R050 PASS-01 — California settlement judgment entry, retained jurisdiction, and settlement/dismissal administration
Current-original verification remains incomplete. During the actual check on October 27, 2026, America/Los_Angeles, retrieval of the official California Code of Civil Procedure § 664.6 page and the official rule 3.1385 page repeatedly returned 403 access errors. I obtained and read complete reproductions of those provisions, the reproduced chaptered 2026 amendment, selected historical amendment provisions, and the necessary boundary texts identified below. I also read the Judicial Council’s accessible official rulemaking record. The reproductions are not presented as verified current official originals, and the original-access failures remain unresolved.
No conclusion from R036, R039, R037, R049, or R001/S_CA supplies a premise here. No actual or fictional litigation facts are supplied or inferred.
Reading and status conventions
Throughout this report:
- S001, for example, means R050-P1-S001; C001 means R050-P1-C001.
- T — reproduced text: the specified legal text was read in full within the stated bounds on an accessible alternate publisher. Its current official original was not verified. A T finding is a conditional reading of that text, subject to that limitation.
- P — official record read: an official publication or administrative record was accessible and read within the stated bounds. This does not authenticate a different, inaccessible instrument.
- U — unresolved: the required original, interpretive authority, or predicate is absent.
- H — held: the issue lies outside this pass or requires facts or records that must remain unexamined.
All substantive readings of § 664.6 and rule 3.1385 below carry T status. The official rulemaking-record findings carry P status only for what that record actually reports.
No PDF was successfully opened as a readable document or visually inspected. Consequently, no printed-page or zero-based PDF-index verification is claimed. HTML provision locators are used where the legal body was actually read.
1. Substantive findings
1.1 The version issue changes the analysis
The accessible reproduction of AB 1908, chapter 907, Statutes of 2026, reports approval and filing on September 30, 2026. Its section 1 reproduces § 664.6 through subdivision (h), and section 2 declares immediate effectiveness as an urgency statute. The reproduced subdivision (h) addresses specified settlements of tort claims against a statutorily defined local public entity, including circumstances in which a civil action has not been filed or has been voluntarily withdrawn.
That provision prevents a universal statement that every agreement considered under § 664.6 must have been made while litigation was pending. The ordinary route in subdivision (a) expressly begins with pending litigation; the distinct route in reproduced subdivision (h) has its own cumulative conditions and contemplates enforcement in a subsequent action. The official chapter and current code body were inaccessible, so this reported 2026 change remains subject to the original-verification gap. C002, C007–C013, C032–C036; S001–S002. LegiScan+1
The historical text also matters. The reproduced 2023 AB 1756, chapter 478, § 12 contained the older retention sentence based on a request by the parties and expressly repealed that version on January 1, 2025. Section 13 supplied a replacement version operative January 1, 2025, with a stipulated-dismissal/retention route, a court-initiated conditional-settlement process, and additional postdismissal provisions. It would be unsafe to use the older retention sentence as the complete modern provision. Only the stated portions of that omnibus enactment were read; its entire enactment and amendment history were not audited. C003–C004; S003. LegiScan
For rule 3.1385, the reproduced body carries a July 1, 2013 amendment notation, while the accessible official Judicial Council record identifies a passed September 20, 2024 rule/form item recommending advisory comments effective January 1, 2025. Those are different kinds of dates and different components of the publication. The official final amendment PDF could not be read. C005–C006; S007–S008. Court Rules+1
1.2 Section 664.6 contains distinct mechanisms
Under the reproduced subdivision (a), the ordinary judgment-entry route requires parties to pending litigation to stipulate to settlement of the case or part of it, either through the specified signed-writing alternative outside the court’s presence or orally before the court. The court may, upon motion, enter judgment pursuant to the settlement terms. A private agreement, a settlement notice, or an allegation of breach is not itself an entered judgment. The provision does not establish that any particular agreement was formed, that its terms are ascertainable, or that the requested judgment matches them. C007–C011, C068–C071; S001–S002. california.public.law
The second sentence of subdivision (a) describes a separate stipulated route: the settlement parties or their counsel stipulate in writing or orally before the court; the court may dismiss as to the settling parties without prejudice and retain jurisdiction to enforce the settlement until performance in full of its terms. The text gives the court permission to act. It does not establish that a request, agreement, notice, dismissal, or retention order actually exists, and it does not resolve the consequences of every other form of dismissal. C012–C013, C069; S001–S002. LegiScan
