Federal credit-card payment crediting, excess-payment allocation, and credit-balance refunds

The central finding is that these rules govern three different things: receipt of a payment controls its effective crediting date; the amount above the required minimum payment controls the allocation rule; and an actual credit balance exceeding $1 triggers the credit-balance provisions. Paying more than the minimum does not, by itself, create money refundable to the consumer. Nor does timely crediting establish that the full amount needed to avoid interest was paid. Actual source-access date: October 27, 2026, America/Los_Angeles. Research basis: Fresh public primary-source reading for this assignment. No A005/R005 report or other research report was used as a foundation. Review status: Researcher self-check only; not independent review, component acceptance, or parent acceptance. Provenance limitation: I cannot independently verify the chat interface’s selected model or tier and make no claim that its selector showed GPT-6 Pro.

Material source-status qualification

The substantive payment rules and associated official interpretations were recovered from CFPB regulation pages, with the operative regulations also checked against retrieved eCFR bodies. The CFPB version index identified April 8, 2026 as its current Part 1026 version. Retrieved eCFR packets identified Title 12 as updated through October 22, 2026 for §§ 1026.10 and .53, and October 23, 2026 in the later § 1026.11 packet. Those are publisher/version observations, not findings that these particular sections were amended on those dates. eCFR itself distinguishes its continuously updated text from an official legal edition of the CFR. Consumer Financial Protection Bureau+3

Current House Code body requests failed through the routes recorded below. I therefore read the necessary statutory bodies in the official 2024 U.S. Code edition on GovInfo. Search-index descriptions of newer House compilations were not substituted for body reading. Accordingly, the findings below are substantively developed, but verification against a successfully retrieved current House statutory body and a complete subsequent session-law/CFR amendment audit remains partial. This limitation attaches to every statutory-currentness assertion.

1. Principal findings and scope

The general open-end crediting and credit-balance provisions have broader coverage than § 1026.53’s allocation rule. The latter applies to a credit card account under an open-end, not home-secured, consumer credit plan, subject to the governing definitions and exemptions. A home-equity plan accessed by a card and specified overdraft arrangements are excluded from that defined category. Charge cards, however, are generally included in references to credit cards and covered credit-card accounts; their absence of a periodic interest rate is not a blanket exclusion. Consumer Financial Protection Bureau+2

The principal operational distinctions are:

Subject Supported finding Boundary that must remain visible
Crediting Generally credit a payment as of receipt, with the exceptions in § 1026.10. Posting, receipt, collection of a check, available credit, and debt forgiveness are different questions.
Conforming payment Reasonable requirements and method-specific cutoffs matter. A creditor-promoted method generally produces conforming payments when the applicable conditions are met. The creditor cannot automatically invoke the nonconforming-payment delay for a method it promotes.
Nonconforming payment When qualifying requirements were specified on or with the statement and a nonconforming payment is accepted, crediting is generally required within five days of receipt. The provision says “days,” not “business days”; it is not a universal five-day processing allowance.
Excess allocation Ordinarily allocate the amount above the required minimum to balances in descending APR order. Minimum-payment allocation is not prescribed by this general excess-only rule.
Deferred interest Special treatment applies during the promotion, including priority near expiration. A true zero-rate promotion and a recurring grace period are not automatically deferred-interest programs.
Consumer allocation requests Specified deferred-interest and secured-balance exceptions permit issuer acceptance of consumer instructions. The issuer generally may decline a request and follow the applicable default rule.
Credit balance A qualifying credit balance exceeding $1 must be credited, with request-based and aged-balance refund duties. An excess payment above the minimum, a zero balance, or a disputed merchant charge is not necessarily a refundable credit balance.
Refund clocks Written-request receipt starts the seven-business-day rule; more than six months of remaining credit balance triggers a good-faith effort. These are different triggers. Neither supplies a universal immediate cash-refund rule on closure.

Authorities and exact predicates for these findings appear in the claim register below. Consumer Financial Protection Bureau+4

  • R: Supported by the regulatory body or official interpretation actually read.
  • S: Supported by statutory text actually read in the official 2024 edition; current-body limitation remains.
  • I: Expressly identified inference or limitation drawn from the identified provisions.
  • U: Actual application remains unknown because the relevant facts or additional authority were not investigated.

All claims retain the source-version limits above. “Covered account” never substitutes for establishing the applicable consumer, product, actor, exemption, and provision-specific predicates.

A. Coverage and actors

Claim ID Area and precise claim Trigger, conditions, exceptions Source pinpoint Status / limit
R009-P1-C001 Consumer coverage depends on credit primarily for personal, family, or household purposes. The statutory consumer-transaction definition refers to a natural person; regulatory cardholder and specified trust rules require their own treatment. A consumer-facing label alone is insufficient. S003, § 1602(i); S005, § 2(a)(11)–(12), comments 2(a)(11)-1, -3 and 2(a)(12)-1. S/R; actual purpose and status U.
R009-P1-C002 Open-end credit ordinarily requires a plan contemplating repeated transactions, possible finance charges on unpaid balances, and generally replenishing credit. All three regulatory criteria matter. Card-issuer provisions also bring specified no-finance-charge and closed-end card arrangements within relevant Subpart B rules; “not ordinary revolving credit” is not a universal exclusion from §§ 10–11. S003, § 1602(g), (j); S005, § 2(a)(17)(iii)–(iv), (20), comments 2(a)(17)(iii)-1, 2(a)(17)(iv)-1, 2(a)(20)-1–5. S/R; specialized closed-end applications otherwise held.
R009-P1-C003 A card issuer is the issuer or its agent with respect to the card; “creditor” has provision-specific routes. Mere card production or data processing does not alone establish agency. Section 10(e) separately expands its own creditor definition to specified payment processors. S003, § 1602(g), (o); S005, § 2(a)(7), (17), comment 2(a)(7)-1; S006, § 10(e). S/R; agency and actual creditor status U.
R009-P1-C004 Regulatory cardholder status can include a natural person agreeing with the issuer to pay consumer-card obligations issued to another. The commentary distinguishes a co-obligor/guarantor from a merely authorized user. This definition does not itself decide contract liability, joint ownership, or entitlement to a particular refund. S005, § 2(a)(8), comment 2(a)(8)-1–4. R; liability/refund ownership U.
R009-P1-C005 The narrow covered-credit-card-account definition excludes a § 1026.40 home-equity plan accessed by a card and the specified overdraft lines. The account-number overdraft exclusion has an express exception for a hybrid prepaid-credit card accessing a covered separate credit feature. A debit card without a credit feature is not automatically a credit card. S005, § 2(a)(15)(i)–(ii), comments 2(a)(15)-2 and -4. R; full hybrid-prepaid classification held.
R009-P1-C006 A charge card is a credit card for which no periodic rate computes a finance charge; references to covered card accounts in Subparts B and G generally include charge cards. Particular sections contain express distinctions. Section 53 still requires an actual excess amount and allocable balances; no interest-bearing balance is invented for a charge card. S005, § 2(a)(15)(iii), comment 2(a)(15)-3; S007, § 53(a). R/I; product features U.
R009-P1-C007 General-purpose, store, cash-advance, balance-transfer, promotional, and non-home-secured secured-card labels do not independently displace the core coverage tests. The actual plan, access device, consumer purpose, security, balances, and exemptions control. A secured balance can expressly fall within § 53(b)(2). S005, § 2(a)(15), (20); S007, § 53(a), (b)(2), comment 53-5. I anchored in R; no comprehensive subtype acceptance.
R009-P1-C008 Business-purpose cards do not acquire these consumer operational protections merely through occasional personal use; consumer-purpose cards do not lose them through occasional business use. Section 3(a)’s commercial/organizational exclusions and the limited § 12(a)–(b) exceptions must be distinguished. Those exceptions are not a general extension of §§ 10, 11, or 53 to business cards. S003, § 1603(1); S005, § 3(a), comments 3-1, 3(a)-2 and 2(a)(8)-4. S/R; actual mixed-purpose classification U.
R009-P1-C009 The high-value exemption can matter even to an open-end account. The 2026 threshold is $73,400. The relevant route is an initial extension exceeding the then-applicable threshold or a qualifying firm written commitment at opening—not merely a later displayed balance. Real-property/principal-dwelling security and private-education exceptions must be respected. S005, § 3(b)(1), comment 3(b)-3.xvii; S012, comments 3(b)-4.i and -6(i). R; threshold effective Jan. 1–Dec. 31, 2026; actual exemption U.
R009-P1-C010 An exemption’s history matters: initial-extension and firm-commitment routes do not have identical persistence rules. Reduction of a qualifying commitment can end that route; a qualifying initial extension can preserve exemption despite later reductions. Combining smaller advances is not the same as the specified single initial advance. Later real-property/principal-dwelling security can end an open-end exemption. S012, comments 3(b)-4.ii–iv, -6(i), -7; legacy transition in -8. R; no actual opening/history determination.
R009-P1-C011 Exclusion from § 53’s narrow account category does not automatically eliminate general open-end crediting or credit-balance duties. A covered home-equity line or non-card open-end plan can remain subject to general § 10 and § 11(a) requirements, while § 10(b)(3), § 10(e), and § 53 have their narrower express scopes. S005, § 2(a)(15)(ii), (17), (20); S006–S008, respective operative clauses. R; no wholesale application of card-specific rules to HELOCs.

