United States Virgin Islands: Debt-relief provider regulation and applicability
Research baseline: October 22, 2026, America/Los_Angeles
Actual public-source checks: October 26, 2026
Assignment: A066 / J_VI / PASS-01, focused provider-regulation component only
Mode: Regular Chat; no Deep Research, external actions, private records, or entity-specific searches. The interface does not provide a separately verifiable model-tier record, so no model-switch claim is made.
Research complete subject to identified source and currentness holds — not publication-approved### Principal finding
The U.S. Virgin Islands has a dedicated debt-relief provider statute: Title 12A, Chapter 7, Virgin Islands Uniform Debt-Management Services Act, §§401–441, added by Act No. 7145 on January 27, 2010. Its text covers compensated intermediaries seeking creditor concessions for Virgin Islands residents, requires territorial registration subject to defined exclusions, regulates fees and customer money, and supplies specific administrative and private remedies.
This is not a “no dedicated statute located” jurisdiction. It is also not safe to treat a mainland registration, nonprofit status, or an attorney's participation as automatically authorizing a provider. law.justia.comlaw.justia.comlaw.justia.com
Critical currentness limitation: The full territorial provisions were read in the 2025 Virgin Islands Code reproduced by Justia, an unofficial host of enacted statutory text. The government advertises free access to the Virgin Islands Code through LexisNexis, but the official-access gateway did not yield readable operative sections through the available public web retrieval. The enacted Act No. 7145 session-law pages, an authenticated consolidation through October 26, 2026, and any operative inflation-adjustment rules were not obtained. Accordingly, this report states what the accessed codified text provides, but does not certify that its printed dollar amounts or every provision are the operative 2026 text. 1. Jurisdiction and source-authority map
| Authority |
Function relevant to PASS-01 |
Boundary |
| Legislature of the Virgin Islands; Virgin Islands Code and session laws |
Creates territorial provider duties and remedies. Title 12A, Chapter 7 is the principal law. |
Enactment and later amendments control over any unofficial consolidation. Act publication year is not its effective date. |
| Lieutenant Governor, through the Division of Banking, Insurance and Financial Regulation (DBIFR) |
Provider registration, examinations, rulemaking, adjustments, investigations, penalties, restitution and registration suspension/revocation. |
The agency expressly lists debt-management providers among its regulated categories. A public registration list is statutorily required, but a verified dedicated online lookup was not located. United States Virgin Islandslaw.justia.com |
| Department of Licensing and Consumer Affairs (DLCA) |
Separate general business-licensing and consumer-fraud functions. Title 12A, Chapter 7 registration applications reference compliance with Title 27, Chapter 9. |
A DLCA business license is not proof of Chapter 7 registration. The DLCA's general search does not establish that a provider appears on the Lieutenant Governor's required list. law.justia.comlaw.justia.comdlca.vi.gov |
| Attorney General / territorial Department of Justice |
Potential referral and territorial enforcement. |
A Lieutenant Governor referral under §432(a) is distinct from an individual's express private action under §435. |
| Superior Court of the Virgin Islands |
Territorial trial-court proceedings and specified registration-denial review. |
A regulatory violation does not automatically erase an underlying creditor obligation. |
| Supreme Court of the Virgin Islands |
Highest territorial appellate court; controlling territorial-law appellate authority. |
The court assumed appellate jurisdiction in 2007. Federal courts have separate subject-matter jurisdiction. supreme.vicourts.org |
| District Court of the Virgin Islands and federal appellate structure |
Federal claims within federal jurisdiction; federal bankruptcy proceedings through the District Court's Bankruptcy Division. |
Bankruptcy availability is a jurisdictional alternative here, not a substitute for provider classification and not a finding about any borrower's eligibility. vid.uscourts.gov |
| FTC and federal courts |
FTC Act and, where independently applicable, Telemarketing Sales Rule (TSR) enforcement. |
“U.S. territory” does not make every provider transaction a covered telemarketing transaction. |
| Federal Credit Repair Organizations Act (CROA) |
Separate federal rules for an entity offering credit-history improvement for consideration, where its statutory predicates are met. |
Ordinary settlement negotiation alone does not establish that the provider is a CROA credit-repair organization. |
Geographic definitions must be tested separately.
