SettleADebt R040 PASS-02 — Bounded correction to R040-P1-C087

Confirmed by fresh official-source access: §524(e) expressly excepts subsection (a)(3). The original C087 omitted that qualification and therefore stated the other-entity boundary too broadly. The replacement below supersedes C087 only; the original report and its access record remain intact. uscode.house.gov

The repair concerns the distinction between personal liability and a conditioned property injunction. It does not establish that any actual debt, entity, property, or claim qualifies. It changes no FCCS compromise provision and does not equate an FCCS compromise with a bankruptcy discharge.

1. Source and read register

Fresh access date for S001–S003: October 27, 2026, America/Los_Angeles (PDT). The observed UTC date was October 28, 2026. Each official page displayed a compilation containing laws in effect through Public Law 119-121, October 9, 2026. That displayed cutoff is not an assertion that the entire later-law chain was checked, nor is it the enactment or effective date of every provision.

All fresh sources are official OLRC HTML presentations of federal statutory text. Printed-page and zero-based PDF-index fields are not applicable.

Source ID; issuer/title Complete literal HTTPS URL Exact read bounds and provenance Version, status, limitations, and next generic inquiry
R040-P2-S000 — Supplied original researcher rows and coordinator context No independent URL for the supplied extraction. Its original S022 URL is reproduced in S001 below. The supplied S022, C087, comparison row, B19, B23, and coverage 4.5 were reviewed as the correction targets. The coordinator’s account of reading the complete saved report and brief is supplied context, not my claim of having reread those materials. Context and original researcher records, not fresh primary verification or independent review. No additional prior-report material was retrieved.
R040-P2-S001 — Congress / Office of the Law Revision Counsel, 11 U.S.C. §524, “Effect of discharge” https://uscode.house.gov/us/usc/119-121/t11/s524/ Freshly opened. Read the displayed compilation header; complete §524(a)(1)–(3); complete §524(b)(1)(A)–(B) and (b)(2)(A)–(B) as the direct qualification of (a)(3); and complete §524(e). Selected reading, not a whole-section or full-exceptions review. Displays P.L.119-121 / October 9, 2026. Official compiled statutory body; no postcutoff or complete amendment/effective-history verification. Same section and URL as original R040-P1-S022, but this is a separately dated opening with different reliance bounds. Next inquiry, only if separately needed: authenticate any relevant later enactment or indispensable referenced predicate.
R040-P2-S002 — Congress / OLRC, 11 U.S.C. §541, “Property of the estate” https://uscode.house.gov/us/usc/119-121/t11/s541/ Freshly opened. Read §541(a)’s introductory estate-creation sentence and complete §541(a)(2)(A)–(B). Reliance is confined to the property-kind reference required by §524(a)(3). No whole-estate, exemption, or community-property analysis. Same displayed compilation cutoff. No actual property classification, management/control, liability, jurisdiction, or estate-inclusion determination. Next inquiry, if separately scoped: the indispensable public law needed to classify the referenced property interest.
R040-P2-S003 — Congress / OLRC, 11 U.S.C. §101, “Definitions” https://uscode.house.gov/us/usc/119-121/t11/s101/ Freshly opened. Read the introductory applicability sentence and complete §101(7), “community claim.” No whole-§101-read claim. Same displayed compilation cutoff. The definition does not establish actual claim status or allowability. Next inquiry, if indispensable and separately scoped: the public statutory predicate for allowability or a preserved discharge exception.

The three displayed compilation headers and the selected bodies were actually retrieved in this pass. They are related statutory provisions, not independent corroboration of a complete currentness chain. uscode.house.gov+2

Original R040-P1-S022 is unchanged. Its historical read/reliance description is not retroactively enlarged by this fresh opening.

2. Explicitly superseding replacement claim

The following replaces the substantive proposition and conditions of R040-P1-C087 for purposes of this correction.

