PASS-08 remains saved but **unreviewed**; none of its collection-licensing or conduct conclusions is treated as an accepted premise here. The limited actor and debt definitions necessary for this pass were freshly read.\n\nCredit reporting and furnishing disputes, FCRA identity-theft blocking, litigation proof and admissibility, pleadings, service, default judgments, ordinary limitation and revival rules, garnishment, creditor remedies, secured-debt enforcement, full sector dossiers, local and tribal law, and comprehensive remedies remain open.\n\n## Executive determination\n\nNebraska does **not have one verified general state validation procedure applying to every collection agency, original creditor, debt buyer, servicer, and commercial collector**. After fresh review of the operative Collection Agency Act provisions and the current agency-hosted Title 433, Chapter 2 text, no generally applicable Nebraska rule was verified that requires every licensed collection agency to:\n\n- send an FDCPA-style validation notice;\n- stop collection whenever a consumer disputes;\n- provide original-creditor information upon request;\n- produce a signed contract or assignment chain;\n- or give the consumer direct access to the agency’s retained payment records.\n\nChapter 2 requires licensed agencies to retain detailed collection-payment records for two years, but it does not convert those internal records into a consumer-facing inspection or production right. Its FDCPA provision requires the Board to notify applicants that the federal statute exists; it does not independently enact every FDCPA or Regulation F requirement as Nebraska law. This is a bounded verification result, not proof that no administrative interpretation, archived order, private contract duty, or unindexed authority exists. [Nebraska Legislature+3](https://nebraskalegislature.gov/laws/statutes.php?statute=45-601)\n\nNebraska instead has **targeted account-information duties** tied to particular actors and transactions:\n\n- licensed installment-loan owners and servicers;\n- holders of retail installment contracts;\n- sellers under revolving charge agreements;\n- secured parties under UCC §9-210;\n- licensed residential mortgage bankers and servicers; and\n- public bodies before placing debts with collection agencies.\n\nThose rights differ materially in scope, required documents, deadlines, fees, and whether they apply to consumer or commercial transactions. None of the reviewed targeted Nebraska requests automatically suspends collection unless another law independently does so. [Nebraska Legislature+5](https://nebraskalegislature.gov/laws/statutes.php?statute=45-345)\n\nThe federal FDCPA and Regulation F provide the principal generally applicable validation architecture for a qualifying **federal debt collector** collecting a personal, family, or household debt. They do not automatically apply to an original creditor collecting in its own name, a commercial debt, or every entity requiring a Nebraska collection-agency license. A debt buyer can still qualify under the federal “principal purpose” definition even though it owns the debt and hires others to make the direct contacts. [U.S. Code+2](https://uscode.house.gov/us/usc/119-124/t15/s1692a/)\n\nThe federal oral-versus-written distinction is exact:\n\n- Under the validation notice’s assumption language, a consumer may **contact** the collector to dispute by the validation-period end date; a timely oral dispute therefore prevents the collector from relying on the notice’s stated assumption that the debt is valid.\n- But the statutory **cease-collection-and-verify** protection requires a dispute or original-creditor request submitted **in writing** during the validation period. The collection pause begins when the collector receives that timely written submission.\n- Failure to dispute is not a legal admission. [eCFR+1](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\nNeither federal validation nor the Nebraska targeted account-statement statutes establish a universal right to a wet-ink contract, every invoice, every assignment document, or a complete litigation-ready file. In *Dunham v. Portfolio Recovery Associates*, the Eighth Circuit found the verification sufficient on the particular mistaken-identity facts without requiring the collector to contact the original creditor, while expressly recognizing that different facts might require more. That holding is fact-specific, not a universal minimum-document checklist. [U.S. Court of Appeals+1](https://ecf.ca8.uscourts.gov/opndir/11/12/111553P.pdf)\n\n# A. [Nebraska Legislature+2](https://nebraskalegislature.gov/laws/statutes.php?statute=45-204) |\n\n# B. Nebraska Collection Agency Act and Chapter 2\n\n## B1. Necessary scope gateway\n\nThe Collection Agency Act definition includes persons soliciting claims “of any kind” from more than one creditor-client and persons asserting, enforcing, or prosecuting those claims. It also reaches a creditor that collects its own accounts under a name suggesting that a third person is collecting. Exclusions include regular employees of a single creditor, specified financial institutions, qualifying attorneys, court-order actors, and purchasers that buy claims for value and collect them in the purchaser’s own name. These classifications determine whether the state licensing regime applies; they do not themselves create a consumer validation right. [Nebraska Legislature+1](https://nebraskalegislature.gov/laws/statutes.php?statute=45-601)\n\nThe federal and Nebraska classifications can diverge. A commercial collection agency can be state-licensed even though its business invoices are outside the FDCPA. Conversely, a purchaser excluded from Nebraska’s collection-agency definition may still be a federal principal-purpose debt collector. [Nebraska Legislature+2](https://nebraskalegislature.gov/laws/statutes.php?statute=45-602)\n\n## B2. State records retained by collection agencies\n\nThe current agency-hosted Chapter 2 rule requires a licensee to retain collection-payment records for two years after receipt. The record fields include:\n\n- consumer or business name;\n- client name;\n- amount and date received;\n- allocation among principal, interest, court costs, attorney fees, and other costs;\n- applicable interest rate;\n- current balance; and\n- deposit date.