- Territorial §402(19) expressly includes the Virgin Islands in its definition of state. Territorial §§403–404 focus chiefly on the individual's residence when an agreement or service undertaking is made. law.justia.comlaw.justia.com
- TSR §310.2(ff) includes U.S. territories and possessions. The TSR nevertheless requires a covered telemarketing campaign, defined in §310.2(ii) by telephone activity involving more than one interstate telephone call, as well as the relevant transaction and exemption analysis. ecfr.govecfr.gov
- FTC Act §4, 15 U.S.C. §44, expressly encompasses commerce in a U.S. territory in its definition of commerce; FTC jurisdiction and institutional exemptions remain separate inquiries. COMMERCE AND TRADE
- CROA, 15 U.S.C. §1679a(3), uses interstate-commerce-or-mails and service/consideration predicates; its application cannot be established solely by calling the Virgin Islands a state. govinfo.gov
2. Provider-classification decisions
The decisive territorial concept is acting as an intermediary between an individual and one or more of that individual's creditors to obtain concessions. “Concessions” are creditor assent to terms more favorable than the original contract. The statutory term provider includes persons offering or furnishing these services directly or through others. The definition does not expressly require that all covered debts be unsecured or household-purpose debts. Its reference to an individual distinguishes a natural person from a borrowing entity; mixed-purpose and secured cases need careful factual classification. law.justia.com
| Activity / fact pattern |
Territorial Chapter 7 result |
Other law / unresolved edge |
| Paid debt-settlement negotiator seeks less than principal from creditors of a VI-resident individual |
Covered, absent §403 exclusion; registration analysis required. |
TSR additionally tested if qualifying telephone campaign and unsecured debts. |
| DMP operator negotiates reduced interest/late fees and distributes payments |
Covered where acting as creditor-concession intermediary. |
§§417–428 contain a distinct DMP fee, plan and trust-money track. |
| Paid “debt adjustment” or “debt negotiation” service |
Name is not decisive. Covered if the functional §402(8) test is met. |
No separate license is created merely by the marketing label. |
| General financial education or budgeting without creditor intermediation |
Not established as debt-management services under §402(8). |
Deceptive marketing, other professional/business rules may still apply; pure counseling classification should not be presumed from a label. |
| Credit-repair business promising to improve credit history but not negotiating debts |
Chapter 7 coverage not established solely by credit-repair activity. |
Test CROA and the TSR's distinct credit-repair provision if otherwise covered. Separate dedicated VI credit-repair registration law: NOT LOCATED in bounded examination; this is not a finding that none exists. |
| Creditor collecting, restructuring, or settling its own receivable |
Merely being a creditor is not the intermediary role. |
Creditor/collector conduct is a separately queued dimension. CROA expressly excludes a creditor to the extent it helps restructure debt owed to itself. |
| Actual lender provides a consolidation/refinance loan |
Lending is not transformed into debt-management intermediation merely because proceeds pay old creditors. |
Loan licensing and credit disclosures require their own product/activity analysis; no license by analogy. |
| Company advertises “consolidation,” but actually charges to negotiate old creditors' terms |
Potential Chapter 7 provider based on conduct. |
An actual loan and an intermediary service must be separated in the agreement and fund flows. |
| Individual owes a business-purpose debt |
Chapter 7 potentially applies, because §402(8) does not expressly restrict purpose, if the debtor is an individual and the other predicates hold. |
Do not import the personal/household limitation from a different VI statute or CROA. |
| LLC or corporation is the debtor |
A business entity is not the statutory “individual” served under §402(8). |
Other law remains possible; no universal deregulation inference. |
| Secured debt of a natural person |
Chapter 7 does not expressly exclude it. |
TSR “debt relief service” definition refers to unsecured creditors or debt collectors; collateral and creditor consequences deferred. |
| Fully online/off-island provider knowingly signs up a VI resident |
Potentially covered regardless of local storefront. |
§406 expressly contemplates applicants with no VI service location. |
| Unpaid service, including compensation neither from/on behalf of the individual nor from creditors |
§403(b)(2) exclusion may apply. |
Genuine absence of all specified compensation must be established. |
| Creditor-funded nonprofit counseling/settlement intermediary |
Not exempt simply because nonprofit; creditor payments defeat the no-compensation premise. |
See specific nonprofit governance rules below. |
| Attorney or accountant assisting with creditors |
Genuine attorney-client legal services by a VI-authorized attorney, or accountant-client accounting services by a VI-licensed CPA, are outside §402(8)'s service definition. |
Using a lawyer/CPA as a nominal affiliate does not automatically exclude a separate provider's commercial debt-settlement business. |
| Financial planner |
Exception only for actual planner-client financial-planning services and the profession recognized by Lieutenant Governor rule with licensing, discipline, ethics and continuing education predicates. |
No qualifying territorial implementing rule verified. |
| Bank; regulated bank affiliate; judicially directed person; specified incidental bill-paying service |
Specific §403(c) exclusions in the ordinary course, as worded. |
An unrelated service or unregulated affiliate cannot assume exemption. |
law.justia.comlaw.justia.comlaw.justia.comgovinfo.gov## 3. Registration, security and exemptions
| Regulatory issue |
Read statutory answer |
Limitation |
| Mandatory provider registration |
§404(a): obtain VI registration before servicing an individual whom the provider reasonably should know resides in VI when services are agreed. Registered provider's employee/agent not separately registered merely for that role. |
