SettleADebt R033 PASS-01 — Federal retail-credit workout and account-management policy
The published supervisory baseline verified in this investigation is the FFIEC’s June 2000 Uniform Retail Credit Classification and Account Management Policy, supplemented, for covered credit-card programs, by the January 2003 interagency account-management guidance. The operative texts permit prudent, controlled relief while prescribing supervisory conditions, loss-recognition standards, and monitoring expectations. They do not themselves establish a consumer entitlement to modification or convert a supervisory charge-off into debt forgiveness. federalregister.gov+3
Currentness finding: continued Federal Reserve and OCC supervisory use is affirmatively supported by later substantive materials, including the Federal Reserve’s currently linked retail-credit manual section. An unqualified finding that every provision remains unchanged and applicable across every adopting agency is not established. FDIC current-status bodies were inaccessible, and the current legal treatment of the original OTS valuation-allowance footnote remains unresolved. The distinctions and precise gaps appear below.
Access: October 27, 2026, America/Los_Angeles; corresponding UTC access occurred October 28, 2026. Dates below identify publications, implementation, source currency, or legal effectiveness—not calculated account deadlines.
Register notation: every Snnn, Cnnn, Bnnn, and Ennn reference below carries the prefix R033-P1-. Source formats grouped under one source ID are versions or presentations of the same instrument, not independent corroboration. Findings identified as an inference state the limited conclusion drawn from the cited bodies.

R033-P1-S001 — FFIEC, Uniform Retail Credit Classification and Account Management Policy
Issuer and character: FFIEC, on behalf of the Federal Reserve Board, FDIC, OCC, and OTS; final notice of supervisory policy. Dated June 6, 2000; published June 12, 2000, 65 FR 36903–36906. Implementation: the December 31, 2000 Call Report or Thrift Financial Report, as appropriate.
Grouped official presentations and exact URLs:
Read extent and pinpoints: the complete operative policy, including all three footnotes, was read in the Federal Register and Federal Reserve presentations. In the four-page Federal Register PDF: printed 36903/index 0 contains issuance, implementation and historical context; 36904/index 1 contains the policy introduction, classification provisions and footnotes 1–2; 36905/index 2 contains remaining classification provisions, partial payments, workout controls, open-end conditions and footnote 3 definitions; 36906/index 3 completes closed-end controls, examination considerations and implementation. The eight-page Federal Reserve attachment’s complete operative portion is printed 4–8/indices 3–7; introductory material was also read selectively. GovInfo and FDIC archive presentations were read selectively, not treated as separate instruments.
Status limitation: original issuance plus a current Federal Reserve reproduction; later implementation/use evidence is separately registered. The archive is historical evidence, not proof of present effectiveness. FederalRegister.gov describes its HTML as informational rather than the official legal edition. R033-P1-S002 — Federal Reserve, SR 00-8, Revised Uniform Retail Credit Classification and Account Management Policy
URL: https://www.federalreserve.gov/boarddocs/srletters/2000/sr0008.htm
Issued June 12, 2000; the page’s later update date is not a new issuance. Entire substantive letter and both notes read. Pinpoints: introductory supersession paragraph; change-summary bullets; depository-institution/BHC applicability paragraphs; contractual-versus-recency discussion; note 2 on preimplementation re-aging. It supersedes SR 99-5. This is an implementation/examiner instruction, not a new regulation. federalreserve.gov

URL: https://www.occ.treas.gov/news-issuances/bulletins/2000/bulletin-2000-20.html
Issued June 20, 2000. Entire substantive body read: current applicability notice, Purpose, Policy and Implementation. Expressly adopts the revised policy for national banks and operating subsidiaries; rescinds OCC Bulletin 99-13; the current body says the attachment continues to apply to federal savings associations. Particularly material: additional formal-workout re-aging must meet all other re-aging requirements. OCC