\n\nThe rule does not say that a consumer may inspect, demand, or obtain those records before litigation. Nor does the Act’s regular-office or discipline language create such a right. [Nebraska Secretary of State+2](https://sos.nebraska.gov/sites/default/files/doc/Chapter-2.pdf)\n\nThe rule’s FDCPA provision requires the Board to advise applicants of the federal statute and how to obtain it. It does not state that the federal validation provisions become independent Nebraska requirements for:\n\n- commercial debt;\n- original creditors;\n- Nebraska-excluded debt purchasers;\n- or another actor outside the federal definition. [Nebraska Secretary of State](https://sos.nebraska.gov/sites/default/files/doc/Chapter-2.pdf)\n\n## B3. Bounded “no general counterpart verified” conclusion\n\nThe following Nebraska collection-agency requirements were **not verified** in the complete operative Act provisions and current agency-hosted Chapter 2 reviewed here:\n\n- a five-day state validation notice;\n- a state thirty-day dispute period;\n- a statewide original-creditor request right;\n- a statewide cease-collection-on-dispute rule;\n- a general production right for the original contract or assignment chain;\n- a state model validation form;\n- or a consumer right to inspect Chapter 2 records.\n\nThis conclusion is bounded by three limitations:\n\n1. The complete certified adoption and revision history for Title 433 was not authenticated.\n2. No exhaustive paper administrative-order archive or records request was used.\n3. Private contracts and sector-specific statutes can impose separate duties.\n\n# C. Nebraska targeted account-information duties\n\n## C1. Licensed installment loans\n\n### Covered actor and transaction\n\nThe Nebraska Installment Loan and Sales Act defines a “consumer” as a Nebraska-resident individual obtaining financial products or services primarily for personal, family, or household use. A covered “loan” is a qualifying extension of credit to such a consumer. The licensing statute reaches persons that own, acquire, service, participate in, or otherwise conduct loan activity with the installment borrower, subject to enumerated exclusions. A debt buyer or servicer is therefore not excluded from these duties merely because it did not originate the loan, but actual license and exemption facts remain necessary. [Nebraska Legislature+1](https://nebraskalegislature.gov/laws/statutes.php?statute=45-335)\n\n### Written account-statement and document request\n\nUpon the borrower’s written request, a covered licensee must provide:\n\n- a written statement of the dates and amounts of payments;\n- default and deferment charges assessed before the month in which the request was received;\n- the total unpaid amount at the end of the statement period;\n- a copy of the loan agreement;\n- a copy of the security agreement; and\n- a facsimile of an insurance certificate issued as part of the transaction, when applicable.\n\nThe copy fee must be reasonable and may not exceed $0.50 per page. Section 45-345(8) supplies no response deadline, assumed-receipt rule, collection pause, sworn-verification standard, or assignment-chain requirement. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-345)\n\n### Payoff request\n\nA licensee must answer a written payoff request from the borrower or the borrower’s representative in writing within ten business days after receipt. The service is free unless the licensee already fulfilled another payoff request within the preceding sixty days; in that circumstance, the subsequent request may carry a processing fee of up to $10. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-345)\n\nThe payoff request and the §1692g dispute are distinct:\n\n- the state payoff request seeks a current payoff figure;\n- the federal dispute seeks verification and may pause collection;\n- satisfying one does not necessarily satisfy the other.\n\n## C2. Retail installment contracts\n\nThe current holder of a retail installment sales contract must, on the buyer’s written request, give or forward a written statement showing:\n\n- the dates and amounts of payments; and\n- the total amount unpaid under the contract.\n\nA cash payment requires a written receipt. After full payment, the holder must deliver or mail an acknowledgment of payment in full, release security in the goods, mark the relevant document canceled, and return the original agreement or copy—or other signed instruments—to the buyer. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-364)\n\nThe ordinary written-request duty does not state:\n\n- a response deadline;\n- a collection pause;\n- a verification affidavit;\n- a requirement to identify every prior owner;\n- or a right to every underlying transaction document.\n\nBecause the duty is imposed on the current “holder,” it can follow the account to a successor holder without depending on whether that holder is a federal debt collector.\n\n## C3. Revolving charge agreements\n\nA seller must promptly provide a statement for each monthly or otherwise agreed regular period in which an unpaid balance exists. The statement must show:\n\n- beginning and ending unpaid balances;\n- purchases or services and dates unless otherwise supplied;\n- payments and credits;\n- the time-price differential; and\n- the buyer’s right to pay all or part of the balance.\n\nCompliance with applicable federal Consumer Credit Protection Act disclosure regulations is deemed compliance. A fully paid account inactive for at least twenty-four months must be marked closed or paid, and the buyer must receive written notice within forty-five days after that designation. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-206)\n\nThe definition of “buyer” includes a person, firm, or corporation. This branch is therefore not limited to personal-purpose debt. It is an automatic periodic-statement duty, not a dispute-triggered verification or collection-pause procedure. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-204)\n\n## C4. UCC §9-210 secured-obligation requests\n\nA debtor may send a signed record reasonably identifying the transaction or relationship and request one of three things:\n\n1. an accounting of unpaid obligations secured by collateral;\n2. approval or correction of the debtor’s collateral list; or\n3. approval or correction of the debtor’s stated aggregate unpaid secured obligations as of a specified date.