§403 exclusions, Chapter 7 effective/grandfather provisions and actual service classification control. |
| Authority and register |
Lieutenant Governor. §404(c) requires a public list of registered-provider names. |
Dedicated accessible list and its freshness unverified; no entity was searched. |
| Initial materials |
Prescribed form/fee, surety or permitted security, trust-account identifiers and examination consent, misconduct insurance, Title 27 Chapter 9 proof, jurisdiction/process-service documentation, extensive personnel, audits, accreditation/counselor evidence, client forms and fees. |
Exact current application and official fee schedule not obtained. |
| Nonresident / remote application |
§406 asks for local locations or a statement that none exists; websites and electronic addresses are disclosed. |
Registration still required if §404 applies. |
| License held in another state |
§412 permits substitution of sufficiently equivalent prior application/license materials with additional VI information and current certification. |
Application shortcut only; not reciprocal permission to operate before VI registration. |
| Initial misconduct insurance |
Printed §405(b)(4) amount $250,000, qualifying insurer and coverage; deductible printed maximum $5,000; cancellation-notice protection. |
Amount subject to §432(f) adjustments; live insurance/regulator rules not verified. |
| Renewal misconduct insurance |
§411(b)(5): greater of printed $250,000 or highest daily customer trust balance in previous six months. |
Actual adjusted minimum unknown. |
| Surety bond |
§413 printed default $50,000, with individual regulator adjustment permitted; remains effective for two years after the provider ceases serving VI individuals. Approved alternative security under §414. |
Neither bond face amount nor insurance premium is a consumer fee. |
| Renewal |
Annual registration; renewal application in the period 30–60 days before expiration; audit, fee, coverage and activity figures; timely complete renewals have procedural continuation protections. |
No actual certificate expiry or calendar is assumed. |
| Agency determination |
§410 sets initial decision period of 120 days, possible additional 60 on stated grounds, notice/review procedures. |
This is an agency obligation, not an automatic license-by-silence rule. An apparent word “Commission” in the reproduced text requires checking the enacted Act. |
| Nonprofit governance |
§409(d) mandates denial if the nonprofit/tax-exempt applicant lacks an independent board as defined there. |
Nonprofit status creates a governance predicate, not blanket exemption. |
| Employees, professional status, accreditation |
Registered-provider employees/agents get §404(b)'s narrow treatment; certification, accreditation and professional exceptions have their own predicates. |
Accreditation is not registration; an attorney's separate statutory professional role must be real. |
| Records and exams |
Application statements, public/confidential information categories, specified updates, financial audits, insurer/bond controls and regulator examination powers apply. |
Exact extra rules, reporting forms and schedule not obtained. |
| Suspension / revocation |
§434 allows action for listed material violations, insolvency and failures of examination; emergency trust-related action and judicial steps have specific conditions. |
No penalty or seizure should be assumed without the required process. |
law.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.com### The crucial fee-currentness hold
Section 432(f) directs the Lieutenant Governor to adopt inflation-adjusted dollar figures, based on a designated CPI-U base year, triggered by at least a 10% index change, effective July 1 as specified; most affected amounts are rounded to $100, whereas §423 fee figures are rounded to whole dollars. This reaches the statutory numbers in §§402, 405, 409, 413, 423, 433 and 435. The base-year rule, actual notices and any adjustment schedule were not retrieved.
Thus, the next figures are faithfully reported printed statutory figures, not certified 2026 effective maxima. No inflation factor or updated cap has been invented. law.justia.com
4. Permitted fees: territorial text versus federal timing
| Charge or calculation |
Title 12A, §423, as reproduced in 2025 |
Governing qualification |
| General prerequisite |
No provider charge/payment except what §423 permits; valid signed agreement complying with §§419 and 428 before charges. |
A signed contract is not enough to satisfy an independently applicable TSR timing prohibition. |
| Education/counseling without an agreement |
Printed maximum $100, unless Lieutenant Governor approves more for actual nature/extent of services. |
If a qualifying agreement follows within 90 days after those services end, §423(e) requires refund of that educational fee. |
| DMP involving reduced interest, late fees or finance charges |
Printed startup ≤$50; monthly ≤min($10 × participating remaining creditors, $50). |
No simultaneous collection under DMP and settlement startup/monthly tracks. |
| Settlement for less than principal |
Printed setup ≤min($400, 4% × plan debt at inception); monthly ≤min($10 × remaining creditors, $50). |
Subject to §419(d)'s refund provisions and federally applicable timing. |
| Additional settlement-service compensation |
Per-debt ceiling: 30% × (principal when agreed − amount paid to creditor) − specified setup/monthly fees not previously credited against an earlier settlement fee. |
§423(f)'s per-debt allocation and credit history must be documented; no negative additional fee is assumed. |
| Dishonored payment |
Reasonable charge, printed ≤min($25, other applicable law's allowance). |
Not a general “late charge” authorization. |
| Voluntary contributions |
§424 bars solicitation from the individual or affiliate; limited acceptance, with aggregate collections restricted to otherwise authorized fees until 30 days after plan end. |
Voluntary labels do not turn compensation into an exemption. |
| Creditor “fair share,” lender referral money |
Actual source and recipient matter. Chapter 7 requires creditor-compensation disclosure and restricts provider referral compensation, with a narrow government-sponsored counseling exception. |
