Federal civil judgments ordinarily borrow the execution procedure of the state in which the federal court sits unless a federal statute supplies a different rule. Federal government debts, federal taxes, federal student loans, protected federal benefits, and federal wage-garnishment limits each have their own overlays. Federal Rule of Civil Procedure 69 expressly makes state procedure the normal execution framework for federal money judgments, subject to applicable federal statutes. [D028-C005; D028-S001] 1\n\nThe strongest reusable national conclusions are therefore these. A default judgment is not merely the automatic consequence of missing a payment: there must be a lawsuit, failure to plead or otherwise defend, entry of default, and then entry of judgment under the applicable procedure. In federal court, Rule 55 separates entry of default from default judgment, requires at least seven days' written notice of a default-judgment application to a party who has appeared, and allows a final default judgment to be attacked under Rule 60(b). [D028-C001–C003; D028-S001] 1\n\nOrdinary wage garnishment has a federal ceiling but not a uniform national withholding percentage. Under the Consumer Credit Protection Act rules administered by the Department of Labor, an ordinary garnishment is capped at the lesser of 25% of disposable earnings or the amount by which disposable earnings exceed 30 times the federal minimum wage; a state rule giving the worker greater protection controls. Child/spousal support, taxes, bankruptcy orders, and specified federal debts follow different rules. [D028-C009–C011; D028-S007–S008] 2\n\nBank levies require a second distinction: **garnishment by an outside creditor is not the same thing as contractual setoff by the customer's own financial institution.** For covered federal benefits deposited electronically, 31 C.F.R. Part 212 requires financial institutions to perform an account review and automatically preserve a protected amount without making the account holder file an exemption claim, subject to specified government/child-support exceptions. Separately, JPMorgan Chase's June 14, 2026 Deposit Account Agreement illustrates how a bank may reserve contractual setoff rights against other accounts, including joint accounts, while expressly excluding debts created under a consumer credit-card plan from that particular setoff clause. That is a Chase contract term, not a universal bank rule. [D028-C015–C019; D028-S009, S019] 3\n\nA recorded judgment lien also should not be confused with a tax lien or consensual security interest. For debts owed to the United States under the Federal Debt Collection Procedures Act, a judgment lien on real property can last 20 years and may be renewed once for another 20 years if the statutory conditions are met; this is **not** a general duration rule for every private judgment. Federal tax liens arise under a different statute and federal tax sales carry their own redemption rules. [D028-C007, C020–C022; D028-S003, S014–S016] 4\n\nExempt property likewise depends on creditor and debt type. Social Security/SSI/VA and other covered federal-benefit direct deposits receive special bank-account protection under Part 212; VA benefits also have an underlying statutory creditor exemption, with express federal exceptions including tax levy. ERISA-qualified retirement plans have a separate federal anti-alienation regime. State homestead, personal-property and bank-account exemptions can materially exceed federal baselines, but they must be checked jurisdiction by jurisdiction. [D028-C015–C018, C029–C030, C034; D028-S006, S009–S012] 5\n\n**Jurisdictional scope.** Federal primary law was researched directly. California was used as the principal state-law layer because it is a major consumer-debt jurisdiction and relevant to the requester; several California Judicial Branch sources were current as of the check date. However, direct access to some California Legislative Information pages and several Judicial Council pages returned access errors, so this report does **not** represent a completed 50-state enforcement matrix, and California statutory propositions that could not be confirmed from opened controlling text are expressly marked partial or held. No tribe-specific code, court rule, or compact was selected, so there is no universal “tribal judgment-enforcement” finding here; tribal recognition and enforcement remain jurisdiction-specific publication work.\n\nThe investigation also deliberately did **not** infer a universal settlement percentage, settlement timeline, credit-score change, tax exclusion, or eligibility standard. Cancellation-of-debt tax treatment, in particular, can change with the tax year and facts. Current Internal Revenue Code §108 shows that bankruptcy and insolvency can exclude otherwise includible discharge-of-indebtedness amounts subject to statutory limits, while the qualified-principal-residence exclusion now reaches post-2025 discharges only if the discharge is pursuant to an arrangement entered into and evidenced in writing before January 1, 2026. [D028-C031; D028-S018] 6\n\n## Default judgments and duration — area A\n\n**Area ID: A061.**\n\n**Failure to respond and entry of default.** In federal district court, Rule 55(a) directs the clerk to enter a default when a party against whom affirmative relief is sought has failed to plead or otherwise defend and that failure is shown by affidavit or otherwise. A clerk may enter a default judgment for a “sum certain” or a sum capable of computation if Rule 55(b)(1)'s conditions are met; other cases require an application to the court. If the party against whom default judgment is sought has appeared personally or through a representative, Rule 55(b)(2) requires written notice of the application at least seven days before the hearing. The court may need a hearing or evidence to determine damages or establish allegations. [D028-C001–C002; D028-S001, Rule 55(a)–(b), current PDF pp. 81–82] 1\n\nThat distinction is important operationally: **entry of default and entry of default judgment are separate events.** A research article should not say simply that “missing the answer deadline creates a judgment.” The precise deadline to answer varies with court, service method, waiver and substantive regime, and this project did not establish one universal response deadline. California's current Judicial Branch guidance likewise describes default and default judgment as separate steps and identifies debt-buyer-specific default forms. [D028-C001, C023; D028-S001, S027] 7\n\nThe Servicemembers Civil Relief Act adds protections before default judgment against an absent defendant in covered civil actions, including a required affidavit addressing military status. The official current statute was located, but its entire default-judgment procedure was not separately opened line-by-line in this session; any detailed SCRA article should therefore re-open and quote-check 50 U.S.C. §3931 before publication. [D028-C032; D028-S028] 8\n\n**Service defects and vacatur.