Search discovery identified FIL-40-2000, with a displayed June 29, 2000 date, but direct bodies returned 403. That discovery date is not treated as a fully body-verified implementation finding. No current-status conclusion rests on these failed pages. The policy itself was read through S001.
R033-P1-S005 — Joint 2003 credit-card account-management guidance
Issuers: OCC, Federal Reserve Board, FDIC and OTS. The PDF heading is “Credit Card Lending”, with “Description: Account Management and Loss Allowance Guidance.” The Federal Reserve’s current editorial heading is “Interagency Guidance on Credit Card Lending.”
URLs:
Issued January 8, 2003. The complete HTML guidance, including footnotes 1–6, was read. URL: https://www.federalreserve.gov/boarddocs/srletters/2003/sr0301.htm
Issued January 8, 2003. Entire substantive letter read. Pinpoints: joint issuance, supervised banking organizations engaged in credit-card lending, and final-versus-draft repayment-period explanation. Its subsequent webpage update is not an amendment date. federalreserve.gov

URL: https://www.occ.treas.gov/news-issuances/bulletins/2003/bulletin-2003-1.html
Issued January 8, 2003. Entire substantive body read. It states effective immediately, while recognizing that necessary account-management systems/practice changes might require implementation time coordinated with the OCC and completed promptly. That accommodation is not a general suspension of existing accounting or reporting obligations. The current body says the attachment continues to apply to federal savings associations. OCC+1

URLs:
The manual page states September 2026, with footer September 18, 2026. The linked compilation’s metadata says February 2026; §2241.0 itself is dated February 2023.
Read extent: the entire four-page §2241.0, including subsections 2241.0.1 through 2241.0.1.6 and footnotes 1–5, printed section pp. 1–4/PDF indices 70–73, was read. The section explicitly presents the 2000 policy with clarifying edits and updated references. In the supplement compilation, September 2026 Supplement 59 pp. 1–3/indices 0–2 were read, together with selected earlier version notes: November 2024 accounting update p. 1/index 5, and February 2023 §2241.0 revision explanation p. 3/index 9. The entire 85-page section compilation and 32-page supplement compilation were not read.
This is substantive current examiner-use evidence, with a separately identified section revision date—not a newly issued 2026 interagency policy. Bank Holding Company Supervision Manual+5

URLs:
Booklet dated April 2021, issued April 29, 2021. The cover also carries the March 20, 2025 reputation-risk notice. The transmittal replaces the previous booklet and rescinds its earlier issuance bulletin; it does not announce replacement of the 2000 or 2003 interagency instruments.
Read extent: cover, complete transmittal body, complete Re-Aging and Fixed Payment Programs discussions, pp. 41–44/indices 44–47, including footnotes 55–61. Selected adjacent classification/collection text was returned; the entire 185-page booklet was not read. OCC+2
R033-P1-S014 — OCC status/index bodies
URLs:
Relevant list entries and topic text read. The rescission entry identifies 1999-13 as replaced by 2000-20. A failed text find for another bulletin is not affirmative proof of active status. Older handbook metadata on a topic page does not displace the later booklet/transmittal in S012–S013. These are status/index bodies, not additional policy instruments. OCC+1

The core instrument is the FFIEC Uniform Retail Credit Classification and Account Management Policy, issued for FRB, FDIC, OCC and OTS. It is a final supervisory-policy notice, dated June 6 and published June 12, 2000—not a retail-credit regulation newly promulgated by an examiner manual. |

The 2000 revision superseded the February 10, 1999 policy. In particular, it replaced uniform numerical limits on closed-end extensions/deferrals/renewals/rewrites with prudential internal standards. SR 99-5 and OCC 99-13 were superseded/rescinded through their respective implementation instruments. |

The Federal Reserve’s September 2026 manual page links a complete §2241.0 dated February 2023. That section expressly reproduces the policy with clarifying edits and updated references. The 2023 version note identifies scope, classification-definition and supervisory-guidance-status edits. This supports continued use while disproving any assumption of word-for-word immutability. |

