Federal criminal fines: payment, modification, delinquency, default, and the boundary with enforcement against property

The selected framework separates the fine imposed, its payment terms, later modification or remission, statutory delinquency or default, and judicial enforcement consequences. A request does not establish an order; default does not establish willful refusal; and a fine or judgment lien does not establish the lawfulness of a particular execution against property. The operative distinctions are established below from published primary sources. No actual obligation, payment history, notice, ability to pay, default, relief, or custody consequence is determined.

Access date: October 27, 2026, America/Los_Angeles. The corresponding UTC retrieval date was October 28, 2026.

Currentness qualification: The retrieved core OLRC section pages expressly contained laws through Public Law 119-120, October 7, 2026. OLRC’s general currency and classification material extended through Public Law 119-134, October 20, 2026. The reviewed classification entries did not identify amendments to the selected core fine provisions. This is a bounded currentness check, not a complete session-law audit through October 27 or a complete later-history audit of the opinion discussed below. The remaining interval and retrieval limitations are recorded rather than treated as proof that no intervening law exists. uscode.house.gov+4

1. Selected scope, actors, and charge boundaries

1.1 Scope and actors

This pass concerns the published federal criminal-fine framework in Title 18, principally §§3572–3574 and §§3611–3614. Necessary connections to federal sentencing provisions, probation or supervised-release procedure, and a separate willful-nonpayment offense are identified only to explain the selected payment/default mechanisms.

The generic actors have distinct functions:

Actor Selected function Limits
Sentencing court Imposes a lawful fine; determines payment terms; exercises specifically authorized modification, interest relief, and enforcement powers No actual sentence, jurisdiction, findings, or order is established
Defendant, including an organizational defendant where applicable Performs the payment and notification obligations that actually apply Inability, willfulness, resources, and efforts remain unadjudicated
Government as petitioner Invokes §3573 on its statutory collection-effectiveness predicate A defendant’s own request does not itself satisfy the government-petition requirement
Attorney General and authorized DOJ officials Collect certified unpaid obligations; give statutory notices; exercise applicable waiver authority A published delegation or policy does not prove a particular official exercised authority
Administrative Office Director Specifies payment mechanisms under §3611 and 28 U.S.C. §604(a)(18) Does not thereby change a judicial payment schedule or remit principal
Clerk or designated payment recipient Receives payments, transmits information, and performs required administrative notifications Receipt or processing does not establish judicial relief
Magistrate judge May conduct a §3613A hearing subject to de novo district-court review; performs specified Rule 32.1 functions Does not eliminate the applicable substantive predicates or procedural protections

These functions are supported individually in C001–C025 and C040–C066 below.

1.2 A shared provision does not make the charge categories interchangeable

Provision Express category or linkage material to this pass Treatment here
§3572(a) Fine imposition, amount, time, and method Fine analysis only
§3572(b) Fine or other monetary penalty constrained by certain restitution obligations Restitution relationship acknowledged; complete restitution analysis held
§3572(d)(1)–(2) Fine or other monetary penalty, expressly including restitution General payment language distinguished from the narrower next paragraph
§3572(d)(3) A fine judgment permitting installments Selected financial-change and schedule-adjustment mechanism
§3572(h)–(i) Fine or payment of restitution Fine triggers examined; no complete restitution application
§3573 Fine or special assessment Government-petition relief; no restitution-remission power inferred
§3611 Fine, assessment, restitution, including interest or penalty Common payment-channel provision
§3612(b), (d)–(g), (i) Multiple provisions expressly mention fines and restitution Each operative clause applied only within its verified fine scope
§3612(c) Separate sequence for §3013 assessments, restitution, then other sentence payments Categories preserved
§3013(b) Assessments collected in the manner fines are collected This linkage is acknowledged; it is not a blanket conclusion that every fine provision applies identically
§3613(c) Specified fines, a specified assessment, and specified restitution orders Only the fine/lien boundary examined
§§3613A and 3614 Fine and restitution language, with clause-specific wording Selected fine consequences and protections examined

Sources: S004–S012. The wording of §3612(f)(2), for example, specifically describes computation of interest on a fine, although surrounding provisions also mention restitution. That textual difference is preserved rather than resolved through an imported restitution analysis. uscode.house.gov+5

2. Atomic substantive claim table

The following tables are the substantive findings. Each claim includes its operative conditions or the limit on what was established.

2.1 Fine imposition, payment terms, changes, and remission

Claim ID Verified proposition and conditions Authority
R025-P1-C001 Section 3551 establishes the general federal sentencing framework unless otherwise specifically provided. Its scope includes federal offenses described there, with express exclusions for an Act applicable exclusively in the District of Columbia and the Uniform Code of Military Justice. This pass does not determine whether an actual obligation falls within that framework. S001, §3551(a). uscode.house.gov
R025-P1-C002 Fine authorization and permissible amounts are distinct from payment administration. Sections 3551 and 3571 address authorized sentencing; §3574 points implementation to chapter 229, subchapter B. Section 18 defines an organization as a person other than an individual. Actual offense classification, fine limits, and sentencing legality remain held. S001–S002, §§3551(b)–(c), 3571(a)–(e), 3574, 18. uscode.house.gov+2
R025-P1-C003 Section 3553(a), incorporated by §3572(a), requires consideration of offense and defendant circumstances, sentencing purposes, available sentences, applicable guidelines and policy statements, disparity, and restitution. This cross-reference does not establish an individual sentencing result. S003, §3553(a)(1)–(7). uscode.house.gov
R025-P1-C004 For a fine’s imposition, amount, timing, and method, §3572(a) additionally requires consideration of resources and earning capacity; burdens on dependents and others relative to alternatives; pecuniary loss; restitution; illegal gains; government imprisonment/supervision/probation costs; ability to pass on the fine’s expense; and organizational size and corrective measures. S004, §3572(a)(1)–(8). uscode.house.gov
R025-P1-C005 When conviction creates a restitution obligation to an offense victim other than the United States, §3572(b) permits a fine or other monetary penalty only to the extent it will not impair the ability to make restitution. No actual restitution obligation or impairment is determined here. S004, §3572(b); S017, §207(b)(1). uscode.house.gov+1
R025-P1-C006 A fine judgment remains final for other purposes despite the specified possibilities of §3573 modification/remission, Rule 35 correction, and §3742 correction or appellate modification. Section 3572(c) does not supply an unrestricted power to reopen a sentence. Full appellate and sentencing-validity analysis is held. S004, §3572(c). uscode.house.gov
R025-P1-C007 Immediate payment is the statutory starting point unless the court, in the interest of justice, provides a date certain or installments. An administrative payment arrangement is not itself proof of such a judicial provision. S004, §3572(d)(1); S025 for the particular distinction adjudicated there. uscode.house.gov+1
R025-P1-C008 Court-authorized installments are equal monthly payments unless the court establishes another schedule. For authorized non-immediate payment, the court sets the period, which must be the shortest period in which full payment can reasonably be made. S004, §3572(d)(1)–(2); S017, §207(b)(2). uscode.house.gov+1
R025-P1-C009 A fine judgment permitting installments must require notification to the court of a material economic change that might affect ability to pay. The paragraph’s express condition is an installment fine judgment; it does not itself establish that every immediately payable fine has this particular duty. Other duties may apply, including C048. S004, §3572(d)(3). uscode.house.gov
R025-P1-C010 Upon receipt of that notice, the court may, on its own motion or a party’s motion, adjust the schedule or require immediate full payment, as justice requires. The provision does not itself remit principal or guarantee a reduction. S004, §3572(d)(3); S017, §207(b)(2)(C). uscode.house.gov+1
R025-P1-C011 Section 3573 requires a government petition showing that reasonable collection efforts are not likely to be effective. The court then has discretionary authority in the interest of justice. The statutory petitioner and showing cannot be replaced merely by labeling a defendant’s request a §3573 petition. S005, opening clause. uscode.house.gov
R025-P1-C012 On the required §3573 petition, the court may remit all or part of an unpaid fine or special assessment, including interest and penalties; defer payment to a date certain or installments; or extend an existing date or schedule. These are different possible orders, not automatic results of collection difficulty. S005, paragraphs (1)–(3). uscode.house.gov
R025-P1-C013 A §3573 petition belongs in the original sentencing court unless jurisdiction has been transferred. The section expressly applies to fines and assessments irrespective of imposition date. That reach-back language must be preserved when considering older obligations. S005, concluding paragraphs. uscode.house.gov
R025-P1-C014 Section 3572(f) places an organizational-asset payment duty on individuals authorized to make the organization’s disbursements. Conversely, an obligation imposed on an officer, director, shareholder, employee, or agent may not be paid from organizational assets unless the court finds it expressly permissible under applicable state law. No state-law or organizational determination is made. S004, §3572(f). uscode.house.gov
R025-P1-C015 If a fine sentence is stayed, §3572(g) requires deposit of the due amount, security, or restraint on asset transfers/dissipation, absent exceptional circumstances determined by the court. The prerequisite is an actual stay; see C061 for the appeal rule. S004, §3572(g); S016, §7. uscode.house.gov+1
R025-P1-C016 At the original fine sentencing, the court may not impose an alternative sentence that will be carried out if the fine is unpaid. This prohibition is distinct from a later proceeding under §§3613A or 3614. S004, §3572(e). uscode.house.gov
R025-P1-C017 Section 3013(b) connects assessment collection to the manner used for fines. It does not resolve, without examining the particular provision, every assessment question about interest, remission, delinquency, or execution. Complete assessment treatment remains held. S012, §3013(b), read with the category-specific provisions above. uscode.house.gov