No invented universal dollar or percentage cap on every creditor contribution. |
law.justia.comlaw.justia.comlaw.justia.comWhen the FTC TSR applies, §310.4(a)(5) bars requesting or receiving debt-relief fees until a particular debt has been changed pursuant to an executed creditor agreement, the customer has made a payment under that agreement, and the prescribed per-debt proportional/savings allocation is met. For covered unsecured-debt telemarketing programs, this can prevent the up-front collection of startup or monthly fees that the territorial text otherwise describes. The TSR's separate qualified customer-owned account arrangement allows fund accumulation, subject to insured institution, independence, interest, referral and withdrawal/refund conditions; it does not allow advance earned provider fees. ecfr.govecfr.govecfr.gov
In turn, where covered credit-repair claims and consideration bring an actor within CROA, §1679b(b) bars charging for a service before it is fully performed. Where a covered telemarketing credit-improvement representation independently triggers TSR §310.4(a)(2), further completion-and-evidence conditions apply. Neither regime is automatically imposed on every bare negotiation of debt. govinfo.govCOMMERCE AND TRADEecfr.gov
5. Agreement, cancellation, creditor consent and customer money
Required pre-agreement work and disclosures
Under §417, a registered provider must give a retainable, itemized service/charge list. A certified counselor or certified debt specialist must provide financial education and analysis. For a plan involving regular payments, the provider must assess suitability and ability to pay, and have a basis for believing listed creditors will accept the contemplated payments.
Before assent, the individual must receive the applicable analysis, plan, creditor participation/nonparticipation information, alternatives and risk disclosures. The requirements distinguish plans anticipating reductions in interest and charges from plans anticipating reduced principal. Settlement-related risks include impaired credit, continued collection or litigation, possible increasing balances and potential tax consequences. Advertisements carry related warnings under §430. These are duties to evaluate and disclose, not proof that creditors have agreed. law.justia.comlaw.justia.com
| Issue |
Rule in the accessed territorial text |
Qualification or limit |
| Form and copy |
§419(a): retainable record, dated signatures of individual and provider, party details, services, itemized fees, payment schedules and immediate delivery of agreement. |
§419(b) permits retrievable/saveable/printable electronic delivery with notice. |
| Creditor details |
For regular creditor payments, identify expected participants, each obligation and planned disbursement; identify creditors expected not to participate. |
Forecast participation is not an actual creditor concession. |
| Assent to larger settlement |
Under §§419(e), 428(a)(2)–(3), a power of attorney cannot authorize settlement above 50% of debt principal; a creditor-approved settlement above 50% requires the individual's later assent. |
A provider has no power to force a creditor to accept even a 50% offer. |
| Creditor rejection/withdrawal |
Agreement must provide notice to the individual within five days after provider learns of a creditor's final rejection or withdrawal, identifying the creditor and the right to modify or terminate. |
No universal deadline obliging a creditor to respond was established. |
| Choice of law/forum |
§419(f) restricts choice-of-law, forum and remedial waivers. |
The reproduced §419 contains apparent model-act section-reference remnants (“Section 27(a)” and “Section 20”); controlling Act comparison remains a hold. |
| Language |
§421: English unless agency rule changes it; translated mandatory documents if provider communicates primarily in another language. |
Actual implementing rules unverified. |
| Electronic disclosure |
§418 applies federal E-SIGN consumer-consent predicates to specified sections; web disclosure presentation and paper-copy rights are detailed. |
§418 specifically defines consumer for its purpose as primarily personal/family/household; cannot assume identical electronic route for a business-purpose individual. |
| Ordinary cancellation |
§420(a): written/record notice by midnight on the third business day after assent; mailing effective when mailed. |
A defective agreement under listed provisions permits the stated 30-day cancellation period instead. |
| Emergency waiver |
§420(c): narrow actual financial emergency requiring early creditor disbursement; customer's own signed, dated explanation and explicit waiver. |
Standard-form waiver is void. |
| Later individual termination |
§419(d): individual may terminate at any time by written/electronic notice, without penalty; unused customer money is refunded, specified settlement setup fee portion refunded, powers of attorney revoked. |
Already-authorized and earned charges require independent verification; creditor's remaining claim is unaffected. |
| Provider termination |
§426(a): provider may terminate after 60 days' failure to make required payments; §426(b) controls immediate customer money and qualifying setup-fee return on termination by either party. |
The contract cannot create a broader unilateral forfeiture of customer reserves. |
| Monthly accounting |
§427: monthly during plan, on termination/cancellation, and within five business days of a request, with an exception for more than one request per calendar month. |
Must show receipts, creditor payments, deductions, reserves and settlement-fee calculation details. |
| Record retention |
§427 requires provider records for five years after the last payment by the individual. |
This is a provider record duty, not the limitations period for creditor claims. |
law.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comlaw.justia.comCancellation is not the same as forgiveness of debt. An individual can cancel or void an agreement with the provider under applicable rules, but the actual creditor still controls whether its original contract was altered or satisfied. No underlying debt, judgment, lien or adverse reporting entry is automatically nullified by a provider's registration failure.
