Federal FLSA wage floors, free-and-clear payment, and employer deduction or repayment claims

The selected federal authorities distinguish recovery of a genuine, previously advanced sum from shifting an employer’s business expenses to an employee. Employer-benefiting charges remain subject to the applicable minimum-wage and overtime protections, including when repayment occurs outside payroll. DOL’s published interpretations recognize narrower treatment for genuine loan or wage-advance principal, but that treatment does not establish the existence, contractual validity, or collectibility of an alleged debt. The specific support and limitations appear in C019–C043 below. ecfr.gov+2

1. Currentness, authority, and reading limits

Category What was established Limit
Current statutory bodies The retrieved OLRC bodies state that they contain laws in effect through Public Law 119-134, October 20, 2026. That compilation cutoff is not a completed session-law audit through October 27. See C060.
Current regulatory bodies The latest retrieved Part 531 and Part 778 bodies displayed October 26, 2026 currency. Other retrieved snapshots and their dates are identified below. A title-wide amendment date does not establish when each particular provision changed. See C061.
Historical final rules relevant to current text The selected 2011 wage-payment amendments and 2019 regular-rate amendments were read with their effective dates and operative provisions. Their historical publication does not substitute for the current consolidated text. See C062–C063.
Older agency interpretations The 1984 Administrator letter, two 2004 non-Administrator letters, and selected handbook provisions were examined within the stated retrieval bounds. These retain their interpretive or enforcement status; publication on a current website does not make them statutes or establish exhaustive later-history clearance.
Future-effective or proposed material None is used as an operative rule in this answer. No comprehensive inventory of pending proposals or future amendments was performed.
Withdrawn, stayed, or vacated material No material identified as withdrawn, stayed, or vacated is used as operative authority here. No comprehensive judicial-history or withdrawal audit was completed. The publisher checks and remaining uncertainty are specified in C059 and C064.
Judicial opinions No judicial opinion was necessary to report the bounded statutory, regulatory, and agency positions selected here. No judicial holding, posture, disposition, or subsequent case history is represented as examined. Broader judicial treatment of clawbacks remains open.

PDF limitation: PDF reading below means parsed text, not pixel inspection. No unseen page image, scan, form, signature appearance, or layout is represented as inspected.

2. Substantive findings and atomic claim table

Each row states a bounded proposition. An agency interpretation is identified as such; none is silently promoted into a statutory exemption or universal collection authorization.

A. Coverage, exemptions, rates, and the relevant period

Claim ID Finding, conditions, and exceptions Support
R022-P1-C001 FLSA status begins with the statutory employment relationship: “employ” includes suffering or permitting work; “employer” and “employee” have defined scopes and exclusions. A job or contract label alone does not establish those predicates. No complete employee/contractor determination is made here. S001, §203(d), (e), (g). uscode.house.gov+1
R022-P1-C002 Ordinary enterprise coverage requires the relevant commerce/materials-handling predicate and at least $500,000 annual gross sales or business, excluding separately stated retail excise taxes. Specified institutions and public agencies have separate routes; $500,000 is not universal. Enterprise aggregation and the owner/immediate-family-only establishment exclusion also matter. S001, §203(r), (s). uscode.house.gov
R022-P1-C003 Failure to establish enterprise coverage does not resolve individual coverage. An employee’s own covered interstate-commerce or production activities can independently bring the employment within §§206 and 207. The actual activities remain unknown. S002–S003; S012, individual coverage. U.S. Department of Labor
R022-P1-C004 Section 213(a)(1)’s qualifying executive, administrative, professional, and outside-sales exemptions concern minimum wage and overtime, subject to its terms and regulations; §213(b) exemptions concern overtime. Section 541.2 rejects job-title-only exemption decisions. Applicable duties/pay requirements must actually be met. S004; S008. uscode.house.gov+2
R022-P1-C005 The state/local public-agency volunteer exclusion has specific conditions: no compensation beyond permitted expenses, reasonable benefits or nominal fee, and no volunteering the same type of services for the agency that employs the individual. It is not a general “volunteer” label exemption. S001, §203(e)(4). uscode.house.gov
R022-P1-C006 Section 213(f) separately limits geographic application of §§206, 207, 211, and 212 by reference to the workplace during the workweek. No actual foreign-country or territorial application is established. S004, §213(f). uscode.house.gov
R022-P1-C007 The general §206(a)(1)(C) federal minimum is $7.25 per hour, effective July 24, 2009. That is the verified general federal rate used in the illustrations, subject to coverage and special-rule gates. It is not a state/local rate determination. S002; S022’s rate history. uscode.house.gov+1
R022-P1-C008 The general §206(g) initial-employment provision permits $4.25 for qualifying employees under 20 during the first 90 consecutive calendar days, with anti-displacement conditions. Territorial and other special provisions require separate predicates. No such special-rate eligibility is assumed here. S002, §206(g), including its separately stated territorial provisions. uscode.house.gov
R022-P1-C009 Under the standard §207(a)(1) rule, covered nonexempt work over 40 hours in a workweek requires compensation at least 1.5 times the employee’s regular rate. Merely preserving the minimum wage does not establish overtime payment. S003, §207(a)(1); S009, §§778.107–.110. uscode.house.gov+1
R022-P1-C010 Selected alternative periods require their own conditions. Section 207(j) permits a qualifying, previously agreed 14-day arrangement for specified institutions, with daily-over-eight and period-over-80 protections. Section 207(k) separately addresses qualifying public fire/law-enforcement periods. Neither follows from a payroll label. S003, complete §207(j)–(k). uscode.house.gov
R022-P1-C011 The standard workweek is a fixed recurring 168 hours. Weeks cannot be averaged merely because payroll is biweekly, semimonthly, or monthly. A workweek change must satisfy the permanence/non-evasion condition; actual start and end points remain necessary. S009, §§778.104–.105. ecfr.gov+1
R022-P1-C012 Section 218(a) preserves applicable higher minimum wages and shorter maximum workweeks and prevents using the FLSA as justification for lowering existing standards. Section 531.26 likewise preserves compatible wage-payment restrictions. Passing this federal test does not establish state-law or contractual permission. S005; S007, §531.26. uscode.house.gov+1