2.2 Payment channels, administration, and the different clocks

Claim ID Verified proposition and conditions Authority
R025-P1-C018 Under §3611, payment of a fine, assessment, or restitution, including interest or penalty, follows specifications of the Administrative Office Director. The Director may designate the clerk or mechanisms under 28 U.S.C. §604(a)(18). This concerns payment administration, not principal remission or judicial schedule modification. S006, §3611 and §604(a)(18). uscode.house.gov+1
R025-P1-C019 A judgment/order imposing, modifying, or remitting a fine or restitution order over $100 must contain the categories specified in §3612(b)(1): identifying and address information, case reference, original and unpaid amounts, authorized schedule, and change/remission description. Restitution-specific victim information is separate. No such identifying entries were sought or supplied. S007, §3612(b)(1)(A)–(G). uscode.house.gov
R025-P1-C020 If non-immediate payment is permitted, the judgment must require notice to the Attorney General of mailing/residence-address changes within 30 days after the change, until payment in full. This is different from economic-change notice to the court. S007, §3612(b)(1)(F). uscode.house.gov
R025-P1-C021 The court must transmit a certified copy of the covered judgment/order to the Attorney General no later than 10 days after entry. This is an administrative transmission period, not a defendant payment grace period. S007, §3612(b)(2). uscode.house.gov
R025-P1-C022 The clerk/designated recipient must notify the Attorney General of covered payment receipts within 15 days after receipt, or another jointly determined AG/AO time. The statute moves a fifteenth-day Saturday, Sunday, or legal public holiday to the next other day. It also allows an agreed notification manner. S007, §3612(a)(1)–(2) and final sentence; S016, §11(a). uscode.house.gov+1
R025-P1-C023 The Attorney General has collection responsibility for unpaid fines or restitution for which the specified certification has issued. This does not establish certification or an actual collectible balance in any instance. S007, §3612(c), first sentence. uscode.house.gov
R025-P1-C024 Section 3612(c) prescribes a sequence across sentence obligations: §3013 assessment, then all victims’ restitution, then other fines, penalties, costs, and sentence payments, each category paid in full before the next. S007, §3612(c)(1)–(3); S017, §207(c)(2)(C). uscode.house.gov+1
R025-P1-C025 Section 3612(i) separately orders application of payments relating to fines and restitution: principal, costs, interest, penalties. This component ordering must not be confused with C024’s sequence across different obligations. A mixed-obligation ledger is not reconstructed here. S007, §3612(i); S016, §11. uscode.house.gov+1
R025-P1-C026 Under §3572(h), a fine is delinquent when a payment is more than 30 days late. Identifying the applicable due payment is therefore a necessary predicate; a fine’s mere existence is insufficient. S004, §3572(h). uscode.house.gov
R025-P1-C027 Under §3572(i), default occurs when a payment has been delinquent for more than 90 days. The text does not say merely 90 days after the original due date. No exact calendar date is calculated here. S004, §3572(i), first sentence. uscode.house.gov
R025-P1-C028 After default, the entire fine becomes due within 30 days after notification of default, notwithstanding installments, subject to §3613A. Notification and the statutory qualification are material conditions; a notice’s preparation date is not automatically the established notification date. S004, §3572(i), second sentence; S017, §207(b)(5). uscode.house.gov+1
R025-P1-C029 The Attorney General must give delinquency notice within 10 working days after the fine is determined to be delinquent. The commencement event is the determination identified by §3612(d), not simply an assumed due date. S007, §3612(d). uscode.house.gov
R025-P1-C030 The Attorney General must give default notice within 10 working days after the default determination, informing the person of default and that the entire unpaid balance, including interest and penalties, is due within 30 days. This is read together with C028. S007, §3612(e). uscode.house.gov
R025-P1-C031 Current §3612(d)–(e) do not retain their former certified-mail wording; OLRC’s 1988 amendment note records its deletion. The reviewed text does not establish a universal presumed-receipt date, a complete service method, or a universal remedy for defective notice. None is inferred. S007, current (d)–(e) and 1988 amendment notes. uscode.house.gov

Clock separation: judgment entry, an installment’s due date, determination of delinquency, determination of default, notification of default, receipt of payment, receipt of economic-change notice, and a change of address are different events. The periods attached to them cannot be substituted for each other. C020–C033 identify the relevant units and commencement conditions.

2.3 Interest, additions, and relief from them

Claim ID Verified proposition and conditions Authority
R025-P1-C032 Section 3612(f)(1) requires interest on a fine greater than $2,500, unless paid in full before the fifteenth day after the judgment date. If that fifteenth day is a Saturday, Sunday, or legal public holiday, liability starts on the next other day. “Greater than” is not “at least.” S007, §3612(f)(1). uscode.house.gov
R025-P1-C033 Interest on a fine is computed daily from the first liability day. The rate is the Federal Reserve Board’s weekly average one-year constant-maturity Treasury yield for the calendar week preceding that first liability day. No actual rate was retrieved or assigned. S007, §3612(f)(2); S018, §307(b). uscode.house.gov+1
R025-P1-C034 The reviewed clauses establish the fine-interest trigger and benchmark, but do not establish an actual outstanding interest-bearing base, payment allocations, multiple-fine aggregation, daily denominator, rounding, or compounding convention for a calculation here. A total account balance is not substituted for those missing predicates. Research boundary of S007 and S026; C024–C025 remain relevant to allocation.
R025-P1-C035 Delinquency produces a mandatory statutory addition equal to 10 percent of the principal amount that is delinquent. The stated base is delinquent principal, not an assumed total including interest and penalties. S007, §3612(g), first sentence. uscode.house.gov
R025-P1-C036 Default produces an additional 15 percent of the principal amount in default. The two clauses can involve different principal bases. They do not establish a recurring monthly percentage or automatically justify applying 25 percent to every balance. S007, §3612(g), second sentence; S016, §11. uscode.house.gov+1
R025-P1-C037 If the court determines inability to pay interest, §3612(f)(3) permits waiver of interest, a dollar cap, or a limit on the accrual period. The required finding concerns ability to pay interest; discretion and an actual order remain necessary. S007, §3612(f)(3)(A)–(C). uscode.house.gov
R025-P1-C038 The Attorney General may waive all or part of interest or penalties under §3612, or relating to a fine under prior law, upon determining reasonable collection efforts are unlikely to be effective. This is not §3573 principal remission. S007, §3612(h). uscode.house.gov
R025-P1-C039 This pass does not establish nationwide postjudgment jurisdiction to grant every later §3612(f)(3) request. The statute’s relief language is verified; the temporal/jurisdictional issue was not resolved by a selected fine-specific published holding. Restitution cases were not substituted as the foundation. Express unresolved boundary of C037 and S007.