These scope conclusions follow the statute/regulation distinction rather than treating all products called “cards” alike. COMMERCE AND TRADE+6

B. Receipt and payment crediting

Claim ID Area and precise claim Trigger, conditions, exceptions Source pinpoint Status / limit
R009-P1-C012 Section 1666c(a) requires prompt posting as specified by regulation and protection against a finance charge when its stated payment conditions are met. Receipt in readily identifiable form by 5 p.m. on the due date, in the amount, manner, and location indicated to avoid the charge. This is not a rule that every timely minimum payment prevents all interest. S001, § 1666c(a). S; read with implementing regulation.
R009-P1-C013 Section 10(a) generally requires crediting as of receipt, not posting on one particular date. Exceptions: delay produces no finance or other charge, or paragraph (b) applies. Posting date alone therefore does not establish a crediting violation. S006, § 10(a), comment 10(a)-1. R.
R009-P1-C014 A check is received when it reaches the creditor, rather than when the funds are collected. Sending or postmarking is not the identified receipt event. Applicable requirements and cutoffs still matter. S006, comment 10(a)-2.i; § 10(b). R/I; no universal postmark rule.
R009-P1-C015 With a consumer-selected third-party payor, receipt generally occurs when the creditor receives that payor’s check or transfer medium. The payment must satisfy applicable § 10(b) requirements. An instruction to another bank is not automatically receipt by the creditor. S006, comment 10(a)-2.iii. R; actual transfer/agency facts U.
R009-P1-C016 An issuer-website payment is received on the date the consumer authorizes the issuer to effect it. Advance scheduling does not move receipt to the earlier instruction date. An immediate instruction received after 5 p.m. or a later specified cutoff is deemed authorized for the next business day. S006, comment 10(a)-2.iv. R; exact method, authorization date, cutoff, and calendar U.
R009-P1-C017 The specified voluntary payroll arrangement uses the debit from the asset account as receipt, not the earlier payroll deposit. Consumer retains use until the contractual payment date; the commentary separately describes the covered hybrid-prepaid arrangement. This does not establish general setoff or compulsory-autopay authority. S006, comment 10(a)-2.ii. R; cross-referenced setoff/prepaid regimes held.
R009-P1-C018 A creditor may prescribe reasonable requirements enabling most consumers to conform. Examples include an account locator/stub, checks or money orders by mail, U.S. dollars, and a specified address. Ordinary mail/electronic/telephone/in-person cutoffs may not be earlier than 5 p.m. on the due date at the specified receipt location, subject to the branch exception. S006, § 10(b)(1)–(2). R; no universal consumer-local-time assumption.
R009-P1-C019 If requirements were not specified, the commentary supplies implied payment guidelines. Payment at business locations during normal business hours; cash, money order, draft, similar negotiable instrument, or agreed electronic transfer. Comment 10(b)-1 separately flags possible compulsory-EFT restrictions. S006, comments 10(b)-1 and -4. R; full Regulation E analysis excluded.
R009-P1-C020 Creditor-promoted payment methods are treated as conforming under § 10(b)(4)(ii). Promotion can encompass website, telephone, in-person, or specified third-party channels. Applicable permitted cutoffs remain relevant; conformity does not independently prove receipt. S006, § 10(b)(4)(ii), comment 10(b)-2.i–iv. R.
R009-P1-C021 An accepted nonconforming payment generally must be credited within five days of receipt. Qualifying requirements must have been specified on or with the periodic statement. Promoted-method treatment can defeat the asserted nonconformity. Commentary permits finance-charge accrual between receipt and crediting in this branch. S006, § 10(b)(4)(i)–(ii), comment 10(b)-3. R; no general duty to accept every defective tender inferred.
R009-P1-C022 Qualifying in-person payments at a financial-institution issuer’s branch/office count as received that day when made before close of business. Covered not-home-secured consumer card account; accepted branch location; financial institution means bank, savings association, or credit union. Closing time controls, including an earlier-than-5-p.m. closing. S006, § 10(b)(3)(i)–(ii). R.
R009-P1-C023 A merchant retail location is not automatically the issuing financial institution’s branch or office. The commentary specifically addresses merchant-limited and cobranded cards. A merchant payment may still be conforming under other provisions. S006, comment 10(b)-5; § 10(b)(4)(ii). R.
R009-P1-C024 Employee assistance and affiliate relationships affect the in-person branch rule. Teller/employee-assisted payment qualifies; a branch mail slot does not qualify as in-person under this rule. A same-name affiliate accepting issuer-account payments is covered by the stated affiliate interpretation. S006, comments 10(b)-6–7. R; factual relationship U.
R009-P1-C025 Improperly delayed crediting that causes finance or other charges requires an account adjustment during the next billing cycle. The failure must violate § 10(a) or (b) and result in the charges described. This is the section’s account-adjustment duty, not a damages award or complete remedies analysis. S006, § 10(c). R.
R009-P1-C026 If the creditor does not receive or accept mail payments on the due date, the next-mail-business-day protection generally applies. For § 10(d), that next business day means the next day the creditor accepts or receives payments by mail. This is not a universal Monday–Friday definition. S004, § 1637(o)(2); S006, § 10(d)(1), comment 10(d)-1. S/R.
R009-P1-C027 A mail-closure extension does not necessarily extend a different payment channel. If electronic or telephone payments are accepted on the due date, payments made by that channel the next business day need not be treated as timely under § 10(d)(2). Ordinary periodic interest on a no-grace account is not, by itself, late treatment. S006, § 10(d)(2), comment 10(d)-2; S009, comment 5(b)(2)(ii)-2. R; other timing protections not decided.
R009-P1-C028 A separate fee for making a payment is generally prohibited on the specified covered card accounts unless the stated expedited-service exception applies. Section 1637(l) supplies the statutory rule; § 10(e) uses the narrow not-home-secured account category and includes a processor acting for the creditor. A late charge is not classified as this separate payment-method fee merely because payment was late. S004, § 1637(l); S006, § 10(e), comments 10(e)-1, -4. S/R; general late-fee legality held.
R009-P1-C029 The § 10(e) exception requires expedited service involving a live representative or agent. Expedited means same-day crediting, or next-business-day crediting after cutoff. Automated-only service is not a representative; mixed live/automated service may qualify. A consumer’s own transfer service/bill-pay bank is not thereby the creditor’s processor. S006, comments 10(e)-2–4. R; exception is not an all-law permission to charge.
R009-P1-C030 A material issuer change in payment address/procedures can prohibit late-payment fees or finance charges during the specified 60-day period. Required causal link: the change causes material delay. A harmless address-format change or continued successful acceptance at the former address does not establish that predicate. S001, § 1666c(c); S006, § 10(f), comments 10(f)-1–4. S/R; change date and causation U.
R009-P1-C031 The retail-location interpretation has a specific notice-based correction mechanism. If the issuer uses that treatment, notice must reach it no later than 60 days after transmission of the first statement reflecting the affected charge; qualifying charges imposed in the change’s 60-day period must be waived, removed, or equivalently credited. S006, comment 10(f)-3.ii, -4.vi. R; the two 60-day triggers must not be merged.
R009-P1-C032 Section 10(f)’s safe harbor and late-payment-charge concept have limits. The issuer may avoid affected charges for the specified period; waiver/removal/equivalent credit counts. Ordinary periodic interest on an account without a grace period is not automatically a finance charge “for a late payment.” S006, comments 10(f)-3.i and -5. R.
R009-P1-C033 The crediting provisions do not themselves establish instantaneous restoration of available credit, cancellation of debt, or a particular allocation of the payment. This is a limitation of the provisions examined. Other contract, funds-availability, payment-system, or legal requirements may matter. S006, § 10; S005, comment 2(a)(20)-5; S007–S008. I; broader duties U.