B. Wages, facilities, business costs, consent, and reimbursement

Claim ID Finding, conditions, and exceptions Support
R022-P1-C013 Required wages ordinarily must be cash or a negotiable instrument payable at par. Section 203(m)(1) conditionally includes customary board, lodging, or other facilities; an applicable Secretary-determined fair value can replace actual cost. A qualifying collective-bargaining exclusion must be honored. S001, §203(m)(1); S007, §§531.2, .6, .27–.29. uscode.house.gov+2
R022-P1-C014 Section 531.3 limits reasonable cost to actual cost without employer/affiliate profit. Its default facilities calculation includes operation, maintenance, adequate depreciation and a capital-interest allowance not exceeding 5.5%, subject to the fair-rental/fair-price cap and accounting conditions. That allowance is not authorization to charge employee-loan interest. S007, complete §531.3(a)–(c), .33. ecfr.gov
R022-P1-C015 Costs primarily benefiting or serving the employer cannot be credited as reasonable-cost wages. The nonexclusive examples include trade tools, business materials/services, employer construction, and required uniforms and laundering. S007, §531.3(d). ecfr.gov
R022-P1-C016 Potential employee facilities include meals, housing, ordinary merchandise/clothing, personal utilities, and qualifying transportation. Section 531.32 also specifically mentions tuition furnished by a college to student employees; that is not a general training-repayment rule. Employer stock is not an “other facility.” S007, complete §531.32. ecfr.gov
R022-P1-C017 Facility-credit analysis requires actual benefit, customary furnishing, and the regulation’s voluntary, uncoerced acceptance requirement. Section 531.31 excludes unlawful furnishing from customary furnishing. A label such as “employee benefit” does not establish these predicates. S007, §§531.30–.31. ecfr.gov
R022-P1-C018 The text treats meals as primarily employee-benefiting. FOH 30c09(b) separately states WHD’s policy not to enforce voluntary acceptance for meals where the credit does not exceed actual cost. This is a limited enforcement position, not deletion of §531.30. S007, §531.32(c); S014, §30c09(b). ecfr.gov+1
R022-P1-C019 The complete §531.35 rule requires required wages to be paid finally and unconditionally. It reaches direct or indirect kickbacks to the employer or another for its benefit, whether returned in cash or another form. The applicable minimum-wage/overtime impact must then be tested. S007, complete §531.35. ecfr.gov
R022-P1-C020 Required trade tools violate the rule in a workweek when their cost cuts into required minimum or overtime wages. Other expressly identified employer costs include necessary business transportation, required uniform rental, employer-obligated medical services, and employer-required examinations. Attribution and applicable facts still matter. S007, §§531.32(c), .35; S013. ecfr.gov+2
R022-P1-C021 Uniforms required by law, the employer, or the nature of the business are treated as employer expenses. Their purchase and required maintenance cannot reduce protected minimum or overtime wages. S007, §531.3(d); S013. ecfr.gov+1
R022-P1-C022 DOL’s deduction guidance applies the protected-wage limitation to shortages, employer-property damage, customer nonpayment, and theft losses, including employee negligence. A claimed loss does not become a genuine loan merely by being described as a debt. S013; S017’s business-expense distinction. U.S. Department of Labor+1
R022-P1-C023 In a nonovertime week, §531.36 protects the applicable minimum. Eligible facility credits may reduce cash below that floor if all credit conditions hold. Its treatment of facility profit is limited to the extent protected wages are impaired; it is not general approval of above-floor deductions. S007, complete §531.36. ecfr.gov
R022-P1-C024 In an overtime week, qualifying particular-item deductions cannot exceed what could be deducted for the maximum straight-time hours, cannot evade overtime or other law, and cannot replace payment of full wages. Regular rate is determined before deductions. Eligible reasonable-cost facilities receive the separately stated treatment. S007, complete §531.37(a)–(b); S022. ecfr.gov+1
R022-P1-C025 FOH 32j08 requires prior agreement or understanding before the work, particular identified items, knowledge of how amounts are determined, and affirmative assent. Writing is not its universal FLSA requirement, but the employer bears proof of agreement. Otherwise-illegal or non-bona-fide charges do not qualify. S015, §32j08(b)–(d). U.S. Department of Labor
R022-P1-C026 Inference from the preceding provisions: signed consent alone does not satisfy the benefit, cost, wage-floor, overtime, timing, anti-evasion, or other-law conditions. Agreement is one predicate in certain rules, not a waiver of all protections. C015, C019, C024–C025; S007, S015. govinfo.gov+1
R022-P1-C027 Cash reimbursement outside payroll does not avoid the free-and-clear rule. An actual demand still requires examination of payment, beneficiary, amount, and workweek attribution; the selected provisions do not resolve every posttermination collection scenario. S007, §531.35; S013’s cash-reimbursement discussion. ecfr.gov+1
R022-P1-C028 DOL allows installment deductions only while each relevant week remains compliant. FOH 30c12(e) separately requires the necessary reimbursement for a worker-purchased required uniform by the regular payday for the expense week; it rejects spreading that required reimbursement over the garment’s life. S013; S014, §30c12(e). U.S. Department of Labor+1
R022-P1-C029 FOH distinguishes ordinary street clothing from sufficiently specified uniforms. Its maintenance exceptions address genuinely ordinary wash-and-wear care, offered free laundry voluntarily declined, and voluntarily purchased extra uniforms beyond an adequate supplied quantity. The wash-and-wear policy does not cover daily required washing when only one uniform is supplied. S014, §30c12(a)–(g). dol.gov+1
R022-P1-C030 Employee-assessed taxes actually forwarded to the proper government agency may count as wages under §531.38. Employer-borne taxes may not be shifted under that provision. Thus bank-deposit net pay alone is not the complete wage-floor measure. S007, complete §531.38. ecfr.gov
R022-P1-C031 Section 531.40 conditionally treats an employee-directed payment to an independent third party as wages: actual payment for the employee’s benefit, no direct/indirect employer-side benefit or profit, and no evasion. It does not supply the employer-loan exception. S007, complete §531.40(a)–(c). ecfr.gov
R022-P1-C032 Section 531.39 separately addresses court-ordered third-party payments and expressly cross-references CCPA limits. No garnishment entitlement, percentage, disposable-earnings amount, or calculation is determined here. S007, complete §531.39; CCPA component excluded. ecfr.gov
R022-P1-C033 Eligible facilities furnished in addition to cash generally enter the regular-rate calculation at the prescribed reasonable cost or applicable fair value. Facilities therefore cannot simply be ignored when assessing overtime. S007, §531.37(b); S009, complete §778.116. ecfr.gov+1