The court’s §3612(f)(3) inquiry, the Attorney General’s §3612(h) determination, and the government-petition route under §3573 therefore have different predicates and effects. An inability assertion, an ineffective-collection assertion, and a granted remission are not interchangeable.

2.4 Default response and possible resentencing

Claim ID Verified proposition and conditions Authority
R025-P1-C040 Upon a court finding of default, §3613A(a)(1) permits a response selected from its menu: revocation or modification of probation/supervised release, §3614 resentencing, contempt, restraint or injunction, sale, a performance bond, entry/adjustment of a payment schedule, or other necessary compliance action. These are discretionary possibilities subject to their governing predicates. S009, §3613A(a)(1). uscode.house.gov
R025-P1-C041 In choosing action, the court must consider employment, earning ability, financial resources, willfulness, and other circumstances bearing on ability or failure to comply. A ledger classification alone does not adjudicate those considerations. S009, §3613A(a)(2). uscode.house.gov
R025-P1-C042 A §3613A hearing may be conducted by a magistrate judge subject to de novo court review. For a confined participant, communication technology is to be used to the extent practicable without removal from confinement. The section does not prescribe one identical hearing procedure for every listed remedy. S009, §3613A(b)(1)–(2). uscode.house.gov
R025-P1-C043 Section 3614(a) concerns a defendant who knowingly fails to pay a delinquent fine. Subject to the statutory restrictions, the court may resentence to a sentence originally available. Its text does not require waiting for §3572(i) default in every instance. S010, §3614(a). uscode.house.gov
R025-P1-C044 One imprisonment predicate is a court determination of willful refusal to pay the delinquent fine or failure to make sufficient bona fide efforts to pay. Nonpayment alone does not establish either determination. S010, §3614(b)(1). uscode.house.gov
R025-P1-C045 Section 3614(b)(2) supplies a separate, disjunctive predicate: considering the offense and person’s characteristics, alternatives to imprisonment are inadequate for punishment and deterrence. It must be read together with subsection (c); it is not an unrestricted inability-to-pay incarceration power. S010, §3614(b)(2)–(c). uscode.house.gov
R025-P1-C046 Section 3614(c) prohibits incarceration under that section solely because indigency makes payment impossible. This protection applies when reading the whole resentencing provision, including both alternatives in subsection (b). No individual indigency or willfulness finding is made here. S010, §3614(c); S017, §207(c)(5). uscode.house.gov+1
R025-P1-C047 Section 3615 separately defines willful failure to pay a fine as an offense carrying possible criminal punishment. That provision is not an automatic conversion of civil collection status into guilt. A complete prosecution or sentencing-range analysis under that separate offense is held. S011, complete operative section. uscode.house.gov

Three distinctions are consequential:

  1. Delinquency and default differ. Section 3614 uses knowing failure to pay a delinquent fine; §3613A begins with a court finding of default.
  2. Willfulness and ability differ. The statute requires the relevant judicial determinations and preserves the indigency protection.
  3. A potential remedy and an imposed sentence differ. Sections 3572(e), 3613A, and 3614 do not create automatic incarceration upon an unpaid installment.

2.5 Necessary procedural rules and supervision connections

Claim ID Verified proposition and conditions Authority
R025-P1-C048 Probation creates a separate relevant connection: §3563(a)(7) requires an economic-change notification condition covering restitution, fines, and special assessments. Its concluding paragraph also makes payment/adherence a probation condition when the court has imposed and ordered execution of a fine and placed the defendant on probation. This does not expand §3572(d)(3) itself. S013, §3563(a)(7) and final paragraph of (a). uscode.house.gov
R025-P1-C049 Probation-condition modification under §3563(c) is permitted before expiration/termination and is governed by the Criminal Rules and initial-setting provisions; §3563(d) requires clear written conditions. Revocation/continuation under §3565(a) requires its violation predicate, a Rule 32.1 hearing, and consideration of §3553(a). Full probation law is held. S013, §§3563(c)–(d), 3565(a)–(c). uscode.house.gov+2
R025-P1-C050 Supervised-release modification or revocation has its own §3583(e) predicates, factors, procedural requirements, and limits; subsection (e)(3) specifies a preponderance finding for violation. Delayed revocation under (i) has its pre-expiration warrant/summons condition. None of these is established from an unpaid-fine label alone. S013, §3583(e)–(i), selected read. uscode.house.gov
R025-P1-C051 For a person in custody for a supervision violation, Rule 32.1(b)(1) calls for a prompt preliminary probable-cause hearing unless waived. It includes recording, notice, counsel information, presentation of evidence, and requested questioning of adverse witnesses subject to the stated interest-of-justice exception. Absence of probable cause requires dismissal of that proceeding. S014, Rule 32.1(b)(1), printed pp.45–46, PDF indices 63–64. uscourts.gov
R025-P1-C052 Unless waived, the revocation hearing must occur within a reasonable time in the district with jurisdiction. Rule 32.1(b)(2) provides written allegations, evidence disclosure, appearance/presentation, qualified adverse-witness questioning, counsel notice, and an opportunity for a statement and mitigation. S014, Rule 32.1(b)(2), printed p.46, PDF index 64. uscourts.gov
R025-P1-C053 Before modifying supervision conditions, Rule 32.1(c) generally requires a hearing with counsel and an opportunity for statement/mitigation. Exceptions are waiver, or favorable relief without term extension and government notice, a reasonable opportunity to object, and no objection. A stand-alone fine motion is not automatically a supervision-condition proceeding. S014, Rule 32.1(c), printed pp.46–47, PDF indices 64–65. uscourts.gov
R025-P1-C054 Rule 32.1(e) incorporates Rule 26.2(a)–(d), (f) for witness statements. Those provisions define qualifying statements, production after direct testimony on motion, review/redaction, and time to examine them. Noncompliance with the incorporated production order means the witness’s testimony must not be considered at the Rule 32.1 hearing. S014, Rules 26.2 and 32.1(e), printed pp.38–39, 47; PDF indices 56–57, 65. uscourts.gov+1
R025-P1-C055 If the chosen route is criminal contempt, Rule 42 generally requires prosecution on notice, preparation time, specified charge information, and its trial protections. Its summary exception concerns qualifying conduct in the court’s presence with required judicial certification. Section 3613A’s reference to contempt does not erase these distinctions; complete civil-contempt doctrine is held. S014, Rule 42(a)–(b), printed p.59, PDF index 77.
R025-P1-C056 The selected sentencing rules provide opportunities to address the court and disputed sentencing matters, require a judge-signed judgment entered by the clerk, and prescribe presence and counsel rules with exceptions. They do not establish a universal evidentiary hearing or appointed-counsel entitlement for every later financial motion. S014, Rule 32(i)(2)–(4), (k); Rules 43–44, printed pp.44–45, 59–60; PDF indices 62–63, 77–78. uscourts.gov+1
R025-P1-C057 Rule 47 generally requires a motion stating grounds and requested relief, in writing unless its exceptions/permission apply. An affidavit is permitted, not universally mandatory. Its ordinary hearing-related service period is at least seven days, subject to different rules/orders and good cause; supporting/opposing affidavits have their stated service rules. S014, Rule 47(a)–(d), printed p.64, PDF index 82. uscourts.gov
R025-P1-C058 Rule 49 governs service, filing, signatures, and permitted electronic/non-electronic channels. Represented and unrepresented filers have different defaults; service generally goes to represented parties’ counsel. Verification/affidavit is not generally required absent a rule or statute. Filing, service, and notice of an entered order remain distinct. S014, Rule 49(a)–(d), printed pp.64–66, PDF indices 82–84. uscourts.gov
R025-P1-C059 Rule 45 supplies computation rules within its scope where a statute does not specify a method, including its treatment of triggering days, intermediate days, last days, and holidays. It does not erase express statutory “working days” or special fifteenth-day language. Its three-day service addition is limited to listed service methods, not a universal receipt presumption. S014, Rule 45(a)–(c), printed pp.61–62, PDF indices 79–80. uscourts.gov
R025-P1-C060 Rule 35(a) addresses specified clear sentencing errors within 14 days after oral sentencing announcement; Rule 35(b) concerns government substantial-assistance motions with its own timing conditions. Neither is a general financial-hardship modification rule. No actual deadline is computed. S014, Rule 35(a)–(c), printed p.52, PDF index 70. uscourts.gov
R025-P1-C061 Under Rule 38(c), an appealed fine may be stayed by the district or appellate court on appropriate terms, with specified security-related measures. An appeal or stay request alone does not establish a stay. Section 3572(g)’s requirements must also be respected. S014, Rule 38(c), printed p.53, PDF index 71; C015. uscourts.gov