\n\nA covered secured party must respond within fourteen days after receipt by signing and sending the accounting, approval, or correction. The current-secured-party duty excludes a buyer of accounts, chattel paper, payment intangibles, or promissory notes and a consignor. [Nebraska Legislature](https://nebraskalegislature.gov/laws/ucc.php?code=9-210)\n\nA former secured party that claims no present interest but previously claimed one must, within fourteen days:\n\n- disclaim the interest; and\n- if known, provide the name and mailing address of an assignee or successor.\n\nThat is the clearest Nebraska statutory successor-identification duty located in this pass. [Nebraska Legislature](https://nebraskalegislature.gov/laws/ucc.php?code=9-210)\n\nThe debtor receives one response without charge in each six-month period. The secured party may charge no more than $25 for each additional response. An “accounting” must identify aggregate unpaid secured obligations as of a date no more than thirty-five days before or after the record date and identify the obligation components in reasonable detail. [Nebraska Legislature+1](https://nebraskalegislature.gov/laws/ucc.php?code=9-210)\n\nA UCC request may be electronic. “Record” includes information stored electronically in perceivable form, and “sign” includes an electronic symbol, sound, or process attached or logically associated with the record with present intent to authenticate or adopt it. [Nebraska Legislature+1](https://nebraskalegislature.gov/laws/ucc.php?code=1-201)\n\nSection 9-210 does **not** state that:\n\n- collection must stop;\n- the secured debt is invalid if the response is disputed;\n- the secured party must produce the original signed contract;\n- every assignment document must be supplied;\n- or the response proves litigation standing.\n\n## C5. Residential mortgage servicing\n\nFor a covered Nebraska residential mortgage, the licensed mortgage banker’s annual report must identify the licensee and borrower and summarize:\n\n- escrow beginning balance;\n- aggregate escrow deposits;\n- withdrawals categorized by principal, interest, taxes, insurance, and other withdrawals;\n- beginning principal;\n- principal payments; and\n- ending principal.\n\nThe licensee must maintain a toll-free or collect-call inquiry channel while servicing, and for twelve months after servicing ceases. A written payoff request from the borrower or designated representative must be answered in writing within seven business days after receipt. It is free unless a prior request was fulfilled within sixty days, in which case a fee of up to $10 is permitted. Mortgage loan and application documents must be retained for five years after funding, denial, or withdrawal. [Nebraska Legislature+1](https://nebraskalegislature.gov/laws/statutes.php?statute=45-702)\n\nThe five-year retention requirement is not an express right for the borrower to demand the complete file. Full RESPA and Regulation X notices of error, information requests, servicing-transfer obligations, and foreclosure-document consequences remain outside this pass.\n\n## C6. Public debt before agency placement\n\nBefore assigning a public debt to a licensed collection agency, a Nebraska public body generally must:\n\n- attempt first-class-mail notice to the debtor’s last-known address;\n- identify the debt’s existence;\n- state that it may be assigned to a collection agency if unpaid; and\n- wait at least thirty days after sending the notice.\n\nThe child-support branch is excepted. This is a pre-placement notice, not an itemized validation procedure or a consumer-request production right. [Nebraska Legislature](https://nebraskalegislature.gov/laws/statutes.php?statute=45-623)\n\n# D. Federal FDCPA and Regulation F validation architecture\n\n## D1. Coverage comes first\n\nThe FDCPA defines:\n\n- “consumer” as a natural person obligated or allegedly obligated to pay a debt;\n- “debt” as an obligation arising primarily from a personal, family, or household transaction; and\n- “debt collector” through the principal-purpose and regularly-collects-for-another branches, plus specified inclusions and exclusions.\n\nA Nebraska collection-agency license does not itself establish federal coverage, and the absence of such a license does not itself resolve federal coverage. [U.S. Code](https://uscode.house.gov/us/usc/119-124/t15/s1692a/)\n\nA debt buyer that owns the account is outside only the “regularly collects debts owed another” branch addressed in *Henson*. The Supreme Court expressly declined to decide the separate principal-purpose definition. The Eighth Circuit later held in *Reygadas* that a debt buyer can satisfy that principal-purpose branch even when independent law firms and agencies perform the direct collection work. [Supreme Court+1](https://www.supremecourt.gov/opinions/16pdf/16-349_c07d.pdf)\n\n## D2. Initial validation information\n\nUnless the required information is included in the initial communication, provided orally in that initial communication, or the debt is paid before the later notice would be due, a covered debt collector must provide validation information within five days after the initial communication. Formal civil pleadings and specified statutory privacy or breach notices are excluded from “initial communication.” [U.S. Code+1](https://uscode.house.gov/us/usc/119-124/t15/s1692g/)\n\nThe current validation information generally includes:\n\n- collector name and dispute/request mailing address;\n- consumer name and mailing address;\n- the creditor on the itemization date for covered consumer-financial-product debt;\n- associated account number or recognizable truncation;\n- current creditor;\n- itemization date;\n- debt amount on that date;\n- itemization of interest, fees, payments, and credits since that date;\n- current debt amount;\n- validation-period end date;\n- dispute, verification, and original-creditor-right disclosures; and\n- response prompts and mailing information.