Federal Reserve’s August 2026 topic body lists both SR letters. OCC’s 2021 retail and credit-card handbooks substantively refer to the 2000/2003 issuances, and the implementation bulletins expressly retain FSA applicability. These are affirmative continued-use signals, not a universal certification of unchanged status through access. |

FDIC current statements/manual and implementation-cover bodies could not be read. Consequently, a comprehensive FDIC-specific continuity/status determination from the 2000 and 2003 issuances through October 27, 2026 remains unresolved. Supervisory guidance lacks the force and effect of law. OCC, FDIC and Federal Reserve rules prohibit enforcement or supervisory criticism based merely on a “violation” or “non-compliance” with guidance. Underlying unsafe practices or violations of independently applicable law remain separate grounds; statutory guidelines capable of creating binding obligations are expressly preserved. |

The guidance-status statements are binding on the agencies under the cited regulations. Their statements about numerical examples do not turn retail-policy benchmarks into statutory consumer rights or freestanding legal prohibitions. The 2021 rules’ effective dates are March 15 for OCC, April 1 for FDIC, and May 10 for FRB. |

| R033-P1-C010 |
The September 1, 2026 OCC/FDIC unsafe-practices/MRA final rule has a November 2, 2026 effective date. It was not yet effective at access. Its existence is not a basis for rewriting the retail-policy numerical conditions in this pass. |
S020, Dates and future codified provisions. federalregister.gov+2 |
Interpretive convention for the remaining register: “should,” “may,” “normally” and “generally” retain their supervisory meaning. A statement that the policy prohibits a practice describes the policy’s standard, subject to C008–C009; it does not assert an independently enforceable consumer-law prohibition.

Retail credit includes open- and closed-end credit extended to individuals for household, family and other personal expenditures, including consumer loans and credit cards. Small size or use of a card does not itself establish the stated personal-purpose predicate. |

| R033-P1-C012 |
The policy also includes loans to individuals secured by their personal residence, including first mortgages, home-equity and home-improvement loans. It is therefore not confined to unsecured credit. Inference/limit: the separate residence-secured inclusion should not be silently rewritten as a definitive exclusion of every mixed-purpose or business-purpose residence-secured edge case; that interpretation was not resolved here. |

| R033-P1-C013 |
SR 00-8 describes the policy by its terms as applying to depository institutions; current Federal Reserve §2241.0 says federally insured depository institutions. OCC’s adoption expressly covers national banks and operating subsidiaries, with an express current FSA applicability notice. These formulations must be read with issuer-specific scope, not generalized to every creditor. |

Federal Reserve examiners are instructed to consider the policy as appropriate for consumer-finance subsidiaries of BHCs and SLHCs. SR 14-9 and its updated list include SR 00-8 and SR 03-1 for the SLHC program, subject to original scope and relevant statutory/regulatory differences. This is a verified, limited extension beyond bank entities—not a rule for all nonbanks. |

Under 12 USC 1813(q)(1), OCC is the appropriate federal banking agency for national banking associations, federal branches/agencies of foreign banks, and federal savings associations. The subsection expressly permits more than one appropriate agency for a given institution. It is not a mutually exclusive charter-classification shortcut. |