** Federal Rule 55(c) permits an entry of default to be set aside for “good cause” and a final default judgment under Rule 60(b). Rule 60(b) includes mistake, inadvertence, surprise or excusable neglect; newly discovered evidence; fraud/misrepresentation/misconduct; a void judgment; a judgment that has been satisfied, released or discharged; and a residual “any other reason” category. Motions under Rule 60(b) must be made within a reasonable time, and grounds (1)–(3) carry an outside limit of one year after entry of the judgment/order or date of the proceeding. Filing the Rule 60 motion itself does not suspend the judgment. [D028-C003; D028-S001, Rule 55(c), Rule 60(b)–(c)] 1\n\nA service problem can therefore be far more consequential than merely missing a procedural deadline: a judgment that is void can be attacked under Rule 60(b)(4). But “bad service” is not one factual category; questions include whether the selected service method was authorized, whether jurisdiction attached, whether actual notice existed, and whether the applicable jurisdiction imposes a separate time limit or diligence requirement. Rule 60 itself does not create a blanket rule that every service error voids a judgment. [D028-C003; D028-S001] 1\n\nCalifornia supplies a useful state example. An official California Supreme Court source discussing Code of Civil Procedure §473.5 states the outer timing rule for relief when service of summons did not result in actual notice in time to defend: the motion must be brought within a reasonable time and no later than the earlier of two years after entry of default judgment or 180 days after service of written notice of the default/default judgment. A current 2026 superior-court source separately describes §473(b)'s discretionary relief for mistake, inadvertence, surprise or excusable neglect as requiring filing within a reasonable time and in no event more than six months. These are California rules, not nationwide deadlines. [D028-C035; D028-S026] 9\n\n**Immediate enforcement and stays.** In federal court, Rule 62(a) generally imposes an automatic 30-day stay of execution and other enforcement proceedings after entry of judgment unless the court orders otherwise. A party may obtain a further stay through bond or security under Rule 62(b), and Rule 62(f) gives a judgment debtor the same execution stay available in state court when the judgment constitutes a lien under the law of the state in which the federal court sits. [D028-C004; D028-S001, Rule 62(a), (b), (f)] 1\n\n**Duration and renewal.** There is no safe nationwide statement that “a judgment lasts X years.” Rule 69(a)(1) directs ordinary federal money-judgment execution to follow the procedure of the state where the federal court is located unless a federal statute applies. In contrast, for debts to the United States governed by the Federal Debt Collection Procedures Act, 28 U.S.C. §3201 creates a real-property judgment lien upon the prescribed filing, makes it effective for 20 years unless satisfied, and permits one additional 20-year period if notice of renewal is timely filed and the court approves renewal. [D028-C005, C007; D028-S001, S003] 1\n\nCalifornia Judicial Branch guidance states that most civil judgments last ten years and need renewal before expiration if collection will continue; current renewal guidance says the earliest renewal is after five years and that renewals generally last ten years, with exceptions. Separate court guidance characterizes multiple ten-year renewals and a 10% rate as the typical case while flagging exceptions for some medical-expense and personal-debt judgments. Because the underlying current California statutory provisions were not successfully opened during this investigation, those consumer-debt exceptions should be revalidated against current Code of Civil Procedure §§683.110–683.220 and §685.010 before a public-facing calculator treats them as categorical. [D028-C023–C024; D028-S020–S021] 10\n\n**Interest.** Federal district-court money judgments accrue postjudgment interest under 28 U.S.C. §1961 from the date judgment is entered, at a rate tied to the weekly average one-year constant-maturity Treasury yield for the calendar week preceding judgment; the statute also provides for annual compounding. The official House source located in this research was the current Code search entry rather than the more recent through-Public-Law-119-120 stable page used for several other statutes, so the formula is verified but a publication workflow should re-check the current §1961 page immediately before publishing a live rate calculator. [D028-C006; D028-S002] 11\n\nCalifornia is different. Current Judicial Branch guidance says unpaid judgments can accrue either 5% or 10% annual interest and that the 5% rate is confined to qualifying judgments; it should not be generalized to all consumer judgments. Because the underlying current §685.010 text was not opened from the Legislature's site, this report intentionally does not state a simplified eligibility test for the 5% category. [D028-C024; D028-S021] 12\n\n**Satisfaction and records.** Payment does not make the documentary trail disappear automatically. California's Judicial Branch instructs the paid judgment creditor to file an Acknowledgment of Satisfaction of Judgment, form EJ-100, and its current guidance states the creditor must do so within 14 days after being paid. EJ-100 can also be recorded in a county to release the recorded judgment lien. This is an important closing document in any settlement that resolves an existing judgment. [D028-C025; D028-S022] 13\n\nFor a United States judgment lien under 28 U.S.C. §3201, release occurs by filing a satisfaction of judgment or release of lien in the same manner in which the judgment was filed to obtain the lien. Thus a settlement document saying only “paid” is not necessarily the final enforcement record; the applicable satisfaction/release filing matters. [D028-C037; D028-S003] 4\n\n**Failure cases and next actions.** The recurrent failure modes are treating default as irreversible; assuming actual notice necessarily cures defective service; assuming a vacatur motion automatically pauses enforcement; waiting beyond a jurisdictional or rule-based vacatur window; confusing a judgment's expiration with a lien's expiration; and paying a judgment without obtaining the required satisfaction or lien-release records. The correct reusable workflow is to identify the court and judgment date, obtain the docket and proof of service, identify whether default and judgment are separate entries, calculate every applicable relief deadline, determine whether a stay exists, identify each lien/levy already issued, and require documentary satisfaction/release as part of final performance. The underlying rules for those steps are jurisdiction- and creditor-specific as described above. 