[U.S. Code](https://uscode.house.gov/us/usc/119-124/t15/s1681j/) |\n\n## GROUP 2 — E-SIGN/UETA relationship correction\n\n| Affected PASS-06 location | Exact replacement |\n| --- | --- |\n| **E2 — Federal E-SIGN consumer consent** | **Electronic contract validity, electronic satisfaction of a federal writing requirement, and electronic satisfaction of a state-only writing requirement must be analyzed separately.** Section 7001(a) generally prevents a signature, contract, or record relating to a transaction in or affecting interstate or foreign commerce from being denied effect solely because it is electronic. Section 7001(c)(1) is narrower: when a statute, regulation, or other law requires transaction-related information to be provided or made available **in writing** to an E-SIGN “consumer,” electronic delivery satisfies that writing requirement only through the statutory consumer-consent framework. That framework includes affirmative consent not withdrawn; prior clear and conspicuous disclosures concerning the paper option, withdrawal and its consequences or fees, scope of consent, withdrawal and contact-update procedures, paper-copy access and charges; disclosure of hardware and software requirements; and electronic consent or confirmation reasonably demonstrating access to the format used. A material change in access requirements can require revised disclosures and renewed access demonstration. Withdrawal operates prospectively within a reasonable period after receipt, and an oral communication or recording is not an electronic record for §7001(c) unless other applicable law provides otherwise. E-SIGN also preserves the underlying law’s required content, timing, specified verification or acknowledgment method, proximity, and retainability. [U.S. Code+4](https://uscode.house.gov/us/usc/119-124/t15/s7001/) **That federal consumer-consent rule is not automatically the exhaustive rule for a Nebraska-only writing requirement.** Section 7002 permits a qualifying state enactment of the 1999 Uniform Electronic Transactions Act, or qualifying technology-neutral alternative procedures, to modify, limit, or supersede §7001 **with respect to state law only**. Section 7002(c) prevents using that authority to circumvent E-SIGN through nonelectronic-delivery requirements. Federal writing obligations—such as CROA’s disclosure, written-contract, cancellation-form, and copy requirements when CROA actually applies—remain federal obligations and are not converted into state-only obligations by Nebraska law. By contrast, for Nebraska-only Chapter 69 or CSO writing requirements, the electronic-law analysis must account for Nebraska UETA and §7002 rather than automatically applying §7001(c)(1) as though §7002 did not exist. [U.S. Code+4](https://uscode.house.gov/us/usc/119-124/t15/s7002/) Nebraska calls §§86-612 through 86-643 the **Uniform Electronic Transactions Act**, enacted through LB 929 in 2000 and recodified in 2002; §86-631 makes it prospective for electronic records or signatures created, generated, sent, communicated, received, or stored on or after July 13, 2000. Nebraska UETA separately requires party agreement to transact electronically, preservation of prescribed methods and formatting, retainability at receipt, attribution, and accessible retention. But this bounded patch did **not** authenticate a complete section-by-section comparison between current Nebraska UETA and the NCCUSL 1999 text, nor did it locate a controlling Nebraska or Eighth Circuit decision conclusively defining Nebraska’s complete §7002(a)(1) or (a)(2) effect for these DMP/CSO writings. That conformity and controlling-interpretation issue remains held. [Nebraska Legislature+5](https://nebraskalegislature.gov/laws/statutes.php?statute=86-612) **Section 7001(c)(3) is limited.** A consumer contract’s effectiveness, validity, or enforceability may not be denied **solely** because the provider failed to obtain electronic consent or confirmation in the access-demonstration manner specified by §7001(c)(1)(C)(ii). That provision does not declare the required disclosure delivered, does not excuse failure to obtain the other consent and preconsent disclosures in §7001(c)(1), and does not cure missing mandatory terms, wrong timing or proximity, use of a prohibited delivery method, failure to provide a retainable record, or other noncompliance under CROA, Nebraska law, or another applicable statute. Conversely, a §7001(c)(1)(C)(ii) access-confirmation defect alone cannot be treated as the sole ground for denying the consumer contract