Procedure boundary: Section 3613A supplies substantive response authority and hearing-related provisions. Rule 32.1 supplies protections when the selected action involves probation or supervised release; Rule 42 applies to criminal contempt; the sentencing, motion, filing, and presence rules apply according to their respective scope. Combining every remedy into one universal default-hearing procedure would conceal those differences.

2.6 Property enforcement, delegation, forms, and the selected opinion

Claim ID Verified proposition and conditions Authority
R025-P1-C062 Section 3613(a) authorizes the United States to enforce a fine judgment through federal or state civil-judgment practices, subject to its stated exceptions and cross-references. The paragraph expressly addresses specified Internal Revenue Code exemptions, §3014, and §1673. Their complete operation is outside this component. S008, §3613(a)(1)–(3). uscode.house.gov
R025-P1-C063 Under §3613(c), the selected qualifying fine creates a federal lien arising on judgment entry; subsection (d) separately addresses notice filing and third-party effects. Lien creation and the effect of filing notice are different legal questions. Other expressly listed obligations are not silently assimilated to the fine. S008, §3613(c)–(d). uscode.house.gov+1
R025-P1-C064 A fine, a payment schedule, a statutory lien, and a lawful particular execution therefore require separate analysis. This pass establishes neither that installment compliance universally bars execution nor that a lien makes every asset executable. Property exemptions, benefits, tax-lien analogy, insolvency, offsets, garnishment, and actual limitations remain held. Limited inference from C062–C063; no asset application.
R025-P1-C065 The reviewed 28 C.F.R. §0.171 allocates collection and notice functions to U.S. Attorneys, subject to specified DOJ-division assumptions of responsibility. Its express prior-law fine provisions must not be read as current general relief for every modern fine. S020, §0.171(a)–(g), within full section read. ecfr.gov
R025-P1-C066 Justice Manual 9-143.360 describes interest/late-penalty waiver by the U.S. Attorney or a qualifying supervisory official under its referenced delegation structure. The selected Directive 1-15 text concerns delegated civil-litigation authority; this pass does not prove a particular official’s complete written redelegation or convert policy into statutory principal-remission power. S021–S022, Directive §1; JM 9-143.360. ecfr.gov+1
R025-P1-C067 DOJ’s policy on suspension of collection activity states that suspension does not affect the judgment’s validity. Suspension, low collection priority, or administrative inactivity is not established remission. S022, JM 9-143.400. United States Department of Justice
R025-P1-C068 AO 245C is an amended judgment form. The reviewed PDF bears revision 11/25 and has judicial signature fields and separate monetary/schedule sections. It is not itself a defendant’s granted modification or a universal financial-evidence affidavit. Only the stated parsed pages were read; no successful pixel inspection is claimed. S023, Sheets 1, 5, 5A, 6, 8; PDF indices 0, 14, 15, 17, 21. uscourts.gov+2
R025-P1-C069 The bounded national-form search and catalogue read did not establish a nationally uniform defendant application form specifically for §3572(d)(3) or §3573. This is not a finding that no such form, local form, or applicable instruction exists anywhere. S024, displayed criminal-form catalogue; search/read boundary below. United States Courts
R025-P1-C070 In the published precedential Third Circuit opinion United States v. Savage (March 31, 2020), the court affirmed denial of the selected payment-schedule motion: an immediately payable fine, accompanied by a prison collection-program recommendation and a contingent later payment provision, did not supply the installment judgment needed for §3572(d)(3) jurisdiction. S025, holding/reasoning printed pp.6–11, PDF indices 5–10; full opinion read. www2.ca3.uscourts.gov
R025-P1-C071 That holding is reported with its Third Circuit jurisdiction, procedural posture, and fact-pattern limits. No docket, underlying record, cited-case chain, citator, or comprehensive later-history review was performed. It is not presented as verified nationwide, unchanged law through October 2026. S025 read/history boundary.

2.7 Application dates, currentness, and conflicting official material

Claim ID Verified proposition and conditions Authority
R025-P1-C072 The modern framework’s original effective-date notes point to November 1, 1987 and offenses committed after the relevant provisions took effect. Older obligations cannot be assigned the entire modern framework solely because a current compilation displays it. Express reach-back provisions, including C013 and C038, must separately be considered. S001, §235(a)(1) note as amended; S004, S007, S010 effective-date notes. uscode.house.gov+2
R025-P1-C073 The relevant 1996 amendments operate, to the extent constitutionally permissible, for sentencing proceedings in cases with conviction on or after April 24, 1996. They added §3572(d)(2)–(3), removed the former five-year payment-period ceiling, added §3613A, and added §3614(c). This is not merely a sentencing-date rule. S017, §§207(b)–(c), 211. govinfo.gov+1
R025-P1-C074 The 1987 §3611 amendment has its own transition: fines imposed after October 31, 1988, and certain earlier fines still uncollected on February 1, 1989, with possible AO-Director delay to the specified May 1, 1989 condition. The interim 1987–1988 payment directions are historical. S006 notes; S016, §§9–10. uscode.house.gov
R025-P1-C075 The §3612 notes reproduce a historical transition for certain outstanding fines, with special notice, payment-plan, exception, and interest/penalty provisions. Those historical conditions do not establish a general current two-year payment entitlement or general interest exemption. No old-fine application is made. S007, historical “Outstanding Fines” material, Pub. L. 98-473 §237. uscode.house.gov
R025-P1-C076 Public Law 106-554, incorporated Appendix G §307(b), changed the fine-interest benchmark to the one-year constant-maturity formulation; the official court guide identifies December 21, 2000 as the change date. Section 307 and its incorporation were read, but every possible retroactivity issue was not audited. The 2002 note records a punctuation correction. S018; S026; S007 amendment notes. oui.doleta.gov+2
R025-P1-C077 The retrieved core statute headers were through October 7, 2026; the reviewed OLRC general currency/classification material was through October 20. R025-P1-C078 The official Criminal Rules PDF is labeled December 1, 2025; the official rules landing page identifies the last Criminal Rules amendment as 2023. The 2026–2027 publication-for-comment material lists proposed changes to Rules 11, 32, 45, 49, and 49.1. Those proposals were not applied as operative rules. S014–S015. uscourts.gov+2
R025-P1-C079 The retrieved eCFR §0.171 page displayed currency through October 23, 2026; the appendix page through October 22. eCFR describes itself as authoritative but unofficial. The title-level latest-amendment date is not proof that each selected clause changed on that date. DOJ manual text remains policy, not statutory text. S020–S022. ecfr.gov+2
R025-P1-C080 A DOJ district FAQ updated June 14, 2021 uses a $2,500-or-more formulation, sentencing-date/Treasury-bill rate language, and a 90-days-overdue penalty shorthand. These differ materially from the current statutory threshold, benchmark, and staged delinquency/default language. The FAQ is not used to determine a rate, deadline, or amount. S027 compared with S004 and S007. Common Questions And Answers+2
R025-P1-C081 The retrieved §3614 amendment note names Public Law 104-232 in three 1996 entries, while its source credit/effective note identify 104-132. The actual Public Law 104-132 §207(c)(5) contains the selected amendments. The session-law text resolves this particular editorial discrepancy; it does not establish a full historical audit. S010 and S017. uscode.house.gov+1
R025-P1-C082 No numeric fine, interest, penalty, deadline, or custody illustration is justified in this pass. Necessary actual inputs are held, and calculation conventions identified in C034 remain unverified. The qualitative branches below provide the worked decision structure without inventing those inputs. Methodological conclusion from C026–C039 and the expressly held facts.