C. Excess-payment allocation

Claim ID Area and precise claim Trigger, conditions, exceptions Source pinpoint Status / limit
R009-P1-C034 On a covered card account, the ordinary rule allocates excess above the required minimum first to the highest-APR balance, then other balances in descending APR order. Subject to § 53(b) and official dispute-related interpretation. Product coverage must first be established. S001, § 1666c(b)(1); S007, § 53(a). S/R.
R009-P1-C035 Section 53 does not prescribe the amount of the required minimum or generally dictate how that minimum is allocated. The issuer remains subject to other applicable law and regulatory guidance. Voluntarily using the excess-payment method for the minimum is permitted where otherwise consistent. S007, comment 53-1. R; minimum-setting/allocation law otherwise held.
R009-P1-C036 The issuer may use rates and balances from the preceding cycle’s end, the payment-crediting date, or a date between. The selection generally must be consistent between cycles, although adjustments from time to time are permitted. This does not authorize a rate change or prove the selected APR lawful. S007, comment 53-2 and examples. R; actual valuation practice and lawful rate U.
R009-P1-C037 The commentary generally prescribes no particular allocation among tied-rate balances when at least one other balance has a different rate. Tied balances may be treated together or separately. If all rates are identical, the descending-rate rule itself supplies no differential ranking; that last point is a textual inference, subject to special rules and other law. S007, comment 53-4, example 53-5.iv; § 53(a). R for specified tie case; I for all-identical-rate observation.
R009-P1-C038 Deferred-interest treatment depends on interest accruing but being avoidable, waived, or refunded through full payment by the specified expiration. Applies regardless of required interim payments. A recurring grace period is excluded. A temporary zero APR is not enough unless interest accrued during the period can become payable. S007, comment 53(b)-1; S009, § 16(h)(2), comment 16(h)-1. R; promotional label alone insufficient.
R009-P1-C039 During the relevant deferred-interest period, the balance is treated as having a zero APR for § 53 allocation. Consequently, equal nominal accrual rates do not necessarily create tied allocation rates. The expiration-period exception remains applicable. S007, comment 53-4. R; not a finding that no interest is accruing.
R009-P1-C040 In the default deferred-interest branch, excess goes first to that balance during the two billing cycles immediately preceding expiration; remainder follows § 53(a). Outside that period, ordinary allocation applies, unless a permitted consumer-request allocation is used. The statutory “entire excess” language is implemented with an express rule for any remainder after the deferred balance is satisfied. S001, § 1666c(b)(2); S007, § 53(b)(1)(i)–(ii). S/R; no assumption that “two cycles” equals two calendar months.
R009-P1-C041 Expiration before a cycle’s payment due date changes which cycles count. That expiration cycle is not one of the two immediately preceding cycles under comment 53(b)-2. Its example gives priority in the preceding two cycles and in the preexpiration portion of the expiration cycle. S007, comment 53(b)-2; S005, § 2(a)(4). R; actual cycle/due/expiration dates U.
R009-P1-C042 The issuer is generally not required to follow a consumer’s allocation request. It may decline requests generally or for failure to meet its requirements, provided default allocation complies with § 53(a) or (b)(1)(i). Missing or unusable requests likewise require default allocation unless corrected. S007, § 53(b)(1)(ii), comment 53(b)-3.i. R; no general request-based override.
R009-P1-C043 A qualifying request must be an affirmative consumer instruction, not merely issuer-imposed or preselected language. Commentary recognizes oral/electronic/written instructions, purpose-built submitted forms, and requests to reallocate a prior payment. Preprinted assent, untouched preselected boxes, and conditioning features/services on an allocation are insufficient examples. Issuer acceptance requirements remain relevant. S007, comment 53(b)-3.ii–iii. R.
R009-P1-C044 For a secured balance on a covered not-home-secured card account, the issuer may elect to allocate excess to that balance if the consumer requests it. This is the specific secured-balance option, not a requirement to comply or permission to import § 53 into a home-equity plan. S007, § 53(b)(2), comment 53(b)-3. R; existence and reach of security interest U.
R009-P1-C045 A qualifying § 12(c) claim/defense or § 13 billing-error allegation affects payment allocation. The issuer must avoid or minimize reducing the disputed amount. The official example permits residual application to it when no other amounts remain; a subsequently established billing error still requires the identified correction. Not every informal complaint is assumed to meet the referenced provisions. S007, comment 53-3.i–ii. R; dispute qualification, merits, procedures, and remedies held.

The statutory rule, current regulation, and official commentary must be read together; neither “highest rate first for every dollar” nor “the consumer can always choose” is supported. COMMERCE AND TRADE+5

D. Credit balances and refunds

Claim ID Area and precise claim Trigger, conditions, exceptions Source pinpoint Status / limit
R009-P1-C046 The credit-balance rule is triggered by a credit balance in excess of $1, created through the specified categories. Categories include funds above the total balance due, rebates of unearned finance charges/insurance premiums, and amounts otherwise owed to or held for the consumer. An excess above the minimum alone does not establish this. S002, § 1666d opening clause; S008, § 11(a). S/R; actual ledger balance U.
R009-P1-C047 A qualifying credit balance must be credited to the consumer’s account. This is separate from the request-based refund and aged-balance effort. The provision does not make cash refund immediate in every case. S002, § 1666d(A); S008, § 11(a)(1). S/R.
R009-P1-C048 The statute requires refund upon request; the regulation specifies refund of the remaining credit balance within seven business days after receipt of a written request. The written-request and seven-business-day details appear in the regulation, not the statutory wording. Whether a particular electronic communication legally constitutes the required writing is not determined here. S002, § 1666d(B); S008, § 11(a)(2). S/R; request form/receipt U.
R009-P1-C049 The ordinary § 2(a)(6) business-function definition governs the § 11(a)(2) period. It asks when the creditor’s offices are open to the public for substantially all business functions; limited bill-payment/deposit services alone do not establish that. Section 10(d)’s mail-specific definition is not imported. S005, § 2(a)(6), comment 2(a)(6)-1; S008, § 11(a)(2). R; no calendar calculated.
R009-P1-C050 A creditor may satisfy the obligation earlier, including by immediate refund, refund before written request, or refund on oral/electronic request. These permitted compliance methods do not erase the mandatory written-request trigger or establish that every oral request starts the same seven-business-day clock. S008, comment 11(a)-1.i–iii. R; electronic-writing characterization held.
R009-P1-C051 The creditor need not honor standing orders requesting refunds of future credit balances. This concerns prospective standing orders; it is not a general exception to a qualifying request for an existing credit balance. S008, comment 11(a)(2)-1. R.
R009-P1-C052 Refund amount is the remaining credit balance at the time refund is required. Intervening purchases or other debits, including amounts not yet shown on a periodic statement, may decrease or eliminate it. Their underlying validity is not established merely by appearing in a ledger. S008, comment 11(a)-2. R/I; debit validity U.
R009-P1-C053 A credit balance remaining for more than six months requires a good-faith refund effort. Statutory channels are cash/check/money order; the regulation also lists credit to the consumer’s deposit account. This duty is not conditional on a new written request. S002, § 1666d(C); S008, § 11(a)(3). S/R.
R009-P1-C054 “Unlocated consumer” requires more than a stale address on file. Positive steps are required, including necessary tracing through the last-known address or telephone number, or both. The text’s no-further-action condition requires unknown current location and inability to trace through those sources. S002, § 1666d(C); S008, § 11(a)(3), comment 11(a)(3)-1. S/R; adequacy of an actual effort U.
R009-P1-C055 An unsuccessful qualifying good-faith effort can exhaust the further duties imposed by § 11; an unsuccessful early effort need not be repeated merely at six months. The ultimate disposition of an unsuccessful-refund balance, or a balance of $1 or less, remains governed by other applicable law. This is not creditor ownership or debt-forfeiture authority. S008, comments 11(a)-1.iv and 11(a)(3)-2. R; property/unclaimed-property law held.
R009-P1-C056 Closure alone supplies no express exception to § 11(a)’s credit-balance duties and no express new immediate-cash deadline. This is a textual inference from § 1666d and § 11(a); the separately stated termination provisions do not supply either proposition. Particular closure, security-deposit, or contract obligations remain unexamined. S002; S008, § 11(a)–(b). I; broader closure consequences U.
R009-P1-C057 Zero balance, an unposted payment, a merchant dispute, and a settlement discount are not interchangeable with an established credit balance. A merchant credit or other adjustment can contribute to a credit balance once legally/accountingly owed, but the label or allegation alone does not establish money held for the consumer. S002, opening clause; S006, § 10; S008, § 11(a). I; underlying merits and accounting U.