legal effect under E-SIGN. No ordinary DMP or CSO services contract was identified among §7003’s enumerated exceptions, but that observation does not itself establish interstate commerce, statutory-consumer status, CROA coverage, or the applicable state/federal delivery regime. [U.S. Code+3](https://uscode.house.gov/us/usc/119-124/t15/s7001/) |\n| **S_NE-P06-C041** | **Replacement claim:** Where §7001(c)(1) governs electronic delivery of a legally required writing to an E-SIGN consumer—after accounting for §7002’s state-law-only modification or supersession rule—the provider must satisfy the applicable affirmative-consent, preconsent disclosure, format-access, and material-access-change conditions. Section 7001(c)(3) prevents denial of the contract’s legal effect **solely** for failure to obtain the §7001(c)(1)(C)(ii) electronic consent or access confirmation, but it does not establish compliant delivery or cure missing content, timing, method, proximity, retainability, or other applicable-law defects. **Sources:** S_NE-P06-S004, §§7001(a)–(f), 7002(a) and (c); S_NE-P06-S003, §§86-632, 86-635, 86-636, and 86-639. **Conditions and confidence:** High for the federal and Nebraska statutory text; conditional on the actual transaction, interstate-commerce facts, E-SIGN consumer status, source of the writing requirement, CROA coverage, Nebraska UETA applicability, consent records, delivery method, and retainability. Nebraska’s complete §7002 conformity and controlling-interpretation question remains unresolved. Section 7002’s state-law-only modification/supersession rule is now preserved for Nebraska-only Chapter 69 and CSO writing duties. Remaining evidence: complete current Nebraska-versus-1999-model UETA conformity analysis; a controlling Nebraska or Eighth Circuit interpretation of §7002’s effect; actual interstate-commerce and statutory-consumer facts; actual entity and CROA status; consent, format-access, delivery, and retention records; and the separate unresolved electronic-cancellation, email-delivery, and “two easily detachable copies” equivalence issues. By contrast, for Nebraska-only Chapter 69 or CSO writing requirements, the electronic-law analysis must account for Nebraska UETA and §7002 rather than automatically applying §7001(c)(1) as though §7002 did not exist. \nU.S. Code\n+4\n\n\nNebraska calls §§86-612 through 86-643 the Uniform Electronic Transactions Act, enacted through LB 929 in 2000 and recodified in 2002; §86-631 makes it prospective for electronic records or signatures created, generated, sent, communicated, received, or stored on or after July 13, 2000. Nebraska UETA separately requires party agreement to transact electronically, preservation of prescribed methods and formatting, retainability at receipt, attribution, and accessible retention. But this bounded patch did not authenticate a complete section-by-section comparison between current Nebraska UETA and the NCCUSL 1999 text, nor did it locate a controlling Nebraska or Eighth Circuit decision conclusively defining Nebraska’s complete §7002(a)(1) or (a)(2) effect for these DMP/CSO writings. That conformity and controlling-interpretation issue remains held. \nNebraska Legislature\n+5\n\n\nSection 7001(c)(3) is limited. A consumer contract’s effectiveness, validity, or enforceability may not be denied solely because the provider failed to obtain electronic consent or confirmation in the access-demonstration manner specified by §7001(c)(1)(C)(ii). \nU.S. Code\n+3"],["S_NE-P06-C041","Replacement claim: Where §7001(c)(1) governs electronic delivery of a legally required writing to an E-SIGN consumer—after accounting for §7002’s state-law-only modification or supersession rule—the provider must satisfy the applicable affirmative-consent, preconsent disclosure, format-access, and material-access-change conditions. Section 7001(c)(3) prevents denial of the contract’s legal effect solely for failure to obtain the §7001(c)(1)(C)(ii) electronic consent or access confirmation, but it does not establish compliant delivery or cure missing content, timing, method, proximity, retainability, or other applicable-law defects.\n\nSources: S_NE-P06-S004, §§7001(a)–(f), 7002(a) and (c); S_NE-P06-S003, §§86-632, 86-635, 86-636, and 86-639.\n\nConditions and confidence: High for the federal and Nebraska statutory text; conditional on the actual transaction, interstate-commerce facts, E-SIGN consumer status, source of the writing requirement, CROA coverage, Nebraska UETA applicability, consent records, delivery method, and retainability.