1\n\n## Garnishment, levies, and setoff — area A\n\n**Area ID: A062.**\n\n**Judicial wage garnishment.** Federal law supplies a ceiling for ordinary garnishment, not a national command to garnish 25%. The Department of Labor defines “disposable earnings” as earnings left after deductions required by law. For ordinary garnishments, the maximum for a workweek is the lesser of 25% of disposable earnings or the amount by which disposable earnings exceed 30 times the federal minimum wage. With the current federal minimum wage of $7.25, the protected 30-times figure is $217.50 per week; if disposable earnings are $217.50 or less, ordinary garnishment under the federal formula is zero. [D028-C009; D028-S007–S008] 2\n\nThe federal ceiling is expressly a maximum. DOL states that when state garnishment law provides a lower amount to be garnished, the more protective state rule must be followed. DOL's current fact sheet also states that the CCPA applies throughout the states, District of Columbia, and U.S. territories/possessions to personal earnings. [D028-C011; D028-S007] 2\n\nCalifornia demonstrates why a tool cannot simply use “25% everywhere.” California's current Judicial Branch employer guide identifies 20% of disposable weekly earnings as one state-law limit and a second, earnings-threshold formula as the other calculation. Because only the official search passage, not the full current page or governing statute, was retrievable here, the precise second formula should be primary-source rechecked before it is coded into a public calculator. [D028-C026; D028-S023] 14\n\n**Support, tax and bankruptcy exceptions.** The ordinary CCPA cap does not govern state or federal tax levies or certain bankruptcy orders. For child support/alimony, the federal ceiling can be 50% of disposable earnings if the worker supports another spouse or dependent child, 60% otherwise, with each ceiling increased by five percentage points for support more than 12 weeks in arrears. Those are ceilings; priority and additional state/federal rules still matter. [D028-C010; D028-S007–S008] 2\n\n**Federal government judgment garnishment.** Under 28 U.S.C. §3205, the United States may seek a writ against property, including nonexempt disposable earnings, in which the debtor has a substantial nonexempt interest and which is held by another person. For co-owned property, the federal statute expressly looks to the law of the state where the property is located. The government's application must state, among other things, that at least 30 days have elapsed since demand for payment and that the judgment debtor has not paid. [D028-C012, C036; D028-S005] 15\n\nThe statutory process has several concrete deadlines. The garnishee's answer is due within 10 days of service. After receiving that answer, either the debtor or the United States has 20 days to object and request a hearing; the objecting party states and bears the burden of proving the objection grounds. The court is to hold the hearing within ten days after receiving the request, or as soon thereafter as practicable. Support orders have statutory priority over a §3205 writ. [D028-C013; D028-S005] 15\n\nSeparately, §3202's initial enforcement notice tells a federal judgment debtor of applicable exemptions and gives 20 days after receipt to request a hearing. If the debtor requests the statutory expedited hearing, it is to take place within five days after the clerk receives the request or as soon afterward as possible. At a §3202 hearing, issues ordinarily include the probable validity of an exemption and statutory compliance; for a default judgment, the statute also allows specified debt-validity/good-cause issues to the extent the Constitution or another federal law supplies the right. [D028-C008; D028-S004] 16\n\n**Administrative wage garnishment for federal student loans.** Federal student-loan collection has its own statute. For covered loans held by the Secretary or a guaranty agency, 20 U.S.C. §1095a authorizes administrative garnishment notwithstanding state law and caps the deduction at 15% of disposable pay unless the borrower consents in writing to more. The borrower must receive written notice at least 30 days before proceedings begin, must have access to debt records, must have an opportunity to enter a written repayment agreement, and must have a hearing opportunity on the existence or amount of the debt and specified repayment issues. [D028-C014; D028-S013] 17\n\nA hearing request filed by the 15th day following mailing of the notice triggers a right to the hearing before issuance of the garnishment order; a later request must still be heard but need not precede the order. The hearing official must issue the final decision as early as practicable and no later than 60 days after the hearing petition is filed. The statute also contains a special reemployment rule: after certain involuntary separations, no deduction may begin until the individual has been continuously reemployed for at least 12 months. [D028-C014; D028-S013] 17\n\nThis is why “state law protects my wages, so the federal student-loan garnishment is barred” is not a safe general proposition. §1095a expressly operates notwithstanding state law, while the federal CCPA remains relevant to aggregate limits. [D028-C014; D028-S007, S013] 2\n\n**Frozen bank accounts and protected federal benefits.** Treasury's Part 212 creates a mechanized protection for specified electronically deposited federal benefits, including Social Security, SSI, VA, Railroad Retirement and federal civil-service retirement benefits. The “lookback period” is two months, and the “protected amount” is the lesser of the sum of covered benefit payments posted during that lookback or the account balance when the review is performed. [D028-C015; D028-S009, 31 C.F.R. §§212.3, 212.6] 3\n\nA financial institution generally must examine the garnishment order and perform the account review no later than two business days after it has the order and sufficient identifying information. If a covered benefit was deposited in the lookback period, the institution must immediately establish the protected amount and leave it available; the account holder does not have to file an exemption claim before accessing that amount. Funds above the protected amount can be handled under ordinary garnishment procedures, including freezing, subject to the regulation. [D028-C016; D028-S009] 3\n\nPart 212 is deliberately indifferent to several facts that sometimes cause confusion. The bank's account review is performed without tracing transfers between accounts, and the automatic protection rules are not defeated simply because there is a co-owner, multiple beneficiaries, multiple protected programs, or nonbenefit funds are commingled. The protected amount is calculated separately for each account. [D028-C018; D028-S009] 3\n\nBut the Part 212 mechanism is not absolute immunity from every legal process. If the garnishment order contains the prescribed Notice of Right to Garnish Federal Benefits from the United States or a state child-support enforcement agency, the bank follows its otherwise customary procedures instead of the ordinary §§212.5–212.6 protected-amount process. Part 212 also expressly preserves a customer's ability to assert other exemptions and does not displace state law providing greater protection. [D028-C017; D028-S009] 3\n\n**VA benefits.