C. Genuine advances, overpayments, tuition, and final pay

Claim ID Finding, conditions, and exceptions Support
R022-P1-C034 DOL’s 1984 Administrator letter and FOH 30c10 treat genuine loan or cash/wage-advance principal as recoverable through deductions even when minimum wage or overtime is affected. The letter includes final-pay recovery and does not require a written agreement, while emphasizing proof of the loan and terms. S016, situation (1); S014, §30c10. This is an agency interpretation of actual advanced money. dol.gov+1
R022-P1-C035 The same interpretation expressly withholds that treatment from interest or administrative expenses to the extent they cut into minimum wage or overtime. Calling a business charge “principal” does not establish that money was advanced. S016, situation (1); S014, §30c10. dol.gov
R022-P1-C036 FLSA-834 addresses cash advanced to an employee who pays school tuition, forgiven if employment continues through course completion and a grade of C or better is achieved. DOL permitted the described recoupment if the employee clearly understood the policy before accepting payment. That is a specific fact pattern. S016, situation (2), PDF indices 0–1. dol.gov
R022-P1-C037 FLSA2004-17NA addresses vacation permitted before accrual, with an understood advance-repayment policy. It treats that voluntarily accepted advance as deductible from final pay despite minimum-wage or overtime impact, subject to its facts and other-law warning. S017, printed p.1; qualifications also reviewed. dol.gov
R022-P1-C038 That vacation letter limits the amount to the rate paid when the vacation money was advanced, rather than a higher termination-date rate. It also rejects below-minimum-wage administrative charges or interest and flags potentially prohibitory state law. S017, printed p.1. dol.gov
R022-P1-C039 In FLSA2004-19NA’s specific inadvertent vacation-overpayment scenario, DOL applied its principal-advance position to recoupment without employee permission, in the next or later pay period. This establishes the published response to that scenario—not every alleged overpayment. The letter’s second page remains unread. S018, printed p.1, Q1/A1 and Q3/A3. dol.gov
R022-P1-C040 Bounded conclusion: final pay is not established as a general exception to wage protection. The selected affirmative final-pay interpretations concern specifically described advances, with their assumptions. They do not validate every termination charge or decide a state final-pay deadline. S016–S018; C019–C025, C034–C039. dol.gov+2
R022-P1-C041 Unresolved beyond those narrow predicates: general training repayment, tuition reimbursement of a different structure, signing/retention or relocation clawbacks, disputed recalculated earnings, and equipment “loans” that may shift business costs. Neither the tuition letter nor a regular-rate exclusion supplies a universal recoupment rule. Scope comparison of S007, S016–S018 and S023; no broader holding inferred. dol.gov+2
R022-P1-C042 Scope conclusion: the selected deduction interpretations do not establish a cause of action to sue, enforceable contract terms, a collectible balance, or permission for every collection method. Those separate questions remain held. Questions actually addressed in S016–S018, with S005/S007’s other-law preservation. dol.gov+2
R022-P1-C043 Section 778.224 identifies loans/advances and qualifying tuition benefits as possible regular-rate exclusions. Its conditions concern payments not compensating hours, services, or work quality/quantity; certain eligibility or repayment conditions do not themselves defeat exclusion. Exclusion from regular rate is not recoupment authorization. S009, complete §778.224(a)–(b); S023, final text. govinfo.gov

D. Hours, regular rate, payment, and records

Claim ID Finding, conditions, and exceptions Support
R022-P1-C044 Section 785.27 excludes training time under its general test only if all four conditions hold: outside normal hours, voluntary attendance, not directly job-related, and no productive work. Required attendance or reasonably perceived employment consequences defeats voluntariness under §785.28. S011, §§785.27–.29. ecfr.gov
R022-P1-C045 Sections 785.30–.31 separately address an employee’s own-initiative independent schooling and qualifying voluntary, after-hours employer programs corresponding to bona fide independent education. Those conditions require their own analysis; tuition funding alone does not determine compensable hours. S011; S016’s express cross-reference. ecfr.gov+1
R022-P1-C046 Section 207(e) starts with all remuneration for employment and provides eight statutory exclusion categories. Only applicable exclusions may be removed. The employee’s actual regular rate is not created merely by naming a figure “regular rate.” S003, §207(e); S009, §§778.1, .108. uscode.house.gov+2
R022-P1-C047 Under the general calculation, regular rate in dollars/hour equals includable workweek remuneration in dollars divided by hours for which that compensation was paid. A single hourly rate with no other includable remuneration gives the simpler hourly-rate case. Salary, commissions, and bonuses can require different inputs. S009, complete §§778.109–.110. ecfr.gov
R022-P1-C048 Reasonable reimbursement of expenses incurred in furtherance of the employer’s interests may be excluded from regular rate. Section 778.217’s current test does not require sole employer benefit. This addresses reimbursement treatment, not a universal reimbursement obligation or clawback right. S003, §207(e)(2); S009, §778.217(a)–(b); S023. ecfr.gov+1
R022-P1-C049 Section 778.217 excludes only actual or reasonably approximate expense reimbursement; disproportionate excess is included. Its business-travel safe harbor requires both the specified government-rate ceiling and the other section conditions; exceeding the ceiling is not automatically unreasonable. Ordinary personal commuting, lunch, and rent do not qualify under that expense clause. S009, complete §778.217(c)–(d); S023. No current mileage/per-diem rate adopted. ecfr.gov+1
R022-P1-C050 Section 778.315 states that overtime is not paid unless straight-time compensation due under contract or statute is also paid. The bona fide particular-item deduction framework must be distinguished from simply withholding agreed wages. No general judicial “gap-time” holding is asserted. S009, complete §778.315; S015, §32j02. ecfr.gov+1
R022-P1-C051 Overtime ordinarily is due on the regular payday for the period in which the week ends. If the correct amount cannot then be determined, §778.106 requires payment as soon as practicable and no later than the next payday after calculation becomes possible. This is not blanket permission to delay payroll. S009, complete §778.106; S018, Q2/A2. ecfr.gov+1
R022-P1-C052 Under §207(h), amounts excluded under §207(e) generally cannot be credited toward minimum wages or overtime; the specified §207(e)(5)–(7) premium credits are separately permitted. An expense reimbursement or loan is therefore not automatically wage payment merely because money changed hands. S003, complete §207(h)(1)–(2). uscode.house.gov
R022-P1-C053 Covered payroll records must distinguish workweek start, daily/weekly hours, pay basis and relevant regular-rate information, straight-time earnings, overtime premium, itemized additions/deductions, total wages, payday and pay period. No particular form is universally mandated. The worksheet below is analytical, not a substitute official record. S006; S010, §§516.1–.2. uscode.house.gov+2
R022-P1-C054 A fixed schedule may support the specified alternative record method only with actual deviations properly recorded. Section 516.3 separately addresses certain exempt employees’ records; it does not establish that an exemption exists. S010, §516.2(c), .3. ecfr.gov+1
R022-P1-C055 Payroll records generally require three years from last entry; listed agreements require three years after last effectiveness. Supporting time/pay and itemized deduction records generally require two years from last entry; wage-rate tables use the specified last-effective-date trigger. These are the selected Part 516 periods, not a universal retention schedule. S010, complete §§516.5–.6. ecfr.gov
R022-P1-C056 Section 516.27 requires facility-cost accounting and specified weekly additions/deductions records where facilities affect minimum wage or overtime. Its exception applies when the week is not subject to overtime and cash alone meets the minimum for all hours; other record duties remain. S010, complete §516.27(a)–(c). ecfr.gov