\n\nThe itemization date may be the last statement date, charge-off date, last payment date, transaction date, or judgment date. [eCFR+2](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\nEvery required itemization field must appear. Where no interest, fee, payment, or credit exists, the collector may state “0,” “none,” or an equivalent explanation, but may not leave the required field blank. The arithmetic display does not independently establish that an interest or fee is lawful. [Consumer Financial Protection Bureau+1](https://www.consumerfinance.gov/rules-policy/regulations/1006/34/)\n\nFor certain residential mortgage debts with a Regulation Z periodic statement, the collector may provide the most recent periodic statement in the same communication and refer to it instead of reproducing the itemization-date, itemization-amount, and intervening-itemization fields on the validation notice. [eCFR+1](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\n## D3. Validation period and assumed receipt\n\nThe validation period begins when the validation information is provided and ends thirty days after the consumer receives or is assumed to receive it. For calculation purposes, the collector may assume receipt on a date at least five days after provision, excluding Saturdays, Sundays, and federal legal holidays. [eCFR](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\nThe official interpretation permits the collector to use the assumed-receipt date when calculating the displayed end date even if the collector later learns that actual receipt occurred on another date. If an initial notice is undeliverable and a later notice is sent, the later notice receives a newly calculated validation period. [Consumer Financial Protection Bureau](https://www.consumerfinance.gov/rules-policy/regulations/1006/34/)\n\nThis is not a universal five-business-day mailing presumption under Nebraska law. It is the federal Regulation F calculation for a covered validation notice.\n\n## D4. Oral dispute versus written dispute\n\nThe validation notice must say that the collector will assume the debt valid unless the consumer **contacts** the collector to dispute by the specified date. The word “contacts” is not limited to writing. A timely oral dispute therefore negates the notice’s stated basis for assuming validity. [eCFR+1](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\nBut the statutory collection pause is different. Under §1692g(b) and §1006.38, the consumer must submit the dispute **in writing** during the validation period. Upon the collector’s receipt of that timely written dispute, it must cease collection of:\n\n- the entire debt, if the entire debt is disputed; or\n- only the disputed portion, if the dispute is partial,\n\nuntil it sends the consumer a copy of the verification or judgment. [U.S. Code+1](https://uscode.house.gov/us/usc/119-124/t15/s1692g/)\n\nThus:\n\n| Consumer action | Prevents collector’s stated “assume valid” position? | Creates mandatory federal collection pause? |\n| --- | --- | --- |\n| Timely oral dispute | **Yes**, under the validation-notice wording | **No**, not under §1692g(b)/§1006.38 alone |\n| Timely written dispute | **Yes** | **Yes**, upon receipt |\n| Late oral or written dispute | Failure to dispute remains no legal admission | No §1692g/§1006.38 pause established |\n| Timely written partial dispute | Yes for disputed portion | Pause applies to disputed portion |\n\nCollection activities may otherwise continue during the validation period, but they may not overshadow or contradict the consumer’s dispute and original-creditor rights. [U.S. Code+1](https://uscode.house.gov/us/usc/119-124/t15/s1692g/)\n\n## D5. Original-creditor request\n\nUpon receipt of a written original-creditor request submitted during the validation period, the collector must stop collection of the whole debt until it sends the original creditor’s name and address. If the original and current creditor are the same, the collector may instead:\n\n- reasonably determine they are the same;\n- notify the consumer of that fact; and\n- refer the consumer to the previously supplied validation information. [eCFR](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.38)\n\nThis right is an identity request. It does not, by itself, require:\n\n- the original contract;\n- the original creditor’s complete file;\n- every assignment;\n- payment history from inception;\n- or evidence sufficient for a later lawsuit.\n\n## D6. Written and electronic submissions\n\nFor §1006.38, “in writing” includes:\n\n- mailed writing;\n- the validation-notice response form;\n- an email or portal through which the collector accepts consumer electronic communications;\n- personal delivery; or\n- courier delivery.\n\nA message sent through an electronic channel the collector does not accept is not automatically a valid written submission under the official interpretation. [Consumer Financial Protection Bureau](https://www.consumerfinance.gov/rules-policy/regulations/1006/38/)\n\n## D7. Duplicative disputes\n\nA later dispute is duplicative when it:\n\n- is substantially the same as a prior timely written dispute;\n- the collector already supplied verification for the prior dispute; and\n- it contains no new and material supporting information.\n\nA canceled check or other information reasonably likely to change the prior verification is new and material, not duplicative. For a true duplicative dispute, the collector may end the pause by sending a notice that:\n\n- identifies the dispute as duplicative;\n- briefly explains why; and\n- refers the consumer to the earlier response,\n\nor by reverifying the debt. [Consumer Financial Protection Bureau+1](https://www.consumerfinance.gov/rules-policy/regulations/1006/38/)\n\n## D8. Delivery and electronic validation\n\nRequired written or electronic disclosures must be sent in a manner reasonably expected to provide actual notice and in a retainable form. A known undeliverable transmission does not satisfy that standard. Mailing to the last-known address is a safe harbor only if the collector does not know or have reason to know that the consumer no longer receives mail there. An opted-out email address or telephone number cannot be used for required disclosures. [Consumer Financial Protection Bureau](https://www.consumerfinance.gov/rules-policy/regulations/1006/42/)\n\nThe express Regulation F electronic pathways for:\n\n- a validation notice sent electronically within five days after an initial communication;\n- an original-creditor response; and\n- a verification response\n\nmust satisfy E-SIGN §101(c). This is not unrestricted authority to email a validation packet without applicable consent and access requirements. [Consumer Financial Protection Bureau](https://www.consumerfinance.gov/rules-policy/regulations/1006/42/)\n\n## D9. Model Form B-1\n\nModel Form B-1, or a substantially similar form used as specified, creates a safe harbor for the validation-information and form requirements. It is not the only lawful format, and it is not an independently mandatory Nebraska form. Content placed on a permitted separate page does not receive the same safe harbor