For the 2003 guidance, a workout is a former open-end credit-card account, with credit availability closed, whose balance is placed on a fixed dollar or percentage repayment schedule under modified concessionary terms. It generally amortizes/liquidates over a defined period and addresses inability/unwillingness under original terms with willingness/ability under modified terms. |
S005 footnote 2, p. 4/index 3. federalreserve.gov |
| R033-P1-C051 |
Temporary-hardship programs are not workouts for that guidance merely because they provide temporary help. A program longer than 12 months, including renewals, is treated as a workout. The trigger is longer than, not automatically “at least” 12 months. |
S005 Workout and Forbearance Practices, p. 4/index 3. ~1255528.doc |
| R033-P1-C052 |
Workout programs should maximize principal reduction and generally strive for repayment within 60 months. Less-conservative terms require clearly documented exceptions supported by compelling evidence. This is a conditional supervisory benchmark, not an exceptionless contractual maximum. |
S005 Repayment Period, p. 4/index 3. ~1255528.doc |
| R033-P1-C053 |
To meet that repayment objective, institutions may need substantially reduced or eliminated interest/fees. The passage does not grant a universal fee waiver, permanent rate reduction, interest suspension or principal forgiveness. |
S005 Repayment Period, final sentence; C008–C009. ~1255528.doc |
| R033-P1-C054 |
Minimum payments should amortize the current balance within a reasonable period consistent with the unsecured consumer nature of the debt and documented creditworthiness. Persistent payments below finance charges/fees can produce negative amortization through capitalization. Prolonged negative amortization, inappropriate fees and practices masking portfolio quality raise supervisory concerns. |
S005 Minimum Payment and Negative Amortization, p. 3/index 2. ~1255528.doc |
| R033-P1-C055 |
The guidance identifies extended liberal repayment terms, high charge-offs, movement between programs, multiple re-agings and inadequate MIS as workout-management concerns. Its corrective-action language must be read with the later guidance-status rules in C008–C009, not as an independent legal offense. |
S005 Workout and Forbearance Practices; S016–S018. ~1255528.doc+1 |

Workout accounts should be segregated for performance measurement, monitoring and impairment analysis; programs with different performance characteristics should be separately tracked. The original accounting terminology does not establish current GAAP treatment. |

Within this credit-card guidance’s scope, limited exceptions to the Uniform Policy may be warranted in well-managed programs. Policies/procedures should identify the basis, permitted types and circumstances; exception volume should be small and controlled, with close performance monitoring. Imprudence, improper reporting or concealed delinquencies/losses defeats the rationale. This is not universal permission to disregard benchmarks. |

A full payment received after a 120- or 180-day threshold but before month-end charge-off may be considered in deciding whether charge-off remains appropriate. The text does not make any partial payment an automatic cure, and does not expressly extend this clause to every special-event clock. |

For computing past-due status, an institution may recognize a payment of 90% or more of the contractual payment as a full payment. The denominator is the contractual payment—not the balance, proposed workout amount or unpaid arrears generally. This is not a contractual discount. |

A past-due loan need not be classified if clear documentation establishes it is well secured and in collection, so collection will occur regardless of delinquency. “Well secured” requires a perfected security interest in, or pledge of, property, including securities, with estimable value net of selling costs sufficient for recorded investment plus a reasonable return. |
S001 Other Considerations; S010 §2241.0.1.1. federalreserve.gov |

OCC’s credit-card handbook notes that industry usage of “re-aging” can include forward or backward delinquency changes. Its selected discussion focuses on collection re-aging, distinguishing one-time customer-service/error-correction actions. This does not redefine every use of the word as the policy’s qualifying workout treatment. |
S013 Re-Aging, p. 41/index 44. occ.gov |
| R033-P1-C088 |
OCC says re-aging policies typically address approval/reporting, account age, whether the account is closed/blocked/open, and overall repayment capacity. Oversight reports identify newly re-aged accounts in the current month and accounts re-aged during the previous 12 months, with cumulative performance history. That reporting window is not a replacement for the policy’s five-year frequency history. |

OCC describes temporary fixed-payment programs up to 12 months, followed by return to original terms, and permanent programs generally within 60 months. OCC retail guidance says workout/forbearance terms should predominantly amortize principal and prohibit negative amortization; generally, interest should not be capitalized when creditworthiness is doubtful. Footnote 63 recognizes short temporary programs, generally less than 12 months, that may not amortize principal. Footnote 64 identifies original planned capitalization, availability of similar terms elsewhere, GAAP and reporting instructions as additional considerations—not a blanket capitalization permission. |