Subdivision (e) has a different actor and predicate. After a plaintiff, cross-complainant, or other party seeking affirmative relief files a notice of conditional settlement, the court may, on its own motion and without a stipulation, set an order to show cause concerning dismissal of the entire action without prejudice and retained jurisdiction. That is a provision for a court process; it is not self-executing dismissal upon filing the notice. Its express statutory-category exclusion belongs to subdivision (e), not automatically to all of § 664.6. C021–C025; S001–S002, S005–S006. california.public.law
Subdivision (f) then addresses specified filings after judgment or dismissal without prejudice pursuant to the section. Its permission to file settlement-related documents, its required exercise of retained jurisdiction upon the specified missing-signature notice, its narrow first-appearance-fee protection, and its direction to the clerk to accept properly filed documents do not establish entitlement to the relief sought. C026–C030; S001–S002. LegiScan
1.3 The signature provisions do not eliminate authorization questions
Subdivision (b) is a provision-specific rule about when a writing counts as signed by a party. It covers the party, an attorney representing the party, and a carefully qualified insurer-authorized agent. The insurer route requires both defense and indemnification, written authorization from the insurer, and satisfaction of the exception concerning liability above policy limits. Subdivision (c) removes the attorney and insurer-agent alternatives in its listed proceeding categories; it does not say that the entire section is unavailable in every such proceeding. C014–C018; S001–S002. california.public.law
Subdivision (d) separately addresses an attorney’s lack of the party’s express authorization, professional discipline absent good cause, and available civil remedies. A signer’s statutory category, actual authority, client authorization, assent, authenticity, capacity, and the existence of a binding agreement remain separate questions. The good-cause qualification in the disciplinary provision does not itself establish agreement formation or authorization. C019–C020; S001–S002. LegiScan
1.4 Rule 3.1385 administers settlement notice and dismissal
The reproduced rule’s initial notice trigger is settlement or other disposition of the entire case. Each plaintiff or other party seeking affirmative relief must immediately file written notice and serve the specified recipients. An additional immediate oral-notice duty applies when a hearing, conference, or trial is scheduled within the stated 10-day interval. This differs from § 664.6(a), which expressly accommodates settlement of part of a case. C010, C042–C045; S001, S007. california.public.law+1
The rule’s default dismissal provisions use two different events:
- The party’s stated 45-day period follows the date of settlement.
- The court’s stated 45-day dismissal provision follows the court’s receipt of notice of settlement, subject to its conditions and good cause.
Those events must not be substituted for one another. C048–C049; S007. Court Rules
The conditional-settlement provision is narrower than any agreement containing a condition. It addresses dismissal conditioned on satisfactory completion of specified terms not to be performed within 45 days of settlement, including installment payments. The notice must specify the date by which dismissal is to be filed. The later provisions refer to the dismissal date stated in that notice; they do not establish that the stated date equals actual performance, final payment, approval, or satisfaction. C050–C054; S007. Court Rules
The rule contains material exceptions and qualifications: specified sanctions and good-faith-settlement proceedings need not be vacated; the minor/disability provision conditions the sequencing of a particular order-to-show-cause hearing on appropriate approval papers; and the additional-time provision requires notice, a supporting declaration, a good-cause showing, a proposed alternative date, and the stated five-court-day lead time. Filing a document is not itself a finding of good cause. C055–C061; S007, S014. Court Rules
1.5 Notice, dismissal, judgment, performance, and satisfaction remain separate
The reproduced advisory comments explain that parties using § 664.6 still follow rule 3.1385(a) and (b), and that subdivision (c) supplies an alternative conditional-settlement process where dismissal under § 664.6 is not sought. Separately, rule 3.1390 assigns a notice-of-entry-of-dismissal duty to the party requesting dismissal. None of those texts establishes actual payment, satisfactory performance, entry of a particular judgment, satisfaction of a judgment, or release of a lien or other obligation. C062–C064, C068; S007–S008, S016. Court Rules+2
The precise effect of a particular dismissal on jurisdiction, the necessary timing of a retention request outside the express mechanism, disputed agreement terms, the sufficiency of assent or authority, the meaning of “before the court” in disputed settings, and the availability of another enforcement route remain unresolved here. No controlling judicial-authority investigation was undertaken. C069–C071.