Full claim ID Superseding supported proposition Conditions and limits Exact evidence
R040-P1-C087 — SUPERSEDING REPLACEMENT, R040 PASS-02 Section 524(a)(1)–(2) addresses the debtor’s discharged personal liability; (a)(3) separately provides a conditioned property injunction. Section 524(e)’s rule concerning another entity’s liability on, or property for, the debt expressly excepts subsection (a)(3). That property injunction is not a universal discharge of another entity’s personal liability. Apply the express qualifications below and the incorporated definitions in §541(a)(2) and §101(7). No qualifying discharge, debt, claim, entity, property, jurisdiction, or exception predicate is established. R040-P2-S001, §524(a)(1)–(3), (b), (e); R040-P2-S002, §541(a)(2)(A)–(B); R040-P2-S003, §101(7). Original R040-P1-S022 remains the preserved provenance entry. uscode.house.gov

Express qualifications retained in that replacement

Pinpoint Necessary qualification
§524(a)(1)–(2) Judgments are void only to the debtor-personal-liability extent for debts discharged under §§727, 944, 1141, 1192, 1228, or 1328. The injunction addresses commencement/continuation of actions, process, or acts collecting, recovering, or offsetting that personal liability.
§524(a)(3) It concerns debtor property of the §541(a)(2) kind acquired after commencement, for allowable community claims. It excepts claims excluded under §§523, 1192, 1228(a)(1), or 1328(a)(1), or hypothetically so excluded in a spouse case commenced on the debtor’s petition-filing date, determined under §§523(c)–(d). Paragraphs (a)(1)–(3) retain their waiver-independent language.
§524(b)(1) Nonapplication requires the specified Title 11/former Bankruptcy Act spouse case commenced within six years of the relevant petition-filing date and no discharge granted in that case.
§524(b)(2) Alternatively, hypothetical Chapter 7 nondischarge in the specified same-date spouse case and the bankruptcy court’s determination within §727’s prescribed time and manner.

These are statutory references and conditional predicates, not findings that any exception applies. No referenced chapter-discharge or §523 regime was opened into a separate dossier. uscode.house.gov

Narrow incorporated definitions

Provision Complete material definition or condition retained Limit of this correction
§541(a)(2)(A)–(B) The specified category comprises interests of the debtor and the debtor’s spouse in community property as of commencement that are either under the debtor’s sole, equal, or joint management and control, or liable for an allowable claim against the debtor, or for allowable claims against both debtor and spouse, to the extent the interest is so liable. The alternatives are not cumulative. The provision’s commencement-based category must remain distinct from the acquisition condition in corrected C087. No actual property status or liability is determined. R040-P2-S002. uscode.house.gov
§101(7) A community claim is a claim arising before commencement of the case concerning the debtor, for which property of the §541(a)(2) kind is liable, whether or not such property exists at commencement. Definition, allowability, discharge exceptions, and actual application remain separate questions. No claim is classified here. R040-P2-S003. uscode.house.gov

Why the omission mattered

The supplied original C087 combined a qualified personal-liability discussion with an unqualified statement of §524(e). Its concluding reservation about particular debts and surviving rights did not expressly repair that missing statutory exception.

The correction therefore restores the exception and its necessary limits. It does not reverse the original report into an opposite categorical proposition, establish protection for any property, or characterize every previously qualified row as materially erroneous.

3. Original-to-corrected and dependent-effect crosswalk

Only the supplied rows were reviewed for this bounded correction.

