Replacement material claim record\n\n| Field | Revised D012-C026 |\n| --- | --- |\n| Claim ID | D012-C026 — preserved |\n| Area | A016 / Collections / Validation disputes |\n| Precise claim | When an FDCPA-covered debt collector receives a consumer's written dispute within the Regulation F validation period, it must cease collection of the debt, or disputed portion, until it sends verification or a copy of a judgment in the manner required by § 1006.42. For a reasonably determined duplicative dispute, the collector may instead send the specified duplicative-dispute notice, including reasons and a reference to its earlier response, before resuming collection. |\n| Qualifying conditions | Covered collector; qualifying consumer dispute; writing delivered through an accepted method; dispute submitted within the validation period. |\n| Duplicative-dispute definition | The later written dispute must be substantially the same as an earlier written dispute submitted within the validation period, the collector must already have satisfied § 1006.38(d)(2)(i) for that earlier dispute, and the later dispute must contain no new and material supporting information. |\n| Alternative response | The collector may send either (A) a written/electronic notice meeting § 1006.38(d)(2)(ii)(A), or (B) verification or a judgment copy under § 1006.38(d)(2)(i). |\n| Failure to dispute | Failure to dispute does not constitute a legal admission of liability. It does not automatically invalidate, forgive, or discharge the debt. |\n| Sources/pinpoints | S021 §§ 1006.34(b)(5), (c)(3)(i); S048 §§ 1006.38(a)(1), (d)(1), (d)(2)(i)–(ii), official interpretations 38-1, 38(a)(1)-1–2, 38(d)(2)(ii)-1. |\n| Jurisdiction/date | U.S. federal Regulation F; verified October 22, 2026. |\n| Disposition | Revised — operative federal rule verified; individual-fact and state-law applications held. |\n\n### Publication-ready replacement wording\n\nWriting### What happens when you dispute a debt during the validation period?\n\nUnder federal Regulation F, if a covered debt collector receives your written dispute within the validation period, the collector generally must stop collecting the debt, or the disputed portion, until it sends you verification of the debt or a copy of a judgment.\n\n**There is an important exception for qualifying repeat disputes.** If you previously submitted a written dispute within the validation period, the collector responded with verification or a judgment copy, and you submit another substantially identical dispute without new and material supporting information, the collector may reasonably determine that the later dispute is duplicative.\n\nIn that situation, the collector can satisfy the regulation by sending a notice explaining briefly why the dispute is considered duplicative and referring you to its earlier response, instead of sending a new verification. Collection must remain paused until the collector completes one of the permitted responses.\n\nA later dispute is not duplicative under this rule when it includes new and material information reasonably likely to change the earlier verification. For example, a newly provided canceled check showing payment may qualify.\n\nWritten disputes can be mailed, delivered, submitted using the validation notice's response form, or sent electronically through a communication method the collector accepts from consumers. Sending a message through an arbitrary or unaccepted channel does not necessarily satisfy the writing requirement.\n\nFailing to dispute a debt does not constitute a legal admission that you owe it. Conversely, disputing a debt does not automatically cancel it or make it unenforceable.\n\n**Federal sources:** 12 CFR §§ 1006.34(b)(5), 1006.38(a)(1), 1006.38(d)(1)–(2), and CFPB Supplement I official interpretations.\n\n## 3. Operative rule and official interpretation — pinpoint findings\n\n| Provision | Verified operative effect |\n| --- | --- |\n| § 1006.34(b)(5) | The validation period begins when required validation information is provided and ends 30 days after actual or assumed receipt. The collector's permitted assumed-receipt calculation accounts for at least five days excluding Saturdays, Sundays and specified federal holidays. |\n| § 1006.34(c)(3)(i) | The validation notice must disclose the right to dispute in writing by the stated validation-period end date and the resulting cease-until-response protection. |\n| § 1006.38(d)(2)(i) | The collector must pause collection until sending verification or a judgment copy in the prescribed manner. |\n| § 1006.38(a)(1) | A dispute qualifies as duplicative only when all definitional elements are met, including the absence of new and material information. |\n| Official interpretation 38(a)(1)-1–2 | Substantially identical wording is not required. New information is information not previously submitted; material information is reasonably likely to change the verification. The official interpretation gives a canceled check demonstrating payment as an example. |\n| § 1006.38(d)(2)(ii)(A) | A reasonably determined duplicative dispute may be addressed through a notice identifying the duplicative determination, briefly explaining why, and referring to the earlier response. |\n| Official interpretation 38(d)(2)(ii)-1 | Explains how a collector can satisfy the brief-reasons and earlier-response-reference requirements, including stating the prior response date. |\n| § 1006.38(d)(2)(ii)(B) | The collector may instead send verification or a judgment copy under (d)(2)(i). |\n| § 1006.38(d)(1) | Failure to dispute is not a legal admission of liability. |\n| Official interpretation 38-1 | Accepted electronic channels, including a collector's accepted email or portal, may satisfy writing; not every electronic message necessarily does. |\n\nAll provisions above were read directly from the opened CFPB and eCFR pages. Consumer Financial Protection Bureau+1\n\n## 4. Worked examples\n\nExample A — ordinary timely dispute. A collector provides validation information. During the validation period, the consumer mails a written dispute contesting a $2,400 medical bill. Assuming the collector is covered and the dispute is timely, collection of the disputed $2,400 must pause until the collector sends verification or a judgment copy as required.\n\nExample B — qualifying duplicative dispute. The consumer timely disputes the same $2,400 bill. The collector sends verification. Still within the validation period, the consumer repeats substantially the same dispute without new material information. The collector may reasonably classify it as duplicative and send the required notice, including reasons and a reference to its earlier response, rather than provide fresh verification.\n\nExample C — new material evidence. After the first verification, the consumer submits a previously unprovided canceled check demonstrating payment of $1,000. If reasonably likely to change the verification, this is new and material information. The collector cannot treat the dispute as duplicative merely because it challenges the same bill.\n\nThese examples do not determine whether the debt is valid, whether verification is substantively adequate, or whether a particular collector complied with delivery requirements.\n\n## 5. Coverage patch\n\n| Subtopic | Status | Claim/source IDs | Remaining hold |\n| --- | --- | --- | --- |\n| Timely written validation dispute | Answered — federal baseline | C026; S021, S048 | Collector coverage, actual dates, delivery evidence |\n| Cease-collection protection | Answered — federal baseline | C026; S048 | Disputed amount and compliance with response/delivery rules |\n| Duplicative-dispute exception | Answered — federal baseline | C026; S048 | Reasonableness of classification and earlier response |\n| New and material information | Answered — legal test | C026; S048 | Materiality and authenticity in individual cases |\n| Accepted electronic writing | Answered — federal baseline | C026; S048 | Whether collector accepted the specific communication channel |\n| Failure to dispute | Answered — federal baseline | C026; S048 | Separate validity, enforceability and defenses |\n| State collection and limitations law | Held — outside scope | C026; existing state assignments | Jurisdiction and case-specific facts |\n| Time-barred debt collection | Unchanged | C027; S022 | No new state-law survey; original coordinator check preserved |\n\n## 6.