** The underlying VA statute is stronger than a mere bank-processing rule: 38 U.S.C. §5301(a)(1) makes covered VA benefits nonassignable except as authorized, exempt from creditor claims and generally not liable to attachment, levy or seizure before or after receipt. But §5301 contains important exceptions, including claims of the United States under the administered benefits laws and an express provision making VA benefits subject to federal tax levy under the Internal Revenue Code. [D028-C029; D028-S010] 18\n\n**Joint accounts.** There is no nationwide rule that “only half of a joint account can be seized.” In a United States judgment garnishment under §3205, the reach of co-owned property is explicitly tied to the law of the state where the property sits. Part 212 separately says the presence of a co-owner does not prevent its automatic federal-benefit review. The ownership question and the federal-benefit-protection question are therefore separate. [D028-C018, C036; D028-S005, S009] 15\n\n**Setoff at the same financial institution.** A bank's own setoff is analytically different from compliance with a third-party garnishment. JPMorgan Chase's complete Deposit Account Agreement, effective June 14, 2026, says that when a customer owes Chase or an affiliate a due or overdue debt, the customer grants a right of setoff and security interest in the customer's accounts; for a joint account, Chase says it may use joint funds for the debt of any account owner. The agreement says prior notice is not required except where law requires it and purports, to the extent permitted by law, to reach deposited federal/state benefit payments. Crucially, the same clause says the setoff right **does not apply if the debt is created under a consumer credit-card plan**. [D028-C019; D028-S019, Deposit Account Agreement §VI.E, p. 23 in extracted text, effective 6/14/2026] 19\n\nThat contract evidence should not be generalized to Bank of America, Wells Fargo, a credit union, a business account, or even every Chase product. Contract version, account ownership, applicable state law, benefit statutes, bankruptcy law and the debt agreement can change the outcome. The research did not locate and validate a second current complete issuer agreement, so any cross-bank comparison remains a publication opportunity rather than a completed finding.\n\n**California bank-levy objections.** California's current Judicial Branch guidance says a debtor claiming an exemption from a bank levy must file the claim with the sheriff no later than 15 days after being served with the Notice of Levy, extended to 20 days when served by mail. California also has an automatic deposit-account exemption reflected in current form EJ-156, but the exact July 2026 dollar amount was not successfully extracted from the official PDF in this session; it is therefore deliberately not stated as a verified number here. [D028-C027–C028; D028-S024–S025] 20\n\n**Administrative offset gap.** General Treasury administrative offset under 31 U.S.C. §3716 and 31 C.F.R. Part 285 is materially relevant to federal non-tax debt, but the controlling provisions were not opened during this investigation. Accordingly, this report does not publish a general Treasury Offset Program notice/deadline formula. Debt-specific federal student-loan garnishment, federal judgment garnishment and federal-benefit account protections were separately verified above.\n\n## Liens, foreclosure, and repossession — area A\n\n**Area ID: A063.**\n\n**Judgment liens are not automatic everywhere merely because a creditor wins a money judgment.** In federal court, Rule 69 sends ordinary execution to state procedure unless a federal statute applies. The Federal Debt Collection Procedures Act creates a special federal rule for judgments in favor of the United States: filing a certified abstract in the statutorily prescribed manner creates a lien on the debtor's real property for the amount necessary to satisfy the judgment, including costs and interest. Priority runs against later-perfected liens, and the lien lasts 20 years unless satisfied, with one possible additional 20-year renewal after timely notice and court approval. [D028-C005, C007; D028-S001, S003] 1\n\nCalifornia's official court guidance illustrates the state process: an Abstract of Judgment can be recorded in a county to create a lien against a judgment debtor's California real estate; the practical effect is that sale or refinancing may generate payment to the judgment creditor. That state lien process should be distinguished from a consensual mortgage/deed of trust and from a federal tax lien. [D028-C023; D028-S027] 21\n\n**Federal tax lien.** Under current 26 U.S.C. §6321, when a person liable for tax neglects or refuses to pay after demand, the amount—including tax, interest, statutory additions, penalties and costs—becomes a lien in favor of the United States on all property and rights to property belonging to that person. An IRS Notice of Federal Tax Lien is the public-notice/perfection mechanism relevant to third parties; it should not be described as the event that first creates the underlying statutory lien. [D028-C020; D028-S014] 22\n\nRelease has a specific federal rule. Current §6325 requires the Secretary to issue a certificate of release not later than 30 days after determining that the liability has been fully satisfied or has become legally unenforceable, or after accepting a qualifying bond. The statute separately provides mechanisms for discharge of particular property and subordination, which are not equivalent to extinguishing the whole tax liability. [D028-C021; D028-S015] 23\n\n**Tax levy sale and redemption.** Before an IRS sale, 26 U.S.C. §6337 permits the owner to redeem seized property by paying the amount due plus expenses. After an IRS sale of real property, the owner, heirs, executors/administrators, or a person with an interest or lien may redeem within 180 days. The redemption price includes the purchaser's price plus interest at 20% per year. That 180-day rule is specific to federal tax-sale real property and must not be used as a general mortgage-foreclosure redemption period. [D028-C022; D028-S016] 24\n\n**Execution sale on a federal government judgment.