E. Authority status and currentness claims

Claim ID Finding and limitation Support
R022-P1-C057 Part 531 Subpart C and Part 778 expressly present official DOL interpretations. Their codification does not erase their stated interpretive character or the role of authoritative judicial decisions. S007, §531.25; S009, §§778.1, .3. ecfr.gov+1
R022-P1-C058 DOL describes the FOH as a staff operations resource and warns of update delays. Modernization dates and old numerical examples cannot be treated as proof that every substantive passage is newly updated. S019; S014–S015 headers. U.S. Department of Labor+2
R022-P1-C059 DOL distinguishes Administrator letters from non-Administrator letters. The latter express official policy but are not Administrator rulings for the publisher-described Portal-to-Portal Act reliance treatment. No reliance defense is determined here. S020–S021. dol.gov+1
R022-P1-C060 The statutory bodies used here expressly stop at laws in effect through October 20, 2026. Their current compilation status is evidence of the retrieved text, not proof of a complete October 27 amendment audit. S001–S006 version banners. uscode.house.gov+1
R022-P1-C061 The latest Part 531 and Part 778 displays were current through October 26, 2026; Title 29’s displayed last amendment was October 14. eCFR identifies itself as authoritative but unofficial. Neither date establishes each section’s individual amendment history. S007, S009. ecfr.gov+1
R022-P1-C062 The selected 2011 final-rule amendments were published April 5 and effective May 5, 2011. The complete revised §531.37 and §531.36(a) were checked against the consolidated provisions. S022. federalregister.gov+1
R022-P1-C063 The selected 2019 regular-rate final rule was published December 16, 2019 and effective January 15, 2020. Its reimbursement and tuition-benefit provisions concern regular-rate treatment; their repayment references do not create general debt-enforcement authority. S023. federalregister.gov+1
R022-P1-C064 The retrieved publisher entries for the selected 2004 letters showed their dates and non-Administrator status without a withdrawal marker in those entries. DOL warns that later law, regulations, courts, or withdrawal may affect guidance. Exhaustive continuing validity remains unverified. S020–S021; retrieval bounds in S017–S018. dol.gov+2

5. Two fully specified generic illustrations

These examples illustrate C023–C025. They do not establish an actual employment relationship, debt, lawful deduction, collectible amount, or right to recover.

Common premises

Both examples stipulate:

  • One fixed workweek from 00:00 October 12, 2026 through immediately before 00:00 October 19, 2026, PDT, totaling 168 consecutive hours.
  • Covered, nonexempt employment under the standard §207(a)(1) rule.
  • The general federal minimum, M = 7.25 USD/hour, applies for this federal-only arithmetic.
  • Every stated hour is compensable.
  • The stated hourly rate is the only remuneration; bonuses, tips, facilities, other additions, taxes, other deductions, loans, interest, and fees are each 0 USD.
  • The stated item is an employer-benefiting required item at the stipulated cost.
  • Where the overtime deduction framework is illustrated, a bona fide prior agreement identifies the item and calculation; no evasion is assumed.
  • State/local/tribal law, contract permission, and debt validity remain undetermined.

The governing rules are §§531.35–.37, with FOH §32j08’s stated conditions. ecfr.gov+2

R022-P1-E001 — Required uniform in a nonovertime week

Additional inputs: H = 30 hours; R = 8.00 USD/hour; proposed uniform deduction D = 30.00 USD; overtime hours = 0.

Step Plain-text calculation Result
Gross wages 30 hours * 8.00 USD/hour 240.00 USD
Federal minimum-wage amount 30 hours * 7.25 USD/hour 217.50 USD
Margin above that floor 240.00 USD - 217.50 USD 22.50 USD
Cash remaining after proposed charge 240.00 USD - 30.00 USD 210.00 USD
Shortfall under the stipulated federal test 217.50 USD - 210.00 USD 7.50 USD

All results are exact to cents; no rounding is required.

Meaning: the stipulated 30.00 USD deduction fails this federal minimum-wage test. The 22.50 USD arithmetic margin is not a determination that 22.50 USD is lawfully deductible or collectible. See C021, C023 and C028.

R022-P1-E002 — Above-minimum average pay can still fail the overtime deduction test

Additional inputs: H = 45 hours; R = 10.00 USD/hour; proposed tool deduction D = 115.00 USD; standard straight-time threshold = 40 hours.