5. Forms and instructions: what was actually established

5.1 AO 245C

The read portions identify the document as the court’s amended judgment. They contain:

Category What the selected pages establish What is not established
Edition PDF header revision 11/25 That the landing page’s separate 2019 date describes the PDF’s current revision
Signer/attestation Judicial signature, name/title, and date fields on Sheet 1 A defendant financial declaration or universal applicant attestation
Monetary categories Separate assessment, restitution, fine, and additional assessment fields That a single combined figure can be used for every statutory threshold
Interest findings Fields reflecting an interest determination That checking or submitting a field establishes the required court finding
Schedule Immediate, lump-sum/date-certain, installment, and special-instruction categories The operative terms of any actual judgment
Amendment reason Separate reasons section on Sheet 8 A universal substantive entitlement to an amendment
Evidence packet No universally required hardship-evidence packet established by the read form A finding that no evidence or affidavit could be required under another applicable authority
Channels Rule 49 supplies generic filing/service categories; Rule 32(k) supplies judicial signature and clerk entry A particular court’s local filing permission, actual filing, acceptance, or grant
Read/pixel bounds Parsed indices 0, 14, 15, 17, 21; attempted screenshots of 14 and 17 Any visual validation of those pages or unread pages

The form’s mixed-payment allocation language was not used to override §3612(i) or produce a ledger. Reconciliation of mixed obligations and other assessments remains a held component. uscourts.gov+4

5.2 National-form search boundary

The investigation included the public national Criminal Forms catalogue and a targeted public search using:

site:uscourts.gov "fine" "payment schedule" "form" "modify"

Within that boundary, no nationally uniform defendant application specifically establishing a §3572(d)(3) schedule-change procedure or §3573 government-petition procedure was verified. AO 245C was read because it materially distinguishes a judicial output from a request for relief.

No local district was selected, no local form universe was exhausted, and no document was completed, signed, filed, served, or submitted. Consequently, the supported result is “national uniform application not established by this search,” not “no such form exists.”

6. Qualitative branches and branch-level coverage

Status convention: “Answered” means the generic rule is established within the stated research bounds. “Partial” means a material public-law issue remains open. Actual evidence categories are listed only to show what an application would require; they were not requested or investigated.

R025-P1-B002 — Charge type unknown Answered: category table and C017–C019 Fine, restitution, assessment, cost, or another charge; evidence category: separately stated legal obligation Applying fine interest/default rules to an unidentified total Compare the relevant federal charge-authorizing provision with the express nouns in §§3572, 3573, 3611–3612
R025-P1-B003 — Fine versus restitution/assessment Answered within fine scope; other categories excluded: C017, C024–C025 Separate obligation categories and applicable statutory cross-references Assuming shared collection language makes all relief powers identical Read the particular cross-reference for the selected category; preserve complete restitution/assessment work for its own pass
R025-P1-B004 — Immediate versus deferred/installment payment Answered: C007–C010, C070 Judicial payment mode; evidence category: operative payment language, distinguished from an administrative arrangement Treating any periodic collection as a court installment judgment Read §3572(d) and, if necessary, published majority opinions addressing that precise distinction in the relevant federal circuit
R025-P1-B005 — Operative judgment unknown Partial: C006–C010, C056 Which terms actually control; evidence categories: original/amended order, entry, legally effective stay Inferring a schedule, waiver, or current due amount from a generic form Read public rules on judgment entry, amendment, and stays; actual judgment interpretation stays held
R025-P1-B006 — Financial change asserted Answered as predicate, facts held: C009–C010, C048 Materiality, economic change, possible effect on payment, applicable notification duty Treating an assertion as a finding or assuming the only duty is §3572(d)(3) Compare §3572(d)(3) with §3563(a)(7), then read necessary published interpretations of materiality without person/case-record queries
R025-P1-B007 — Request versus court order Answered: C010, C056–C058, C068 Whether relief was ordered and entered; evidence category: judicial disposition, not submission alone Treating a pending or submitted motion as changed payment terms Read Rules 32(k), 47, 49 and any generic applicable local rule; do not query actual filing status
R025-P1-B008 — Defendant request versus government petition Answered: C010–C013 Statutory route and petitioner category; evidence category: authorized petition and required showing Treating a defendant’s §3573-labeled document as the required government petition Read complete §3573 and public DOJ remission policy; investigate a distinct statutory route separately if one is proposed

R025-P1-B012 — Mandatory interest versus discretionary waiver Partial: C032–C039 Trigger satisfaction, applicable exception, decision-maker, finding, order, postjudgment authority Assuming hardship automatically stops interest or that mandatory interest cannot be waived Read §3612(f)–(h) and a fine-specific published decision resolving the temporal jurisdiction issue in the relevant circuit
R025-P1-B013 — Accrual versus collection Answered as distinction: C033, C037–C038, C067 Whether accrual is limited, interest waived, or collection merely suspended Treating administrative collection inactivity as stopping accrual or forgiving debt Compare the exact relief language in §3612 with JM 9-143.400 and any publicly issued operative waiver rules

9.2 Retrieval failures and limitations

Failure / limit Exact source or bounded description Treatment
Earlier OLRC retrieval failures Several view.xhtml requests returned errors, maintenance responses, or failed retrieval; successful section-specific URLs are recorded in S001–S013 Recovered text was read from successful official pages. A failed request was not treated as absence of law
Newer-version path attempts Attempts to retrieve newer OLRC version paths for selected core provisions were inaccessible No claim that the core bodies themselves were retrieved through Public Law 119-134
Current Rule 32.1 HTML request failed https://uscode.house.gov/view.xhtml?edition=prelim&req=granuleid%3AUSC-prelim-title18a-node35-node92-rule32.1 Current official U.S. Courts PDF used

Current Rule 49 HTML request failed https://uscode.house.gov/view.xhtml?edition=prelim&req=granuleid%3AUSC-prelim-title18a-node35-node109-rule49 Current official U.S. Courts PDF used
Congress public-laws page failed https://www.congress.gov/public-laws/119th-congress returned a restricted-fetch failure Remaining currentness gap retained; no workaround attempted
PDF screenshot attempts Criminal Rules and AO 245C screenshot calls returned text markers rather than inspectable image content Zero qualifying pixel inspection claimed
Search collisions Some searches returned unrelated bill numbers, archived guidance, or outside-scope material Search hits were not treated as evidence of absence or as current law
Outside-scope case material Unpublished, restitution-centered, property-centered, and actual-record results were not adopted as the fine framework’s foundation Only the necessary published opinion S025 used