** Under §3202(e), property subject to sale to satisfy a United States judgment may be sold by federal judicial sale or execution sale. If the debtor timely requests the statutory §3202 hearing about the property, the property in dispute is not to be sold before that hearing. Section 3201 also permits a court, on proper application, to order sale of real property subject to a federal judgment lien. [D028-C008; D028-S003–S004] 4\n\n**Mortgage foreclosure.** Foreclosure on a consensual mortgage or deed of trust is a separate remedy from executing on a money judgment. California's current Judicial Branch guidance explains that a nonjudicial foreclosure proceeds without a lawsuit but only through the legally required foreclosure process. Its current consumer guide states the basic California sequence as: after the required borrower contact, the lender can record a Notice of Default after 30 days; 90 days later it can record a Notice of Sale; and 21 days later the property can be sold. These are California nonjudicial-foreclosure guideposts, not nationwide timelines. [D028-S029] 25\n\nThis investigation did **not** successfully open current California Civil Code §§2924–2924c from the Legislature's site. Accordingly, detailed California claims about cure/reinstatement cutoffs, postponement rules, Homeowner Bill of Rights protections, trustee-sale bidding, deficiency bars, owner-occupancy conditions, and post-sale rescission rights remain publication holds even though the basic Judicial Branch timeline above was verified from current official guidance.\n\n**Repossession.** Repossession of a vehicle or other collateral is not a remedy that springs from an ordinary unsecured judgment. It depends on a security interest or other collateral right plus the governing state secured-transactions and consumer-credit law. California's Judicial Branch currently recognizes auto-debt litigation after repossession and specifically gives as a defense example a deficiency suit in which a repossessed vehicle allegedly was sold far below market value. [D028-S030] 26\n\nThe investigation did not successfully retrieve current controlling California Civil Code §2983.2 or Commercial Code Article 9 provisions governing repossession notices, disposition, redemption, reinstatement and deficiency. For that reason, no universal “15-day redemption notice,” repossession fee, sale deadline, or deficiency formula is stated here. Those propositions require state- and collateral-specific primary-law validation. This is a **material unresolved gap**, not evidence that the protections do not exist.\n\n**Deficiency judgments.** A deficiency can arise in materially different settings—foreclosure of real property, disposition of personal collateral, tax enforcement, or an ordinary judgment execution sale—and the availability and calculation of the deficiency are jurisdiction- and debt-specific. This research verified only the federal tax-sale redemption regime and the existence of California auto-deficiency litigation; it did not verify a universal California or national anti-deficiency rule. Any article claiming “the creditor can always sue for the balance after collateral is sold” or “there is never a deficiency after foreclosure” should therefore be held.\n\n**Lien releases after settlement.** Closing documents should match the kind of lien. A federal United States judgment lien is released by filing satisfaction/release in the same manner used to obtain it; a federal tax lien has the §6325 certificate mechanism; a California recorded judgment lien can be addressed through the EJ-100 satisfaction record. A settlement with the creditor should not be presented as automatically clearing every public-record lien without the corresponding release/satisfaction step. [D028-C021, C025, C037; D028-S003, S015, S022] 4\n\n**Guarantors and collateral.** Guaranty liability is contract-specific. A judgment against a borrower does not establish, as a universal proposition, that a nonparty guarantor's assets are executable, nor does a settlement with one obligor necessarily release every guarantor or collateral lien. No complete current guaranty agreement was selected for this assignment, so guarantor-release language is a publication hold requiring the actual contract, judgment and settlement instrument.\n\n## Protected income and property — area A\n\n**Area ID: A064.**\n\n**Wages.** The federal ordinary-debt floor and ceiling operate through disposable earnings. With legally required deductions removed, an ordinary creditor may reach no more than the lesser of 25% or the amount over 30 times the federal minimum wage, and a more protective state rule controls. Support, tax, bankruptcy and certain federal debt collections fall into separate categories. [D028-C009–C011; D028-S007–S008] 2\n\nA second important protection is employment-related rather than dollar-based: DOL states that the CCPA prohibits firing an employee because earnings are garnished for any **one debt**, regardless of the number of levies or proceedings used for that debt. That federal protection should not be paraphrased as a complete ban on adverse action whenever a worker has multiple garnishments. [D028-S007] 2\n\n**Social Security, SSI and other covered federal benefits in bank accounts.** Part 212 identifies Social Security, SSI, VA, Railroad Retirement and covered federal retirement benefit payments as protected benefit payments for the automatic account-review mechanism. The bank examines the electronically coded deposits during the two-month lookback and preserves the lesser of those covered deposits or the current account balance. [D028-C015–C016; D028-S009] 3\n\nThe practical protection is stronger than a conventional “file an exemption and wait” model: the bank must leave the calculated protected amount fully available without requiring an advance exemption claim. But money above that amount can be frozen under ordinary process, and account holders retain the right to claim other statutory exemptions. [D028-C016; D028-S009] 3\n\nThe underlying Social Security anti-assignment statute, 42 U.S.C. §407, was located in the official U.S. Code and expressly addresses execution, levy, attachment and garnishment, but it was not separately opened and line-reviewed after retrieval. It is therefore registered below as a primary source located but not fully opened, and detailed exceptions—especially federal offset/support interactions—should be rechecked before publication. [D028-S011] 27\n\n**VA benefits.