Customer funds: distinguish two arrangements
| Question |
Provider-held VI trust money — §§402(20), 422 |
Federal TSR qualified dedicated account — §310.4(a)(5)(ii) |
| Trigger |
Money given to the provider for distribution to creditors under a plan. |
Covered TSR debt-relief program asks consumer to accumulate funds in a dedicated account. |
| Institution |
Insured bank under territorial definition; segregated, identified trust arrangement. |
Insured financial institution. |
| Ownership |
Money is not the provider's/designee's property and is protected from their creditors as prescribed in §422(b). |
Customer owns funds and receives any accrued interest. |
| Administrator |
Provider may operate the regulated trust under §422, with ledger and reconciliation duties. |
Administrator must be independent of, and unaffiliated with, debt-relief provider; no compensated business referrals between them. |
| Deposits |
Provider deposits customer money within two business days of receipt. |
No provider-fee entitlement arises merely from depositing savings. |
| Ledger/operations |
Separate individual records, balances summing to actual cash, at least monthly reconciliation, payments under agreed plan/creditor due dates, corrections of misdirected transfers and reimbursement for resulting creditor fees. |
Dedicated-account conditions govern; territorial provider-held trust rules are not silently imported to every independent third-party account. |
| Withdrawal/termination |
Territorial §422(h) calls for prompt return of unspent money less §423-payable fees; §426 imposes immediate return on termination. |
Qualified TSR account requires return of unearned funds within seven business days after customer withdrawal request. |
| Theft/failure |
§422(g): immediate regulator notice of suspected unlawful appropriation and further information within the prescribed period unless modified by rule. |
Applicable contract/account, federal and possible separate banking rules require their own review. |
| Insolvency |
Statutory ownership protection stated for provider-held trust money. |
Verify actual account title, administrator and ownership; cannot promise recovery from any insolvency merely because marketing calls an account “escrow.” |
law.justia.comlaw.justia.comlaw.justia.comlaw.justia.comecfr.govNo located territorial operative provision establishes a blanket requirement that every settlement company's customer's account be in a bank physically located in the Virgin Islands. That does not eliminate account eligibility, registration, insurer, regulator-examination or bank-location reporting rules. Whether a distinct money-transmission license attaches to additional independent remittance conduct remains a separate, unresolved activity test under Title 9, Chapter 22—not a license inferred from the mere existence of Chapter 7. law.justia.com
6. Consequences, remedies and read-only consumer process
| Route |
Statutory powers or remedies |
Conditions and limits |
| Lieutenant Governor investigation |
§432(a)–(b): complaints, examinations within or outside VI, records and subpoenas, possible Attorney General referrals, exam expense recovery. |
Individual identities in regulatory information have confidentiality limits. |
| Administrative correction |
§433(a): desist/correct orders, restitution to aggrieved persons, civil actions, injunctions and intervention. |
Printed civil penalty up to $10,000 per violation, subject to inflation rule, regulator discretion and enumerated factors. |
| Final-order violation |
§433(b): printed civil penalty up to $20,000 per violation for specified final-order violations/knowing participation. |
Not an automatic consumer damage award. |
| Registration sanctions |
§434: suspension, revocation and nonrenewal on enumerated grounds; expedited protections for specified trust failures. |
Applicable hearing and judicial procedures cannot be skipped. |
| Unauthorized fees |
§425(a) makes the provider agreement voidable at the individual's election, with §435(b) providing a specified treble recovery in a civil action. |
It is not automatic rescission of creditor contracts. |
| Unregistered provider |
§§425(b)–(c), 435(a): individual may void provider agreement, with recovery in a civil action of paid/deposited money except amounts paid to creditors; provider loses specified contract/restitution claims against that individual. |
Must establish requirement to register, absence of registration at assent and exercise of voidability. |
| Other material provider violations |
§435(c): proven injury, including noneconomic injury; for enumerated sections, greater of injury or printed $5,000 minimum; punitive damages and fees as specified. |
Class-action modification, actual violation, causation, statutory good-faith-error defense and judicial determination matter. |
| Cancellation-right violation |
§435(e): additional expressly stated recovery of paid/deposited money excluding payments to creditors. |
No automatic double restitution for the same dollars. |
| Consumer fraud overlap |
Title 12A, Chapter 6 protects against specified deceptive consumer-service acts; §§327–328 establish DLCA enforcement, §331 addresses its private action. |
§436 forbids a duplicate recovery under Chapters 6 and 7 for the same act/practice; Chapter 6's own consumer-purpose definitions and exemptions govern. |
| Limitation period for provider-law enforcement |
§437: four years for specified Lieutenant Governor actions; private §435 action within two years after the latest of enumerated payments, accounting, discovery or agency-action events, with specified tolling. |
These are provider statute limitation rules only; this pass does not research general debt limitations/revival. |
| Federal CROA, if independently applicable |
§1679g allows a specified measure of actual damages/fees paid, court-allowed punitive damages and fees in successful actions. |
Federal CROA definitions, exclusions and independent procedure control; do not transfer its remedies to a provider who is not covered. |
| Criminal offense |
Chapter 7's expressly read remedy sections primarily specify civil/administrative action. |
A Chapter 7-specific criminal penalty was not located in the bounded review; no declaration that other laws are inapplicable. |
| Square provider cases |
No controlling appellate decision squarely deciding Chapter 7 settlement-provider applicability/fees was identified in the bounded official-court search. |
NOT LOCATED, not proof that no decisions or agency orders exist. |

Individual provider-evaluation checklist — documents only
- Identify who contracts with the individual, who speaks to creditors, who collects compensation, and who holds funds. Keep the actual agreement, schedules and advertising representation.