9.3 Status separation

Status Treatment in this pass
Current operative compilation Core statutes and current Criminal Rules, subject to their recorded currency/application limits
Historical Original commencement provisions, 1987–1988 payment transitions, prior five-year cap, outstanding-fines transition, former interest benchmark
Future-effective No future-effective provision relied on; no universal absence claim
Proposed The identified 2026–2027 Criminal Rules proposals were kept separate from operative rules
Withdrawn No withdrawn material relied on; no exhaustive withdrawn-guidance audit claimed
Stayed or vacated No such status inferred from silence; later-history verification of the selected opinion remains bounded
Unknown Unverified application facts, unresolved procedural/calculation issues, unread history, and remaining currentness interval
CFPB material Not needed or introduced

10. Explicit gaps, preserved holds, and researcher self-check

10.1 Remaining legal and source gaps

  1. Currentness beyond the observed compilation/classification bounds. The review does not certify every enactment through October 27, 2026. The failed Congress retrieval and inaccessible newer section paths remain source gaps.
  2. Postjudgment §3612(f)(3) jurisdiction. The statutory interest-relief options are established. A universally applicable later-motion jurisdiction rule is not. A necessary further investigation would use published fine-specific majority opinions on that precise issue, with the same posture and later-history discipline.
  3. Notification method, receipt, and defective-notice consequences. The statutory notice periods and default-notification trigger are established. A universal delivery presumption and remedy are not.
  4. Exact interest computation. No actual rate, base, aggregation method, daily denominator, compounding convention, rounding rule, or allocation history was established for a worked amount.
  5. Mixed-category allocation. Section 3612(c), §3612(i), and a multi-charge judgment form address related but distinct matters. No complete mixed-debt ledger reconciliation was attempted.
  6. Delegation to a particular official. Public regulation and policy were read; the full individual written redelegation chain and its exercise were not established.
  7. Forms and local practice. A nationally uniform application was not established by the bounded search. No selected district’s complete local rules, forms, or filing instructions were investigated. Parsed form text was not pixel-validated.
  8. Opinion later history. S025’s exact selected holding and disposition were read, but no comprehensive later-history assurance is made.

10.2 Parent holds remain intact

Held matters include every actual defendant, offense, jurisdiction, judgment, sentence, payment, notice, receipt, fine amount, means, willfulness, effort, petition, order, and default fact.

Also held are sentencing validity; complete restitution and assessments; complete probation and supervised-release law; court costs; traffic, parking, tolls, and incarceration charges; state, local, tribal, territorial, and international law; broad constitutional doctrine; full property execution, exemptions, liens, garnishment, Treasury, tax, benefits, insolvency, offsets, and limitations analysis; actual balances, interest, penalties, settlement, and other A025 dimensions.

No contract was identified or interpreted. No actual or invented identifying entry, roster, account, property, case record, docket status, or factual query was used to apply these rules.

R025-P1-C001Section 3551 establishes the general federal sentencing framework unless otherwise specifically provided. Its scope includes federal offenses described there, with express exclusions for an Act applicable exclusively in the District of Columbia and the Uniform Code of Military Justice. This pass does not determine whether an actual obligation falls within that framework.S001, §3551(a). uscode.house.gov
R025-P1-C002Fine authorization and permissible amounts are distinct from payment administration. Sections 3551 and 3571 address authorized sentencing; §3574 points implementation to chapter 229, subchapter B. Section 18 defines an organization as a person other than an individual. Actual offense classification, fine limits, and sentencing legality remain held.S001–S002, §§3551(b)–(c), 3571(a)–(e), 3574, 18. uscode.house.gov +2
R025-P1-C003Section 3553(a), incorporated by §3572(a), requires consideration of offense and defendant circumstances, sentencing purposes, available sentences, applicable guidelines and policy statements, disparity, and restitution. This cross-reference does not establish an individual sentencing result.S003, §3553(a)(1)–(7). uscode.house.gov
R025-P1-C004For a fine’s imposition, amount, timing, and method, §3572(a) additionally requires consideration of resources and earning capacity; burdens on dependents and others relative to alternatives; pecuniary loss; restitution; illegal gains; government imprisonment/supervision/probation costs; ability to pass on the fine’s expense; and organizational size and corrective measures.S004, §3572(a)(1)–(8). uscode.house.gov
R025-P1-C005When conviction creates a restitution obligation to an offense victim other than the United States, §3572(b) permits a fine or other monetary penalty only to the extent it will not impair the ability to make restitution. No actual restitution obligation or impairment is determined here.S004, §3572(b); S017, §207(b)(1). uscode.house.gov +1
R025-P1-C006A fine judgment remains final for other purposes despite the specified possibilities of §3573 modification/remission, Rule 35 correction, and §3742 correction or appellate modification. Section 3572(c) does not supply an unrestricted power to reopen a sentence. Full appellate and sentencing-validity analysis is held.S004, §3572(c). uscode.house.gov
R025-P1-C007Immediate payment is the statutory starting point unless the court, in the interest of justice, provides a date certain or installments. An administrative payment arrangement is not itself proof of such a judicial provision.S004, §3572(d)(1); S025 for the particular distinction adjudicated there. uscode.house.gov +1
R025-P1-C008Court-authorized installments are equal monthly payments unless the court establishes another schedule. For authorized non-immediate payment, the court sets the period, which must be the shortest period in which full payment can reasonably be made.S004, §3572(d)(1)–(2); S017, §207(b)(2). uscode.house.gov +1
R025-P1-C009A fine judgment permitting installments must require notification to the court of a material economic change that might affect ability to pay. The paragraph’s express condition is an installment fine judgment; it does not itself establish that every immediately payable fine has this particular duty. Other duties may apply, including C048.S004, §3572(d)(3). uscode.house.gov
R025-P1-C010Upon receipt of that notice, the court may, on its own motion or a party’s motion, adjust the schedule or require immediate full payment, as justice requires. The provision does not itself remit principal or guarantee a reduction.S004, §3572(d)(3); S017, §207(b)(2)(C). uscode.house.gov +1
R025-P1-C011Section 3573 requires a government petition showing that reasonable collection efforts are not likely to be effective. The court then has discretionary authority in the interest of justice. The statutory petitioner and showing cannot be replaced merely by labeling a defendant’s request a §3573 petition.S005, opening clause. uscode.house.gov
R025-P1-C012On the required §3573 petition, the court may remit all or part of an unpaid fine or special assessment, including interest and penalties; defer payment to a date certain or installments; or extend an existing date or schedule. These are different possible orders, not automatic results of collection difficulty.S005, paragraphs (1)–(3). uscode.house.gov
R025-P1-C013A §3573 petition belongs in the original sentencing court unless jurisdiction has been transferred. The section expressly applies to fines and assessments irrespective of imposition date. That reach-back language must be preserved when considering older obligations.S005, concluding paragraphs. uscode.house.gov
R025-P1-C014Section 3572(f) places an organizational-asset payment duty on individuals authorized to make the organization’s disbursements. Conversely, an obligation imposed on an officer, director, shareholder, employee, or agent may not be paid from organizational assets unless the court finds it expressly permissible under applicable state law. No state-law or organizational determination is made.S004, §3572(f). uscode.house.gov
R025-P1-C015If a fine sentence is stayed, §3572(g) requires deposit of the due amount, security, or restraint on asset transfers/dissipation, absent exceptional circumstances determined by the court. The prerequisite is an actual stay; see C061 for the appeal rule.S004, §3572(g); S016, §7. uscode.house.gov +1
R025-P1-C016At the original fine sentencing, the court may not impose an alternative sentence that will be carried out if the fine is unpaid. This prohibition is distinct from a later proceeding under §§3613A or 3614.S004, §3572(e). uscode.house.gov
R025-P1-C017Section 3013(b) connects assessment collection to the manner used for fines. It does not resolve, without examining the particular provision, every assessment question about interest, remission, delinquency, or execution. Complete assessment treatment remains held.S012, §3013(b), read with the category-specific provisions above. uscode.house.gov