The reproduced (h)(1) concerns a settlement resolving a tort claim against a local public entity where both conditions hold: the civil action has not been filed or was voluntarily withdrawn by the plaintiff; and the claim is eligible for payment from the entity-established victims’ compensation fund or other victim-related financial-assistance program. |
S001 § 664.6(h)(1)(A)–(B); S002 § 1. |
T/U currentness |

The agreement must also expressly state that it is enforceable pursuant to § 664.6; with the stated predicates, the text permits enforcement in a subsequent action under the section. It does not make execution of the agreement itself a judgment. |

The reproduced Civil Rules application provision reaches all superior-court civil cases, including general civil, family, juvenile, and probate cases, unless a statute or California Rule of Court otherwise provides. |
S011 rule 3.10; reproduced adoption history effective January 1, 2007. |
T |
| R050-P1-C038 |
In the rules, subject to context or subject matter, “action” includes special proceeding; “case” includes action or proceeding; civil cases concern the stated protection/enforcement/redress functions and exclude criminal cases and habeas petitions. |
S010 rule 1.6 introductory clause, (1)–(3). |
T |
| R050-P1-C039 |
“General civil case” is narrower than “civil case”: the definition excludes the listed probate/guardianship/conservatorship, juvenile, family, small-claims, unlawful-detainer, and other-civil-petition categories. That narrower label must not silently replace rule 3.10’s language. |
S010 rule 1.6(4)–(5); S011. |
T |
| R050-P1-C040 |
For the rules, subject to the introductory qualification, “party” includes self-represented and attorney-represented persons, and the listed party designations include the attorney of record. This is not a general statutory authorization to settle. |

T |
| R050-P1-C041 |
The reproduced rule-construction provision makes “must” mandatory, “may” permissive, “may not” prohibitory, “will” a future contingency rather than a mandatory duty, and “should” a preference/nonbinding recommendation; standards are described as recommended guidelines or goals. |

T |
| R050-P1-C046 |
Failure to notify an involved arbitrator or court-connected ADR neutral of settlement at least 2 days before its scheduled hearing/session permits the court to order compensation for the scheduled hearing time. It does not make compensation automatic. |
S007 rule 3.1385(a)(2), first sentence. |
T |
| R050-P1-C047 |
Compensation is bounded by the referenced maximum entitlement of the arbitrator under § 1141.18(b), or the neutral’s entitlement for the scheduled session. Section 1141.18(b) supplies compensation-floor units, permits higher superior-court compensation and waiver, and restricts payment before award filing or settlement. It is not a universally fixed compensation ceiling. No monetary amount is calculated here. |

T |
| R050-P1-C049 |
If that request is not made as required, the court must dismiss the entire case 45 days after receiving notice of settlement, unless good cause is shown against dismissal. This is a different trigger from C048. |
S007 rule 3.1385(b), second sentence. |
T |
| R050-P1-C050 |
The conditional route requires dismissal to depend on satisfactory completion of specified terms not to be performed within 45 days of settlement; installment payments are an included example, not an exception to that full predicate. |

“Retention can always be added later,” or “every dismissal necessarily ends all jurisdiction.” |
Check official generic amendment explanations for express timing treatment; retain unresolved judicial questions. Unresolved. |
| B15 — Performance incomplete |
Retention’s stated duration and later nonperformance filings are distinct from conditional-dismissal administration. C013, C027, C050–C052, C059–C061; S001, S007 |
Terms, required performance and completion |
“A notice or expected date proves completion or breach.” |
Compare the public provisions’ separate performance and dismissal predicates. Partial/Unresolved. |
| B16 — Unconditional/default settlement notice |
The default track is subject to the rule’s stated exceptions and separate settlement/receipt triggers. C042–C049; S007 |
Whether the default rather than conditional/special track applies |
“All settlements require the same dismissal event on the same clock.” |
Read the default provision with (c), (d), and (e), preserving each trigger. Partial. |
| B17 — Conditional settlement notice |
Rule (c)(1) requires the full satisfactory-completion and beyond-45-day predicate. C050–C054; S007 |
Nature and timing of specified terms |
“Any condition or any installment arrangement automatically qualifies.” |
Verify the entire conditional definition and its relationship to statutory dismissal with retention. Partial. |
| B18 — Recipient, signature and content |
Rule identifies duty bearers, recipients and conditional-date content; full signature/form requirements remain unverified. C043–C045, C051, C065; S007, S017 |
Complete official form and indispensable signature rules |
“Settlement-signature authority automatically determines the proper notice signer.” |
Read both pages of the current official blank CM-200 and necessary generic signature/form rules, without completing anything. Partial/Unresolved. |