Step Plain-text calculation Result
Overtime hours 45 hours - 40 hours 5 hours
Straight-time compensation for all hours 45 hours * 10.00 USD/hour 450.00 USD
Additional overtime premium 5 hours * 0.5 * 10.00 USD/hour 25.00 USD
Gross compensation before deduction 450.00 USD + 25.00 USD 475.00 USD
Maximum margin under the stipulated particular-item framework 40 hours * (10.00 USD/hour - 7.25 USD/hour) 110.00 USD
Required remaining amount under that framework (40 hours * 7.25 USD/hour) + (5 hours * 1.5 * 10.00 USD/hour) 365.00 USD
Remaining amount after proposed deduction 475.00 USD - 115.00 USD 360.00 USD
Shortfall 365.00 USD - 360.00 USD 5.00 USD
Misleading final average 360.00 USD / 45 hours 8.00 USD/hour

All results are exact to cents; no rounding is required.

Meaning: 8.00 USD/hour exceeds 7.25 USD/hour, yet the stipulated deduction exceeds the permitted straight-time margin by 5.00 USD. The regular rate remains 10.00 USD/hour for this example. If the required prior agreement or another material predicate is missing, this conditional deduction model cannot simply be applied. See C024–C025 and C050.

L001 — OLRC routes Some older view.xhtml routes returned errors. Current section bodies were recovered through OLRC navigation using the complete URLs in S001–S006. Findings use the recovered bodies and their October 20 cutoff; failed routes are not evidence of absent law.
L002 — eCFR section routes Some individual section URLs, including §§531.30, .31, .33, .40 and .778.224, were inaccessible. Their material text was available in the consolidated parts. Those provisions were read in S007/S009; the failure does not create a substantive gap in those clauses.
L003 — eCFR access redirect A §778.109 route redirected to an access-request page. No access request or workaround was attempted. The clause was read in the accessible consolidated Part 778.
L004 — Fact Sheet 16 The clean route https://www.dol.gov/agencies/whd/fact-sheets/16-flsa-wage-deductions initially returned 403. Complete substantive text was recovered at the S013 publisher URL; same instrument, not corroboration.
L005 — FOH Chapter 30 Initial PDF retrieval failed; later retrieval succeeded. Selected complete provisions were read as parsed PDF text with indices recorded. No pixel-inspection claim.
L006 — FOH Chapter 32 Direct HTML and the PDF route https://www.dol.gov/sites/dolgov/files/WHD/legacy/files/FOH_Ch32.pdf failed. Complete material §32j08 text and the modernization header were recovered through indexed primary publisher text. Full chapter/history not claimed.
L007 — FLSA2004-17NA Direct PDF attempts failed or timed out. Printed-page text was recovered through primary indexing. PDF container/index and visual layout remain unverified.
L008 — FLSA2004-19NA Original and alternative publisher PDFs failed. Page 1 material responses were recovered. Page 2 remains a source gap. The cited 1977/1998 enclosures were not treated as independently reviewed authority.
L009 — opinion-status page Direct status-page retrieval failed. Primary indexed status text was used with that limitation disclosed.
L010 — final rules Federal Register HTML and GovInfo PDFs were available. Relevant dates and operative provisions were read; formats are grouped under S022/S023. Unrelated provisions were not treated as researched.
L011 — historical examples and cross-citations Handbook text contains old dollar examples and references other legal authorities. Old figures were not adopted as current; cited cases, enclosures, and unrelated programs were not silently counted as read.

8. Explicit remaining gaps and parent holds

The following are unresolved or excluded, rather than inferred away:

  1. Actual predicates: employment status, employer status, enterprise/individual coverage, exemption, workweek, hours, rate, remuneration, overtime, facility, cost, benefit, consent, payment, deduction, reimbursement, advance, principal, fees, overpayment, and termination facts.
  2. Source completeness: FLSA2004-19NA page 2; the 1977/1998 enclosures cited by the 2004 letters; full later-history clearance of the selected guidance; and a complete session-law/amendment audit after the statutory compilation cutoff.
  3. Transaction boundaries: whether a particular alleged “loan” is an actual advance, shifted business cost, wage revision, contingent benefit, or penalty; whether a disputed overpayment exists; and how an unusual reimbursement or posttermination payment should be allocated among weeks.
  4. Unestablished A022 outcomes: general training-repayment enforceability; tuition structures outside the examined advance; signing, retention, and relocation clawbacks; equipment repayment beyond the examined wage-floor predicates; and employer loans beyond the narrow principal/fee distinction.
  5. Preserved legal dimensions: contract formation, enforceability, choice of law, state/local/tribal wage and contract law, licensing, consumer credit, APR/usury, liens, garnishment and CCPA, hardship or settlement, collection methods, credit reporting, limitations, remedies, litigation, tax, insolvency, international/country law, and every other unaddressed A022 dimension.

The same holds apply to any product rule or workflow that might later use this research. A source-supported federal wage-floor proposition is not an operational approval.

Researcher self-check — not independent review

  • Current primary statutory and regulatory bodies were used, with their actual displayed version bounds.
  • The complete free-and-clear clause and material facility/deduction conditions were read.
  • Direct deductions and separate reimbursements were tested under the same relevant wage-protection framework.
  • Genuine advanced principal was separated from fees and business-cost shifting.
  • The overpayment and tuition interpretations retained their factual and retrieval limits.
  • Minimum wage, regular rate, overtime, and pay-period/workweek distinctions were kept separate.
  • Both examples state their periods, inputs, units, arithmetic, and rounding treatment.
  • No actual classification, wage amount, debt validity, collection right, garnishment amount, or governing state-law result was determined.
  • No subagents, prior-chat foundation, unreviewed Library foundation, actual-party records inquiry, or docket-status inquiry was used.
  • Model-selector/UI provenance was not verified or represented as verified.
  • No independent review, component acceptance, parent acceptance, operations acceptance, or publication acceptance is asserted.