The statute–regulation differences are substantive enough that the seven-business-day period, written request, and deposit-account refund method should be attributed to the regulation rather than silently inserted into the statutory text. govinfo.gov+3

E. Generic forms, proof, and version limits

Claim ID Area and precise claim Trigger, conditions, exceptions Source pinpoint Status / limit
R009-P1-C058 G-18(D) illustrates placement/proximity of payment information; it is not an account agreement or universal processing instruction. Appendix G allows adjustment for charge-card/revolving features. G-18(F)/(G) contain some optional information and formats. No sample amount, rate, or date was adopted as law. S010, comments 9–10; S009, § 7(b)(13). R; complete F/G images not inspected.
R009-P1-C059 An outstanding deferred-interest balance has a periodic-statement expiration disclosure requirement. Under § 7(b)(14), the full-payment date must appear on the front of a page of each statement issued during the period, beginning with the first statement reflecting the transaction; wording substantially similar to G-18(H). S009, § 7(b)(14); S010, G-18(H). R; disclosure is not an actual receipt or payoff determination.
R009-P1-C060 The worksheet’s evidence categories are analytical needs, not newly asserted statutory document-production duties or universal evidentiary presumptions. A statement may show requirements and dates; it does not alone establish delivery of a particular payment or the legal correctness of every balance/rate. S006–S010, compared by function. I; admissibility, burdens, and records requests excluded.
R009-P1-C061 Currentness verification is bounded by the actual retrieved versions and failures. Historical final rules establish specified historical implementation; metadata/search descriptions do not replace current operative bodies. No full repeal/stay/vacatur/session-law audit is claimed. S001–S017 and the retrieval log. Observed research limitation; not legal acceptance.

4. Clock and proof comparison

No actual or hypothetical calendar deadline is calculated in this report. Periods below are the source-prescribed periods; the trigger and calendar must be established before any application.

Event / clock Trigger and prescribed treatment Calendar or measurement rule Evidence categories needed for a later authorized analysis Claim links
Ordinary payment crediting Payment received; generally credit as of that date. Not a particular posting date; no-charge and paragraph (b) exceptions. Method, receipt event, effective-credit date, charges attributable to delay. C012–C016
Website scheduling Date the creditor is authorized to effect payment. Immediate instructions after permitted cutoff move to next business day under comment 10(a)-2.iv. Authorization content, selected execution date, timestamp, cutoff/location. C016, C018
Accepted nonconforming payment Receipt of an accepted payment failing properly specified requirements. Within five days; source does not say five business days. Statement requirements, acceptance, actual nonconformity, promoted-method facts. C020–C021
Assisted branch payment Payment before qualifying branch/office closes. Same-day receipt; branch closing may precede 5 p.m. Financial-institution issuer, accepted location, employee involvement, closing time. C022–C024
No mail accepted on due date Due date is a day creditor does not receive/accept mail payments. Next business day for this paragraph means next mail-receipt/acceptance day. Other channels have their own exception. Due date, mail schedule, chosen channel, receipt date. C026–C027
Correction of crediting-caused charges Failure to credit under § 10(a)/(b) causes covered charges. Credit those charges during the next billing cycle. Required crediting date, imposed charge, causal connection, cycle boundaries. C025
Material payment-procedure change Effective change causes material delay. Specified 60-day period after change. Retail notice branch separately uses 60 days after transmission of first statement showing the charge. Change effective date, affected procedure, causal delay, statement transmission and notice dates. C030–C032
Excess allocation Payment exceeds required minimum on a covered account. Allocation uses a permitted rate/balance reference date; no separate universal waiting period is created by § 53. Minimum, payment, separate balances/rates, chosen reference-date practice, exceptions. C034–C045
Deferred-interest priority Relevant promotion approaches expiration. Two billing cycles, with the expiration-before-due-date interpretation. Promotion terms, expiration date, cycle boundaries, each cycle’s due date, requests. C038–C043
Requested credit-balance refund Receipt of qualifying written request for an existing credit balance. Seven business days, using the applicable business-function test. Credit-balance creation, request form/receipt, business-function schedule, intervening debits, refund. C046–C052
Aged credit balance Qualifying credit balance remains for more than six months. Good-faith effort; not a fixed substitute mailing deadline derived here. Age of remaining credit, prior efforts, permissible return channel, tracing evidence. C053–C055

These clocks cannot be combined into a single “payment processing period.” In particular, a five-day nonconforming-payment rule is not a seven-business-day refund rule, and a mail-specific next-business-day definition does not supply the refund calendar. Consumer Financial Protection Bureau+4

5. Necessary generic model material

The complete G-18(H) model clause read was:

“You must pay your promotional balance in full by [date] to avoid paying accrued interest charges.”

This is a generic disclosure of the promotion’s full-payment condition. It does not establish the date for an actual promotion, the amount needed to satisfy it, whether a payment arrived, or which billing cycles receive priority. The operative statement requirement comes from § 1026.7(b)(14), and allocation comes from § 1026.53. Consumer Financial Protection Bureau+1

G-18(D) was examined only as the official payment-information sample. The instructions explain its proximity purpose and permit distinguishing charge and revolving features. No actual creditor statement, generic creditor contract, or account-identifying document was queried. Full G-18(F)/(G) forms were not claimed as visually reviewed. Consumer Financial Protection Bureau

6. Clearly hypothetical qualitative failure branches

All facts below are stipulated teaching assumptions. There are no real or invented person, provider, account, property, or case identifiers. “Evidence needed” describes why an application would remain uncertain; it is not an instruction to search for, request, or obtain actual records.

Example Stipulated facts Provision-specific result versus unknown Evidence needed Adverse misclassification to avoid
E01 — Sent, not received A consumer mails a payment using the designated address; creditor receipt is not established. Section 10’s receipt-based crediting date cannot be fixed from mailing alone. Whether a separate payment-procedure-change protection applies is also unknown. Receipt evidence, method requirements, any relevant address change. Treating a postmark as conclusive timely receipt. C014–C015, C030.
E02 — Conforming timely receipt A covered payment reaches the creditor before its valid cutoff, meets requirements, and is posted later. It generally must be credited as of receipt. Later posting alone is not the violation. Whether the amount satisfies the minimum or avoids all interest remains separate. Effective-credit date, amount required, resulting charges. Equating posting delay with unlawful crediting, or timely minimum payment with interest forgiveness. C012–C014, C033.
E03 — Accepted nonconforming payment Requirements were properly specified with the statement; payment fails them, is accepted, and uses no promoted method. The five-day receipt rule can apply; the commentary permits intervening finance-charge accrual in this branch. Actual charge legality beyond that remains unknown. Requirements, defect, acceptance, receipt/credit dates. Applying ordinary same-day effective crediting without testing the exception—or calling the allowance five business days. C021.
E04 — Promoted telephone channel A creditor advertises telephone payment, and a payment is made through it within the applicable conditions. The promoted-method rule prevents treating it as nonconforming merely because it was not mailed with a stub. Actual completion/receipt still matters. Promotion, call/payment completion, cutoff, effective credit. Automatically granting five days because the payment was not mailed. C018, C020.
E05 — Minimum plus excess A covered account has two different-rate balances; payment exceeds the required minimum; no special exception applies. Section 53 directs the excess by descending APR. It does not establish how the minimum portion was allocated. Minimum, balance/rate schedule, reference-date practice. Applying highest-rate-first to every dollar or assuming the minimum necessarily goes to the lowest rate. C034–C036.
E06 — Deferred-interest expiration A qualifying deferred-interest balance remains; the promotion expires before the due date in its expiration cycle; issuer does not accept allocation requests. Comment 53(b)-2 changes which two cycles count and preserves priority for relevant preexpiration payments. No actual dates are computed. Exact expiration, cycle boundaries, due dates, receipt/allocation history. Counting “two months back” without the due-date relationship, or treating deferred accrual rate as the current ranking rate. C038–C041.
E07 — Equal-rate balances Two balances share an APR; a third bears a higher APR; no deferred-interest, secured-request, or dispute exception applies. After required priority to the higher-rate balance, the commentary generally leaves the method among tied balances unspecified. Rates at the issuer’s permitted reference date; other governing terms/law. Calling every non-pro-rata tie allocation a § 53 violation. C036–C037.
E08 — Requested credit balance An actual credit balance exceeding $1 exists and a written refund request is received. Section 11(a)(2)’s seven-business-day period applies, subject to the remaining credit balance when refund is required. No date is calculated. Request receipt, creditor business functions, intervening debits, refund action. Substituting seven calendar days, starting from request dispatch, or refunding an assumed original amount despite intervening activity. C046–C052.
E09 — Consumer cannot be located A qualifying balance remains more than six months; a statement address is stale, but no tracing effort is established. Stale address alone does not establish the no-further-action condition. Positive good-faith steps remain material. Ultimate disposition under other law is unknown. Efforts through last-known address/telephone, their results, remaining balance. Treating returned mail as automatic creditor ownership. C053–C055.
E10 — Business-purpose card The card was issued for business purposes and occasionally used personally. The commentary does not extend the consumer payment/allocation/refund rules merely because of those purchases. Contract or other-law protections are not decided. Issuance purpose and governing legal classification. Applying the full consumer-card regime transaction by transaction. C008.
E11 — Home-equity card access A § 1026.40 home-equity plan is accessed through a card. It is excluded from the narrow § 53 account definition; general covered open-end crediting/refund duties are not thereby erased. Plan classification, applicable general duties, security facts. Applying § 53 automatically—or concluding that no payment rules apply. C005, C011.
E12 — Branch payment versus slot One payment is made with a teller before a qualifying branch closes; another is placed in a mail slot without employee assistance. The first falls within the described in-person rule. The second does not obtain that treatment merely from being at the same building; other receipt rules still govern. Assistance, location, acceptance policy, closing time, actual collection/receipt. Treating every branch deposit as assisted in-person receipt. C022–C024.
E13 — Mail closure, electronic availability No mail is accepted on the due date, but the creditor accepts electronic payments that day; payment is made electronically the next business day. Section 10(d)(2) does not require that electronic payment to be treated as timely merely because mail was closed. Other protections are not decided. Channel availability, cutoff, due date, receipt. Extending a mail-specific protection to every payment method. C026–C027.
E14 — Secured-balance request A covered not-home-secured card contains a secured balance; consumer affirmatively requests excess allocation to it. Section 53(b)(2) allows the issuer to elect that allocation. Request alone does not compel it. Security scope, request, issuer acceptance, default allocation if declined. Treating all secured cards as excluded or treating the request as mandatory. C042–C044.
E15 — Qualifying disputed amount A stipulated qualifying § 12(c) claim or § 13 billing-error allegation affects part of a balance. The allocation must avoid or minimize reducing that amount; the official example allows a residual application when nothing else remains. Merits and procedural compliance are not decided. Qualifying dispute predicate, affected amount, other balances, final disposition. Saying either “disputed amounts can never receive payment” or “highest rate always controls despite the dispute.” C045.
E16 — Closure and ledger adjustment An account closes with an asserted consumer credit; later activity may reduce that credit. Closure alone supplies neither a refund exemption nor an immediate cash deadline under the examined rule. The amount actually owed, request trigger, and lawful intervening debits remain necessary. Credit creation, valid later entries, request/age, closure terms, other law. Equating closure with forfeiture, or assuming a settlement discount is refundable cash. C046, C052, C056–C057.
E17 — Payment procedure changed An issuer materially changes an accepted payment route; the change causes a late payment during the relevant period. The § 10(f) branch must be tested, including the separate retail notice mechanism if applicable. Ordinary no-grace interest is not automatically a prohibited late-payment charge. 12. Specific parent holds and remaining limits