merely because the front page uses Model Form B-1. [eCFR+1](https://www.ecfr.gov/current/title-12/chapter-X/part-1006/subpart-B/section-1006.34)\n\n## D10. Failure to dispute\n\nFailure to dispute:\n\n- may permit the collector to use the notice’s stated assumption of validity for its collection process;\n- does **not** constitute a legal admission of liability in court;\n- does not validate an unauthorized fee;\n- does not prove ownership;\n- and does not waive transaction-specific Nebraska account-information rights. [U.S. Code+1](https://uscode.house.gov/us/usc/119-124/t15/s1692g/)\n\n# E. Validation versus account-document requests\n\n| Request or notice | What must be supplied | What it does **not** necessarily require | Pause |\n| --- | --- | --- | --- |\n| **Federal validation notice** | Creditor and collector identities, account identifier, itemization date and amount, intervening interest/fees/payments/credits, current amount, rights and response information | Original contract, every statement, full assignment chain, sworn affidavit | None merely from notice |\n| **Timely federal written dispute** | Verification or judgment must be sent before collection restarts | Universal wet-ink contract, original-creditor contact, every litigation exhibit | Yes, debt or disputed portion |\n| **Timely federal original-creditor request** | Original creditor’s name and address, or same-creditor notice and reference | Original creditor’s full file or payment ledger | Yes, whole debt |\n| **Nebraska installment-loan §45-345(8) request** | Payment dates/amounts, default/deferment charges, unpaid total, loan and security agreements, insurance certificate if applicable | Assignment chain, litigation proof package | No statutory pause |\n| **Installment-loan payoff request** | Written payoff response | Verification of ownership or dispute response | No statutory pause |\n| **Retail installment holder request** | Payment dates/amounts and total unpaid | Full contract copy before payoff, assignment chain | No statutory pause |\n| **Revolving charge periodic statement** | Beginning/end balances, purchases, payments, credits, time-price differential | Dispute investigation or ownership verification | No statutory pause |\n| **UCC §9-210 accounting** | Aggregate secured obligations and components; or approval/correction; successor information from former party | Original contract, all assignments, unsecured-debt validation | No statutory pause |\n| **Mortgage annual report/payoff** | Annual escrow/principal summary or timely payoff | Complete servicing file; federal RESPA information-request response | No statutory pause |\n| **Chapter 2 retained records** | Records must exist and be retained by licensee | Consumer production or inspection right | None |\n\n# F. It does not require a collector to create records it would not otherwise create solely for retention purposes. Accurate and accessible electronic retention is sufficient. A transfer may start the former collector’s three-year retention clock if the transfer is its last collection activity. [Consumer Financial Protection Bureau](https://www.consumerfinance.gov/rules-policy/regulations/1006/100/)\n\n## F2. Evidence legally required to be furnished\n\nThe following are affirmative production duties under the authorities reviewed:\n\n- federal validation information;\n- federal verification or judgment after a timely written dispute;\n- federal original-creditor identity after a timely written request;\n- Nebraska installment-loan statement and specified agreement copies;\n- retail installment payment/unpaid-balance statement;\n- revolving charge periodic statement;\n- UCC accounting, correction, or successor identification;\n- Nebraska mortgage annual report and payoff; and\n- public-debt pre-placement notice.\n\nNo reviewed authority supplies a universal prelitigation right to:\n\n- the original wet-ink agreement;\n- a complete chain of assignments;\n- every monthly statement;\n- every electronic data field;\n- a bill of sale identifying the individual account;\n- witness testimony;\n- account-level admissibility foundations;\n- or all documents required to win a later collection lawsuit.\n\nThose may be required by a targeted statute, private contract, court rule, discovery order, evidentiary standard, or later litigation proof—but not by federal validation alone.\n\n# G. Successor collector and transfer matrix\n\n| Transfer event | Verified consequence | Unresolved point |\n| --- | --- | --- |\n| Retail installment contract transferred | Current holder owes the §45-364 statement and payoff-completion duties | Whether predecessor must transmit every dispute record is not stated |\n| Installment loan sold or servicing transferred to a covered licensee | Current covered owner or servicer falls within §45-336’s broad licensing architecture and can owe §45-345 duties | Actual exemption, licensing, and transfer agreement facts |\n| UCC secured interest transferred | Former secured party must identify known assignee or successor after qualifying signed request | Buyer-of-accounts exclusion and exact transaction classification |\n| Collection account placed with new federal debt collector | New collector must assess its own initial communication and validation duties; no blanket predecessor-notice exemption was located in the reviewed text | Effect of a prior timely dispute or verification on the successor beyond the specific federal rules |\n| Different federal collector selects itemization date | Later collector may use a different permitted reference date than the prior collector | Each collector must use its selected date consistently in its own disclosures |\n| Former federal collector transfers debt as final activity | Former collector’s three-year Reg F retention clock may begin | Contractual access to transferred records and successor retention duties |\n| Nebraska collection account sold or reassigned generally | No general state rule was verified requiring transfer of consumer dispute flags or prior verification communications | FCRA furnishing, litigation, contract, and sector duties remain later work |\n| Public debt assigned to agency | Public body generally must send notice and wait 30 days first | No general dispute-transfer or itemization duty in §45-623 |\n\nThe successor itemization-date rule and former-collector record-retention rule are express federal interpretations. [Consumer Financial Protection