- Compare territorial registration to mere DLCA business licensing, another state's license, counselor accreditation and nonprofit representations. Do not infer identity or authority from the brand name.
- Examine the exact fee base and earned-fee event: debt balance at agreement, amount actually paid to creditor, prior setup/monthly amounts, credits, refund and any paid creditor contributions.
- Record whether there were telephone sales, interstate calls, qualifying unsecured debts, creditor-executed agreements and actual first creditor payment before fees. A web landing page alone does not settle TSR coverage.
- Separate provider-held trust from customer-owned independent account. Read ownership, bank/administrator identity, reconciliation, disbursement permissions, withdrawal rights and termination instructions.
- Look for the individualized analysis, creditor participation assumptions, litigation/credit/tax risk disclosures, cancellation form, language provisions, powers of attorney and periodic accountings.
- Preserve the distinction between provider dispute and creditor obligation. A provider refund or cancellation does not prove a creditor released the debt.
- If documents are missing or inconsistent, classify the result as unverified and retain the statutory issue; do not fill gaps with a savings estimate or an assumed provider promise.
Three bounded hypotheticals
Example A — classification and failed exemption
Assumptions: A company has no VI office. It is incorporated elsewhere, holds that state's registration, describes itself as nonprofit and offers telephone counseling. For a natural person whom it knows resides in St. Croix, it negotiates concessions with three credit-card issuers. Those issuers pay the company for successful enrollments. No attorney-client legal services or bank exemption is involved.
Predicates and result:
- Three creditors' more-favorable terms are concessions, and the company is an intermediary: §402(6), (8), (15).
- Known VI residence when agreeing means §404 applies even without a VI storefront.
- Creditor compensation defeats the no-compensation exclusion in §403(b)(2).
- Nonprofit status does not exempt it, and §409(d) adds an independent-board predicate.
- Another state's registration may simplify submission under §412 but does not itself issue a VI certificate.
Conclusion: Treat Chapter 7 territorial registration as required on the stated assumptions. Its status remains unverified without the Lieutenant Governor's registration information. If genuine uncompensated counseling without creditor concessions replaced these facts, classification could differ. Consumer commercial-purpose or business-entity borrowing must also be evaluated separately. law.justia.comlaw.justia.comlaw.justia.comlaw.justia.com
Example B — worked fee ceiling and federal timing
Assumptions: One natural-person unsecured debt, original principal at agreement $10,000.00; creditor ultimately agrees to accept $6,000.00 in full satisfaction. Assume an otherwise valid VI settlement-plan agreement, a setup charge of $400.00, two monthly charges of $10.00 each, all uncredited against earlier settlement fees. Assume printed §423 figures apply only for this historical-text illustration; no separate inflation-adjustment figure is assumed.
| Step |
Plain-text equation |
Result |
| Printed setup maximum |
min($400.00, 0.04 × $10,000.00) |
$400.00 |
| Two one-creditor monthly maxima |
2 × min($10.00 × 1, $50.00) |
$20.00 |
| Actual assumed creditor reduction |
$10,000.00 − $6,000.00 |
$4,000.00 |
| Printed per-debt settlement percentage ceiling |
0.30 × $4,000.00 |
$1,200.00 |
| Illustrative additional settlement-fee ceiling |
$1,200.00 − $400.00 − $20.00 |
$780.00 |
| Illustrative aggregate of these provider fees |
$400.00 + $20.00 + $780.00 |
$1,200.00 |
All calculations are exact to cents; no rounding beyond displaying two decimal places is necessary. This is a ceiling calculation, not an authorized payment schedule or recommended price. It assumes the full $6,000 was actually paid to satisfy the debt and that §423(f)'s prior-credit conditions are met. For multiple debts, prior fee credits and each debt's separate base must be reconstructed.