This pass preserves all actual agreement, account, receipt, assent, default, balance, rate-validity, payment-finality, ownership, security, and creditworthiness facts. It does not determine whether an actual payment satisfied a contractual obligation, whether a particular electronic request qualifies as a writing, whether an actual tracing effort was adequate, or who owns a refund on a joint or otherwise shared account.

The following remain outside this component: origination; underwriting; rate-change authority; general late-fee law beyond the necessary § 10 interactions; full billing-error resolution; credit reporting; setoff; collection; settlement; charge-off consequences; limitations; damages and remedies; litigation, standing, admissibility, or filing questions; taxes; insolvency; and state, local, tribal, international, and country-specific law.

The general/store/secured/charge/business/cash-advance/transfer/promotional/joint/closed-with-balance product families have been addressed only to the extent needed for these payment operations. Every other A009 product and lifecycle dimension remains open. The current House statutory-body retrieval gap and complete amendment-lag audit remain explicit source limitations.

No component, parent, operational, or publication acceptance is asserted.

Subject · Supported finding · Boundary that must remain visible · 8 data rows

SubjectSupported findingBoundary that must remain visible
CreditingGenerally credit a payment as of receipt, with the exceptions in § 1026.10.Posting, receipt, collection of a check, available credit, and debt forgiveness are different questions.
Conforming paymentReasonable requirements and method-specific cutoffs matter. A creditor-promoted method generally produces conforming payments when the applicable conditions are met.The creditor cannot automatically invoke the nonconforming-payment delay for a method it promotes.
Nonconforming paymentWhen qualifying requirements were specified on or with the statement and a nonconforming payment is accepted, crediting is generally required within five days of receipt. The provision says “days,” not “business days”; it is not a universal five-day processing allowance.
Excess allocationOrdinarily allocate the amount above the required minimum to balances in descending APR order.Minimum-payment allocation is not prescribed by this general excess-only rule.
Deferred interestSpecial treatment applies during the promotion, including priority near expiration.A true zero-rate promotion and a recurring grace period are not automatically deferred-interest programs.
Consumer allocation requestsSpecified deferred-interest and secured-balance exceptions permit issuer acceptance of consumer instructions. The issuer generally may decline a request and follow the applicable default rule.
Credit balanceA qualifying credit balance exceeding $1 must be credited, with request-based and aged-balance refund duties. An excess payment above the minimum, a zero balance, or a disputed merchant charge is not necessarily a refundable credit balance.
Refund clocksWritten-request receipt starts the seven-business-day rule; more than six months of remaining credit balance triggers a good-faith effort. These are different triggers. Neither supplies a universal immediate cash-refund rule on closure.

R009-P1-C001Consumer coverage depends on credit primarily for personal, family, or household purposes. The statutory consumer-transaction definition refers to a natural person; regulatory cardholder and specified trust rules require their own treatment. A consumer-facing label alone is insufficient.S003, § 1602(i); S005, § 2(a)(11)–(12), comments 2(a)(11)-1, -3 and 2(a)(12)-1.S/R; actual purpose and status U.
R009-P1-C002Open-end credit ordinarily requires a plan contemplating repeated transactions, possible finance charges on unpaid balances, and generally replenishing credit. All three regulatory criteria matter. Card-issuer provisions also bring specified no-finance-charge and closed-end card arrangements within relevant Subpart B rules; “not ordinary revolving credit” is not a universal exclusion from §§ 10–11.S003, § 1602(g), (j); S005, § 2(a)(17)(iii)–(iv), (20), comments 2(a)(17)(iii)-1, 2(a)(17)(iv)-1, 2(a)(20)-1–5.S/R; specialized closed-end applications otherwise held.
R009-P1-C003A card issuer is the issuer or its agent with respect to the card; “creditor” has provision-specific routes.Mere card production or data processing does not alone establish agency. Section 10(e) separately expands its own creditor definition to specified payment processors.S003, § 1602(g), (o); S005, § 2(a)(7), (17), comment 2(a)(7)-1; S006, § 10(e).S/R; agency and actual creditor status U.
R009-P1-C004Regulatory cardholder status can include a natural person agreeing with the issuer to pay consumer-card obligations issued to another. The commentary distinguishes a co-obligor/guarantor from a merely authorized user. This definition does not itself decide contract liability, joint ownership, or entitlement to a particular refund.S005, § 2(a)(8), comment 2(a)(8)-1–4.R; liability/refund ownership U.
R009-P1-C005The narrow covered-credit-card-account definition excludes a § 1026.40 home-equity plan accessed by a card and the specified overdraft lines. The account-number overdraft exclusion has an express exception for a hybrid prepaid-credit card accessing a covered separate credit feature. A debit card without a credit feature is not automatically a credit card.S005, § 2(a)(15)(i)–(ii), comments 2(a)(15)-2 and -4.R; full hybrid-prepaid classification held.
R009-P1-C006A charge card is a credit card for which no periodic rate computes a finance charge; references to covered card accounts in Subparts B and G generally include charge cards.Particular sections contain express distinctions. Section 53 still requires an actual excess amount and allocable balances; no interest-bearing balance is invented for a charge card.S005, § 2(a)(15)(iii), comment 2(a)(15)-3; S007, § 53(a).R/I; product features U.
R009-P1-C007General-purpose, store, cash-advance, balance-transfer, promotional, and non-home-secured secured-card labels do not independently displace the core coverage tests. The actual plan, access device, consumer purpose, security, balances, and exemptions control. A secured balance can expressly fall within § 53(b)(2).S005, § 2(a)(15), (20); S007, § 53(a), (b)(2), comment 53-5.I anchored in R; no comprehensive subtype acceptance.
R009-P1-C008Business-purpose cards do not acquire these consumer operational protections merely through occasional personal use; consumer-purpose cards do not lose them through occasional business use.Section 3(a)’s commercial/organizational exclusions and the limited § 12(a)–(b) exceptions must be distinguished. Those exceptions are not a general extension of §§ 10, 11, or 53 to business cards.S003, § 1603(1); S005, § 3(a), comments 3-1, 3(a)-2 and 2(a)(8)-4.S/R; actual mixed-purpose classification U.
R009-P1-C009The high-value exemption can matter even to an open-end account. The 2026 threshold is $73,400.The relevant route is an initial extension exceeding the then-applicable threshold or a qualifying firm written commitment at opening—not merely a later displayed balance. Real-property/principal-dwelling security and private-education exceptions must be respected.S005, § 3(b)(1), comment 3(b)-3.xvii; S012, comments 3(b)-4.i and -6(i).R; threshold effective Jan. 1–Dec. 31, 2026; actual exemption U.
R009-P1-C010An exemption’s history matters: initial-extension and firm-commitment routes do not have identical persistence rules.Reduction of a qualifying commitment can end that route; a qualifying initial extension can preserve exemption despite later reductions. Combining smaller advances is not the same as the specified single initial advance. Later real-property/principal-dwelling security can end an open-end exemption.S012, comments 3(b)-4.ii–iv, -6(i), -7; legacy transition in -8.R; no actual opening/history determination.
R009-P1-C011Exclusion from § 53’s narrow account category does not automatically eliminate general open-end crediting or credit-balance duties.A covered home-equity line or non-card open-end plan can remain subject to general § 10 and § 11(a) requirements, while § 10(b)(3), § 10(e), and § 53 have their narrower express scopes.S005, § 2(a)(15)(ii), (17), (20); S006–S008, respective operative clauses.R; no wholesale application of card-specific rules to HELOCs.