** VA's statutory rule is independently verified. Covered benefits generally are exempt from creditor claims and legal seizure before or after receipt, while §5301 itself identifies exceptions including federal tax levy and specified government claims. This illustrates why a page that says simply “VA benefits can never be garnished” would be inaccurate. [D028-C029; D028-S010] 18\n\n**Retirement assets.** ERISA §206(d), codified at 29 U.S.C. §1056(d), contains the federal rule requiring covered pension plans to prohibit assignment or alienation of benefits, with statutory exceptions including qualified domestic relations orders and other special federal provisions. The current official Code source was located, but this investigation did not fully extract each exception, plan-type exclusion, tax-levy interaction, or the different treatment of IRAs after distribution. Accordingly, “retirement funds are judgment-proof” is not a verified universal claim. [D028-C034; D028-S012] 28\n\n**Federal-debt exemption election.** For Federal Debt Collection Procedures Act proceedings, 28 U.S.C. §3014 gives an individual debtor an election between the property listed in Bankruptcy Code §522(d) and, alternatively, applicable federal/state/local exemptions plus specified interests in entireties/joint/community property to the extent exempt under applicable nonbankruptcy law. The applicable state/local-law alternative is tied to the debtor's domicile during the 180 days preceding the federal remedy application, using the statute's longer-portion rule if more than one place is involved. [D028-C030; D028-S006] 5\n\nA court may require an exemption statement under oath describing the property, its value, valuation basis and ownership interest. Either side may request a hearing; unless application of the exemption is reasonably evident, the debtor bears the burden of persuasion. Assertion of an exemption prevents the United States from selling or disposing of the claimed property until the court determines the nonexempt interest. These rules govern the United States under Chapter 176; they are not the private-creditor exemption procedure for every state judgment. [D028-C030; D028-S006] 5\n\n**Homestead and other state property exemptions.** These remain one of the largest state-law variables. California Judicial Council materials show current homestead-exemption forms and current exemption schedules, but the exact 2026 California homestead dollar formula was not successfully verified from opened controlling statutory text during this investigation. Earlier/current secondary code discovery showed an indexed formula rather than a safe permanent fixed dollar figure; because the user required primary sourcing, that secondary discovery is not promoted to a final legal claim here. [D028-S031] 29\n\nThat limitation matters substantively. A homestead exemption normally addresses judgment execution against equity; it should not be described as erasing a consensual mortgage, tax lien, or every superior lien. Exact protected equity, acreage, residency, sale-proceeds treatment and procedural claiming rules must be checked in the applicable state's current law.\n\n**California bank-account exemption process.** In addition to the federal benefit mechanism, California provides state exemption procedures. The Judicial Branch says the claim-of-exemption deadline for a bank levy is 15 days after service of the Notice of Levy or 20 days when the notice was mailed. Its current EJ-156 form reflects a separate automatic deposit-account exemption effective July 1, 2026, but because the actual number was not successfully read from the primary PDF, the amount is held rather than guessed. [D028-C027–C028; D028-S024–S025] 20\n\n**Creditor and debt distinctions.** The protected-property analysis should therefore begin with four questions rather than “is this money exempt?”: what type of creditor is collecting; what type of debt is being collected; what is the source of the asset or income; and which jurisdiction/procedure applies. The federal ordinary-creditor wage cap, federal student-loan AWG, federal tax levy, United States judgment enforcement, Part 212 benefit protection and a bank's contractual setoff all answer those questions differently. 2\n\n**Business versus consumer assets.** DOL's CCPA protections concern an individual's personal earnings, while several California consumer-debt interest/renewal rules are expressly described by the Judicial Branch as exceptions associated with medical or personal debt. A business obligation, business account, guaranty or commercial collateral agreement therefore should not automatically receive a consumer protection merely because an individual owner is involved. No complete guaranty selected; no universal release rule asserted. |\n\n### Worked examples\n\n**Ordinary weekly wage garnishment.** Assume weekly gross pay has already been reduced by legally required deductions to **$500 of disposable earnings**, there is one ordinary consumer-debt garnishment, no competing support/tax order, and no more protective state rule. Federal test one is 25% × $500 = **$125**. Test two is $500 − (30 × $7.25) = $500 − $217.50 = **$282.50**. The garnishable amount is the lesser figure: **$125**. A state such as California may reduce that further, so $125 is a federal ceiling in this example, not a nationwide entitlement to withhold $125. [C009–C011] 2\n\n**Protected federal-benefit bank account.** Assume a checking account has a **$3,400** balance when reviewed. During Part 212's two-month lookback, the account received **$2,600** in correctly coded covered Social Security payments; other deposits account for the rest. Protected amount = lesser of covered lookback deposits ($2,600) and current balance ($3,400) = **$2,600**. The bank must preserve access to that $2,600 under the ordinary Part 212 process; the remaining **$800** can be treated under ordinary garnishment rules, subject to any additional exemption. A joint owner does not, by itself, eliminate that Part 212 calculation. [C015–C018] 3\n\n**Why same-bank setoff differs from a sheriff levy.** Assume Customer A has **$8,000** in a Chase joint checking account and separately owes Chase an overdue personal installment debt. Chase's June 2026 agreement states that it may use joint-account funds for the debt of an account owner, subject to law. But change the debt to one “created under a consumer credit card plan,” and that agreement expressly says its setoff right does not apply. This example proves the need to classify both account and debt rather than asking merely whether “banks can take money from my account.” [C019] 19\n\n**Federal government garnishment timeline.