Shows how examiners examine documentation, payment conventions, classification conditions and subsequent performance; includes the customer-service/program-extension scope note. |
A selective examiner checklist does not replace the complete open-/closed-end policy body. C074, C092; S012. |
No numerical account illustration is provided. The exact policy numbers and their units are reported above; no payment ledger, calendar deadline, rate, recovery, tax or credit-score outcome is invented.
4. Substantive qualitative branches
Branch status describes this generic investigation only. Missing evidence is identified as a predicate held outside the pass. The “next inquiry” column authorizes only generic public-law or published-policy research; it is not a request for private records or actual-party identification.
| Branch ID and issue |
Supported rule and complete-condition linkage |
Missing evidence / status |
Adverse inference to avoid |
Next permissible public inquiry |
| R033-P1-B001 — Regulator/institution scope unknown |
Agency roles and adoption scope must both be satisfied; statutory jurisdiction alone is insufficient. C013–C018; S002–S003, S010–S011, S019. |
Institutional category and applicable adoption facts held; FDIC continuity gap. Partial. |
Every lender follows the bank policy; agency roles are always mutually exclusive. |
Read a current generic adoption/applicability body and the corresponding statutory category; no directory or charter lookup. |
| R033-P1-B002 — Retail versus business |
Personal-purpose definition plus separate personal-residence-secured inclusion. C011–C012; S001, S010. |
Purpose and security predicates held; mixed-purpose edge not resolved. Partial. |
Small balances or card form establish consumer coverage; all residence-secured business-purpose situations are definitely excluded. |
Locate a published agency interpretation of the policy’s mixed-purpose/residence-secured boundary. |
| R033-P1-B003 — Open-end versus closed-end |
Different workout standards; fixed schedules have a specific charge-off instruction without necessarily deciding legal product status. C024–C030, C045–C048, C062, C099. |
Structure and contractual classification held. Generic rule answered; application excluded. |
Transfer open-end re-aging numbers to every closed-end loan or treat fixed repayment as universal legal conversion. |
Read generic product-definition and fixed-schedule interpretations, keeping other-law classification separate. |
| R033-P1-B004 — Original terms/delinquency unknown |
Clocks begin from contractual due dates where specified and require the applicable payment-recognition method. C058–C066. |
Original schedule, valid modifications and recognized payments held. Generic rule answered; application excluded. |
Derive delinquency from a label, request date, last contact or number alone. |
Read public policy/reporting explanations of contractual aging and partial-payment recognition. |
| R033-P1-B005 — Voluntary hardship request without approval |
Prudent relief is permitted with renewed ability/willingness, institutional standards and supported decisions. C019–C023, C043. |
Decision, agreement and approval facts held. Generic rule answered; application excluded. |
Request equals acceptance, payment holiday or interest suspension. |
Examine published generic decision/documentation expectations; consumer application rights remain a separate held inquiry. |
| R033-P1-B006 — Proposed re-aging without verified performance |
All ordinary eligibility conditions apply together, including account age, demonstrated capacity, qualifying performance and funding restriction. C031–C038; applicable exception controls C057. |
No performance, capacity or funding evidence evaluated. Generic rule answered; application excluded. |
Three unspecified transfers automatically reset delinquency. |
Seek a published interpretation of equivalent cumulative payments and performance evidence, without constructing a ledger. |
| R033-P1-B007 — Frequency/period history unknown |
Both ordinary windows apply; the formal-workout allowance is separately bounded; historical implementation relief is limited to its stated transition. C035–C042. |
Prior actions and program history held. Generic rule answered; application excluded. |
Calendar-year reset, fresh allowance after each program transfer, or revival of the 2000 transition. |
Read generic agency explanations of counting within any period and interaction of ordinary/workout allowances. |
| R033-P1-B008 — Formal workout/DMP versus ordinary treatment |
Program entry is followed by qualifying program-agreed performance; extra re-age retains all other criteria; 2003 card-workout definition adds closed availability/fixed repayment. C039–C041, C050–C057. |
Program classification, entry and terms held. Generic rule answered; application excluded. |
Counseling enrollment itself approves relief or creates an extra reset for every plan. |
Compare the complete public definitions and any current agency exception interpretation. |
| R033-P1-B009 — Collateral/security unknown |
Non-real-estate repossession, residential LTV/senior-lien, and well-secured/in-collection branches have different conditions. C067–C079. |
Security, priority, valuation, sale costs and collection predicates held. Generic rule answered; application excluded. |
Any collateral prevents loss classification or establishes workout eligibility. |
Read generic valuation, lien-position and collection definitions; no property or security search. |
| R033-P1-B010 — Extension versus renewal/rewrite |
Extension changes monthly schedule/maturity as defined; deferral preserves other terms; renewal concerns a matured loan; rewrite entails significant changes and underwriting. C025–C030, C045–C048. |