R009-P1-C012Section 1666c(a) requires prompt posting as specified by regulation and protection against a finance charge when its stated payment conditions are met.Receipt in readily identifiable form by 5 p.m. on the due date, in the amount, manner, and location indicated to avoid the charge. This is not a rule that every timely minimum payment prevents all interest.S001, § 1666c(a).S; read with implementing regulation.
R009-P1-C013Section 10(a) generally requires crediting as of receipt, not posting on one particular date.Exceptions: delay produces no finance or other charge, or paragraph (b) applies. Posting date alone therefore does not establish a crediting violation.S006, § 10(a), comment 10(a)-1.R.
R009-P1-C014A check is received when it reaches the creditor, rather than when the funds are collected.Sending or postmarking is not the identified receipt event. Applicable requirements and cutoffs still matter.S006, comment 10(a)-2.i; § 10(b).R/I; no universal postmark rule.
R009-P1-C015With a consumer-selected third-party payor, receipt generally occurs when the creditor receives that payor’s check or transfer medium. The payment must satisfy applicable § 10(b) requirements. An instruction to another bank is not automatically receipt by the creditor.S006, comment 10(a)-2.iii.R; actual transfer/agency facts U.
R009-P1-C016An issuer-website payment is received on the date the consumer authorizes the issuer to effect it.Advance scheduling does not move receipt to the earlier instruction date. An immediate instruction received after 5 p.m. or a later specified cutoff is deemed authorized for the next business day.S006, comment 10(a)-2.iv.R; exact method, authorization date, cutoff, and calendar U.
R009-P1-C017The specified voluntary payroll arrangement uses the debit from the asset account as receipt, not the earlier payroll deposit.Consumer retains use until the contractual payment date; the commentary separately describes the covered hybrid-prepaid arrangement. This does not establish general setoff or compulsory-autopay authority.S006, comment 10(a)-2.ii.R; cross-referenced setoff/prepaid regimes held.
R009-P1-C018A creditor may prescribe reasonable requirements enabling most consumers to conform.Examples include an account locator/stub, checks or money orders by mail, U.S. dollars, and a specified address. Ordinary mail/electronic/telephone/in-person cutoffs may not be earlier than 5 p.m. on the due date at the specified receipt location, subject to the branch exception.S006, § 10(b)(1)–(2).R; no universal consumer-local-time assumption.
R009-P1-C019If requirements were not specified, the commentary supplies implied payment guidelines.Payment at business locations during normal business hours; cash, money order, draft, similar negotiable instrument, or agreed electronic transfer. Comment 10(b)-1 separately flags possible compulsory-EFT restrictions.S006, comments 10(b)-1 and -4.R; full Regulation E analysis excluded.
R009-P1-C020Creditor-promoted payment methods are treated as conforming under § 10(b)(4)(ii).Promotion can encompass website, telephone, in-person, or specified third-party channels. Applicable permitted cutoffs remain relevant; conformity does not independently prove receipt.S006, § 10(b)(4)(ii), comment 10(b)-2.i–iv.R.
R009-P1-C021An accepted nonconforming payment generally must be credited within five days of receipt.Qualifying requirements must have been specified on or with the periodic statement. Promoted-method treatment can defeat the asserted nonconformity. Commentary permits finance-charge accrual between receipt and crediting in this branch.S006, § 10(b)(4)(i)–(ii), comment 10(b)-3.R; no general duty to accept every defective tender inferred.
R009-P1-C022Qualifying in-person payments at a financial-institution issuer’s branch/office count as received that day when made before close of business.Covered not-home-secured consumer card account; accepted branch location; financial institution means bank, savings association, or credit union. Closing time controls, including an earlier-than-5-p.m. closing.S006, § 10(b)(3)(i)–(ii).R.
R009-P1-C023A merchant retail location is not automatically the issuing financial institution’s branch or office. The commentary specifically addresses merchant-limited and cobranded cards. A merchant payment may still be conforming under other provisions.S006, comment 10(b)-5; § 10(b)(4)(ii).R.
R009-P1-C024Employee assistance and affiliate relationships affect the in-person branch rule.Teller/employee-assisted payment qualifies; a branch mail slot does not qualify as in-person under this rule. A same-name affiliate accepting issuer-account payments is covered by the stated affiliate interpretation.S006, comments 10(b)-6–7.R; factual relationship U.
R009-P1-C025Improperly delayed crediting that causes finance or other charges requires an account adjustment during the next billing cycle. The failure must violate § 10(a) or (b) and result in the charges described. This is the section’s account-adjustment duty, not a damages award or complete remedies analysis.S006, § 10(c).R.
R009-P1-C026If the creditor does not receive or accept mail payments on the due date, the next-mail-business-day protection generally applies. For § 10(d), that next business day means the next day the creditor accepts or receives payments by mail. This is not a universal Monday–Friday definition.S004, § 1637(o)(2); S006, § 10(d)(1), comment 10(d)-1.S/R.
R009-P1-C027A mail-closure extension does not necessarily extend a different payment channel. If electronic or telephone payments are accepted on the due date, payments made by that channel the next business day need not be treated as timely under § 10(d)(2). Ordinary periodic interest on a no-grace account is not, by itself, late treatment.S006, § 10(d)(2), comment 10(d)-2; S009, comment 5(b)(2)(ii)-2.R; other timing protections not decided.
R009-P1-C028A separate fee for making a payment is generally prohibited on the specified covered card accounts unless the stated expedited-service exception applies.Section 1637(l) supplies the statutory rule; § 10(e) uses the narrow not-home-secured account category and includes a processor acting for the creditor. A late charge is not classified as this separate payment-method fee merely because payment was late.S004, § 1637(l); S006, § 10(e), comments 10(e)-1, -4.S/R; general late-fee legality held.
R009-P1-C029The § 10(e) exception requires expedited service involving a live representative or agent.Expedited means same-day crediting, or next-business-day crediting after cutoff. Automated-only service is not a representative; mixed live/automated service may qualify. A consumer’s own transfer service/bill-pay bank is not thereby the creditor’s processor.S006, comments 10(e)-2–4.R; exception is not an all-law permission to charge.
R009-P1-C030A material issuer change in payment address/procedures can prohibit late-payment fees or finance charges during the specified 60-day period.Required causal link: the change causes material delay. A harmless address-format change or continued successful acceptance at the former address does not establish that predicate.S001, § 1666c(c); S006, § 10(f), comments 10(f)-1–4.S/R; change date and causation U.
R009-P1-C031The retail-location interpretation has a specific notice-based correction mechanism. If the issuer uses that treatment, notice must reach it no later than 60 days after transmission of the first statement reflecting the affected charge; qualifying charges imposed in the change’s 60-day period must be waived, removed, or equivalently credited.S006, comment 10(f)-3.ii, -4.vi.R; the two 60-day triggers must not be merged.
R009-P1-C032Section 10(f)’s safe harbor and late-payment-charge concept have limits. The issuer may avoid affected charges for the specified period; waiver/removal/equivalent credit counts. Ordinary periodic interest on an account without a grace period is not automatically a finance charge “for a late payment.”S006, comments 10(f)-3.i and -5.R.
R009-P1-C033The crediting provisions do not themselves establish instantaneous restoration of available credit, cancellation of debt, or a particular allocation of the payment. This is a limitation of the provisions examined. Other contract, funds-availability, payment-system, or legal requirements may matter.S006, § 10; S005, comment 2(a)(20)-5; S007–S008.I; broader duties U.