Bureau+1](https://www.consumerfinance.gov/rules-policy/regulations/1006/34/)\n\n# H. Controlling and material appellate authorities\n\n## H1. *Dunham v. Portfolio Recovery Associates, LLC*\n\n**Court and posture:** Published Eighth Circuit decision reviewing summary judgment. The collector mistakenly sent a collection letter to the wrong person bearing the same name. The recipient timely disputed in writing and requested validation. [U.S. Court of Appeals](https://ecf.ca8.uscourts.gov/opndir/11/12/111553P.pdf)\n\n**Consumer status:** The Eighth Circuit held that a person mistakenly dunned is still a statutory “consumer” because a mistaken allegation that the person owes a debt is still an allegation. [U.S. Court of Appeals](https://ecf.ca8.uscourts.gov/opndir/11/12/111553P.pdf)\n\n**Verification holding:** The collector’s response included identifying information about the actual debtor, transaction and purchase dates, current balance, and an employee affidavit addressing assignment and amount. The court held that response sufficient on those facts even though the collector had consulted only its own records and had not contacted the original creditor. [U.S. Court of Appeals](https://ecf.ca8.uscourts.gov/opndir/11/12/111553P.pdf)\n\n**Limit:** The court expressly said different facts might require more. *Dunham* therefore does not establish that:\n\n- every spreadsheet is sufficient;\n- original-creditor contact is never required;\n- a signed contract can never be required under another law;\n- every assignment affidavit proves ownership;\n- or federal verification equals litigation proof.\n\nThe decision predates Regulation F’s detailed initial-notice itemization requirements, but no later Eighth Circuit or Supreme Court authority located in this bounded search displaced its fact-specific verification holding.\n\n## H2. *Henson v. Santander Consumer USA Inc.*\n\nThe Supreme Court held only that an entity collecting debts it owns does not satisfy the FDCPA branch covering one who regularly collects debts owed another. The Court expressly declined to decide the principal-purpose definition. [Supreme Court+1](https://www.supremecourt.gov/opinions/16pdf/16-349_c07d.pdf)\n\n## H3. *Reygadas v. DNF Associates, LLC*\n\nThe Eighth Circuit held that the principal-purpose branch is distinct and can cover a debt buyer whose principal business purpose is collecting purchased consumer debts, even when other firms perform the direct contacts. The court vacated and remanded on the separate agency/imputation question; it did not hold every purchaser liable for every contractor act. [U.S. Court of Appeals+1](https://ecf.ca8.uscourts.gov/opndir/20/12/193167P.pdf)\n\n## H4. Negative and unavailable authority limits\n\nThe bounded public-source search did not locate:\n\n- a Nebraska appellate decision establishing a general state validation right;\n- a Nebraska appellate interpretation of a consumer’s right to inspect Chapter 2 collection records;\n- an Eighth Circuit decision establishing one universal document package for every §1692g verification;\n- a controlling Nebraska or Eighth Circuit decision resolving electronic validation through an unaccepted email channel;\n- or a controlling successor-collector decision requiring transfer of every prior dispute record.\n\nThat is not proof that no trial decision, unpublished opinion, administrative order, archived matter, or commercial-citator authority exists.\n\n# I. Bounded workflows and worked examples\n\n## Example 1 — Original creditor versus covered third-party collector\n\n### Facts A: original creditor\n\nA Nebraska retailer collects its own personal-purpose account in its true name.\n\n**Result**\n\n- No federal §1692g duty is established solely from those facts because the retailer is not shown to be a federal debt collector.\n- If the account is a revolving charge agreement, §45-206 periodic statements may still apply.\n- A Nebraska collection-agency license or Chapter 2 record rule does not create a federal validation right.\n\n### Facts B: third-party collector\n\nThe retailer places the account with a company that regularly collects consumer debts owed to others.\n\n**Result**\n\n- Federal debt-collector and debt predicates are satisfied on the stated assumptions.\n- The collector must provide §1006.34 validation information.\n- A timely written dispute triggers §1006.38’s pause.\n\nNo conclusion is made about licensing, ownership, fee legality, or remedies.\n\n## Example 2 — Timely oral dispute\n\n**Assumptions**\n\n- Validation-period end date shown in the notice is **V**.\n- Consumer telephones the covered collector before V and says the debt is not theirs.\n- No written dispute is submitted.\n\n**Result**\n\nPlain text\n```\nTimely contact disputing debt                 Yes\nCollector's stated basis to assume validity   Defeated\nMandatory §1006.38 collection pause           No\nLegal admission from failure to write         No\n```\n\nThe collector may continue otherwise lawful collection, but may not overshadow the dispute rights or make false statements. The oral dispute does not become a timely written dispute merely because the collector records the call.\n\n## Example 3 — Timely written partial dispute\n\nDefine:\n\nPlain text\n```\nP = date validation information is provided\nR = actual or permitted assumed receipt date\nV = 30 days after R, as displayed by collector\nD = date collector receives timely written dispute\n```\n\nAssume the consumer timely submits in writing by V and disputes only a $200 fee.\n\n**Sequence**\n\nPlain text\n```\nP          Validation information provided\nR          Consumer receives or is assumed to receive it\nV          Validation period ends\nD          Collector receives timely written partial dispute\nD onward   Collector must cease collection of disputed $200 portion\n```\n\nCollection of the undisputed balance is not automatically paused, but communications may not misrepresent the dispute or overshadow rights. Collection of the $200 portion may restart only after the collector sends verification or a judgment covering that portion.\n\nNo exact calendar date is calculated because actual provision, receipt, federal holidays, and delivery facts were not supplied.\n\n## Example 4 — Late written dispute\n\n**Assumptions**\n\n- Consumer submits a written dispute after V.\n- Collector receives it.\n- No other statute or contract creates a pause.