R025-P1-C018Under §3611, payment of a fine, assessment, or restitution, including interest or penalty, follows specifications of the Administrative Office Director. The Director may designate the clerk or mechanisms under 28 U.S.C. §604(a)(18). This concerns payment administration, not principal remission or judicial schedule modification.S006, §3611 and §604(a)(18). uscode.house.gov +1
R025-P1-C019A judgment/order imposing, modifying, or remitting a fine or restitution order over $100 must contain the categories specified in §3612(b)(1): identifying and address information, case reference, original and unpaid amounts, authorized schedule, and change/remission description. Restitution-specific victim information is separate. No such identifying entries were sought or supplied.S007, §3612(b)(1)(A)–(G). uscode.house.gov
R025-P1-C020If non-immediate payment is permitted, the judgment must require notice to the Attorney General of mailing/residence-address changes within 30 days after the change, until payment in full. This is different from economic-change notice to the court.S007, §3612(b)(1)(F). uscode.house.gov
R025-P1-C021The court must transmit a certified copy of the covered judgment/order to the Attorney General no later than 10 days after entry. This is an administrative transmission period, not a defendant payment grace period.S007, §3612(b)(2). uscode.house.gov
R025-P1-C022The clerk/designated recipient must notify the Attorney General of covered payment receipts within 15 days after receipt, or another jointly determined AG/AO time. The statute moves a fifteenth-day Saturday, Sunday, or legal public holiday to the next other day. It also allows an agreed notification manner.S007, §3612(a)(1)–(2) and final sentence; S016, §11(a). uscode.house.gov +1
R025-P1-C023The Attorney General has collection responsibility for unpaid fines or restitution for which the specified certification has issued. This does not establish certification or an actual collectible balance in any instance.S007, §3612(c), first sentence. uscode.house.gov
R025-P1-C024Section 3612(c) prescribes a sequence across sentence obligations: §3013 assessment, then all victims’ restitution, then other fines, penalties, costs, and sentence payments, each category paid in full before the next.S007, §3612(c)(1)–(3); S017, §207(c)(2)(C). uscode.house.gov +1
R025-P1-C025Section 3612(i) separately orders application of payments relating to fines and restitution: principal, costs, interest, penalties. This component ordering must not be confused with C024’s sequence across different obligations. A mixed-obligation ledger is not reconstructed here.S007, §3612(i); S016, §11. uscode.house.gov +1
R025-P1-C026Under §3572(h), a fine is delinquent when a payment is more than 30 days late. Identifying the applicable due payment is therefore a necessary predicate; a fine’s mere existence is insufficient.S004, §3572(h). uscode.house.gov
R025-P1-C027Under §3572(i), default occurs when a payment has been delinquent for more than 90 days. The text does not say merely 90 days after the original due date. No exact calendar date is calculated here.S004, §3572(i), first sentence. uscode.house.gov
R025-P1-C028After default, the entire fine becomes due within 30 days after notification of default, notwithstanding installments, subject to §3613A. Notification and the statutory qualification are material conditions; a notice’s preparation date is not automatically the established notification date.S004, §3572(i), second sentence; S017, §207(b)(5). uscode.house.gov +1
R025-P1-C029The Attorney General must give delinquency notice within 10 working days after the fine is determined to be delinquent. The commencement event is the determination identified by §3612(d), not simply an assumed due date.S007, §3612(d). uscode.house.gov
R025-P1-C030The Attorney General must give default notice within 10 working days after the default determination, informing the person of default and that the entire unpaid balance, including interest and penalties, is due within 30 days. This is read together with C028.S007, §3612(e). uscode.house.gov
R025-P1-C031Current §3612(d)–(e) do not retain their former certified-mail wording; OLRC’s 1988 amendment note records its deletion. The reviewed text does not establish a universal presumed-receipt date, a complete service method, or a universal remedy for defective notice. None is inferred.S007, current (d)–(e) and 1988 amendment notes. uscode.house.gov

R025-P1-C032Section 3612(f)(1) requires interest on a fine greater than $2,500, unless paid in full before the fifteenth day after the judgment date. If that fifteenth day is a Saturday, Sunday, or legal public holiday, liability starts on the next other day. “Greater than” is not “at least.”S007, §3612(f)(1). uscode.house.gov
R025-P1-C033Interest on a fine is computed daily from the first liability day. The rate is the Federal Reserve Board’s weekly average one-year constant-maturity Treasury yield for the calendar week preceding that first liability day. No actual rate was retrieved or assigned.S007, §3612(f)(2); S018, §307(b). uscode.house.gov +1
R025-P1-C034The reviewed clauses establish the fine-interest trigger and benchmark, but do not establish an actual outstanding interest-bearing base, payment allocations, multiple-fine aggregation, daily denominator, rounding, or compounding convention for a calculation here. A total account balance is not substituted for those missing predicates.Research boundary of S007 and S026; C024–C025 remain relevant to allocation.
R025-P1-C035Delinquency produces a mandatory statutory addition equal to 10 percent of the principal amount that is delinquent. The stated base is delinquent principal, not an assumed total including interest and penalties.S007, §3612(g), first sentence. uscode.house.gov
R025-P1-C036Default produces an additional 15 percent of the principal amount in default. The two clauses can involve different principal bases. They do not establish a recurring monthly percentage or automatically justify applying 25 percent to every balance.S007, §3612(g), second sentence; S016, §11. uscode.house.gov +1
R025-P1-C037If the court determines inability to pay interest, §3612(f)(3) permits waiver of interest, a dollar cap, or a limit on the accrual period. The required finding concerns ability to pay interest; discretion and an actual order remain necessary.S007, §3612(f)(3)(A)–(C). uscode.house.gov
R025-P1-C038The Attorney General may waive all or part of interest or penalties under §3612, or relating to a fine under prior law, upon determining reasonable collection efforts are unlikely to be effective. This is not §3573 principal remission.S007, §3612(h). uscode.house.gov
R025-P1-C039This pass does not establish nationwide postjudgment jurisdiction to grant every later §3612(f)(3) request. The statute’s relief language is verified; the temporal/jurisdictional issue was not resolved by a selected fine-specific published holding. Restitution cases were not substituted as the foundation.Express unresolved boundary of C037 and S007.

R025-P1-C040Upon a court finding of default, §3613A(a)(1) permits a response selected from its menu: revocation or modification of probation/supervised release, §3614 resentencing, contempt, restraint or injunction, sale, a performance bond, entry/adjustment of a payment schedule, or other necessary compliance action. These are discretionary possibilities subject to their governing predicates.S009, §3613A(a)(1). uscode.house.gov
R025-P1-C041In choosing action, the court must consider employment, earning ability, financial resources, willfulness, and other circumstances bearing on ability or failure to comply. A ledger classification alone does not adjudicate those considerations.S009, §3613A(a)(2). uscode.house.gov
R025-P1-C042A §3613A hearing may be conducted by a magistrate judge subject to de novo court review. For a confined participant, communication technology is to be used to the extent practicable without removal from confinement. The section does not prescribe one identical hearing procedure for every listed remedy.S009, §3613A(b)(1)–(2). uscode.house.gov
R025-P1-C043Section 3614(a) concerns a defendant who knowingly fails to pay a delinquent fine. Subject to the statutory restrictions, the court may resentence to a sentence originally available. Its text does not require waiting for §3572(i) default in every instance.S010, §3614(a). uscode.house.gov
R025-P1-C044One imprisonment predicate is a court determination of willful refusal to pay the delinquent fine or failure to make sufficient bona fide efforts to pay. Nonpayment alone does not establish either determination.S010, §3614(b)(1). uscode.house.gov
R025-P1-C045Section 3614(b)(2) supplies a separate, disjunctive predicate: considering the offense and person’s characteristics, alternatives to imprisonment are inadequate for punishment and deterrence. It must be read together with subsection (c); it is not an unrestricted inability-to-pay incarceration power.S010, §3614(b)(2)–(c). uscode.house.gov
R025-P1-C046Section 3614(c) prohibits incarceration under that section solely because indigency makes payment impossible. This protection applies when reading the whole resentencing provision, including both alternatives in subsection (b). No individual indigency or willfulness finding is made here.S010, §3614(c); S017, §207(c)(5). uscode.house.gov +1
R025-P1-C047Section 3615 separately defines willful failure to pay a fine as an offense carrying possible criminal punishment. That provision is not an automatic conversion of civil collection status into guilt. A complete prosecution or sentencing-range analysis under that separate offense is held.S011, complete operative section. uscode.house.gov