R009-P1-C034On a covered card account, the ordinary rule allocates excess above the required minimum first to the highest-APR balance, then other balances in descending APR order.Subject to § 53(b) and official dispute-related interpretation. Product coverage must first be established.S001, § 1666c(b)(1); S007, § 53(a).S/R.
R009-P1-C035Section 53 does not prescribe the amount of the required minimum or generally dictate how that minimum is allocated. The issuer remains subject to other applicable law and regulatory guidance. Voluntarily using the excess-payment method for the minimum is permitted where otherwise consistent.S007, comment 53-1.R; minimum-setting/allocation law otherwise held.
R009-P1-C036The issuer may use rates and balances from the preceding cycle’s end, the payment-crediting date, or a date between. The selection generally must be consistent between cycles, although adjustments from time to time are permitted. This does not authorize a rate change or prove the selected APR lawful.S007, comment 53-2 and examples.R; actual valuation practice and lawful rate U.
R009-P1-C037The commentary generally prescribes no particular allocation among tied-rate balances when at least one other balance has a different rate.Tied balances may be treated together or separately. If all rates are identical, the descending-rate rule itself supplies no differential ranking; that last point is a textual inference, subject to special rules and other law.S007, comment 53-4, example 53-5.iv; § 53(a).R for specified tie case; I for all-identical-rate observation.
R009-P1-C038Deferred-interest treatment depends on interest accruing but being avoidable, waived, or refunded through full payment by the specified expiration.Applies regardless of required interim payments. A recurring grace period is excluded. A temporary zero APR is not enough unless interest accrued during the period can become payable.S007, comment 53(b)-1; S009, § 16(h)(2), comment 16(h)-1.R; promotional label alone insufficient.
R009-P1-C039During the relevant deferred-interest period, the balance is treated as having a zero APR for § 53 allocation.Consequently, equal nominal accrual rates do not necessarily create tied allocation rates. The expiration-period exception remains applicable.S007, comment 53-4.R; not a finding that no interest is accruing.
R009-P1-C040In the default deferred-interest branch, excess goes first to that balance during the two billing cycles immediately preceding expiration; remainder follows § 53(a).Outside that period, ordinary allocation applies, unless a permitted consumer-request allocation is used. The statutory “entire excess” language is implemented with an express rule for any remainder after the deferred balance is satisfied.S001, § 1666c(b)(2); S007, § 53(b)(1)(i)–(ii).S/R; no assumption that “two cycles” equals two calendar months.
R009-P1-C041Expiration before a cycle’s payment due date changes which cycles count. That expiration cycle is not one of the two immediately preceding cycles under comment 53(b)-2. Its example gives priority in the preceding two cycles and in the preexpiration portion of the expiration cycle.S007, comment 53(b)-2; S005, § 2(a)(4).R; actual cycle/due/expiration dates U.
R009-P1-C042The issuer is generally not required to follow a consumer’s allocation request. It may decline requests generally or for failure to meet its requirements, provided default allocation complies with § 53(a) or (b)(1)(i). Missing or unusable requests likewise require default allocation unless corrected.S007, § 53(b)(1)(ii), comment 53(b)-3.i.R; no general request-based override.
R009-P1-C043A qualifying request must be an affirmative consumer instruction, not merely issuer-imposed or preselected language.Commentary recognizes oral/electronic/written instructions, purpose-built submitted forms, and requests to reallocate a prior payment. Preprinted assent, untouched preselected boxes, and conditioning features/services on an allocation are insufficient examples. Issuer acceptance requirements remain relevant.S007, comment 53(b)-3.ii–iii.R.
R009-P1-C044For a secured balance on a covered not-home-secured card account, the issuer may elect to allocate excess to that balance if the consumer requests it.This is the specific secured-balance option, not a requirement to comply or permission to import § 53 into a home-equity plan.S007, § 53(b)(2), comment 53(b)-3.R; existence and reach of security interest U.
R009-P1-C045A qualifying § 12(c) claim/defense or § 13 billing-error allegation affects payment allocation. The issuer must avoid or minimize reducing the disputed amount. The official example permits residual application to it when no other amounts remain; a subsequently established billing error still requires the identified correction. Not every informal complaint is assumed to meet the referenced provisions.S007, comment 53-3.i–ii.R; dispute qualification, merits, procedures, and remedies held.

R009-P1-C046The credit-balance rule is triggered by a credit balance in excess of $1, created through the specified categories.Categories include funds above the total balance due, rebates of unearned finance charges/insurance premiums, and amounts otherwise owed to or held for the consumer. An excess above the minimum alone does not establish this.S002, § 1666d opening clause; S008, § 11(a).S/R; actual ledger balance U.
R009-P1-C047A qualifying credit balance must be credited to the consumer’s account. This is separate from the request-based refund and aged-balance effort. The provision does not make cash refund immediate in every case.S002, § 1666d(A); S008, § 11(a)(1).S/R.
R009-P1-C048The statute requires refund upon request; the regulation specifies refund of the remaining credit balance within seven business days after receipt of a written request. The written-request and seven-business-day details appear in the regulation, not the statutory wording. Whether a particular electronic communication legally constitutes the required writing is not determined here.S002, § 1666d(B); S008, § 11(a)(2).S/R; request form/receipt U.
R009-P1-C049The ordinary § 2(a)(6) business-function definition governs the § 11(a)(2) period. It asks when the creditor’s offices are open to the public for substantially all business functions; limited bill-payment/deposit services alone do not establish that. Section 10(d)’s mail-specific definition is not imported.S005, § 2(a)(6), comment 2(a)(6)-1; S008, § 11(a)(2).R; no calendar calculated.
R009-P1-C050A creditor may satisfy the obligation earlier, including by immediate refund, refund before written request, or refund on oral/electronic request. These permitted compliance methods do not erase the mandatory written-request trigger or establish that every oral request starts the same seven-business-day clock.S008, comment 11(a)-1.i–iii.R; electronic-writing characterization held.
R009-P1-C051The creditor need not honor standing orders requesting refunds of future credit balances. This concerns prospective standing orders; it is not a general exception to a qualifying request for an existing credit balance.S008, comment 11(a)(2)-1.R.
R009-P1-C052Refund amount is the remaining credit balance at the time refund is required.Intervening purchases or other debits, including amounts not yet shown on a periodic statement, may decrease or eliminate it. Their underlying validity is not established merely by appearing in a ledger.S008, comment 11(a)-2.R/I; debit validity U.
R009-P1-C053A credit balance remaining for more than six months requires a good-faith refund effort.Statutory channels are cash/check/money order; the regulation also lists credit to the consumer’s deposit account. This duty is not conditional on a new written request.S002, § 1666d(C); S008, § 11(a)(3).S/R.
R009-P1-C054“Unlocated consumer” requires more than a stale address on file.Positive steps are required, including necessary tracing through the last-known address or telephone number, or both. The text’s no-further-action condition requires unknown current location and inability to trace through those sources.S002, § 1666d(C); S008, § 11(a)(3), comment 11(a)(3)-1.S/R; adequacy of an actual effort U.
R009-P1-C055An unsuccessful qualifying good-faith effort can exhaust the further duties imposed by § 11; an unsuccessful early effort need not be repeated merely at six months. The ultimate disposition of an unsuccessful-refund balance, or a balance of $1 or less, remains governed by other applicable law. This is not creditor ownership or debt-forfeiture authority.S008, comments 11(a)-1.iv and 11(a)(3)-2.R; property/unclaimed-property law held.
R009-P1-C056Closure alone supplies no express exception to § 11(a)’s credit-balance duties and no express new immediate-cash deadline. This is a textual inference from § 1666d and § 11(a); the separately stated termination provisions do not supply either proposition. Particular closure, security-deposit, or contract obligations remain unexamined.S002; S008, § 11(a)–(b).I; broader closure consequences U.
R009-P1-C057Zero balance, an unposted payment, a merchant dispute, and a settlement discount are not interchangeable with an established credit balance.A merchant credit or other adjustment can contribute to a credit balance once legally/accountingly owed, but the label or allegation alone does not establish money held for the consumer.S002, opening clause; S006, § 10; S008, § 11(a).I; underlying merits and accounting U.

R009-P1-C058G-18(D) illustrates placement/proximity of payment information; it is not an account agreement or universal processing instruction.Appendix G allows adjustment for charge-card/revolving features. G-18(F)/(G) contain some optional information and formats. No sample amount, rate, or date was adopted as law.S010, comments 9–10; S009, § 7(b)(13).R; complete F/G images not inspected.
R009-P1-C059An outstanding deferred-interest balance has a periodic-statement expiration disclosure requirement.Under § 7(b)(14), the full-payment date must appear on the front of a page of each statement issued during the period, beginning with the first statement reflecting the transaction; wording substantially similar to G-18(H).S009, § 7(b)(14); S010, G-18(H).R; disclosure is not an actual receipt or payoff determination.
R009-P1-C060The worksheet’s evidence categories are analytical needs, not newly asserted statutory document-production duties or universal evidentiary presumptions.A statement may show requirements and dates; it does not alone establish delivery of a particular payment or the legal correctness of every balance/rate.S006–S010, compared by function.I; admissibility, burdens, and records requests excluded.
R009-P1-C061Currentness verification is bounded by the actual retrieved versions and failures.Historical final rules establish specified historical implementation; metadata/search descriptions do not replace current operative bodies. No full repeal/stay/vacatur/session-law audit is claimed.S001–S017 and the retrieval log.Observed research limitation; not legal acceptance.