Current statutory bodiesThe retrieved OLRC bodies state that they contain laws in effect through Public Law 119-134, October 20, 2026.That compilation cutoff is not a completed session-law audit through October 27. See C060.
Current regulatory bodiesThe latest retrieved Part 531 and Part 778 bodies displayed October 26, 2026 currency. Other retrieved snapshots and their dates are identified below.A title-wide amendment date does not establish when each particular provision changed. See C061.
Historical final rules relevant to current textThe selected 2011 wage-payment amendments and 2019 regular-rate amendments were read with their effective dates and operative provisions.Their historical publication does not substitute for the current consolidated text. See C062–C063.
Older agency interpretationsThe 1984 Administrator letter, two 2004 non-Administrator letters, and selected handbook provisions were examined within the stated retrieval bounds. These retain their interpretive or enforcement status; publication on a current website does not make them statutes or establish exhaustive later-history clearance.
Future-effective or proposed materialNone is used as an operative rule in this answer. No comprehensive inventory of pending proposals or future amendments was performed.
Withdrawn, stayed, or vacated materialNo material identified as withdrawn, stayed, or vacated is used as operative authority here.No comprehensive judicial-history or withdrawal audit was completed. The publisher checks and remaining uncertainty are specified in C059 and C064.
Judicial opinionsNo judicial opinion was necessary to report the bounded statutory, regulatory, and agency positions selected here.No judicial holding, posture, disposition, or subsequent case history is represented as examined. Broader judicial treatment of clawbacks remains open.

R022-P1-C001FLSA status begins with the statutory employment relationship: “employ” includes suffering or permitting work; “employer” and “employee” have defined scopes and exclusions. A job or contract label alone does not establish those predicates. No complete employee/contractor determination is made here.S001, §203(d), (e), (g). uscode.house.gov +1
R022-P1-C002Ordinary enterprise coverage requires the relevant commerce/materials-handling predicate and at least $500,000 annual gross sales or business, excluding separately stated retail excise taxes. Specified institutions and public agencies have separate routes; $500,000 is not universal. Enterprise aggregation and the owner/immediate-family-only establishment exclusion also matter.S001, §203(r), (s). uscode.house.gov
R022-P1-C003Failure to establish enterprise coverage does not resolve individual coverage. An employee’s own covered interstate-commerce or production activities can independently bring the employment within §§206 and 207. The actual activities remain unknown.S002–S003; S012, individual coverage. U.S. Department of Labor
R022-P1-C004Section 213(a)(1)’s qualifying executive, administrative, professional, and outside-sales exemptions concern minimum wage and overtime, subject to its terms and regulations; §213(b) exemptions concern overtime. Section 541.2 rejects job-title-only exemption decisions. Applicable duties/pay requirements must actually be met.S004; S008. uscode.house.gov +2
R022-P1-C005The state/local public-agency volunteer exclusion has specific conditions: no compensation beyond permitted expenses, reasonable benefits or nominal fee, and no volunteering the same type of services for the agency that employs the individual. It is not a general “volunteer” label exemption.S001, §203(e)(4). uscode.house.gov
R022-P1-C006Section 213(f) separately limits geographic application of §§206, 207, 211, and 212 by reference to the workplace during the workweek. No actual foreign-country or territorial application is established.S004, §213(f). uscode.house.gov
R022-P1-C007The general §206(a)(1)(C) federal minimum is $7.25 per hour, effective July 24, 2009. That is the verified general federal rate used in the illustrations, subject to coverage and special-rule gates. It is not a state/local rate determination.S002; S022’s rate history. uscode.house.gov +1
R022-P1-C008The general §206(g) initial-employment provision permits $4.25 for qualifying employees under 20 during the first 90 consecutive calendar days, with anti-displacement conditions. Territorial and other special provisions require separate predicates. No such special-rate eligibility is assumed here.S002, §206(g), including its separately stated territorial provisions. uscode.house.gov
R022-P1-C009Under the standard §207(a)(1) rule, covered nonexempt work over 40 hours in a workweek requires compensation at least 1.5 times the employee’s regular rate. Merely preserving the minimum wage does not establish overtime payment.S003, §207(a)(1); S009, §§778.107–.110. uscode.house.gov +1
R022-P1-C010Selected alternative periods require their own conditions. Section 207(j) permits a qualifying, previously agreed 14-day arrangement for specified institutions, with daily-over-eight and period-over-80 protections. Section 207(k) separately addresses qualifying public fire/law-enforcement periods. Neither follows from a payroll label.S003, complete §207(j)–(k). uscode.house.gov
R022-P1-C011The standard workweek is a fixed recurring 168 hours. Weeks cannot be averaged merely because payroll is biweekly, semimonthly, or monthly. A workweek change must satisfy the permanence/non-evasion condition; actual start and end points remain necessary.S009, §§778.104–.105. ecfr.gov +1
R022-P1-C012Section 218(a) preserves applicable higher minimum wages and shorter maximum workweeks and prevents using the FLSA as justification for lowering existing standards. Section 531.26 likewise preserves compatible wage-payment restrictions. Passing this federal test does not establish state-law or contractual permission.S005; S007, §531.26. uscode.house.gov +1