Original target Disposition Exact correction or crosslink treatment Reason and preserved limit
R040-P1-C087 Material correction; expressly superseded Use the replacement in section 2, supported by R040-P2-S001–S003. The omission identified by the coordinator is confirmed by fresh source access. The original text is not silently erased.
B19 — Other liable roles or creditors Affected dependent boundary; narrow correction required Use the corrected B19 annotation below. Retain its existing §902.4 / R040-P1-C055 component as supplied, without a fresh FCCS verification claim. Its bankruptcy clause depended on C087. The two legal routes must remain separate.
Comparison row — “Bankruptcy-related result” Unchanged-with-limit; reference update only Retain its decision question and substantive distinction verbatim. Reference cell becomes: “C081–C086 unchanged; R040-P1-C087 as superseded in R040 PASS-02; original S019–S022 preserved; fresh correction evidence R040-P2-S001–S003.” The supplied row already distinguishes petition, stay, discharge, plan payment, surviving claim, and other-entity liability, and disclaims an actual-case conclusion.
B23 — Bankruptcy discharge unknown. Partial. Unchanged-with-limit; reference update only Retain the supplied substantive row. Read its C087 link as the superseding replacement; append R040-P2-S001–S003 for this correction. C086 and its original sources remain unchanged. Its existing partial status and warnings already leave discharge scope, exceptions, and surviving rights unresolved. This pass does not freshly verify §903.3(c).
Coverage 4.5 — Bankruptcy predicates Unchanged-with-limit; reference update only Retain the supplied status, finding, missing-evidence statement, and next inquiry. Update its reference cell in the same manner as the comparison row above. The row already excludes full bankruptcy merits and identifies missing chapter, coverage, exception, and effective-discharge predicates.
R040-P1-S022 Unchanged provenance record Preserve the original source entry. Add the separately scoped R040-P2-S001 opening; do not replace the earlier read/access history. Fresh access is not retroactive researcher access or a reason to reclassify other PASS-01 fallback sources.

Corrected B19 annotation

Branch and coverage status Supported conditional rule; exact claims/sources Missing authority or predicate Adverse inference to avoid Next permissible generic public-law inquiry
B19 — Other liable roles or creditors. Answered only as the corrected generic boundary; applicability unresolved. Retain the supplied §902.4 / R040-P1-C055 clause unchanged. For the bankruptcy clause, use R040-P1-C087 as superseded above, including its express statutory qualification and incorporated limits. Fresh evidence: R040-P2-S001–S003. Actual liability structure; relevant property/claim classifications; discharge and exception predicates; independent authority—all remain absent or held. One FCCS compromise binds every creditor or releases every co-obligor; conversely, treating the original C087 formulation as an exceptionless boundary. Only if separately necessary, authenticate relevant later enactments or the indispensable generic statutory predicate identified in corrected C087. No actual proceedings, property records, creditor records, or state-law dossier.

No change is made to the FCCS compromise mechanism itself. The correction also does not adopt the coordinator’s separate later eCFR checks as this researcher’s earlier access.

1 — Express exception confirmation Answered. The supplied omission is confirmed. Corrected C087; S001, §524(e). No application predicate inferred.
1 — Personal-liability versus property distinction Answered within the narrow statutory boundary. Corrected C087 and qualification table. No actual discharge scope, property classification, or other-entity liability determination.
1 — Express qualifications and cross-references Answered as identification and preservation, not a full exceptions analysis. Direct §524(b) qualification also read. S001, §§524(a)(1)–(3), (b), (e). Referenced chapter-discharge and exception regimes remain held. Read only an indispensable referenced provision if separately required.
1 — §541(a)(2) Answered as a narrow definition read. Both alternatives and the extent-of-liability qualification retained. R040-P2-S002, §541(a)(2)(A)–(B). Actual community-property, control, liability, and jurisdiction facts absent. No state-law expansion here.
1 — §101(7) Answered as a narrow definition read. Precommencement and no-property-at-commencement qualifications retained. R040-P2-S003, §101(7). Actual claim classification and allowability remain unresolved.
2 — Full-ID replacement Answered. One expressly superseding C087 supplied. Section 2. Original report remains immutable.
2 — Affected B19 boundary Answered. Narrow dependent annotation supplied. Section 3; C055 preserved, C087 corrected. No fresh §902.4 review; no actual liable-role determination.