Nature of proposed legal/contractual act held. Generic rule answered; application excluded. |
Treat all modifications as interchangeable or assume a replacement obligation releases an old one. |
Read published supervisory definitions and, separately if within scope, public refinancing/novation law. |
| R033-P1-B011 — Capitalized interest/fees or payment source unknown |
Distinct restrictions address qualifying-payment funding, closed-end advances, extension fees, over-limit balances and negative amortization. C026, C034, C038, C047, C054, C091. |
Charge composition, funding source and treatment held. Generic rule answered; application excluded. |
Balance inclusion proves lawful capitalization; all relief requires zero interest; any borrowed payment is automatically forbidden. |
Read generic agency capitalization/funding guidance with its full predicates; detailed contractual/accounting questions remain held. |
| R033-P1-B012 — Charge-off versus cancellation |
Recognition of loss permits possible recovery and does not itself forgive debt. C058–C086. |
Cancellation agreement and applicable liability/collection law held. Generic distinction answered. |
Charge-off cancels debt, or charge-off proves perpetual enforceability. |
Read public explanations distinguishing accounting recognition, cancellation and enforceability; no case or account inquiry. |
| R033-P1-B013 — Supervisory criteria versus consumer entitlement |
Guidance has a defined supervisory role; eligibility conditions do not command a specific modification. C008–C009, C019–C023, C043, C053. |
Separate statutory/contractual rights not researched. Generic distinction answered; entitlement dossier excluded. |
A policy benchmark is a private entitlement or all consensual relief is prohibited. |
Examine only a specifically relevant public entitlement provision if a later authorized component addresses it. |
| R033-P1-B014 — Accounting/current-status reset versus credit reporting |
Current supervisory status and loss classification do not decide historical reporting accuracy or deletion. C024, C080, C083–C086, C094–C095. |
Reporting content, dates and applicable reporting law held. Generic distinction answered. |
Automatic removal of late history, reporting-date reset, or credit-score improvement. |
Read the separate generic public credit-reporting framework in a later authorized component. |
| R033-P1-B015 — Crisis relief/historical version versus ordinary policy |
Ordinary rules, the 2000 transition and any special emergency instrument require distinct version/period treatment. C001–C007, C042, C097–C098. |
No event-specific operative instrument or eligibility assessed. Ordinary/history answered; special relief unresolved/excluded. |
A past emergency exception is presently available or a host date makes old relief current. |
Read a specifically identified public emergency instrument in full, including sunset, extensions and preserved ordinary rules. |
| R033-P1-B016 — New agreement and other-law overlays unknown |
Supervisory transaction definitions do not resolve legal refinancing, validity, disclosures, charges, application procedures or cancellation. C030, C086, C096. |
Agreement and all separate legal predicates held. Boundary answered; application excluded. |
Prudential acceptability proves contract validity or compliance with all consumer laws. |
A bounded public-law inquiry into the particular overlay, without account/application entry. |
| R033-P1-B017 — Partial payments / month-end treatment unknown |
Choose the contractual-payment percentage method or aggregation; never both simultaneously for one loan. Full-payment month-end consideration is conditional. C063–C066. |
Recognized method and payment facts held. Generic rule answered; application excluded. |
A partial payment automatically restarts every clock, or the percentage convention forgives the remainder. |
Read generic payment-recognition and month-end interpretations; do not calculate an account deadline. |
| R033-P1-B018 — Collection or special-event exception uncertain |
Court-notice receipt, discovery, loss determination, documented likelihood, security and proceeding collection each have distinct triggers/conditions. C073–C079. |
No event, notice, estate, insurance or legal-action facts queried. Generic rule answered; application excluded. |
Death, bankruptcy, insurance or collection intent automatically proves cancellation or exemption. |
Read only generic agency event-trigger and documentation interpretations, without case or record searches. |
| R033-P1-B019 — Longer program or repeated temporary programs |
Over-12-month temporary hardship including renewals becomes a workout under the card guidance; 60-month objective has documented compelling exceptions; program movement needs analysis. C051–C057, C090. |
Program durations, renewals and exception evidence held. Generic rule answered; application excluded. |
Relabeling resets program duration; 60 months is absolute; 72 months is universally approved. |
Examine current published program-duration/exception explanations within verified issuer scope. |
| R033-P1-B020 — Current-status or historical accounting reference unresolved |
Continued use is affirmatively supported for identified Fed/OCC materials; FDIC and OTS-successor gaps remain distinct. C005–C010, C085, C094, C098. |
Unread current FDIC bodies and successor allowance provision. Partial/unresolved. |
All active, all withdrawn, or old accounting references fully current. |
Read accessible official current status bodies and the complete successor provision when publicly available; no private request or access workaround. |