If covered by the TSR, requesting the $400 setup and $10 monthly payments before its creditor-agreement/first-payment conditions would breach federal fee timing, notwithstanding these territorial printed allowances. If no qualifying settlement or payment has occurred, the illustrated $780 is not presently collectible merely because it can be calculated. Current territorial adjustment rules remain unresolved. law.justia.comecfr.govlaw.justia.com
Example C — termination and money versus creditor obligations
Assumptions: An individual has remitted $1,200.00 to a provider-held §422 trust for scheduled creditor payments. The provider has properly paid a creditor $350.00 and has earned no provider fee. The customer sends an effective later termination notice. A separate optional variant assumes $200.00 of a settlement setup fee was collected and none was credited to an earlier settlement fee.
| Item |
Calculation |
Result |
| Individual's initial trust balance |
Given |
$1,200.00 |
| Properly paid creditor |

−$350.00 |
| Provider fees payable from reserve |
Assumed zero |
−$0.00 |
| Remaining individual trust money |
$1,200.00 − $350.00 − $0.00 |
$850.00 |
| Variant: qualifying setup-fee refund |
0.65 × $200.00 |
$130.00 |
Section 426(b) calls for immediate return of the $850.00 trust balance upon termination and, in the separate variant where its predicates hold, the $130.00 setup-fee refund. Section 419(d) revokes provider powers of attorney. The creditor retains the $350 properly paid and any remaining contractual debt unless there is an actual creditor agreement altering it.
A valid timely §420 cancellation presents a different refund analysis from later termination, including the required early-cancellation form and possible narrowly valid emergency waiver. An unaffiliated TSR-qualified savings account presents still another seven-business-day withdrawal rule. Nothing here assumes an actual cancellation date, holiday calendar, creditor release or provider insolvency recovery. law.justia.comlaw.justia.comlaw.justia.comlaw.justia.comecfr.gov

- T — territorial codified-text mirror: An actual enacted-code section reproduced as 2025 Virgin Islands Code on Justia. The operative HTML section body was opened/read, unless marked otherwise. The site is not an official publisher, disclaims guaranteed currentness, and does not prove intervening amendments or implementing rules. For every T entry: jurisdiction USVI; asserted historical enactment Act No. 7145 (2010) for Chapter 7; checked 2026-10-26; HTML printed page = not applicable; PDF page index = not applicable; no source-document pixels examined. Historical session-law page references on that site were not independently inspected as page images.

Historical and status distinctions: The 2025 code-section text states Act No. 7145 was added January 27, 2010, with 2009 session-law pagination. That is historical enactment metadata, not proof that a bill became operative immediately or that no later amendment or adjustment occurred. No proposed bill or model-law text has been treated as enacted VI law. The web search returning the British Virgin Islands government's gov.vg law database was excluded as a different country/jurisdiction.
Bounded negative searches, October 26, 2026: Public indexed searches covered ltg.gov.vi, legvi.org, dlca.vi.gov, supreme.vicourts.org, vicourts.org, vid.uscourts.gov and ca3.uscourts.gov. Exact combinations included “Act 7145”, “debt-management” “rule”, “debt management” “registration”, “12A V.I.C.” “423”, “12A” “435” and “Uniform Debt-Management Services Act”. They found the regulator's general page but did not retrieve the specific operative Chapter 7 rule, fee adjustment, registered-provider roster, or square controlling opinion. These are bounded search results, never proof of legal absence.

D. Researcher self-check and publication holds
Evidence checks performed
- Jurisdiction check: U.S. Virgin Islands, not British Virgin Islands. The
gov.vg repository was excluded.
- Dedicated-statute search: Resolved positively to Title 12A, Chapter 7; no generic “unregulated” conclusion.
- Text versus authority check: Most detailed territorial conclusions rest on enacted statutory words reproduced by an unofficial publisher. This material limitation applies even to rows marked
answered.
- Exception check: Read §§402–403, 409, 412, 423–424, 428 and TSR §310.6 rather than relying on an unqualified registration/fee slogan.
- Federal overlap check: Separated FTC Act commerce, TSR telephone/unsecured-service predicates and CROA paid credit-repair purpose/exclusions.
- Math check: Example B: $10,000 − $6,000 = $4,000; 30% × $4,000 = $1,200; $1,200 − $400 − $20 = $780. Example C: $1,200 − $350 = $850; 65% × $200 = $130. No inflation adjustment was fabricated.
- Money-ownership check: Provider-held §422 trust and independent TSR customer-owned dedicated account were evaluated as different arrangements.