R022-P1-C013Required wages ordinarily must be cash or a negotiable instrument payable at par. Section 203(m)(1) conditionally includes customary board, lodging, or other facilities; an applicable Secretary-determined fair value can replace actual cost. A qualifying collective-bargaining exclusion must be honored.S001, §203(m)(1); S007, §§531.2, .6, .27–.29. uscode.house.gov +2
R022-P1-C014Section 531.3 limits reasonable cost to actual cost without employer/affiliate profit. Its default facilities calculation includes operation, maintenance, adequate depreciation and a capital-interest allowance not exceeding 5.5%, subject to the fair-rental/fair-price cap and accounting conditions. That allowance is not authorization to charge employee-loan interest.S007, complete §531.3(a)–(c), .33. ecfr.gov
R022-P1-C015Costs primarily benefiting or serving the employer cannot be credited as reasonable-cost wages. The nonexclusive examples include trade tools, business materials/services, employer construction, and required uniforms and laundering.S007, §531.3(d). ecfr.gov
R022-P1-C016Potential employee facilities include meals, housing, ordinary merchandise/clothing, personal utilities, and qualifying transportation. Section 531.32 also specifically mentions tuition furnished by a college to student employees; that is not a general training-repayment rule. Employer stock is not an “other facility.”S007, complete §531.32. ecfr.gov
R022-P1-C017Facility-credit analysis requires actual benefit, customary furnishing, and the regulation’s voluntary, uncoerced acceptance requirement. Section 531.31 excludes unlawful furnishing from customary furnishing. A label such as “employee benefit” does not establish these predicates.S007, §§531.30–.31. ecfr.gov
R022-P1-C018The text treats meals as primarily employee-benefiting. FOH 30c09(b) separately states WHD’s policy not to enforce voluntary acceptance for meals where the credit does not exceed actual cost. This is a limited enforcement position, not deletion of §531.30.S007, §531.32(c); S014, §30c09(b). ecfr.gov +1
R022-P1-C019The complete §531.35 rule requires required wages to be paid finally and unconditionally. It reaches direct or indirect kickbacks to the employer or another for its benefit, whether returned in cash or another form. The applicable minimum-wage/overtime impact must then be tested.S007, complete §531.35. ecfr.gov
R022-P1-C020Required trade tools violate the rule in a workweek when their cost cuts into required minimum or overtime wages. Other expressly identified employer costs include necessary business transportation, required uniform rental, employer-obligated medical services, and employer-required examinations. Attribution and applicable facts still matter.S007, §§531.32(c), .35; S013. ecfr.gov +2
R022-P1-C021Uniforms required by law, the employer, or the nature of the business are treated as employer expenses. Their purchase and required maintenance cannot reduce protected minimum or overtime wages.S007, §531.3(d); S013. ecfr.gov +1
R022-P1-C022DOL’s deduction guidance applies the protected-wage limitation to shortages, employer-property damage, customer nonpayment, and theft losses, including employee negligence. A claimed loss does not become a genuine loan merely by being described as a debt.S013; S017’s business-expense distinction. U.S. Department of Labor +1
R022-P1-C023In a nonovertime week, §531.36 protects the applicable minimum. Eligible facility credits may reduce cash below that floor if all credit conditions hold. Its treatment of facility profit is limited to the extent protected wages are impaired; it is not general approval of above-floor deductions.S007, complete §531.36. ecfr.gov
R022-P1-C024In an overtime week, qualifying particular-item deductions cannot exceed what could be deducted for the maximum straight-time hours, cannot evade overtime or other law, and cannot replace payment of full wages. Regular rate is determined before deductions. Eligible reasonable-cost facilities receive the separately stated treatment.S007, complete §531.37(a)–(b); S022. ecfr.gov +1
R022-P1-C025FOH 32j08 requires prior agreement or understanding before the work, particular identified items, knowledge of how amounts are determined, and affirmative assent. Writing is not its universal FLSA requirement, but the employer bears proof of agreement. Otherwise-illegal or non-bona-fide charges do not qualify.S015, §32j08(b)–(d). U.S. Department of Labor
R022-P1-C026Inference from the preceding provisions: signed consent alone does not satisfy the benefit, cost, wage-floor, overtime, timing, anti-evasion, or other-law conditions. Agreement is one predicate in certain rules, not a waiver of all protections.C015, C019, C024–C025; S007, S015. govinfo.gov +1
R022-P1-C027Cash reimbursement outside payroll does not avoid the free-and-clear rule. An actual demand still requires examination of payment, beneficiary, amount, and workweek attribution; the selected provisions do not resolve every posttermination collection scenario.S007, §531.35; S013’s cash-reimbursement discussion. ecfr.gov +1
R022-P1-C028DOL allows installment deductions only while each relevant week remains compliant. FOH 30c12(e) separately requires the necessary reimbursement for a worker-purchased required uniform by the regular payday for the expense week; it rejects spreading that required reimbursement over the garment’s life.S013; S014, §30c12(e). U.S. Department of Labor +1
R022-P1-C029FOH distinguishes ordinary street clothing from sufficiently specified uniforms. Its maintenance exceptions address genuinely ordinary wash-and-wear care, offered free laundry voluntarily declined, and voluntarily purchased extra uniforms beyond an adequate supplied quantity. The wash-and-wear policy does not cover daily required washing when only one uniform is supplied.S014, §30c12(a)–(g). dol.gov +1
R022-P1-C030Employee-assessed taxes actually forwarded to the proper government agency may count as wages under §531.38. Employer-borne taxes may not be shifted under that provision. Thus bank-deposit net pay alone is not the complete wage-floor measure.S007, complete §531.38. ecfr.gov
R022-P1-C031Section 531.40 conditionally treats an employee-directed payment to an independent third party as wages: actual payment for the employee’s benefit, no direct/indirect employer-side benefit or profit, and no evasion. It does not supply the employer-loan exception.S007, complete §531.40(a)–(c). ecfr.gov
R022-P1-C032Section 531.39 separately addresses court-ordered third-party payments and expressly cross-references CCPA limits. No garnishment entitlement, percentage, disposable-earnings amount, or calculation is determined here.S007, complete §531.39; CCPA component excluded. ecfr.gov
R022-P1-C033Eligible facilities furnished in addition to cash generally enter the regular-rate calculation at the prescribed reasonable cost or applicable fair value. Facilities therefore cannot simply be ignored when assessing overtime.S007, §531.37(b); S009, complete §778.116. ecfr.gov +1