6. Granular coverage and question-to-evidence crosswalk
A — Answered: the generic published rule or distinction is established.
P — Partial: a material interpretation or currentness qualification remains.
U — Unresolved: the necessary public body was not read or the question is not resolved by the selected material.
X — Excluded: outside this focused component or expressly held by the user.
“Application excluded” does not mean the generic rule is unanswered.

8. Explicit remaining gaps and limits
Currentness gaps
- FDIC-specific continuity remains incomplete. The joint 2000/2003 instruments are verified; the FDIC’s current relevant statements/manual bodies were not readable. The unresolved question is the complete FDIC-specific status and implementation continuity between those issuances and October 27, 2026, not whether the historical instruments existed. S004, S008, S015; C007.
- The OTS footnote cannot be carried forward unqualified. Original footnote 2 is read, and the later Federal Reserve restatement omits it. The complete current successor regulation was not read. No inference of universal continuation, repeal, or current availability is made. S001, S010, S022; C085.
- Current source inclusion has a defined evidentiary reach. The Federal Reserve’s current manual body and OCC’s later substantive handbooks support continued supervisory use. They do not justify treating every historical accounting reference, every issuer’s adoption history, and every incidental word as unchanged. S009–S013; C005–C006, C094.
- Displayed legal compilations leave short currency intervals. The eCFR and U.S. Code dates in C098 are retained. A crawl date, present URL, or a successful download is not legal promulgation or an assurance against intervening changes.
Interpretation and application gaps
- The policy does not supply every computational implementation detail. It gives the relevant units, triggers, payment alternatives and frequency conditions, but not a complete ledger algorithm for every boundary or changing-payment situation. C044.
- The personal-residence inclusion requires care at the business-purpose edge. The exact inclusion is reported; an unreviewed universal exclusion is not substituted for it. C012.
- No special emergency regime is applied. No present event, eligibility, acceptance or continuation of past relief is inferred. C097.
- All actual facts remain held. No regulator/charter/institution, creditor, servicer, borrower, account, product, collateral, contract, delinquency, payment, capacity, approval or workout history has been classified or supplied.
- Other-law and accounting consequences remain separate. No full TILA/Regulation Z, ECOA, FCRA, FDCPA, bankruptcy, tax, GAAP/CECL, state, local, tribal, territorial or foreign-law analysis is embedded in these supervisory findings. No present application/denial procedure or bank-specific hardship policy is invented.