** Assume the United States has a judgment and sends demand on January 1. Section 3205 requires at least 30 days after demand before the application representation in §3205(b)(1)(B) can be made. After a writ is served, the garnishee has 10 days to answer. If the debtor receives the answer and disputes it, the debtor has 20 days after receipt to file the written objection and hearing request; the court then holds the hearing within ten days after receiving the request or as soon thereafter as practicable. These are separate clocks and should not be merged into a single “30-day garnishment appeal deadline.” [C012–C013] 15\n\n**Federal student-loan AWG.** Assume disposable pay for a pay period is **$1,200**, no other garnishments affect the calculation, and no greater percentage was authorized in writing. The statutory 15% ceiling produces $1,200 × 0.15 = **$180** for the period. This does not mean garnishment can begin without process: the statute separately requires at least 30 days' advance notice and the hearing opportunity described above. [C014] 17\n\n**Federal tax-sale redemption.** Assume real property was sold by the IRS for **$100,000** and an eligible person redeems on day 90. Ignoring any fact-specific adjustments not included in this simplified illustration, the 20%-annual statutory interest component is:\n\n[\n$100{,}000\\times 20%\\times\\frac{90}{365}=$4{,}931.51\n]\n\nIllustrative redemption total = **$104,931.51**. The legal deadline is 180 days after sale; this is a federal tax-sale example, not a mortgage-foreclosure calculator. [C022] 24\n\n**Federal postjudgment interest.** Assume, solely for illustration, a $25,000 federal district-court judgment whose applicable §1961 rate happens to be **4.00%**. The actual rate must come from the Treasury-linked statutory week; 4.00% is not asserted to be the current rate. A simple 90-day accrual approximation before annual compounding is:\n\n[\n$25{,}000\\times .04\\times\\frac{90}{365}=$246.58.\n]\n\nThe important research rule is to store the judgment date and the applicable §1961 rate rather than hard-coding a single federal interest percentage. [C006] 11\n\n**Cancellation-of-debt tax example after judgment settlement.** Assume a valid **$20,000** judgment is settled and fully discharged for **$12,000**, and assume for illustration that the unrepaid **$8,000** constitutes otherwise includible cancellation-of-debt income. Immediately before discharge, assume the taxpayer's liabilities exceed the fair-market value of assets by **$3,000**. Section 108's insolvency exclusion is capped at the amount of insolvency, so at most **$3,000** would be excluded on that ground; the remaining **$5,000** requires analysis of other tax rules/exclusions. This is why “settling a judgment creates no tax” and “all forgiven debt is taxable” are both unsafe categorical statements. [C031] 6\n\n### Meaningful comparison matrix\n\n| Situation | Primary rule source | Main numerical protection/process | Key reason not to generalize |\n| --- | --- | --- | --- |\n| Ordinary private wage judgment | CCPA / 29 C.F.R. Part 870 | Lesser of 25% or amount over 30× federal minimum wage. 30 | State can protect more. |\n| Child/support withholding | CCPA support exception | 50/60%, potentially 55/65% for older arrears. 30 | Priority and state support law separately matter. |\n| Federal student loan AWG | 20 U.S.C. §1095a | 15%; 30-day notice; timely hearing request by day 15. 17 | Operates notwithstanding state garnishment law. |\n| U.S. judgment garnishment | 28 U.S.C. §3205 | 30 days post-demand; garnishee 10 days; objections 20 days. 15 | Specialized federal government remedy. |\n| Federal-benefit bank freeze | 31 C.F.R. Part 212 | Two-month lookback; automatic protected amount. 3 | Special notices for government/support change process. |\n| Same-bank setoff | Deposit contract + governing law | No universal percentage; Chase agreement has broad setoff but consumer-credit-card carveout. 19 | Contract/provider/debt-specific. |\n| U.S. judgment lien | 28 U.S.C. §3201 | 20 years + one possible 20-year renewal. 4 | Not a private-state-judgment duration rule. |\n| Federal tax lien/sale | IRC §§6321, 6325, 6337 | Release within 30 days after statutory condition; 180-day real-property redemption. 22 | Separate tax collection regime. |\n| California ordinary judgment | California Courts guidance | Most judgments 10 years; 5%/10% interest categories; renewal exceptions. 33 | Current statutory consumer exceptions need primary check. |\n| California nonjudicial foreclosure | California Courts | Official guide gives 30-day contact-to-NOD, then 90 days, then 21 days to sale. 25 | Mortgage foreclosure is not ordinary judgment execution. |\n\n### Draft article, tool, and document opportunities\n\nThe research supports a strong article titled **“A Judgment Is Not One Collection Remedy: Garnishment, Bank Levy, Liens and Setoff Explained.”** Its central framework should separate judgment creation, execution, wage garnishment, bank levy, benefit exemptions, same-bank setoff, judgment liens, tax liens and secured collateral. That distinction is directly supported by Rule 69, the federal garnishment statutes, Part 212 and the Chase contract. 1\n\nA **wage-garnishment calculator** is feasible if it has a jurisdiction selector and debt-type selector. The federal ordinary formula can be coded now, as can the federal student-loan 15% ceiling; a California implementation should not go live until the current statutory second formula is opened and verified. 30\n\nA **bank levy exemption triage tool** could ask whether the frozen funds include electronically deposited Social Security, SSI, VA or other Part 212 benefits; whether the creditor is a private creditor, the United States or a state child-support agency; whether the account is joint; and which state's levy law applies. The tool should compute the two-month Part 212 protected amount separately from any additional state exemption. 3\n\nA **judgment settlement closing checklist** should require, where applicable: signed settlement/release, dismissal or stipulated judgment document if litigation remains pending, confirmation of payment allocation, Acknowledgment of Satisfaction of Judgment, release of recorded judgment liens, separate tax-lien discharge/release documents where relevant, and confirmation of any garnishment termination. Federal Chapter 176 and California EJ-100 sources demonstrate why payment and public-record release are separate operational steps. 4\n\nA **judgment-vacatur intake worksheet** should collect the summons/complaint, proof of service, default entry, judgment, notice-of-entry date, first actual notice date, military status at relevant times, docket, collection notices and any prior motion. Those documents map directly to Rule 55/60 and California's no-actual-notice deadlines. 1\n\nA **lien type decision tree** should distinguish an abstract-of-judgment lien, federal tax lien, consensual mortgage/deed of trust, Article 9 security interest and federal government judgment lien before discussing duration, sale or release. The verified federal sources show that these instruments have different creation, duration and release mechanisms. 