Log item Actual action Outcome / read limit
P2-L01 Opened the exact official §524 URL recorded in R040-P2-S001. Succeeded. Header and selected statutory bodies read. No whole-§524 or full historical-notes review claimed.
P2-L02 Opened the official §541 URL recorded in R040-P2-S002. Succeeded. Narrow incorporated property category read; no complete property-of-the-estate investigation.
P2-L03 Opened the official §101 URL recorded in R040-P2-S003. Succeeded. Narrow community-claim definition read; no complete definitions chapter investigation.
P2-L04 Compared the supplied original C087 and dependent rows with the bounded correction. Material correction limited to C087 and B19’s dependent boundary; other supplied rows remain qualified and receive crosslink updates.
P2-L05 Checked whether any source-access failure occurred in this pass. None in the three fresh statutory openings. This does not alter any PASS-01 access failure or fallback status.
P2-L06 Preserved the coordinator/researcher distinction. Coordinator review remains supplied context. Fresh researcher openings are recorded separately.

6. Preserved gaps and researcher self-check

Check / remaining limit Result
Original record preservation The original C087 and source/access history are not claimed to have been edited or erased. This visible replacement is explicitly superseding.
Scope of correction One replacement claim; one affected branch annotation; necessary comparison/coverage reference updates only.
Other supplied rows Reviewed and expressly classified unchanged-with-limit, rather than mislabeled materially wrong.
Currentness Official displayed compilation through P.L.119-121 / October 9, 2026 confirmed; complete later-law and judicial history remain held.
Direct qualification §524(b) was read because it directly limits the incorporated property injunction. No actual predicate was established.
Actual application No finding about a qualifying debt, entity, property, claim, jurisdiction, discharge, exception, lien, or collection act.
FCCS provenance No fresh §§902/903 investigation; the coordinator’s later access does not reclassify PASS-01’s 2025 fallback or become retroactive researcher access.
Other preserved issue The existing §362 contingent-effective trigger remains unresolved and untouched.
Prior-report boundary R049 and R032 were not premises or evidence for this correction.
Method Public primary statutory browsing only for the fresh legal check; no party, case, account, property, agreement, or record query.
Review status Researcher self-check, not independent review.
Provenance claims No local-file, hash, import, or unseen model/UI-verification claim.
Acceptance No component, parent, operational, or publication acceptance.

Check / remaining limitResult
Original record preservationThe original C087 and source/access history are not claimed to have been edited or erased. This visible replacement is explicitly superseding.
Scope of correctionOne replacement claim; one affected branch annotation; necessary comparison/coverage reference updates only.
Other supplied rowsReviewed and expressly classified unchanged-with-limit, rather than mislabeled materially wrong.
CurrentnessOfficial displayed compilation through P.L.119-121 / October 9, 2026 confirmed; complete later-law and judicial history remain held.
Direct qualification§524(b) was read because it directly limits the incorporated property injunction. No actual predicate was established.
Actual applicationNo finding about a qualifying debt, entity, property, claim, jurisdiction, discharge, exception, lien, or collection act.
FCCS provenanceNo fresh §§902/903 investigation; the coordinator’s later access does not reclassify PASS-01’s 2025 fallback or become retroactive researcher access.
Other preserved issueThe existing §362 contingent-effective trigger remains unresolved and untouched.
Prior-report boundaryR049 and R032 were not premises or evidence for this correction.
MethodPublic primary statutory browsing only for the fresh legal check; no party, case, account, property, agreement, or record query.
Review statusResearcher self-check, not independent review.
Provenance claimsNo local-file, hash, import, or unseen model/UI-verification claim.
AcceptanceNo component, parent, operational, or publication acceptance.

R040-P1-C087 Saved research record

Section 524(a)(1)–(2) addresses the debtor’s discharged personal liability; (a)(3) separately provides a conditioned property injunction. Section 524(e)’s rule concerning another entity’s liability on, or property for, the debt expressly excepts subsection (a)(3). That property injunction is not a universal discharge of another entity’s personal liability.