R022-P1-C034DOL’s 1984 Administrator letter and FOH 30c10 treat genuine loan or cash/wage-advance principal as recoverable through deductions even when minimum wage or overtime is affected. The letter includes final-pay recovery and does not require a written agreement, while emphasizing proof of the loan and terms.S016, situation (1); S014, §30c10. This is an agency interpretation of actual advanced money. dol.gov +1
R022-P1-C035The same interpretation expressly withholds that treatment from interest or administrative expenses to the extent they cut into minimum wage or overtime. Calling a business charge “principal” does not establish that money was advanced.S016, situation (1); S014, §30c10. dol.gov
R022-P1-C036FLSA-834 addresses cash advanced to an employee who pays school tuition, forgiven if employment continues through course completion and a grade of C or better is achieved. DOL permitted the described recoupment if the employee clearly understood the policy before accepting payment. That is a specific fact pattern.S016, situation (2), PDF indices 0–1. dol.gov
R022-P1-C037FLSA2004-17NA addresses vacation permitted before accrual, with an understood advance-repayment policy. It treats that voluntarily accepted advance as deductible from final pay despite minimum-wage or overtime impact, subject to its facts and other-law warning.S017, printed p.1; qualifications also reviewed. dol.gov
R022-P1-C038That vacation letter limits the amount to the rate paid when the vacation money was advanced, rather than a higher termination-date rate. It also rejects below-minimum-wage administrative charges or interest and flags potentially prohibitory state law.S017, printed p.1. dol.gov
R022-P1-C039In FLSA2004-19NA’s specific inadvertent vacation-overpayment scenario, DOL applied its principal-advance position to recoupment without employee permission, in the next or later pay period. This establishes the published response to that scenario—not every alleged overpayment. The letter’s second page remains unread.S018, printed p.1, Q1/A1 and Q3/A3. dol.gov
R022-P1-C040Bounded conclusion: final pay is not established as a general exception to wage protection. The selected affirmative final-pay interpretations concern specifically described advances, with their assumptions. They do not validate every termination charge or decide a state final-pay deadline.S016–S018; C019–C025, C034–C039. dol.gov +2
R022-P1-C041Unresolved beyond those narrow predicates: general training repayment, tuition reimbursement of a different structure, signing/retention or relocation clawbacks, disputed recalculated earnings, and equipment “loans” that may shift business costs. Neither the tuition letter nor a regular-rate exclusion supplies a universal recoupment rule.Scope comparison of S007, S016–S018 and S023; no broader holding inferred. dol.gov +2
R022-P1-C042Scope conclusion: the selected deduction interpretations do not establish a cause of action to sue, enforceable contract terms, a collectible balance, or permission for every collection method. Those separate questions remain held.Questions actually addressed in S016–S018, with S005/S007’s other-law preservation. dol.gov +2
R022-P1-C043Section 778.224 identifies loans/advances and qualifying tuition benefits as possible regular-rate exclusions. Its conditions concern payments not compensating hours, services, or work quality/quantity; certain eligibility or repayment conditions do not themselves defeat exclusion. Exclusion from regular rate is not recoupment authorization.S009, complete §778.224(a)–(b); S023, final text. govinfo.gov

R022-P1-C044Section 785.27 excludes training time under its general test only if all four conditions hold: outside normal hours, voluntary attendance, not directly job-related, and no productive work. Required attendance or reasonably perceived employment consequences defeats voluntariness under §785.28.S011, §§785.27–.29. ecfr.gov
R022-P1-C045Sections 785.30–.31 separately address an employee’s own-initiative independent schooling and qualifying voluntary, after-hours employer programs corresponding to bona fide independent education. Those conditions require their own analysis; tuition funding alone does not determine compensable hours.S011; S016’s express cross-reference. ecfr.gov +1
R022-P1-C046Section 207(e) starts with all remuneration for employment and provides eight statutory exclusion categories. Only applicable exclusions may be removed. The employee’s actual regular rate is not created merely by naming a figure “regular rate.”S003, §207(e); S009, §§778.1, .108. uscode.house.gov +2
R022-P1-C047Under the general calculation, regular rate in dollars/hour equals includable workweek remuneration in dollars divided by hours for which that compensation was paid. A single hourly rate with no other includable remuneration gives the simpler hourly-rate case. Salary, commissions, and bonuses can require different inputs.S009, complete §§778.109–.110. ecfr.gov
R022-P1-C048Reasonable reimbursement of expenses incurred in furtherance of the employer’s interests may be excluded from regular rate. Section 778.217’s current test does not require sole employer benefit. This addresses reimbursement treatment, not a universal reimbursement obligation or clawback right.S003, §207(e)(2); S009, §778.217(a)–(b); S023. ecfr.gov +1
R022-P1-C049Section 778.217 excludes only actual or reasonably approximate expense reimbursement; disproportionate excess is included. Its business-travel safe harbor requires both the specified government-rate ceiling and the other section conditions; exceeding the ceiling is not automatically unreasonable. Ordinary personal commuting, lunch, and rent do not qualify under that expense clause.S009, complete §778.217(c)–(d); S023. No current mileage/per-diem rate adopted. ecfr.gov +1
R022-P1-C050Section 778.315 states that overtime is not paid unless straight-time compensation due under contract or statute is also paid. The bona fide particular-item deduction framework must be distinguished from simply withholding agreed wages. No general judicial “gap-time” holding is asserted.S009, complete §778.315; S015, §32j02. ecfr.gov +1
R022-P1-C051Overtime ordinarily is due on the regular payday for the period in which the week ends. If the correct amount cannot then be determined, §778.106 requires payment as soon as practicable and no later than the next payday after calculation becomes possible. This is not blanket permission to delay payroll.S009, complete §778.106; S018, Q2/A2. ecfr.gov +1
R022-P1-C052Under §207(h), amounts excluded under §207(e) generally cannot be credited toward minimum wages or overtime; the specified §207(e)(5)–(7) premium credits are separately permitted. An expense reimbursement or loan is therefore not automatically wage payment merely because money changed hands.S003, complete §207(h)(1)–(2). uscode.house.gov
R022-P1-C053Covered payroll records must distinguish workweek start, daily/weekly hours, pay basis and relevant regular-rate information, straight-time earnings, overtime premium, itemized additions/deductions, total wages, payday and pay period. No particular form is universally mandated. The worksheet below is analytical, not a substitute official record.S006; S010, §§516.1–.2. uscode.house.gov +2
R022-P1-C054A fixed schedule may support the specified alternative record method only with actual deviations properly recorded. Section 516.3 separately addresses certain exempt employees’ records; it does not establish that an exemption exists.S010, §516.2(c), .3. ecfr.gov +1
R022-P1-C055Payroll records generally require three years from last entry; listed agreements require three years after last effectiveness. Supporting time/pay and itemized deduction records generally require two years from last entry; wage-rate tables use the specified last-effective-date trigger. These are the selected Part 516 periods, not a universal retention schedule.S010, complete §§516.5–.6. ecfr.gov
R022-P1-C056Section 516.27 requires facility-cost accounting and specified weekly additions/deductions records where facilities affect minimum wage or overtime. Its exception applies when the week is not subject to overtime and cash alone meets the minimum for all hours; other record duties remain.S010, complete §516.27(a)–(c). ecfr.gov

Corrections, review and scope

Read the evidence with its boundaries. These are saved research components, including revisions. A scoped coordinator review checks selected evidence; it does not certify every claim, a complete jurisdiction, current law or individual applicability. Dates and access limits remain attached to the records.