4\n\n### Open questions and publication holds\n\n**California exemption amounts.** Do not publish a July 2026 California automatic bank-account exemption number or current homestead dollar amount from this research package alone. The official forms were located, but the exact numbers were not successfully rendered from opened primary text. 32\n\n**California 5% judgment-interest eligibility and consumer renewal restrictions.** Official California Courts guidance confirms 5%/10% categories and renewal exceptions, but current controlling Code of Civil Procedure text was not opened. A California-specific article or calculator should be held until §§683.110 et seq. and 685.010 are retrieved directly from an official legislative source. 10\n\n**California foreclosure cure/reinstatement and deficiency.** The Judicial Branch's 30/90/21 sequence is verified, but exact statutory cure cutoffs, reinstatement rights and anti-deficiency rules were not. Hold those claims until current Civil Code §§2924 et seq. and applicable Code of Civil Procedure deficiency statutes are primary-reviewed. 25\n\n**Repossession.** Current California motor-vehicle repossession notices, redemption/reinstatement, commercial reasonableness, sale timing and deficiency requirements were not primary-verified. The official court source confirms that deficiency litigation can occur and sale value can matter, but it is not enough to build a repossession-rights article. 34\n\n**Treasury Offset Program.** General administrative offset procedures under 31 U.S.C. §3716 and 31 C.F.R. Part 285 remain unverified in this package.\n\n**Retirement exceptions.** ERISA anti-alienation is verified at the statutory-rule level, but a publishable “which retirement accounts are judgment-proof?” article requires separate treatment of ERISA plans, IRAs, distributions after receipt, QDROs, IRS levies, federal criminal restitution and bankruptcy exemptions. 28\n\n**Social Security exceptions.** Part 212 bank procedures are well verified, but detailed §407 exceptions and federal offset/support rules should be read directly before publishing a broader “Social Security can never be taken” article. 27\n\n**Fifty-state comparison.** This assignment did not produce a 50-state table of judgment life, renewal, interest, wage formula, bank balance exemption, homestead, joint-account presumptions, foreclosure, repossession or deficiency rules. No nationwide page should fill those gaps by extrapolating from California.\n\n**Tribal enforcement.** No selected tribe's law was researched. Recognition of state/federal judgments in tribal courts and enforcement against tribal assets/lands may implicate sovereign immunity, tribal codes, federal Indian law and specific court rules; publication requires tribe-specific research.\n\n**Credit-score impact.** No numerical score-drop or recovery timeline was verified. A judgment, lien or collection event should not be assigned a universal point loss or recovery period.\n\n**Guarantors.** No universal rule should say that settling with the borrower releases the guarantor, that releasing collateral releases a guaranty, or vice versa. The actual guaranty and settlement/release language must be examined.\n\n### Researcher self-check\n\nThe investigation **verified from opened/read primary federal sources** Federal Rules 55, 60, 62 and 69; the Federal Debt Collection Procedures Act provisions governing judgment liens, enforcement hearings, garnishment and exemption elections; the Department of Labor/eCFR ordinary wage-garnishment framework; Treasury's Part 212 federal-benefit account protections; federal student-loan administrative wage-garnishment provisions; VA benefit protection; federal tax-lien creation/release/redemption rules; and the current federal cancellation-of-debt exclusion framework. 1\n\nThe investigation also **retrieved and reviewed an actual complete creditor agreement**: JPMorgan Chase Bank's Deposit Account Agreement effective June 14, 2026, including its setoff/security-interest provision and the consumer-credit-card-plan carveout. That contract is used only as evidence of Chase's contract terms, not as evidence of universal banking law. 19\n\nThe investigation **verified through current California Judicial Branch materials** the basic ten-year judgment framework, current renewal guidance, existence of 5%/10% judgment-interest categories, EJ-100 satisfaction function, the 15-/20-day bank-levy exemption claim deadline, the California wage guide's 20% component, the basic 30/90/21-day nonjudicial foreclosure sequence, use of abstracts to create real-property judgment liens, and the existence of auto-deficiency disputes after repossession. 10\n\nThe investigation **did not fully verify from opened controlling California statutory text** the current 5% interest eligibility test, every consumer-judgment renewal restriction, the July 2026 automatic bank-account exemption dollar amount, current homestead amount/formula, foreclosure reinstatement deadline, real-estate anti-deficiency rules, or motor-vehicle repossession notice/redemption/deficiency statutes. Those findings remain partial or unresolved rather than being filled with secondary-source assumptions.\n\nThe investigation **did not verify** a general Treasury Offset Program deadline matrix, a complete ERISA/IRA exemption matrix, every Social Security statutory exception, a nationwide joint-account ownership rule, a 50-state judgment/exemption/foreclosure/repossession matrix, tribe-specific law, a universal guarantor-release rule, a universal credit-report/score effect, or a universal settlement tax exclusion.\n\nNo source was treated as current merely because its webpage showed a recent update date. Where available, rule editions, effective contract dates, statutory currency statements and actual statutory triggers were recorded separately. The federal U.S. Code sources for §§3014, 3201, 3202, 3205, 6321, 6325, 6337 and 108 expressly reflected law through Public Law 119-120 dated October 7, 2026, within the October 22, 2026 research baseline. 4\n\nNo private borrower information was accessed, no person or organization was contacted, no publication occurred, and no claim is made that files were written to the SettleADebt.com shared folder.\n\n","tables":[{"headers":["Source ID","Source, issuer, direct URL","Pinpoint / version / effective status","Check date; jurisdiction/scope","Access and limits"],"index":0,"links":[],"rows":[["Source ID","Source, issuer, direct URL","Pinpoint / version / effective status","Check date; jurisdiction/scope","Access and limits"],["D028-S001","Federal Rules of Civil Procedure, U.S. Courts. https://www.uscourts.gov/sites/default/files/document/federal-rules-of-civil-procedure.pdf \n1","Rules 55, 60, 62, 69; PDF amended through Dec. 1, 2025.