\n\n**Result**\n\nPlain text\n```\nTimely §1006.38 written dispute        No\nMandatory §1692g collection pause      No\nConsumer's silence treated as court admission  No\n```\n\nThe collector may respond voluntarily and remains subject to prohibitions against deception, unfairness, and collecting an unauthorized amount. A late dispute is not the same as debt validity.\n\n## Example 5 — Original-creditor information request\n\n**Assumptions**\n\n- Consumer submits a written request within the validation period.\n- Collector receives it.\n\n**Branch A: different original creditor**\n\nThe collector must stop collection of the entire debt until it sends the original creditor’s name and address.\n\n**Branch B: original and current creditor are the same**\n\nThe collector may:\n\n1. reasonably determine they are the same;\n2. notify the consumer in writing or electronically; and\n3. refer the consumer to the prior validation information.\n\nThe request does not compel a signed contract or full original-creditor file.\n\n## Example 6 — Federal verification versus Nebraska loan documents\n\n**Facts**\n\n- Covered federal collector is servicing a Nebraska installment loan.\n- Borrower timely disputes in writing under §1006.38.\n- Borrower also separately makes a written §45-345(8) request.\n\n**Federal branch**\n\nCollector must pause and send verification or judgment before restarting collection.\n\n**Nebraska branch**\n\nCovered licensee must provide:\n\n- payment dates and amounts;\n- default/deferment charges;\n- unpaid total;\n- loan agreement;\n- security agreement; and\n- applicable insurance certificate.\n\nThe federal verification may be adequate under *Dunham* without the complete document package, while the separate Nebraska request can independently require the specified agreement copies.\n\n## Example 7 — Successor collector\n\n**Facts**\n\n- Collector A sends a validation notice and later transfers the account.\n- Collector B begins collection.\n- Both are assumed to be covered federal debt collectors.\n\n**Result**\n\n- Collector B must assess whether its first communication triggers its own §1006.34 duty.\n- Collector B may select a different permitted itemization date from Collector A.\n- Collector B must use its selected date consistently.\n- Collector A retains its compliance evidence for three years after its last collection activity, which may be the transfer.\n- No general Nebraska rule was verified requiring A to transfer every prior dispute and response to B.\n\nThe actual transfer agreement, existing dispute status, and any credit-reporting obligations remain held.\n\n## Example 8 — Electronic dispute\n\n### Accepted medium\n\nThe notice says the collector accepts disputes at a specified email address. Consumer sends a timely dispute there.\n\nPlain text\n```\nElectronic medium accepted by collector     Yes\n\"In writing\" under official interpretation  Yes\nPause begins                                On collector's receipt\n```\n\n### Unaccepted medium\n\nConsumer sends a direct message through a social-media account the collector has never designated or accepted for consumer communications.\n\nPlain text\n```\nAccepted electronic medium established      No\nTimely written dispute established           Held\n```\n\nA collector may voluntarily treat the message as a dispute, but the official interpretation does not make every electronic channel sufficient.\n\n## Example 9 — Regulation F itemization arithmetic\n\n**Hypothetical assumptions**\n\nPlain text\n```\nDebt on itemization date                   $1,000\nInterest since itemization date               40\nFees since itemization date                   25\nPayments since itemization date             -150\nCredits since itemization date               -20\n                                           ------\nCurrent amount                              $895\n```\n\nCalculation:\n\nPlain text\n```\n$1,000 + $40 + $25 - $150 - $20 = $895\n```\n\nThe notice must identify all four itemization categories, using zero or “none” where appropriate. The arithmetic does **not** establish that the $40 interest or $25 fee is contractually or legally authorized, that the collector owns the debt, or that $895 would be admissible litigation proof.\n\n## Example 10 — Nebraska installment-loan copies and payoff\n\n**Assumptions**\n\n- Covered licensee must provide twelve pages of agreement copies.\n- Maximum statutory copy charge is used.\n- Borrower also makes a written payoff request.\n- No prior payoff request was fulfilled within sixty days.\n\n**Copy calculation**\n\nPlain text\n```\n12 pages × $0.50 per page = $6.00 maximum copy charge\n```\n\n**Payoff**\n\nPlain text\n```\nWritten payoff request received      Event R\nResponse due                         Within 10 business days after R\nPermitted payoff fee                 $0\n```\n\nIf a prior payoff request was fulfilled within sixty days, the subsequent processing fee may not exceed $10. The ordinary §45-345(8) account/document request has no verified response deadline.\n\n## Example 11 — UCC accounting requests\n\n**Assumptions**\n\n- Requester is the debtor.\n- Recipient is a covered secured party, not an excluded buyer of accounts or other excluded actor.\n- Request is a signed record reasonably identifying the transaction.\n\n### First request in six months\n\nPlain text\n```\nResponse deadline       14 days after receipt\nPermitted charge        $0\nCollection pause        None stated\n```\n\n### Second request in same six-month period\n\nPlain text\n```\nResponse deadline       14 days after receipt\nMaximum charge          $25\nCollection pause        None stated\n```\n\nAn electronic record with an electronic signature made with present intent can satisfy the signed-record form.\n\n## Example 12 — Former secured party\n\n**Facts**\n\n- Recipient previously held the security interest.\n- Recipient no longer claims any interest.\n- Recipient knows the successor’s name and mailing address.\n\n**Result**\n\nWithin fourteen days after receipt of the qualifying request, the former secured party must send a signed record:\n\n1. disclaiming its interest; and\n2. identifying the known successor and mailing address.\n\nThis is successor identification, not proof of every intermediate assignment.\n\n## Example 13 — Mortgage payoff\n\n**Assumptions**\n\n- Covered Nebraska mortgage banker receives a written payoff request on event R.\n- No previous payoff request was fulfilled within sixty days.