| B19 — Completion/stated dismissal date unknown |
The conditional notice specifies a dismissal-filing date; that is not proof of actual completion. C050–C052; S007 |
Stated date, completion conditions and performance |
“The notice’s date necessarily equals final payment or satisfaction.” |
Examine the rule’s exact date terminology and any official generic explanation of it. Partial/Unresolved. |
| B20 — Trigger and counting unit unknown |
Settlement, court receipt, stated dismissal date and expiration of the request period are distinct triggers; (e) expressly uses court days. C045–C049, C052, C060, C072; S007 |
Counting rules, service effects, holidays and actual event facts |
“Every interval begins at settlement and uses the same unit.” |
A separately bounded generic review could establish applicable counting provisions; no actual calendar follows here. Held for computation. |
| B21 — Scheduled proceeding/trial relationship |
Oral notice, neutral compensation, vacatur and later settings have separate conditions and exceptions. C045–C047, C053–C055; S007, S013 |
Scheduled event, recipient, notice and court action |
“A conditional notice proves every appearance has already been vacated.” |
Compare the specified court duties and express exceptions without examining a calendar. Partial/Unresolved. |
| B22 — Good cause |
Good cause qualifies dismissal provisions and supports the additional-time process; (e) requires the specified notice/declaration. C049, C052, C059–C061; S007 |
Adequate showing and court determination |
“Claiming difficulty automatically extends time.” |
Read official generic explanations of the particular good-cause provision; disputed sufficiency remains held. Unresolved. |
| B23 — Disputed terms or breach |
Judgment must follow settlement terms; later nonperformance filings are permitted; no merits finding is supplied. C011, C027–C028, C071; S001 |
Agreement formation, ascertainable terms, performance and evidentiary rules |
“A motion, notice, or allegation establishes breach or authorizes new terms.” |
Identify what the text expressly authorizes; keep judicial merits and evidence questions unresolved. Unresolved/Held. |
| B24 — Judgment entry versus payment/satisfaction |
The selected mechanisms do not identify judgment entry or dismissal notice as payment or satisfaction. C068; S001, S007, S016 |
Any actual judgment, payment, performance or satisfaction |
“Entry or dismissal proves the obligation has been paid or released.” |
Maintain the public-law distinction; satisfaction and release law remain a separate held component. Held. |
| B25 — Statewide versus local procedure |
Broad civil-rule application and qualified local-rule preemption do not establish every local requirement. C037–C039, C066–C067; S010–S012 |
Applicable category and unexamined local practice |
“All local rules are irrelevant,” or “a local practice can override every statewide provision.” |
Verify the statewide preemption boundary only; no local rule or court record is examined. Partial/Held. |
| B26 — Another forum or remedy |
The section’s affirmative mechanism does not decide all other routes. C036, C070; S001 |
Separate statutory/common-law route and forum authority |
“Failure under § 664.6 proves no lawful enforcement is possible.” |
State the generic alternative-remedy question for a separate authorized public-law review. Held. |
| B27 — Omitted approvals/protections |
References to minors, disability, good faith or liens preserve distinct questions; they do not answer consumer, secured-obligation or co-obligor effects. C056, C058, C071; S001, S007, S014 |
Applicable approval/protection framework |
“The settlement mechanism displaces all special protections.” |
Identify whether an express selected-text cross-reference makes a further public provision indispensable; otherwise retain the hold. Held. |
| B28 — Insurer defense, indemnity and excess liability |
All positive conditions and the above-policy-limits exception in (b)(3) matter. C016–C017; S001 |
Defense, indemnity, written authorization and liability predicates |
“Any insurer-connected agent may sign every settlement.” |
Read the current complete insurer-agent paragraph and preserve the factual fields blank. Partial/Unresolved. |
| B29 — Court action without stipulation |
Subdivision (e) permits the specified OSC process after the specified conditional notice, subject to (e)(2). C021–C025; S001, S005–S006 |
Qualifying notice, category and judicial action |
“No stipulation means no court process is possible,” or “notice causes automatic retention.” |
Distinguish permission to set an OSC from the eventual disposition and its exclusions. Partial. |
| B30 — Required all-party writing not fully signed |
Subdivision (f)(2) states a notice-triggered exercise of retained jurisdiction, not a predetermined merits result. C026, C028; S001 |
Requirement of all-party signatures and notice predicate |
“An unsigned required agreement must be enforced,” or “the paragraph itself supplies missing assent.” |
Read the exact paragraph and identify the unresolved question of appropriate relief without searching cases. Partial/Unresolved. |
| B31 — Later filing and narrow fee treatment |
Subdivision (f) permits specified filings, protects against a second first-appearance fee under its predicate, and requires acceptance of properly filed documents. C026–C030; S001 |