R025-P1-C048Probation creates a separate relevant connection: §3563(a)(7) requires an economic-change notification condition covering restitution, fines, and special assessments. Its concluding paragraph also makes payment/adherence a probation condition when the court has imposed and ordered execution of a fine and placed the defendant on probation. This does not expand §3572(d)(3) itself.S013, §3563(a)(7) and final paragraph of (a). uscode.house.gov
R025-P1-C049Probation-condition modification under §3563(c) is permitted before expiration/termination and is governed by the Criminal Rules and initial-setting provisions; §3563(d) requires clear written conditions. Revocation/continuation under §3565(a) requires its violation predicate, a Rule 32.1 hearing, and consideration of §3553(a). Full probation law is held.S013, §§3563(c)–(d), 3565(a)–(c). uscode.house.gov +2
R025-P1-C050Supervised-release modification or revocation has its own §3583(e) predicates, factors, procedural requirements, and limits; subsection (e)(3) specifies a preponderance finding for violation. Delayed revocation under (i) has its pre-expiration warrant/summons condition. None of these is established from an unpaid-fine label alone.S013, §3583(e)–(i), selected read. uscode.house.gov
R025-P1-C051For a person in custody for a supervision violation, Rule 32.1(b)(1) calls for a prompt preliminary probable-cause hearing unless waived. It includes recording, notice, counsel information, presentation of evidence, and requested questioning of adverse witnesses subject to the stated interest-of-justice exception. Absence of probable cause requires dismissal of that proceeding.S014, Rule 32.1(b)(1), printed pp.45–46, PDF indices 63–64. uscourts.gov
R025-P1-C052Unless waived, the revocation hearing must occur within a reasonable time in the district with jurisdiction. Rule 32.1(b)(2) provides written allegations, evidence disclosure, appearance/presentation, qualified adverse-witness questioning, counsel notice, and an opportunity for a statement and mitigation.S014, Rule 32.1(b)(2), printed p.46, PDF index 64. uscourts.gov
R025-P1-C053Before modifying supervision conditions, Rule 32.1(c) generally requires a hearing with counsel and an opportunity for statement/mitigation. Exceptions are waiver, or favorable relief without term extension and government notice, a reasonable opportunity to object, and no objection. A stand-alone fine motion is not automatically a supervision-condition proceeding.S014, Rule 32.1(c), printed pp.46–47, PDF indices 64–65. uscourts.gov
R025-P1-C054Rule 32.1(e) incorporates Rule 26.2(a)–(d), (f) for witness statements. Those provisions define qualifying statements, production after direct testimony on motion, review/redaction, and time to examine them. Noncompliance with the incorporated production order means the witness’s testimony must not be considered at the Rule 32.1 hearing.S014, Rules 26.2 and 32.1(e), printed pp.38–39, 47; PDF indices 56–57, 65. uscourts.gov +1
R025-P1-C055If the chosen route is criminal contempt, Rule 42 generally requires prosecution on notice, preparation time, specified charge information, and its trial protections. Its summary exception concerns qualifying conduct in the court’s presence with required judicial certification. Section 3613A’s reference to contempt does not erase these distinctions; complete civil-contempt doctrine is held.S014, Rule 42(a)–(b), printed p.59, PDF index 77.
R025-P1-C056The selected sentencing rules provide opportunities to address the court and disputed sentencing matters, require a judge-signed judgment entered by the clerk, and prescribe presence and counsel rules with exceptions. They do not establish a universal evidentiary hearing or appointed-counsel entitlement for every later financial motion.S014, Rule 32(i)(2)–(4), (k); Rules 43–44, printed pp.44–45, 59–60; PDF indices 62–63, 77–78. uscourts.gov +1
R025-P1-C057Rule 47 generally requires a motion stating grounds and requested relief, in writing unless its exceptions/permission apply. An affidavit is permitted, not universally mandatory. Its ordinary hearing-related service period is at least seven days, subject to different rules/orders and good cause; supporting/opposing affidavits have their stated service rules.S014, Rule 47(a)–(d), printed p.64, PDF index 82. uscourts.gov
R025-P1-C058Rule 49 governs service, filing, signatures, and permitted electronic/non-electronic channels. Represented and unrepresented filers have different defaults; service generally goes to represented parties’ counsel. Verification/affidavit is not generally required absent a rule or statute. Filing, service, and notice of an entered order remain distinct.S014, Rule 49(a)–(d), printed pp.64–66, PDF indices 82–84. uscourts.gov
R025-P1-C059Rule 45 supplies computation rules within its scope where a statute does not specify a method, including its treatment of triggering days, intermediate days, last days, and holidays. It does not erase express statutory “working days” or special fifteenth-day language. Its three-day service addition is limited to listed service methods, not a universal receipt presumption.S014, Rule 45(a)–(c), printed pp.61–62, PDF indices 79–80. uscourts.gov
R025-P1-C060Rule 35(a) addresses specified clear sentencing errors within 14 days after oral sentencing announcement; Rule 35(b) concerns government substantial-assistance motions with its own timing conditions. Neither is a general financial-hardship modification rule. No actual deadline is computed.S014, Rule 35(a)–(c), printed p.52, PDF index 70. uscourts.gov
R025-P1-C061Under Rule 38(c), an appealed fine may be stayed by the district or appellate court on appropriate terms, with specified security-related measures. An appeal or stay request alone does not establish a stay. Section 3572(g)’s requirements must also be respected.S014, Rule 38(c), printed p.53, PDF index 71; C015. uscourts.gov

Section 3551 establishes the general federal sentencing framework unless otherwise specifically provided. Its scope includes federal offenses described there, with express exclusions for an Act applicable exclusively in the District of Columbia and the Uniform Code of Military Justice. This pass does not determine whether an actual obligation falls within that framework.

Revocation/continuation under §3565(a) requires its violation predicate, a Rule 32.1 hearing, and consideration of §3553(a). Full probation law is held.

Supervised-release modification or revocation has its own §3583(e) predicates, factors, procedural requirements, and limits; subsection (e)(3) specifies a preponderance finding for violation. Delayed revocation under (i) has its pre-expiration warrant/summons condition. None of these is established from an unpaid-fine label alone.

For a person in custody for a supervision violation, Rule 32.1(b)(1) calls for a prompt preliminary probable-cause hearing unless waived. It includes recording, notice, counsel information, presentation of evidence, and requested questioning of adverse witnesses subject to the stated interest-of-justice exception. Absence of probable cause requires dismissal of that proceeding.

Before modifying supervision conditions, Rule 32.1(c) generally requires a hearing with counsel and an opportunity for statement/mitigation. Exceptions are waiver, or favorable relief without term extension and government notice, a reasonable opportunity to object, and no objection. If the chosen route is criminal contempt, Rule 42 generally requires prosecution on notice, preparation time, specified charge information, and its trial protections. Its summary exception concerns qualifying conduct in the court’s presence with required judicial certification.