- Remedy check: Administrative regulator action, express Chapter 7 private relief, Chapter 6 overlap and CROA remedies kept separate. No implied debt cancellation, private remedy or guaranteed award asserted.
- Negative-source check: Inaccessible rules, registration rosters, sections and opinions remain NOT LOCATED/UNRESOLVED, not nonexistent.
- Page-integrity check: GPO PDF text layers were read; PDF pixel images were not reviewed. All HTML entries explicitly have no PDF page index.
- Scope check: The six other A066 territory dimensions remain queued; this pass did not launch them.

Unresolved question |
Why it matters / precise next evidence |
| P0 |
Does authenticated current VI Title 12A Ch.7 match the reproduced 2025 text, including §§405, 410, 419 and 423–435? |
Textual/legal currentness gate; obtain current official Lexis/authorized code or enacted session laws and amendments. |
| P0 |
What is the actual effective date of Act No. 7145 and how does §440 apply to pre-effective agreements? |
Distinguishes date signed, law published and law in force. Read original Act's effective clause. |
| P0 |
Did the Lieutenant Governor promulgate §432(f) CPI base-year/adjustment regulations and subsequent July 1 schedules? What are the operative 2026 bond, insurance, fee, penalty and statutory-damage amounts? |
Prevents false caps and remedy values. Need official promulgated rule and actual public adjustment notices, not computed estimates. |
| P0 |
Is there a Chapter 7 registration application, prescribed fee schedule and public provider-name list currently maintained by DBIFR? |
Required for accurate licensing workflow and status verification; examine public instructions only, not entities. |
| P1 |
Are the reproduced §405(b)(5) process-agent lettering and §410(b)(1) “Commission” language transcription errors, enacted errors or later cured? |
Procedural correctness; compare original Act and authoritative codification. |
| P1 |
Are §419 references to “Section 27(a)” and “Section 20” enacted numbering artifacts, and what is their binding construction? |
Required consumer agreement and notice wording; compare Act No. 7145/session-law original. |
| P1 |
Which actual Chapter 7 and related Title 3 Chapter 35 rules implement counselor certification, planner recognition, language variation, fee approval, trust bank and record duties? |
Material exception/operational duties; published regulatory instrument needed. |
| P1 |
Is a particular fund-handling arrangement independently money transmission under Title 9, Chapter 22, and what are its exclusions? |
§511 body failed; no second-license conclusion supported. Separate activity analysis. |
| P1 |
Is there an independently applicable VI credit-repair/credit-services law outside Chapter 7, and which activities trigger it? |
Separate credit-improvement business classification; no law by analogy or third-party marketing summary. |
| P1 |
Are there controlling Virgin Islands Supreme Court, District Court/Third Circuit or published agency decisions specifically interpreting §§402, 403, 423, 425 or 435? |
Can change scope and remedies; bounded indexed search was negative, archives may differ. |
| P2 |
What are the complete operative §416 customer-service staffing/system requirements? |
Direct section retrieval failed; cannot publish specific call-center promises. |
| P2 |
For mixed business/personal and secured obligations of natural persons, is there controlling VI statutory construction not obvious from §402's text? |
Boundary between §402 wording and specialized product regulation. |
| P2 |
What current public legal-aid resources and complaint intake channels are explicitly designated for Chapter 7 claims? |
Public-process accuracy; general agency sites are not a verified specialist referral. |
| P2 |
What post-2024 amendments, if any, change the relied-on federal CROA Code provisions? |
Official GPO source is 2024 edition; a newer federal statute compilation should be checked before definitive 2026 guidance. |
Publication restrictions for SettleADebt
Until the P0 holds are resolved, a public VI jurisdiction page should not claim:
- an unqualified current dollar fee cap, surety amount, insurance minimum, civil-penalty maximum or minimum statutory damages;
- that a specific provider is licensed, unlicensed, exempt, accredited or presently permitted to solicit VI residents;
- that a different state's license, nonprofit status or lawyer participation supplies an automatic exemption;
- that all debt-relief firms everywhere must wait for settlement before taking fees, without testing TSR coverage and other governing rules;
- that a provider contract binds creditors, guarantees acceptance, eliminates debt or protects against lawsuits;
- a specific customer's final cancellation, refund or filing date without actual event and counting facts;
- that an unlocated rule, license or court decision does not exist.
A conditional educational explanation of the reproduced statute, with those limitations and verified federal distinctions, is supportable. A regulatory compliance checklist authorizing business operations, a live fee calculator or a definitive consumer-remedy page is not yet publication-ready.
Disposition: Focused research report supplied, with all source, claim and granular coverage registers visible. This is a researcher self-check only. It is not independent legal verification and not acceptance of J_VI PASS-01, the complete USVI dossier, A066 or any operational/publication decision. The coordinator must separately validate the consequential territorial text, 2026 rules, arithmetic and coverage.