\n\nPlain text\n```\nResponse deadline       Within 7 business days after R\nPermitted charge        $0\n```\n\nA repeat request within sixty days may carry up to a $10 processing fee. No exact calendar date is supplied because the receipt date and holiday calendar were not provided.\n\n## Example 14 — Public-debt placement notice\n\nDefine:\n\nPlain text\n```\nN = date first-class notice is sent\n```\n\nAbsent the child-support exception:\n\nPlain text\n```\nEarliest statutory placement point = at least 30 days after N\n```\n\nThe notice must advise of the debt’s existence and possible collection-agency assignment. It is not a thirty-day federal validation period and does not itself require the public body to produce a contract or payment ledger.\n\n## Example 15 — Retail installment holder\n\n**Facts**\n\n- Buyer sends a written payment-history request to the current holder.\n- Contract has been sold twice.\n\n**Result**\n\nThe current holder must give or forward:\n\n- payment dates and amounts; and\n- total unpaid.\n\nNo response deadline or pause is stated. The request does not expressly compel identification of both former holders.\n\n# J. Statutes and federal gateway authorities overlapping with PASS-08 were freshly read for the narrower PASS-09 validation purpose. No P8 licensing, remote-nexus, conduct, sector, or remedies conclusion was adopted merely because it appeared in the saved report.\n\n## Bounded negative searches\n\nTargeted official searches did not locate:\n\n- a general Nebraska validation statute outside the targeted provisions discussed;\n- a Nebraska appellate general-validation decision;\n- a state rule giving consumers direct access to Chapter 2 records;\n- a controlling Eighth Circuit electronic-validation-delivery case;\n- or a controlling successor-collector dispute-transfer case.\n\nThose are limited search results, not claims that no such authority exists in trial courts, unpublished decisions, nonindexed administrative files, commercial databases, or historical paper archives.\n\n## Not read or performed\n\n- No actual borrower account, collector file, contract, statement, assignment, bill of sale, affidavit, credit report, dispute, validation letter, email, portal record, call recording, or payment ledger.\n- No named-company license or account search.\n- No private provider or borrower data.\n- No records request, complaint, filing, purchase, subscription, regulator contact, provider contact, or court contact.\n- No complete:FCRA furnishing or CRA-dispute report;identity-theft blocking analysis;RESPA/Regulation X servicing-error report;litigation standing, pleading, evidence, or admissibility report;limitation/revival report;bankruptcy, probate, judgment, or garnishment report;secured-enforcement report;sector, local, or tribal dossier;damages or limitations omnibus.\n- No Deep Research, Work, Codex research generation, API, account change, website action, publication, Chrome control, other Chat, CAPTCHA bypass, security workaround, or local-file save.\n\n**Focused disposition:** Nebraska supplies several useful, actor-specific account-information rights, but no general state validation-and-pause system was verified for all collectors. For covered consumer debts and federal debt collectors, §1692g and Regulation F provide the principal validation architecture: detailed initial information, a receipt-based thirty-day period, a limited role for oral disputes, a mandatory pause for timely written disputes or original-creditor requests, and fact-dependent verification. Those federal rights do not transform every Nebraska collector, commercial debt, original creditor, or targeted state statement request into an FDCPA workflow.\n\nEND S_NE PASS-09.\n\n","tables":[{"headers":["Actor or transaction","Applicable prelitigation information duty established here","Required request or trigger","Collection pause established?","Principal limits"],"index":0,"links":[{"href":"https://sos.nebraska.gov/sites/default/files/doc/Chapter-2.pdf","text":"Nebraska Secretary of State\n+1"},{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code"},{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code\n+3"},{"href":"https://www.supremecourt.gov/opinions/16pdf/16-349_c07d.pdf","text":"Supreme Court\n+1"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-336","text":"Nebraska Legislature\n+1"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-364","text":"Nebraska Legislature"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-204","text":"Nebraska Legislature\n+1"},{"href":"https://nebraskalegislature.gov/laws/ucc.php?code=9-210","text":"Nebraska Legislature"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-702","text":"Nebraska Legislature\n+1"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-623","text":"Nebraska Legislature"},{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code"},{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-204","text":"Nebraska Legislature\n+2"}],"row_links":[[],[{"href":"https://sos.nebraska.gov/sites/default/files/doc/Chapter-2.pdf","text":"Nebraska Secretary of State\n+1"}],[{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code"}],[{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code\n+3"}],[{"href":"https://www.supremecourt.gov/opinions/16pdf/16-349_c07d.pdf","text":"Supreme Court\n+1"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-336","text":"Nebraska Legislature\n+1"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-364","text":"Nebraska Legislature"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-204","text":"Nebraska Legislature\n+1"}],[{"href":"https://nebraskalegislature.gov/laws/ucc.php?code=9-210","text":"Nebraska Legislature"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-702","text":"Nebraska Legislature\n+1"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-623","text":"Nebraska Legislature"}],[{"href":"https://uscode.house.gov/us/usc/119-124/t15/s1692a/","text":"U.S. Code"}],[{"href":"https://nebraskalegislature.gov/laws/statutes.php?statute=45-204","text":"Nebraska Legislature\n+2"}]],"rows":[["Actor or transaction","Applicable prelitigation information duty established here","Required request or trigger","Collection pause established?","Principal limits"],["Nebraska-licensed collection agency, general consumer or commercial account","Two-year internal payment-record retention under Title 433, Chapter 2","Agency receives collection payment","No consumer-request pause or access right verified","Internal records are not automatically consumer-facing;
