authority could supply a standard.
R078-P1-C078Broader modification, private-entity, employment, education, language-access, technical-web, physical-access, enforcement and financial regimes require their own authorities and facts.Scope boundary supported by S003, §§ 12131–12134; S002, §§ 35.102–35.103; S006, § 12201; exact next-authority pointers below. B10 — Privacy/independence unknown. Answered boundary; application unresolved.Effective provision must protect both privacy and independence. C044; S001.Method, disclosure context, independence implications and separate confidentiality authority.Convenience, accompaniment or information access authorizes disclosure or representative control.Compare § 35.160(b)(2) with the exact separate confidentiality authority if indispensable; no records or consents.
B11 — Accompanying adult, ordinary setting. Answered boundary; application unresolved.Specific individual request and adult agreement and appropriateness are required; the published explanation rejects coercion. C045–C046, C049.Each separate predicate and context.Relationship or willingness alone allows reliance, or the entity can require the individual to bring help.Read § 35.160(c)(1), (c)(2)(ii) and the voluntary-assistance analysis together.
B12 — Accompanying minor. Answered boundary; application unresolved.Minor-child reliance is barred except for the stated emergency/imminent-threat/no-interpreter conditions. No ordinary requested-assistance route is stated. C048.Legal category and every emergency predicate; numerical age definition absent here.Adult-rule consent conditions can be transferred to children.Read § 35.160(c)(3); investigate a generic age-definition authority only if that narrow interpretive issue becomes necessary.
B13 — Emergency condition asserted. Answered boundary; application unresolved. The relevant adult/minor exception requires the specified imminent safety/welfare threat and interpreter unavailability; the explanation rejects treating ordinary foreseeable operations as sufficient. C047–C049, C064.Threat, urgency, availability and meaning of the guide/regulation wording difference. An emergency-service label automatically excuses ordinary communication duties.Review the complete § 35.160(c) analysis and any later official generic clarification of the availability wording; no incident or case inquiry.
B14 — VRI proposed or assumed. Answered boundary; application unresolved.Qualified interpretation, necessary/effective method selection, timely/privacy/independence conditions, and all four VRI performance clauses must coexist. C034, C036, C040–C044, C050.All operational and contextual facts; no technical specifications tested.A video connection or available equipment establishes effective communication.Read § 35.160(d) with § 35.104; any technical-standard investigation would require separate scope.
B15 — Ordinary telephone/automated/relay category. Answered boundary; application unresolved.Apply the correct § 35.161 paragraph: effective telephone means, accessible real-time automated handling, and same-manner relay response have distinct predicates. C051–C054.System function, user method, service category and FCC approval.Any telephone system or relay label satisfies all three paragraphs.Read § 35.161(a)–(c), then only the indispensable generic clause of 47 USC § 225 or 47 CFR Part 64, Subpart F.
B16 — Emergency telephone access. Answered boundary; application unresolved.Telephone emergency services must provide the specified direct TDD/modem access; ordinary relay access is not simply substituted for direct access. C055.Actual service/technology and any separately applicable technical authority.A universal text-to-emergency-service requirement or response time is proved here.Examine § 35.162 and its direct-access analysis; hold new technical emergency-communications standards for a separate pass.
B17 — Information and signage. Answered boundary; application unresolved.Supply accessible-service existence/location information, all-inaccessible-entrance directions and each-accessible-entrance symbols as the separate clauses require. C056–C057.Facility/entrance facts and separate technical sign standards.Information or a symbol proves complete building accessibility.Read § 35.163; next inspect only necessary public design/program-access provisions in §§ 35.149–35.151 if separately authorized.
B18 — Fundamental alteration asserted. Answered boundary; application unresolved.Entity demonstration, prescribed decision-maker/resource consideration/written reasons, and residual action all remain necessary under § 35.164. C058–C060.Nature of alteration, proof, authority, resources, reasons and alternatives.Staff disagreement or any program change is a complete defense.Read all sentences of § 35.164 and the incorporated burden explanation; no program-specific decision.