Accepted nonconforming paymentReceipt of an accepted payment failing properly specified requirements.Within five days; source does not say five business days.Statement requirements, acceptance, actual nonconformity, promoted-method facts.C020–C021
Assisted branch paymentPayment before qualifying branch/office closes.Same-day receipt; branch closing may precede 5 p.m.Financial-institution issuer, accepted location, employee involvement, closing time.C022–C024
No mail accepted on due dateDue date is a day creditor does not receive/accept mail payments.Next business day for this paragraph means next mail-receipt/acceptance day. Other channels have their own exception.Due date, mail schedule, chosen channel, receipt date.C026–C027
Correction of crediting-caused chargesFailure to credit under § 10(a)/(b) causes covered charges.Credit those charges during the next billing cycle.Required crediting date, imposed charge, causal connection, cycle boundaries.C025
Material payment-procedure changeEffective change causes material delay.Specified 60-day period after change. Retail notice branch separately uses 60 days after transmission of first statement showing the charge.Change effective date, affected procedure, causal delay, statement transmission and notice dates.C030–C032

Example · Stipulated facts · Provision-specific result versus unknown · 17 data rows

ExampleStipulated factsProvision-specific result versus unknownEvidence neededAdverse misclassification to avoid
E01 — Sent, not receivedA consumer mails a payment using the designated address; creditor receipt is not established.Section 10’s receipt-based crediting date cannot be fixed from mailing alone. Whether a separate payment-procedure-change protection applies is also unknown.Receipt evidence, method requirements, any relevant address change.Treating a postmark as conclusive timely receipt. C014–C015, C030.
E02 — Conforming timely receiptA covered payment reaches the creditor before its valid cutoff, meets requirements, and is posted later. It generally must be credited as of receipt. Later posting alone is not the violation. Whether the amount satisfies the minimum or avoids all interest remains separate.Effective-credit date, amount required, resulting charges.Equating posting delay with unlawful crediting, or timely minimum payment with interest forgiveness. C012–C014, C033.
E03 — Accepted nonconforming paymentRequirements were properly specified with the statement; payment fails them, is accepted, and uses no promoted method. The five-day receipt rule can apply; the commentary permits intervening finance-charge accrual in this branch. Actual charge legality beyond that remains unknown.Requirements, defect, acceptance, receipt/credit dates.Applying ordinary same-day effective crediting without testing the exception—or calling the allowance five business days. C021.
E04 — Promoted telephone channelA creditor advertises telephone payment, and a payment is made through it within the applicable conditions. The promoted-method rule prevents treating it as nonconforming merely because it was not mailed with a stub. Actual completion/receipt still matters.Promotion, call/payment completion, cutoff, effective credit.Automatically granting five days because the payment was not mailed. C018, C020.
E05 — Minimum plus excessA covered account has two different-rate balances; payment exceeds the required minimum; no special exception applies.Section 53 directs the excess by descending APR. It does not establish how the minimum portion was allocated.Minimum, balance/rate schedule, reference-date practice.Applying highest-rate-first to every dollar or assuming the minimum necessarily goes to the lowest rate. C034–C036.
E06 — Deferred-interest expirationA qualifying deferred-interest balance remains; the promotion expires before the due date in its expiration cycle; issuer does not accept allocation requests.Comment 53(b)-2 changes which two cycles count and preserves priority for relevant preexpiration payments. No actual dates are computed.Exact expiration, cycle boundaries, due dates, receipt/allocation history.Counting “two months back” without the due-date relationship, or treating deferred accrual rate as the current ranking rate. C038–C041.
E07 — Equal-rate balancesTwo balances share an APR; a third bears a higher APR; no deferred-interest, secured-request, or dispute exception applies. After required priority to the higher-rate balance, the commentary generally leaves the method among tied balances unspecified.Rates at the issuer’s permitted reference date; other governing terms/law.Calling every non-pro-rata tie allocation a § 53 violation. C036–C037.
E08 — Requested credit balanceAn actual credit balance exceeding $1 exists and a written refund request is received.Section 11(a)(2)’s seven-business-day period applies, subject to the remaining credit balance when refund is required. No date is calculated.Request receipt, creditor business functions, intervening debits, refund action.Substituting seven calendar days, starting from request dispatch, or refunding an assumed original amount despite intervening activity. C046–C052.
E09 — Consumer cannot be locatedA qualifying balance remains more than six months; a statement address is stale, but no tracing effort is established.Stale address alone does not establish the no-further-action condition. Positive good-faith steps remain material. Ultimate disposition under other law is unknown.Efforts through last-known address/telephone, their results, remaining balance.Treating returned mail as automatic creditor ownership. C053–C055.
E10 — Business-purpose cardThe card was issued for business purposes and occasionally used personally. The commentary does not extend the consumer payment/allocation/refund rules merely because of those purchases. Contract or other-law protections are not decided.Issuance purpose and governing legal classification.Applying the full consumer-card regime transaction by transaction. C008.
E11 — Home-equity card accessA § 1026.40 home-equity plan is accessed through a card.It is excluded from the narrow § 53 account definition; general covered open-end crediting/refund duties are not thereby erased.Plan classification, applicable general duties, security facts.Applying § 53 automatically—or concluding that no payment rules apply. C005, C011.
E12 — Branch payment versus slotOne payment is made with a teller before a qualifying branch closes; another is placed in a mail slot without employee assistance. The first falls within the described in-person rule. The second does not obtain that treatment merely from being at the same building; other receipt rules still govern.Assistance, location, acceptance policy, closing time, actual collection/receipt.Treating every branch deposit as assisted in-person receipt. C022–C024.
E13 — Mail closure, electronic availabilityNo mail is accepted on the due date, but the creditor accepts electronic payments that day; payment is made electronically the next business day.Section 10(d)(2) does not require that electronic payment to be treated as timely merely because mail was closed. Other protections are not decided.Channel availability, cutoff, due date, receipt.Extending a mail-specific protection to every payment method. C026–C027.
E14 — Secured-balance requestA covered not-home-secured card contains a secured balance; consumer affirmatively requests excess allocation to it.Section 53(b)(2) allows the issuer to elect that allocation. Request alone does not compel it.Security scope, request, issuer acceptance, default allocation if declined.Treating all secured cards as excluded or treating the request as mandatory. C042–C044.
E15 — Qualifying disputed amountA stipulated qualifying § 12(c) claim or § 13 billing-error allegation affects part of a balance. The allocation must avoid or minimize reducing that amount; the official example allows a residual application when nothing else remains. Merits and procedural compliance are not decided.Qualifying dispute predicate, affected amount, other balances, final disposition.Saying either “disputed amounts can never receive payment” or “highest rate always controls despite the dispute.” C045.
E16 — Closure and ledger adjustmentAn account closes with an asserted consumer credit; later activity may reduce that credit.Closure alone supplies neither a refund exemption nor an immediate cash deadline under the examined rule. The amount actually owed, request trigger, and lawful intervening debits remain necessary.Credit creation, valid later entries, request/age, closure terms, other law.Equating closure with forfeiture, or assuming a settlement discount is refundable cash. C046, C052, C056–C057.
E17 — Payment procedure changedAn issuer materially changes an accepted payment route; the change causes a late payment during the relevant period. The § 10(f) branch must be tested, including the separate retail notice mechanism if applicable. Ordinary no-grace interest is not automatically a prohibited late-payment charge.Effective change, causation, charge type, statement transmission, notice timing.Treating every address change as a blanket 60-day payment holiday. C030–C032.

OFR, full Supplement I: https://www.ecfr.gov/current/title-12/chapter-X/part-1026/appendix-Supplement%20I%20to%20Part%201026

Recorded check status: unreopened oversized route history

Actual result and effect
Retrieval failed because content exceeded the tool’s size limit. This was not treated as absence of official commentary. Necessary comments were read in the CFPB section bodies; additional threshold text was read in S012.

Recorded check status: unreopened unused navigation history

Actual result and effect
§ 1666j’s selected text concerned state-law applicability and was not used as the fee rule or as a state-law analysis. § 13 was opened/searched but not used as a completed billing-error investigation. Standalone interpretation routes were navigation/duplicate access; the complete payment/refund/allocation comment readings claimed above are the integrated bodies in S006–S008. No separate corroboration count.