Prior fee payment, proper filing and qualifying prior disposition |
“All later filings are fee-free or must be granted.” |
Verify the narrow statutory predicates; complete fee and motion practice remain held. Partial/Held. |
| B32 — Local-public-entity program exception |
All conditions in reported (h)(1)–(3) are cumulative within the special route. C032–C035; S001–S004 |
Official amendment, legal entity category, tort-claim/action status and program eligibility |
“Every public-agency agreement or prelitigation settlement qualifies.” |
Authenticate the current (h) text and § 970(c), without investigating any program or entity. Partial/Unresolved. |
| B33 — Notice of entry of dismissal |
The requesting party’s notice-of-entry duty is distinct from settlement notice and the dismissal request. C064, C068; S016 |
Entered dismissal and notice/service predicates |
“A settlement notice satisfies every later notice duty.” |
Read current rule 3.1390 and only indispensable statewide implementing text. Partial. |
| B34 — Case-disposition-time cross-reference |
Rule (c)(4) concerns case-disposition-time computation; its standard citation needs reconciliation. C057; S007, S015 |
Accessible current standard and relettering instrument |
“The reference automatically tolls every deadline or proves jurisdiction is lost.” |
Read the current standard and official relettering amendment; preserve the limited administrative subject. Unresolved. |

| L14 — Search results outside the authorized evidence set |
Generic searches incidentally returned opinion, local-rule, and other unrelated results |
Those were not opened or used as substantive evidence. No actual lawsuit, party, docket, agreement, provider, or identifying-entry query was conducted. No case or opinion identifier is adopted in this report. |
9. Explicit gaps and limits
G01 — Current statutory original
The pass does not establish an authenticated current official § 664.6 body as of the check date. The complete readable reproduction and reproduced 2026 chapter support the conditional textual analysis, but they do not satisfy the requested original-source verification by themselves. C001–C002; S001–S002.
G02 — Complete amendment and effectiveness chain
The selected 2023 transition provisions and reproduced 2026 urgency clause were read. The complete official session-law chain, possible intervening or later amendments, and future-effective legislation were not exhaustively established. No conclusion that no such material exists is made. C002–C006.
G03 — Official rule and final amendment instrument
The complete reproduced rule and comments were read, and the official administrative adoption record was read. The current official rule body and final amendment PDF remained inaccessible. The body’s older amendment notation, later comments, publisher check labels, and current-site headings are kept separate. S007–S008.
G04 — Standard 2.2 cross-reference
Rule 3.1385(c)(4)’s reference to standard 2.2(n)(1)(A) requires reconciliation with the differently lettered indexed lead. No conclusion about all deadline tolling, jurisdiction, stays, or actual case-disposition reporting is drawn. C057; S015.
G05 — Notice signatures and complete form requirements
The selected rule establishes its stated actors, recipients, content and timing. The complete current official blank CM-200 and any indispensable general signature/form requirements were not successfully verified. This report therefore does not announce a universal notice-signature rule or claim to have read the whole form. C065; S017.
G06 — Questions requiring judicial interpretation
The following remain precisely unresolved:
- What disputed settings satisfy “orally before the court.”
- What constitutes a legally sufficient stipulation, authorization or assent under the applicable circumstances.
- How the exact subdivision-(e)(2) references apply at disputed category boundaries.
- When a retention request must be made in relation to dismissal outside the express mechanism.
- What jurisdiction survives different dismissal forms or defective retention proceedings.
- What relief follows a subdivision-(f)(2) missing-signature notice.
- How disputed settlement terms, severability, nonperformance or breach affect requested judgment terms.
- How the reproduced subdivision-(h) subsequent-action mechanism operates beyond its express conditions.
- Whether another lawful enforcement route is available.
No judicial consensus is inferred, and no opinion or actual case investigation was used to resolve these questions. C069–C071.
G07 — Facts and records remain entirely absent
No source establishes an actual pending action, party, signer, authorization, agreement, conditional term, notice, receipt, scheduled proceeding, request, order, payment, performance, breach, dismissal, judgment or satisfaction. None was queried, invented, examined or entered.
G08 — Other procedural and substantive consequences remain held
No complete local-practice, special-approval, protective-order, family, bankruptcy, secured-obligation, consumer-protection, fee, service, motion, hearing, appeal, reinstatement, default, interest, costs, satisfaction, lien-release, collection, guarantee, tax or credit analysis is supplied. The narrow provisions actually read do not silently import those frameworks. C071–C072.