B19 — Financial/administrative burdens asserted. Answered boundary; application unresolved.Use Title II’s own financial-and-administrative-burdens formulation, complete resource base and decision procedure. C058–C061.Available resources, asserted burden, decision and alternatives.Cost, absence of a budget line, or another ADA title’s hardship test alone establishes an exception.Compare § 35.164 with its published § 35.150(a) explanation; do not import Title I/III tests.
B20 — Decision-maker/resources/reasons missing. Answered boundary; application unresolved. The codified head/designee decision follows consideration of all available program-operating/funding resources and must have written reasons; the published explanation adds its high-level/budget-authority description. C059, C061.Delegation, resource scope, actual consideration and statement. An informal refusal is the prescribed determination.Examine the generic decision-authority text and current official explanation; actual delegations remain held.
B21 — Residual action unknown. Answered boundary; application unresolved.Even when the particular action would cause the stated alteration/burdens, other action avoiding them must preserve benefits/services to the maximum extent possible. C060.Feasible alternatives and their effectiveness/limitations.Denial of one method ends every communication obligation.Read § 35.164’s final sentence together with § 35.160(b), without selecting an actual alternative.
B22 — Charge or personal service assumed. Answered boundary; supporting currentness partial.Required nondiscriminatory measures cannot be surcharged under the republished § 35.130(f); the separate § 35.135 personal-device/service boundary remains. C037, C062.Whether the measure is required; its program/personal character; supporting-section currentness after the accessible republication. All assistance is free professional representation, or every personal device is a required aid.Reopen the complete current §§ 35.130(f), 35.135 through ordinary public access.
B23 — Regarded-as or exclusion issue. Answered boundary; application unresolved.Preserve the applicable prong, objective transitory-and-minor exception, sole-regarded-as modification limitation and every relevant exclusion qualification. C021–C030.Actual predicates and any indispensable later interpretation.A duration, identity label, diagnosis label or history alone determines coverage or liability.Read the precise § 12102/§ 12210/§ 12211 clause and § 35.108 subdivision implicated; no patient or case query.
B24 — Current source inaccessible. Partial. An access failure establishes a source-access limitation only. A historical/republication alternative must retain its own date and legal status. C075–C076.Unread current supporting bodies or original enactment pages.Failure proves repeal, no protection, withdrawal or a technical quota.Retry the exact public original through ordinary access, or identify a clearly dated official publication; no gate workaround.
B25 — History/cross-reference transition incomplete. Partial.Current compilation, actual amendment, historical republication and unresolved reference alignment are separate evidence states. C011, C067–C076.Rail recodification chain; original 1990 pages; later amendment/judicial chain.A host timestamp or source credit proves the whole legal history.Read the exact enacted renumbering or amendment/date clause implicated by the discrepancy; no opinion/docket inquiry in this pass.
B26 — Other title, web or language-access regime. Excluded beyond boundary. The selected communication duty does not complete separate private-entity, employment, technical-web, translation or other access regimes. C004, C065, C078.Separate jurisdiction, actor, activity and governing authority. All access barriers use the same test, or exclusion from this selected component means no other protection.Generic next leads: 28 CFR § 36.303; 42 USC §§ 12111–12117; Part 35 Subpart H; 29 USC § 794; 42 USC § 2000d, as appropriate to a separately authorized category.
B27 — Actual remedy or financial outcome. Unresolved/excluded.Definition, communication duty and remedy are distinct; § 12133’s incorporated remedy chain and substantive financial/benefit law remain separate. C007, C009, C066, C078.Every actual qualification, act, decision, obligation, jurisdiction and remedy predicate.Accessible communication proves cancellation, immunity from collection, damages, approval or permission to ignore notices.Read the narrow generic remedy or substantive program provision in a separately scoped pass; no actual record or action.
B28 — Companion treated as representative. Answered boundary; application unresolved.Companion status concerns an appropriate communication participant; it does not itself establish agency, consent, privilege, disclosure authority or power to make decisions. C039, C044.Separate representation/confidentiality authority and all actual facts.Family/friend/associate status creates universal authority over legal, medical or financial decisions.Identify the exact generic representation/confidentiality authority only if indispensable to a later component.
